NEW AND REVISED POLICIES (TAB 2) Policy3.206 (Community Use of School Facilities) Purpose of revision: Add a provision prohibiting the use of school facilities for funeral, cremation, or burial purposes or services. Memorial services may be permitted for individuals who have particularly strong involvement with a school or the school system if approved, in advance, by the Director of Schools and so long as the deceased is not brought onto the school property. Policy 5.118 (Background Investigations) Purpose of Adoption: The adoption of the policy is recommended by the Tennessee School Board Association to be compliant with state and federal law requiring policies and/or procedures that address use, dissemination, retention, security, storage, disposal, chain of custody and misuse of criminal history background check records. Recommend Approval --- motion to approve the revisions to Policy 3.206 and the adoption of Policy 5.118 on first reading as recommended by the Policy Committee.

5. VISITORS

Scott Kozimor, resides at 12741 Manchester Highway, addressed the School Board about his concerns with accommodations that are being made for the teaching of Islam and other world religions. Pam King, resides at 609 Federal Court, addressed the School Board about a letter to parents that was sent home from a school in Cheatham County concerning the study of Islam. She asked for assurance that similar assignments would not be required in Rutherford County.

Tammy Berens, resides at 7033 Alon Babayan Arch, LaVergne, addressed the School Board about Islam being taught in schools. She stated that if the School Board did not support the banning of Islam being taught in schools that they would find other candidates to run for School Board.

Pete Doughtie, resides at 1415 Knight Drive, addressed the School Board with concerns about past meetings that have been held with the Department of Justice officials concerning Islam and local schools. He also discussed other concerns he has with Islam and Muslims. Darrel Whaley, resides 4974 W. Trimble Road, addressed the School Board about Bible activities, prayer being removed from schools and concerns he has about Islam. Jackie Archer, resides at 606 Lillard Road, addressed the School Board about concerns she and others have had with the textbook adoption process. Lou Ann Zelenik, resides at 2610 Sequoya Trace, addressed the School Board about a Power Point presentation concerning Islam that is being used in other school districts and asked if it was being used in Rutherford County.

6. SPOTLIGHT ON EDUCATION

Dr. Andrea Anthony, Coordinator of Secondary Education, gave a presentation on American College Testing (ACT) and rigorous coursework and strategies that work.

7. ZONE EXEMPTION APPEAL    

  Angel McCloud, Staff Attorney, swore in Ms. Ellis for the zone exemption hearing.

Parent Tyra D. Martin-Ellis requested a zone exemption for her son to attend Oakland High School instead of LaVergne High School. The request has been denied previously because the student does not meet the minimum qualifications for the IB program, is an athlete, and the LaVergne principal recommended against the

exemption. In addition, the application was not submitted by the deadline for priority consideration, which was April 15, 2015. Motion made by Mr. Holladay, seconded by Mr. Young, to deny the zone exemption request.

Roll Call Vote: Yes – Jeff Jordan, Jim Estes, Lisa Moore, Coy Young, Terry Hodge, Aaron Holladay, Wayne Blair Motion approved to deny the request.

8. OLD BUSINESS Revised Rutherford County Schools 2016-2017 Academic Calendar Change Revised student registration date has been changed from August 4, 2016 to August 5, 2016. Motion made by Mr. Jordan, seconded by Ms. Moore, to approve the revised Rutherford County Schools 2016-2017 Academic Calendar as presented.

Vote: All Yes

9. 2015 – ED-2152 CERTIFICATION OF COMPLIANCE WITH TENNESSEE CODE ANNOTATED SECTION 49-3-310(4)(A) “The superintendent and the Chairman of the Board of each LEA (Local Education Agency) shall certify to the Commissioner on or before October 15 of the current school year that all children enrolled in that LEA have been furnished all required textbooks, as determined by the Commissioner.” Motion made by Mr. Hodge, seconded by Mr. Holladay, for approval of the 2015 ED-2152 Certification of Compliance Report showing all children enrolled in that LEA have been furnished all required textbooks. Vote: All Yes

10. 2015 LEA (LOCAL EDUCATION AGENCY) COMPLIANCE REPORT

LEAs (Local Education Agency) are required to comply with all state education laws and State Board of Education (SBE) rules. The Commissioner of Education will not grant approval to LEAs that are not in compliance with state education laws and rules and have no Tennessee Department of Education (TDOE) approved plan for compliance. Every school in Rutherford County has reviewed the Compliance Report Form including state rules and regulations. The 2015 LEA Compliance Report shows there are no deficiencies for Rutherford County.

Motion made by Mr. Jordan, seconded by Mr. Young, for approval of the 2015 LEA Compliance Report as presented. Vote: All Yes 11. FACILITIES Smyrna High School Soccer Concession Stand and Storage Principal Rick Powell has requested permission to purchase and place a 10ʹ x 20ʹ pre-constructed concession and storage building adjacent to the soccer field at Smyrna High School. The building will be funded through a grant from the Richard Siegel Foundation. Electrical is available at the field. The Application for Campus Construction has been completed and filed with Rutherford County Schools Engineering and Construction Department along with a site plan, estimate and schedule. The location has also been checked by Engineering. Engineering and Construction commends Mr. Powell and Staff for a thorough job of completing all criteria for approval. Motion made by Mr. Holladay, seconded by Mr. Young, to approve purchase and placement of a 10ʹ x 20ʹ pre-constructed building for concession and storage at the Smyrna High School Soccer Field. All required criteria have been met by Principal Rick Powell and staff for this project including gender equity. Vote: All Yes

Mr. Young suggested that we require metal roofs on future buildings, and this be added to the application.

12. FINANCIAL MATTERS

A. Revised Capital Projects List for 2015-2016

The Major Capital Project, Fund 177, list has been revised based on the budget and the revenue approved by the Rutherford County Commission on June 26, 2015. The new total is $3,833,049 which includes $184,534 for the 2014-2015 projects that weren’t complete as of June 30, 2015.

Motion made by Mr. Hodge, seconded by Mr. Estes, to approve the revised Major

Capital Project, Fund 177, list which totals $3,833,049 for 2015-2016 as presented.

B. EMS (Emergency Medical Service) Coverage for Middle School and High School Football (For Information Only) Questions have arisen about the costs associated with providing trainers at

middle school football games similar to our current contract with MTSU for varsity high school football games. MTSU has informed us that additional MTSU trainers are not available since many of these are students also completing coursework requirements.

Rutherford County Emergency Medical Service (EMS) was contacted to ask

if EMS persons would be available to serve in a similar capacity as the high school trainers for middle school football games. EMS stated that because of required protocols and the cost of malpractice insurance, individual EMS personnel do not independently serve in that capacity. The EMS office reported that they would charge us the same rate as their coverage for MTSU football that includes two paramedics and an ambulance. The rate is $65/hour with a 4-hour minimum plus any supplies used.

Middle school football ends in September with one championship game in October.

Middle school football (41 games X $260 = $10,660) High school freshmen and junior varsity play back-to-back on the

same evenings for 4-5 hours total. (40 games X $325 = 13,000) C. Technology Department Purchase

The Technology Department is seeking approval to purchase upgraded and additional networking equipment to handle the increasing demand of internet access. These upgrades are needed to maintain the growth due to testing computer labs, student’s devices, and the ever growing technology demand. The upgrades and expansion will ensure the availability of internet bandwidth for online testing and additional educational content. The price is $150,313.78, and this includes both hardware and software to meet the growing demand. The Hardware Systems Support Department will install this equipment and software.

Motion made by Mr. Young, seconded by Mr. Hodge, to approve the purchase of

hardware and software from Dell at a cost of $150,313.78 to meet the growing demand of Rutherford County School’s technology needs. This purchase will be funded from the previously approved technology upgrade for testing.

13. ATLAS (ACADEMIC TIME LEADS TO ACHIEVING STUDENTS) PROGRAM The number of students served by the ATLAS (Academic Time Leads to Achieving Students) Program has grown to more than 1,000 each of the last two years. To more effectively serve students and parents in transition, Kim Snell, ATLAS Liaison, would like to add a part-time (15 hrs./wk.) administrative assistant. The salary, which will not exceed $10,000, will be paid entirely by the McKinney-Vento sub-grant (Title X). Funds are available to cover this position, and this is an allowable expense for this grant. Motion made by Ms. Moore, seconded by Mr. Holladay, to approve the addition of a part-time administrative assistant position for the ATLAS program, to be paid by Title X funds. Vote: All Yes

14. STUDENT DISCIPLINE APPEAL The Board has been requested to review the September 11, 2015, decision of the Disciplinary Hearing Authority (DHA) to uphold the remandment of a student from Blackman Middle School to Smyrna West Alternative School. This review is pursuant to Board policy. The policy states that the Board shall review the record (report) and shall:

1. Affirm the decision of the DHA; or 2. Modify the decision to a lesser penalty; or 3. Grant a second hearing which would be before the Board; or 4. Deny a request for a Board hearing. Motion made by Mr. Young, seconded by Mr. Jordan, to affirm the decision of the DHA (Disciplinary Hearing Authority). Vote: All Yes

15. INSURANCE UPDATE

Mr. Sandvig gave a brief report on the Insurance Committee. He stated that a recommendation to approve Benefit Focus as our new on-line benefit management and enrollment system and to add their claims analytics system was forwarded to Budget.

16. GENERAL DISCUSSION BY BOARD MEMBERS

The Board requested that substitute teacher pay be discussed in the 2016 budget cycle. Mrs. Moore thanked the visitors who came to speak and those who came to listen. She said she has spent the past year reading the textbooks students are using and realizes the standards are set by the State. She stated that she feels the Board should respond and recognize these concerns. She thinks we should teach the standards but is concerned the teachers are using outside resources. She wants the Board to talk about what they can do to ensure that the curriculum is being taught in our Rutherford County system and staying with the standards but making sure that it is true and accurate history and not indoctrination. She expressed that it is our responsibility to help reassure our citizens, parents, and grandparents that we are doing what we can to be accountable to make sure that indoctrination does not happen in our classrooms.

Memorial services could be permitted for individuals who have particularly strong involvement with a school or the school system if approved, in advance, by the Director of Schools, so long as the deceased is not brought onto the school facility. Motion to approve the proposed revisions made by Mr. Terry Hodge, seconded by Mr. Aaron Holladay. VOTE: All yes The committee discussed the adoption of Policy 5.118 – Background Investigations. Adoption of the proposed policy is recommended by the Tennessee School Board Association. Federal and state laws require districts to have policies and/or procedures that address use, dissemination, retention, security, storage, disposal, chain of custody and misuse of criminal history record checks. The committee discussed the adoption of a proposed administrative procedure regarding state and district mandated assessments. The procedure will clarify that Tennessee requires participation in assessments for accountability purposes. There is no provision in the law authorizing parents and/or students to opt out of mandated assessments. Therefore, school districts are not authorized to adopt policies and/or procedures allowing such. The legal requirements for participation in assessments apply to all mandated assessments including those required to be completed via an internet based computer program. Administrative Procedures are approved by the Director of Schools so there was no committee action taken. 35 Hour – Title I Funded – Extended Contract at LaVergne Lake Elementary School Pamela Egner Pierce will complete one extended contract:

1) Ms. Pierce will be conducting the “Little Hawk Leaning Lab” which will utilize the research based intervention tool, Imagine Learning. This individualized, intervention program will target our struggling learners who fall into the categories of SWD and ELL population as identified on the 2015 TCAP assessment, aimsweb universal screener, along with additional assessment tools used by classroom teachers such as Common Formative Assessments. This program will provide these students with strategies to improve reading fluency and comprehension by targeting areas such as letter naming fluency, phonemic awareness, phonics, vocabulary, and comprehension in an effort to increase proficiency on state assessments, close identified learning gaps, and move towards becoming college and career ready.

2) Dates of the extended contract are tentatively: October 27, 2015 – February 9, 2016 Tuesday, Wednesday, Thursday One hour per day 2:45 – 3:45 P.M.

The cost is $600.00 for the 35 hour extended contract. The LaVergne Lake Elementary School Title I funds will pay for 100% of the cost for this contract. Approve a 35 hour extended contract with Pamela Egner Pierce and Rutherford County Schools for the “Little Hawk Learning Lab”.

Title I Contract with Appelbaum Training Institute Appelbaum Training Institute will provide a full day workshop, How to Handle the Hard to Handle Student, January 5, 2016 at Stewartsboro Elementary School. The faculty of Stewartsboro will be given classroom management strategies to handle challenging behaviors which will lead to increased academic achievement. Contract Details: January 5, 2016 – Full day – 5 hours Total Contract Fees: $4,700.00 (Fee includes consultant fee, travel, and training materials.) Approve Title I administration staff development funds to pay the one day training for the faculty at Stewartsboro Elementary School on classroom management and difficult behaviors.

Title II Contract with Blackburn Consulting Group, Dr. Abbigail Armstrong Dr. Abbigail Armstrong will provide one day of professional development on January 5, 2016 for the faculties of Cedar Grove Elementary, Smyrna Elementary, Walter Hill and Kittrell Elementary schools. January 5, 2015 is a Rutherford County in service day for teachers. The professional development will provide information and strategies on increasing rigor in Tier 1 academic instruction. Payment for this training will be provided with Title II funds and will not exceed $4,600.00 for the one day of training and includes all travel related expenses. Payment will be payable upon receipt of an invoice at the conclusion of training. Approve contract with Blackburn Consulting Group for $4,600.00 for Dr. Abbigail Armstrong to provide one day of professional development for the faculties of Cedar Grove, Smyrna Elementary, Walter Hill and Kittrell Elementary schools on January 5, 2015. All expenses will be paid with Title II funds.

Payment will be payable upon receipt of an invoice at the conclusion of training. Approve contract with Blackburn Consulting Group for $7,425.00 for Dr. Barbara Blackburn to provide one day of training for the faculties of Rockvale Elementary School and Stewarts Creek Elementary School on January 5, 2016. All expenses will be paid using Title II funds.

Title II Contracts for Hands on Science Trainers Nine Rutherford County teachers will lead Hands-on Science (HOS) kit training with Rutherford County Elementary teachers in September 2015 and January/February 2016:

When not in use for school purposes, school buildings and grounds or portions thereof may be used for 1 

public, governmental, charitable, civic, recreational, cultural, and other purposes as approved by the 2 

Board.1,2 3 

1. Requests for the use of a school's facilities shall be made at the office of the principal; 4 

2. Student clubs and activities, parent-teacher associations, and other organizations affiliated with 5 

the schools shall be permitted use of school facilities without charge; 6 

3. School facilities may not be used for private profit, except that unused facilities may be leased 7 

for private day-care centers which provide educational and child care services to the 8 

community;3 9 

4. All activities must be under adult supervision and approved by the building principal. If 10 

deemed necessary, the principal may assign a school employee to be present. The group using 11 

the facilities will be responsible for any damage to the building or equipment; 12 

5. Groups receiving permission for building use are restricted to the dates and hours approved and 13 

to the building area and facilities indicated, unless requested changes are approved by the 14 

principal; 15 

6. Groups receiving permission for building use are responsible for the observance of all fi re and 16 

safety regulations at all times; 17 

7. The use of alcoholic beverages, drugs or tobacco, profane language, or gambling in any form is 18 

not permitted in school buildings; 19 

8. During emergencies or disasters, the Board will cooperate with recognized agencies, such as 20 

the Red Cross, National Guard and Civil Defense to make suitable facilities available without 21 

charge; 22 

9. When school kitchens are used, at least one member of the cafeteria staff must be present to 23 

supervise the use of equipment; 24 

10. The Board will approve and periodically review a fee schedule for the use of school facilities 25 

by community or civic organizations and other non-profit groups. 26 

11. School facilities shall not be used by such community, civic, religious groups, etc. on a 27 

permanent basis; 28 

A. A period of three months may be allowed upon request and may be renewed at the 29 

discretion of the Board. 30 

B. The group must have an established organization within the community. 31 

C. The regular school custodian must be employed to perform custodian services and be paid 32 

directly by the group using the school. 33 

D. Classroom use is not recommended, but if a classroom is used, it must be put in order 34 

before the group leaves or prior to the next scheduled use by the school. 35 

E. Any school equipment to be used must be specified and approved by the principal prior to 36 

its use. The principal shall satisfy himself that the person to use the equipment shall be paid 37

12. All use of facilities requests for non-school related activities must be accompanied by a 1 

certificate of insurance showing the Board of Education as additional insured with a minimum 2

13. School facilities belonging to the Rutherford County Board of Education shall not be used for 5

To ensure the safety and welfare of students and staff, the district shall require criminal history 1 

background checks and fingerprinting of applicants for teaching positions and any other positions that 2 

require proximity to children. 3 

USE AND DISSEMINATION 4 

Fingerprints or other approved forms of positive identification shall be submitted with all requests for 5 

criminal history record checks for non-criminal justice purposes.3 The director of schools shall ensure 6 

the Originating Agency Identifier number is on file at all times. 7 

Tennessee and FBI Criminal History Record Information (CHRI) obtained by the district shall be 8 

solely used to verify criminal violation(s) and shall not be disseminated. Results shall be considered 9 

confidential and only accessible to district personnel identified by the director of schools. CHRI shall 10 

only be accessed by authorized personnel in the performance of their duties and shall never be released 11 

to the public. 12 

RETENTION AND SECURITY 13 

The Director of Schools shall develop procedures to ensure CHRI is stored in a secure location. Areas 14 

in which CHRI is processed and handled shall be restricted to authorized personnel identified by the 15 

Director of Schools. The area shall be out of the view of the public and unauthorized personnel. The 16 

Director of Schools shall maintain a list of all employees who have access to, can process, disseminate, 17 

and/or destroy CHRI. 18 

DISPOSAL OF CHRI 19 

When CHRI is no longer needed, it shall be destroyed by burning, shredding or other method rendering 20 

the information unreadable. Record destruction must be conducted under the supervision of the 21 

director of schools. 22 

MISUSE 23 

Employees who misuse CHRI or violate this policy shall be subject to disciplinary action up to and 24 

including termination. Any employee with knowledge of misuse shall immediately report a violation to 25 

the director of schools. 26
