RESOLUTION NO. 2021-264

Approval of Grant Award from the State of New Jersey for the SFY21 Body-Worn Camera Grant Program, $42,798.00 WHEREAS, the State of New Jersey has put in place a grant program to assist police departments with the acquisition of Body-Worn Cameras; and, WHEREAS, the Borough of Waldwick has been assigned award number 21-BWC-059 in the amount of $42,798.00; and, WHEREAS, the full $42,798.00 will be provided by the State of New Jersey. No matching funds from the Borough of Waldwick are required for this grant award; and, WHEREAS, the award period for the SFY21 Body Worn Camera Grant Program is from January 1, 2021 to December 31, 2025; and, WHEREAS, the Mayor and Council of the Borough of Waldwick are authorized to accept the SFY21 Body-Worn Camera grant award. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick hereby accept the award amount of $42,798.00 for the SFY21 Body-Worn Camera Grant Program.

RESOLUTION NO. 2021-265

Approval of Chapter 159 – Body Cameras WHEREAS, NJS 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount was not determined at the time of the adoption of the budget; and, WHEREAS, the Director may also approve the insertion of an item of appropriation for equal amount. NOW, THEREFORE, BE IT RESOLVED, that the Municipal Council of the Borough of Waldwick in the County of Bergen, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2021 in the sum of $42,798.00, which is now available from _______________________ in the amount of $42,798.00. BE IT FURTHER RESOLVED, that the like sum of $42,798.00 is hereby appropriated under the caption State of New Jersey – Body Cameras; and, BE IT FURTHER RESOLVED that the above is the result of funds from the State of New Jersey – Body Cameras Grant in the amount of $42,798.00.

Award Fair and Open Contract to Watchguard Video for Body-Worn Cameras and Associated Equipment and Services, $52,023.00 WHEREAS, the State of New Jersey Attorney General issued Law Enforcement Directive 2021-5 requiring that all uniformed patrol officers and additionally designated officers be equipped with body-worn cameras; and, WHEREAS, the State of New Jersey put in place a grant program to assist police departments with the acquisition of body-worn cameras; and, WHEREAS, the Borough of Waldwick has been assigned award number 21-BWC-059 in the amount of $42,798.00; and, WHEREAS, the Borough received the attached proposal, dated August 27, 2021, from Watchguard Video for the required body-worn cameras and associated equipment and services, in the amount of $52,023.00; and, WHEREAS, the body-worn camera and associated equipment provided under state contract 17-FLEET-00793; and, WHEREAS, the contracts were awarded through a fair and open process, pursuant to N.J.S.A. 19:44A-20.4 et seq.; and, WHEREAS, the Chief Financial Officer of the Borough of Waldwick has certified that $52,023.00 is available in the following appropriation: $42,798.00 from GRANT X-XX-XXX-XXX and $9,225 from 1-01-25-240-274, and has further certified that this commitment together with all previous commitments and payments does not exceed the funds available in said appropriation. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick authorize Watchguard Video, 415 E. Exchange, Allen, TX 75002, to purchase Body Cameras in the amount of $52,023.00

(Page 1 of 2) Authorize Increase in Non-Fair and Open, Open Ended Contract with Miracle Chemical Company in an Amount Not to Exceed $6,000.00 WHEREAS, the Borough requires ongoing chemicals to ensure proper safety standards are met at the Borough Pool and approved Resolution No. 2021-#52 at the Reorganization Meeting of January 5, 2021 in the amount not to exceed $20,000.00; and, WHEREAS, the Borough wishes to increase the amount not to exceed by $6,000.00; and, WHEREAS, Miracle Chemical Company has been determined to be the most advantageous provider of pool chemicals, cost and other factors considered; and, WHEREAS, the Borough seeks to enter an open-ended contract with Miracle Chemical Company for an amount not to exceed $26,000.00; and, WHEREAS, Miracle Chemical Company will provide equipment and service by request only; the Borough is not obligated to order, accept, or pay for services except when it orders them; and, WHEREAS, pursuant to N.J.A.C. 5:30-5.5(b), a certification of funds is not required for this contract; and, WHEREAS, this contract will terminate December 31, 2021; and, WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions of N.J.S.A. 19:44A-20.4 et seq.; and, WHEREAS Miracle Chemical Company, has completed and submitted a Business Entity Disclosure Certification which certifies Miracle Chemical Company has not made any reportable contributions to a political or candidate committee in the Borough of Waldwick in the previous one year, and that the contract will prohibit v from making any reportable contributions through the term of the contract. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick authorize an increase of $6,000.00 to Miracle Chemical Company 1151B NJ-33, Farmingdale, NJ 07727 for pool chemicals in an open ended contract not to exceed $26,000.00.

Change Order No. 2, John Dow Avenue, West Prospect Street and Hopper Avenue Improvement Project, $9,282.54 WHEREAS, a contract was awarded to 4 Clean-Up, Inc., for the John Dow Avenue, West Prospect Street and Hopper Avenue Improvement Project on July 28, 2020 in the amount of $421,102.80 as per Resolution No. 2020-221; and, WHEREAS, Change Order No. 1, as per Resolution No. 2020-316 increased the contract amount from $421,102.80 to $440,375.39; and, WHEREAS, the Borough Engineer has submitted Change Order No. 2 dated August 3, 2021, which decreases the contract by $9,282.54; and, WHEREAS, Change Order #2 results in a final contract amount of $431,092.85 which represents a 2.3% increase from the original contract amount. GOVERNING BODY CERTIFICATION OF THE ANNUAL AUDIT WHEREAS, N.J.S.A. 40A: 5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions; and, WHEREAS, the Annual Report of Audit for the year 2020 has been filed by a Registered Municipal Accountant with the Municipal Clerk pursuant to N.J.S.A. 40A: 5-6, and a copy has been received by each member of the governing body; and, WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and, WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled "Comments and Recommendations; and, WHEREAS, the members of the Governing Body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled "Comments and Recommendations, as evidenced by the Group Affidavit form of the governing body attached hereto; and, WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and, WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and,

WHEREAS, the Borough of Waldwick is the owner of certain property designated as Lot 16 in Block 132 as shown on the Tax Map of the Borough of Waldwick and upon which lies a Borough structure commonly known as “The Old DPW Complex”; and, WHEREAS, in 1991 the Borough of Waldwick entered into a Lease Agreement with Waldwick High School Graduation Ball, Inc. a non-profit corporation of the State of New Jersey; and, WHEREAS, pursuant to the Lease Agreement, Waldwick High School Graduation Ball, Inc. utilizes The Old DPW Complex for the preparation and storage of materials for the Waldwick High School Graduation Ball; and, WHEREAS, the Borough of Waldwick and Waldwick High School Graduation Ball Inc. wish to codify the Lease Agreement pursuant to the Local Lands and Buildings Law of the State of New Jersey (N.J.S.A. 40A:12-1 et seq.), NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Waldwick as follows: Section 1: Findings. It is hereby determined that Waldwick High School Graduation Ball Inc. is a non-profit corporation organized and existing pursuant to Title 15 of the revised statutes of the State of New Jersey which pursuant to the purposes of such corporation, provides recreational activities for the youths located within the Borough of Waldwick, thereby contributing significantly to promoting the general welfare of the community. Section 2: Authorization and Purpose of Lease Agreement. In accordance with N.J.S.A. 40A:12-14(c) and N.J.S.A. 40A:12-15 pursuant to the terms and conditions hereinafter set forth, the Mayor and Clerk of the Borough of Waldwick are hereby authorized to execute on behalf of the Borough a Lease Agreement with Waldwick High School Graduation Ball Inc., as lessee, allowing use of The Old DPW Complex located within Lot 16 in Block 132 as shown on the Tax Map of the Borough of Waldwick for purposes of constructing and storing Graduation Ball Materials. Section 3: Consideration for Lease. The consideration for the lease hereby authorized shall be the construction and storage of Graduation Ball materials, a place of meeting for the Waldwick High School Graduation Ball Inc. and any other related activities as might normally be conducted by Waldwick High School Graduation Ball Inc. in preparation for the Graduation Ball.

Section 4: Public Purpose. The Waldwick High School Graduation Ball Inc. agrees to prepare, organize and operate a Waldwick High School Graduation Ball for the benefit of the graduating seniors of the Borough of Waldwick High School. Section 5: Term; Renewal; Termination. The term of the Lease between the Borough of Waldwick and Waldwick High School Graduation Ball Inc. shall expire on June 30, 2022. Section 6: Annual Report. In June of each year during which the Lease Agreement is in effect, Waldwick High School Graduation Ball Inc. shall submit to the Mayor and Council of the Borough of Waldwick a written report setting out the use to which the leasehold was put during the year, and the activities of Waldwick High School Graduation Ball Inc. undertaken in furtherance of the public purpose for which the lease was granted. The report shall also contain an affirmation of the continued tax-exempt status of the Waldwick High School Graduation Ball Inc. as a non-profit corporation pursuant to both state and federal law. It is understood and agreed that, by the execution of the within lease, all prior leases of all or part of the leased premises heretofore entered into by the parties including but not limited to the leases dated March 26, 1991 and March 23, 2004 shall cease and be of no further force or effect. Section 7: Enforcement of Conditions. The Borough Council of Waldwick shall be responsible for enforcement on behalf of the Borough of the conditions of the agreement executed pursuant hereto.

BE IT RESOLVED that the Municipal Council of the Borough of Waldwick hereby amend Chapter 87 Swimming Pool, Municipal to revised Section 87-4 Rules and Regular of the Municipal Pool with the changes to Code of the Borough of Waldwick below shows deletions in strikethrough and additions in underline as follows: § 87-4 Rules and regulations of the Municipal Pool. A. All users of the facility and its equipment will be required to purchase a badge or daily pass to gain

entrance. Individuals will be allowed to pick up children without purchasing a pass. Only Waldwick residents and their guests will be allowed with the exception of those limited number of out of town residents that are allowed to join. Residents of other communities may be able to utilize the pool on an annual basis upon the approval of the Mayor and Council at a fee to be determined by resolution.

B. No swimming will take place without a lifeguard being on duty.

C. No shorts will be allowed to be worn when in the water.

D. Only Coast-Guard-approved flotation devices are permitted.

E. Conduct which endangers the safety and comfort of others shall be prohibited. Profanity, rough housing or any other unacceptable behavior will not be tolerated. In the judgment of the Pool Manager, or Head Lifeguard, said individuals will may be expelled from the pool grounds. In any event of a serious act of an individual(s), the Mayor and Council of the Borough of Waldwick may revoke his/her pool badge for the remainder of the pool season.

F. Running will not be allowed on any surfaces around the pool grounds.

G. Badges will be presented upon entering the facility, or at any time when requested by Pool facility personnel.

H. Inflatable or any type of water toys will not be allowed in the main pool.

I. All children in diapers must wear diapers specially designed for immersion in water (such as swimming diapers). Do not wash soiled diapers in bathing water.Infants must wear diapers at all times. Waterproof diapers or rubber pants are required.

J. No face masks or snorkels are permitted.

K. The Municipal Pool closes at 8:00 p.m. or sundown.

L. Outdoor bathing shall be prohibited during electrical storms. If at any time the Pool Manager or his/her assistant deem it unsafe due to weather conditions, etc., for bathers to swim, they will order the pool closed to all individuals.

M. No animals, except for service animals shall be permitted at the Municipal Pool.in the swimming pool, wading pool, hot tub or spa area, dressing rooms or other parts of the enclosure.

N. There shall be a complete prohibition on smoking, including smokeless tobacco, tobacco products, vaping and vaping products within the property boundaries of the Waldwick Municipal Pool.

O. Any person showing evidence of any communicable skin disease, sore or inflamed eyes, cold, nasal or ear discharges, or any communicable disease shall be denied admission.

P. Any person with excessive sunburn, open blisters, cuts or bandages shall be denied admission.

Q. Do not enter the water if you are experiencing or recovering from diarrhea or have had any signs or symptoms of gastrointestinal (stomach) disease in the past seven days.

R. Children should be encouraged to use the restroom before entering the water. Immediately report any “accidents” you observe in the bathing waters to a lifeguard.

S. Glass containers shall be prohibited in all areas including the food and drinking areas.

T. All persons shall shower before entering the water.

U. Alcohol is prohibited in all areas.

V. Persons suspected of being under the influence of alcohol or drugs shall be prohibited from entering the facility.

W. All children must be accompanied by a parent or guardian at all times.
