EXECUTIVE SUMMARY (General Business): The Florida Housing Finance Corporation (FHFC) requires

that local governments develop and maintain a Local Housing Assistance Plan (LHAP) detailing how

the City intends to use its State Housing Initiatives Partnership (SHIP) funds for 3-year periods. The

City's current plan is in effect until June 30, 2019. Staff has taken the necessary steps to update the

plan and draft a resolution which are attached for approval. The approved documents must be

submitted to FHFC by May 2, 2019.

PRESENTATION INFORMATION: N/A, Neighborhood Services Staff will be available for any questions.

STAFF RECOMMENDATION: Move that the Council approve the updated LHAP by resolution.

BACKGROUND: The Neighborhood Services Department contracted with a consultant to provide

ISSUES/ANALYSIS: The LHAP was updated based on input from the City's Affordable Housing AdvisoryCommittee which is a group of housing professionals appointed by the Mayor in 2018 and tasked withdiscussing housing issues in the community. The committee had 5 public meetings with their final reportbeing approved by the City Council on December 3,2018. The update LHAP incorporates the committee'ssuggestions as required.

FINANCIAL INFORMATION: Based on the most recent State Revenue Estimating Conference (August2018), the 2019-2020 projected SHIP distribution estimate for the City of Port St Lucie is $2,164,876.Final distribution amount is subject to change based on the Florida Legislature.

A RESOLUTION OF THE CITY OF PORT ST. LUCIE. FLORIDA, APPROVING CITY OFPORT ST. LUCIE'S LOCAL HOUSING ASSISTANCE PLAN; DETERMINING THEPERCENTAGE OF LOCAL HOUSING DISTRIBUTION AND PROGRAM INCOMENECESSARY TO PAY THE COSTS OF ADMINISTRATION; AUTHORIZING ANDDIRECTING THE CITY MANAGER TO EXECUTE NECESSARY DOCUMENTS ANDCERTIFICATIONS REQUIRED BY THE STATE; AUTHORIZING THE SUBMISSION OFTHE LOCAL HOUSING ASSISTANCE PLAN FOR 2019-2020, 2020-2021, 2021-2022 TOTHE FLORIDA HOUSING FINANCE CORPORATION; PROVIDING FOR CONFLICT;PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE.

WHEREAS, the State of Florida enacted the William E. Sadowski Affordable Housing

Act, Chapter 92-317, Laws of Florida, allocating a portion of documentary stamp taxes on deeds

to local governments for the development and maintenance of affordable housing; and

WHEREAS, the State Housing Initiatives Partnership ("SHIP") Act, section 420.907-

420.9089, Florida Statutes (2018), and Rule 67-37.005, Florida Administrative Code, requires

local governments to develop a Local Housing Assistance Plan, effective for up to three years,

which outlines how funds will be used to implement housing strategies, incentives, and activities

to be undertaken pursuant to the Local Housing Assistance Plan; and

WHEREAS, the SHIP Act requires local governments to establish the maximum SHIP

funds allowable for each local housing strategy; and

WHEREAS, the SHIP Act further requires local governments to establish an average area

purchase price for new and existing housing benefiting from awards made pursuant to the Act; and

WHEREAS, the Neighborhood Services Department has prepared a three-year Local

Housing Assistance Plan, attached hereto and incorporated herein for submission to the Florida

Housing Finance Corporation; and

WHEREAS, the methodology and purchase prices used are defined in the attached Local

Housing Assistance Plan; and

WHEREAS, pursuant to section 420.9075, Florida Statutes, the City Council finds that 5

percent of the local housing distribution plus 5 percent of the program income is insufficient to

pay the necessary costs of administering the local housing plan; and

WHEREAS, the City Council finds that it is in the best interest of the public for the City

of Port St. Lucie to submit the Local Housing Assistance Plan for review and approval so as to

qualify for said documentary stamp tax funds; and

WHEREAS, the City Council finds that it is in the best interest of the public for the City

of Port St. Lucie to submit the Local Housing Assistance Plan for review and approval so as to

qualify for said documentary stamp tax funds.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PORT ST. LUCIE,

FLORIDA:

Section 1. Ratification of Recitals. The foregoing recitals are hereby ratified and

confirmed as true and correct and are hereby made a part of this Resolution.

Section 2. Approval of the Local Housing Assistance Plan. The City Council of the City of

Port St. Lucie hereby approves the Local Housing Assistance Plan, as attached and incorporated

hereto for submission to the Florida Housing Finance Corporation for fiscal years 2019/2020 -

2021/2022. All provisions of the Local Housing Assistance Plan conform to the requirements of

Section 420.9072, F.S., et seq.. and Rule Chapter 67-37. F.A.C.

Section 3. Costs of Administering Plan. The City Council of the City of Port St. Lucie

hereby determines that an amount of 10 percent of the local housing distribution plus 5 percent of

program income deposited into the trust fund is sufficient to adequately pay the necessary costs of

administering the Local Housing Assistance Plan.

Section 4. Authority. The City Manager is hereby designated and authorized to execute any

documents and certifications required by the Florida Housing Finance Corporation as related to

the Local Housing Assistance Plan, and to do all things necessary and proper to carry out the term

and conditions of said program.

Section 5. Conflict. If any resolutions, or parts of resolutions, are in conflict herewith,

this Resolution shall control to the extent of the conflicting provisions.

Section 6. Severability. The provisions of this Resolution are intended to be severable. If

any part of this Resolution is determined to be void or is declared illegal, invalid, or

unconstitutional by a Court of competent jurisdiction, the remainder of this Resolution shall remain

in full force and effect.

Section 7. Effective Date. This Resolution shall become effective immediately upon

adoption.

B. Purpose of the program:• To meet the housing needs of the very low, low and moderate-income households;• To expand production of and preserve affordable housing; and• To further the housing element of the local government comprehensive plan specific to affordable

housing.

D. Governance: The SHIP Program is established in accordance with Section 420.907-9079, Florida Statutes andChapter 67-37, Florida Administrative Code. Cities and Counties must be in compliance with these applicablestatutes, rules and any additional requirements as established through the Legislative process.

E. Local Housing Partnership: The SHIP Program encourages building active partnerships between government,lending institutions, builders and developers, not-for-profit and community-based housing providers andservice organizations, providers of professional services related to affordable housing, advocates for low-income persons, real estate professionals, persons or entities that can provide housing or support servicesand lead agencies of the local continuums of care.

The City of Port St Lucie has partnered with the Martin/St. Lucie Lending Consortium since the inception ofthe SHIP program. Any financial institution or mortgage company that agrees to send representatives tosemi-monthly meetings, provide a special lending package and support homebuyer education classes mayjoin the consortium and offer first mortgage loans to SHIP applicants. The Consortium lenders have agreedto limit lender fees and provide fixed rate mortgages for SHIP applicants. When bond or portfolio loans arenecessary or beneficial for applicants but are not available from consortium members, NeighborhoodServices staff may give temporary approval for a lender outside of the consortium to fund the loan. It mustbe in the best interest of the applicant and the SHIP program to do so. Training events and special meetingsare also scheduled to bring together lenders, title companies, realtors and homebuilders.

F. Leveraging: The Plan is intended to increase the availability of affordable residential units by combining localresources and cost saving measures into a local housing partnership and using public and private funds toreduce the cost of housing. SHIP funds may be leveraged with or used to supplement other Florida HousingFinance Corporation programs and to provide local match to obtain federal housing grants or programs.

G. Public Input: Public input was solicited through face to face meetings with housing providers, social serviceproviders and local lenders, neighborhood associations and Notice of Funding Availability.

H. Advertising and Outreach: SHIP funding availability shall be advertised in a newspaper of general circulationand periodicals serving ethnic and diverse neighborhoods, at least 30 days before the beginning of theapplication period. If no funding is available due to a waiting list, no notice of funding availability is required.

Discrimination: In accordance with the provisions of ss.760.20-760.37, it is unlawful to discriminate on thebasis of race, color, religion, sex, national origin, age, handicap, or marital status in the award applicationprocess for eligible housing.

Waiting List/Priorities: A waiting list will be established when there are eligible applicants forstrategies that no longer have funding available or if it is necessary to suspend selection due to highvolume of applications. Those households on the waiting list will be notified of their status.Applicants will be maintained in an order that is consistent with the time names were placed on thelist as well as any established funding priorities as described in this plan. When necessary, the Citymay give priority to extremely-low, very-low, low income, and/or special needs applicants on thewaiting list in order to maintain compliance with State guidelines relating to low income and/orspecial needs (defined in 420.004 F.S.) set asides. Disaster Recovery applicants may be funded priorto applicants on a waiting list for other strategies.

J. Support Services and Counseling: Support services are available from various sources. Available supportservices may include but are not limited to: Pre- Homeownership Counseling and Credit Counseling.Additional information regarding these services and other counseling services can also be found on the City ofPort St Lucie website at www.cityofpsl.com or contact the Neighborhood Services Office.

K. Purchase Price Limits: The sales price or value of new or existing eligible housing may not exceed 90% of theaverage area purchase price in the statistical area in which the eligible housing is located. Such average areapurchase price may be that calculated for any 12-month period beginning not earlier than the fourth calendaryear prior to the year in which the award occurs. The sales price of new and existing units, which can belower but may not exceed 90% of the median area purchase price established by the U.S. TreasuryDepartment or as described above.

Local HFA Numbers

L. Income Limits, Rent Limits and Affordability: The Income and Rent Limits used in the SHIP Program areupdated annually by the Department of Housing and Urban Development and posted atwww.floridahousing.org

"Affordable" means that monthly rents or mortgage payments including taxes and insurance do not exceed30 percent of that amount which represents the percentage of the median annual gross income for thehouseholds as indicated in Sections 420.9071, F.S. However, it is not the intent to limit an individualhousehold's ability to devote more than 30% of its income for housing, and housing for which a householddevotes more than 30% of its income shall be deemed Affordable if the first institutional mortgage lender issatisfied that the household can afford mortgage payments in excess of the 30% benchmark and in the caseof rental housing does not exceed those rental limits adjusted for bedroom size.

M. Welfare Transition Program: Should an eligible sponsor be used, a qualification system and selection criteriafor applications for Awards to eligible sponsors shall be developed, which includes a description thatdemonstrates how eligible sponsors that employ personnel from the Welfare Transition Program will be givenpreference in the selection process.

N. Monitoring and First Right of Refusal: In the case of rental housing, the staff and any entity that hasadministrative authority for implementing the local housing assistance plan assisting rental developmentsshall annually monitor and determine tenant eligibility or, to the extent another governmental entity providesperiodic monitoring and determination, a municipality, county or local housing financing authority may relyon such monitoring and determination of tenant eligibility. However, any loan or grant in the original amountof $10,000 or less shall not be subject to these annual monitoring and determination of tenant eligibilityrequirements. Tenant eligibility will be monitored annually for no less than 15 years or the term of assistancewhichever is longer unless as specified above.

Eligible sponsors that offer rental housing for sale before 15 years or that have remaining mortgages fundedunder this program must give a first right of refusal to eligible nonprofit organizations for purchase at thecurrent market value for continued occupancy by eligible persons.

O. Administrative Budget: A line-item budget is attached as Exhibit A. The City of Port St Lucie ensures that themoneys deposited in the local housing assistance trust fund shall be used to administer and implement thelocal housing assistance plan.

Section 420.9075 Florida Statute and Chapter 67-37, Florida Administrative Code, states: "A county or aneligible municipality may not exceed the 5 percent limitation on administrative costs, unless its governing bodyfinds, by resolution, that 5 percent of the local housing distribution plus 5 percent of program income isinsufficient to adequately pay the necessary costs of administering the local housing assistance plan."

Section 420.9075 Florida Statute and Chapter 67-37, Florida Administrative Code, further states: "The cost ofadministering the program may not exceed 10 percent of the local housing distribution plus 5 percent ofprogram income deposited into the trust fund, except that small counties, as defined in s. 120.52(19), andeligible municipalities receiving a local housing distribution of up to $350,000 may use up to 10 percent ofprogram income for administrative costs." The applicable local jurisdiction has adopted the above findings inthe resolution attached as Exhibit E.

R. Essential Service Personnel Definition: The City of Port St Lucie defines "Essential Service Personnel" as"Those employed persons whose household income does not exceed program income limits, includingteachers and educators: other school district employees, community college employees, and universityemployees; police and fire personnel; health care personnel; skilled building trades personnel; governmentpersonnel and active military government personnel".

S. Describe efforts to incorporate Green Building and Energy Saving products and processes: The City willrequire energy star appliances whenpossible. All homes are required to have storm shutters or impactresistant windows if SHIP is replacing windows. Other energy efficient upgrades may be recommended inconnection with needed repairs. When replacing garage doors, we upgrade to insulated doors; windows andsliders are replaced with low-e and air conditioners are 16-seer. Other items may include the following: atticInsulation to R-30, caulking around windows and doors, and weather-stripping of all exterior doors.

T. Describe efforts to meet the 20% Special Needs set-aside: The City of Port St Lucie has reached out to severalorganizations that support special needs households to access the housing needs of their clients. There hasnot been a need for housing assistance expressed by those organizations at this time, but we will continue tocommunicate with them, especially when a new housing plan is being prepared. Staff also reviews the files ofeach new applicant to determine if that applicant or any member of the household meets the definition ofSpecial Needs as defined under Chapter 67-37.002 (21), F.A.C. Those households are eligible for all of ourhousing strategies and, if needed, they may request accessibility retrofit improvements that enable them tolive more independently in their homes.

U. Describe efforts to reduce homelessness: HUD is providing program funding for homeless services in St. LucieCounty through the Continuum of Care administered by the Treasure Coast Homeless Services Council. TheCity of Port St. Lucie maintains its membership on the Council and the priorities established in its Action Planmatch those of the regional Continuum of Care. The City supports the Council's grant application to HUD.The City is a member of the Treasure Coast Homeless Services Council, which is the lead agency for theRegional Continuum of Care. The City participates in the Continuum and supports its efforts. The homelesspriorities established by the Continuum are also the City's priorities established in it CDBG Consolidated Plan.

A. Home Purchase Assistance

Summary: Funding assistance to eligible home buyers to purchase newly constructed homes or existinghomes in the City of Port St Lucie. SHIP monies may be used for all or any portion of the following: downpayment, closing costs, prepaids, and existing homes may use up to $1,000 to address needed repairsbased on the inspection report.

b. Income Categories to be served: Very low, low and moderate

c. Maximum award: $21,000Maximum funding amount includes a grant of up to $1,000 for project delivery costs.

d. Terms (all six items must be completed or "N/A")1. Repayment loan/deferred loan/grant: Deferred payment loan secured by a note and mortgage.

2. Interest Rate: 0%

3. Years in loan term: 15

4. Forgiveness: Loan will be forgiven at the end of the term.

5. Repayment: None required if the loan is in good standing.

6. Default: The loan balance is due in the event of default, which includes:

• Violation by borrower of the terms of the note or mortgage securing the note.• Sale or transfer of all or any part of the property or any interest in the property by borrower

unless (a) the remaining principle balance due under the note and mortgage is paid in full; or(b) if one of the following applies: 1) upon the death of the last surviving mortgagor, a personbecomes the owner of the mortgaged property by virtue of (a) a remainder interest in theproperty created prior to death of the last mortgagor, or (b) a probate or other suchproceeding, and that beneficiary is eligible to assume the remaining principal balance dueunder the Note and the Mortgage. Persons qualified to assume the mortgage must occur thesubject property and qualify under current State Housing Initiatives Partnership (SHIP) orsimilar housing assistance program.

• Failure by borrower to timely pay all taxes, assessments, insurance, and any other chargesand fines that may be imposed on the property which may be superior to the loan ormortgage.

• Borrower moving to another location as a permanent residence, unless the remainingprinciple balance due under the note and the mortgage is paid in full.

• Institution of foreclosure proceedings of a mortgage or lien of any kind, superior or inferior tothis encumbrance, by one other than the City.

If the home is foreclosed on by a superior mortgage holder , the city will make an effort to recapture

fund through the legal process if it is determined that adequate funds may be available to justifypursuing a repayment.

e. Recipient Selection Criteria: Applicants will be ranked for assistance based on a first-qualified, first-servedbasis. The city will give priority to extremely-low, very-low, low income, and or special needs applicantsto maintain compliance with State guidelines relating to very low, low income and or special needs setasides.

f. Sponsor Selection Criteria: N/A

Additional Information: The applicant cannot own a home at the time of application, and theymust contribute $500 of their own funds toward the total cost of the home purchase transaction. Theapplicant's verifiable cash and other assets (combined with gifts from family members, if applicable)cannot not exceed $15,000. Tax deferred accounts are not counted as cash on hand.

Households receiving assistance under this strategy may not reapply after the first home is sold, even ifthe City's mortgage is paid off or completely satisfied.

In order to meet the 75% construction/rehab set-aside for the SHIP program, the City may requirehomebuyers to include documented, eligible repairs or energy efficiency improvements that werecompleted by the seller within 12 months prior to closing.

Loan will be awarded in the amount of money required to allow the homebuyer to qualify. The maximumwill not be awarded in all cases.

The applicant must be able to qualify for a mortgage loan from a member of the Lending Consortium oran approved local lender offering bond or special financing. A prequalification letter will be requiredbefore the application will be processed or selected for funding. The applicant's front-end and back-endratios should not be less than 29% or more than 45% of household income. Mitigating circumstances maybe considered (i.e. history of paying more for housing, etc.)

The applicant must complete a homebuyer education workshop by a HUD approved Counseling Agencyand provide a certificate of completion prior to closing on the purchase of the home.

Subordination: In cases where a SHIP client wishes to refinance their first mortgage, the City'sCurrent policy allows for a subordination of its Mortgage if the household will benefit with an interest rateand/or housing payments reduction that is sufficient to offset the costs of refinancing. The City will notsubordinate for debt consolidation, and the household may not receive any cash payments in thetransaction.

CERTIFICATION TOFLORIDA HOUSING FINANCE CORPORATION

Local Government: City of Port St Lucie

(1)

The local government will advertise the availability of SHIP funds pursuant to FloridaStatutes.

(2) All SHIP funds will be expended in a manner which will insure that there will be nodiscrimination on the basis of race, creed, religion, color, age, sex, familial or maritalstatus, handicap, or national origin.

(3) A process for selection of recipients for funds has been developed.

(4) The eligible municipality or county has developed a qualification system for applications forawards.

(5) Recipients of funds will be required to contractually commit to program guidelines.

(6) The Florida Housing Finance Corporation will be notified promptly if the localgovernment (or interlocal entity) will be unable to comply with the provisions the plan.

The Local Housing Assistance Plan shall provide for the expenditure of SHIP funds within24 months following the end of the State fiscal year in which they are received.

The plan conforms to the Local Government Comprehensive Plan, or that an amendment tothe Local Government Comprehensive Plan will be initiated at the next available opportunityto insure conformance with the Local Housing Assistance Plan.

Amendments to the approved Local Housing Assistance Plan shall be provided to theCorporation within 21 days after adoption.

(10) The trust fund shall be established with a qualified depository for all SHIP funds as wellas moneys generated from activities such as interest earned on loans.

(11) Amounts on deposit in the local housing assistance trust fund shall be invested as permittedby law.

(12) The local housing assistance trust fund shall be separately stated as a special revenue fund inthe local governments audited financial statements, copies of the audits will be forwarded tothe Corporation as soon as available.

An interlocal entity shall have its local housing assistance trust fund separately audited foreach state fiscal year, and the audit forwarded to the Corporation as soon as possible.

(14) SHIP funds will not be pledged for debt service on bonds or as rent subsidies.

(15) Developers receiving assistance from both SHIP and the Low Income Housing TaxCredit (LIHTC) Program shall comply with the income, affordability and other LIHTCrequirements, similarly, any units receiving assistance from other federal programs shallcomply with all Federal and SHIP program requirements.

(16) Loans shall be provided for periods not exceeding 30 years, except for deferred paymentloans or loans that extend beyond 30 years which continue to service eligible persons.

(17) Rental Units constructed or rehabilitated with SHIP funds shall be monitored at leastannually for 15 years for compliance with tenant income requirements and affordabilityrequirements or as required in Section 420.9075 (3)(e)

(18) The Plan meets the requirements of Section 420-907-9079 FS, and Rule Chapter 67-37 FAC,and how each of those requirements shall be met.

(19) The provisions of Chapter 83-220, Laws of Florida has or X has not beenimplemented.
