Article 1.—CERTIFICATION OF PSYCHOLOGISTS 102-1-8a. Renewal audit. (a) A random audit of the continuing education documentation for 10 percent of the psychologist licenses expiring during each license renewal period shall be con- ducted by the board. (b) Each licensee selected for the random audit shall be notified in writing after the board has re- ceived the psychologist’s renewal application form required by K.A.R. 102-1-8. (c) Upon board notification, each renewal ap- plicant for a psychologist license shall submit the following to the board within 30 days after the license expiration date: (1) The completed renewal audit forms; and (2) the original continuing education docu- ments that validate all continuing education units claimed for credit during the current renewal period. (d) Continuing education units that a renewal applicant for a psychologist license earns after board receipt of the renewal application form shall not be approved for continuing education credit for the current renewal period. (e) Failure to comply with this regulation shall be considered unprofessional conduct. (Author- ized by and implementing K.S.A. 74-5318 and K.S.A. 2007 Supp. 74-7507; effective Feb. 13, 2009.) 102-1-13. Fees. Article 1.—CERTIFICATION OFPSYCHOLOGISTS

102-1-8a. Renewal audit. (a) A randomaudit of the continuing education documentationfor 10 percent of the psychologist licenses expiringduring each license renewal period shall be con-ducted by the board.

(b) Each licensee selected for the random auditshall be notified in writing after the board has re-ceived the psychologist’s renewal application formrequired by K.A.R. 102-1-8.

(c) Upon board notification, each renewal ap-plicant for a psychologist license shall submit thefollowing to the board within 30 days after thelicense expiration date:

(1) The completed renewal audit forms; and(2) the original continuing education docu-

ments that validate all continuing education unitsclaimed for credit during the current renewalperiod.

(d) Continuing education units that a renewalapplicant for a psychologist license earns afterboard receipt of the renewal application formshall not be approved for continuing educationcredit for the current renewal period.

102-1-13. Fees. (a) Each applicant for li-censure as a psychologist shall pay the appropriatefee as specified in this subsection:

(1) Application for a license, $225;(2) original license, $50;

(3) renewal, $200;(4) duplicate license, $20;(5) temporary license, $150;(6) temporary license renewal fee, $150;(7) specialty endorsement, $130;(8) temporary, 15-day permit for an out-of-state

professional, $200; or(9) temporary, 15-day permit for an out-of-state

professional extension, $200.(b) Each applicant for a license renewal after

its expiration date shall pay an additional fee of$200, as well as the renewal fee of $200.

(c) Fees paid to the board shall not be refund-able. Article 2.—LICENSING OF SOCIALWORKERS

102-2-3. Fees. (a) Each applicant for a newsocial work license shall pay the appropriate ap-plication fee as follows:

(1) Licensed baccalaureate social worker(LBSW): $100.00;

(2) licensed master social worker (LMSW):$100.00;

(3) licensed specialist clinical social worker(LSCSW): $100.00;

(4) temporary license fee: $50.00;(5) temporary, 15-day permit for an out-of-state

professional: $200; and(6) temporary, 15-day permit for an out-of-state

professional extension: $200.(b) Each applicant for a new social work license

shall pay the appropriate original license fee asfollows:

(1) Licensed baccalaureate social worker(LBSW): $100.00;

(2) licensed master social worker (LMSW):$150.00; and

(3) licensed specialist clinical social worker(LSCSW): $150.00.

(c) Each applicant for license renewal shall paythe applicable fee as follows:

(1) Licensed associate social worker (LASW):$100.00;

(2) licensed baccalaureate social worker(LBSW): $100.00;

(3) licensed master social worker (LMSW):$125.00; and

(4) licensed specialist clinical social worker(LSCSW): $150.00.

(d) Each applicant for license reinstatement af-ter the date of its expiration shall pay, in additionto the renewal fee, the applicable penalty fee asfollows:

(1) Licensed associate social worker (LASW):$100.00;

(2) licensed baccalaureate social worker(LBSW): $100.00;

(3) licensed master social worker (LMSW):$125.00; and

(4) licensed specialist clinical social worker(LSCSW): $150.00.

(e) The fee for a replacement license shall be$20.00, and the fee for a replacement wallet cardlicense shall be $2.00.

(f) Each provider of continuing education pro-grams shall pay the applicable fee as follows:

(1) One-year, provisional approved provider ap-plication fee: $100.00;

(2) three-year approved provider renewal fee:$250.00; and

(3) single-program provider fee: $50.00.(g) Fees paid to the board shall not be refund-

able. 102-2-8. Supervision. (a) Supervision ofnonlicensed social work service providers whoparticipate in the delivery of social work services.

(1) Social work consultation shall not meet thesupervision requirements for any nonlicensed so-cial work service provider.

(2) Each licensee supervising one or more non-licensed individuals who participate in the deliv-ery of social work services shall specifically delin-eate the duties of each non- licensed individualand provide a level of supervision that is consistentwith the training and ability of the nonlicensedsocial work service provider.

(3) Each licensee supervising one or more non-licensed persons who participate in the delivery ofsocial work services shall develop a written agree-ment. The agreement shall consist of specificgoals and objectives, the means to attain the goals,and the manner in which the goals relate to theoverall objective for supervision of the nonli-censed social work service provider. The licenseeshall maintain the following documentation asso-ciated with the written agreement:

(A) A copy of the written agreement signed byboth the licensee and the nonlicensed person;

(B) a summary of the types of clients and situ-ations dealt with at each supervisory session;

(C) a written explanation of the relationship ofthe goals and objectives of supervision to each su-pervisory session; and

(D) the length of time spent in each supervisorysession.

(4) The supervisor shall provide no fewer thanfour hours of supervision per month for eachsupervisee.

(5) The supervisor shall not have a dual rela-tionship with the supervisee.

(b) Supervision of nonlicensed student socialwork service providers.

(1) Social work consultation shall not meet thesupervision requirements for any nonlicensed stu-dent social work service provider.

(2) Each licensee supervising one or more non-licensed students in the delivery of social workservices shall specifically delineate each student’sduties and provide a level of supervision consis-tent with the training and ability of each student.

(3) Each licensee supervising one or more non-licensed students who participate in the deliveryof social work services shall develop a writtenagreement for each student that is consistent withthe requirements of the student’s academic socialwork program.

(4) The supervisor shall not have a dual rela-tionship with the supervisee.

(c) Supervision of holders of temporary socialwork licenses.

(1) Social work consultation shall not meet thesupervision requirements for any holder of a tem-porary social work license.

(2) Each licensee supervising one or more in-dividuals who hold a temporary social work licen-sure permit shall specifically delineate the dutiesof each temporary license holder and provide alevel of supervision consistent with the trainingand ability of each individual.

(3) Each licensee supervising a temporary socialwork license holder and that individual shall de-velop a written agreement. This agreement shallconsist of specific goals and objectives, the meansto attain the goals, and the manner in which thegoals relate to the overall objective for supervisionof that person. The licensee shall maintain the fol-lowing documentation associated with the writtenagreement:

(A) A copy of the written agreement signed byboth the licensee and the temporary social worklicense holder;

(B) a summary of the types of clients and situ-ations dealt with at each supervisory session;

(C) a written explanation of the relationship ofthe goals and objectives of supervision to each su-pervisory session; and

(D) the length of time spent in each supervisorysession.

(4) A minimum of one hour of supervision shallbe provided for each 40 hours of service delivery.

(5) The supervisor shall not have a dual rela-tionship with the supervisee.

(d) Supervision of persons engaged in privatepractice or persons seeking licensure as a special-ist clinical social worker.

(1) A licensed specialist clinical social workershall supervise the practice or delivery of socialwork services by the following persons:

(A) Any licensee who is attaining the two yearsof supervised experience required for licensure asa specialist clinical social worker; and

(B) any licensee who is not a licensed specialistclinical social worker and who is engaged in pri-vate practice.

(2) Any person attaining the supervised expe-rience required for licensure as a specialist clinicalsocial worker may be supervised by a social workerwho is licensed as a clinical social worker author-ized to engage in the private, independent prac-tice of social work in another state and who is oth-erwise qualified.

(3) Supervisor qualifications. To qualify as a su-pervisor, a licensed specialist clinical social workershall fulfill these requirements:

(A) Have practiced as a specialist clinical socialworker, in a position that included assessment, di-agnoses, and psychotherapy, for two years beyondthe date of clinical licensure. This requirementshall apply to each individual commencing a newsupervisory relationship on or after April 15, 2009;

(B) have, in full or in part, professional respon-sibility for the supervisee’s practice of social workor delivery of social work services;

(C) not have a dual relationship with thesupervisee;

(D) not be under sanction from a disciplinaryproceeding, unless this prohibition is waived bythe board for good cause shown by the proposedsupervisor;

(E) have knowledge of and experience with thesupervisee’s client population;

(F) have knowledge of and experience with themethods of practice that the supervisee employs;

(G) have an understanding of the organizationand administrative policies and procedures of thesupervisee’s practice setting; and

(H) be a member of the staff for that practicesetting or meet the requirements of paragraph(d)(4).

(4) If a qualified supervisor is not available fromamong staff in the supervisee’s practice setting,the supervisee may secure an otherwise qualifiedsupervisor outside of the practice setting if all ofthe following conditions are met:

(A) The supervisor has a complete understand-ing of the practice setting’s mission, policy, andprocedures.

(B) The extent of the supervisor’s responsibility

for the supervisee is clearly defined with respectto client cases to be supervised, the supervisor’srole in personnel evaluation within the practicesetting, and other aspects of the clinical supervi-sion training plan.

(C) The responsibility for payment for super-vision is clearly defined.

(D) If the supervisee pays the supervisor di-rectly for the supervision, the supervisor main-tains responsibility to the client and to the practicesetting.

(E) The parameters of client confidentiality areclearly defined and agreed to by the client.

(5) Supervisory duties. Each social work prac-tice supervisor shall perform these duties:

(A) Meet in person or by videoconferencing ac-cording to K.A.R. 102-2-12(c)(4) with the super-visee for clinical supervision throughout the post-graduate supervised professional experience at aratio of a minimum of one hour of clinical super-vision for every 20 hours of direct, face-to-faceclient contact, with a maximum of two hours ofsupervision allowed for each 20 hours of clinicalsocial work practice to be counted toward licen-sure requirements;

(B) meet with not more than four superviseesat a time in the supervisory meetings;

(C) provide oversight, guidance, and directionof the supervisee’s practice of social work or de-livery of social work services by assessing and eval-uating the supervisee’s performance;

(D) conduct supervision as a process distinctfrom personal therapy, didactic instruction, or so-cial work consultation;

(E) ensure that the scope of the supervisor’sown responsibility and authority in the practicesetting has been clearly and expressly defined;

(F) provide documentation of supervisory qual-ifications to the supervisee;

(G) periodically evaluate the supervisee’s role,use of a theoretical base, and use of social workprinciples;

(H) provide supervision in accordance with thewritten clinical supervision training plan;

(I) maintain documentation of supervision;(J) provide the documentation required by the

board upon a supervisee’s application for licen-sure in sufficient detail to enable the board toevaluate the extent and quality of the supervisee’ssupervised experience;

(K) provide a level of supervision that is consis-tent with the education, training, experience, andability of the supervisee; and

(L) ensure that each client knows that the su-pervisee is practicing social work or participatingin the delivery of social work services undersupervision.

(6) Clinical supervision training plan. Each su-pervisor and supervisee shall develop and co-signa written clinical supervision training plan at thebeginning of the supervisory relationship. The su-pervisee shall submit an official position descrip-tion and the training plan to the board and shallreceive board approval of the plan before any su-pervised professional experience hours for clinicallicensure can begin to accrue. This plan shallclearly define and delineate the following items:

(A) The supervisory context, which shall includethe purpose of supervision;

(B) a summary of the types of clients withwhom and the situations in which the superviseewill typically work, as evidenced by the super-visee’s official position description;

(C) a plan that describes the supervision goalsand objectives, the means to attain and evaluateprogress towards the goals, and the manner inwhich the goals relate to the overall objective ofsupervision;

(D) the format and schedule for supervision;(E) the supervisor’s responsibilities;(F) the supervisee’s responsibilities;(G) the plans for both the supervisee’s and su-

pervisor’s documentation of the date, length,method, content, and format of each supervisorymeeting and the supervisee’s progress toward thelearning goals;

(H) the plans for documenting the 4,000 hoursof postgraduate supervised clinical social work ex-perience, which shall include specifically docu-menting the 1,500 hours of direct client contactproviding psychotherapy and assessment;

(I) the plan for notifying clients of the followinginformation:

(i) The fact that the supervisee is practicing so-cial work or participating in the delivery of socialwork services under supervision;

(ii) the limits of client confidentiality within thesupervisory process; and

(iii) the name, address, and telephone numberof the supervisor or other person with administra-tive authority over the supervisee;

(J) a plan to address and remedy circumstancesin which there is a conflict between the supervisorand the supervisee;

(K) the date on which the supervisor and su-pervisee entered into the clinical supervision

training plan, the time frame that the plan is in-tended to encompass, and the process for termi-nation of the supervisory relationship by eitherparty;

(L) the steps for amending or renegotiating theclinical supervision training plan, if warranted, in-cluding written notification of these changes tothe board office as provided in paragraph (d)(7);and

(M) a statement identifying the person who isresponsible for payment, the terms of payment,and the mutual obligations and rights of eachparty with respect to compensation, if there is anycompensation for supervisory services.

(7) Revision of the clinical supervision trainingplan. All changes to the clinical supervision train-ing plan shall be submitted by the supervisee tothe board for its approval. The changes shall besubmitted no more than 45 days after the date onwhich the changes took effect. If the superviseefails to submit the changes to the board within that45-day period, no supervised hours of practiceshall be accrued or credited for any practice, be-ginning on the date the changes took effectthrough the date on which the changes to the planare approved by the board. 102-2-12. Licensed specialist clinical so-cial work licensure requirements. (a) Educa-tional requirements. In order for an applicant whoearns a degree before July 1, 2003 to qualify forlicensure as a licensed specialist clinical socialworker, the applicant shall meet, as a part of or inaddition to the educational requirements pro-vided in K.S.A. 65-6306, and amendmentsthereto, the following educational requirements:

(1) Satisfactory completion of at least threegraduate academic hours in a discrete academiccourse whose primary and explicit focus is uponpsychopathology and the diagnosis and treatmentof mental disorders classified in the diagnosticmanuals commonly used as a part of accepted so-cial work practice;

(2) satisfactory completion of a graduate-level,clinically oriented social work practicum that ful-fills these requirements:

(A) Is taken after completion of the graduate-level, clinically focused academic courses that areprerequisite to entering the clinical practicum;

(B) is an integrated, conceptually organized ac-ademic experience and is not an after-the-fact tab-ulation of clinical experience;

(C) occurs in a practice setting that, by its na-ture and function, clearly supports clinical socialwork practice and consistently provides opportu-nities for the supervised application of clinical so-cial work practice knowledge, skills, values, andethics; and

(D) provides training and close supervision in awide range of clinical social work practice activi-ties with a population of clients presenting a di-verse set of problems and backgrounds.

(b) Each applicant for licensure as a specialistclinical social worker who earns a degree on orafter July 1, 2003 shall meet the followingrequirements:

(1) Satisfactory completion of 15 graduate-levelcredit hours supporting diagnosis or treatment ofmental disorders using the diagnostic and statis-

tical manual of mental disorders as specified inK.A.R. 102-2-14. Three of the 15 credit hoursshall consist of a discrete academic course whoseprimary and explicit focus is upon psychopathol-ogy and the diagnosis and treatment of mental dis-orders as classified in the diagnostic and statisticalmanual of mental disorders. The 15 graduate-levelcredit hours shall be from a social work programaccredited by the council on social work educationor a social work program in substantial complianceas prescribed in K.A.R. 102-2-6 and approved bythe board; and

(2) completion of one of the following experi-ence requirements:

(A) A graduate-level, supervised clinical prac-ticum of professional experience that includespsychotherapy and assessment. The practicumshall integrate diagnosis and treatment of mentaldisorders with use of the diagnostic and statisticalmanual of mental disorders as identified in K.A.R.102-2-14 and shall include not less than 350 hoursof direct client contact; or

(B) postgraduate supervised experience includ-ing psychotherapy and assessment. The experi-ence shall integrate diagnosis and treatment ofmental disorders with use of the diagnostic andstatistical manual of mental disorders, as specifiedin K.A.R. 102-2-14. The experience shall consistof not less than 700 hours of supervised experi-ence, including not less than 350 hours of directclient contact. This experience shall be in additionto the 4,000 hours of postgraduate, supervised ex-perience required for each licensed specialist clin-ical social worker, as specified in subsection (c).The applicant shall provide documentation of thispostgraduate experience on board-approvedforms. The supervision shall comply with K.A.R.102-2-8 and K.A.R. 102-2-12(c) and shall be inaddition to the supervision requirements inK.A.R. 102-2-12(c)(4).

(c) Each applicant for licensure as a specialistclinical social worker shall fulfill the followingrequirements:

(1) Develop and co-sign with the supervisor aclinical supervision training plan for the postgrad-uate supervised clinical experience required un-der K.S.A. 65-6306 and amendments thereto, onforms provided by the board. The applicant shallsubmit this plan to the board for consideration forapproval before beginning clinical supervision.The clinical supervision training plan shall complywith K.A.R. 102-2-8. If changes or amendmentsto the plan occur after initial board approval, these

changes or amendments shall be submitted to theboard for consideration for approval;

(2) complete, in not less than two years and notmore than six years, a minimum of 4,000 hours ofsatisfactorily evaluated postgraduate, supervisedclinical social work practice experience under thesupervision of a qualified licensed specialist clin-ical social worker. A minimum of 2,000 hours ofthe applicant’s total postgraduate, supervised clin-ical experience shall consist of a combination ofthe following types of social work services:

(A) At least 1,500 hours of direct client contactconducting psychotherapy and assessments withindividuals, couples, families, or groups; and

(B) up to 500 hours of providing clinical socialwork practice services;

(3) complete all required practice under super-vision in accordance with K.A.R. 102-2-8; and

(4) participate in a minimum of 100 supervisorymeetings consisting of not less than 150 hours ofclinical supervision. A minimum of 75 hours of the150 required hours of supervision shall be indi-vidual supervision, of which at least 50 hours shallbe obtained in person. The remainder of the 150required hours may be obtained in person or, ifconfidentiality is technologically protected, by vi-deoconferencing. Each applicant using videocon-ferencing shall provide written verification of thetechnological security measure implemented. Thesupervision shall integrate the diagnosis and treat-ment of mental disorders with the use of the di-agnostic and statistical manual of mental disordersspecified in K.A.R. 102-2-14. A maximum of twohours of supervision shall be counted for each 20hours of clinical social work practice.

(d) At the time of the individual’s applicationfor licensure as a specialist clinical social worker,the applicant’s supervisor shall submit documen-tation that is satisfactory to the board and that en-ables the board to evaluate the nature, quality, andquantity of the applicant’s supervised clinical so-cial work experience. This documentation shall in-clude the following information:

(1) A written summary of the types of clientsand situations dealt with during the supervisorysessions;

(2) a written summary that addresses the de-gree to which the goals and objectives of super-vision have been met;

(3) a written statement and supportive docu-mentation that describes the applicant’s practicesetting and provides a summary of the applicant’s

practice activities and responsibilities that oc-curred while under supervision;

(4) a statement indicating whether or not theapplicant merits the public trust; and

(5) an evaluation of the applicant’s supervisedclinical social work experience. Article 3.—PROFESSIONALCOUNSELORS; FEES

102-3-3a. Education requirements. Toqualify for licensure as a professional counselor ora clinical professional counselor, the applicant’seducation shall meet the applicable requirementsprovided in the following subsections.

(a) (1) ‘‘Core faculty member’’ means an indi-vidual who is part of the program’s teaching staffand who meets the following conditions:

(A) Is an individual whose education, training,and experience are consistent with the individual’srole within the program and are consistent withthe published description of the goals, philosophy,and educational purpose of the program;

(B) is an individual whose primary professionalemployment is at the institution in which the pro-gram is housed; and

(C) is an individual who is identified with theprogram and is centrally involved in program de-velopment, decision making, and student trainingas demonstrated by consistent inclusion of the in-dividual’s name in public and departmentaldocuments.

(2) ‘‘In residence,’’ when used to describe a stu-dent, means that the student is present at thephysical location of the institution for the purposeof completing coursework during which the stu-dent and one or more core faculty members arein face-to-face contact.

(3) ‘‘Primary professional employment’’ meansat least 20 hours per week of instruction, research,any other service to the institution in the courseof employment, and the related administrativework.

(b) At the time of application, each applicantshall have fulfilled the following requirements:

(1) Received either a master’s or doctoral de-

gree in counseling from a program that meets oneof the following requirements:

(A) Is not below the accreditation standards ofthe council for the accreditation of counseling andrelated educational programs; or

(B) meets the requirements in subsections (f)and (g); and

(2) as a part of or in addition to the courseworkcompleted for the counseling graduate degree,completed at least 60 graduate semester hours, orthe academic equivalent, of which at least 45 grad-uate semester hours, or the academic equivalent,shall clearly satisfy the coursework requirementsin subsection (c).

(c) Each applicant shall have satisfactorily com-pleted formal academic coursework that contrib-utes to the development of a broad conceptualframework for counseling theory and practice asa basis for more advanced academic studies. Thisformal academic coursework shall consist of atleast 45 graduate semester hours, or the academicequivalent, that are distributed across the sub-stantive content areas provided in this subsection.None of these credit hours shall be earnedthrough independent study courses. There shallbe at least two discrete and unduplicated semesterhours, or the academic equivalent, in each of thefollowing substantive content areas:

(1) Counseling theory and practice, which shallinclude studies in the basic theories, principles,and techniques of counseling and their applica-tions to professional settings;

(2) the helping relationship, which shall includestudies in the philosophical bases of helping re-lationships and the application of the helping re-lationship to counseling practice, as well as an em-phasis on the development of practitioner andclient self-awareness;

(3) group dynamics, processes, and counselingapproaches and techniques, which shall includestudies in theories and types of groups, as well asdescriptions of group practices, methods, dynam-ics, and facilitative skills;

(4) human growth and development, whichshall include studies that provide a broad under-standing of the nature and needs of individuals atall developmental levels and in multiculturalcontexts;

(5) career development and lifestyle founda-tions, which shall include studies in vocational the-ory, the relationship between career choice andlifestyle, sources of occupational and educationalinformation, approaches to career decision-

making processes, and career development explo-ration techniques;

(6) appraisal of individuals and studies andtraining in the development of a framework forunderstanding the individual, including methodsof data gathering and interpretation, individualand group testing, and the study of individualdifferences;

(7) social and cultural foundations, which shallinclude studies in change processes, ethnicity,subcultures, families, gender issues, the changingroles of women, sexism, racism, urban and ruralsocieties, population patterns, cultural mores, useof leisure time, and differing life patterns. Thesestudies may come from the behavioral sciences,economics, political science, and similardisciplines;

(8) research and evaluation, which shall includestudies in the areas of statistics, research design,development of research, development of pro-gram goals and objectives, and evaluation of pro-gram goals and objectives;

(9) professional orientation, which shall includestudies in the goals and objectives of professionalorganizations, codes of ethics, legal considera-tions, standards of preparation and practice, cer-tification, licensing, and the role identities ofcounselors and others in the helping professions;and

(10) supervised practical experience, whichshall include studies in the application and prac-tice of the theories and concepts presented in for-mal study. This experiential practice shall be per-formed under the close supervision of theinstructor and on-site supervisor with the use ofdirect observation and the preparation and reviewof written case notes. Direct observation may in-clude the use of one-way mirrors in a counselinglaboratory, the use of videotaped or audiotapedsessions, or the use of real-time video conferenc-ing or similar synchronous communicationdevices.

(d) Each applicant for licensure as a clinicalprofessional counselor whose master’s or doctoraldegree is earned before July 1, 2003 shall haveearned the graduate degree in accordance withsubsections (b) and (c).

(e) Each applicant for licensure as a clinical pro-fessional counselor whose master’s or doctoral de-gree is earned on or after July 1, 2003 shall meetthe following education requirements:

(1) Have earned a graduate degree in accord-ance with subsections (b) and (c);

(2) in addition to or as a part of the academicrequirements for the graduate degree, have com-pleted 15 graduate semester credit hours, or theacademic equivalent, supporting diagnosis andtreatment of mental disorders using the ‘‘diagnos-tic and statistical manual of mental disorders’’ asspecified in K.A.R. 102-3-15. The 15 graduate se-mester credit hours, or the academic equivalent,shall include both of the following:

(A) The applicant shall have satisfactorily com-pleted two graduate semester hours, or the aca-demic equivalent, of discrete coursework in ethicsand two graduate semester hours, or the academicequivalent, of discrete coursework in psychopa-thology and diagnostic assessment, including thestudy of the latest edition of the ‘‘diagnostic andstatistical manual of mental disorders’’ and assess-ment instruments that support diagnosis.

(B) The applicant shall have satisfactorily com-pleted coursework addressing treatment ap-proaches and interdisciplinary referral and collab-oration; and

(3) completion of a graduate-level, supervisedclinical practicum pursuant to K.S.A. 65-5804a(c)(1)(C), and amendments thereto.

(f) In order to be approved by the board, eacheducational program in professional counselingshall meet the following requirements:

(1) Have established program admissionrequirements that are based, in part or in full, onobjective measures or standardized achievementtests and measures;

(2) require an established curriculum that en-compasses at least two academic years of graduatestudy;

(3) have clear administrative authority and pri-mary responsibility within the program for thecore and specialty areas of training in professionalcounseling;

(4) have an established, organized, and com-prehensive sequence of study that is planned byadministrators who are responsible for providingan integrated educational experience in profes-sional counseling;

(5) engage in continuous systematic programevaluation indicating how the mission objectivesand student learning outcomes are measured andmet;

(6) be chaired or directed by an identifiableperson who holds a doctoral degree in counselingthat was earned from a regionally accredited col-lege or university upon that person’s actual com-pletion of a formal academic training program;

(7) have an identifiable, full-time, professionalfaculty whose members hold earned graduate de-grees in professional counseling or a related field;

(8) have an established, identifiable body of stu-dents who are formally enrolled in the programwith the goal of obtaining a degree;

(9) require an appropriate practicum, intern-ship, or field or laboratory training in professionalcounseling that integrates didactic learning withsupervised clinical experience;

(10) conduct an ongoing, objective review andevaluation of each student’s learning and progress,and report this evaluation in the official studenttranscripts;

(11) require that at least 30 graduate semestercredit hours, or the academic equivalent, ofcoursework be completed ‘‘in residence’’ at oneinstitution and require that the practicum or in-ternship be completed at the same institution; and

(12) require that the number of graduate se-mester hours, or the academic equivalent, deliv-ered by adjunct faculty does not exceed the num-ber of graduate semester hours, or the academicequivalent, delivered by core faculty members.

(g) In order for an applicant to qualify for li-censure, the college or university at which the ap-plicant completed the counseling degree require-ments shall meet these requirements:

(1) Be regionally accredited, with accreditationstandards equivalent to those met by Kansas col-leges and universities;

(2) document in official publications, includingcourse catalogs and announcements, the programdescription and standards and the admissionrequirements of the professional counseling edu-cation and training program;

(3) identify and clearly describe in pertinent in-stitutional catalogs the coursework, experiential,and other academic program requirements thatmust be satisfied before conferral of the graduatedegree in counseling;

(4) clearly identify and specify in pertinent in-stitutional catalogs its intent to educate and trainprofessional counselors;

(5) have clearly established the professionalcounselor education program as a coherent entitywithin the college or university that, when the ap-plicant’s graduate degree was conferred, met theprogram standards in subsection (f); and

(6) have conferred the graduate degree in coun-seling upon the applicant’s successful completionof an established and required formal program ofstudies.

(h) The following types of study shall not besubstituted for or counted toward the courseworkrequirements of subsections (b), (c), (d), and (e):

(1) Academic coursework that the applicantcompleted as a part of or in conjunction with theundergraduate degree requirements;

(2) academic coursework that has been auditedrather than graded;

(3) academic coursework for which the appli-cant received an incomplete or failing grade;

(4) coursework that the board determines is notclosely related to the field or practice ofcounseling;

(5) graduate or postgraduate coursework ortraining provided by any college, university, insti-tute, or training program that does not meet therequirements of subsections (f) and (g); and

(6) any continuing education, in-service activity,or on-the-job training.

(i) The following types of study may be countedtoward the 60 graduate semester hours requiredunder paragraph (b)(2):

(1) No more than six graduate semester hoursof independent study that is related to the field orpractice of counseling, except that independentstudy shall not be used to meet any of the sub-stantive content area requirements specified insubsection (c); and

102-3-9b. Renewal audit. (a) A randomaudit of the continuing education documentationfor 10 percent of the professional counselor li-censes and the clinical professional counselor li-censes expiring each month shall be conducted bythe board.

(b) Each licensee selected for the random auditshall be notified in writing after the board has re-ceived the licensee’s renewal application form re-quired by K.A.R. l02-3-9a.

(c) Upon board notification, each renewal ap-plicant shall submit the following to the boardwithin 30 days after the license expiration date:

(1) The completed renewal audit forms; and(2) the original continuing education docu-

ments that validate all continuing education units

claimed for credit during the current renewalperiod.

(d) Continuing education units that a renewalapplicant earns after board receipt of the renewalapplication form shall not be approved for contin-uing education credit for the current renewalperiod.

Article 4.—MASTER’S LEVELPSYCHOLOGISTS

102-4-9b. Renewal audit. (a) A randomaudit of the continuing education documentationfor 10 percent of the master’s level psychologistlicenses and the clinical psychotherapist licensesexpiring each month shall be conducted by theboard.

(b) Each licensee selected for the random auditshall be notified in writing after the board has re-ceived the licensee’s renewal application form re-quired by K.A.R. l02-4-9a.

(c) Upon board notification, each renewal ap-plicant shall submit the following to the boardwithin 30 days after the license expiration date:

(1) The completed renewal audit forms; and(2) the original continuing education docu-

ments that validate all continuing education unitsclaimed for credit during the current renewalperiod.

(d) Continuing education units that a renewalapplicant earns after board receipt of the renewalapplication form shall not be approved for contin-uing education credit for the current renewalperiod.

Article 5.—LICENSING OF MARRIAGEAND FAMILY THERAPISTS

102-5-3. Education requirements. (a)Definitions. For purposes of this regulation, thefollowing terms shall be defined as follows:

(1) ‘‘Core faculty member’’ means an individualwho is part of the program’s teaching staff andwho meets the following conditions:

(A) Is an individual whose education, training,and experience are consistent with the individual’srole within the program and are consistent withthe published description of the goals, philosophy,and educational purpose of the program;

(B) is an individual whose primary professionalemployment is at the institution in which the pro-gram is housed; and

(C) is an individual who is identified with theprogram and is centrally involved in program de-velopment, decision making, and student trainingas demonstrated by consistent inclusion of the in-dividual’s name in public and departmentaldocuments.

(2) ‘‘In residence,’’ when used to describe a stu-dent, means that the student is present at thephysical location of the institution for the purposeof completing coursework during which the stu-dent and one or more core faculty members arein face-to-face contact.

(3) ‘‘Primary professional employment’’ meansa minimum of 20 hours per week of instruction,research, any other service to the institution in thecourse of employment, and the related adminis-trative work.

(b) Each applicant for licensure shall meet bothof the following education requirements:

(1) Each applicant shall have been awarded amaster’s or doctoral degree that meets the stan-dards in subsection (c), (e), or (f).

(2) The applicant shall have completed no lessthan 50% of the coursework for the degree ‘‘inresidence’’ at one institution, and the requiredpracticum shall be completed at the sameinstitution.

(c) To qualify for licensure with a master’s ordoctoral degree from a marriage and family ther-apy program, both of the following requirementsshall be met:

(1) The college or university at which the ap-plicant completed a master’s or doctoral degreein marriage and family therapy shall be regionallyaccredited, with accreditation standards equiva-lent to those in Kansas.

(2) The marriage and family therapy programthrough which the applicant completed a master’sor doctoral degree either shall be accredited bythe commission on accreditation for marriage andfamily therapy education or shall meet the stan-dards set out in subsection (d).

(d) Each marriage and family therapy programthat is not accredited by the commission on ac-

creditation for marriage and family therapy edu-cation shall meet all of these conditions:

(1) The program requires satisfactory comple-tion by the applicant of a marriage and familytherapy practicum, or its equivalent, that is pro-vided by the program and that fulfills theseconditions:

(A) Is a part-time clinical experience that inte-grates didactic learning with clinical experienceand that is completed concurrently with didacticcoursework at a typical rate of five to 10 hours ofdirect client contact per week;

(B) consists of at least 300 total hours of clientcontact; and

(C) includes at least 60 total hours of supervi-sion that is provided by the program’s core facultyand off-site supervisors. The practicum shall pro-vide a minimum of 30 supervised hours in an in-dividual format and no more than 30 supervisedhours in a group format. Supervision shall occurat least once a week.

(2) The program requires that each marriageand family therapy student successfully completea minimum of nine graduate semester credithours, or the academic equivalent, in each of thefollowing substantive content areas:

(A) Human development and family studycourses in which the interplay between interper-sonal and intrapersonal development is stressedand issues of gender, ethnicity, and ecosystemsare addressed as they relate to human develop-ment. These courses may include studies in sex-uality, sexual functioning, sexual identity, sexism,stereotyping, and racism;

(B) theoretical foundations of marital and fam-ily functioning courses, including an overview ofthe historical development of systems theory andcybernetics, a study of the life cycle of the family,and a study of family processes and the modifi-cation of family structures over time. Thesecourses may include studies in the birth of the firstchild, adolescent sexual development, death of afamily member, and issues of context, includinggender and ethnicity; and

(C) marital and family assessment and therapycourses that underscore the interdependence be-tween diagnosis or assessment and treatment byensuring that students can use appropriate assess-ment instruments and methods within a systemiccontext. These courses shall provide a thoroughunderstanding of the major theoretical models ofsystemic change, including structural, strategic,intergenerational, contextual, experiential, sys-

temic, and behavioral theories. These courses alsoshall teach the principles and techniques evolvingfrom each theory. In addition, the courses shallidentify the indications and contraindications foruse of each theory or technique and shall addressthe rationale for intervention, the role of the ther-apist, and the importance of considering genderand ethnicity in selecting and using assessmentand treatment methods.

(3) The program requires that each marriageand family therapy student successfully completea minimum of three graduate semester credithours, or the academic equivalent, in each of thefollowing substantive content areas:

(A) A professional study course that contributesto the development of a professional attitude andidentity by examining the role of professional so-cialization, professional organizations, licensureand certification, the code of ethics, the legal re-sponsibilities and liabilities of clinical practice andresearch, and interprofessional cooperation, asthese topics relate to the profession and practiceof marriage and family therapy. A generic coursein ethics shall not be considered appropriate forthis area of study; and

(B) a research course in which students gain anunderstanding of research methodology, dataanalysis, computer research skills, and evaluationand critical examination of professional researchreports. The emphasis of the course shall beplaced on the quantitative and qualitative researchthat is relevant to marriage and family therapy.

(e) To qualify for licensure with a master’s ordoctoral degree in a related field, both of the fol-lowing requirements shall be met:

(1) The college or university at which the ap-plicant completed a master’s or doctoral degreein a related field shall be regionally accredited,with accreditation standards equivalent to thosein Kansas.

(2) To be considered equivalent to a marriageand family therapy program, the related-field de-gree program shall have provided and the appli-cant shall have completed the requirements ofsubsection (d).

(f) To qualify for licensure with a master’s ordoctoral degree in a related field with additionalcoursework in marriage and family therapy, bothof the following requirements shall be met:

(1) The college or university at which the ap-plicant completed a master’s or doctoral degreein a related field shall be regionally accredited,

with accreditation standards equivalent to thosein Kansas.

(2) The marriage and family therapy programthrough which the applicant obtained additionalcoursework in marriage and family therapy eithershall be accredited by the commission on accred-itation for marriage and family therapy educationor shall meet the standards approved by the boardas set out in subsection (d).

(g) Each applicant for licensure as a clinicalmarriage and family therapist whose master’s ordoctoral degree is earned on or after July 1, 2003shall meet the following education requirements:

(1) A graduate degree as required by the boardfor licensure as a licensed marriage and familytherapist in accordance with subsection (c), (e), or(f); and

(2) in addition to or as a part of the academicrequirements for the graduate degree, completionof 15 graduate semester credit hours, or the aca-demic equivalent, supporting diagnosis and treat-ment of mental disorders using the ‘‘diagnosticand statistical manual of mental disorders’’ asspecified in K.A.R. 102-5-14. Three of the 15 se-mester credit hours, or the academic equivalent,shall consist of a discrete academic course withthe primary and explicit focus of psychopathologyand the diagnosis and treatment of mental disor-ders as classified in the ‘‘diagnostic and statisticalmanual of mental disorders.’’ The remaining 12graduate semester credit hours, or their academicequivalent, shall consist of academic courses withthe primary and explicit focus of diagnostic as-sessment, interdisciplinary referral and collabo-ration, treatment approaches, and professionalethics or other coursework that specifically con-tains identifiable, equivalent instruction. The 15graduate semester credit hours shall be from aneducational institution and graduate degree pro-gram meeting the requirements described in sub-section (c), (e), or (f).

(h) The following activities shall not be substi-tuted for or counted toward any of the educationor supervised experience requirements set out insubsections (b) through (g):

(1) Academic courses that the applicant com-pleted as a part of or in conjunction with under-graduate degree requirements;

(2) independent studies;(3) thesis or independent research courses;(4) academic coursework that has been audited

rather than graded;

(5) academic coursework for which the appli-cant received an incomplete or a failing grade;

(6) graduate or postgraduate coursework or ex-periential training provided by colleges, universi-ties, institutes, or training programs that do notqualify under subsection (c), (e), or (f); and

(7) continuing education, an in-service activity,or on-the-job training. 102-5-9a. Renewal audit. (a) A randomaudit of the continuing education documentationfor 10 percent of the marriage and family therapistlicenses and the clinical marriage and family ther-apist licenses expiring each month shall be con-ducted by the board.

(b) Each licensee selected for the random auditshall be notified in writing after the board has re-ceived the licensee’s renewal application form re-quired by K.A.R. 102-5-9.

(c) Upon board notification, each renewal ap-plicant shall submit the following to the boardwithin 30 days after the license expiration date:

(1) The completed renewal audit forms; and(2) the original continuing education docu-

ments that validate all continuing education unitsclaimed for credit during the current renewalperiod.

(d) Continuing education units that a renewalapplicant earns after board receipt of the renewalapplication form shall not be approved for contin-uing education credit for the current renewalperiod.

Article 7.—LICENSING OF ADDICTIONCOUNSELORS

102-7-1. Definitions. (a) ‘‘Academicequivalent of a semester credit hour,’’ when usedin K.A.R. 102-7-3, means the prorated propor-tionate credit for formal academic coursework ifthat coursework is completed on the basis of tri-mester or quarter hours rather than semesterhours.

(b) ‘‘Addiction counseling supervision’’ means aformal professional relationship between the su-pervisor and supervisee that promotes the devel-opment of responsibility, skills, knowledge, values,and ethical standards in the practice of addictioncounseling.

(c) ‘‘Board’’ means the Kansas behavioral sci-ences regulatory board.

(d) ‘‘Client’’ means a person who is a direct re-cipient of addiction counseling services.

(e) ‘‘Client contact,’’ for purposes of K.A.R.

102-7-6, means a service to a client or clients thatutilizes individual, family, or group interventionsthrough face-to-face interaction or the use of elec-tronic mediums of face-to-face interaction inwhich confidentiality is protected.

(f) ‘‘Clinical supervision training plan’’ means aformal, written agreement that establishes the su-pervisory framework for postgraduate clinical ex-perience and describes the expectations and re-sponsibilities of the supervisor and the supervisee.

(g) ‘‘Continuing education’’ means formally or-ganized programs or activities that are designedfor and have content intended to enhance the ad-diction counselor’s or clinical addiction coun-selor’s knowledge, skill, values, ethics, and abilityto practice as an addiction counselor or as a clin-ical addiction counselor.

(h) ‘‘Fraudulent representation’’ shall includethe following:

(1) Deceit;(2) misrepresentation; and(3) concealing a material fact.(i) ‘‘Harmful dual relationship’’ means a profes-

sional relationship between a licensee and a client,student, supervisee, or any person who has had asignificant relationship with either a current clientor a person who has been a client within the past24 months if that relationship is known to the li-censee, in which the objectivity or competency ofthe licensee is impaired or compromised becauseof any of the following types of present or previousrelationships:

(1) Familial;(2) social;(3) emotional;(4) financial;(5) supervisory; or(6) administrative.(j) ‘‘LAC’’ means licensed addiction counselor.(k) ‘‘LCAC’’ means licensed clinical addiction

counselor.(l) ‘‘Malfeasance’’ means the performance of an

act by a licensee that is prohibited or that consti-tutes wrongdoing or misconduct.

(m) ‘‘Merits the public trust’’ means that an ap-plicant or licensee possesses the high standard ofgood moral character and fitness that is requiredto practice addiction counseling as demonstratedby the following personal qualities:

(1) Good judgment;(2) integrity;(3) honesty;(4) fairness;

(5) credibility;(6) reliability;(7) respect for others;(8) respect for the laws of the state and nation;(9) self-discipline;(10) self-evaluation;(11) initiative; and(12) commitment to the addiction counseling

profession and its values and ethics.(n) ‘‘Misfeasance’’ means the improper per-

formance of a lawful act by a licensee.(o) ‘‘Nonfeasance’’ means the omission of an act

that a licensee should do.(p) ‘‘Practice setting’’ means the public or pri-

vate addiction counseling agency or delivery sys-tem within which addiction counseling is prac-ticed or addiction counseling services aredelivered.

(q) ‘‘Practicum or its equivalent’’ means a for-mal component of the academic curriculum in theaddiction counseling or in the related field edu-cational program that engages the student in su-pervised addiction counseling practice and pro-vides opportunities to apply classroom learning toactual practice situations in a field setting.

(r) ‘‘Quarter credit hour’’ means two-thirds of asemester hour. Quarter credit hours shall berounded as follows:

(1) One quarter credit hour equals .7 semesterhours.

(2) Two quarter credit hours equal 1.3 semesterhours.

(3) Three quarter credit hours equal 2.0 se-mester hours.

(4) Four quarter credit hours equal 2.7 semes-ter hours.

(5) Five quarter credit hours equal 3.3 semesterhours.

(s) ‘‘Related field’’ means a degree program ina helping profession and may include any of thefollowing:

(1) Criminal justice;(2) counseling;(3) healing arts;(4) human development and family studies;(5) human services;(6) marriage and family therapy;(7) nursing;(8) psychology;(9) social work; or(10) theology.(t) ‘‘Semester credit hour,’’ when used in

K.A.R. 102-7-3, means at least 13 clock-hours of

formal, didactic classroom instruction that oc-curred over the course of an academic semesterand for which the applicant received formal aca-demic credit.

(u) ‘‘Undue influence’’ means misusing one’sprofessional position of confidence, trust, or au-thority over a client or supervisee, or taking ad-vantage of a client’s vulnerability, weakness, infir-mity, or distress for any of the following purposes:

(1) To improperly influence or change a client’sor supervisee’s actions or decisions;

(2) to exploit a client or supervisee for the coun-selor’s or a third party’s financial gain, personalgratification, or advantage; or

102-7-2. Fees. (a) Each applicant or li-censee shall pay the appropriate fee or fees asfollows:

(1) Application for an addiction counselorlicense:

(A) Before January 1, 2012: $50; and(B) on and after January 1, 2012: $100;(2) application for a clinical addiction counselor

license:(A) Before January 1, 2012: $50; and(B) on and after January 1, 2012: $100;(3) original addiction counselor license: $100;(4) original clinical addiction counselor license:(A) Before January 1, 2012: $100; and(B) on and after January 1, 2012: $150;(5) renewal of an addiction counselor license:

$100;(6) renewal of a clinical addiction counselor li-

cense: $150;(7) replacement of an addiction counselor or a

state state licensed clinical addiction counselor ex-tension: $200.

(b) Each applicant for license renewal after thedate of its expiration shall pay, in addition to therenewal fee, the applicable late renewal penaltyfee as follows:

(1) Licensed addiction counselor (LAC): $100;or

(2) licensed clinical addiction counselor(LCAC): $150.

(c) Fees paid to the board shall not be refund-able. 102-7-3. Educational requirements. (a)(1)‘‘Core faculty member’’ means an individual whois part of the teaching staff of a program coveredby this regulation and who meets the followingconditions:

(A) Has education, training, and experienceconsistent with the individual’s role within theprogram and consistent with the published de-scription of the goals, philosophy, and educationalpurpose of the program;

(B) has primary professional employment at theinstitution in which the program is housed; and

(C) is identified with the program and is cen-trally involved in program development, decisionmaking, and student training as demonstrated byconsistent inclusion of the individual’s name inpublic and departmental documents.

(2) ‘‘In residence,’’ when used to describe a stu-dent, means that the student is present at thephysical location of the institution or at any otherlocation approved by the board for the purpose ofcompleting coursework, during which the studentand one or more core faculty members, adjunctfaculty members, or agency internship supervisorsare in face-to-face contact.

(3) ‘‘Primary professional employment’’ meansat least 20 hours each week of instruction, re-search, or any other service to the institution inthe course of employment, and related adminis-trative work.

(4) ‘‘Skill-based coursework’’ means thosecourses that allow students to work on basic help-ing skills including open-ended questions, clarifi-cation, interpretation, response to feelings, andsummarization.

(b) To qualify for licensure as an addictioncounselor with a baccalaureate degree in addic-tion counseling or a baccalaureate degree in a re-lated field that included all coursework require-ments, the applicant shall hold one of thefollowing:

(1) A baccalaureate degree in addiction coun-seling or a related field. When the degree wasgranted, the program met the standards approvedby the board;

(2) a baccalaureate degree in addiction coun-seling or a related field, if the applicant began theprogram on or before May 1, 2011 and the bac-calaureate degree is conferred on or before June1, 2012, from a program that was approved by theKansas department of social and rehabilitationservices, division of addiction and prevention serv-ices; or

(3) a baccalaureate degree in addiction coun-seling or a related field, if the applicant began theprogram on or before June 30, 2012, from a pro-gram that included at least 30 semester hours, orthe academic equivalent, in coursework on sub-stance use disorders and that meets the course-work requirements in subsection (c).

(c) Each applicant for licensure as an addictioncounselor shall have satisfactorily completed for-mal academic coursework that contributes to thedevelopment of a broad conceptual framework foraddiction counseling theory and practice. This for-mal academic coursework shall be distributedacross the substantive content areas specified inthis subsection. For applicants who graduate onor after July 1, 2013, two of the following coursesshall be completed while the student is in resi-dence: methods of individual counseling, methodsof group counseling, practicum one, or practicumtwo. A maximum of three semester hours, or theacademic equivalent, may be completed in inde-pendent study. Except for the required courses ina practicum or its equivalent, there shall be at leastthree discrete and unduplicated semester hours,or the academic equivalent, in each of the follow-ing content areas:

(1) Introduction to addiction, which shall in-clude the study of the nature of addiction andother substance use-related problems; models,theories, philosophies, principles, implications formedical and mental health conditions that coexistwith addiction, and evidence-based strategies ofaddiction prevention, treatment, relapse preven-tion, continuing care, and recovery; and the im-

pact of addiction on the individual, family, andsociety;

(2) methods of individual counseling, whichshall include the study of culturally informed, eth-ical, evidence-based models and approaches to in-dividual counseling; methods for establishing ef-fective therapeutic relationships, developingrealistic and achievable treatment goals, and as-sessing client substance use, functioning, motiva-tion, and progress; and strategies for crisis pre-vention and intervention;

(3) methods of group counseling, which shallinclude the study of culturally informed, ethical,evidence-based models and approaches to groupcounseling; group facilitation and counselingskills; and methods for establishing group goalsand treatment outcomes;

(4) addiction pharmacology, which shall includethe study of the nature of psychoactive chemicals;the behavioral, psychological, physiological, andsocial effects of psychoactive substance use; symp-toms of intoxication, withdrawal, and toxicity; tox-icity screen options, limitations, and legal impli-cations; and the use of pharmacotherapy fortreatment of addiction;

(5) co-occurring disorders, which shall includethe study of the symptoms of mental health andother disorders prevalent in individuals with sub-stance use disorders, screening and assessmenttools used to detect and evaluate the presence andseverity of co-occurring disorders, and evidence-based strategies for managing risks associated withtreating individuals who have co-occurringdisorders;

(6) addiction services coordination, which shallinclude the study of administrative, clinical, eval-uative, and referral activities used to connect cli-ents with treatment services and other communityresources; navigation and coordination acrossmultiple systems; and case management and ad-vocacy skills used to assist clients in achieving theirtreatment and recovery goals;

(7) legal and ethical issues, which shall includethe study of established codes of ethical conduct,standards of professional behavior and scope ofpractice; client rights, responsibilities, and in-formed consent; and confidentiality and other le-gal considerations in counseling;

(8) family and community studies, which shallinclude the study of family, social, and communitysystems; the impact of addiction on the family andsociety; and the development of culturally in-

formed skills utilized in the treatment and recov-ery process;

(9) at least six semester credit hours, or the ac-ademic equivalent, of practicum or its equivalent,which shall include the following:

(A) An experience that integrates didacticlearning that is related to substance use disorderswith face-to-face, direct counseling experiencethat includes intake and assessment, counseling,treatment planning, discharge planning, docu-mentation, and case management activities;

(B) at least 400 clock-hours of practice; and(C) at least one hour of supervision for every 10

hours of practice. Supervision shall be providedby the educational program’s faculty and agencystaff, at least one of whom shall be licensed in thebehavioral sciences; and

(10) for applicants who graduate on and afterJuly 1, 2012, at least three discrete and undupli-cated semester hours, or the academic equivalent,in the study of research, which shall include thestudy of basic research design and methodology;critical evaluation and interpretation of profes-sional research reports; introduction to data col-lection, performance measurement, and outcomeevaluation; and the application of research resultsin a treatment setting.

(d) To qualify for licensure as an addictioncounselor with a baccalaureate degree in a relatedfield with additional coursework in addictioncounseling, the following requirements shall bemet:

(1) The college or university at which the ap-plicant completed a baccalaureate degree in a re-lated field shall be regionally accredited with ac-creditation standards equivalent to those met byKansas colleges and universities.

(2) The applicant shall meet the courseworkrequirements in subsection (c).

(3) The program through which the applicantobtained additional coursework in addiction coun-seling shall meet the standards approved by theboard as specified in subsections (i) and (j).

(e) To qualify for licensure as an addictioncounselor while holding a baccalaureate socialwork license in Kansas, the applicant shall com-plete the coursework specified in paragraphs(c)(1), (4), and (9).

(f) To qualify for licensure as a clinical addictioncounselor with a master’s degree in addictioncounseling or a master’s degree in a related fieldthat included all coursework requirements, theapplicant shall hold one of the following:

(1) A master’s degree in addiction counselingor a related field. When the degree was granted,the program met the standards approved by theboard;

(2) a master’s degree in addiction counseling ora related field, if the applicant began the programon or before May 1, 2011 and the master’s degreeis conferred on or before June 1, 2012 from a pro-gram that was approved by the Kansas depart-ment of social and rehabilitation services, divisionof addiction and prevention services; or

(3) a master’s degree in addiction counseling ora related field. Part of the coursework completedfor the master’s degree shall be at least 30 grad-uate semester credit hours, or the academicequivalent, supporting the diagnosis and treat-ment of substance use disorders and shall meetthe coursework requirements in subsection (g).

(g) Each applicant for licensure as a clinical ad-diction counselor shall have satisfactorily com-pleted formal academic coursework that contrib-utes to the development of a broad conceptualframework for addiction counseling theory andpractice. This formal academic coursework shallbe distributed across the substantive content areasspecified in this subsection. For applicants whograduate on or after July 1, 2013, half of all skill-based coursework shall be completed while thestudent is in residence, as defined in this regula-tion. A maximum of three graduate semesterhours, or the academic equivalent, may be com-pleted in independent study. There shall be atleast three discrete and unduplicated graduate se-mester hours, or the academic equivalent, in eachof the following content areas:

(1) Addiction and recovery services, which shallinclude the study and critical analysis of philoso-phies and theories of addiction and scientificallysupported models of prevention, intervention,treatment, and recovery for addiction and othersubstance-related problems;

(2) advanced methods of individual and groupcounseling, which shall include the study of prac-tical skills related to evidence-based, culturally in-formed individual and group counseling tech-niques and strategies designed to facilitatetherapeutic relationships and the educational andpsychosocial development of clients as specificallyrelated to their addiction;

(3) advanced pharmacology and substance usedisorders, which shall include the study of thepharmacological properties and effects of psycho-active substances; physiological, behavioral, psy-

chological, and social effects of psychoactive sub-stances; drug interactions; medication-assistedaddiction treatment; and pharmacological issuesrelated to co-occurring disorders treated with pre-scription psychotropic medications;

(4) integrative treatment of co-occurring dis-orders, which shall include the study of the rela-tionship between addiction and co-occurringmental or physical disorders or other conditionsand evidenced-based models for the screening, as-sessment, and collaborative treatment of co-occurring disorders;

(5) assessment and diagnosis, which shall in-clude the study of a comprehensive clinical as-sessment process that addresses age, gender, dis-ability, and cultural issues; the signs, symptoms,and diagnostic criteria used to establish substanceuse-disorder diagnoses; and the relationship be-tween diagnosis, treatment, and recovery;

(6) professional ethics and practice, which shallinclude the study of professional codes of ethicsand ethical decision making; client privacy rightsand confidentiality; legal responsibilities and lia-bilities of clinical supervision; and professionalidentity and development issues;

(7) applied research, which shall include thestudy of the purposes and techniques of behav-ioral sciences research, including qualitative andquantitative approaches, research methodology,data collection and analysis, electronic researchskills, outcome evaluation, critical evaluation andinterpretation of professional research reports,and practical applications of research. A maximumof three semester hours, or the academic equiva-lent, may be completed in thesis or independentresearch courses;

(8) practicum or its equivalent, which shallmeet the following requirements:

(A) Be a clinical experience that integrates di-dactic learning supporting the diagnosis and treat-ment of substance use disorders;

(B) include at least 300 hours of client contact;and

(C) provide at least one hour of supervision forevery 10 hours of client contact. Supervision shallbe provided by the program’s faculty and agencysupervisors, at least one of whom shall be licensedat the clinical level by the board; and

(9) six additional graduate semester hours of ac-ademic coursework that contributes to the devel-opment of advanced knowledge or skills in addic-tion counseling, supervision, or research.

(h) To qualify for licensure as a clinical addic-

tion counselor with a master’s degree in a relatedfield with additional coursework in addictioncounseling, the following requirements shall bemet:

(1) The college or university at which the ap-plicant completed a master’s degree in a relatedfield shall be regionally accredited with accredi-tation standards equivalent to those met by Kansascolleges and universities.

(2) The applicant shall meet the courseworkrequirements in subsection (g).

(3) The program through which the applicantobtained additional coursework in addiction coun-seling shall meet the standards approved by theboard as specified in subsections (i) and (j).

(i) In order to be approved by the board, eachaddiction counseling program or related-field pro-gram, except the related-field degree listed in par-agraphs (d)(1) and (h)(1), shall meet the followingconditions:

(1) Have established program admissionrequirements that are based, in part or in full, onobjective measures or standardized achievementtests and measures;

(2) offer education and training in addictioncounseling, one goal of which is to prepare stu-dents for the practice of addiction counseling;

(3) require an established curriculum that en-compasses at least one academic year of study fora baccalaureate degree or two academic years ofstudy for a master’s degree;

(4) have clear administrative authority and pri-mary responsibility within the program for thecore and specialty areas of training in addictioncounseling;

(5) have an established, organized, and com-prehensive sequence of study that is planned byadministrators who are responsible for providingan integrated educational experience in addictioncounseling;

(6) for a master’s degree program, be coordi-nated or directed by an identifiable person whoholds a graduate degree that was earned from aregionally accredited college or university uponthat person’s actual completion of a formal aca-demic training program;

(7) have an identifiable, full-time core facultymember who holds an earned graduate degree inaddiction counseling or a related field;

(8) have an established, identifiable body of stu-dents who are formally enrolled in the programwith the goal of obtaining coursework for the con-centration in the study of addiction counseling;

(9) require the student’s major advisor to be amember of the program faculty;

(10) require each student to complete the in-stitution’s requirements for the number of credithours that must be completed at that institutionand to satisfactorily complete an addiction coun-seling practicum or its equivalent that is providedby the program from which the student completesthe concentration in the study of addiction coun-seling. The required practicum shall meet the fol-lowing requirements:

(A) Accept as practicum students only appli-cants enrolled in the addiction counseling or re-lated-field program;

(B) provide the majority of supervision by anindividual who is licensed at the clinical level bythe board;

(C) exist as a distinct and organized programthat is clearly recognizable within an institution oragency, as well as in pertinent public, official doc-uments issued by the institution or agency, andthat is clearly recognizable as a training programfor addiction counselors;

(D) identify students as being in training andnot as staff members; and

(E) be an integrated and formally organizedtraining experience, not an after-the-fact tabula-tion of experience; and

(11) conduct an ongoing, objective review andevaluation of each student’s learning and progressand report this evaluation in the official studenttranscripts.

(j) In order to be approved by the board, eachaddiction counseling program or related-field pro-gram, except the related-field degree listed in par-agraphs (d)(1) and (h)(1), shall meet the followingrequirements:

(1) Be regionally accredited, with accreditationstandards equivalent to those met by Kansas col-leges and universities;

(2) document in official publications, includingcourse catalogs and announcements, the programdescription and standards and the admissionrequirements for the addiction counseling or re-lated-field education and training program;

(3) identify and clearly describe in pertinent in-stitutional catalogs the coursework, experiential,and other academic program requirements thatmust be satisfied before conferral of the degree;

(4) clearly identify and specify in pertinent in-stitutional catalogs the intent to educate and trainaddiction counselors;

(5) have clearly established the addiction coun-

selor or related-field education program as a co-herent entity within the college or university that,when the applicant’s degree was conferred, metthe program standards in subsection (i);

(6) have conferred the degree upon the appli-cant’s successful completion of an established andrequired formal program of studies; and

(7) have a library and equipment and resourcesavailable that are adequate for the size of the stu-dent body and the scope of the program offered.

(k) The following types of study shall not besubstituted for or counted toward the courseworkrequirements of this regulation:

(1) Academic coursework that has been auditedrather than graded;

(2) academic coursework for which the appli-cant received an incomplete or failing grade;

(3) coursework that the board determines is notclosely related to the field or practice of addictioncounseling;

(4) coursework or training provided by any col-lege, university, institute, or training program thatdoes not meet the requirements of subsections (i)and (j); and

(5) any continuing education, in-service activity,or on-the-job training. 102-7-4. Application for licensure. (a)Each applicant for licensure as an addiction coun-selor or a clinical addiction counselor shall requestthe appropriate licensure application forms fromthe executive director of the board.

(b) Each applicant for licensure as an addictioncounselor shall submit the completed applicationmaterials to the board and perform the following:

(1) Submit the full payment of the licensureapplication fee as specified in K.A.R. 102-7-2;

(2) submit, on board-approved forms, two pro-fessional references. Each individual submitting areference shall meet all of the followingconditions:

(A) Not be related to the applicant;(B) be authorized by law to practice addiction

counseling or to practice in a related field; and(C) be able to address the applicant’s profes-

sional conduct, competence, and merit of thepublic trust;

(3) if not previously provided to the board, sub-

mit, on a board-approved form, a third profes-sional reference from an individual who shall meetthe following conditions:

(A) Not be related to the applicant;(B) if the individual is the applicant’s practicum

supervisor, be authorized by law to practice ad-diction counseling; and

(C) have served as the applicant’s on-site prac-ticum supervisor or, if that supervisor is unavail-able, the program director or any person who hasknowledge of the applicant’s practicum experi-ence on the basis of the applicant’s practicum re-cords; and

(4) meet either of the following requirements:(A) Currently hold a license issued by the board

at the master’s level or above; or(B)(i) Demonstrate completion of the educa-

tional requirements specified in K.A.R. 102-7-3;and

(ii) arrange for the applicant’s transcripts cov-ering all applicable college or university course-work to be sent directly from each academic in-stitution to the board office. Each applicant whograduated from a college or university outside theUnited States also shall arrange for the applicant’stranscript to be translated and evaluated for de-gree equivalency by a source and in a manner thatare acceptable to the board.

(c) Each applicant for licensure as a clinical ad-diction counselor shall submit the completed ap-plication materials to the board and perform thefollowing:

(1) Submit the full payment of the licensureapplication fee as specified in K.A.R. 102-7-2;

(2) demonstrate that the applicant is licensedby the board as an addiction counselor or meetsall requirements for licensure as a licensed addic-tion counselor;

(3) if not previously provided to the board, sub-mit, on board-approved forms, two professionalreferences. Each individual submitting a refer-ence shall meet all of the following conditions:

(A) Not be related to the applicant;(B) be authorized by law to practice addiction

counseling or to practice in a related field; and(C) be able to address the applicant’s profes-

sional conduct, competence, and merit of thepublic trust;

(4) if not previously provided to the board, sub-mit, on a board-approved form, a third profes-sional reference from an individual who shall meetthe following conditions:

(A) Not be related to the applicant;

(B) if the individual is the applicant’s practicumsupervisor, be authorized by law to practice ad-diction counseling; and

(C) have served as the applicant’s on-site prac-ticum supervisor or, if that supervisor is unavail-able, the program director or any person who hasknowledge of the applicant’s practicum experi-ence on the basis of the applicant’s practicumrecords;

(5) meet either of the following requirements:(A) Demonstrate compliance with require-

ments pursuant to L. 2011, ch. 114, sec.12(b)(1)(A)(iv), and amendments thereto; or

(B)(i) Demonstrate satisfactory completion ofthe graduate education requirements specified inK.A.R. 102-7-3; and

(ii) if not previously provided to the board, ar-range for the applicant’s transcripts covering allapplicable college or university coursework to besent directly from each academic institution to theboard office. Each applicant who graduated froma college or university outside the United Statesalso shall arrange for the applicant’s transcript tobe translated and evaluated for degree equiva-lency by a source and in a manner that are ac-ceptable to the board; and

(6) submit each supervisor’s attestation that theapplicant has satisfactorily completed the post-graduate supervised professional experiencerequirements in accordance with a clinical super-vision training plan approved by the board as spec-ified in K.A.R. 102-7-6.

(d) The following provisions shall apply to eachapplicant for licensure as an addiction counselorand each applicant for licensure as a clinical ad-diction counselor:

(1) Upon the board’s determination that the ap-plicant has met the applicable educationalrequirements, each applicant shall pass an appro-priate, nationally administered, standardized writ-ten examination approved by the board in accord-ance with K.A.R. 102-7-5.

(2) An applicant shall not be given a judgmenton the applicant’s eligibility for licensure until theboard receives all application materials and theapplicant completes all application procedures.

(3) Upon notification from the board that alleligibility requirements have been satisfied, theapplicant shall submit the fee for the original two-year licensure period as specified in K.A.R. 102-7-2.

(4)(A) If any of the following conditions appliesto the applicant, the applicant’s application shall

expire one year from the date on which it wassubmitted to the board or on the date the appli-cant’s temporary license expires, whichever dateis later, except as provided by paragraph (d)(4)(B):

(i) The applicant has not met the qualificationsfor licensure.

(ii) The applicant has not submitted a completeapplication.

(iii) The applicant has not submitted the origi-nal license fee.

(B) Any applicant whose application will expireunder paragraph (d)(4)(A) may request that theapplication be kept open for an additional periodof time, not to exceed six months, on the basis ofextenuating circumstances. The applicant shallsubmit a written request to the board with a de-tailed explanation of the extenuating circum-stances that are the basis of the applicant’s re-quest. The written request shall be submitted nolater than 30 days before the application expires.If the request is approved by the board, the ap-plication shall remain open for the period of timestipulated by the board in its approval, which shallnot exceed six months.

(C) Upon expiration of the application, the ap-plicant may submit a new application, the re-quired fee, and all supporting documents if theapplicant wishes to reapply.

(e)(1) Any applicant who is determined by theboard to meet the requirements of L. 2011, ch.114, sec. 12 (a)(1), (2), and (4), and amendmentsthereto, may be granted a temporary license if theapplicant submits a written request for a tempo-rary license on a form approved by the board andthe temporary license fee as specified in K.A.R.102-7-2. Except as provided in paragraph (e)(2),the temporary license shall remain in effect for 12months.

(2) Any applicant whose 12-month temporarylicense is due to expire may request that the tem-porary license remain in effect for a period of timenot to exceed six months on the basis of extenu-ating circumstances. The applicant shall submit awritten request to the board with a detailed ex-planation of the extenuating circumstances thatare the basis of the applicant’s request. The writ-ten request shall be submitted no later than 30days before the application expires. If the requestis approved by the board, the temporary licenseshall remain in effect for the period of time stip-ulated by the board in its approval, which shall notexceed six months.

(f) For purposes of this regulation, the term

‘‘extenuating circumstances’’ shall mean any con-dition caused by events beyond a person’s controlthat is sufficiently extreme in nature to result ineither of the following:

(1) The person’s inability to comply with therequirements of this regulation within the timeframes established by this regulation or L. 2010,ch. 45, sec. 5, and amendments thereto; or

(2) the inadvisability of requiring the applicantto comply with the requirements of this regulationwithin the time frames established by this regu-lation and L. 2010, ch. 45, sec. 5, and amendmentsthereto. 102-7-4a. Licensure without examina-tion. (a) Each applicant for licensure as an addic-tion counselor or clinical addiction counselor shallrequest the appropriate licensure applicationforms from the executive director of the board.

(b) Each applicant for licensure as an addictioncounselor without examination shall submit thecompleted application materials to the board andmeet the following requirements:

(1) Submit a certificate or written statement is-sued by the credentialing organization verifyingthat the applicant was registered or credentialedas an alcohol or other drug counselor pursuant toL. 2011, ch. 114, sec. 12, and amendmentsthereto, at any time from July 1, 2008 throughJune 30, 2011;

(2) submit an attestation, on a board-approvedform, by the applicant that the applicant’s lastKansas alcohol or other drug registration or cre-dential was not suspended or revoked;

(3) submit documentation verifying that the ap-plicant has completed two hours each of contin-uing education in ethics, confidentiality, and in-fectious disease during the three yearsimmediately preceding application;

(4) submit, on board-approved forms, refer-ences from two professionals. Each individualsubmitting a reference shall meet all of the follow-ing conditions:

(A) Not be related to the applicant;(B) be authorized to engage in the practice of

addiction counseling or to practice in a relatedfield; and

(C) be able to address the applicant’s compe-tence to perform the duties of an addiction coun-selor; and

(5) pay the application fee specified in K.A.R.102-7-2.

(c) Each applicant for licensure as a clinical ad-diction counselor without examination shall sub-mit to the board all application materials pre-scribed in paragraphs (b)(1) through (4), inaddition to the following items:

(1) Documentation verifying that the applicanthas completed six hours of continuing educationin the diagnosis and treatment of substance usedisorders during the three years immediately pre-ceding the application date;

(2) (A) Documentation verifying that the appli-cant is authorized to practice independently as alicensed specialist clinical social worker, licensedclinical professional counselor, licensed clinicalmarriage and family therapist, licensed clinicalpsychotherapist, licensed psychologist, mentalhealth advanced registered nurse practitioner, oradvanced practice registered nurse or is a physi-cian licensed to practice medicine and surgery; or

(B) (i) An official transcript verifying that theapplicant holds a master’s degree in a related field;and

(ii) an attestation, on a board-approved form,that the applicant has engaged in the practice, su-pervision, or administration of addiction counsel-ing for at least four years with an average of atleast eight hours each week for at least ninemonths of each of the four years; and

(3) payment of the application fee specified inK.A.R. 102-7-2.

(d) The following provisions shall apply to eachapplicant for licensure as an addiction counselorand each applicant for licensure as a clinical ad-diction counselor:

(1) An applicant shall not be given a judgmenton the applicant’s eligibility for licensure until theboard receives all application materials and theapplicant completes all application procedures.

(2) Upon notification from the board that alleligibility requirements for licensure without ex-amination have been satisfied, the applicant shallsubmit the fee for the original two-year licensureperiod as specified in K.A.R. 102-7-2.

(3)(A) If any of the following conditions appliesto the applicant, the applicant’s application shallexpire one year from the date on which it wassubmitted to the board:

(i) The applicant has not met the qualificationsfor licensure.

(ii) The applicant has not submitted a completeapplication.

(iii) The applicant has not submitted the origi-nal license fee.

(B) Upon expiration of the application, the ap-plicant may submit a new application, the re-quired fee, and all supporting documents if theapplicant wishes to reapply. 102-7-4b. Application for licensurebased on reciprocity. (a) Each individual whowishes to be licensed as an addiction counselor ora clinical addiction counselor based on reciprocity,pursuant to L. 2011, ch. 114, sec. 13 and amend-ments thereto, shall submit an application for li-censure in accordance with this regulation.

(b) Each applicant for licensure as an addictioncounselor shall request the application forms forlicensure by reciprocity from the board. Each ap-plicant shall ensure that the application materialsare submitted to the board as follows:

(1) The applicant shall submit the completedapplication form and payment in full of the appli-cation for a license fee, as specified in K.A.R. 102-7-2.

(2) The applicant shall forward to the licensingagency for the jurisdiction in which the applicantis currently licensed, certified, or registered as anaddiction counselor a form provided by the boardon which the licensing agency is to provide thefollowing information directly to the board:

(A) Verification that the applicant currentlyholds a valid license, registration, or certificationto practice addiction counseling issued by the li-censing agency;

(B) the date on which the applicant was initiallylicensed, registered, or certified as an addictioncounselor by the licensing agency and a completehistory of each subsequent renewal, reinstate-ment, and lapse in licensure, registration, or cer-tification. If an applicant is seeking licensurebased on reciprocity pursuant to L. 2011, ch. 114,sec. 13 (a)(2) and amendments thereto, the ap-plicant shall ensure that documentation covering

the five years of continuous licensure, registration,or certification as an addiction counselor that im-mediately precede the date of the application issubmitted to the board by the licensing agency foreach jurisdiction in which the applicant was li-censed, registered, or certified during that five-year period; and

(C) a complete history of any disciplinary actionof a serious nature brought by the licensingagency against the applicant. For purposes of thisregulation, ‘‘disciplinary action of a serious na-ture’’ shall mean the revocation or suspension ofa license, registration, or certification issued bythe licensing board or the voluntary surrender ofa license, registration, or certification in lieu of thecompletion of an investigation or final disciplinaryaction.

(3) The applicant either shall provide verifica-tion that the standards for licensure, certification,or registration as an addiction counselor in thatjurisdiction are substantially equivalent to thestandards in Kansas or shall meet the followingrequirements:

(A)(i) Demonstrate completion of a baccalau-reate or master’s degree in addiction counselingas specified in K.A.R. 102-7-3; or

(ii) demonstrate completion of a baccalaureateor master’s degree in a related field that includedall required addiction counseling courseworkrequirements as specified in K.A.R. 102-7-3; and

(B) arrange for the applicant’s transcripts cov-ering all applicable college or university course-work to be sent directly from each academic in-stitution to the board office. Each applicant whograduated from a college or university outside theUnited States also shall arrange for the applicant’stranscript to be translated and evaluated for de-gree equivalency by a source and in a manner thatare acceptable to the board.

(4) The applicant shall submit an attestationthat the applicant engaged in the professionalpractice of addiction counseling an average of atleast 15 hours each week for nine months duringeach of the five years immediately preceding thedate of application for licensure based onreciprocity.

(c) In addition to meeting the requirements ofsubsection (b), each applicant for licensure as aclinical addiction counselor shall demonstratecompetence to diagnose and treat substance usedisorders by submitting at least two of the follow-ing forms of documentation:

(1)(A) A transcript sent directly from a region-

ally accredited university or college documentingsatisfactory completion of 15 graduate credithours supporting diagnosis or treatment of sub-stance use disorders, including the followingcoursework:

(i) Three graduate semester hours of discretecoursework in ethics;

(ii) three graduate semester hours of discretecoursework in the diagnosis of substance use dis-orders that includes studies of the established di-agnostic criteria for substance use disorders; and

(iii) coursework that addresses interdisciplinaryreferrals, interdisciplinary collaborations, andtreatment approaches; or

(B) verification from either the licensing agencyor the testing service that the applicant passed anational clinical examination approved by theboard, including the applicant’s score on the examand the passing score established for the exam;

(2) one or both of the following types of docu-mentation, which shall cover periods of time to-taling at least three years:

(A) An attestation by a supervisor or other des-ignated representative of the applicant’s employerthat the applicant has at least three years of clin-ical practice, including at least eight hours of cli-ent contact each week during nine months ormore of each year, in a treatment facility, com-munity mental health center or its affiliate, statemental hospital, or another employment setting inwhich the applicant engaged in clinical practicethat included diagnosis or treatment of substanceuse disorders; or

(B) an attestation by the applicant that the ap-plicant engaged in at least three years of inde-pendent clinical practice that included diagnosisor treatment of substance use disorders, as well assupporting documentation in the form of a pub-lished job description, a description of the appli-cant’s practice in a public information brochure,a description of services in an informed consentdocument, or other similar published statementsdemonstrating that the applicant has engaged inindependent clinical practice for at least threeyears; or

(3) an attestation that the applicant has dem-onstrated competence in diagnosis or treatmentof substance use disorders, which shall be signedby either a professional licensed to practice med-icine and surgery or a professional licensed psy-chologist, a licensed clinical social worker, or an-other professional licensed to diagnose and treatmental disorders or substance use disorders, or

102-7-5. Examination for addictioncounselor or clinical addiction counselor.(a)(1) Each applicant for licensure as an addictioncounselor who does not meet the requirements ofK.A.R. 102-7-4a or 102-7-4b shall be required topass a nationally administered, standardized writ-ten examination approved by the board.

(2) An applicant shall not be authorized to reg-ister for an examination until the applicant iswithin at least four months of anticipated comple-tion of the applicable academic degree require-ments and has satisfied the board that the appli-cant merits the public trust. Each applicant whohas not completed the applicable academic de-gree requirements on the date that the applicationis submitted shall arrange for the required tran-scripts to be sent to the board when the academicdegree is awarded to the applicant.

(3) The applicant’s required written examina-tion may be waived by the board if the applicantobtained a passing score as determined by the ex-amination company on a nationally administered,standardized written examination deemed by theboard to be substantially equivalent to the exam-ination used in this state.

(b)(1) Each applicant for licensure as a clinicaladdiction counselor who does not meet therequirements of K.A.R. 102-7-4a or 102-7-4b shallbe required to pass a nationally administered,standardized written clinical examination ap-proved by the board.

(2) An applicant shall not be authorized to reg-ister for the clinical examination or to qualify fora waiver of the examination until the applicant hasfulfilled all educational requirements and has sat-isfied the board that the applicant merits the pub-lic trust.

(3) The applicant’s required written clinical ex-amination may be waived by the board if the ap-plicant obtained a passing score as determined bythe examination company on a standardized writ-ten examination deemed by the board to be sub-stantially equivalent to the examination used inthis state. 102-7-6. Professional postgraduate su-pervised experience requirement for a clini-cal addiction counselor. For each applicant forlicensure as a clinical addiction counselor, thepostgraduate supervised professional experienceof addiction counseling shall meet all of the fol-lowing requirements:

(a) The postgraduate supervised professionalexperience of addiction counseling shall consist of4,000 hours of professional experience, including1,500 hours of direct client contact conductingsubstance abuse assessments and treatment.

(b) Except as provided in subsection (c), clinicalsupervision shall be provided throughout the en-tirety of the postgraduate supervised professionalexperience at a ratio of one hour of clinical su-pervision for each 20 hours of direct client con-tact, specified as follows:

(1) At least 50 hours of one-on-one, individualclinical supervision occurring with the supervisorand supervisee in the same physical space;

(2) at least 100 hours of clinical supervision withone supervisor and no more than six supervisees,which may be obtained in person or, if confiden-tiality is technologically protected, person-to-per-son contact by interactive video or other tele-phonic means; and

(3) at least two separate clinical supervision ses-sions per month, at least one of which shall beone-on-one individual supervision.

(c) Each applicant with a doctor’s degree in ad-diction counseling or a related field as defined inK.A.R. 102-7-1(s) shall be required to complete,after the doctoral degree is granted, at least one-half of the postgraduate supervised professionalexperience requirements as follows:

(1) At least 25 hours of one-on-one, individualclinical supervision occurring with the supervisorand supervisee in the same physical space;

(2) at least 50 hours of clinical supervision withone supervisor and no more than six supervisees,which may be obtained in person or, if confiden-tiality is technologically protected, person-to-per-son contact by interactive video or other tele-phonic means; and

(3) at least two separate clinical supervision ses-sions per month, at least one of which shall beone-on-one individual supervision.

(d) The clinical supervisor of each person at-

taining the 4,000 hours of postgraduate super-vised professional experience required for licen-sure as a clinical addiction counselor shall meetone of the following requirements while the in-dividual is providing supervision:

(1) The clinical supervisor shall be a clinical ad-diction counselor who is licensed in Kansas or iscertified or licensed in another jurisdiction and,on and after January 1, 2014, who has engaged inthe independent practice of clinical addictioncounseling, including the diagnosis and treatmentof substance use disorders, for at least two yearsbeyond the supervisor’s certification or licensuredate as a clinical addiction counselor.

(2) If a licensed clinical addiction counselor isnot available, the clinical supervisor may be a per-son who is certified or licensed at the graduatelevel to practice in one of the behavioral sciencesand whose authorized scope of practice permitsthe diagnosis and treatment of mental disordersindependently. The qualifying individual shallhave had at least two years of clinical professionalexperience beyond the date of the supervisor’scertification or licensure.

(e) In addition to the requirements of subsec-tion (d), each clinical supervisor shall meet thefollowing requirements:

(1) Have professional authority over and re-sponsibility for the supervisee’s clinical function-ing in the practice of addiction counseling;

(2) not have a harmful dual relationship withthe supervisee;

(3) not be under any sanction from a discipli-nary proceeding, unless the board waives this pro-hibition for good cause shown by the proposedsupervisor;

(4) have knowledge of and experience with thesupervisee’s client population;

(5) have knowledge of and experience with themethods of practice that the supervisee employs;

(6) have an understanding of the organizationand the administrative policies and procedures ofthe supervisee’s practice setting; and

(7) be a member of the practice setting staff ormeet the requirements of subsection (f).

(f) If a qualified clinical supervisor is not avail-able from among staff in the supervisee’s practicesetting, the supervisee may secure an otherwisequalified clinical supervisor outside the practicesetting if all of the following conditions are met:

(1) The supervisor has an understanding of thepractice setting’s mission, policies, andprocedures.

(2) The extent of the supervisor’s responsibilityfor the supervisee is clearly defined in terms ofclient cases to be supervised, role in personnelevaluation within the practice setting, and otheraspects of the clinical supervision training plan.

(3) The responsibility for payment for supervi-sion is clearly defined.

(4) If the supervisee pays the supervisor directlyfor the supervision, the supervisor maintains re-sponsibility for the client and to the practicesetting.

(g) Each clinical supervisor shall perform thefollowing duties:

(1) Provide oversight, guidance, and directionfor the supervisee’s clinical practice of addictioncounseling by assessing and evaluating the super-visee’s performance;

(2) conduct supervision as a process distinctfrom personal therapy, didactic instruction, or ad-diction counseling consultation;

(3) provide documentation of supervisory qual-ifications to the supervisee;

(4) periodically evaluate the supervisee’s clini-cal functioning;

(5) provide supervision in accordance with theclinical supervision training plan;

(6) maintain documentation of supervision inaccordance with the clinical supervision trainingplan;

(7) provide the documentation required by theboard when the supervisee completes the post-graduate supervised professional experience. Thesupervisor shall submit this documentation onboard-approved forms and in a manner that willenable the board to evaluate the extent and qualityof the supervisee’s professional experience and as-sign credit for that experience;

(8) provide a level of supervision that is com-mensurate with the education, training, experi-ence, and ability of both the supervisor and thesupervisee; and

(9) ensure that each client knows that the su-pervisee is practicing addiction counseling undersupervision.

(h)(1) In order for an applicant for a clinicaladdiction counselor license to obtain credit forhours accrued before August 1, 2011 toward therequired 4,000 hours of clinical supervision, theapplicant shall provide an attestation that the clin-ical supervision occurred in accordance with aplan that meets the following conditions:

(A) The supervision was scheduled andformalized.

(B) The supervision included review and ex-amination of cases.

(C) Assessment of the supervisee’s competen-cies was addressed by the supervisor.

(2) The attestation shall be signed by one of thefollowing:

(A) The supervisor, if available; or(B) if the supervisor is not available, another

person who was in the supervisee’s practice set-ting with knowledge of the supervisee’s clinicalsupervision.

(i) For supervision hours accrued on and afterAugust 1, 2011, each supervisor and superviseeshall develop and cosign a written clinical super-vision training plan on forms provided by theboard at the beginning of the supervisory rela-tionship. The supervisee shall submit an officialposition description and the training plan to theboard and shall receive board approval of the planbefore any supervised professional experiencehours for clinical licensure can begin to accrue.This plan shall clearly define and delineate thefollowing items:

(1) The supervisory context, which shall includethe purpose of supervision;

(2) a summary of the anticipated types of clientsand the services to be provided, as evidenced bythe supervisee’s official position description;

(3) a plan that describes the supervision goalsand objectives and the means to attain and eval-uate progress towards the goals;

(4) the supervisor’s responsibilities;(5) the supervisee’s responsibilities;(6) the format and schedule of supervision;(7) a plan for documenting the following

information:(A) The date of each supervisory meeting;(B) the length of each supervisory meeting;(C) a designation of each supervisory meeting

as an individual or group meeting;(D) a designation of each supervisory meeting

as conducted in the same physical space or by an-other means as specified in paragraph (b)(2);

(E) the 4,000 hours of postgraduate supervisedclinical addiction counseling experience, whichshall include specifically documenting the 1,500hours of direct client contact conducting sub-stance abuse assessments and treatment; and

(F) an evaluation of the supervisee’s progressunder clinical supervision;

(8) a plan to address and remedy circumstancesin which there is a conflict between the supervisorand the supervisee;

(9) a plan to notify clients of the followinginformation:

(A) The fact that the supervisee is practicingaddiction counseling under supervision;

(B) the limits of client confidentiality within thesupervisory process; and

(C) the name, address, and telephone numberof the clinical supervisor;

(10) the date on which the parties entered intothe clinical supervision training plan and the timeframe that the plan is intended to encompass;

(11) an agreement to amend or renegotiate theterms of the clinical supervision training plan, ifwarranted, including written notification of thesechanges to the board office, as provided in sub-section (j);

(12) the supervisee’s informed consent for thesupervisor to discuss supervision or performanceissues with the supervisee’s clients, the super-visee’s other addiction counseling or employmentsupervisors, the board, or any other individual orentity to which either the supervisee or the su-pervisor is professionally accountable; and

(13) a statement signed by each supervisor andsupervisee acknowledging that each person hasread and agrees to the postgraduate supervisedprofessional experience requirements specified inthis regulation.

(j) All changes to the clinical supervision train-ing plan shall be submitted by the supervisee tothe board for its approval. The changes shall besubmitted no more than 45 days after the date onwhich the changes took effect. If the superviseefails to submit the changes to the board within that45-day period, no supervised hours of practiceshall be accrued or credited for any practice, be-ginning on the date the changes took effectthrough the date on which the changes to the planare approved by the board. 102-7-7. Renewal; late renewal. (a) To beconsidered for license renewal, each licensed ad-diction counselor and each licensed clinical addic-tion counselor shall submit the following items tothe board:

(1) A completed renewal application;(2) the continuing education reporting form;

and

(3) the renewal fee specified in K.A.R. 102-7-2.

(b) If the items specified in subsection (a) arenot submitted before the date the license expires,the licensee may late renew the license by per-forming the following:

(1) Submitting a completed late renewal appli-cation form;

(2) paying the required renewal fee and the laterenewal penalty fee specified in K.A.R. 102-7-2;and

(3) submitting the continuing education re-porting form and documentation pursuant toK.A.R. 102-7-10.

(c) Each individual who holds an addictioncounseling license or a clinical addiction counsel-ing license but who fails to renew the license be-fore its expiration and subsequently applies to re-new the license shall indicate the following on thelate renewal application form:

(1) Specification of whether or not the individ-ual has continued to practice addiction counselingin Kansas or has continued to represent that in-dividual as being a licensed addiction counselor ora licensed clinical addiction counselor in Kansasafter the individual’s license expired; and

102-7-7a. Reinstatement after suspen-sion or revocation. (a) If the license of any in-dividual has been suspended and the individualsubsequently wants to apply for license reinstate-ment, the individual shall submit the followingitems:

(1) The completed reinstatement applicationform;

(2) the required reinstatement fee specified inK.A.R. 102-7-2;

(3) the continuing education reporting formand documentation pursuant to K.A.R. 102-7-10;

(4) proof satisfactory to the board that the in-dividual has complied with sanctions and anyother conditions imposed under the suspension;and

(5) any materials, information, evaluation or ex-

amination reports, or other documentation thatmay be requested by the board and that will en-able the board to satisfactorily evaluate and de-termine whether or not the license should bereinstated.

(b) If the license of any individual has been re-voked and the individual subsequently wants toapply for license reinstatement, the individualshall submit the following items:

(1) The completed reinstatement applicationform;

(2) the required reinstatement fee specified inK.A.R. 102-7-2;

(3) the continuing education reporting formand documentation pursuant to K.A.R. 102-7-10;and

(4) any materials, information, evaluation or ex-amination reports, or other documentation thatthe board may request and that will enable theboard to satisfactorily evaluate and determinewhether or not to reinstate the license. Factors tobe considered by the board in determiningwhether or not to reinstate the revoked licenseshall include the following:

(A) The extent to which the individual presentlymerits the public trust;

(B) the extent to which the individual has dem-onstrated consciousness of the misconduct thatresulted in the license revocation;

(C) the extent of the individual’s remediationand rehabilitation in regard to the misconduct thatresulted in the license revocation;

(D) the nature and seriousness of the originalmisconduct;

(E) the individual’s conduct after the licenserevocation;

(F) the time elapsed since the license revoca-tion; and

(G) the individual’s present knowledge andcompetence in addiction counseling skills. 102-7-8. Renewal audit. (a) A random au-dit of the continuing education documentation for10 percent of the addiction counselor licenses andthe clinical addiction counselor licenses expiringeach month shall be conducted by the board.

(b) Each licensee selected for the random audit

shall be notified after the board has received thelicensee’s renewal application form required byK.A.R. 102-7-7.

(c) Upon board notification, each renewal ap-plicant shall submit the following to the boardwithin 30 days after the license expiration date:

(1) The completed renewal audit forms; and(2) the original continuing education docu-

ments that validate all continuing education hoursclaimed for credit during the current renewalperiod.

(d) Continuing education hours that a renewalapplicant earns after board receipt of the renewalapplication form shall not be approved for contin-uing education credit for the period being au-dited. 102-7-9. Continuing education. (a) Eachlicensee shall complete 30 hours of documentedand approved continuing education oriented tothe enhancement of an addiction counselor’spractice, values, ethics, skills, or knowledge duringeach two-year renewal period. Continuing edu-cation hours accumulated in excess of the require-ment shall not be carried over to the next renewalperiod.

(b) During each two-year renewal period andas a part of the required continuing educationhours, each licensee shall complete three hours ofprofessional ethics and each clinical addictioncounselor licensee shall complete six hours relatedto the diagnosis and treatment of substance usedisorders. These hours shall be obtained from anyof the activities specified in paragraphs (d)(1),(d)(2), (d)(3), (d)(4), (d)(9), and (d)(10).

(c) One hour of continuing education creditshall consist of at least 50 minutes of classroominstruction or at least one clock-hour of othertypes of acceptable continuing education experi-ences listed in subsection (d). One-quarter hourof continuing education credit may be granted foreach 15 minutes of acceptable continuing educa-tion. Credit shall not be granted for fewer than 15minutes.

(d) Acceptable continuing education, whethertaken within the state or outside the state, shallinclude the following:

(1) An academic addiction counseling course oran academic course oriented to the enhancementof addiction counselor’s practice, values, ethics,skills, or knowledge that is taken for academiccredit. Each licensee shall be granted 15 contin-uing education hours for each academic credithour that the licensee successfully completes. Themaximum number of allowable continuing edu-cation hours shall be 30;

(2) an academic addiction counseling course, oran academic course oriented to the enhancementof an addiction counselor’s practice, values, ethics,skills, or knowledge, that is audited. Each licenseeshall receive continuing education credit on thebasis of the actual contact time that the licenseespends attending the course, up to a maximum of15 hours per academic credit hour. The maximumnumbers of allowable continuing education hoursshall be 30;

(3) a seminar, institute, conference, workshop,or course. The maximum number of allowablecontinuing education hours shall be 30;

(4) if a posttest is provided, an activity consist-ing of completing a computerized interactivelearning module, viewing a telecast or videotape,listening to an audiotape, or reading. The maxi-mum number of allowable continuing educationhours shall be 30;

(5) if a posttest is not provided, an activity con-sisting of completing a computerized interactivelearning module, viewing a telecast or videotape,listening to an audiotape, or reading. The maxi-mum number of allowable continuing educationhours shall be five;

(6) a cross-disciplinary offering in medicine,law, a foreign or sign language, computer science,professional or technical writing, business admin-istration, management sciences, or any other dis-cipline if the offering is clearly related to the en-hancement of an addiction counselor’s practice,values, ethics, skills, or knowledge. The maximumnumber of allowable continuing education hoursshall be 10;

(7) a self-directed learning project preapprovedby the board. The maximum number of allowablecontinuing education hours shall be 10;

(8) providing supervision to practicum or internstudents, applicants for licensure as clinical addic-tion counselors, or other clinical mental healthpractitioners. The maximum number of allowablecontinuing education hours shall be 10;

(9) the first-time preparation and presentationof an addiction seminar, institute, conference,

workshop, or course, or the substantial revision ofan addiction counseling seminar, institute, con-ference, workshop, or course. The maximumnumber of allowable continuing education hoursshall be 10 for documented preparation and pres-entation time;

(10) the preparation of a professional addictioncounseling article published for the first time in aprofessional journal, a book chapter published bya recognized publisher, or a written presentationgiven for the first time at a statewide or nationalprofessional meeting. If more than one licenseeor other professional authored the material, thecontinuing education credit shall be proratedamong the authors. The maximum number of al-lowable continuing education hours shall be 10;and

(11) participation in a professional organizationor appointment to a professional credentialingboard, if the goals of the organization or board areclearly related to the enhancement of addictioncounseling practice, values, ethics, skills, andknowledge. Participation may include holding of-fice or serving on committees of the organizationor board. The maximum number of allowable con-tinuing education hours shall be 10.

(e) Continuing education credit approval shallnot be granted for identical programs if the pro-grams are completed within the same renewalperiod.

(f) Continuing education credit shall not begranted for the following:

(1) In-service training, if the training is for joborientation or job training or is specific to the em-ploying agency; and

(2) any activity for which the licensee cannotdemonstrate to the board’s satisfaction that theprogram’s goals and objectives are to enhance thelicensee’s practice, values, ethics, skills, or knowl-edge in addiction counseling.

(g) Each licensee shall maintain individual,original continuing education records. These re-cords shall document the licensee’s continuing ed-ucation activity attendance, participation, or com-pletion as specified in K.A.R. 102-7-10. Anylicensee may be required to submit these recordsto the board at least 30 days before the expirationdate of each current licensure period. 102-7-10. Documentation of continuingeducation. Each of the following forms of doc-umentation shall be accepted as proof that a li-censee has completed that continuing educationactivity:

(a) An official transcript or other proof indicat-ing a passing grade for an academic course;

(b) a statement signed by the instructor indi-cating the number of actual contact hours at-tended for an audited academic course. A copyshall not be accepted;

(c) a signed statement from the provider of aseminar, institute, conference, workshop, orcourse indicating that the licensee attended thecontinuing education program. A copy shall notbe accepted;

(d) for each videotape, audiotape, computer-ized interactive learning module, or telecast thatthe licensee utilized for continuing education pur-poses, a written statement from the licensee spec-ifying the media format, content title, presenteror sponsor, content description, length, and activ-ity date;

(e) a copy of a self-directed project. The li-censee shall submit this copy to the board to eval-uate and certify the number of credit hours thatthe board will grant;

(f) written, signed verification from the univer-sity practicum or intern instructor or other officialtraining director for whom the licensee supervisedundergraduate or graduate students or from thepostgraduate supervisee for whom the licenseeprovided supervision. A copy shall not beaccepted;

(g) a copy of an academic course syllabus andverification that the licensee presented thecourse;

(h) a copy of a letter from the presentationsponsor or a copy of the brochure announcing thelicensee as the presenter, the agenda of the pres-entation, and verification that the licensee pre-sented the seminar, institute, conference, work-shop, or course;

(i) a copy of an article or book chapter writtenby the licensee and verification of publication orwritten presentation at a professional meeting.The licensee shall submit these materials to theboard to evaluate and certify the number of hoursof credit to be granted; and

(j) a signed letter from a professional organi-zation or credentialing board outlining the li-censee’s participation in that professional organi-zation or credentialing board. A copy shall not be

102-7-11. Unprofessional conduct. Eachof the following acts shall be considered unpro-fessional conduct for a licensed addiction coun-selor, a licensed clinical addiction counselor, or anapplicant for an addiction counselor license or aclinical addiction counselor license:

(a) Except when the information has been ob-tained in the context of confidentiality, failing tonotify the board, within a reasonable period oftime, that the licensee or applicant or any otherperson regulated by the board or applying for li-censure or registration has met any of theseconditions:

(1) Has had a professional license, certificate,permit, registration, certification, or professionalmembership granted by any jurisdiction, profes-sional association, or professional organizationthat has been limited, conditioned, qualified, re-stricted, suspended, revoked, refused, voluntarilysurrendered, or allowed to expire in lieu of or dur-ing investigatory or disciplinary proceedings;

(2) has been subject to any other disciplinaryaction by any credentialing board, professional as-sociation, or professional organization;

(3) has been demoted, terminated, suspended,reassigned, or asked to resign from employment,or has resigned from employment, for some formof misfeasance, malfeasance, or nonfeasance;

(4) has been substantiated of abuse against achild, an adult, or a resident of a care facility; or

(5) has practiced the licensee’s profession in vi-olation of the laws or regulations that regulate theprofession;

(b) knowingly allowing another person to useone’s license;

(c) impersonating another person holding a li-cense or registration issued by this or any otherboard;

(d) having been convicted of a crime resultingfrom or relating to one’s professional practice ofaddiction counseling;

(e) furthering the licensure application of an-other person who is known or reasonably believedto be unqualified with respect to character, edu-cation, or other relevant eligibility requirements;

(f) knowingly aiding or abetting any individual

who is not credentialed by the board to representthat individual as a person who was or is creden-tialed by the board;

(g) failing to recognize, seek intervention, andotherwise appropriately respond when one’s ownpersonal problems, psychosocial distress, or men-tal health difficulties interfere with or negativelyimpact professional judgment, professional per-formance and functioning, or the ability to act inthe client’s best interests;

(h) failing or refusing to cooperate in a timelymanner with any request from the board for a re-sponse, information, or assistance with respect tothe board’s investigation of any report of an al-leged violation filed against oneself or any otherapplicant or professional who is required to belicensed or registered by the board. Each persontaking longer than 30 days to provide the re-quested response, information, or assistance shallhave the burden of demonstrating that the personhas acted in a timely manner;

(i) offering to perform or performing servicesclearly inconsistent or incommensurate with one’straining, education, or experience or with ac-cepted professional standards;

(j) engaging in any behavior that is abusive ordemeaning to a client, student, or supervisee;

(k) imposing one’s personal values, spiritual be-liefs, or lifestyle on a client, student, or supervisee;

(l) discriminating against any client, student, di-rectee, or supervisee on the basis of color, race,gender, age, religion, national origin, or disability;

(m) failing to inform each client of that client’srights as those rights relate to the addiction coun-seling relationship;

(n) failing to provide each client with a descrip-tion of the services, fees, and payment expecta-tions, or failing to reasonably comply with thatdescription;

(o) failing to provide each client with a descrip-tion of the possible effects of the proposed treat-ment if the treatment is experimental or if thereare clear and known risks to the client;

(p) failing to inform each client, student, or su-pervisee of any financial interests that might ac-crue to the licensee or applicant if the licensee orapplicant refers a client, student, or supervisee toany other service or if the licensee or applicantuses any tests, books, or apparatus;

(q) failing to inform each client that the clientcan receive services from a public agency if one isemployed by that public agency and also offersservices privately;

(r) failing to obtain written, informed consentfrom each client, or the client’s legal representa-tive or representatives, before performing any ofthe following actions:

(1) Electronically recording sessions with thatclient;

(2) permitting a third-party observation of theiractivities; or

(3) releasing information concerning a client toa third person, unless required or permitted bylaw;

(s) failing to exercise due diligence in protectingthe information regarding the client from disclo-sure by other persons in one’s work or practicesetting;

(t) engaging in professional activities, includingbilling practices and advertising, involving dishon-esty, fraud, deceit, or misrepresentation;

(u) using alcohol or any illegal drug or misusingany substance that could cause impairment whileperforming the duties or services of an addictioncounselor;

(v) engaging in a harmful dual relationship orexercising undue influence;

(w) making sexual advances toward or engagingin physical intimacies or sexual activities with ei-ther of the following:

(1) Any person who is a client, supervisee, orstudent; or

(2) any person who has a significant relationshipwith the client and that relationship is known tothe licensee;

(x) making sexual advances toward or engagingin physical intimacies or sexual activities with anyperson who meets either of the followingconditions:

(1) Has been a client within the past 24 months;or

(2) has had a significant relationship with a cur-rent client or a person who has been a clientwithin the past 24 months and that relationship isknown to the licensee;

(y) directly or indirectly offering or giving to athird party or soliciting, receiving, or agreeing toreceive from a third party any fee or other consid-eration for referring the client or in connectionwith performing professional services;

(z) permitting any person to share in the feesfor professional services, other than a partner, anemployee, an associate in a professional firm, or aconsultant authorized to practice addiction coun-seling or clinical addiction counseling;

(aa) soliciting or assuming professional respon-

sibility for clients of another agency or colleaguewithout attempting to coordinate the continuedprovision of client services by that agency orcolleague;

(bb) making claims of professional superioritythat one cannot substantiate;

(cc) guaranteeing that satisfaction or a cure willresult from performing or providing any profes-sional service;

(dd) claiming or using any secret or specialmethod of treatment or techniques that one re-fuses to disclose to the board;

(ee) continuing or ordering tests, procedures,or treatments or using treatment facilities or serv-ices not warranted by the client’s condition, bestinterests, or preferences;

(ff) taking credit for work not personally per-formed, whether by giving inaccurate or mislead-ing information or by failing to disclose accurateor material information;

(gg) if engaged in research, failing to meet theserequirements:

(1) Considering carefully the possible conse-quences for human beings participating in theresearch;

(2) protecting each participant from unwar-ranted physical and mental harm;

(3) ascertaining that each participant’s consentis voluntary and informed; and

(4) preserving the privacy and protecting theanonymity of each subject of the research withinthe terms of informed consent;

(hh) making or filing a report that one knowsto be false, distorted, erroneous, incomplete, ormisleading;

(ii) failing to notify the client promptly if oneanticipates terminating or interrupting service tothe client;

(jj) failing to seek continuation of service, orabandoning or neglecting a client under or in needof professional care, without making reasonablearrangements for that care;

(kk) abandoning employment under circum-stances that seriously impair the delivery of pro-fessional care to clients and without providing rea-sonable notice to the employer;

(ll) failing to terminate addiction counselingservices if it is apparent that the relationship nolonger serves the client’s needs or best interests;

(mm) when supervising, failing to provide ac-curate and current information, timely evalua-tions, and constructive consultation;

(nn) when applicable, failing to inform a client

that addiction counseling services are provided ordelivered under supervision;

(oo) failing to inform a client that addictioncounseling services are delivered under supervi-sion as a student or an individual seeking clinicallicensure;

(pp) failing to report unprofessional conduct ofa licensed addiction counselor, licensed clinicaladdiction counselor, or any individual licensed bythe board;

(qq) intentionally or negligently failing to file areport or record required by state or federal law,willfully impeding or obstructing another personfrom filing a report or record that is required bystate or federal law, or inducing another personto take any of these actions;

(rr) offering to perform or performing any serv-ice, procedure, or therapy that, by the acceptedstandards of addiction counseling practice in thecommunity, would constitute experimentation onhuman subjects without first obtaining the full,informed, and voluntary written consent of the cli-ent or the client’s legal representative orrepresentatives;

(ss) practicing addiction counseling after one’slicense expires;

(tt) using without a license, or continuing to useafter a license has expired, any title or abbrevia-tion defined by regulation; and

(uu) violating any provision of the addictionscounselor licensure act or any implementing reg-ulation. 102-7-11a. Recordkeeping. (a) Each li-censed addiction counselor and each licensedclinical addiction counselor shall maintain a rec-ord for each client that accurately reflects the li-censee’s contact with the client and the results ofthe addiction counseling or clinical addictioncounseling services provided. Each licensee shallhave ultimate responsibility for the content of thelicensee’s records and the records of those per-sons under the licensee’s supervision. These re-cords may be maintained in a variety of formats,if reasonable steps are taken to maintain the con-fidentiality, accessibility, and durability of the re-cords. Each record shall be completed in a timelymanner and, at a minimum, shall include the fol-

lowing information for each client in sufficient de-tail to permit planning for continuity of care:

(1) Adequate identifying data;(2) the date or dates of services that the licensee

or the licensee’s supervisee provided;(3) the type or types of services that the licensee

or the licensee’s supervisee provided;(4) the initial assessment, conclusions, and

recommendations;(5) the treatment plan; and(6) the clinical or progress notes from each

session.(b) If a licensee is the owner or custodian of

client records, the licensee shall retain a completerecord for the following time periods, unless oth-erwise provided by law:

(1) At least six years after the date of termina-tion of one or more contacts with an adult; and

(2) for a client who is a minor on the date oftermination of the contact or contacts, at least un-til the later of the following two dates:

(A) Two years past the date on which the clientreaches the age of majority; or

(B) six years after the date of termination of thecontact or contacts with the minor. The ‘‘diagnostic andstatistical manual of mental disorders,’’ fourth edi-tion, text revision, copyrighted in 2000 and pub-lished by the American psychiatric association, ishereby adopted by reference. This manual shallbe used for the diagnosis and treatment of sub-stance use disorders.
