ADMINISTRATIVE REGULATIONS PERTAINING TO FACULTY

Teacher's School DayAll teachers need to be in their assigned stations by 7:45 a.m. Teaching begins at 7:50. Teachers are to be in their classroom until 3:10 p.m.

Faculty AttendanceAttendance on all teachers and all school employees is kept in the main office. Each teacher should keep a thorough record of all days absent from school. This is valuable to provide a check against the office record at the end of the year. The office will provide applications for personal days. Such requests should be made as early as possible and no later than noon prior to the day, except in emergency cases. The Superintendent and Principal must sign these requests.

Attendance DutiesTeachers must take attendance and report to the office any student who has three illegal absences or tardy notices. Teachers must take period-by-period attendance every period that they are assigned students.

It is extremely important that we keep accurate attendance records and that they are reported accurately to the State Education Department to ensure adequate funding for our school district. Please be sure to take accurate attendance at the start of each day and each class period. If a student is absent from your class and is not on the attendance report or if you notice any errors on the attendance report, immediately call the guidance office. (see attendance – Student Handbook)

Faculty MeetingsFaculty meetings after school are called at the discretion of the Administration. Requests to miss a faculty meeting should be made well in advance of the meeting to the Administration. Teachers will be given ample notice of faculty meetings and the meeting will be as brief as possible.

Substitute Teachers and PlansWhen your absence from school is necessary, please contact Carol Graham as soon as possible. If possible, contact her the evening before your absence. If you must call in the morning, do so before 6:30 AM, so she will have ample time to contact a substitute. Please do not call before 5:30 AM or after 9:00 PM. If any emergency occurs at any other time, please phone the secondary principal at his home.

Please provide the following for your substitute: Completed substitute folder, plan book with adequate plans, seating chart for homeroom and other classes, special instructions for special classes, daily schedule, including supervisory duties and special, identification of children with physical, emotional or mental problems, copy of the school regulations, needed routine forms, directions for fire drill, evacuation school bus, disciplinary action, etc.

The expectation of the administration is that plan books will be kept current and a copy of lesson plans and appropriate classroom materials will be placed in the teacher’s folder in the teacher workroom on the Friday preceding each week.

Injuries to School PersonnelReport personal injury immediately to the school nurse, or if the nurse is unavailable, report the injury to an administrator. Report all accidents, even minor ones, so those injured are protected. Report all injuries sustained while doing school work-off school property (i.e. while you are traveling to and from school).

Accidents or Illness of StudentsAll accidents or illness of students must be reported to the school nurse, or if she is unavailable, to the administration. The parents and family physicians must be contacted if the condition is serious. If a student has to be sent home, transportation will be provided. Never allow an injured or ill student to walk home alone. The parents must be contacted before the student is taken home. Make sure someone will be at the home to receive the student

Student InsuranceThe district provides individual non-duplicating accident insurance coverage for all students. This covers students from the time they leave home in the morning, until they return home after school and while at any school activity in which they may be participants. A report of all student accidents or injuries must be made to the school nurse as soon as possible. This will protect the student, family member, and the school district.

Teacher Discipline - ResponsibilityEach teacher is responsible for the proper behavior of the students in his/her classes. Teachers are also expected to monitor behavior in all areas where students are present on school grounds. Proper behavior occurs when students are in a learning situation and not distracting each other. A teacher's right to restrain and correct students in attendance at school is recognized under the law as being the same as that of a parent or guardian (in loco parentis). The teacher may use reasonable and moderate discipline. Removal of a student from class to permitted in conjunction with the regulations of the S.A.V.E. legislation.

SAVE Act: Disruptive Pupil

A disruptive pupil is “an elementary or secondary student...who is substantially disruptive of the educational process or substantially interferes with the teacher’s authority over the classroom.”1 Before a teacher can remove a disruptive student from the classroom, he or she must comply with certain due process requirements. A teacher must inform the student and principal of the reasons for the removal. If the student is not posing a continuing danger to people or property and does not present an ongoing threat of disruption to the academic process, the teacher should give the student notice prior to the removal and the student should be given the opportunity to present his or her version of events. In all other cases, the teacher must give the student notice and an opportunity to be heard within 24 hours of the removal.2

The principal must inform the student’s guardian of the removal and the reasons for it within 24 hours. On request, the student and student’s guardian shall be given an informal conference to discuss the removal, which shall be held within 48 hours after it has occurred.3 Subsequently, the principal must make a final determination by the close of business on the day succeeding the 48-hour period to either uphold or set aside the removal.

A removed student will not return to the classroom until either the principal makes a final determination that the student should return or the removal period expires, whichever happens first. The principal will not set aside the discipline imposed by the teacher unless the principal finds that the charges are not supported by substantial evidence, that the removal violates the law, or that the behavior warrants a suspension instead.4

The law does not require a maximum removal period, but if a removal exceeds five days, a district is required to hold a superintendent’s hearing.5 A district might decide that its code will state a maximum removal period for disruptive students, and that the removal period in any given case should be proportionate to the student’s behavior.

The SAVE legislation mandates that school districts provide continued educational programming and activities for students removed from the classroom, placed in detention, or suspended from school.6 The legislation does not specify whether or how the educational programming for these students should differ from that normally received in the classroom. Supervision of StudentsStudents must be under supervision of a designated employee of the school at ALL times that the student is under the jurisdiction of the school, this includes all extracurricular events and practices. Employees must NOT leave any student or groups of students unattended. In the event of an emergency, which requires a teacher to be absent from his/her assignment, another faculty member must be asked to maintain the class. Coaches and advisors must remain on premises until all students have left and the building is secure.

A teacher has the duty to maintain order and proper student decorum in the areas to which he/she is assigned.

Extracurricular ResponsibilitiesAll moneymaking events are to be coordinated through the principal or athletic director. The advisor/coach must attend all meetings and scheduled events for the group or team. Each advisory and extracurricular position comes with its own set of responsibilities. Faculty performing these jobs should get a job description or consult the administration for guidelines prior to signing up for a job.

Supervision Guidelines (Sporting/Extracurricular Events)1. Supervisors should arrive 30 minutes prior to the scheduled starting time and

remain until the building is clear of spectators.

2. Supervisors are expected to wear ID tags.

3. Supervisors are expected to enforce the eligibility/deficiency list. Any student appearing on that list is not permitted to attend extracurricular events. Please check with Pam Fisher at the end of the day to get the most up to date list.

4. Unless there are extenuating circumstances, those leaving the building cannot re-enter. They should be reminded of that as they leave.

5. Supervisors should remain visible in the gym at the entrance unless dealing with another issue. Please try and keep the floor clear of water, snow, or other debris.

6. There is no smoking permitted on all school grounds. (Parking Lots included)

7. Anyone needing to cross from the spectator side of the gymnasium to the player side should wait for a time out or quarter break, unless it is an emergency. (This includes managers and cheerleaders)

8. Spectators should be kept off from the playing court before games, between games, and at half time. At no time before the game, at half time, or after games are spectators allowed shooting practice. (Only members of the varsity teams are allowed to shoot during the half time of the JV game. No one should be on the court during half time of the varsity game.)

9. Spectators should generally remain seated during contests, though standing in support of and in recognition of outstanding play is fine. No standing on upper bleachers is permitted. Absolutely no kicking of the bleachers is allowed.

10. If a spectator needs to exit or enter the gymnasium to use the restroom or purchase concessions, please ask them to wait for a break in action to do so.

11. Spectators are there in support of their team. Singling out opposing players or coaches will not be permitted and should be specifically addressed as needed. (If help is required see game chairman, athletic director, or principal)

12. Food and drink are not allowed in the gym. (Please point out trash cans to spectators and remind them to be careful not to make a mess.)

13. Spectators are to remain in the immediate gym area and are not free to roam the building.

14. Be reminded that your priority is to maintain a safe environment for players, coaches, officials and spectators. Ensure that the building and grounds are not damaged and it as a high priority to promote sportsmanship from all spectators. You have the authority to confront students and adults in regards to safety and sportsmanship as well as direct either group to leave the premises.

DancesDances must be sponsored by a school-certified organization. Such events must be approved by the administration and properly chaperoned. School dances are primarily for students in regular attendance at Sherman Central School. Anyone over 20 years of age may not attend any Sherman dance. The principal must approve all dances organized for middle and high school students at least two weeks in advance.1. Once students have entered the building, they must remain at the dance. Other parts

of the building are off limits. If students leave the dance, he/she will not be permitted to re-enter. There will be no loitering outside the building. Doors will close 20 minutes after the dance begins.

2. Consumption or use of drugs or alcohol and smoking, including e-cigarettes, are subject to the same rules and procedures in force during the normal school day.

3. If a chaperone detects the consumption of alcoholic beverages or illicit drugs on any student, the student shall not be admitted to the function and shall be required to leave the school property immediately. Parents will be contacted and proper arrangements made for the safe transportation of the student to the home. In most instances the parents should pick up the student at school. The incident will be reported to the principal in writing the next school day after the function.

4. Guest lists will be established by the principal and turned in by noon the day of the dance. Guests and sponsors must enter the dance together. If there is a problem at the dance, both will be asked to leave. A student is responsible for the guest's conduct. A guest must follow the same rules as regular students. Proper, safe transportation must be arranged. Parent/s guardians must be called.

5. The class advisor will provide the head chaperone with the student committees to sell tickets, handle refreshments and cleanup.

6. The head chaperone will be in charge of the dance. In the absence of the principal, all decisions will be made through the head chaperone. He/she will meet with all chaperones prior to the start of the dance and assign appropriate duties.

7. All bands or disc jockeys must be approved and contracted by the principal.8. The sponsoring group reserves the right to refuse attendance to anyone who may be

in violation of school rules. All school regulations are in force at all dances.9. Permission for some special request should always be obtained from the head

chaperone at the dance.10. Students who are absent from school will not be admitted to a dance if held on the

same day of the absence.

Extra Curricular Field Trips All extra-curricular trips should be designed to expand the student's frame of reference with respect to intellectual growth, cooperation, working with others, social growth, etc. In designing a trip (i.e. sports, conferences, field trips), a teacher should relate to the student why they are going on the trip, what they are expected to learn, how they are expected to act and how they are going to be evaluated after the trip is over. Trips should be planned with some outcome in mind. Trips should not be a frivolous adventure; requests and plans for each are to be made at least two weeks in advance. Remember that students have other classes and activities in which they are involved so trips should be planned so that a minimum amount of time will be spent out of classes.

In order to facilitate the process, please adhere to the following procedures:

Procedure 1. Fill out transportation request completely at least two (2) weeks prior to

your trip.a. Be precise on dates, times (leaving and returning), destination.b. If you are not going to return to SCS before 2:30 PM, notify bus

supervisor and students so students will be able to ride the late bus. (Be sure to check in the office as the departure time of the late bus).

2. Provide a roster of all students who will be on the trip to the principal. A memo to the staff approved by the principal must be accomplished.

3. Collect parental permission slips from student. Keep all slips on file until the end of the school year.

4. Take attendance of all students on bus.5. Notify the guidance office of absentees or changes to the roster before

leaving on the trip.6. Get list from the nurse of students who have special problems (i.e. illness,

allergies, etc...)7. Notify the cafeteria at least one day in advance if your group will miss

lunch.

8. All students going on a field trip must have the appropriate medical paperwork filled out and the teacher must take that paperwork on the trip. After the trip the paperwork along with copies of all permission slips need to be turned into the main office and placed on file.

9. Provide the school nurse with a roster of all students attending the field trip at least one (1) week in advance. This allows the nurse to check the list for any students with special needs and to provide you with an appropriate plan for covering those needs.

Special Use of BusesA building and transportation permit must be filled out in quadruplicate and presented to your supervisor as a request for any use of a bus or vehicle other than those regularly scheduled. If such permission is granted, one copy will be sent to the transportation supervisor as notification to have a vehicle and driver prepared, one copy will be returned to you for your records and two copies will be retained in the offices.

At least one school staff member must chaperone each bus that is used for any purpose other than regular daily transportation. Students are expected to follow the general rules set up for bus conduct and procedure. When students attend a function by bus they must return in the same manner unless they have a note from their parents indicating otherwise.

Secondary Field TripsStudent field trips and arrangements must be approved by the principal. No non-student may ride a bus without prior permission of the administration. Any over-night or out-of-state field trips must be approved by the board of education; therefore, timely submission of requests is necessary (2 months minimum). All students must have a signed permission slip to go on a field trip. Forms are available in the principal's office. As a general rule of thumb out of professional respect teachers should refrain from scheduling field trips during the month of June to allow for adequate end of the year test preparation and review.

Elementary Field Trips The trip travel time should not exceed 1-1/2 hours one-way (special cases may be approved). A 1:10 adult-student ratio is recommended.

Requests for field trips should be made to the principal at least two (2) weeks prior to the trip. A list of objectives and a statement of how the field trip relates to the subject area should accompany the request.

Staff members and chaperones will not be permitted to take their own children on curriculum related field trips. Parent permission forms are the responsibility of the teacher and must be signed by the parent or guardian prior to the trip.

Release of School Children

The following policies are in effect:1. Children who ride a school bus to school in the morning must ride home

on that bus, unless the parent calls and requests differently. Bona fide notes from parents permitting their children to go home on the bus with another student may be honored through the principal's office. The child who is expecting the visitor must also have a note stating he/she has permission to have this other child ride home with them. A bus pass is then issued for the elementary student.

2. If children walk to school in the morning with parent approval, they have refused to use the district equipment provided and the district assumes no responsibility for their welfare until they reach the school. If these children walk home, the district assumes the parents do not want to use the transportation provided.

3. Riding bicycles to school comes under the same consideration. However, at no time shall bicycling be permitting on school premises during school hours.

4. No child should be sent off the school premises by a teacher unless the office has written permission from a parent.

5. No child should be permitted to leave school premises without a bona fide request from the parent or guardian and this request should carry some urgency for the permission to be granted.

6. Students who misuse the privilege of using the school parking lot will be dealt with accordingly. All student drivers must register their vehicles in the principal's office.

Transportation to and from Out-of-Town EventsAll students will use district transportation to out of town events. Exceptions are made only by the district's receiving two notes, one from the parent/guardian that outlines alternative transportation and gives permission for the student to use the alternative and the other from the person providing the alternative transportation.

Honors, Awards, ScholarshipsIt is the policy of the Board of Education to allow individual students to accept any honors, awards or scholarships, which they may earn, provided they meet the approval of the administration.

Breakfast Program:Sherman Central School is providing a breakfast program for all students grade preK-12. The program is based on the belief that a nutritious start to the day will help students be more productive learners.

Breakfast will start being served at 7:35 am for all students. Homeroom will begin promptly at 7:50 am. Students not participating in the breakfast program are to report to their homerooms by 7:50 am. No student should be at breakfast after 7:50 am without a pass from a teacher. Teachers need to closely monitor the duration students are at breakfast. Breakfast is not a legal excuse to be tardy to homeroom.

PassesIn the Middle-Senior High school no student shall be in any part of the school, other than his assigned class or study hall, during school hours, without a pass indicating where he/she is going, the time, and the teacher's name giving permission to leave the room.

Study Hall Regulations/PassesAll students are to be quiet, orderly and busy while in a study hall. No student is to talk or move from his seat unless granted permission. Students are to bring books and materials with them when they enter the room. The person in charge must give lavatory permission. A special pass should be used for this purpose. An atmosphere of studiousness should prevail at all times. Students should start working at the beginning of the period and work until the period ends.

If a teacher desires to have a student excused from a study hall, he/she should furnish that student with a written note to be presented before a study hall begins. The student will then be excused after the roll has been taken. No student should be excused without this written pass. Students may be excused with a proper pass to go to the library during the study hall. They may request such permission after roll has been taken. They must have a pass, signed by the librarian, and indicating return time, to re-enter the study hall after he has left it.

Special EducationThe mission of the Sherman Central School is for students to be nurtured and directed to be life-long learners and contributing citizens of a continually evolving world. For students who require special services, the goal is to provide these services and supports in the most inclusive and least restrictive environment appropriate for each student.

Referral ProcessI. Pre-referralBefore a child is referred for special education, every effort should be made to ensure that all strategies and accommodations available to him in the typical classroom are being utilized. If the teacher sees no progress they should refer the student to the Child Study Team. Child Study Team referral forms are available in the Special Education Office and the Main Office. Once the referral has been completed the teachers will discuss the student at Child Study to gather new ideas and/or share insights on and strategies for working with students. The Child Study Team should consist of:

II. Parent ReferralParents with concerns regarding their child’s progress are encouraged to contact the classroom teacher to discuss their concerns. Requests for formal evaluations, when necessary, should be in written form and sent to the Special Education Office.

TRANSPORTATION

General ProceduresThe driver of each bus has the responsibility to assure that all rules of safety and conduct and obeyed on the bus at all times.

Teachers in preK-6 shall assume responsibility for getting their students to their respective buses in the afternoon.

All students who are brought to school on the bus must be taken home on the same bus, unless they have a parental permission slip to do otherwise. Permission to ride a different bus or to get off at a different stop must also be by parental permission, in writing, and approved by the supervising principal.

EMERGENCY PROCEDURES

Fire DrillsIt is required by law that twelve (12) fire drills shall be carried out each year while school is in session. Each teacher will be furnished with specific instructions as to the specific procedures to follow in the execution of these drills.

The fire drill alert is the steady ringing of the fire buzzers. Each classroom teacher must make sure that all students leave the building. Check lavatories to make sure that no students are there. The classroom door and windows should be closed after all students have left the room. Return to the building will be signaled by an announcement. No one will re-enter the building before this signal is given.

In the event of any other situation where the building must be emptied, notice will be given over the intercom with the words "The Building is to be Evacuated.” Students in PreK-6 will proceed immediately to the Baptist Church accompanied by their teachers. Students in grades 7-12 will proceed to the Community Church. Grades 7, 8 & 9 will use the basement, grades 10, 11 & 12 will use the church sanctuary. Do not take time for coats or boots. Teachers are to remain with their classes and keep them together. Take your attendance roster with you and take attendance when you arrive at the designated church. All other teachers not having classes at the time of evacuation will proceed to the churches to help keep order. No personnel are to remain in the building. Should a decision be made to send students home, the busses will line up on Church Street for loading.

Lock Down ProceduresWhen a Lock Down is announced:1. Staff shall immediately detain students already in classrooms, then summon

students located outside into the nearest room. Lock the door(s) and windows, pull the shades, and cover the window on the door.

2. The custodians will lock all outside doors.3. All staff who are not directly supervising students at the time, report to the nearest

classroom.4. If the incident involves possible discharge of a weapon, staff and students may

need to duck or seek cover.a. If evacuation of a building is necessary, teachers are required to bring their

grade books and take attendance. Follow evacuation drill procedures.b. Until the "all clear" signal is given, it is imperative that teachers keep students

inside their room and as calm as possible and wait for additional instructions.c. At the end of the school day, a staff meeting will be held to give a

summary/explanation of the incident and to reduce anxiety and alleviate rumors.

5. Have your class list available and make sure to take attendance, making note of any missing or extra students. Report this to the office when they call you. Do not call the office.

Disaster PlanSherman Central School is a K-12 building with approximately 500 students. The district Emergency Disaster Plan will be one and the same as the Building Evacuation Plan.

I. Building Evacuation1) A building evacuation is called when failure to evacuate poses a danger to

the children and staff. Such an emergency could include: fire evacuation during inclement weather, technical or mechanical failure of heating or plumbing, smoke fumes, threat of natural disaster and bomb threats.

2) In the event such a building evacuation is called (by the principal), students from the Sherman Central School would be evacuated to the Baptist Church. Grades Pre-K through 6 will be in the basement and grades 7-12 will use the church sanctuary.

The following procedures will be followed:a. At the appropriate signal or announcement, teachers and staff lead

the students out of the building and move to the respective churches in a quiet, orderly fashion. During the movement (or prior to), the respective church officials will be notified. Regular fire exit routes will be used for these emergencies.

b. Under certain circumstances (inclement weather) and where there is no immediate danger, elementary students will remain in their classrooms. Junior-Senior High students will be directed to their 1st period classes before evacuation. This will allow time to obtain coats, jackets, etc. before leaving. At this time, attendance will be taken and any missing students will be reported to the office.

c. If there is not time to return to the1st period classroom, the teacher/staff member with the children at the time of the evacuation notice is responsible for the students.

The proper agencies will be notified by the office: fire department, police, radio stations for early dismissal, etc...

d. Teachers must bring their class roster with them. This is imperative when we take attendance after the evacuation.

e. The school nurse is responsible for bringing all medications entrusted to her.

f. The office secretaries will bring the class lists and the census on which are the names, addresses and phone numbers of all the school children.

II) Procedures at Evacuation Sites

Evacuation Format: Please follow fire-drill procedures (sweep room, turn off lights, and shut door

then take attendance immediately once outside. Once we have justified the attendance the signal to evacuate the area will be

given. Students will remain with their instructor (classroom) for the walk to the

sheltering site through dismissal.

All Elementary students and staff:

Travel straight out of the parking lot across Miller St. Travel down Miller St. and take a right on Park St. staying on the right hand side of the road. (Teachers please make sure younger students keep up) Students and faculty then cross at the four corners and proceed to the rear of Baptist Church and enter the basement.

Grades 5 and 6 should be towards the rear of the room with the youngest kids up front closest to the exit.

Teachers take attendance again and make note of how each student is getting home

All Secondary students and staff:

Exit building and follow Park St. on right hand side of street until Miller St. (Teachers, please stay with your class)

At Miller St., cross Park St. and use the far sidewalk, crossing Church Street directly in front of the Baptist Church.

Students will enter the church through the front doors and proceed towards the front filling in the seats completely from front to back. (If all the students can not fit the extras will sit in the side room with their class)

Teachers take attendance again and make note of how each student is getting home

Key points: Move in an orderly fashion. Teachers who do not have a class please assist with crossing the streets

and then find an administrator at the church. Remain silent and listen for instructions. Take attendance twice (at shelter site and report information to Command

Center in church foyer.) Once settled in the church, document on attendance sheet how students

will be getting home. Assist students boarding buses and preparing to walk from shelter. Remain on site until all students have been dismissed.

The principal will notify the transportation supervisor of the evacuation of school. If early dismissal is warranted, the following procedures will be follows:

a. Call and notify his drivers of the need to transport students homeb. As drivers report, the buses will be set up in their regular order at

the regular loading areac. The transportation supervisor will notify the principal and then an

announcement will be made to load the buses.If there is an immediate danger to the students and staff, the building will be evacuated immediately and the following procedures will be followed:

a. Bus supervisor will call and notify each driver of the evacuationb. As drivers report, buses will be taken to Church Street c. The supervisor will notify the principal when the bus arrives d. The principal will announce to each student body what buses are

ready to load. The elementary will load first.

Students will report to their assigned classes at the beginning of the period when the assembly is scheduled. The teacher will take roll and then escort the students to the auditorium or gym. SEXUAL HARASSMENT

Personnel & ProcedureMr. Shawn McKane is the sexual harassment compliance officer and is responsible for coordinating federal regulations concerning sexual harassment.

An employee who believes that he/she has been subjected to sexual harassment is to report such conduct to the designated compliance officer. If the compliance officer is the alleged offender, the report shall be made to the next level of supervisory authority. Allegations of sexual harassment may be reported through informal and/or formal complaint procedures.

Confidentiality of all reports of sexual harassment will be maintained. Subject to all applicable laws and collective bargaining agreements, the following guidelines shall be utilized in the investigation and resolution of sexual harassment complaints.

Step 1 - Informal ComplaintsAn employee who believes that he/she has been subjected to sexual harassment may file an informal complaint by requesting a meeting between him/herself and the compliance officer in order to discuss the allegations and appropriate actions, if any. The compliance officer will next discuss the complaint with the alleged offender. The compliance officer is to prepare a written report of the incident, detailing any corrective action being taken and/or resolution of the complaint, submit one copy of this report to the complainant for his/her information, and file one copy with the Superintendent. If the complainant shall so indicate in writing and the matter shall be deemed closed. If the complainant is not satisfied with the compliance officer's response, the complainant may proceed to file a formal complaint. The Superintendent shall be kept informed of the complaint's response and course of action, if any.

Step 2 - Formal ComplaintAn employee may file a formal written complaint of sexual harassment as an initial step or as a result of an unsatisfactory resolution of an informal complaint. The formal complaint shall include:

a. The name, address and phone number of the complainant;b. The name of the alleged offender;c. The specific nature of the harassment and corresponding dates; andd. The names of any and all witnesses.

The formal complaint will be filed with the compliance officer who will submit a copy of the complaint to the Superintendent of Schools. The compliance officer will, in accordance with the applicable federal guidelines and regulations, conduct a prompt and thorough investigation, issue a written report of the results of the investigation, and notify the complainant in writing of the outcome.

Step 3 - Corrective Action/ResolutionThe compliance officer will inform the Superintendent of the outcome of the his/her investigation. If the Superintendent of Schools issues a finding that no sexual harassment has occurred, the complainant, if not satisfied with this resolution, may appeal the decision to the Board of Education. If the complainant is satisfied with the Superintendent's finding the complainant will so indicate in writing and the matter will be deemed closed.

Should the Superintendent determine that corrective action is necessary, the Superintendent of Schools shall follow all applicable law and regulations and appropriate collective bargaining agreements in the resolution of the complaint.

The complainant shall receive a copy of any and all reports issued by the Superintendent pertaining to the investigation/outcome of the formal complaint.

Step 4 - Appeal to the Board of EducationIn the event that a complainant files an appeal with the Board of Education, following an investigation by the Superintendent of Schools, the Board of Education will conduct a hearing and issue a written response to the complainant following completion of the hearing.

The compliance officer will make follow-up inquiries to ensure that the harassment has not resumed and that the victim and any witnesses have not suffered retaliation. Regardless of whether a complaint has been filed, if the District knows or has reason to know of the existence of any alleged sexual harassment, the District shall require a prompt and thorough investigation by appropriate personnel.

Reporting Fraud and Abuse

The State Comptroller is working to find and fight fraud at every level of State and local government. The public’s help is needed in this fight. New Yorkers can report allegations of fraud, corruption or abuse of taxpayer money by calling a toll-free hotline at 1-888-OSC-4555(1-888-672-4555).

STAFF-STUDENT RELATIONS (FRATERNIZATION)The Board of Education requires that all School District employees maintain a professional, ethical relationship with District students that is conducive to an effective, safe learning environment; and that staff members act as role models for students at all times, whether on or off school property and both during and outside of school hours. Staff must establish appropriate personal boundaries with students and not engage in any behavior that could reasonably lead to even the appearance of impropriety.

Staff members are prohibited, under any circumstances, to date or

engage in any improper fraternization or undue familiarity with students, regardless of the student's age and/or regardless of whether the student may have "consented" to such conduct. Further, employees shall not entertain students or socialize with students in such a manner as to create the perception that a dating relationship exists. Similarly, any action or comment by a staff member which invites romantic or sexual involvement with a student is considered highly unethical, in violation of District policy, and may result in the notification of law enforcement officials and the filing of criminal charges and/or disciplinary action by the District up to and including termination of employment.

Inappropriate employee behavior includes, but is not limited to, flirting; making suggestive comments; dating; requests for sexual activity; physical displays of affection; giving inappropriate personal gifts; frequent personal communication with a student (via phone, e-mail, letters, notes, etc.) unrelated to course work or official school matters; providing alcohol or drugs to students; inappropriate touching; and engaging in sexual contact and/or sexual relations.

Even if the student participated "willingly" in the activity (regardless of the student's age), inappropriate fraternization of staff with students is against District policy and may be in violation of professional standards of conduct and New York State Law. However, inappropriate employee conduct does not need to rise to the level of criminal activity for such conduct to be in violation of District rules and subject to appropriate disciplinary sanctions.

Any student who believes that he/she has been subjected to inappropriate staff behavior as enumerated in this policy, as well as students, school employees or third parties who have knowledge of or witness any possible occurrence of inappropriate staff-student relations, shall report the incident to any staff member or either the employee's supervisor, the student's Principal or the District's designated Complaint Officer. In all events such reports shall be forwarded to the designated Complaint Officer for further investigation. Anonymous complaints of inappropriate fraternization of staff members with students will also be investigated by the District. Investigations of allegations of inappropriate staff-student relations shall follow the procedures utilized for complaints of harassment within the School District. Allegations of inappropriate staff-student behavior shall be promptly investigated and will be treated as confidential and private to the extent possible within legal constraints.

Any employee having knowledge of or reasonable suspicion that another employee may have engaged in inappropriate conduct with a

student that may constitute child abuse (specifically, child abuse in an educational setting) must also follow the District's reporting procedures for such allegations; and such information will be reported by the designated administrator as required by state law to law enforcement officials, the State Education Department and/or Child Protective Services as may be applicable.

If a student initiates inappropriate behavior toward a staff member, that employee shall document the incident and report it to his/her Building Principal or Supervisor.

The District shall promptly investigate all complaints of inappropriate staff-student relations, and take prompt corrective action to stop such conduct if it occurs.

Prohibition of Retaliation The Board of Education prohibits any retaliatory behavior directed against complainants, victims, witnesses, and/or any other individuals who participate in the investigation of allegations of inappropriate staff-student relations. Follow-up inquiries and/or appropriate monitoring shall be made to ensure that the alleged conduct has not resumed and that all those involved in the investigation have not suffered retaliation. Any act of retaliation is subject to appropriate disciplinary action by the District.

District Responsibility/Training The Principal of each school and/or program supervisor shall be responsible for informing students, staff and volunteers of the requirements of this policy, including the duty to report and the procedures established for investigation and resolution of complaints. Further, staff training shall be provided to facilitate staff identification of possible behavior that may constitute inappropriate staff-student relationships. Students shall be provided such training in an age appropriate manner.

The District's policy (or a summary thereof) shall be disseminated as appropriate to staff, students and parents. Further, this topic shall be addressed in the District Code of Conduct.

Disciplinary SanctionsAny staff member who engages in inappropriate conduct with a student, prohibited by the terms of this policy, shall be subject to appropriate disciplinary measures up to and including termination of employment in accordance with legal guidelines, District policy and regulation, and the applicable collective bargaining agreement. A violation of this policy may also subject the employee to criminal

DISTRICT CODE OF ETHICS FOR COMPUTER/TECHNOLOGY USERS[Fair Use Policy]The use of computers, technology and the Internet at Sherman Central School by students and staff is very much encouraged. Anyone who wishes to use computers, technology and the Internet has the responsibility of doing so in an ethical and legal matter. An Internet Filter is in place to protect all SCS computers against pornography and extreme websites, though it is not perfect. As a condition for the use of computers and other technologies at Sherman Central, users (defined as any student, teacher, administrator, staff member or community member utilizing a district computer) are expected to:

1. Respect the privacy of others.

Users will not reveal their passwords to other users.Users will not try to learn or access passwords of other users or network administrators.Users will not attempt to gain unauthorized access to networked or stand-alone systems. Users will not open, read, or modify files of other individuals.

2. Respect the integrity of the Sherman Central Schools networks.

Students will not use Teacher computers without direct permission and presence of the Teacher. Only School-authorized email will be allowed. Email use will be allowed only with the permission of the room supervisor.
