interior landscape peninsulas for a parking lot expansion. Mr. Myerholtz presented the Staff Report with PowerPoint Slides of the Site.
BACKGROUND:
The site is 1.057 acre located on the south side of Cemetery Road approximately 700 feet west of Lacon Road. The
site and adjacent properties are zoned PUD. The site consists of a two-story veterinary clinic. According to Franklin
County Auditor records the existing building was built in 2005 and has a total finished area of 7,766-square-feet.
The applicant is now requesting a variance to eliminate interior landscape peninsulas for a parking lot expansion.
CONSIDERATIONS:
· Hilliard Code Section 1125.05(c) states that any vehicular use area containing more than 4,000-square-feet
of area or being comprised of 12 of more vehicular parking spaces, shall provide “interior” landscaping that
may be peninsular or island in nature and shall be distributed throughout the vehicular use area.
· The site is set back approximately 300 feet from Cemetery Road. To the north, betwixt the site and
Cemetery Road are two businesses: Central Ohio Dental Associates and Premier Bank, to the east is Aldi,
and to the west is Agape Academy.
· The proposed plans show a 6-space parking lot expansion including one handicapped accessible space. The
plans show areas for perimeter landscaping. Finalized perimeter landscaping shall meet code. [Staff
recommends that a perimeter landscape plan adhering to Hilliard Code Section 1125.05(b) is
submitted, subject to staff approval]
STAFF RECOMMENDATION:
Staff finds that there can be a beneficial use of the property without the variance. Staff finds that the proposed
variance is not substantial. Staff finds that the essential character of the neighborhood would not be substantially
altered as a result of the variance. Staff finds that the variance would not adversely affect the delivery of government
services. Staff finds that the proposed variance is consistent with the spirit and intent behind the applicable zoning
requirements. Based on these findings, consistent with the provisions of Hilliard Code Section 1125.05 Staff
recommends approval of the variance with the following 2 conditions:
1) That a perimeter landscape plan adhering to Hilliard Code Section 1125.05(b) is submitted subject to staff
approval; and,
2) That all required permits are obtained prior to construction.

BACKGROUND:
The site is 1.64 acre located approximately 750 feet east of the intersection of Dublin Road and Shirtzinger Road.
The site and surrounding properties to the north, east, and west are zoned R-1, Low Density Residential. To the
south are single family homes zoned PUD. According to Franklin County Auditor records, the site consists of a
single-family residence with a total area of 2,250-square-feet. The applicant is requesting approval of a variance
from Hilliard Code Section 1121.02(b)(6) to permit an accessory building in excess of 14 feet in height and
1127.04(b)(1) to permit a gravel driveway for a new detached garage.
CONSIDERATIONS:
· Hilliard Code Section 1121.02(b)(6) states that the maximum height of accessory structures shall be 14 feet
measured per code. Hilliard Code Section 1127.04(b)(1) states that all parking lots and vehicle storage
areas shall be paved with an asphalt or concrete binder.
· The proposed plans show a 2-story, 900-square-foot detached garage to be located on the north end of the
property. The plans show the garage will be 18-feet in height measured per code. The first story will
function as a garage and the second story shall provide storage space.
· The proposed garage meets provisions of Hilliard City Code regarding location and size. The architecture
of the proposed garage integrates with the surrounding buildings and features numerous architectural
elements to provide variation on each elevation.
· There is a shared access drive on the property. This drive leads to two residences north of the site. The
proposal shows access to the new garage shall be from this drive. The plans include a gravel connection

STAFF RECOMMENDATION:
Motion 1: Staff finds that there can be a beneficial use of the property without the variance. Staff finds that the
proposed variance to permit an accessory building in excess of 14 feet in height is not substantial. Staff finds that the
essential character of the neighborhood would not be substantially altered as a result of the variance. Staff finds that
the variance would not adversely affect the delivery of government services. Staff finds that the proposed variance is
consistent with the spirit and intent behind the applicable zoning requirements. Based on these findings, consistent
with the provisions of Hilliard Code Section 1121.02(b)(6) Staff recommends approval of the variance with the
following 2 conditions:
1) That the proposed garage is limited to 18 feet in height, as proposed; and,
2) That all required permits are obtained prior to construction.
Motion 2: Staff finds that the proposed variance to permit a gravel driveway is not substantial and is consistent with
the spirit and intent behind the applicable zoning requirements. Based on these findings, consistent with the
provisions of Hilliard Code Section 1127.04(b)(1) staff recommends approval of the proposed variance.
President Piper asked if there were any questions of staff.
Arthur Steele asked if there were any insights as to why the applicant wouldn't pave the driveway. The applicant
stated they did not want to impact the environment as much.
Mr. Stepp asking about the height of the proposed garage and if there was any public comments regarding the
height. Staff informed that there had been no negative comments on the height of the garage.
President Piper asked if the applicant was present.
The applicant was present and stated he was appreciative of staff's support in the process.
President Piper asked if there were any public comments on this case, Hearing none he called for a motion.

BACKGROUND:
The site is 0.48 acre located on the northeast side of Scioto Darby Road across from Conklin Drive. The site and
surrounding properties are zoned R-2, Low/Medium Density Residential. According to Franklin County Auditor
records, the site consists of a single-family residence with a total area of 1,456-square-feet. The applicant is
requesting approval of a variance from Hilliard Code Section 1121.02 to permit a fence in the front yard and past the
build line for a 6-foot-tall shadowbox fence.
CONSIDERATIONS:
· Hilliard Code Section 1121.02(d)(1)(i) states that fences shall only be located in the rear and side yards and
shall not be located past the build-to line of the main structure on the parcel.
· The proposed plans show a 6-foot-tall Shadowbox style fence. The fence begins on the southeast property
line approximately 16.5 feet forward of the house and follows the southeast property line to the northeast
(rear) property line, runs along the northeast property line to a gate located at the north corner of the site,
then follows the northwest property line and ends approximately 16.5 feet forward of the house,
approximately 30 feet from the Scioto Darby Road right-of-way line.
· There is an existing fence on the property, the proposed fence will be replacing the existing one in the same
location.
· The proposed location of the fence forward of the house aligns with both adjacent neighbor’s build lines.

BACKGROUND:
The site is 0.24 acre located on the north side of Scioto Run Boulevard approximately 170 feet
east of Stoneroot Drive. The site and adjacent properties are located in the Scioto Run PUD. The
site consists of a single-family residence. According to Franklin County Auditor records the
existing building was built in 1991 and has a total finished area of 3,202-square-feet. The
applicant is now requesting a variance to reduce the side-yard setback to permit a pool closer
than 10 feet to the property line.
CONSIDERATIONS:
• Hilliard Code Section 1121.06(f)(2) states that private swimming pools and adjacent
walks, paved areas and accessory structures shall not be located closer than 10 feet to any
property line.
• There is a 10-foot utility easement on the rear property line that prevents any permanent
structures or paving.
• The proposal is to construct a 338 (13’ x 26’) square-foot pool with adjacent paving. The
pool and the proposed patio space will be located 2.5 feet from the west property line.
• The proposed pool will meet all other code requirements regarding location and perimeter
fencing.
STAFF RECOMMENDATION:
Staff finds that there can be a beneficial use of the property without the variance. Staff finds that
the proposed variance is not substantial. Staff finds that the essential character of the
neighborhood would not be substantially altered as a result of the variance. Staff finds that the
variance would not adversely affect the delivery of government services. Staff finds that the
property owner’s predicament cannot feasibly be obviated through some method other than a
variance. Staff finds that the proposed variance is consistent with the spirit and intent behind the
applicable zoning requirements. Based on these findings, consistent with the provisions of
Hilliard Code Sections 1106.04 and 1121.06(f) staff recommends approval of the proposed
variance with the following 2 conditions:
1. That the proposed pool and adjacent paving is located not less than 2.5 feet from the west
property line as shown; and,

CASE 2: 21-0164-AR – Crosby Residence - 6083 Nova Park Lane

APPLICANT: Brian Crosby, 6083 Nova Park Lane, Hilliard, OH 43026
REQUEST: Review & approval of a variance from Hilliard Code Section 1121.02(d) to permit
a fence in the front yard and past the build line.
BACKGROUND:
The site is 0.33 acre located at the southeast corner of Nova Park Lane and Landen Farm Road.
The site and surrounding properties are located in the Lakewood PUD. According to Franklin
County Auditor records, the site consists of a single-family residence with a total area of 3,356-
square-feet. The applicant is requesting approval of a variance from Hilliard Code Section
1121.02 to permit a fence in the front yard and past the build line for a 3.5-foot-tall picket style
fence.
CONSIDERATIONS:
• Hilliard Code Section 1121.02(d)(1)(i) states that fences shall only be located in the rear
and side yards and shall not be located past the build-to line of the main structure on the
parcel.
• The proposed plans show a 3.5-foot-tall picket style fence. The fence begins at the
southwest corner of the house, extends toward the Landen Farm Road right-of-way by
approximately 12 feet, then goes parallel to the Landen Farm right-of-way line for 60 feet
then follows the south property line and connects to the neighbor’s fence on the east
property line.
• There is an existing fence on the property, the proposed fence will be replacing the
existing one in the same location. The existing fence was permitted without a variance by
the city in error in 2014.
STAFF RECOMMENDATION:
Staff finds that there can be a beneficial use of the property without the variance. Staff finds that
the proposed variance is not substantial. Staff finds that the essential character of the
neighborhood would not be substantially altered as a result of the variance. Staff finds that the
variance would not adversely affect the delivery of government services. Staff finds that the
proposed variance is consistent with the spirit and intent behind the applicable zoning
requirements. Based on these findings, consistent with the provisions of Hilliard Code Section
1121.02(d) Staff recommends approval of the variance with the following 2 conditions:
1) That the fence is located not less than 18 feet from the Landen Farm Road right-of-way
line as proposed; and,
2) That a fence permit is obtained prior to installation.
