Friday, March 13, 2020 7:30 a.m. CALL TO ORDER Adrienne Konigar-Macklin, Board President, called the meeting to order at 7:36 a.m. MEMBERS PRESENT Adrienne Konigar-Macklin, President; Andrew S. Moore, Attorney, Mundell, Odlum & Haws, LLP 1 OPENING BUSINESS Information: 1.01 Pledge of Allegiance The Pledge of Allegiance was led by Mr. Moore. Information: 1.02 Superintendent's Comments: Mr. Martinez thanked the Board members for getting together so quickly. He said we have been working the issue of COVID-19 for the last couple of weeks. He brought everyone here today to ensure any decisions and actions that we take as an organization can be done quickly and not waiting until the 15th of April to make decisions that need to be made clearly on an hourly basis. If we need to make decisions in the next 72 hours we will not have to keep bringing you back every day for an approval. This will allow us authority to look at any services that support students, to keep our classrooms clean and safe. That might mean hiring or bringing in more subs for custodians so we can really clean surfaces to make sure our kids and staff are in a safe environment. It also could mean bringing in an outside resource. We have been working closely with Mariana (Orozco) so she understands what this is about. It will also allow us authority, if we must close a school once LACOE and Department of Public Health gives us the direction to do so. We want to make sure we can make that call by first calling my Board president, and as Education Code indicates, we can close a school, multiple schools, or the entire district.

Los Angeles Unified School District is dealing with making the decision this morning as to if they are going to close their entire system. This action to the Board is declaring that emergency conditions exist here in this district and other sites, and provides authorization for me to take any and all actions necessary to respond effectively to Coronavirus COVID-19. People are counting on principals, directors and governance to be the lead, and to maintain calm. He said he keeps on reminding folks this flu has been kind to youth, and that is a good piece that we don’t have to worry too much about. He said he will be in contact with the Board members as we make decisions. He said we are creating a running list of everything we are doing so they will be aware of what we spending and where we are going outside of the boundaries. He thanked them all for their confidence in him.

IN RECOGNITION OF TEACHER APPRECIATION WEEK, NATIONAL TEACHER’S DAY AND CALIFORNIA'S DAY OF THE TEACHER

WHEREAS, Teacher Appreciation Week, National Teacher's Day, and California's Day

of the Teacher gives an opportunity for members of the teaching staff to be recognized for all their dedication and hard work; and

WHEREAS, Teacher Appreciation Week is the first full week of May (May 3 - May 9, 2020); and

WHEREAS, National Teacher’s Day is May 5, 2020; and

WHEREAS, California's Day of the Teacher is May 13, 2020; and

WHEREAS, education is the most vital activity we as a society undertake to ensure the well-being of the nation; and

IN RECOGNITION OF ADMINISTRATIVE PROFESSIONAL’S WEEK AND ADMINISTRATIVE PROFESSIONAL’S DAY

WHEREAS, Administrative Professional’s Week and Administrative Professional’s Day

gives an opportunity for members of the Administrative Support staff to be recognized for all their dedication and hard work; and

WHEREAS, Administrative Professional’s Week is the last full week of April (April

19 - 25, 2020); and WHEREAS, Administrative Professional’s Day is April 22, 2020; and WHEREAS, this occasion is observed globally as a way to show appreciation and support

PROCLAMATION BY THE BOARD OF EDUCATION OF THE POMONA UNIFIED SCHOOL DISTRICT

IN RECOGNITION OF HOLOCAUST REMEMBRANCE DAY APRIL 21, 2020

WHEREAS, the Holocaust was a state-sponsored atrocity in Nazi Germany that

systematically persecuted and attempted to annihilate 6 million people between 1933 and 1945; and

WHEREAS, this persecution targeted people across Europe, including Jews, Poles,

Gypsies, people with disabilities, homosexuals, Jehovah Witnesses, Soviet prisoners of war, and political dissidents; and

WHEREAS, this tragedy reminds us of the importance of the moral responsibilities

incumbent upon citizens within a free society; and WHEREAS, this date should always be remembered so that we can remain ever

vigilant against hatred, persecution, and tyranny in the future; and WHEREAS, it is important that both citizens and the children who will be our future

citizens, actively dedicate themselves to the principals of individual freedom in a just society;

NOW THEREFORE BE IT HEREBY RESOLVED that the Pomona Unified School

District proclaims April 21, 2020 as “Holocaust Remembrance Day” in memory of the victims of the Holocaust and in honor of its survivors, rescuers and liberators, and furthermore encourages youth to learn from the lessons of the Holocaust, act against discrimination, and defend democratic values.

PROCLAMATION BY THE BOARD OF EDUCATION OF THE POMONA UNIFIED SCHOOL DISTRICT

IN RECOGNITION OF NATIONAL MENTAL HEALTH MONTH MAY 2020

WHEREAS, “National Mental Health Month” is part of a nationwide effort in the month

of May to reduce the stigma and discrimination surrounding mental health challenges and increase awareness of tools and resources to prevent mental health challenges and reduce the symptoms; and

WHEREAS, by passing the Mental Health Services Act of 2004 (Proposition 63), voters

dedicated resources to keep individuals healthy so they don’t reach the crisis point of our jails, hospitals, or homelessness; and

WHEREAS, through Prop. 63, California is undertaking a historic effort to reach

California’s underserved communities with new resources and strategies for improving mental wellness; and,

WHEREAS, Los Angeles County’s partnership in the California Mental Health Services

Authority has enabled 820,000 Californians to access crisis and early intervention services, trained 125,000 individuals in prevention strategies; and made systemic improvements with a long- term impact such as changing school administrator credentialing standards to include mental health training and to adopt new guidelines for reporting on mental health and illness by journalists; and

WHEREAS, California’s mental health system now empowers people living with mental

health challenges and their families to break down stigma and reduce discrimination associated with mental illness; and

WHEREAS, growing energy around improving our state’s mental wellness has

generated “Each Mind Matters: California’s Mental Health Movement;” and WHEREAS, Each Mind Matters is a call to action embraced by thousands of

individuals and organizations working together to eliminate stigma and increase awareness of opportunities to live mentally well; and

WHEREAS, every Californian can participate in this movement by wearing lime green

– the color of California’s Mental Health Movement – and by taking the pledge to end stigma and discrimination against people with mental health challenges at eachmindmatters.org; and

NOW, THEREFORE, BE IT RESOLVED, that the Pomona Unified School District

proclaims the month of May as National Mental Health Month and calls upon the students, families, administrators, teachers, and staff to join the pledge to end mental health stigma and be informed of resources to improve their mental wellness.

TO ORDER BIENNIAL GOVERNING BOARD ELECTION

Order of Election for the Pomona Unified School District of Los Angeles County, California

RESOLUTION ORDERING GOVERNING BOARD MEMBER ELECTION RESOLVED that pursuant to Education Code (EC) §§5000-5030, the Los Angeles County Superintendent of Schools (County Superintendent) is hereby ORDERED to call an election for the purpose, and in accordance with the designations contained in the following specifications of the Election Order made under the authority of EC §5302, §5304, and §5322.

SPECIFICATIONS OF THE ELECTION ORDER The election shall be held on Tuesday, November 3, 2020. The polling hours shall be from 7:00 a.m. to 8:00 p.m. on multiple days at the Voting Centers leading up to Election Day. The purpose of the election is to submit to the voters of the district the question of whether two members shall be elected to the Governing Board of the Pomona Unified School District. The Los Angeles County Registrar-Recorder/County Clerk (Registrar-Recorder) will perform all the duties incident to the preparation for and holding of the above-mentioned election. The Pomona Unified School District will pay the costs of the election. If any agency holds an election on November 3, 2020, the Pomona Unified School District shall pay its pro rata share pertaining to the conduct of this election and shall be under the provisions of the appropriate sections of the Education and Election Codes. IT IS FURTHER ORDERED that the Clerk of the district is hereby directed to furnish two copies of this order to the County Superintendent not less than 130 days prior to the date set for the election. The foregoing Resolution and Order was adopted and affirmed by the Governing Board of Pomona Unified School District of Los Angeles County, being the Board authorized by law to make the designations contained therein, by formal vote as follows:

POMONA UNIFIED SCHOOL DISTRICT

RESOLUTION NO. 24 (2019-2020) ELIMINATION AND/OR REDUCTION OF CLASSIFIED

WHEREAS, Education Code section 45117 provides that classified employees shall be

subject to layoff for lack of work or lack of funds; and

WHEREAS, Education Code section 45117 provides that classified employees subject to layoff shall be given notice of layoff not less than sixty (60) days prior to the effective date of layoff and be informed of their displacement rights, if any, and reemployment rights; and

NOW, THEREFORE, BE IT RESOLVED that the Governing Board of the Pomona Unified School District hereby determines that positions in the classified service shall be eliminated and/or reduced for lack of work and/or lack of funds, as follows:

Eliminations and or Reduction of Classified Employee Services

Classification FTE 1.1 Community School Coordinator 2.0 1.2 Family Service Case Worker Specialist I 2.0 1.3 Instructional Aide – Child Development 3.0 1.4 Secretary II 2.0 Total Eliminations: 9.0 FTE

BE IT FURTHER RESOLVED by the Governing Board of the Pomona Unified School District, as follows:

1. That the Superintendent is directed and authorized to give notice of layoff/reduction

in hours and displacement rights, if any, to the affected Classified Personnel of the District in accordance with the requirements of law; and

2. That said layoff shall become effective on June 30, 2020; and

3. That classified employees laid off pursuant to this Resolution shall be eligible for

reemployment pursuant to Education Code section 45298.

PASSED AND ADOPTED by the Board of Education of Pomona Unified School District on this 22nd day of April, 2020.
