Topic: Cover Memo for November 3, 2014 Board of Directors Meeting

Please note that the Board meeting will take place at the Harbour Pointe Clubhouse.

Item 5: Member Voice

Please note that the comment period regarding the FY20 15 Budget occurs separate from this agenda item. Residents are encouraged to address the Board about any topic they wish during Member Voice.

Item 6: Reports

Treasurer Hillman will again recommend the appointment of Gail Plante as a voting member of the Finance Committee.

Other committee appointments will be made at the December Board of Directors meeting. The CM will repOli on the committee recruitment process and success to date.

Item 7: Appeal Hearing re: 2600 Suller 's Mill Terrace

The Board wi 11 first be given an overview by staff of the appeal issue in question, (written material from Al Raimo included in the Board package). The Board will then hear comments from the owner of the propelty. The Board may ask questions of either as the presentations are given.

Item 8: Changes to the Design Standards re: Temporary Signage

The ARB and staff have reviewed and revised the proposed changes that were submitted in October to the Board and the language is ready for approval.

Item 9: Changes to the Design Standards re: Solar Panels

The ARB has received a request to have solar panels installed on a house; the property is located at 2206 Birnham Woods Place. However, solar panels are not really addressed within our current design standards. During this past month, the ARB received valuable information and assistance from the property owner, his contractor, as well as from Dominion Power. While the ARB is more knowledgeable about this application than before, they are not yet ready to give final approval to the supplicant until we have the standards in place. The homeowner (Mr. Brake), contractor, and Dominion Power have contributed and assisted the ARB with the development of changes to the design standards. The language for the Board' s consideration addresses the use of solar panels specifically and directly, and is being submitted by the ARB for the Board's consideration.

Item 10: 2015 Recommended Budget

The Community Manager will give a brief presentation on any changes that the Finance Committee and the CM have made to the budget, as it went from being the Proposed Budget to the Recommended Budget following the community meeting. The presentation will be followed by a period of Member Comment, giving yet another opportunity for the membership to weigh in on the budget. After Member Comment, the Board members are encouraged to make comments and discuss possible amendments that they may be considering. No vote will be taken on the budget at this meeting. Budget amendments, final overall adoption, and setting of the annual assessment wi ll occur at 7:00pm on Tuesday, November 18,2014 at the Harbour Pointe Clubhouse.

1. Call Board Meeting to Order - The October 6, 2014 BCA Board of Directors Meeting was called to order by President Charlie Davis at 7:00 PM at The Brandermill Church, 4500 Millridge Parkway, Midlothian, V A 23112. Directors Jack Bettin, Don Blom, Charlie Davis, Frances Hillman, Tom Leonard, Bob Malek, and Greg Pearson, Community Manager John Bailey, and Recorder Judy Agee were present.

2. Director Bettin led the meeting with the Pledge of Allegiance.

3. Approval of Agenda MOTION: Director Malek moved to approve the Agenda. MOTION SECONDED: Director Hillman MOTION CARRIED: Unanimously approved.

4. Consideration of Minutes for Meeting of September 8, 2014 MOTION: Director Blom moved to approve the Minutes of the Regular Board Meeting of September 8, 2014. MOTION SECONDED: Director Malek MOTION CARRIED: Unanimously approved.

5. Reports A. President - There w as no report.

B. Treasurer's Report - Director Hillman gave an overview of the "Budget Variances including Year to Date for Operating to August 31, 2014" report. Several board members discussed their concerns regarding budget entries.

C. 1st Vice President - Committee AppOintment - President Davis expressed concern that Gail Plante, the candidate for membership of the Finance Committee, be interviewed by 1st Vice President Pearson and the board deferred her appointment to the November 3 Board meeting.

D. Members of the Board - Director Leonard reported the ARB has received a request to review an application for solar panels and stated currently no standards exist. H e advised the Association cannot restrict the use of solar panels unless there is a written standard, which will be drafted by the ARB for Board review and approval.

E. Community Manager - Report & Budget Preview - Community Manager Bailey provided an update on the committee member recruitment to include 7 members for each committee: ARB has 7 members; Communications & Marketing needs 5; Community Services needs 3; Finance needs 1; H earing Panel needs 1; NRC needs 3; Planning needs 7 members. Manager Bailey encouraged everyone to recruit more committee members.

vacuum leaf and pine tag pickups scheduled for November, December and January, with special rates for members. Further information and the order form will be included in The Village Mill October issue.

-Manager Bailey provided the status report of activities for the Property Management Department and minutes of the September Hearing Panel meeting. He reported there are now 30 brown mailboxes, of which 16 are ordered and need installation, 11 are involved in the Hearing Panel process, and 3 are included in the self-help program.

-Manager Bailey reported the areas noted by Dennis Lacey during Member Voice at the September board meeting are being checked for correction and cleanup.

-Community Manager Bailey reported an email message was received prior to this evening's meeting from Brandermill Woods' Executive Director Mira Pallota. Health Care Facilities Administrator Cynthia Ritter attended the board meeting to express Pallota's concern about the board's lack of information regarding the proposed assisted living and memory care facility planned by the owner of property formerly occupied by the Brandermill Inn in Harbour Pointe, and whether there is a need for additional assisted living and Alzheimer care in the Brandermill area. The board of directors responded that the ARB has reviewed the plans for this development and noted the state and county have authority to decide the types and number of business that come into Brandermill. President Davis reported Community Manager Bailey will meet with Ms. Pallota to discuss these concerns.

-Manager Bailey presented the proposed BCA 2015 Budget which is included in the October issue of The Village Mill. He noted a community meeting for Brandermill residents is scheduled October 20, 2014 at 6:30 PM at the Harbour Pointe Clubhouse and encouraged members to attend this meeting and also to provide comments and suggestions regarding the proposed budget by email to:[email protected]. or calling the BCA office. The board will continue to receive member input until the final vote is taken in mid-November.

F. Committee Chairs-1. ARB - August 26 and September 9, 2014 meeting minutes are attached. 2. Special Committee on Abandoned and Rental Properties (SCARP) - August 27,

2014 meeting minutes are attached. Director Pearson reported the SCARP has met three times and the fourth meeting is scheduled on October 8 which will include the BCA attorney to discuss legal issues. They have identified properties that are abandoned or vacant, and which properties have not paid BCA assessments. The group will continue to meet and will provide a report to the board in January.

The board agreed to move Agenda Item 8. Consideration of Request by Committee to Pursue Liens Against Two Residential Properties before Agenda Item 6. Member Voice.

6. Consideration of Request by Committee to Pursue Liens Against Two Residential Properties (properties located in Fortunes Ridge and Winterberry Ridge -

MOTION: Director Pearson moved to pursue liens against the residential properties located on Fortunes Ridge Road and Winterberry Ridge Terrace, with 30 days notice given to the owners. MOTION SECONDED: Director Davis Discussion: All board members were involved in the discussion of this motion. MOTION CARRIED: Unanimously approved.

7. Member Voice - There was no report.

8. Consideration of Changes to the Design Standards reo Temporary Signage -

MOTION: Director Leonard moved to adopt the Changes to the Commercial Design Standards regarding Temporary Signage, as recommended by the ARB. MOTION SECONDED: Director Hillman Discussion: All board members were involved in the discussion of this motion. SUBSTITUTE MOTION: Director Pearson moved to defer action on these changes until the November board meeting. MOTION SECONDED: Director Davis MOTION CARRIED: Directors Blom, Davis, Hillman, Malek and Pearson approved, and Directors Bettin and Leonard opposed.

9. Executive Session - Per Virginia Property Owners Association Act. Section 55-51D.I.C - For the purpose of discussing Contractual, Legal and Personnel Matters -

MOTION: Director Bettin moved to enter into executive session according to Section 55-51D.1.C of the Virginia Property Owners Association Act for the purpose of discussing legal and personnel matters. MOTION SECONDED: Director Pearson MOTION CARRIED: Unanimously approved.

10. Return to Open Session - The board returned to open session.

MOTION: Director Blom moved to grant Mr. Bhupendra Patel's request to convert the Sleep Inn & Suites - Harbour Pointe from "Public or Commercial Unit" to "Self­Maintained Public or Commercial Unit." MOTION SECONDED: Director Hillman MOTION CARRIED: Unanimously approved.

MOTION: Director Hillman moved to establish a policy of no loans to employees by the Association and task the Finance Committee to create language for incorporating such language into the Financial Policy; and to furthermore task the Finance Committee to

Budget Summary YTO (September 30, 2014)

• Year to date Revenue (Operating Income) $1,720,794 less than budget by ($15,652)

• Year to date Operating Expenses were $1,759,019 more than budget by $1,261 • Year to date Net Income was $38,225 variance of $16,913

Cash Balances:

• At the end of September, cash on hand was ($8,437.71) • The Total Reserve fund is $1,220,641

1. The Capital Replacement Reserve is $1,067,152 2. Capital Improvement is $139,597 3. Sunday Park & Interest is $13,892

Significant Variances vs Budget:

• There are several Income accounts which were significantly less than budgeted 1. Assessments ($4,419) Commercial property went self-maintenance 2. Advertising Sales - Village Mill ($19,750) advertisers are not renewing contracts 3. Directory Income ($4,653) hopefully this trend will not continue 4. Pool Membership ($7, 869) with a small increase in fees hopefully next year will

not see a deficit .

• There are two Income accounts which are Significantly more than budget 1. Violation Charges $3,052 unfortunately we have more violation 2. Disclosure Packages $6,400 home sales are more than budget

• Employee costs are running less than budget by ($42,950), employees have not been replaced, plus some short term illnesses.

• Total Operating Expenses were more than budget:

Operating accounts which were significantly more than budget: 1. Equipment Purchases ($4,638) Better budgeting required next year 2. Bank/Credit Card Charge ($3,108) more people using credit cards 3. Bad Debts ($11,690) more bankruptcy and foreclosures 4. Collect ion Expenses ($4,828) a lot of res idents are being sent to collections

5. General Repairs & Maintenance ($13,566) Hopefully we can budget better

6. Irrigation Repairs ($5,406) un budgeted repairs to our Irrigation system 7. Legal Fees ($13,084) Brandermilllnn, Covenant 2a & Abandoned Property 8. Postage ($3,305) Survey on Covenant 2a . 9. Tree Removal ($5,475) more trees needed to be removed 10. Uniforms - Maintenance ($11,308) Budgeted incorrectly 11. Leaf Pickup ($3,052) There is income to offset expense

Other Comments/Actions • Employee costs will run under budget all year because it was budgeted for a full time

person and was not replaced along with loss of a maintenance person

• Everyone is working hard to keep expenses down.

• We are in good financial shape.

• The budgeting process should be concluded in November.

• The Financial Policies will be reviewed and revisions should be soon.

During the month of October follow up reviews on non compliant mail box structures were conducted. You may recall that starting in February, and every month since, all single family residential neighborhoods were reviewed to determine the status ofthemail box transition. Please see below for updated infomlation.

Below is a breakdown of key information:

I. There are twenty four brown mailbox units remaining. Last month there were thirty (30). When we started the review in February of this year there were two hundred and forty eight (248) non compliant units, and that number has been continually reduced every month since.

2. Of the twenty four (24), eleven (II) owners will have their units replaced over the next 30 days, as part of the self help program. Eleven (II) other owners have made arrangements for replacement units and two (2) properties have been referred to our legal counsel.;

3. There are twenty (20) neighborhoods that have at least one property that needs a replacement unit all other neighborhoods are compliant.

4. No neighborhood has more than two (2) properties that need a replacement mailbox. Four (4) neighborhoods have two (2) units to be replaced. Sixteen (16) neighborhoods have only one property that needs a new unit.

5. The cluster units are complete.

Mr. President, and members of the Board. We are here this even ing based upon an appeal of a Hearing

Panel (HP) decision regarding the above referenced property. The owner of the property, Property

Ventures, through its members representative Mr. Robert Beloff has filed a timely appeal of the HP

decision rendered on August 28, 2014.

On behalf of the staff and the HP I am here tonight to ask that you uphold the decision of the HP for the

following reasons.

1. All appropriate protocols were followed by staff and HP, (outlined below are the details).

2. The property was in non compliance on the day of the hearing, and remains in non compliance.

The HP determined that the following conditions constituted non compliance with the Declaration

(General Covenants) and or the Residential Design Standards (RDSf:

1. Repair peeling paint, (unsightly conditions)

2. Remove and or replace rotting landscape timbers, (unsightly conditions)

3. Grind stumps from trees that were removed without BCA approval, (unsightly conditions)

4. Submit landscape plan to ARB showing what was to be replaced for the unauthorized trees

removed, (General Covenants- "no tree to be removed greater than 6" in diameter at 2 'off the

ground, unless approve by the company"). ;;

The specifics of this case are as follows:

1. Three written notices - dated 5/28/14,7/1/14, and 7/31/14 - were mailed to Property Ventures,

at their last known address, outlining the nature of the violation(s), the corrective action

necessary, and the time line to bring the property into compliance.

2. With each notice a minimum 15 day compliance date was established.;;;

3. In accordance with the Virginia Property Owners Association Act (VPOAA), on August 14, 2014

Property Ventures was notified, via Certified Mail return receipt requested that the subject

property would be referred to the HP for a hearing on Thursday August 28,2014. ;'

4. Hearing was held, property owner did not attend and did not communicate to the staff. '

5. HP determined property in non - compliance and established a new compliance date of

September 27, 2014, and imposed a $10.00 a day additional assessment retroactive to the

date, the additional assessments are charged for a maximum of 90 days, or until the property is

brought into compliance).

5. Again, in accordance with the VPOM, on September 2, 2014 staff sends certified letter to

property owner documenting the results of the HP meeting.';

7. The property remains in non compliance as it relates to the above violations.

Based upon the information presented above and attached, and in the VPOAA, the Declaration, and

other governing documents, I ask that you uphold the decision of the Hearing Panel. Further I ask that

you strongly encourage the property owner, through their agent here this evening, to comply with

requests of staff in a timely manner, and that the owner immediately take steps to cure the deficiencies

and improve the conditions of this property for the greater good of Brandermill and specifically the

Sutter's Mill neighborhood.

11.1.2 Houses/Buildings:

a. Roofs and gutters shou ld be relatively free from leaves, limbs and debris. Missing shingles, broken gutters, broken down spouts, and rotten wood on steps and stoops are to be repaired in a timely manner.

b. Paint and stain that has faded, discolored, peeled, chipped or cracked is in need of maintenance. Excessive mold, mildew and other signs of damage or neglect are to be addressed instead of being allowed to continue. A house or other structure that has not been painted or stained andlor exhibits a need for re-application or stain constitutes an unsightly condition and must be addressed in a timely manner.

c. Windows and sliding glass doors that use Thermopane-type glass should be replaced if the vapor barrier is breached.

d. Structures or enclosures utilizing tarps, drop cloths or sheets of plastic are unattractive and unacceptable.

e. The permanent use of sheets or towels for window coverings is prohibited. All torn or bent window coverings must be replaced.

f. Holiday decorations may be installed no sooner than 30 days before and removed no later than 30 days after the holiday.

g. Excessive roof stains that noticeably and negatively impact the overall appearance of the building must be removed.

does not overcrowd the site as determined by the ARB and provided further that such building is not used for any activity in any way conducted as a business. Such accessory building may not be constructed prior to the construction of the main building. A guest suite or like facility without a kitchen may be included as a part of the main dwelling or accessory building, but such suite may not be rented or leased except as part of the entire improved lot including the main residence. (See also Condominiums in para. 4.5.11 below.)

4.5.3 Minimum Floor Areas: All houses in Brandermill are subject to minimum finished floor area requirements. Consult the NEIGHBORHOOD MA TRIX in "Appendix A" following these Standards for the requirement for your lot. Minimum finished floor areas include all finished areas except: unfinished "bonus" rooms, garages, basements, open or screened porches, terraces, decks, walk-up attic areas, attics, and attached storage sheds.

4.5.4 Maximum Height: Houses shall not be more than 2-% stories in height above a crawl space or basement, nor more than 35' above grade. One-half (%) story is defined as useable floor area under a gabled roof.

4.5.5 Massing and Form: Exterior walls, planes, and masses shall be of a residential scale with sufficient openings for light, view and air consistent with the residential scale of the community. The ARB reserves the right to require that large planes be broken up with additional windows, or off-sets to maintain appropriate scale.

4.5.6 Minimum Roof Pitch: Generally, the minimum roof pitch on main roof shall be 7 in 12. Secondary roofs (porches, rear dormers, additions) shall generally be no less than 3 in 12 pitch. Exceptions to these minimum slopes may be granted by the ARB for new homes if a lower pitch is an essential element of an architectural style and that style has been approved by the ARB.

4.5.7 Design Styles: The ARB reserves the right to reject highly stylized houses with overstated eclectic design elements, houses with overly mixed styles, or houses with insufficient stylistic theme or treatment.

4.5.8 Openings and Privacy: Where proposed designs indicate windows, doors, or other openings that directly face openings on adjacent existing houses, the ARB may require screening, relocation, or elimination of the opening.

4.5.9 Patio Homes: Homes in neighborhoods defined as Patio Lots (,PAT" in the NEIGHBORHOOD MATRIX) have privacy restrictions on one side of the house. On the side defined on the plat as the "zero lot line" side, the house shall have no openings (windows or doors) that face that side, unless such opening is screened fully from view by a patio wall (see Article 9.0). Open and screened porches shall also be closed on that side or screened by a patio wall.

4.5.10 Townhomes: Some neighborhoods, defined as Townhouse or Multi-Family ("TMF" in the NEIGHBORHOOD MATRIX) are constructed as townhouses on individual lots. These houses may be attached on both sides or on one side. Ownership of each attached unit extends to the center of the common wall between units. Modification of the common wall is prohibited except that any exposed wall surface may be finished to match the unit to which it faces (main house only - not sheds or accessory structures).

4.5.11 Condominiums: Some neighborhoods, defined as Townhouse or Multi-Family ("TMF" in the NEIGHBORHOOD MATRIX) are constructed as condominiums on common lots. Exterior modifications to condominium units are restricted by the condominium documents recorded with the deed to the unit, in addition to BCA standards. Contact your condominium representatives for limitations applying to your unit.

4.6 EXTERIOR CONSTRUCTION

4.6.1 General Policy: All improvements to any lot in a neighborhood shall meet minimum standards of deSign, material quality, and workmanship consistent with the level of quality established for that neighborhood. The exterior of each structure shall consist of a vocabulary of materials, products, and assemblies that are

A. Language making it clear that BCA approval of the location of temporary sign age is contingent

on the applicant applying and receiving appropriate approvals from Chesterfield County,

B. allow establishments sixty (60) consecutive days, to place an approved sign outside of their

business,

C. allow a sign to be placed for a total of one hundred and twenty (120) days during a twelve

month time frame, and

D. allow one construction sign that may include various companies/business's related to the

project.

Attached is a copy of the Commercial Design Standard as discussed above.

5.3 TEMPORARY SIGNS AND BANNERS: Exterior temporary signs are permitted under SpecifIC circumstances. All temporary sign permits are discretionary and may be approved limited or denIed by the ARB for any reason. In aocordance with Chesterfield County zoning and subdivision ordinances, Section 19-613, htto:/twww.chesterfield.gov/content2.aspx7id-3485 it is the responsibility of the applicant to determine the need to seek approval or apply for a permit for the proposed sign(s). Signs to be located in

areas adjacent to the roadway, (twenty (20) feet or less to the curb} generally require a permit from the county. Applicant will represent to the ARB that contact has been made with Chesterfield County Planning Department and those results. Applicant will provide ARB with copy of permit if Sign requires such. Approval by the county does not automatically assure ARB approval. Generally, the ARB will approve a single temporary sign for placement outside a particular business but in some cases, depending on the business location and street frontage, the ARB will consider two signs. , However no more than two signs can be approved for the same business at the same time. The length of

time will be limited to sixty (60) days at one time, and no longer than one hundred and twenty days (120) in any given twelve (12) month period. General limitations for these signs are provided in the sub-paragraphs

below. Temporary signs, flyers, etc. are not permitted to be attached to trees, poles, existing permanent sign structures or any other surface not Specifically designed for signage. Temporary signs inside windows of inhabited building spaces are not regulated by this section.

5.3.1 BUILDING MOUNTED BANNERS: Weatherproof fabric banners, professiOllally made. may be permitted to be displayed on building faces for limited times to announce grand openings or other major events. Banners may not be used for on-going advertising purposes or for political campaigns. Building-mounted banners shall not exceed a maximum area of 40 s.f.

5.3.2 FREE-STANDING BANNERS: Free-standing banners may be permitted for limited lime5.,--QAly to announce

grand openings or other major events, non-commercial charity or civic events, sign-ups or fund·raising drives, allocations approved by the ARB. Free-standing banners for political campaigns are not permitted.

Free-standing banners shall not exceed a maximum area of 32 s.f Banners shall be supported with guy lines as needed to be kept straight and true.

5.3.3 TEMPORARY PROMOTIONAL SIGNS: Temporary promotional signs may be permitted to be used on an on·going basis (gaily GURRQ QblSiR966 R9l:1r:& 9Rly), in one of the following forms:

2' x 3' metal frame mounted sign located in landscaped area (planting bed or lawn) immediately adjacent (within 20') to the tenant space (for tenant signs) or owner's building professionally made sandwich board, maximum face size of 48" h x 30" w, set on sidewalk directly in front of tenant space (for tenant signs) or owner's building .

5.3.4 PROMOTIONAL DISPLAYS OTHER THAN SIGNS: Portable and trailer mounted reader boards, inflatable or other 3-dimensional structures, searchlights, or other promotional devices not addressed in this Artide are generally not permitted. For consideration as an exception, submit request to ARB. See also Flags and Flagpoles in para. 5.4 below

5.3.5 REAL ESTATE SALE AND TENANT LEASING SIGNS: Real Estate sale and tenant leasing signs are permitted in store or building windows. Free-standing signs for property sale or lease may be permitted in aocordance with the design and specifications below. No other commercial real estate sale or leasing signs are permitted.

5.3.6 CONSTRUCTION PERIOD SIGNS: Generally one construction sign is permitted on a property during construction. However the single construction sign, approved by the ARB, may indude the names of subcontractor, supplier, manufacturer, and financier. No individual subcontractor, supplier, manufacturer, financier or other advertising signs are permitted. Any proposed construction sign that exceeds the size limitations for post mounted

signs, in para . 5.2.2, shall be submitted for review and approval by the ARB. Construction signs shall be removed

within one week of issuance of Certificate of Occupancy by Chesterfield County. "No Trespassing~ or other temporary property control signage is permitted.

5.4 FLAGS AND FLAGPOLES: Flags and flagpoles may be permitted in accordance with the following standards. The ARB must approve the location, style and color of any flagpole.

5.4.1 VERTICAL FLAGPOLES FOR U.S. FLAG: Poles shall be commercially manufactured for the purpose of flying flags, of a durable, finished material. Maximum height is 30'; however shorter height limits may apply in some Zones

5.4.2 OTHER VERTICAL FLAGPOLES: Poles shall be commercially manufactured for the purpose of flying flags, of a durable, finished material. Maximum height is 25'; however shorter height limits may apply in some Zones. Generally, flags will be permitted for state and local governmental entities and for corporate entities. Decorative flags on vertical poles will generally not be approved.

5.4.3 BUILDING MOUNTED HORIZONTAL OR ANGLED FLAG STANDARDS: Permanent or temporary flag standards will be considered on commercial buildings upon approval of the location, number, size and proposed use, by the ARB.

5.4.4 FLAG SIZES AND TYPES: Conform to the following criteria:

The horizontal length of a permitted flag, flying on a vertical pole, should be at least 25%, but not more than 30% of the height of the pole. Flags on horizontal or angled standards should have a horizontal length not greater than 50% of the length of the standard. Flags designed for decoration or advertising will be reviewed generally like building mounted banners (see para. 5.3.1) except that repetitive use for advertising may be considered. All approved flags shall be commercially manufactured of a durable, weatherproof fabric with professionally printed graphics. All flag graphics are subject to approval by the ARB.

The ARB has before it an application for the installation of Solar Panels on a lot in Birnam Woods. The

current edition of the Residential Design Standards (RDS) is silent regarding this topic.

The ARB has created language that will now provide guidance to the membership and to the ARB in

addressing these type of applications. The current applicant understands that we are working to create

standards and he, his contractor and Dominion Power have been helpful in the ARB gaining a better

understanding of the technology and providing valuable insight that assisted in crafting this new

language.

The recommended language is attached for your review, and hopefully your approval.

Recommended language for Solar Panels

4.6.18 House Mounted Solar Panels: Solar panels will be considered for use on house roofs in

accordance with the following submittal requirements and review criteria:

a) Submittal shall demonstrate that panel system has been designed in conformance with industry

standards as adopted by the North American Board of Certified Energy Practitioners (NABCEP).

b) Submittal shall include the name of the installing contractor, who shall be licensed in Virginia

(Class A or B) and certified as an Alternative Energy Systems (AES) provider.

c) Submittal shall include a roof plan to scale with the panel sizes and locations shown. Flat panels

shall be mounted close to and in line with the building roof slope and organized in a simple and

aesthetic arrangement on the roof. The ARB reserves the right to require a different layout,

location, coverage area or organization of panels in order to achieve a more harmonious

presentation on the roof, to the extent that such changes do not unduly restrict the owner from

obtaining solar reception.

d) Any proposed tree removal required to maximize solar gain will be reviewed on a case-by-case

basis consistent with the overall character of the neighborhood and visual/solar impact on

neighboring properties.

e) Panels shall be finished in a uniform color and, to the extent possible, close to the roof color. All

panel trim shall be prefinished in the same color as the panels.

f) Mounting hardware shall be concealed under the panels. Wiring shall be in conduit that is

painted to match the roofing and located so as to minimize exposed runs on the roof. Wire

locations and all visible accessories shall be shown on the plan and shall be painted or finished

to match the roof (if no the roof surface) or the panel (if on the panel surface).

g) Alternative products such as thin films, conductive shingles or conductive finishes shall be

reviewed on a case by case basis consistent with the goals of this section.

h) The requirements of this section are subject to amendment over time as solar technologies and

application methods change.

For solar equipment not mounted on a house, I recommend adding language in Article 8 at the end.

8.12 Ground-Mounted Solar Arrays: Solar panels mounted in a yard and separate from the house, may

be considered in limited areas in accordance with the following submittal requirements and review

criteria:

a) Submittal shall demonstrate that panel system has been designed in conformance with industry

standards as adopted by the North American Board of Certified Energy Practitioners (NABCEP).

b) Submittal shall include the name of the installing contractor, who shall be licensed in Virginia

(Class A or B) and certified as an Alternative Energy Systems (AES) provider.

c) Ground mounted solar panels will only be permitted in the rear yard. Submittal shall include a

site plan to scale with the panel sizes and locations shown with distances to property lines.

from adjacent properties, streets or amenities. The ARB may also require landscape screening

as part of any approval.

basis consistent with the overall character of the neighborhood and visual/solar impact on

neighboring properties.

f) Supporting framework, trim, wiring and accessories shall be finished to match the panels.

g) The requirements of this section are subject to amendment over time as solar technologies and

application methods change.
