FY 2014 Project Proposals - Enhanced Data and Recordkeeping Requirements for Effective Pipeline Integrity
Management in ASME B31.8 and B31.8S (M. Rosenfeld) June 2013 – From the Board Research Evaluation Group (BREG) 3/29 minutes. “Recommended but needs further input regarding the PHSMA R&D proposal received from Lou Hayden. The BERG decided this project serves government needs rather serving the needs of the Committee and enhancing the ASME standards. HOLD, Wait for action from PHSMA. September 2013 - It seems that there was a little confusion in regards to the intent of the project as the BERG seemed to think that the title of the project does not really match the deliverable. There is a need to add more detail to what is anticipated to be done from the proposal (implementation) and what type of detail is being requested.
- Detail Prevention Mitigation and Repair Options in B31.8S (K. Leewis) Jan. 2013 – It was noted that this might be a B31.8 level, and might be handled by a task group under B31.8. Mr. Meyer also noted that if this information is to be published as a separate document, there might be other funding options available.

Mr. Wendler will be calling into the Tuesday, September 24th Joint B31.4/8 Executive Meeting to give an update and answer questions on the Incorporation by Reference (IBR) issue. A handout update on the issue can be seen on pages 20-28.

9.3.1 Inquiry on encirclement welds (see page 29) - 9.3.2 Inquiry on minimum temperature (see page 30) - 9.3.3 Inquiry on miter bends in sour gas service (see page 31) -
9.4 Review of IPC for B31.8 and B31.8S Code Improvement (Item 12-1801)
An initial Ad Hoc team consisting of the Executive Committee and Mr. Rosenfeld as project team leader will initial review the 2012 IPC proceedings and develop suggestions for possible new work items. From this initial review it will then be determined if a permanent review team be developed and which proceedings would be reviewed by the team.

It was also noted that there was an interest in possibly moving the B31.8 meetings back to a Tuesday through Thursday schedule during the B31 Code Week. A proposal for this action will be developed.

Update on Section 24 of the Pipeline Safety Act and ASME Activities Related to Incorporation by Reference (IBR)
(8-29-13) Background: On January 3, 2012, the Pipeline Safety, Regulatory Certainty, and Job Creation Act of 2011 was signed into law (P.L. 112-90). Section 24 of the Act prohibited the U.S. Department of Transportation (DOT) from issuing regulations or guidelines incorporating by reference any standards that are not “made available to the public, free of charge, on an internet website.” The law went into effect on January 3, 2013.
ASME and a number of other standards developing organizations (SDOs) requested a repeal of, or modification to, this provision, noting that it was contrary to existing law and policies that only require standards to be reasonably available (not free) and that it would have negative consequences for the SDO community, industry, government agencies, and ultimately, the general public.
Update: On August 9, 2013, a technical correction to Section 24 was signed into law (P.L. 113-30). This technical correction, which was passed by the House of Representatives on July 16, 2013 by a vote of 405-2, and subsequently passed by the Senate via unanimous consent on August 1, 2013, modifies Section 24 as follows:
SUBTITLE VIII—PIPELINES * * * * * * * CHAPTER 601—SAFETY * * * * * * * § 60102. Purpose and general authority (a) * * ** * * * * * *
(p) LIMITATION ON INCORPORATION OF DOCUMENTS BY REFERENCE.— Beginning 1 year 3 years after the date of enactment of this subsection, the Secretary may not issue guidance or a regulation pursuant to this chapter that incorporates by reference any documents or portions thereof unless the documents or portions thereof are made available to the public, free of charge, on an Internet Web site.
This change, coupled with the issuance of Congressional intent - which was lacking for the original bill - has several implications:
• extends the effective date to January 3, 2015, thereby allowing PHMSA to pursue its rulemaking agenda without being unduly impeded by this provision;
• exempts guidance documents from the provision; • removes the requirement for documents to be freely available on the internet; and • clarifies that the “free of charge” provision is for non-commercial purposes (see page 3, first
paragraph of attached Congressional Report)
Next Steps: ASME will continue to work with PHMSA to help enable their compliance with the legislation, and will continue to monitor any additional developments related to IBR (including potential revisions to OMB Circular A-119 and any potential revisions to policies established by the Office of Federal Register).

PURPOSE OF LEGISLATION
H.R. 2576 amends title 49, United States Code, to modify re-quirements relating to the availability of pipeline safety regulatory documents. The bill corrects an unintended consequence of the Pipeline Safety, Regulatory Certainty, and Job Creation Act of 2011.
BACKGROUND AND NEED FOR LEGISLATION
For many years, government agencies have used standards and other materials published by standards development organizations (SDOs) as one means of satisfying regulatory objectives. In 1982, the Office of Management and Budget (OMB) promulgated OMB Circular A–119, which required federal agencies to use privately developed voluntary consensus standards in lieu of government- unique standards in their procurement and regulatory activities, except where inconsistent with law or otherwise impractical. The use of such standards, whenever practicable and appropriate, was intended to achieve the following goals: (1) eliminate the cost to the government of developing its own standards and decrease the cost of goods procured and the burden of complying with agency regula-tion; (2) provide incentives and opportunities to establish standards that serve national needs; (3) encourage long-term growth for U.S. enterprises and promote efficiency and economic competition through harmonization of standards; and (4) further the policy of reliance upon the private sector to supply government needs for goods and services.
In 1996, Congress passed the National Technology Transfer and Advancement Act, codifying the requirements contained in the OMB Circular into law. Therefore, by law, federal agencies are re-quired to use such voluntary consensus standards, instead of ex-pending resources to create their own, unless use of such standards would be inconsistent with applicable law or otherwise impractical. Oftentimes, instead of reprinting the standards into the federal regulations, agencies simply reference the voluntary consensus standards by name, a practice more commonly known as ‘‘incorpo-ration by reference.’’ SDOs maintain that the practice of incorpora-tion by reference has a number of benefits, including dramatically reducing costs to the government of developing its own standards, preventing duplicative and conflicting government-imposed stand-ards, and allowing agencies to use standards that are already rec-ognized and accepted in the United States and around the world, which result in a public-private partnership that enhances public safety and health while saving government agencies and taxpayers money. Many safety advocates, universities, researchers, and state and local communities, however, have raised concerns about the lack of transparency and openness in reviewing the voluntary con-sensus standards, particularly when incorporated into federal safe-ty regulations.
In 2011, the bipartisan Pipeline Safety, Regulatory Certainty, and Job Creation Act of 2011 (Pipeline Safety Act) became law. In an effort to ensure public access to pipeline standards, section 24 of the Pipeline Safety Act included a provision, codified at section 60102(p) of title 49, United States Code, that requires the Pipeline and Hazardous Materials Safety Administration (PHMSA) to make

any document, or portion thereof, incorporated by reference into PHMSA regulations or guidance publicly available, free of charge, on an internet website. Acting in good faith, the intent was to en-sure transparency and openness in government regulation, but an unintended consequence arose with regard to some SDOs whose business model could be jeopardized by allowing internet access to its standards. H.R. 2576 will ensure that the provisions of the Pipe-line Safety Act support broader public availability of voluntary con-sensus standards and related information to the general public for non-commercial purposes—consistent with existing law and regula-tions—while also maintaining the invaluable public-private part-nership between the private sector and government agencies. H.R. 2576 provides PHMSA with the flexibility necessary to continue to work with SDOs to improve regulatory outcomes and ensure that materials incorporated by reference are made available to the pub-lic.
HEARINGS
No hearings were held on H.R. 2576.
LEGISLATIVE HISTORY AND CONSIDERATION
On June 28, 2013, Representatives Bill Shuster, Jeff Denham, Nick Rahall, and Corrine Brown introduced H.R. 2576 to ensure the protection of intellectual property and copyrights of standard development organizations while providing public access to docu-ments incorporated by reference into pipeline safety regulations. On July 10, 2013, the Committee on Transportation and Infrastruc-ture met in open session and ordered the bill reported favorably to the House by voice vote.
COMMITTEE VOTES
Clause 3(b) of rule XIII of the Rules of the House of Representa-tives requires each committee report to include the total number of votes cast for and against on each record vote on a motion to report and on any amendment offered to the measure or matter, and the names of those members voting for and against. There were no record votes taken in connection with consideration of H.R. 2576.
COMMITTEE OVERSIGHT FINDINGS
With respect to the requirements of clause 3(c)(1) of rule XIII of the Rules of the House of Representatives, the Committee’s over-sight findings and recommendations are reflected in this report.
NEW BUDGET AUTHORITY AND TAX EXPENDITURES
Clause 3(c)(2) of rule XIII of the Rules of the House of Represent-atives does not apply where a cost estimate and comparison pre-pared by the Director of the Congressional Budget Office under sec-tion 402 of the Congressional Budget Act of 1974 has been timely submitted prior to the filing of the report and is included in the re-port. Such a cost estimate is included in this report.

PERFORMANCE GOALS AND OBJECTIVES
With respect to the requirement of clause 3(c)(4) of rule XIII of the Rules of the House of Representatives, the performance goal and objective of this legislation is to provide PHMSA greater flexi-bility in providing public access to documents incorporated by ref-erence into pipeline safety regulations.
ADVISORY OF EARMARKS
Pursuant to clause 9 of rule XXI of the Rules of the House of Representatives, the Committee is required to include a list of con-gressional earmarks, limited tax benefits, or limited tariff benefits as defined in clause 9(e), 9(f), and 9(g) of rule XXI of the Rules of the House of Representatives. No provision in the bill includes an earmark, limited tax benefit, or limited tariff benefit under clause 9(e), 9(f), or 9(g) of rule XXI.
DUPLICATION OF FEDERAL PROGRAMS
Pursuant to section 3(j) of H. Res. 5, 113th Cong. (2013), the Committee finds that no provision of H.R. 2576 establishes or reau-thorizes a program of the federal government known to be duplica-tive of another federal program, a program that was included in any report from the Government Accountability Office to Congress pursuant to section 21 of Public Law 111–139, or a program related to a program identified in the most recent Catalog of Federal Do-mestic Assistance.

DISCLOSURE OF DIRECTED RULE MAKINGS
Pursuant to section 3(k) of H. Res. 5, 113th Cong. (2013), the Committee estimates that enacting H.R. 2576 does not specifically direct the completion of any specific rule makings within the mean-ing of section 551 of title 5, United States Code.
FEDERAL MANDATE STATEMENT
The Committee adopts as its own the estimate of federal man-dates prepared by the Director of the Congressional Budget Office pursuant to section 423 of the Unfunded Mandates Reform Act (Public Law 104–4).
PREEMPTION CLARIFICATION

Section 1. Availability of pipeline safety regulatory documents H.R. 2576 strikes the phrase ‘‘on an internet Web site’’ from sec-
tion 60102(p) of title 49, United States Code, which will help pro-tect copyright and intellectual property concerns, while granting PHMSA the flexibility necessary to ensure compliance with the law. It also extends the deadline for implementation from one year after the date of enactment to three years after the date of enact-ment, and reduces the number of documents to which the provision applies by striking ‘‘guidelines’’ from section 60102(p).

Adam, I recently took a training course for pipe stress analysis and one thing that was mentioned in there was the minimum temperature of API 5L. In ASME B31.3, the minimum temperature of API 5L is ‐20F, but in ASME B31.8 (from what I was told) the minimum temperature is 32F. I believe the reason they made this claim was that there was no listed expansion coefficient below 32F (I could be wrong on this reason though). So my question is according to ASME B31.8, what is the minimum temperature for API 5L that the code allows? And are there any special requirements to go below 32F (if this is allowed)? The reason I ask is that we are designing a system using ASME B31.8, and I don’t want to design something outside the limits of this code. At the same time, I can’t find anything in the code that specifically says not to go below 32F. Hello Dear Sir/Miss We have a question about the definition of miter in sour gas services whether the definition is it deferent from sweet services? Accordance to ASME B31.8‐2003 paragraph B841.231 " Neither wrinkle bends nor miter bends are permitted for sour gas lines, we want to know in this sentence the miter is defined more than 3 degrees, same as sweet gas services or no? Because in section of sour gas clearly hasn't been described about the degrees of miter. As you know in part of general for sweet gas in the paragraph 841.232 clearly is mentioned that "deflections caused by misalignment up to 3 deg are not considered as a miter ", this statement is it true and valid for sour gas services or no?
