BOARD OF ALDERMEN PROPOSAL Today the Love The Harrisonville Square organization and the Love the Harrisonville Square design committee is asking for approval to use 18 of the 35 parking spaces at the site of the old hotel. Funding for this project will come from a combination of possible appropriated funds from the city, Love The Harrisonville Square funds/ fundraising, in conjunction with grants for the plaza space. The amount in which is TBD. Getting this approval will allow us to continue to work further on this project and get a more specific number and vision and come back to the Board of Aldermen for final approval. The information below is a general vision and plan for the Board of Aldermen to get a general picture. We are not asking for final approval on the vision, mission, and plan as written yet. The vision: ◼ Open green space, with recycled green turf ◼ Lots of chairs and seating space ◼ Photo op space with a hashtag ◼ Landing from Pearl with stairs down to the space ◼ Beautiful string lighting to create a safe cozy atmosphere ◼ Big sturdy outdoor games: cornhole, checkers, concrete card tables, big chess
pieces, dominos, etc. ◼ Outdoor speakers ◼ Stage for live performances ◼ Potato sack races ◼ Archway at entry/ landing ◼ Beautiful greenery and flowers ◼ Plaque explaining the toilet paper roll and the history of the community space ◼ Sidewalk chalk ◼ Inviting food trucks ◼ 4 square game ◼ bubble machine The mission: Our mission is to create a landing space right off the square for families and friends to gather and enjoy Harrisonville’s historic square and everything it has to offer. A quite safe space accessible to everyone. A homey spot with old childhood games that represents Harrisonville’s hospitality and keep people wanting to come back to our square and generate revenue for our city.

The plan: -Safety: the plan for safety is to have enough lighting to create a safe space. I believe the proximity to the police department will also aide greatly in the safety of the plaza. In addition having heavy decorative barricades to keep patrons safe from accidental or intentional acts. -Maintenance: The idea is to use maintenance free products as much as possible through donors and volunteers, similar to the flower planters on the square. -Parking: the square currently has 405 parking spaces, the plan is to use 18 of those spaces to help the beautification and revitalization of the square. There are a total of 96 spaces on the square, 97 on the street (off the square), 134 in the two parking lots near the library, 44 in the parking lot west of the square, and 17 in the parking lot adjacent to the proposed site of the plaza. The grant from Missouri Main Street Connection Harrisonville received, has a strong emphasis on green space and the important role it plays in the revitalization and beautification of the square. Using these underutilized 18 parking spaces is a great step in renewing our beloved square.

SUBJECT: 2904 Twin Pines Surface Water Problem

Issue:
Water surfacing at fire hydrant in front of 2904 Twin Pines Rd. causing issues with the yard and
home.
Background:
KC Wilson, owner of 2904 Twin Pines Rd. has experienced a heavy amount of surface water at
the house that is pushing up at the fire hydrant in front. The water is likely following a rock or
hard surface shelf that escapes the pond located on the west side of Highway 7 across the street
from Twin Pines Rd. The water is causing hydrostatic pressure on the house foundation wall
that Mr. Wilson reports has moved the wall and inch and 1/2 in the last year, especially the
beginning of this year with the high amount of rainfall.
Ted Martin, our engineer, did an analysis and believes it is possible the pond water is causing the
issue due to elevation slopes he has calculated and it can escape at the hydrant due to the clean
rock infill that surrounds the water pipes. Also, Twin Pines is the natural draining area for rain
starting at Highway 7.
Recommendation:
Mr. Wilson wants the City to take care of the water problem. Mr. Martin has drawn a plan for an
underground "french drain" that would divert the water across the street and down the hill
eventually surfacing 300 feet down Twin Pines Dr. We would install the pipe in the right of way
while Mr. Wilson could extend it into his yard on private property. Mr. Wilson would prefer the
City pay and do all of the work to solve the issue from the water flow.

Issue:
Parking on Bird Ave. causing problems with traffic flow.
Background:
Bird Avenue is a connector road between Mechanic St. (Highway 7) and South St. (Highway 2)
for residential/light commercial traffic. It is a residential street (no traffic count available) that is
used by passenger vehicles, contractors, emergency vehicles, and school busses. Tractor/trailers
are not to use that street. There are issues at times when it is busy and there are vehicles parked
along the street for larger vehicles to pass through safely for two way traffic. It is one of the
City's collector streets and has 5 intersections from Mechanic to South.
Recommendation:
Discuss recommending to the traffic engineer to make Bird Avenue no parking from Mechanic
to South St.

One item not considered at the last work session was allowing developers to burn vegetation on
the site of their development. In the past the Missouri Department of Natural Resources issued a
permit to allow developers to burn waste in a pit with an air curtain incinerator. MoDNR defined
the limits of the burning and the time.
Since that is now left up to the local jurisdiction I asked our city attorney to add some language
to allow this type of burning. We revised the definition for vegetative waste and developer, and
included regulations in the language.
Before taking to a regular meeting I wanted the Board to have a chance to review and discuss
first.

This section of Municipal Code is on Open Burning from the Chapter for police enforcement
Open Burning In Violation Of Sections 205.020 — 205.025 and 205.040 — 205.060 205.120 of
this Title, The International Fire Code And The Amendments Thereto. It shall be unlawful for
any person to kindle or maintain or authorize to be kindled or maintained any open burning in
violation of Section 307 of the International Fire Code as adopted and amended by Article II of
the Fire Code, Sections 205.020 — 205.025 and 205.040 — 205.060 205.120 of this Title.
This is the Section of the Municipal Code that regulates burning. We do not require a permit.
Section 205.120 Amendments to Adopted Code.

A.
The fire code adopted by the provisions of this article is hereby amended and/or modified in the
following respects:
1.
In IFC Section 101.1, insert: "the City of Harrisonville."
2.
In IFC Section 105.1.2, Types of permits, delete Paragraph Number 2 in its entirety.
3.
Delete IFC Section 105.7, Required construction permits, in its entirety.
4.
Delete IFC Section 108, Board of Appeals, in its entirety.
5.
Delete IFC Section 113, Fees, in its entirety.
6.
Delete IFC Section 307, Open Burning, Recreational Fires and Portable Outdoor Fire Places, in
its entirety and enact as follows:
307.1. General.
Open burning shall not be authorized unless conducted in accordance with this Section and
Section 215.1105 for properties with two (2) residential units or less; or for developers for land
clearing operations as defined in Section 307.1.3. Open burning that causes or constitutes a
public health hazard, a hazard to vehicular or air traffic, is composed of material listed in
subsection (3)(A) of this Section, or violates any other rule or statute, is not allowed unless
specified otherwise. A public health hazard is to be as determined by the Fire Code Official or
his/her designee on a case-by-case basis. Commercial businesses and properties with two (2) or
more residential units, such as mobile home parks or multi-family dwellings are not allowed to
open burn.

307.1.2. Burn Ban.
No open burning allowed during any period when the Fire Code Official or his/her designee
has declared a burn ban under the provisions of the Code of Ordinances of the City of
Harrisonville.
307.1.3. Definitions.
(A) Air curtain incinerator—A device that operates by forcefully projecting a curtain of air
across an open chamber or open pit in which combustion occurs.
(B) Developer – Person, company, or its employees who buys land within the City and builds
upon it residential housing. The person, company or its employees remains a Developer
through the completion of the land clearing operations for the purposes of constructing
residential housing.
(C) Open burning—The burning of materials where the products of combustion are emitted
into the open air without passing through a chimney or stack.
(DC) Salvage Operation—Any business, trade, industry, or other activity conducted in whole
or in part for the purpose of salvaging or reclaiming any product or material.
(ED) Trade waste—Waste materials from any business, institution, or industry.
(FE) Untreated wood—Wood that has not been chemically preserved, painted, stained, or
composited. Untreated wood does not include plywood, particleboard, chipboard, and wood
with other than minimal quantities of paint, coating, or finish.
(GF) Vegetative waste— Organic waste materials including, tree limbs, tree trunks, tree
trimmings, and vegetation.
(HG) Wood processing facility—A facility that uses logs or dimensional lumber to be cut and
used in the manufacturing process.
(IH) Yard waste – Leaves, pruned branches, weeds, dead flowers, grass clippings, and brush.
307.2. Extinguishment of burn. The Fire Code Official or his/her designee reserves the right
to prohibit, restrict, or order the extinguishment of open burning where burning is considered
detrimental to air quality standards, or where burning would be hazardous due to atmospheric
conditions or local circumstances.
307.3. Allowed Burning of Yard Waste
The City shall allow open burning of yard waste from two dwelling units or less provided it
originates and is burned on the same premises. This Section does not apply to mobile home
parks or apartment complexes. Yard waste does not include home remodeling wastes, wastes
from home businesses, durable goods such as old appliances, carpets or furniture, tires or other
routine household waste. Materials such as tires or used oil may not be used to start the fires or
be burned in the fires.

307.3.1. Allowed Burning of Vegetative Waste
The City shall allow open burning of vegetative waste from developers sites during land
clearing operations provided it originates and is burned on the same premises, in a burn pit with
an air curtain incinerator. Vegetative waste does not include vegetation containing poison ivy
or other allergenic vines or shrubs.
307.3.2. Prohibited Items
The following materials must not be disposed of by open burning: 1. Petroleum-based
materials, including but not limited to, tires, asphalt roofing material, carpet, and used oils; 2.
Materials containing Asbestos ; 3. Trade waste, except untreated wood; 4. Construction or
demolition waste, except untreated wood; 5. Salvage operation waste; 6. Household waste 7.
Organic or vegetative waste containing poison ivy or other allergenic vines or shrubs; or 8.
Durable goods.
307.4. Allowed Open Burning Time
Burning of Yard and Vegetative Waste will be allowed during certain months and at certain
times. Burning of Yard and Vegetative Waste in a burn pit or on the ground will be allowed
and limited to the months of March, April, May, October, November, and December between
the hours of 10:00 a.m. to 4:00 p.m., unless the National Weather Service has issued any of the
following: a Wind Advisory or High Wind Watch or Warning in effect, or a Fire Weather
Watch or Red Flag Warning. 307.53. Location.
The location for open burning shall not be less than fifty (50) feet [fifteen thousand two
hundred forty (15,240) mm] from any structure or property line, and provisions shall be made
to prevent the fire from spreading to within fifty (50) feet [fifteen thousand two hundred forty
(15,240) mm] of any structure. Burning is not permitted in or on public parks, sidewalks,
streets, curbs or drainage areas or in parking areas which are generally open to the public.
Exceptions:
1. Fires in approved containers that are less than fifteen (15) feet [four thousand five hundred
seventy-two (4,572) mm] from a structure.
2. The minimum required distance from a structure shall be twenty-five (25) feet [seven
thousand six hundred twenty (7,620) mm] where the pile size is five (5) feet [nine hundred
fifteen (915) mm] or less in diameter and two (2) feet [six hundred ten (610) mm] or less in
height. 307.53.1 Bonfires. A bonfire shall not be conducted within twenty-five (25) feet [seven
thousand six hundred twenty (7,620) mm] of a structure or combustible material unless the
bonfire is contained in a barbeque pit. Conditions which could cause a fire to spread within
twenty-five (25) feet [seven thousand six hundred twenty (7,620) mm] of a structure shall be
eliminated prior to ignition. 307.53.2 Recreational fires. Recreational fires shall not be conducted within twenty-five (25)
feet [seven thousand six hundred twenty (7,620) mm] of a structure or combustible material
unless the fire is contained in a barbeque pit. Conditions which could cause a fire to spread

within twenty-five (25) feet [seven thousand six hundred twenty (7,620) mm] of a structure
shall be eliminated prior to ignition. 307.64. Attendance and Notification Required. Open burning, bonfires or recreational fires
shall be constantly attended until the fire is extinguished. A minimum of one (1) portable fire
extinguisher complying with IFC Section 906 with a minimum 4-A rating or other approved
on-site fire-extinguishing equipment, such as dirt, sand, water barrel, garden hose or water
truck, shall be available for immediate utilization. Police Dispatch must be notified at least
twenty-four hours (24) in advance or in writing to ___________before any Open Burning.
Notification is not required for burning of charcoal or gas grills, and wood burning fire pits
with screen covers.
307.74.1. Exceptions
The following items are exempt from Section 307:
a. Charcoal or gas grills
b. Metal or masonry outdoor wood burning fire pits with screen cover
