Mayor Cox called the regular meeting to order at 6:58 p.m.

Alderman Hudson made the motion to approve the Accounts Payable over $1250 in the amount of $375,984.16. Alderman Magley seconded the motion. On a call by the Mayor for ayes and nays, the motion passed unanimously. Absent Wilkins.

COMMENTS FROM CITIZENS:

The Comments from Citizens portion of the meeting was opened at 7:06 p.m. by Mayor Cox. 7:07 opened up comments on pay at the pump ordinance.

Nada Gibson 197 S. Howard Burton - Prepay/Pay at the pump statement and stated that it is very inconvenient for her because she doesn't have a card to pay at the pump. Stated there are other people in town displeased with this ordinance.

Joe Bryson 408 Stone St-Asked the board why they felt they had the right to run other people's business.

Don Bormann stated that he has had several people in his office complaining about the pay at the pump ordinance. Dou Rodgers stated he has also lmd several complaints about the ordinance.

Discussion to amend the ordinance set for July 8"'.

DarlaHerigon 1389 hwy 22 east lot 53, brought forth issues she is having with the trailer park.

Comments from Citizens portion of the meeting was closed at 7:46 p.m, by Mayor Cox.

ORDINANCE: AN ORDINANCE AMENDING SECTION 18-4 OF TIIE CODE OF THE CITY OF CENTRALIA, MISSOURI TO ADD OTHER MOVABLE OB.JECTS AND ADDING SUBSECTION A TO ADD FINES FOR VIOLATIONS OF THIS SECTION.

Alderman Bormann presented a bill marked and designated !Ill bill no. 2304 to create an ordinance entitled "AN ORDINA."'ICE AMENDING SECTION 18-4 OF THE CODE OF THE CITY OF CENTRALIA, MISSOURI TO ADD OTHER MOVABLE OB.JECTS AND ADDING SUBSECTION A TO ADD FINES FOR VIOLATIONS OF THIS SECTION." Alderman Bonnann moved that it be placed on its first reading by title only. Before the bill was introduced copies of the bill were made available for public inspection. Motion was seconded by Alderman Hudson and motion carried unanimously. The bill was then read by title only. Alderman Bormann moved the bill be placed on its second reading. Motion was seconded by Alderman Hudson and motion carried unanimously. The bill was then read the second time by title only. The Mayor then called for discussion on the bill and after some discussion Alderman Bormann moved the final passage of the bill. Alderman Hudson seconded the motion. The Mayor called for a roll call vote and the ordinance passed with the following vote. Aldermen voting FOR: Hudson, Motley, Magley, Bormann, and Rodgers, Voting AGAINST: none. Absent: Wilkins. The Mayor declared the bill passed and thereupon signed the same as passed. The bill was approved by the Mayor and signed by the Mayor as approved and was returned to the City Clerk who attested to the signature of the Mayor, affixed the city seal and the Ordinance was designated as Ordinance, 3022

Minutes of the Public Works and Public Utilities Committee for Monday, July 8, 2019 The meeting was called to order by Alderman Hudson at 7:00p.m. I. ATTENDANCE. Present were Mayor Chris Cox, City Administrator, Heather Russell, Aldermen Don Rodgers, Landon Magley, Robert Hudson, Terri Motley and Alderman Don Bormann joined at 7:12p.m. Also attending were Public Works and Public Utilities Director Mike Forsee, Electric Foreman Jeff Armontrout, Street Foreman Phil Hoffman, Water Foreman Matthew Rusch, Fire Chief Denny Rusch , Chief Bob Bias, and Lieutenant Kribbs. Citizens present; James Smith with the Centralia Fireside Guard, Linda Bormann, Sheila Bias, Joe Bryson, Kenny Coolley, Dan Hamilton, Dylan Dick, Matt Fadler, Taylor Clemons, Aaron Kroeger, Phyllis Brown, Dick Ward, Mike Colvin, Codi Colvin, Susan Jackson, and Melody Whitworth. II. PLEDGE OF ALLIGAIANCE III. COMMENTS FROM CITIZENS Kenny Coolley discussed the alley behind his house with the Board. Alderman Wilkins made a motion to accept the gate for Kenny Coolley to have in the alley, Alderman Rodgers seconded the motion which was then approved by unanimous voice vote. IV. Russell talked about the sidewalk project. VI. WATER AND SEWER DEPARTMENT A. Activity Report Rusch discussed the water main for Addie Lane. B. Water None C. Sewer Rusch said they have had a few water issues and worked on them this month. D. Other None VII. OTHER A. Director of Public Works & Utilities Monthly Report – June 2019 Forsee explained to the Board what they have been working on. VIII. CLOSED SESSION* Alderman Wilkins moved the Board of Aldermen of the City of Centralia, Missouri to hold a closed meeting as provided and hold a closed vote, and the purpose of such closed session and closed vote shall be: as provided for under Section 610.021(3) of the Revised Statutes of Missouri for hiring, firing, disciplining or promoting of employees by a public governmental body. Alderman Magley seconded and Roll call vote was unanimous. The meeting went into closed session at 7:14p.m.

During closed session there was discussion with no vote taken. Alderman Wilkins made a motion to return to open session. Alderman Motley seconded the motion. The motion passed with a unanimous vote.

Returned to open session at 8:16p.m.

IX. AS MAY ARISE Russell talked about Randolph Road. X. ADJOURN Alderman Hudson, made a motion to adjourn the Committee meeting, Alderman Motley seconded the motion which was then approved by unanimous voice vote at 8:20p.m.

Minutes of the General Government and Public Safety Committee meeting of Monday, July 8, 2019 The meeting was called to order by Aldermen Wilkins at 8:21p.m. I. ATTENDANCE. Present were Mayor Chris Cox, City Administrator, Heather Russell, Aldermen Don Rodgers, Landon Magley, Robert Hudson, Terri Motley and Don Bormann. Also attending were Public Works and Public Utilities Director Mike Forsee, Water Foreman Matthew Rusch, Fire Chief Denny Rusch, Chief Bob Bias, and Lieutenant Kribbs. II. COMMENTS FROM CITIZENS Darla Herigon talked to the Board about the entrance into the Trailer Park and how it is dark and could they get a street light. III. PUBLIC SAFETY A. Fire Department 1. Activity Report Rusch said same stuff. Russell compliments on the Fireworks show. 2. Other None B. Police Department 1. Activity Report None 2. Other a. Changes to the existing tobacco policy Russell discussed the tobacco policy and she will discuss it more with Mayfield. b. Anti-tethering Russell said Mayfield has reviewed this and she wants to move forward with a Public Hearing and the Board would like to have Code Enforcement Officer, Sandy Buck’s input as well. C. Emergency Management 1. Boone County Hazard Mitigation Planning Update Russell discussed her Meeting he attended recently and the passing of Boone County Commissioner Tom Hurley. D. Protective Inspection Russell said the bid packets are ready to be sent out and had discussion about the

Park Board Bormann, Linda commented on Erle and the clean-up after Anchor-Fest C. Cemetery Report None D. Tree Board Report None E. Library Board None F. June 2019 Financial Statements Russell said they are not in the packet but will be in the next. G. Bills over $1,250 = $266,710.95 None H. Other General Government None V. OTHER None A. Police Chief’s Monthly Report – June 2019 Russell had asked Chief Bias to give a report and he did. VI. AS MAY ARISE Hudson spoke about the Bicentennial and he passed around flyers and then had questions about Golf Carts. Linda Bormann also had questions about Golf Carts and there was discussion. Hudson also had questions about Police Officer’s and their holiday pay. VII. ADJOURN Alderman Hudson, made a motion to adjourn the Committee meeting, Alderman Magley seconded the motion which was then approved by unanimous voice vote at 8:46p.m.

BILL NO. _____ ORDINANCE NO. ______ A BILL TO CREATE AN ORDINANCE ENTITLED: AN ORDINANCE AMENDING SECTIONS 16-27, 16-31 AND 20-8 OF THE CODE OF THE CITY OF CENTRALIA, MISSOURI TO REGARDING THE SALE OF TOBACCO PRODUCTS AND ADDING FINES FOR VIOLATIONS OF THESE SECTIONS.

BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CENTRALIA, MISSOURI, as follows:

SECTION 1. Sections 16-27, 16-31 and 20-8 of the Centralia City Code are hereby changed, altered and amended to read as follows:

CHAPTER 16 LICENSES. ARTICLE III CIGARETTES TOBACCO, ALTERNATIVE NICOTINE AND VAPOR PRODUCTS.

Sec. 16-27 License and tax for sale, etc. – registration fee. Every wholesaler and every retailer who pays an occupational license tax, and any other person engaged in selling cigarettes tobacco, alternative nicotine product, or vapor product or offering, delivering or displaying the same for sale within the City shall procure a tobacco retailer license therefor for each place of business that such person desires to have for sale or distribution of cigarettes tobacco, alternative nicotine product, or vapor product, and at the time such license is issued shall pay to the City Clerk the sum of one dollar ($1.00) for each such place of business. In addition to the registration fee, every retailer and every wholesaler shall pay an occupational license tax at the rate of one dollar ($1.00) per thousand (1,000) for each and all cigarettes sold, offered, delivered or displayed for sale within the City. The cigarette taxes provided in this Section were the same taxes in effect by Centralia City ordinance on September 30, 1993, per Section 149.192 of the Revised Statutes of Missouri.

A. Term. Any tobacco retailer license, or renewal thereof, issued hereunder shall be effective as of the date of its issuance

and shall expire the next December thirtieth (30th).

B. Renewal of license. The term of a renewed tobacco retailer license is one (1) year, commencing on January first (1st); provided however, if the business services administrator determines that there is good reason not to issue a license for the full one-year period, the business services administrator may issue a license for a shorter period of time. Each tobacco retailer shall apply for the renewal of a tobacco retailer license no later than thirty (30) days prior to expiration of the prior license. No license shall be renewed until outstanding fines have been paid.

C. Expiration of license. A tobacco retailer license that is not timely renewed shall expire at the end of its term. To apply

for reinstatement of a license not timely renewed, the person must:

(1) Submit the application renewal form; and

(i) Upon the receipt of a complete application for a tobacco retailer license, the City Clerk shall issue a license

upon a finding that the requirements of this article have been met. The provision of incomplete, inaccurate, false or misleading information shall be grounds for denial or revocation. In the case of a renewal, failure to operate the business in accordance with the requirements of this article shall be grounds for denial or revocation.

D. Nontransferable. A tobacco retailer license may not be transferred from one person to another or from one location to

another. A new tobacco retailer license is required whenever a tobacco retailer location has a change in ownership.

E. (a) Denial. When a license under this article is denied, the business services administrator shall send a letter to the applicant stating why the license was denied and how to appeal the denial. The letter may be hand delivered or sent by first class mail. If mailed, the letter shall be presumed received three (3) days after it was mailed, unless returned.

F. (b) Appeal by applicant. The applicant may appeal the denial to the tobacco retailer license review board by mailing or delivering a written notice of appeal to the director of finance and a copy to the business services administrator. The notice of appeal must be received by the director of finance no later than ten (10) days after the applicant received the

letter of denial. The applicant may submit to the director of finance a position statement explaining why applicant believes the license should be granted. The business services administrator may also submit to the director a position statement explaining why the administrator believes the denial should be upheld.

Sec. 16-31 Business license for vending machines; sales through vending machines. Every person who, in the capacity of owner, lessee, tenant, or in any other capacity shall operate or cause to be operated, directly or indirectly, one (1) or more vending machines for selling and dispensing cigarettes tobacco, alternative nicotine product, or vapor products to the public shall obtain from the City Clerk one (1) business license, and such business license a tobacco retailer license or a copy thereof, in whatever form prescribed by the City Clerk, shall be affixed on a conspicuous part of each such vending machine. It shall be unlawful for any person to sell and dispense through a vending machine any cigarettes tobacco, alternative nicotine product, or vapor products upon which the occupational license tax has not been paid and the payment thereof evidenced on the containers thereof. It shall be unlawful for any person, through a vending machine or otherwise, to remove any package of cigarettes, in whole or in part, or mutilate same before the occupational license tax thereon has been paid and evidence of payment stamped or printed thereon or otherwise provided.

Chapter 20. Ordinance Violations — Miscellaneous

Section 20-8. Cigarettes Tobacco, alternative nicotine and vapor products— definitions — sale to persons under eighteen prohibited — exception — posting notice — penalty. [Ord. No. 32 § 774, c.a. 1918; Ord. No. 1704 § 1, 10-19-1992; Ord. No. 2390 § 1, 1-16-2006]

A. Definitions. For the purposes of this Section, the following words and phrases shall have the following meanings:

ALTERNATIVE NICOTINE PRODUCT

Any noncombustible product containing nicotine that is intended for human consumption, whether chewed, absorbed, dissolved, or ingested by any other means. Alternative nicotine product does not include any product regulated as a drug or device by the United States Food and Drug Administration under Chapter V of the Food, Drug, and Cosmetic Act;

DISTRIBUTE

A conveyance to the public by sale, barter, gift, or sample.

PROOF OF AGE A driver's license or other generally accepted means of any other government issued photo identification that contains a picture of the individual, the date of birth, and appears on its face to be valid.

ROLLING PAPERS

Paper designed, manufactured, marketed or sold for use primarily as a wrapping or enclosure for tobacco, which enables a person to roll loose tobacco into a smokable cigarette.

SAMPLE

A tobacco product distributed to members of the general public at no cost or at nominal cost for product promotional purposes.

SAMPLING

The distribution to members of the general public of tobacco product samples.

TOBACCO PRODUCTS Any substance containing tobacco leaf including, but not limited to, cigarettes, cigars, pipe tobacco, snuff, chewing tobacco or dipping tobacco. Tobacco or Tobacco product means any product containing, made, or derived from tobacco or nicotine, whether natural or synthetic, that is intended for human consumption or is likely to be consumed, whether smoked, heated, chewed, snorted, sniffed, absorbed, dissolved, inhaled or ingested by any other means, including, but not limited to, cigarettes, cigars, little cigars, pipe tobacco, chewing tobacco, snuff, or snus. Tobacco or Tobacco product also means any component or accessory used in the consumption of tobacco products, whether or not they contain nicotine, including, but not limited to, filters, cartridges, pods, pens, rolling papers, or pipes.

VAPOR PRODUCT Any noncombustible product, whether containing nicotine or not, that employs a heating element, power source, electronic circuit, or other electronic, chemical or mechanical means, regardless of shape or size, that can be used to produce vapor from nicotine in a solution or other form. Vapor product includes any electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device and any vapor cartridge or other container of nicotine in a solution or other form that is intended to be used with or in an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device.

VENDING MACHINES Any mechanical, electric or electronic self-service device which, upon insertion of money, tokens or any other form of payment, dispenses tobacco products.

B. No person or entity shall sell, provide or distribute any tobacco, alternative nicotine, or vapor products or rolling papers to any person under eighteen (18) years of age, except that this Subsection shall not apply to the distribution of any tobacco product or rolling papers to a person under eighteen (18) years of age by a family member of that person on property that is not open to the public.

C. The owner of an establishment at which tobacco, alternative nicotine, or vapor products or rolling papers are sold at retail or through vending machines shall cause to be prominently displayed in a conspicuous place at every display from which tobacco products are sold and on every vending machine where tobacco products are purchased a sign that shall:

1. Contain in red lettering at least one-half (1/2) inch high on a white background the following: "It is a violation of State law for cigarettes or other tobacco, alternative nicotine, or vapor products to be sold or otherwise provided to any person under the age of eighteen (18) or for such person to purchase, attempt to purchase or possess cigarettes or other tobacco products"; and

2. Include a depiction of a pack of cigarettes at least two (2) inches high defaced by a red diagonal diameter of a surrounding red circle and the words “Under 18”.

No person or entity shall sell individual packs of cigarettes or smokeless tobacco, alternative nicotine, or vapor products unless such packs satisfy one (1) of the following conditions prior to the time of sale:

1. It is sold through a vending machine that is in a location that is not accessible at any time to persons under the age of eighteen; or

2. It is displayed behind the checkout counter or it is within the unobstructed line of sight of the sales Clerk or store attendant from the checkout counter.

D. From time to time, but at least twice per year, the city or its authorized agent shall conduct compliance checks on each tobacco, alternative nicotine, or vapor products retailer. The city shall conduct compliance checks by engaging persons between the ages of 16 and 18 to enter the premises to attempt to purchase tobacco, alternative nicotine, or vapor products. Unannounced follow-up compliance check(s) of all non-compliant retailers are required within three (3) months of any violation of this article. The results of all compliance checks and inspections shall be published by the City or its authorized agent at least annually and made available to the public upon request.

A person or entity selling tobacco, alternative nicotine, or vapor products or rolling papers or distributing tobacco, alternative nicotine, or vapor product samples shall require proof of age from a prospective purchaser or recipient if an ordinary person would conclude on the basis of appearance that such prospective purchaser or recipient may be under the age of eighteen (18) thirty (30). Reasonable reliance on proof of age or on the appearance of the purchaser or recipient shall be a defense to any action for a violation of this Section. A person cited for selling, providing or distributing of any tobacco, alternative nicotine or vapor product to any individual less than eighteen (18) years of age in violation of this Section shall conclusively be presumed to have reasonably relied on proof of age of the purchaser or recipient and such person shall not be found guilty of such violation if such person raises and proves as an affirmative defense that such individual presented a driver's license or other government-issued photo identification purporting to establish that such individual was eighteen (18) years of age or older.

E. If a sale or distribution of a tobacco, alternative nicotine, or vapor product or rolling papers is made by an employee of the owner of an establishment in violation of this Section, the employee shall be guilty of the offense established in this Section. If there is not displayed on a tobacco, alternative nicotine or vapor product vending machine or in a conspicuous place at every tobacco, alternative nicotine or vapor products display a sign meeting the requirements of Subsection (C) of this Section, the owner of the establishment where the vending machine or tobacco products display is located shall be guilty of an offense

under this Section. If a sample is distributed by an employee of a company conducting the sampling, such employee shall be guilty of an offense under this Section. F. Any person, including, but not limited to, a sales Clerk, owner or operator, who violates this Section shall be fined:

1. For the first (1st) offense $25.00 $250.00

2. For the second (2nd) offense $100.00 $500.00

3. For the third (3rd) and any subsequent offense under this Section $500.00

No person shall be liable for more than one (1) violation of this Section on any single day.

G. Tobacco retailers. Any tobacco retailer found to have violated this ordinance shall be subject to: (1) For a first violation, a fine no less than $250; (2) For a second violation within a 36 month period, a fine no less than $500 and the tobacco retailer shall be prohibited from distributing tobacco products for a minimum of seven days; (3) For a third violation within a 36 month period, a fine no less than $500 and the tobacco retailer shall be prohibited from distributing tobacco products for a minimum of 30 days; and (4) For a fourth and any subsequent violations within a 36 month period, a fine no less than $500 and the tobacco retailer shall be prohibited from distributing tobacco products for a period of ninety days.

SECTION 2. All ordinance or parts of ordinances in conflict herewith are hereby repealed.

SECTION 3. This ordinance shall take effect and be in full force and effect from and after the date of its passage and approval.

• Participated in the Public Utilities and Public Works Committee Meeting on June 10th. • Participated in the General Government and Public Safety Committee meeting on June 10th. • Participated in the Board of Aldermen work session on June 10th. • Participated in the Board of Aldermen meeting on June 10th and June 17th. • Participated in the Planning and Zoning Commission meeting on June 12th. • Assisted with the development of packets for the Committees, Commission and the Board meetings. • Worked with City Clerk to prepare items for the annual audit. • Prepared documents for the auditors during the annual audit June 24th – 28th. • Prepared or helped to prepare ordinances for MIRMA Health participation, amending chapter 18-4

regarding obstacles in the roadways, accepting SW Country Estates Plat 5, revising commercial solid waste charges, DNR use and user charge ordinances.

• Reviewed CPD video footage at the request of the City Attorney on June 4th. • Attended the MML Elected Officials Conference on June 6th and 7th • Prepared information for updating the tobacco ordinance for work session on June 10th. • Met with Ed Musterman with First State Community Bank. • Attended a DNR Water and Waste Water Funding Workshop in Perry on June 13th. • Worked with City Hall staff to fix issues with employee W-2’s. • Worked with City Clerk on balancing May financial statements. • Prepared documents for demolition grant; submitted to Mid-Mo RPC and Economic Dev. • Prepared a rental agreement for the Golf Course. • Submitted SW Country Plat 5 plans to Boone County Recorder on June 20th. • Worked with Summit to fix Chart of Account duplicate accounts. • Attended the Boone County Hazard Mitigation Plan Update meeting on June 25th. • Talked with Boone County Emergency Management about setting up an emergency plan for Parks & Rec. • Met with a Journalist from MU regarding his study regarding the need for grocery stores in rural areas. • Participated in an employee benefits meeting and gathered information for the committee on June 27th. • Met with Danielle Bennett’s summer school class about careers on June 27th. • Discussed funding options through MJMEUC and MAMU with MPUA staff. • Held nuisance abatement hearings with Code Enforcement Officer on June 5th, 19th, and 21st. • Attended meetings of Department heads (June 5th, 12th, 19th, and 26th), and City Hall Staff (June 11th and

25th). • Completed various contracts, payment agreements, and other misc. paperwork as arose. • Responded to various citizen requests, personnel issues, reviewed payroll, issued Unlicensed Vehicle

Permits and as needed approved final building permits, reviewed parts of commercial building permits, entered building permit information, answered questions from the media and other tasks.

All of the tasks started and completed required the support of the Board of Aldermen and the cooperation of the staff in City Hall and the rest of the City staff.
