AFFIDAVIT OF WITNESS

I, NORVILLOS BARDILLAS, Filipino, of legal age, and a resident of Mohon Talisay City, Cebu, after having sworn in accordance with law, do hereby depose and state THAT:

1. On March 16, 2016, at about 10:00 o’clock in the morning, I and my cousin Lloyd Ybanez (Ybanez) went to Parkmall. When we were inside the mall, a crew of a Food Cart called our attention and introduced himself as Jesusimo Buensuceso, (Buensuceso) an agent of EIGHT IN ONE FOOD CONCEPT, (EIOFC for brevity) a Food Cart Franchising Business. He gave us a brochure about a special promotion of Food Cart Franchising business and tried to convince us to engage in the said business.

2. My cousin Ybanez was interested to engage in the said business. Buensuceso accompanied us in their EIOFC office located at 562-A ML Quezon St., Maguikay, Mandaue City so we can talk with the owner named Francisca Mangalindan (Mangalindan for brevity) to discuss the possible investment and the perks of availing the said franchising business.

3. When we were in the office, Buensuceso introduced us to a certain Henry Fernandez, as staff employee of EIOFC and because the latter will be the one to explain on us about the details of the business. My cousin Ybanez hurled several questions and inquiries to Fernandez concerning the but because he cannot answer some of the queries, he referred us to talk with the Mangalindan directly.

4. After a couple minutes waiting, a woman went outside the room in the office, approached us, seated with us in the table and introduced herself as Francisca Mangalindan, the owner of EIOFC. She discussed and oriented us on the nature of the business, how profitable it is and our capital investment will be returned in just a matter of six months’ time.

5. I heard Mangalindan offering to my cousin Ybanez the following as part of their agreement if my cousin Ybanez would invest in the two food carts amounting to Four Hundred Thousand Pesos (P400,000.00):

a. That she will deliver the Two (2) Food Carts in the location where it would start business operation a week after my cousin Ybanez would pay the amount of investment for the two food carts;

b. That it is the sole responsibility of EIOFC to provide the location of the business where it would generate customers without any hassle from my cousin because they will be the one to find locations for my food carts;

c. That she shall be the one to hire for the crew and for the training of the crew and that upon the start of the business operation of my cousin’s food cart business, crew are already are already hired, screened and well-trained by EIOFC;

d. That she assured to my cousin that the least amount of sales he would earn daily would not be below FOUR THOUSAND PESOS (P4,000.), that is only the minimal he could earn so that in just six months’ time he would have earned double of his invested capital;

e. That she would also hire a manager aside from the crew to take charge of the business and that what my cousin needs to do is to just invest the amount for the two food carts and he will only have to wait for the operation of the food cart business one week after payment a collect the inconceivable huge return of his investment.

6. I executed this affidavit to attest the truthfulness of the foregoing facts and to support the filing of Criminal Case against FRANCISCA MANGALINDAN and JESUSIMO FELIPE BUENSUCESO for the crime of SWINDLING (ESTAFA)
