SECTION II: INTRODUCTION

Summary of Permit Activity Superior Industries International, Inc. owns and operates an OEM aluminum road wheel manufacturing facility located at 1901 Borick Drive in Fayetteville. The two main processes that occur in this facility are wheel casting and chrome plating. This permit modification is issued to permit a facility expansion. This modification will add #1 8000 lb melt furnace (SN-123a), #1 8000 lb melt furnace flux hood exhaust (SN-123b), Paint Room Boiler (SN-124), and Clear Coat Boiler - (Back Up) (SN-125), and delete #1 6000 lb Melt Furnace (SN-01), #1 6000 lb Melt Furnace Flux Hood Exhaust (SN-02), 4-Stage Power Washer Heater Tube Exhaust (SN-27 & SN-28), #5 4000 lb Melt Furnace (SN-09), #5 4000 lb Melt Furnace Flux Hood Exhaust (SN-10), #6 4000 lb Melt Furnace (SN-11) and #6 4000 lb Melt Furnace Flux Hood Exhaust (SN-12). Three mist collector exhausts (SN-85, SN-86, & SN-90) are also removed from the previous permit.

Process Description Casting Operation: Raw material (aluminum ingots) is melted in gas fired furnaces rated at 6,000-8,000 pounds of molten metal (SNs 03, 05, 07, and 123a). During melting operations, the molten metal receives flux by injection to control oxidation, etc., (SNs 04, 06, 08, and 123b). Chips are reclaimed from the machining operations and are also fluxed and added to the furnaces (SNs 13-15, and 59). Machining Operation: The center hole in the rim is cut during this operation. No air emissions are associated with this operation. Inspection: The wheel is inspected for casting defects during this operation. No air emissions are associated with this operation. Heat Treat Operation: The wheel is heat treated for improved mechanical properties in gas fired heat treat ovens (SNs 21-24b). After the wheels leave the oven, they are quenched in large temperature controlled tanks (SNs 25, 26). Wheel-a-brating Operation: This operation shot peens the wheel. No air emissions are currently associated with this

Painting: First, the wheel is cleaned in a power washer (SNs 27, 28, 66, and 67) and sent through a pretreatment process (SNs 29, 30). The wheels are then dried in an oven (SNs 32, 33) and painted (SNs 34, 35k, 64, and 65). The paint is then cured in an oven (SNs 36-38). Heat for the painting area is provided by a 10.0 MMbtu/hr boiler (SN-124). Machining Operation: All finished machining work is done on the wheel during this operation. The coolant used during this operation creates mist which is collected in mist collection units (SNs 83-94). Painting (Clear Coat): The wheel is cleaned in a power washer (SN-69) and pretreated in dip tanks. Some of the stages in the power washer and some of the dip tanks are heated by steam provided from a boiler (SNs 48 and 49). The wheel is then dried in an oven (SNs 46, 47). The wheel is then clear coated (SNs 114, 119) in clear coat touch booths. Heat for the clear coat area is provided by a 10.0 MMbtu/hr boiler (SN-125). Inspect and Package: The final operation performed on the wheel is inspection and packaging for shipment to the customer. The following are secondary operations used to support and/or make the processes used more economically efficient. Chip Recovery System: Chips from both machining operations are collected in a central chip recovery system (SNs 16-20). Mold Maintenance: The molds are cleaned in heated dip tanks (SNs 50, 62, and 63) prior to repairs being made.

Regulations This facility is subject to regulation under the Arkansas Air Pollution Control Code (Regulation 18), the regulations of the Arkansas Plan of Implementation for Air Pollution Control (Regulation 19), and the Regulations of the Arkansas Operating Air Permit Program (Regulation 26). Superior Industries International is subject to applicable provisions of 40 CFR 63, Subpart

Superior Industries International, Inc. Permit #: 1302-AOP-R5 CSN #: 72-0270 N, National Emission Standards for Chromium Emissions from Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks (Attachment A). The facility is not subject to regulation under 40 CFR 63, Subpart RRR - National Emission Standards for Secondary Aluminum Production because their melt furnaces are only charged with clean ingots and internally recycled scrap. The Natural Gas Fired Boiler (SN-56), Paint Room Boiler (SN-124) and the Clear Coat Boiler - Back Up (SN-125) are subject to regulation under 40 CFR 60 - Subpart Dc - Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units (Attachment B). The following table is a summary of emissions from the facility. Specific conditions and emissions for each source can be found starting on the page cross referenced in the table. This table, in itself, is not an enforceable condition of the permit.

SECTION III: PERMIT HISTORY Permit #1302-A was the first air permit issued to the facility on April 4, 1994. This permitting action allowed the melting of aluminum ingots and chips; fluxing of molten aluminum to remove impurities; casting cooling, machining, and painting to manufacture custom wheels. Permit #1302-AR-1 was issued to the facility on November 18, 1994. This permitting action incorporated seven (7) new sources of emissions. These sources came about with the construction of a plating plant to be used in conjunction with the previously (1302-A) permitted sources. Permit #1302-AOP-R0 was the first permit issued to this facility and established Superior Industries as a major source due to VOC and Hazardous Air Pollutant emissions. This permitting action incorporated the removal and addition of sources, including a bright polishing and ink stamping operation. Permit #1302-AOP-R1 was issued to the facility on January 23, 2001. It allowed the facility to construct and operate a 0.4 MMBTU/hr sludge dryer (SN-120) for increased drying capacity in the waste treatment operation. Permit #1302-AOP-R2 was issued on September 18, 2001. This modification allowed the facility to change the opacity limits for Source Numbers 02, 04, 06, 08, 10, 12-15, 83-94, 82, 109, and 116 in Specific Conditions 9, 23, and 43 from 20 percent opacity to 10 percent opacity. The corresponding opacity observation requirements have been changed from daily to weekly. Also, the following sources were removed from the permit Sprue Furnace (SN-61), Crucible Furnaces (SNs 117-118), and Chip Well Exhaust (SN-59). The following activity was reclassified as insignificant Wheel-a-brator Shot Blast (SNs 41-44). The facility also replaced the #2 4500 lb Melt Furnace, #2 4500 lb Furnace Flux Hood Exhaust, Chip Well Exhaust Stack, and Mold Cleaning Tank Heater Tube Exhausts at SNs 03, 04, 13, 50, 62, and 63. The permitted increase in emissions was less than 0.5 tpy for each affected pollutant. Permit #1302-AOP-R3 was issued February 21, 2002. This modification included the addition of a mechanical dust collector (SN-121) in the polishing operations, modification of the monitoring requirements of 40 CFR 60 Subpart Dc for natural gas usage for the natural gas fired boiler (SN-56), and the Ink Transfer Operation (formerly SN-111) was changed to an insignificant activity. The permitted increase in emissions was 22.4 tpy particulate matter. Permit No. 1302-AOP-R4 was issued to Superior Industries International on February 12, 2002. The modification was issued for the addition of the Mechanical Dust Collector (SN-122) to the Polishing Operations. This resulted in an increase of the emission limits for particulate matter by 8.2 tpy.

Natural Gas Fired Equipment

Source Description

Wheel Casting Plant: Initially during the casting operation, raw material (aluminum ingots and internally generated scrap) is melted in gas furnaces rated at 6,000 lbs of molten metal (SN-05, & SN-07) and rated at 8,000 lbs of molten metal (SN-03 & SN-123a). During the heat treat operation, the wheel is heat treated for improved mechanical properties in gas fired heat treat ovens (SN-21, SN-22, SN-23, SN-24a, SN-24b). After the wheels leave the oven, they are quenched in large temperature controlled tanks (SN-25, & SN-26). Prior to painting, the wheel is cleaned in a power washer (SN-66, SN-67) and sent through a pretreatment process (SN-29, & SN-30). The wheels are then dried in an oven (SN-32, & SN-33) and painted and then cured in an oven (SN-36, SN-37, SN-38). Some of the stages in the power washer and some of the dip tanks are heated by steam provided from a boiler (SN-48, & SN-49). The wheel is then dried in an oven (SN-46, & SN-47). In the chip recovery system, chips from both machining operations are collected in a central chip recovery system (SN-16, SN-17, SN-18, & SN-19). Metal from the first machining operation (cutting the center hole of the wheel) is collected and recovered and melted. During mold maintenance, the molds are cleaned in heated dip tanks (SN-50, SN-62, & SN-63) prior to repairs being made.

Chrome Plating Plant: Initially, wheels are cleaned in a power washer (SN-70) and aged in an overhead gas fired age oven (SN-31). After initial polishing, wheels are transferred to a dip tank and power washer which are heated by two boilers (SN-57, & SN-58). Wheels are then chrome plated, polished again, and transferred to the dip tank and power washer again. Finally, wheels are nickel/chrome plated, washed and dried off in a thermocycle oven (SN-75, & SN-76), painted and packaged. Waste Treatment: Waste generated during the plating operations is treated through a variety of chemical processes in order to precipitate out metals, adjust pH, etc. The final product from these chemical treatment operations is pressed in a filter press. This filter press Acake@ is then dried in a sludge dryer (SNs 81 and 120) to remove excess water prior to shipping off site for disposal.

Source Description

During the melting operations, the molten metal receives flux to control oxidation (SN-04, SN-06, SN-08, SN-123b). Chips are reclaimed from machining operations and are also fluxed and added to the furnaces (SN-13, SN-14, SN-15).

from SN-04, SN-06, SN-08, SN-13, SN-14, SN-15, SN-123b shall not, during fluxing, exceed 10% as measured by EPA reference method 9. Compliance with this condition shall be demonstrated through compliance with Specific Condition 12.

12. Pursuant to '19.705 of Regulation 19 and 40 CFR Part 52, Subpart E, on days of operation weekly observations of the opacity from SN-04, SN-06, SN-08, SN-13, SN-14, SN-15, SN-123b shall be conducted by personnel familiar with the permittee=s visible emissions. The permittee shall maintain personnel trained in EPA Reference Method 9. If visible emissions which appear to be in excess of the permitted opacity are detected, the permittee shall immediately take action to identify the cause of the visible emissions, implement corrective action, and document that visible emissions did not appear to be in excess of the permitted opacity following the corrective action. The permittee shall

19. Pursuant to '18.1004 of Regulation 18, and A.C.A. '8-4-203 as referenced by '8-4-304

and '8-4-311, the permittee shall maintain records which demonstrate compliance with the limits set forth in Specific Condition 17 and 18. These records may be used by the Department for enforcement purposes. The records shall be updated on a monthly basis, shall be kept on site, and shall be provided to Department personnel upon request. A consecutive twelve month total and each individual month=s data shall be submitted in accordance with General Provision 7.

26. Pursuant to '19.705 of Regulation 19 and 40 CFR Part 52, Subpart E, on days of

operation, weekly observations of the opacity from SN-83, SN-84, SN-87, SN-88, SN-89, SN-91, SN-92, SN-93, and SN-94 shall be conducted by personnel familiar with the permittee=s visible emissions. The permittee shall maintain personnel trained in EPA Reference Method 9. If visible emissions which appear to be in excess of the permitted opacity are detected, the permittee shall immediately take action to identify the cause of the visible emissions, implement corrective action, and document that visible emissions did not appear to be in excess of the permitted opacity following the corrective action. The permittee shall maintain records which contain the following items in order to demonstrate compliance with this specific condition. These records shall be updated weekly, kept on site, and made available to Department personnel upon request.

Source Description The wheels are plated in nickel and chrome baths (SN-112 and SN-113) and fumes from these processes are collected in four scrubbers (SN-52 through SN-55). These sources are subject to applicable provisions of 40 CFR Part 63 Subpart N, National Emission Standards for Chromium Emissions from Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks. Although SN-52 emissions are routed to a scrubber, the scrubber is not needed to comply with NESHAP requirements. Also, each source is vented through a scrubber except SN-112.

to, Specific Conditions 29 through 39. 29. Pursuant to 40 CFR Part 63.342(d)(2), the permittee shall not allow the surface tension of

the electroplating or anodizing bath contained within the affected source to exceed 45 dynes per centimeter (dynes/cm) (3.1 H 10-3 pound-force per foot [lbf / ft]) at any time during operation of the tank.

30. Pursuant to 40 CFR Part 63.342(f)(1)(i), the permittee shall, at all times, including

periods of shutdown, and malfunction, operate and maintain any affected source, including associated air pollution control devices and monitoring equipment, in a manner consistent with good air pollution control practices, consistent with the operation and maintenance plan required by paragraph (f)(3) of this section.

31. Pursuant to 40 CFR Part 63.342(f)(1)(ii), the permittee shall correct malfunctions as soon

as practicable after their occurrence in accordance with the operation and maintenance plan required by paragraph (f)(3) of this section.

32. Pursuant to 40 CFR Part 63.342(f)(2)(i), a determination of whether acceptable operation

and maintenance procedures are being used will be based on information available to the Administrator, which may include, but is not limited to, monitoring results; review of the operation and maintenance plan, procedures, and records; and inspection of the source.

33. Pursuant to 40 CFR Part 63.342(f)(2)(ii), the Administrator may require that the owner or

operator of an affected source make changes to the operation and maintenance plan required by paragraph (f)(3) of this section for that source. Revisions may be required if the Administrator finds that the plan:

a. Does not address a malfunction that has occurred;

b. Fails to provide for the operation of the affected source, the air pollution control

techniques, or the control system and process monitoring equipment during a malfunction in a manner consistent with good air pollution control practices; or

c. Does not provide adequate procedures for correcting malfunctioning process

equipment, air pollution control techniques, or monitoring equipment as quickly as practicable.

34. Pursuant to 40 CFR Part 63.342(f)(3), the permittee shall prepare an operation and

maintenance plan to be implemented no later than the compliance date. The plan shall include the following elements:

a. The plan shall specify the operation and maintenance criteria for the affected

source, and the process control system monitoring equipment, and shall include a standardized checklist to document the operation and maintenance of this equipment;

b. For sources using monitoring equipment to comply with this subpart, the plan

shall incorporate the work practice standards for that device or monitoring equipment, as identified in Table 1 of this section, if the specific equipment used is identified in Table 1 of this section;

c. If the specific equipment used is not identified in Table 1 of this section, the plan

shall incorporate proposed work practice standards. These proposed work practice standards shall be submitted to the Administrator for approval as part of the submittal required under '63.343(d);

d. The plan shall specify procedures to be followed to ensure that equipment or

process malfunctions due to poor maintenance or other preventable conditions do not occur; and

e. The plan shall include a systematic procedure for identifying malfunctions of

process equipment, and process and control system monitoring equipment and for implementing corrective actions to address such malfunctions.

1. If the operation and maintenance plan fails to address or inadequately

addresses an event that meets the characteristics of a malfunction at the time the plan is initially developed, the owner or operator shall revise the operation and maintenance plan within 45 days after such an event occurs. The revised plan shall include procedures for operating and maintaining the process equipment during similar malfunction events, and a program for corrective action for such events.

2. Recordkeeping associated with the operation and maintenance plan is

identified in '63.346(b). Reporting associated with the operation and maintenance plan is identified in '63.347 (g) and (h) and paragraph (f)(3)(iv) of this section.

3. If the actions taken by the owner or operator during periods of malfunction are inconsistent with the procedures specified in the operation and maintenance plan required by paragraph (f)(3)(i) of this section, the owner or operator shall record the actions taken for that event and shall report by phone such actions within 2 working days after commencing actions inconsistent with the plan. This report shall be followed by a letter

within 7 working days after the end of the event, unless the owner or operator makes alternative reporting arrangements, in advance, with the Administrator.

4. The owner or operator shall keep the written operation and maintenance

plan on record after it is developed to be made available for inspection, upon request, by the Administrator for the life of the affected source or until the source is no longer subject to the provisions of this subpart. In addition, if the owner or operator shall keep previous (i.e., superseded) versions of the operation and maintenance plan on record to be made available for inspection, upon request, by the Administrator for a period of 5 years after each revision to the plan.

5. To satisfy the requirements of paragraph (f)(3) of this section, the owner

or operator may use applicable standard operating procedure (SOP) manuals, Occupational Safety and Health Administration (OSHA) plans, or other existing plans, provided the alternative plans meet the requirements of this section.

35. Pursuant to 40 CFR Part 63.343(c)(5)(ii), the facility shall monitor the surface tension of

the electroplating or anodizing bath. Operation of the affected source at a surface tension greater than 45 dynes/cm shall constitute noncompliance with the standards. The surface tension shall be monitored according to the following schedule:

a. The surface tension shall be measured once every 4 hours during operation of the

tank with a stalagmometer or a tensiometer as specified in Method 306B, appendix A of this part.

b. The time between monitoring can be increased if there have been no exceedances.

The surface tension shall be measured once every 4 hours of tank operation for the first 40 hours of tank operation after the compliance date. Once there are no exceedances during 40 hours of tank operation, surface tension measurement may be conducted once every 8 hours of tank operation. Once there are no exceedances during 40 hours of tank operation, surface tension measurement may be conducted once every 40 hours of tank operation on an ongoing basis, until an exceedance occurs. The minimum frequency of monitoring allowed by this subpart is once every 40 hours of tank operation.

c. Once an exceedance occurs as indicated through surface tension monitoring, the original monitoring schedule of once every 4 hours must be resumed. A subsequent decrease in frequency shall follow the schedule laid out in paragraph

(c)(5)(ii)(B) of this section. For example, if an owner or operator had been monitoring an affected source once every 40 hours and an exceedance occurs, subsequent monitoring would take place once every 4 hours of tank operation. Once an exceedance does not occur for 40 hours of tank operation on this schedule, monitoring can occur once every 40 hours of tank operation.

36. Pursuant to 40 CFR Part 63.343 (c)(5)(iii), the facility shall ensure that once a bath

solution is drained from the affected tank and a new solution added, the original monitoring schedule of once every 4 hours must be resumed, with a decrease in monitoring frequency allowed following the procedures of paragraphs (c)(5)(ii) (B) and (C) of this section.

37. Pursuant to 40 CFR Part 63.346(b), the permittee shall maintain the following records for

each affected source: a. Inspection records for the monitoring equipment, to document that the inspection

and maintenance required by the work practice standards of '63.342(f) and Table 1 of '63.342 have taken place. The record can take the form of a checklist and should identify the device inspected, the date of inspection, a brief description of the working condition of the device during the inspection, and any actions taken to correct deficiencies found during the inspection.

b. Records of all maintenance performed on the affected source, and monitoring

equipment;

c. Records of the occurrence, duration, and cause (if known) of each malfunction of process, and monitoring equipment;

d. Records of actions taken during periods of malfunction when such actions are

inconsistent with the operation and maintenance plan;

e. Other records, which may take the form of checklists, necessary to demonstrate consistency with the provisions of the operation and maintenance plan required by '63.342(f)(3);

f. Test reports documenting results of all performance tests;

g. All measurements as may be necessary to determine the conditions of

performance tests, including measurements necessary to determine compliance with the special compliance procedures of '63.344(e);

k. The total process operating time of the affected source during the reporting

period;

p. All documentation supporting the notification and reports required by '63.9,

'63.10, and '63.347. 38. Pursuant to 40 CFR Part 63.346(c), the permittee shall maintain all records for a period

of 5 years in accordance with '63.10(b)(1). 39. Pursuant to 40 CFR Part 63.347(g)(3), the owner or operator of an affected source for

which compliance monitoring is required in accordance with '63.343(c) shall prepare a summary report to document the ongoing compliance status of the source. The report must contain the following information:

a. The name and address of the affected source;

b. An identification of the operating parameter that is monitored for compliance

determination, as required by '63.343(c);

Source Description SN-56 is a 12 MMBtu/hr boiler for their chiller system in the Plating Plant. It was constructed in 1994 and has not been modified or reconstructed since that time. SN-124 is a 10 MMBtu/hr boiler installed as a heat source in the Paint Room. It was constructed in 2002 and has not been modified since that time. SN-125 is a 10 MMBtu/hr boiler installed as a heat source in the Clear Coat area as a back up. It was constructed in 2002 and has not been modified since that time. These sources are subject to applicable regulations of 40 CFR Part 60 Subpart Dc - Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units.

Specific Conditions 45. Pursuant to '19.501 of the Regulations of the Arkansas State Implementation Plan for

Air Pollution Control (Regulation 19) and 40 CFR Part 52, Subpart E, the permittee shall not exceed the combined emission rates set forth in the following table for SN-56, SN-124, and SN-125. The pound per hour and ton per year pollutant emission rates are based on the maximum capacity of the equipment.

47. Pursuant to '18.501 of Regulation 18 and A.C.A. '8-4-203 as referenced by '8-4-304

and '8-4-311, the permittee shall not exceed 5% opacity at SN-56, SN-124, and SN-125 as measured by EPA Reference Method 9. Compliance with this condition is demonstrated by Specific Condition 48.

48. Pursuant to '19.705 of Regulation 19, A.C.A. '8-4-203 as referenced by '8-4-304 and

'8-4-311, and 40 CFR 70.6, the permittee shall burn only natural gas at SN-56, SN-124, and SN-125.

49. Pursuant to 40 CFR Part 60.48c(g), the permittee shall maintain records of the amounts

of fuel combusted each month at SN-56, SN-124, and SN-125.

NSPS Requirements 50. Pursuant to '19.304 of Regulation 19, and 40 CFR Part 60, Subpart Dc - Standards of

Performance for Small Industrial-Commercial-Institutional Steam Generating Unit, the Natural Gas Fired Boiler (SN-56), the Paint Room Boiler (SN-124), and Clear Coat Boiler (SN-125) are affected sources.

51. Pursuant to '19.304 of Regulation 19 and 40 CFR Part 60, the permittee shall comply with all applicable provisions of Subpart Dc - Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Unit. Applicable provisions include, but are not limited to, the following: '60.48c(g), which requires that records of the amount of fuel combusted for SN-56, SN-124, and SN-125 be maintained; and '60.48c(i), which requires that these records be maintained for at least two years. The permittee is allowed to compute the fuel usages for SN-56, SN-

124, and SN-125 based on an allocation program. The allocated fuel usage for SN-56 will be 24.7% of the facility fuel usage metered for the Plating meter (SNs 51, 56, 57, 58, 75, 76, 77 106, 107, and 108) until the Paint Room Boiler (SN-124) and the Clear Coat Boiler commence operation. When the Paint Room Boiler (SN-124) and the Clear Coat Boiler (SN-125) commence operation the allocations will be 17.5 % of the Plating meter for SN-56 and 14.6 % each for SN-124 and SN-125. This allocation is based upon current equipment at the facility which burns only pipeline-quality natural gas. The permittee shall update this allocation as needed to reflect the addition/deletion of equipment, and in accordance with the methodology submitted with this application. Any new equipment shall be subject to all applicable permitting requirements of Arkansas Regulation 18 and Arkansas Regulation 19. Compliance with this condition shall be demonstrated through Specific Condition 52.

52. Pursuant to '19.304 of Regulation 19 and 40 CFR Part 60, Subpart Dc - Standards

of Performance for Small Industrial-Commercial-Institutional Steam Generating Unit, the permittee shall maintain monthly records which demonstrate compliance with Specific Condition 51. Records shall be updated by the fifteenth day of the month following the month to which the records pertain. All records required by '60.48c shall be maintained by the permittee for a period of two years following the date of such records. These records shall be kept on site, and shall be made available to Department personnel upon request.

SECTION V: COMPLIANCE PLAN AND SCHEDULE Superior Industries International, Inc. is in compliance with the applicable regulations cited in the permit application. Superior Industries International, Inc. will continue to operate in compliance with those identified regulatory provisions. The facility will examine and analyze future regulations that may apply and determine their applicability with any necessary action taken on a timely basis.

SECTION VI: PLANTWIDE CONDITIONS 1. Pursuant to '19.704 of Regulation 19, 40 CFR Part 52, Subpart E, and A.C.A. '8-4-203

as referenced by '8-4-304 and '8-4-311, the Director shall be notified in writing within thirty (30) days after construction has commenced, construction is complete, the equipment and/or facility is first placed in operation, and the equipment and/or facility first reaches the target production rate.

2. Pursuant to '19.410(B) of Regulation 19, 40 CFR Part 52, Subpart E, the Director may

cancel all or part of this permit if the construction or modification authorized herein is not begun within 18 months from the date of the permit issuance or if the work involved in the construction or modification is suspended for a total of 18 months or more.

3. Pursuant to '19.702 of Regulation 19 and/or '18.1002 of Regulation 18 and A.C.A.

'8-4-203 as referenced by A.C.A. '8-4-304 and '8-4-311, any equipment that is to be tested, unless stated in the Specific Conditions of this permit or by any federally regulated requirements, shall be tested with the following time frames: (1) Equipment to be constructed or modified shall be tested within sixty (60) days of achieving the maximum production rate, but in no event later than 180 days after initial start-up of the permitted source or (2) equipment already operating shall be tested according to the time frames set forth by the Department or within 180 days of permit issuance if no date is specified. The permittee shall notify the Department of the scheduled date of compliance testing at least fifteen (15) days in advance of such test. Compliance test results shall be submitted to the Department within thirty (30) days after the completed testing.

4. Pursuant to '19.702 of Regulation 19 and/or '18.1002 of Regulation 18 and A.C.A.

'8-4-203 as referenced by A.C.A. '8-4-304 and '8-4-311, the permittee shall provide:

a. Sampling ports adequate for applicable test methods b. Safe sampling platforms c. Safe access to sampling platforms d. Utilities for sampling and testing equipment

5. Pursuant to '19.303 of Regulation 19 and A.C.A. '8-4-203 as referenced by A.C.A.

'8-4-304 and '8-4-311, the equipment, control apparatus and emission monitoring equipment shall be operated within their design limitations and maintained in good condition at all times.

this permit subsumes and incorporates all previously issued air permits for this facility. Title VI Provisions 7. The permittee shall comply with the standards for labeling of products using ozone

depleting substances pursuant to 40 CFR Part 82, Subpart E:

a. All containers containing a class I or class II substance stored or transported, all products containing a class I substance, and all products directly manufactured with a class I substance must bear the required warning statement if it is being introduced to interstate commerce pursuant to '82.106.

b. The placement of the required warning statement must comply with the requirements pursuant to '82.108.

c. The form of the label bearing the required warning must comply with the requirements pursuant to '82.110.

d. No person may modify, remove, or interfere with the required warning statement except as described in '82.112.

8. The permittee shall comply with the standards for recycling and emissions reduction

pursuant to 40 CFR Part 82, Subpart F, except as provided for MVACs in Subpart B:

a. Persons opening appliances for maintenance, service, repair, or disposal must comply with the required practices pursuant to '82.156.

b. Equipment used during the maintenance, service, repair, or disposal of appliances must comply with the standards for recycling and recovery equipment pursuant to '82.158.

c. Persons performing maintenance, service repair, or disposal of appliances must be certified by an approved technician certification program pursuant to '82.161.

d. Persons disposing of small appliances, MVACs, and MVAC-like appliances must comply with record keeping requirements pursuant to '82.166. (AMVAC-like appliance@ as defined at '82.152.)

e. Persons owning commercial or industrial process refrigeration equipment must comply with leak repair requirements pursuant to '82.156.

f. Owners/operators of appliances normally containing 50 or more pounds of refrigerant must keep records of refrigerant purchased and added to such appliances pursuant to '82.166.

9. If the permittee manufactures, transforms, destroys, imports, or exports a class I or class II substance, the permittee is subject to all requirements as specified in 40 CFR part 82, Subpart A, Production and Consumption Controls.

ozone-depleting substance refrigerant (or regulated substitute substance) in the motor vehicle air conditioner (MVAC), the permittee is subject to all the applicable requirements as specified in 40 CFR part 82, Subpart B, Servicing of Motor Vehicle Air Conditioners.

The term Amotor vehicle@ as used in Subpart B does not include a vehicle in which final assembly of the vehicle has not been completed. The term AMVAC@ as used in Subpart B does not include the air-tight sealed refrigeration system used as refrigerated cargo, or the system used on passenger buses using HCFC-22 refrigerant.

11. The permittee shall be allowed to switch from any ozone-depleting substance to any

alternative that is listed in the Significant New Alternatives Program (SNAP) promulgated pursuant to 40 CFR part 82, Subpart G, Significant New Alternatives Policy Program.

Superior Industries International, Inc. Permit #: 1302-AOP-R5 CSN #: 72-0270 SECTION VIII: GENERAL PROVISIONS 1. Pursuant to 40 CFR 70.6(b)(2), any terms or conditions included in this permit which

specify and reference Arkansas Pollution Control & Ecology Commission Regulation 18 or the Arkansas Water and Air Pollution Control Act (A.C.A. '8-4-101 et seq.) as the sole origin of and authority for the terms or conditions are not required under the Clean Air Act or any of its applicable requirements, and are not federally enforceable under the Clean Air Act. Arkansas Pollution Control & Ecology Commission Regulation 18 was adopted pursuant to the Arkansas Water and Air Pollution Control Act (A.C.A. '8-4-101 et seq.). Any terms or conditions included in this permit which specify and reference Arkansas Pollution Control & Ecology Commission Regulation 18 or the Arkansas Water and Air Pollution Control Act (A.C.A. '8-4-101 et seq.) as the origin of and authority for the terms or conditions are enforceable under this Arkansas statute.

2. Pursuant to 40 CFR 70.6(a)(2) and '26.701(B) of the Regulations of the Arkansas

Operating Air Permit Program (Regulation 26), effective August 10, 2000, this permit shall be valid for a period of five (5) years beginning on the date this permit becomes effective and ending five (5) years later.

3. Pursuant to '26.406 of Regulation #26, it is the duty of the permittee to submit a

complete application for permit renewal at least six (6) months prior to the date of permit expiration. Permit expiration terminates the permittee's right to operate unless a complete renewal application was submitted at least six (6) months prior to permit expiration, in which case the existing permit shall remain in effect until the Department takes final action on the renewal application. The Department will not necessarily notify the permittee when the permit renewal application is due.

4. Pursuant to 40 CFR 70.6(a)(1)(ii) and '26.701(A)(2) of Regulation #26, where an

applicable requirement of the Clean Air Act, as amended, 42 U.S.C. 7401, et seq (Act) is more stringent than an applicable requirement of regulations promulgated under Title IV of the Act, both provisions are incorporated into the permit and shall be enforceable by the Director or Administrator.

5. Pursuant to 40 CFR 70.6(a)(3)(ii)(A) and '26.701(C)(2) of Regulation #26, records of

monitoring information required by this permit shall include the following:

a. The date, place as defined in this permit, and time of sampling or measurements;

b. The date(s) analyses were performed;

c. The company or entity that performed the analyses;

d. The analytical techniques or methods used; e. The results of such analyses; and f. The operating conditions existing at the time of sampling or measurement.

6. Pursuant to 40 CFR 70.6(a)(3)(ii)(B) and '26.701(C)(2)(b) of Regulation #26, records of

all required monitoring data and support information shall be retained for a period of at least 5 years from the date of the monitoring sample, measurement, report, or application. Support information includes all calibration and maintenance records and all original strip-chart recordings for continuous monitoring instrumentation, and copies of all reports required by this permit.

7. Pursuant to 40 CFR 70.6(a)(3)(iii)(A) and '26.701(C)(3)(a) of Regulation #26, the

permittee shall submit reports of all required monitoring every 6 months. If no other reporting period has been established, the reporting period shall end on the last day of the anniversary month of this permit. The report shall be due within 30 days of the end of the reporting period. Even though the reports are due every six months, each report shall contain a full year of data. All instances of deviations from permit requirements must be clearly identified in such reports. All required reports must be certified by a responsible official as defined in '26.2 of Regulation #26 and must be sent to the address below.

8. Pursuant to 40 CFR 70.6(a)(3)(iii)(B), '26.701(C)(3)(b) of Regulation #26, and '19.601

and 19.602 of Regulation #19, all deviations from permit requirements, including those attributable to upset conditions as defined in the permit shall be reported to the Department. An initial report shall be made to the Department by the next business day after the discovery of the occurrence. The initial report may be made by telephone and shall include:

a. The facility name and location, b. The process unit or emission source which is deviating from the permit

limit, c. The permit limit, including the identification of pollutants, from which

deviation occurs, d. The date and time the deviation started, e. The duration of the deviation,

f. The average emissions during the deviation,

g. The probable cause of such deviations, h. Any corrective actions or preventive measures taken or being taken to

prevent such deviations in the future, and i. The name of the person submitting the report.

A full report shall be made in writing to the Department within five (5) business days of discovery of the occurrence and shall include, in addition to the information required by initial report, a schedule of actions to be taken to eliminate future occurrences and/or to minimize the amount by which the permits limits are exceeded and to reduce the length of time for which said limits are exceeded. If the permittee wishes, they may submit a full report in writing (by facsimile, overnight courier, or other means) by the next business day after discovery of the occurrence and such report will serve as both the initial report and full report.

9. Pursuant to 40 CFR 70.6(a)(5) and '26.701(E) of Regulation #26, and A.C.A.'8-4-203,

as referenced by '8-4-304 and '8-4-311, if any provision of the permit or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications hereof which can be given effect without the invalid provision or application, and to this end, provisions of this Regulation are declared to be separable and severable.

10. Pursuant to 40 CFR 70.6(a)(6)(i) and '26.701(F)(1) of Regulation #26, the permittee

must comply with all conditions of this Part 70 permit. Any permit noncompliance with applicable requirements as defined in Regulation #26 constitutes a violation of the Clean Air Act, as amended, 42 U.S.C. 7401, et seq. and is grounds for enforcement action; for permit termination, revocation and reissuance, or modification; or for denial of a permit renewal application. Any permit noncompliance with a state requirement constitutes a violation of the Arkansas Water and Air Pollution Control Act (A.C.A. '8-4-101 et seq.) and is also grounds for enforcement action; for permit termination, revocation and reissuance, or modification; or for denial of a permit renewal application.

11. Pursuant to 40 CFR 70.6(a)(6)(ii) and '26.701(F)(2) of Regulation #26, it shall not be a

defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the conditions of this permit.

12. Pursuant to 40 CFR 70.6(a)(6)(iii) and '26.701(F)(3) of Regulation #26, this permit may be modified, revoked, reopened, and reissued, or terminated for cause. The filing of a request by the permittee for a permit modification, revocation and reissuance, or termination, or of a notification of planned changes or anticipated noncompliance does not stay any permit condition.

Superior Industries International, Inc. Permit #: 1302-AOP-R5 CSN #: 72-0270 13. Pursuant to 40 CFR 70.6(a)(6)(iv) and '26.701(F)(4) of Regulation #26, this permit does

not convey any property rights of any sort, or any exclusive privilege. 14. Pursuant to 40 CFR 70.6(a)(6)(v) and '26.701(F)(5) of Regulation #26, the permittee

shall furnish to the Director, within the time specified by the Director, any information that the Director may request in writing to determine whether cause exists for modifying, revoking and reissuing, or terminating the permit or to determine compliance with the permit. Upon request, the permittee shall also furnish to the Director copies of records required to be kept by the permit. For information claimed to be confidential, the permittee may be required to furnish such records directly to the Administrator along with a claim of confidentiality.

15. Pursuant to 40 CFR 70.6(a)(7) and '26.701(G) of Regulation #26, the permittee shall pay

all permit fees in accordance with the procedures established in Regulation #9. 16. Pursuant to 40 CFR 70.6(a)(8) and '26.701(H) of Regulation #26, no permit revision

shall be required, under any approved economic incentives, marketable permits, emissions trading and other similar programs or processes for changes that are provided for elsewhere in this permit.

17. Pursuant to 40 CFR 70.6(a)(9)(i) and '26.701(I)(1) of Regulation #26, if the permittee is

allowed to operate under different operating scenarios, the permittee shall, contemporaneously with making a change from one operating scenario to another, record in a log at the permitted facility a record of the scenario under which the facility or source is operating.

18. Pursuant to 40 CFR 70.6(b) and '26.702(A) and (B) of Regulation #26, all terms and

conditions in this permit, including any provisions designed to limit a source's potential to emit, are enforceable by the Administrator and citizens under the Act unless the Department has specifically designated as not being federally enforceable under the Act any terms and conditions included in the permit that are not required under the Act or under any of its applicable requirements.

19. Pursuant to 40 CFR 70.6(c)(1) and '26.703(A) of Regulation #26, any document

(including reports) required by this permit shall contain a certification by a responsible official as defined in '26.2 of Regulation #26.

20. Pursuant to 40 CFR 70.6(c)(2) and '26.703(B) of Regulation #26, the permittee shall

allow an authorized representative of the Department, upon presentation of credentials, to perform the following:

a. Enter upon the permittee's premises where the permitted source is located or emissions-related activity is conducted, or where records must be kept under the conditions of this permit;

b. Have access to and copy, at reasonable times, any records that must be kept under the conditions of this permit;

c. Inspect, at reasonable times, any facilities, equipment (including monitoring and air pollution control equipment), practices, or operations regulated or required under this permit; and

d. As authorized by the Act, sample or monitor, at reasonable times, substances or parameters for the purpose of assuring compliance with this permit or applicable requirements.

21. Pursuant to 40 CFR 70.6(c)(5) and '26.703(E)(3) of Regulation #26, the permittee shall

submit a compliance certification with terms and conditions contained in the permit, including emission limitations, standards, or work practices. This compliance certification shall be submitted annually and shall be submitted to the Administrator as well as to the Department. All compliance certifications required by this permit shall include the following:

a. The identification of each term or condition of the permit that is the basis

of the certification; b. The compliance status; c. Whether compliance was continuous or intermittent; d. The method(s) used for determining the compliance status of the source,

currently and over the reporting period established by the monitoring requirements of this permit; and

e. Such other facts as the Department may require elsewhere in this permit or by '114(a)(3) and 504(b) of the Act.

22. Pursuant to '26.704(C) of Regulation #26, nothing in this permit shall alter or affect the

following:

a. The provisions of Section 303 of the Act (emergency orders), including the authority of the Administrator under that section;

b. The liability of the permittee for any violation of applicable requirements prior to or at the time of permit issuance;
