1. Adoption of Agenda

Oldenburg - I’m going to ask my colleagues before adoption if there are changes.

Samolyk - I have a few restaurants that would make sense if we hear them all at the same time. We

have neighbors to talk on all three. I would like to propose we move Tortilla Coast which is towards

the end of the agenda to after Bullfeathers.

Oldenburg - Does anybody have any objections? (none) OK. Anybody else have anything you wish to

shift, add or subtract? I want to add a letter I circulated to my colleagues to the Bureau of Prisons to

the agenda. It is in the meting packet. I propose we move it between 10 and 11, after financial reports

since we need to vote on it. And I wanted to ask the Chair of PZ do you want to remove the public

space case?

Burger - Yes.

Oldenburg - Before we finish this, we’ve just been joined by Commissioner Jayaraman (Jayaraman

introduces himself, indicates no request to move, alter agenda.)

Rachel Mariman - w/ Mayor Bowser - I’m sure you have all heard about the Mayor’s effort to push for

DC statehood. We are now establishing working groups for residents to shape how our ballot initiative

would look statehood.dc.gov for more information to sign up to join a stakeholder working group.

Samolyk - I spoke with Seth Shapiro. The park we call plastic park, 9th

and D, they will be cleaning

that out. They will give residents a 7 day notice. The problem was that this park was not on the

calendar to be serviced by DPR, and now DPR controls that park and they will be cleaning that park

out.

Hagedorn - I wanted to remind everyone this weekend is Capitol Hill Classic. Be prepared for street

closures on Sunday.

Sidney Davis - I’m here with friends to talk about area 6B, Garfield Park. We wanted to discuss a few

items if we may. I want to be able to discuss the area around the park. There are many families that

used to live there, African American families. Over the years we have been using Garfield Park as a

reunion area for those who no longer live here. Today we are letting you know we need to have a

conversation to have an opportunity to be a part.

Samolyk - For everyone who isn’t in the know. If anyone wishes to have an event at Garfield Park,

they ask you to have a letter from ANC commissioner to support the application. I would be happy to

do it for you. I can give you my contact information. Whoever you are working with, I can happily

give you a letter of support. (audience member hands to Samolyk letter/information in folder)

Mr. Westrate - the problem we are having is parking. We are trying to get concessions. Since they

built a stadium down there, about 70 percent who attend do not live in Ward 6 so we are looking for

allowance to have our participants have parking. The event is 3rd

Saturday in August.

Oldenburg - Thank you very much for coming. Commissioner Samolyk will meet you in the hallway

to talk.

Loots - The Miracle Theatre is officially open for business. They’ve been open all week and I’ve been

there 3 times already

Krepp - with WMATA we’re going to have a little problem in August for 3 weeks, they will shut down

Eastern Market, Potomac Ave, I bring you this attention is that 9 years ago congress wrote legislation

to require WMATA to do communications, and security drill. If we are about to suffer the loss of a

system, we, the students who go to Eastern, Eliot Hine, Charter schools. We should demand the name

who certified the system to get money. The system is now broken. My recommendation is to find out

who certified.

Naomi Mitchell - CM Allen is actively on top of that issue with WMATA and CW Norton to get that

started earlier in the summer so it is completed by time students go back to school. We have a similar

experience not too long ago where it was closed and impacted students. Hopefully we won’t have that

happen.

Chao- I know this is in Diane’s SMD, but since she can’t be here tonight I’d like to put in a good word

for East City Bookstore, which opened recently on Pennsylvania Avenue between Hank’s and the CVS

store. It is a pleasure to have another bookstore on Capitol Hill and I hope they will be very

successful. I urge everyone to drop by and check out what they have to offer.

4. Consent Agenda

Oldenburg - The items have been discussed at the committee level and the committee recommended

the ANC put them on consent agenda. So we will be voting for everything, every case on the consent

agenda. I do want to go through the list and I have my colleague who chairs the ABC Committee, to

ensure we have all the settlement agreements?

Jayaraman - I have emails from Commissioner Hoskins, I don’t have hard copies. We have Starbucks,

LPQ, Folger’s.

Burger - Re La Lomita, we agreed to have previous one continue. No changes.

Oldenburg - So we have several cases and two items from PZ committee - the letter re: lead in water

by Commissioner Krepp and a public space case for 1401 A Street SE. Somebody can make a motion?

Oldenburg - It is my pleasure to introduce our Director of OUC Karima Holmes.

Acting Director Karima Holmes, Office of Unified Communications

Holmes - Hello, I’m Karima Holmes and your Director of OUC. I will tell you a little bit about myself

and the center. I have been in the 911 business for 16 years, starting out in August Georgia, as call

taker, moved to dispatcher, to Sgt. and Lt. I also did training for 911 center and became assistant

director. Then in 2012 I moved to Dallas and ran a regional center for the past 3.5 years until I applied

for DC position. I started Jan 19th

, same week as snowzilla. I was so busy but I learned a lot about the

district in a short amount of time. I have a criminal justice degree and a master’s in public

administration with focus on homeland security.

OUC on MLK is responsible for 911, 311, and also the district wide coordination of public safety

radio, communications between departments. Our objective is to correctly manage incoming calls and

partner with federal, state, regional agencies for interoperability. As far as 911 center in 2015, we

received 1.4 million calls. Out of those 1.4 million only 900k were actually dispatched. We

coordinate with park police, capitol police, and have over 100 languages that we serve out of the

center.

In March 28 of this year with started with a 3rd

party service AMR. We had 2 of their dispatchers in

our call center so that their dispatchers can speak directly. We also began SMART 911, a profile

setting. Goto smart911.com and set a profile for residence. You can put in information about you and

your family, e.g., your child, and their health issues. This is confidential. Let’s say my son is having

an asthma attack, can’t talk. The responder can see that perhaps this is the son calling who isn’t

talking. This service is not only for disabled but for anyone. Also it helps for those who go out of

town and if your alarm goes out, we can make contact with you.

Samolyk - Is smart 911 DC only or across US.

A: DC is one of the cities that use it, it is offered nation wide, depending on city. As far as DC 311

your ward uses a lot. 157 service request types, 14 agencies that service this. DPW, DMV, DDOT,

DoH, 1.8 million calls last year in 2015. We will have service to text 311 with live agent that is

coming soon. We are trying to find different ways to address the call volume and help community at

the same time. You can call 311, download 311 mobile app, tweet, 311.dc.gov. We also have a 311

call back assistance. You can request to call back if the hold time is too long for you. I have my

public affairs specialist Wanda here with us today. She is also the voice on the recording for 311. She

does a lot of community outreach so we would like you guys to know if you want more meetings,

church, school, want us to talk to your neighbors, we are happy to do that. We also host groups for

tours. If you have a group, we are with HSEMA and are open to that.

Eric is our operations manager for 311 and he is going to talk to you about our numbers.

Eric Hines - I have been at OUC for 10 years. 6b uses all forms of communications. You have

contacted us over 29k times. We appreciate that you are taking full advantage of every avenue. Most

of request is for bulk collection. Parking enforcement is frequent too. 632 parking requests has been

made.

For this area, that is not bad. Emergency parking verification - that is #3 on list. #4 is street repair.

For trees, Capitol Hill has a ton of them and if a tree request isn’t in by May 23rd

, it won’t be in by

2017. If you have tree issues please request for those issues now.

Trash and recycling - 487 requests for recycling being missed. We try to collect trash within 48 hours.

Oldenburg - Questions?

Ridge - I’m on the 311 smart phone app right now. As many residents will know it isn’t more than

website wrapped in an app. It doesn’t even work as well as the website. Right now I was trying to

enter a service request and it can take as long as a minute that I hit submit request and popping up in

screen.

Hines: We have two apps. One app is blue and white, the original version. July of last year we

changed our platform and when we did that, that platform came with another app. What you have is

the newest version of our app.

Ridge - so it’s the new one that is problematic.

Hines - With all honesty the new one is cloud based and the old one is server based. Jan. 22nd

, snow

day, for example, the city 1000 to 2000 parking tickets. So once we create a service request. This new

version is better for us to get to you quicker. With the old app we had to go to the third party vendor.

This one may be less user friendly but on our end is easier. And vice versa. So my CIO and I are

having that conversation right now about this issue.

Burger - re: parking requests. If I submit parking violation request via app, is there differential

response rate v. phone?

A: No.

Burger - I submit requests and seems like no one comes out quick enough. What’s the response time?

A: DPW tries to respond within 2 hours. Parking enforcement is constantly checking for parking up

particular street/block, depending on where parking enforcement is; they have to finish that block

before moving onto the request to review the issue.

Samolyk - Mark Beach mentioned that sometimes lax on both sides. E.g., man on gun on 3rd

street and

hang up and lack of information for police officer. They had asked for me to ask you all can you all

take more details. Maybe that’s a conversation you would have with MPD.

Holmes - We have a protocol our operators go through, e.g., detailed list to ask. We hears that a lot

and what happens is sometimes caller don’t want to give too much information because they are afraid

the suspect will know who called. And they won’t answer the phone when we try to call back.

Samolyk - Re trees, if we don’t get request in by May 23rd

, it’ll be 2017 issue where do you see the

dates?

Hines - It is on DDOT website and it changes seasonally. Look under Urban Forestry category.

Loots - I was going to compliment you, not knowing that it is the older version, I actually use it

frequently and is very consumer friendly. I can take pictures, and it reports back to me when

something happens. It is proof that it is working for me. If we are moving away from this system…

Holmes - I haven’t decided and it is good to hear that from you.

Loots - The other thing that concerns me is that in my SMD and elsewhere on Capitol Hill, there are

odd streets with names and I have more than once try to report and the dispatcher has no clue, even if I

give them quadrant and nearby intersection. I wonder do your folks get training. I’m told that the

address don’t show and I’m standing in front of the street address.

Holmes - We need to work on training. When I started here there was a very small training ongoing.

Almost 400 employees and 1 person responsible for training. I requested that we have a real training

program. The other reason isn’t popping up is we need to look at that with OCTO. We don’t add the

street in and it is added and filtered in by other. I would love to receive the streets as you get issues.

So I can double check.

Oldenburg - Questions from audience?

Q - Is data submitted anonymous? Have you worked with the local development community to look at

applications?

A: We have some grad students from Georgetown and we just had a meeting today, a small team that

works in public policy and we are working with them on the app. We have decisions to make about

the future of the app. This group is coming in and looking at things to look at download, user data, etc.

You can call and tell us you wish to be anonymous and we will clear your name out.

Q - We hear sometimes you list cases as completed but the agency does not follow through.

A: If a call comes in and we put the service request in, that is the end of our system and we log it in as

complete. We get complaints that OUC didn’t do x, y, z. We are just the customer service part and we

shoot them to the agency.

Krepp - I’d like the parking stats you received for Ward 6. Can I have it. I just want 6B. Do you keep

it by month?

A: We do by year, month, date…

Krepp - Cool I’ll go outside and talk to you about it.

Hoskins - Shocked to hear that you are using caps and not google map. I also want to follow up on

Samolyk’s comments. Re: calls coming into OUC. My understanding is that OUC call center is in

charge of prioritization. My concern is how does that information get acted upon and what I am

hearing is some finger pointing in both directions. Police will say it is OUC and vice versa. I am

concerned in this neighborhood that calls to 911 are being made and responses aren’t happening.

Holmes - we don’t prioritize calls. MPD gives us priority. E.g., Baby choking priority 1. And it is

entered in our system and our dispatcher dispatches first the baby choking over others if both calls

come in at once. The part about responses. On our side I do see a need for fix there. That was one of

the reason I created a new department - training/quality assurance - so we know if it is done right. I

have a 6 man team just hired that will be responsible for training. I do see some big fixes on our side.

Hoskins - Can you give timeline implementation?

Holmes - By the end of this year.

Jayaraman - First Case is Capitol Hill Tandoor. The applicant has submitted a letter requesting a

continuation to ABRA and 6B will submit a letter in that same regard accepting, but we will need to

vote on that. Although ABRA said we didn’t need to do that. The Chair has a draft of that letter. We

will see a theme here that we are serious about this. Commissioner Samolyk is working to organize a

group that involves all establishments on that corner because it has to be a concerted joint effort.

Jayaraman - This is one of the good ideas that has come out of the meetings. From an owner

management perspective, taking a picture, or some instances we have night manager to double check

that dumpsters are in fact closed. People make mistakes, but at the end of the evening one manager

will check and ensure that problem doesn’t continue to fester.

Elena McGrann - I hear that Bullfeather will hire new trash company. How quick will the trash can be

replaced.

A: We are having problems so we are changing company, so different company would replace it. We

are now doing 5 days for both cans from 3 days.

This is one of the reasons the amendment is here. The language is in place. Trash management is

handled by landlord who works extremely hard to ensure trashroom is clean. Which is why I am

comfortable to not have to do a full renewable SA. Because we know it is working and working well.

Jayaraman - Recommendation was ANC protest license. We had a number of questions.

Samolyk - The reason why we chose to protest. Right now, tortilla coast has never had a SA with

ANC 6B. They own other establishments throughout other ANCs they have SAs. I don’t want to put

words in Brian’s mouth, but everything we are asking for in SA they are required by law anyways. I

did have a meeting with Brian and neighbors at 630 tonight. They are not bad apples; we don’t want to

protest, but we do have a policy that the committee votes to protest if we don’t have a signed. SA.

Oldenburg - So now we have no SA. And we haven’t had one to date with Tortilla Coast.

Jayaraman - I’d like to know from Brian Sullivan. What are on the SAs that you have at your other

SAs that are not objectable.

What I prefer to suggest is to speak to both of you with more details after this meeting. That might be

more productive afterwards.

Samolyk - how often do you pick trash?

A: Mon, Wed, Fri.

Samolyk - Brian did offer to host neighborhood meeting of all restaurants to tackle rat abatement. Rat

issue is only as good as weakest link. If we can get all on board we can improve condition on that

corner.

Oldenburg - so I know petition date is May 31st. So there is time should we decide to do protest vote

there’s time to negotiate to ultimately withdraw protest. That gives us 2 weeks for negotiation.

Krepp - I’m disappointed you don’t have an agreement with the ANC . I love Tortilla Coast, and have

celebrated multiple occasions. It’s a wonderful place and that is why I’m disappointed to hear you

have no agreement. I support having a conversation, there are 10 of us who have to vote on this

tonight. While you’re only talking to two, ten are voting. I’m disappointed to hear 10 of us who are

voting, not all have information in front of us. I encourage you to work with us. We really do like

your establishment and really do want you to work with us.

Neighbor - I guess I understand how well he seems to be working. My objection is that it is unfair that

all other restaurants are doing this and there’s one here that is being exempt. That would be my

objection.

Peter Rooney, 138 NC Avenue. - I abut the alley. We did have a discussion with Mr. Harris last week

and Chairman Jayaraman’s committee. We have shared photographs. This has been typical of

Bullfeather’s for overflow trash. The agreement with Bullfeathers are very encouraging. We want to

see a change in behavior. It is the same alley and we see the exact problem with Tortilla Coast. We

shared photos of poor trash management. I think Mr. Sullivan has an absolute right to not enter into

voluntary agreement, but the committee should protest and insist on it. They’ve been feeding rodent

population in our neighborhood.

Jake Gatch - I did see those pictures Peter was speaking about. It surprised me. Because the good

thing, two years ago this month there was a rat forum. One of the few restaurant forums who attended

aback by the photos of Tortilla Coast. Over the past few years I saw good faith efforts. I’m surprised

and I don’t know what happened here.

Larry Johnson - Mr. Sullivan at the meeting last week expressed legal reasons. It seems to be if the

commission were to create an exception in this case, if they want to do that, at least have some kind of

MOU that is substantive with the restaurant that memorialize the agreement.

Oldenburg - The committee has recommended a protest. We don’t need a 2nd

Samolyk - I’m going to abstain in good faith that Brian and I have a productive conversation. My vote

for the neighbor’s sake is that I want Brian to talk to me and hopefully enter into a SA.

Hoskins - I reached out to the owner over the weekend and was unable to be in touch. We do have an

existing SA but have not had any discussions. Applicant has not responded to request to discuss. The

critical issue that must be addressed is impact on adjacent property value. Their storm water drain is

disconnected and all of their storm water is flooding rear property. A lot of us like Oysters and Hanks

but in my opinion that matter must be addressed. It is impacting adjacent property value and meets

standard of protest. We welcome opportunity to discuss with applicant. Critical is date certain. I am

open to that date, but that issue must be addressed.

Andrew Klein - I’ve learned over the past few days timeline. This issue dates back 4 years. Hanks has

been working on it through change in ownership with foreclosure. They’ve engaged engineers,

worked and will continue to work. We don’t see it as an ABC issue. If this is an ABC issue than

everything issue ABC. Hanks will continue to spend great deal of money to resolve this in good faith.

There are 2 issues. One is storm water from their property flowing onto neighbor’s property. The

other issue is storm water from adjacent roofs flowing onto their property. This is a complicated issue

that needs attention of engineer who they have engaged.

Loots- I want to reiterate last week. Although this is legitimate, but not related causily or realistically

or legally to ABRA license. We are stretching pretty far afield. An issue arising from inadequate

building maintenance, storm water runoff, is negligently maintained designed and maintained by

owner is not something we can correct through liquor license. Clearly it must be addressed. I am

impressed Hank’s has taken initiative to fund and resolve it. I can’t in good conscience believe this is

in scope of ABRA protest.

Hoskins - For me that is primary issue but not only issue. There is a problem with screening of

mechanicals. The proposed language also addresses that. And trash, the same issues we have been

discussing with all establishments. The local standard clearly states impact on property value. To me

that is impacting peace, order quiet so I think I will move that we protest on both.

Burger - I was going to 2nd

what Loots said relating to water. I like what we are doing to address

fundamental issues with restaurants but am concerned we reach too far with liquor license. Especially

if there are other DC law that addresses it. If there are other issues consistent and confined with those

sets of issues we have been working on I would support the protest.

Mac Cutler - I like Hank’s Oyster Bar and am very sorry you are stuck with a landlord situation. All of

the commissioners have voted to hold landlords accountable. I think it would be equally consistent if

landlord is not maintaining property in safe and positive aspect they shouldn’t be operating. If they

can’t successfully keep water out, which impacts trash. Maybe they should not have a liquor license.

If water is running out to street and carrying dirt back and forth.

Jayaraman - Counsel for applicant said this is a 4 plus years issue. If remedies available I would have

expected applicant/landlord to mitigate and address the issue. Liquor license comes up only once

every 3 years. They have had time. Why are they hiring an engineer now. This is not a new

development. Unfortunately they put themselves in a position where the neighbors had no other

recourse.

Oldenburg - I wouldn’t support protest on basis of storm water issue. I agree with Loots and Burger on

that. We do have existing SA with Hanks. Hoskins says they have trash issues. How does that

existing SA handle trash issues. Is it not comprehensive enough?

Hoskins - That’s my view. On existing SA I have proposed SA language but I did circulate last

Thursday both existing SA and proposed SA for all my cases.

Attorney - I would request if you give us protest you give us clarity of what to address I am hearing a

split.

Samolyk - Are you willing to sign SA?

Attorney - That’s not up to me, but my client.

Hoskins - Hanks’s never entered SA with 6B. They inherited from 2013 their predecessor. One page

2 lines. Their current SA is very bare bones. It says applicant shall keep sidewalk, curb…reads from

SA. It is certainly not equivalent to other applicants on the block.

Hoskins - I am recommending we protest ground of 2 issues, effect on real property values and on

peace order and quiet including noise and litter provisions in section 25-725 and 25-726.

Jayaraman - The changes I recommended must have been about 5:30p. And I have specific

amendments I would like to make. One of them have to do with provision of dumpster lids bent or

warped, prior to closing applicant will inspect all trash area and close lids. Power washing in middle

of night and kitchen exhaust system. My amendment says they won’t occur at night. If they have to,

the power wash equipment would be placed on business side.

Loots - I would note the existing draft does in fact maintain applicant maintain trash bins in good

working order. The existing agreement also includes affirmative covenant to conduct business to

minimize noise and odor to neighboring businesses. The increase in power washing frequency is in

my mind very important. We have discussed number of applicants when that power washing occurs.

Jayaraman - I changed language to “we will not oppose” instead of ….

Loots - This is different. This pertains to interface to sidewalk café.

Jayaraman - The onus should not be on us to support. Its up to them to convince public space…

Oldenburg - We have battling SAs, one is signed. One isn’t. Before the applicant speaks I’d like

motion from commissioner.

Loots - I move to we vote to support SA and adopt as executed by parties. 2nd

Steven Abram - one of partners. We did everything we felt we could to participate openly. I worked

with Jim closely over the last few days. Everytime we asked for something we gave detailed reason

and never said no. we gave details. I understand there are too many chefs in the kitche. When you are

working with the commission it is very difficult to come to the hearing and walking in the door to be

notified that there are changes. Why wouldn’t you support? We did everything that was asked of us at

the last hearing. If there’s an issue we will address it. We did our best we stand by it.

Hoskins - I’m sensitive to issue of power washing of rear alley overnight. Is that something you

discussed?

A: We didn’t want to limit to hours wasn’t because we want to make noise but if there was a need we

want to address it immediately and not let it fester. We have a power washer in place, not industrial.

know if it is viable so it is hard to agree in advance. There are in that agreement provision that say..the

most important thing is that our customers are being served by us.

Krepp - Quick question on power washing. We have a situation at 3rd

and Penn power washing at

midnight. That is coming to my mind. Is your operation different so if you had to do something at 1a

or midnight you are not waking up neighbors?

A: We are situated in middle of block. Right behind is church and residential is behind. There’s not

much across from us. We don’t typically power wash in middle of night. We power wash in morning.

I didn’t want to have constraint. I don’t know what we will need in order to keep the alley clean. I

don’t want the practice to backfire.

Burger - Can you clarify language to side walk café, is the provision in SA if we sign, we will support

subsequent application for sidewalk café?

Loots - My thought and expectation was we not judge one before the other. I guess one possibility is

we can table this and see how public space ..

Burger - That is correct interpretation? I can not support his SA because I don’t like the dependency

on sidewalk café. As much as I think we are moving to resolution, I don’t like obligation the other

document. If we are not going to strike, I am not going to support it.

Catherine - I’m a neighbor I have a group of neighbors who are here (they raise their hands).

Restaurants on this block have been an important issue. One of the issues has been the trash lids not

coming down at end of the day. With new restaurants, we have been having indoor. We have

compromised with you all. it would be great to have manager at end of the day to step out and take a

photo, and make sure it is neat. So you have a record.

Hadi - live on 400 block. I wouldn’t call them competing because we are all moving towards the same

thing. I fully support a couple of points, one in particular on trash lids. We walked last week with

Mayor Bowser and it was awful. We still had trash lids bent, out of shape. I appreciate your efforts to

com eto SA.

Samolyk - I agree on power washing when it is industrial. Heaven forbid if there’s an oil spill. If

something happens and they have to clean it up, they just want to take care of it. That’s what I

understand.

Oldenburg - I would support it except for sentence linking sidewalk café issue, be stricken, I am very

uncomfortable with that.

Loots - In that sentence it does refer to a resolution to be placed before you…

Oldenburg - This is continuation of the May 10 2016 meeting. We have a quorum present so we can

get going. I can dispense with introductions this time around. First thing we should do is clarify the

order of the items. Let me read through the agenda. (reads from agenda) Does anybody have any

differences or concerns of the agenda? (no one responds).

Loots - If I may, it si going to be necessary for us to resolve Medium Rare case tonight. I think we still

were in the middle of discussion when we last left off last time. I would suggest we table that and

discuss first the public space application for Medium Rare. Then at that point we can discuss it in

context of ABRA.

Oldenburg - Does anybody have objections (hearing none). OK so we will take that up first.

DDOT Tracking #10239313, Medium Rare Barracks Row, Revision to existing sidewalk

café

Burger - At PZ Committee we passed a motion recommending ANC oppose the extension of the

sidewalk café in front fo the Shakespeare Building.

Loots- During that meeting we had an extensive dialogue with the applicant, whowas generally

receptive to the concerns voiced at that meeting. Subsequently they’ve come back with a revised plan

and verbal commitment which I circulated via email. They showed mark in blue in line where they

would move back table to provide 6 feet of real clearance to give red brick side walk space. Basically

eliminating one row of two top seating all the way across. They also agreed to revise the specifications

for the type of expansion and fence. Right now there’s a loose chain, loop to loop. They are willing to

use heavy cast iron metal connecting with straight solid railing which is much more difficult to move

one direction or the other. I shared with the applicant what I circulated last week. I would propose at

this point in form of substitute motion I’d like to move that we support the application of public space

and send a letter to DDOT public space committee articulating support conditioned upon the 5 bullet

points I articulated in the formal written resolution.

Jayaraman - is there any reference to the exhibit they referred to in the SA? The new drawing tey

submitted is changed from what we considered initially. Is there a way to make that change so we

refer to new set of plans?

Loots - They are going to have to file with DDOT amended plans. So the answer is no, all I have is

what I circulated which is revised with blue line. In the resolution I specifically say ABRA should

provide public space committee … .

Oldenburg - What is SSL….?

Loots - That is the legal definition for square and lot for the Shakespeare building.

Burger - In the drawing the blue line is the new border and it doesn’t look like it extends across

existing sidewalk café?

Oldenburg - Will it be continuous all the way across?

Loots - What I said was they need to provide minimum of 6 feet all the way across. My understanding

is when they give a sidewalk café permit it has to be a straight line. It cannot be a zigzag line. I don’t

know where its written, but its what I was told. This is DDOT’s question. When you apply for single

public space permit which covers 2 different properties, is that one or two permits, what happens if one

goes away? For our purpose Im satisfied that they would vacate and abandon if they lose their lease,

which protects us.

Burger - I would like to see, re: 4th

bullet, this application focuses on extension. I’d like to make it

clear that there will be a straight line and will extend 6 feet out the whole way.

Loots - That’s what we talked about in that their current space is beyond the limits anyways, and at this

point we can certainly add extra wording to clarify this is entirety of it.

Oldenburg - It talks about expansion of sidewalk café, but needs to be somehow tied to existing and

modify existing as well.

Burger - (suggests language to Commissioner Loots re: 6 feet extension of sidewalk space)

Loots - I’ll just write in a couple of changes and hand them into the Secretary so its reflected. (Loots

continues to edit and verbally read edits to receive feedback from Commissioners). So that is my

motion

Chao - Question - Did we receive in writing from the building owner that they are ok with the

applicant moving forward with this?

Loots - We did not but we did put in condition we are voting on tonight to our approval that they must

have the approval as a condition. In any even we don’t want to be writing and demanding that they do.

Jayaraman - As I read the language, it reads in event the owner of the Shakespeare theatre, would they

terminate their own right to use?

Loots - That’s not what I intended. We can say the owner terminates ABRA’s right to use. Is that

more clear?

Jayaraman - Yes. Thank you.

Oldenburg - So we are approving this and sort of leaves it open for Matthew Marcou and his group …

I’m a little nervous. We are not saying we oppose, but we request owner to come back to us with

revised application. If public space does not agree…you know…

Loots - I think we give them a checklist; as they already have it. We add to the checklist our approval

and support is contingent upon things. The default is if those checkmarks are not met and public space

decides to … then it does not have the support of the ANC and does not turn into an opposition, but

neutral.

Oldenburg - I’m going to say if we in fact vote this way and support, we are letting public space act on

our behalf, I’m going to suggest you go to the committee and testify.

Loots - I will commit to that right now.

Oldenburg - Ok that’s comforting. I’m okay with this now.

Hoskins - In the letter, can we add this is a unique situation. I think the context and your testimony

would provide that. In the opening sentence say that this is a very unique situation and we have given

this a lot of thoughts. But being very clear. I would open the letter with that.

Burger - I think that makes sense. Stress that we don’t intend for this as something we routinely

approve.

Oldenburg - Anything else? Do we want to vote? The vote is to support as we discussed with the list

of stipulations all in favor?

ABC Restaurant License Renewals for Lincoln Park Kitchen/Wine Bar,

Jayaraman - Last Tuesday motion voted no position on renewal, 8-0. There were language we needed

to work through and I have modified SA based on additional discussions. I think the biggest issue they

have, a cert of occupancy says 50. They have seats more than that currently, inside. I think its because

there’s a main level and with stairs inside and with open area there are seats as well. If its 50 its 50.

They went and investigated and were told they’d have to install sprinklers throughout the building if its

anything over 50. They are new and said they can’t do that. They are proposing to remove tables

downstairs. I said if some day ABRA comes in and count heads and over 50 that’s on you. I can’t do

anything to help…they are taking that risk. This SA does say applicant shall limit no more than 75

patrons including seating for up to 50 patrons interior and no more than 12 on sidewalk café. So it

maintains number in certificate of occupancy. They can renovate under this SA.

Loots - Does language have our standard language?

Jayaraman - They asked me to take that out and said they’d be willing to take that risk.

Samolyk - Doesn’t all restaurants take that risk?

Oldenburg - Sometimes we don’t know what cert of occupancy says with new restaurants, it may

restrict that.

Samolyk - Our SA isn’t going to let them escape the law.

Oldenburg - They are still subject to the law.

what final seating is. It matters to me that…we’re setting an upper limit regardless than what it says.

Jayaraman - I’ve always seen it as an issue of noise if there’s more noise…

Oldenburg - Can I remind we do have 2 hours, but we do not have to use it.

Burger - We are taking out language at the request of applicant for questionable reasons. Even though

that language may be codified by law. … I don’t like the inconsistency.

Jayaraman - I would be happy to put it back in. What I will do is call them and put the language back

in.

Hoskins - What happens if they don’t sign it?

Jayaraman - We would protest.

Loots - We don’t need to. Here’s the update. In continued discussions, the applicant has agreed, with

assurance of sidewalk café to strike that language that ties together and includes the language on lids. I

have here a revised SA which incorporates the changes we voted on including the one we voted down.

I hope the new SA I have here today…we never voted on the as amended. So we pick up where we

left off with those amendments. Recognizing voluntarily they added language. This does in fact

address concerns priorly expressed and I am cautiously optimistic there are no further concerns. I

withdraw my previous motion. Instead I propose as substitute motion awe approve execution of SA as

amended and recommend to ABRA they approve the renewal of app of permit. 2nd

Jayaraman.

Hoskins - Any other changes?

Loots - The only changes to the document are those three things. One was removed, two were added.

Burger - Does the SA place limits on sidewalk café seating capacity?

Loots - That draft and other one incorporates by reference of the license not to exceed….

Samolyk - It is in the packet. Next month will be more in depth.

Hoskins - We had a great discussion with DCRA and she has been very responsive since.

Samolyk - It was good. I like getting the director into our committee hearings so they have more time

to talk to the neighbors. So we are not putting them in front of big monthly meetings to rush through.

Hoskins - It is as is, I’ve nothing additional to add. Does anyone have any questions?

Jayaraman - Hypothetically we needed guidance with protest hearing? Is expenditure allowed?

Hoskins - Yes. My understanding is we can hire counsel, they can advise us but cannot represent us.

Oldenburg - I know a certain board member of HPRB who will be saying something internally.

12. Letter to the U.S. Bureau of Prisons on a proposed Half Way House in 6B

Oldenburg - This is my letter about the potential halfway house at 8th

and M SE. You have the letter.

After I submitted it and circulated it. I had two push backs about Bachelor’s Mill language and I’m

quite willing to take that out. In fact that whole bullet point…there’s a tavern club next door…cause

disturbance……then that follows beer garden will be open. The intent is to say, two things. There’s

already activity in the neighborhood that is unwanted and there’s I don’t know how Bureau of Prisons

evaluate locations, I have no idea. I also understand from Martin Smith who lives near one of these

that what happens around these facilities but their friends come around and congregate around the area

in order to payback or get their grievances settled. So its just a part of the neighborhood they are

putting the facility there.

Burger - I would support the letter in general it’s a good letter. My only comment, reason why I will

support the letter, is that this is a very large facility. The same way there’s a problem with DC

General, that’s a problem here. I will say that part of the argument is this facility is close to alcohol

establishments, parks, schools. Name a location that is not near those things. I am a little resistant to,

this idea…it’s the same problem….I want to be careful

Chao – I think that our situation is unique. I would say that it is not everywhere in D.C. that you can

find two large public housing complexes within just two blocks away from where this proposed BoP

halfway house will be located. I echo the sentiment of commissioner Oldenburg. I and the neighbors

surrounding and within the Hopkins and Potomac Gardens housing have been working hard to address

crime at the pocket parks. We’ve met with DCHA Director, law enforcement, Mayor’s office, CM

Allen, etc. We know it is not the residents but those who drive from outside of our neighborhood to

visit and approach residents who are causing issues. We are dealing with open air drug market and

prostitution at the pocket parks and the issue at the end of the day is about public safety. And similar

to Hopkins and Potomac Gardens, this residential facility’s location abuts public parks. One pocket

park directly in front, across the street and another larger park less than 100 feet away.

At this proposed facility not only are there vulnerable population, school children mentioned by CM

Allen in his letter, in the morning, but also at night. I have friends who have frequented the gay bar

and I haven’t had the chance to but have been invited a few times. I know as a gay man that I would

not want to go if there are 300 former prisoners residing next door, unless I knew for certain that there

are enough patrols present in front of the bar at all times. I’m afraid that I could be a target of a

Hoskins - Following up on commissioner Chao’s comments. I question the 2nd

bullet. I wonder if we

can reframe the content a little and make it more about vulnerable people, potential vulnerable. I

understand rowdiness of bar. I don’t think that point helps us in this letter, saying there’s a loud

bar….it undermines more salient point which would be, you could be causing a potential problem by

bringing in criminals and putting them next to a gay bar. Potential hate crimes. Saying neighbors

don’t like that bar does not help the letter.

Jayaraman - It would stymie economic development, potentially brings in more crime for LGBT

community and students and seems to go against the Mayor’s plan to bring more economic

development to the area and plopping such a large facility with 300 beds.

Hoskins - Is it possible to move we support the letter and then add points we raised?

Oldenburg - I’m willing to work with everyone to capture what everyone is saying. I’m at a loss at this

point with what the language should be.

Burger - Can I move that we support the letter pending minor modifications?

Oldenburg - I just don’t want this to get too weakened. I never could find out if there’s a process for

this. I don’t know about timing. The letter I finally got was a letter to CM Allen which does say BOP

will be evaluating proposals and ask to express your comments/concerns. They didn’t come to us

though I have had a lengthy conversation with them about this. I’m OK with that.

I am a long-time resident of Capitol Hill. Along with my partner Joyce Jones, I

have lived on Capitol Hill since 1988 and in the 100 block of North Carolina Ave SE

since 1992. I retired from the federal government after working in health policy

research mainly in the areas of Medicare/Medicaid policy and health care delivery

systems for the elderly. I have a particular interest in issues affecting the Hill such

as the proliferation of commercial and association offices in predominately

residential areas and the various transportation (traffic) challenges spawned by

Coffee House Holdings, LLC Starbucks Coffee # 7610 237 Pennsylvania Avenue, SE Washington, DC 20003 At a publicly noticed monthly meeting of ANC 6B, ANC 6B voted _____ – ____ to send this letter in support of Starbucks efforts to take actions consistent with their commitment to maintaining the trash storage area and addressing rodent and vermin issues on the Premises of the store located at 237 Pennsylvania Avenue, SE. On May 10, 2016 ANC 6B voted to support renewal of Starbucks’s ABRA Class “DR” License No. 100610 and keep in force the Settlement Agreement (SA) that was negotiated and approved by ANC 6B in November 2015 and subsequently approved by ABRA. The SA included language related to refuse storage, disposal and sanitation and the maintenance of the trash storage area. 1. Replace or repair the concrete floor in the existing trash storage area in coordination with the landlord.

Currently, large cracks and divots in the concrete floor of the trash storage area prevents store personnel from being able to adequately clean or power wash the area. In keeping with their commitment to maintaining a clean trash storage area, Starbucks has proposed to repair or replace the concrete in collaboration with the landlord of the property. ANC 6B is appreciative of this initiative and supportive of any such efforts to the maintenance of the trash storage area.

2. Install wire mesh or other such material to prevent rodents and vermin from having access to a

crawl space behind the Premises.

Currently, there exists stairs that the lead down to a door labeled “Sprinkler Control Valve.” There is a sizable hole below this door that provides access to the crawl space and potentially provide an area for the harborage of rodents and vermin. In keeping with their commitment to addressing rodent issues, Starbucks has proposed to work with the landlord to install appropriate material, at their discretion, to prevent access to this the crawl space. ANC 6B is supportive of any such efforts to address rodent issues on the Premises or in the area.

ANC 6B appreciates the efforts of Starbucks and the landlord to take actions to improve the overall sanitation of the trash storage area and supports on-going efforts to rodent abatement. Adam Peters, head of Perseus, updated the committee on the revised Frager’s site plans. HPRB

recommended refinements to the design, including changes to materials. The revised design has updated

colors and materials, especially to the new construction 3rd story. Delineation between two existing

facades increased, and one of the infill bays was pulled down to the street (no protrusion). Rear materials

were changed to fit better with the townhouses to the south of the project.

By unanimous consent, the committee took no action.

2. HPA 16-441, 120 6th

Street SE, raze of 2-story carriage house and construction of 2-story carriage

house: Brad Kenemuth (applicant)

Becky and Brad Kenemuth, homeowners, presented the case. The project consists of a proposed raze of

an existing carriage house and replacement with a 23-foot tall garage. Building was design based on

direct input from HPO. There is support from neighbors (including abutting) and CHRS. Proposed use is

short-term rental and personal use.

Commissioner Burger moved (seconded by Commissioner Samolyk) that the committee support the case

and place the item on the consent agenda. The motion passed 8 to 0.

3. HPA 16-434, 622-624 North Carolina Avenue SE, partial in-fill of dogleg and 3rd floor addition:

Kenneth Golding

Ken Golding, owner and his architect presented the case. The applicant proposes infill and an addition,

including an elevator (to support aging in place). Proposal is to keep 3 units (as existing), go up one floor

and then a penthouse. Letters of support from one adjacent neighbor (626) and CHV. The other abutting

neighbor (618) is not opposed, and she expressed she was at the meeting to learn about process—her

questions are more about construction than design. The committee’s questions focused on the visibility

from the street, both front and rear, and whether there are alternative designs that could reduce the

visibility.

5. HPA 16-449, 1237 (Rear) C Street SE, conversion of alley warehouse into residential housing: Sean

Ruppert, Opal.

Sean Ruppert, developer, presented the proposed conversion of vacant warehouse to 3-unit residential

building in an alley in the historic district. Proposal is to expand the building on the north and west, using

a combination of traditional (brick) and modern (aluminum panels) materials. A neighbor who owns two

properties in the alley, with one opening onto the alley, asked about access to her buildings. Michael

Lawson (1241 C St), another neighbor, was generally supportive, asked the committee to keep the case

off consent agenda.

Commissioner Burger moved (seconded by Commissioner Oldenburg) that the committee recommend

the ANC support the application. The motion passed 7 to 0 (1 abstaining).

6. BZA # 19294, 328 D Street SE. Andrew Devine. Hearing date: July 12, 2016 Application of Andrew Devine, pursuant to 11 DCMR § 3104.1, for a special exception under § 223, not

meeting the lot occupancy requirements under § 403.2, the side yard requirements under § 405.9, and the

court requirements under § 406.1, to construct a rear addition to an existing one-family dwelling in the

CAP/R-4 District at premises 328 D Street S.E. (Square 792, Lot 801).

Andrew Devine, owner, presented the case. The applicant proposes a rear addition that maintains existing

side structure lines and expands lot occupancy to ~56% (up from 42%). [Note: property includes a side

yard thus maximum allowed lot occupancy by right is 40%.] Owner has spoken with all three immediate

neighbors. Commission Hoskins facilitated conversations with the neighbors.

Commissioner Burger moved (seconded by RM Johnson) that the committee recommend the ANC

support the case and place the item on the consent agenda. The motion passed 9 to 0.

7. DDOT Tracking #10237104, Bullfrog Bagels, 317 7th Street SE, sidewalk café. [Due June 29, 2016]

Matthew Frumin, zoning lawyer, and Jeremiah Coh, the owner, presented the application. They propose

a first floor patio with raised counter and seating, with two porch seats. The second floor balcony would

have two two-person tables. There would be a total of 12 seats in public space. Questions from the

committee focused on the seating design and table height, including materials proposed. The applicant

8. Letter to DGS supporting removal of a tree outside Congressional Cemetery.

9. ZC 15-33, Insight E Street LLC PUD: Sarah Davison. Hearing June 30, 2016 Consolidated PUD & Related Map Amendment from C-M-1 to R-5-B, 1339, 1343-1345 & 1351-1355 E

Sarah Davidson, partner, IPG and her team presented the proposed PUD application. The project would

involve rezoning a C-M-1 (light industrial) site to R-5-B for a ~150 unit apartment building. They

walked through the design, attention to neighbor concerns on the alley system and for the massing. The

transportation expert discussed the transportation impacts.

Commissioner Burger moved (seconded by RM Foster) that the committee recommend the ANC support

the PUD application. In addition, the ANC will convey its support for the project design, MOUs, and

benefits and amenities documents to the ZC. The ANC will also authorize the Chair to designate a

representative to testify before the ZC at future ZC hearings for this case.

Announcements:

Update on 17th Street SE Pedestrian Safety project—The DDOT project director informed

Commissioner Oldenburg on 5/16 that the RFP for the work was advertised on 4/28 with a

closing date in June.1 DC Water is still estimating that its 17

th Street main replacement project

will conclude at the end of June 2016 and will, thus, be out of DDOT’s way. Washington Gas is

continuing its work along the street in coordination with DDOT.

DDOT to hold its public kick-off meeting on the Downtown West Transportation Planning Study

on June 15, 2016, at 6pm, at the MLK Jr. Library.

DDOT DC State Rail Plan

John Manley provided an overview of this ongoing study, based on the Open House held on June 7, 2016,

at Eastern Market’s North Hall. The plan will cover both freight and passenger rail but does not include

Metro rail. The goals of the plan will be to: (1) enhance safety and security, (2) increase operational

flexibility, (3) provide added rail capacity, (4) grow economic opportunity, and (5) improve quality of

Currently, the study has identified a list of possible projects and initiatives. All documents from the June

7th open house are available at http://www.dcrailplan.com/library under Public Meeting Materials. Those

who did not attend the open house can send comments on the list to [email protected] by July 8,

2016. It is anticipated that the Committee will have an opportunity to discuss this fully at a future

meeting with the DDOT project director, Ryan Westrom.

Review of DDOT Pennsylvania Avenue SE Street Lighting Improvements

This project was initiated by DDOT in January 2016. Commissioner Oldenburg was unable to

obtain an update from DDOT on its status prior to the meeting. It is obvious, however, that the

suggested “short term” remedy has been accomplished as new LED luminaires installed on the

existing infrastructure are easy to spot at each intersection.

The next step is to obtain information from DDOT as to whether the follow up analysis has been

completed and, if so, to obtain the results. Commissioner Oldenburg plans to have a

representative present at the July meeting. Meanwhile, for background, the DDOT manual on

DDOT Pennsylvania Avenue SE Signal Synchronization: Preparation of list of critical

intersections

The DDOT project director—Mr. Wasim Raja—was unable to attend the committee meeting but

will attend the September 7, 2016, meeting. At that point, the first phase of the synchronization

process (“conversion of controller firmware from old interval-based operation to phase-based

operation”) will be completed. Phase 2 (implementation) is planned for Winter 2016-2017. In

the meantime, Mr. Raja asked if the committee would provide a list of intersections and specific

signal timing concerns so they can be included in the project’s evaluations.

After some discussion, the committee concluded that

A normal adult needs 35-40 seconds to walk north or south across the avenue. Currently, this

amount of time is only provided at 7th

and 8th

Streets SE. At other intersections pedestrian

crossing times range from 11 seconds to 25 seconds and vary according to the time of day

and day of the week. As noted in the ANC 6B letter to DDOT in May 2013, because of the

wide median along the avenue, DDOT expects pedestrians to halt on the median and await an

entire cycle until continuing their journey across the avenue. Pedestrians rarely do this,

preferring to cross against the signal.

Vehicles traveling east/west along the avenue ought to be given priority during weekday

morning and evening rush hours. Otherwise, pedestrians ought to be given priority.

We need clarification on why at some intersections the pedestrian crossing times differ

between the east and west sides. An example is at 11th

Street where pedestrians cannot

complete a southward crossing on the east side because the signal times on each side of the

median differ (i.e., one side is shorter than the other) but can just barely make it on the west

side. Conversely, crossing northward is best on the east side of the intersection. A similar

situation occurs at 6th

Street.

We would like to know if the Penn/Potomac/14th Street intersections crossings will be included in the

current synchronization since a final decision on the Penn/Potomac EA is still pending. Currently, the

shortest timed crossings for pedestrians are from SE corner of 14th Street SE north to Potomac Metro

plaza and from Potomac Metro plaza south to Jenkins Row.

Commissioner Oldenburg will send these conclusions/questions to Mr. Raja.

Recent and Upcoming Activities

1. Schedule: Discuss schedule of activities.

a. 4 Week Look-ahead schedule from Clark Construction and McCullough

Construction

i. Saturday workday procedures – review attached log of lost workdays.

ii. Towards the end of June, Miller & Long will be using outside concrete

while working on power underneath the batch plant.

b. Projected Project Milestones (subject to adjustment):

i. Excavation Complete – March 2016 CLOSED

ii. Building Structure to Grade – July 2016

iii. Structure Above Grade Complete – September 2016

iv. Façade Installation – May to December 2016

v. Unit Deliveries and Retail/Office Openings – June 2017

vi. North Building roof to be installed June 2016.

vii. Clark is pouring concrete for the Plaza Building (SE corner opposite

Eastern Market) and expects to top out by the end of June.

viii. Top out on the 8th

Street building is expected by mid-July.

ix. Clark expects to be pouring concrete to grade at the Office Building

(Southwest corner) in June.

2. Construction Staging Area Weekend/Evening Parking – Toward the end of June Miller &

Long will be using concrete trucks while power work is being done underneath the Batch

Plant. This will mean additional concrete trucks along 8th

Street and the D Street spur.

Developers were urged to employ more flagmen and to reinstall the crosswalk stop sign

at 8th

& C Streets SE. Developers were reminded that school will be letting out soon

resulting in more local and tourist pedestrian traffic. In response to multiple complaints

about construction vehicles blocking the visibility of the stop sign at 8th

& C SE Clark

responded that DDOT prevented any measures to place temporary barriers in the space

between the north alley and the stop sign. Since then plastic barrels have been placed in

that spot and the tree by the stop sign has been trimmed. DDOT reportedly remains

unresponsive to the developers’ request that the staging permit not include hours outside

their legal work hours so that private vehicles can use the 8th

Street spots without getting

ticketed. CAC members were urged to contact DDOT directly.

3. Construction Parking - workers continue to park in the neighborhood in violation of the

CMA.

4. Vibration Monitoring – SEB will continue to post reports on vibration monitoring from

its ECS to the project website.

5. Disruption of Utility Services (Article 13)

a. Pepco and Clark are continuing installation of Permanent Power vaults in C

6. D Street Closure Permit extended through 6/30/16 to accommodate concrete trucks

7. Rodent Control – “Vector control” measures ongoing but problems have been noted

around 7th

8. Dust Control (Article 14) – Clark Dust Control plan posted on project website.

9. Site Cleanliness (Article 18) – CAC to discuss site cleanliness at each CAC meeting and

provide feedback to SEB/Clark.

10. Construction Work Hours and Noise (Article 19) – DC Code Construction Hours are

7AM to 7PM. CMA requires that Saturday hours are from 8:00 AM to 4:00 PM.

Repeated violations of the work hours have occurred, especially on May 25th
