    1.-(1) This Act may be cited as the Advertisements Shor t t i t l eandappli-Regulation Act. cation.( 2 ) This Act shall not apply within the Urban andSub-Urban Districts of the Corporate Area as defined inthe Kingston and St. Andrew Corporation Act or withimthe limits of any town as defined for the purposes of thisAct or for general purposes under the provisions containedin the Parish CouncilsAct.

    2. In this Act- IntWpICta-advertisement includes any sky sign and any notice, bill, placard, poster and other similar publication;hoarding includes any structure used as an advertise-ment or for exhibiting any advertisement;the Minister means the Minister responsible for com-munications;sky sign means any word, letter, model, sign, device orrepresentation in the nature of an advertisement,announcement or direction, supported or attached toany post, pole, standard, framework or bther support,wholly or in part upon, over or above any building,structure or erection, which, or any part of which,

    4 ADVERTISEMENTS REGULATIONin part for the purposes of any advertisement orannouncement on, over or above any building, structureor erection of any kind or on or over any public placein the Island or in the waters thereof; but does notinclude any flagstaff, pole, vane or weathercock unlessadapted or used wholly or in part for the purpose ofany advertisement or announcement.

    3. No hoarding shall be erected and no advertisementshall be exhibited upon any hoarding or on any wall, tree,pole, fence, gate or other place so as to be visible from anypublic place in the Island except in accordance with theprovisions of this Act and of any regulations made there-under.4. The Chief Technical Director may erect or authorizethe erection of hoardings and advertisements and may, uponthe application in writing of the person responsible there-

    for, authorize the use of hoardings and advertisementsexisting at the date of the coming into operation ofregulations made under this Act. Every such authorizationshall be given for such period not exceeding five years asthe Chief Technical Director may determine.

Notwithstanding the provisions of sections 3 and 4,tmmentson any person may exhibit in or upon his own premises, or inpremLses or upon any premises in his occupation, advertisementsrelating to the business, profession or trade carried on inor upon those premises, and further may exhibit anyadvertisements upon any building used by hmfor businesspurposes in or upon such premises :

    Provided that any advertisement so exhibited shall not besuspended across the street or in any way suspended orprojected outwards from such premises.6-(1)The Minister may make regulations generallyfor the better carrying out of the provisions of thisAct.

    ADVERTISEMENTS REGULATION 5(2) Regulations made under this s&ion may, wth-out prejudice to the generality of the power conferred bysubsection (11, provide for regulating, restricting o r pro-hibiting the erection of hoardings and the exhibition ofadvertisements in such places, in such manner and by such

    means as to afect injuriously the amenith of a publicpark or pleasure promenade or any place frequented bythe public soley or chiefly on account of its beauty, or todisfigure the view of rural scenery from any highway orrailway or from any public place or water.

    7. If any person is aggrieved by the refusal of the Chief AppealfromdecisionofTahnicals.7.

    Technical D irector to authorize the erection of any hoard- a ding or the use of any hoarding or advertisement as provided Dirstor.in section 4, such persbn may appeal to the Minister,and 1311955if it be made to appear to the Minister that the erectionof such hoarding or the use of any hoarding or advalise-ment should be authorized under thi s Act, the Ministermay give directions to the Chief Technical Director to tha teffect.

    &+I) unless authorized under Section 4 or exempted R a ~ d o funder section 5, any hoarding erected and any advertise- iFcdhoard-regulations made under this Act shall be removed by the -b.person responsible therefor wthn six months from suchdate, and if not 50 removed as aforesaid the Chief TechnicalDirector shall serve on the p?rson responsible for suchhoarding or advertisement a notice in writing requiring theremoval thereof wthi n one month, and upon failure tocomply wth such notice such person shall be deemed tohave committed a contravention of the provisions of thi sAct.

    (2) If no person responsible for such hoarding oradvertisement can be foundwthnsix months from the date

    6 ADVERTISEMENTS REGULATIONof the coming nto operation of regulations made under thisAct, the Chief Technical Director may cause such hoard-ing or advertisement to be removed and for ths purposemay enter upon any land whereon such hoarding oradvertisement is and may do such other acts and things aamay be necessary for the removal thereof.

    9. Every person who contravenes the provisions of thisAct or of any regulations made thereunder shall be liable,on conviction befqre a Resident Magistrate, to a h e ftwenty dollars and to a further fine of four dollars forevery day during which the offence is continued after hisconviction therefor:Frovided that the offence shall not be deemed to be

    continued during a period of fourteen days from the dateof the conviction and, if any appeal is lodged, during theperiod until the determination of such appeal.10. Nothing in this Act shall apply to hoardings erectedand advertisements exhibited by any Department Of theGovernment or by any Military,Naval or Air ForceAuthority, or by any Judicial Authority, or by anyMunicipal Authority, or by or under the authdty &f anyenactment, or to any notice relating to my service in a

    church, chapel, temple or mosque.
