Falls through a wide variety of media outlets throughout the year, as you can see this is only a portion of marketing

and advertising for the Little Falls Area.

1. CALL TO ORDERThe special work session City Council meeting of the City of Little Falls was called to order

by City Administrator Radermacher on January 2, 2018, at 7:00 p.m. in the Council Chambers at City Hall. Councilmembers Hircock, Gosiak, Lundberg, Hanfler, Liljegren, Knafla, Hanson, and Mayor Zylka were present. It was determined there was a quorum.

2. PUBLIC FORUMa. Robin Hensel, 807 Southeast First Street, reviewed: 1] discrimination; 2] invocations

are unconstitutional; and 3] that the City Council should listen and engage in discussions.

3. BILLS DISCUSSIONNo discussion.

4. CONSENT AGENDA ITEMS DISCUSSIONNo discussion.

5. COUNCIL INFORMATIONAL ONLY ITEMSa. Other

1. Local Option Sales Tax – City Administrator Radermacher reviewed the localoption sales tax; possible question in General Election to include for a community center, recreation space, zoo improvements, conference center, etc. No action.

6. CONSTITUENT COMPLAINTSa. Councilmember Gosiak stated he received a complaint as to why the City does not have

a convention center.

REGULAR CITY COUNCIL MEETING ~ JANUARY 2, 2018

1. CALL TO ORDERThe regular City Council meeting of the City of Little Falls was called to order by City

Administrator Radermacher on Tuesday, January 2, 2018, at 7:31 p.m. in the Council Chambers at City Hall. Councilmembers Hircock, Gosiak, Lundberg, Hanfler, Liljegren, Knafla, Hanson, and Mayor Zylka were present. It was determined there was a quorum.

a. COUNCIL REORGANIZATION1. Election of Council President – City Administrator Radermacher called for

nominations for Council President for 2018. Councilmember Gosiak nominated Councilmember Hanfler. There being no further nominations, motion was made Councilmember Gosiak, seconded by Councilmember Hanson to cast a unanimous ballot for Councilmember Hanfler as Council President for 2018. Ayes: Hircock, Gosiak, Lundberg, Zylka, Hanfler, Liljegren, Knafla, and Hanson. Nays: none. Motion carried.

City Administrator Radermacher turned the meeting over to Council President Hanfler at 7:33 p.m.

2. Election of Council Vice President – Council President Hanfler called fornominations for Council Vice President for 2018. Councilmember Hanson nominated Councilmember Hircock. There being no further nominations, motion was made by Councilmember Hanson, seconded by Councilmember Liljegren to cast a unanimous ballot for Councilmember Hircock as Council Vice President for 2018. Ayes: Hircock, Gosiak, Lundberg, Zylka, Hanfler, Liljegren, Knafla, and Hanson. Nays: none. Motion carried.

2. APPROVAL OF AGENDAMotion was made by Councilmember Lundberg, seconded by Mayor Zylka to approve the

agenda of January 2, 2018, as presented. Ayes: Hircock, Gosiak, Lundberg, Zylka, Hanfler, Liljegren, Knafla, and Hanson. Nays: none. Motion carried.

3. APPROVAL OF MINUTESMotion was made by Councilmember Knafla, seconded by Councilmember Hircock to approve

the City Council minutes of the special work session of December 18, 2017; and the regular meeting of December 18, 2017, as presented. Ayes: Hircock, Gosiak, Zylka, Hanfler, Liljegren, Knafla, and Hanson. Nays: none. Abstention: Lundberg. Motion carried.

4. APPROVAL OF BILLSMotion was made by Councilmember Hircock, seconded by Councilmember Liljegren to

approve the bills totaling $287,405.65 for check numbers 97731 through 97787. Ayes: Hircock, Gosiak, Lundberg, Zylka, Hanfler, Liljegren, Knafla, and Hanson. Nays: none. Motion carried.

5. AWARDS, DONATIONS, PRESENTATIONS, AND PROCLAMATIONS

6. CONSENT AGENDAMotion was made by Mayor Zylka, and seconded by Councilmember Hanson to take the

following action on Consent Agenda items a. through d.:

a. Approved to the Minnesota Charitable Gambling Control Board, an Application for ExemptPermit as requested by Horizon Health, Inc., to allow bingo at the VFW Post 1112, 1210 Northeast Third Avenue, on April 13, 2018, and further waived any waiting period; and

b. Received and placed on Building Report for November 2016; and

c. Received and placed on file the Economic Development Authority minutes of October andNovember 2017; and

7. PUBLIC HEARINGS AND LETTINGS a. Lettings 1. Trimble S7 Robotic Total Station, Frontier Precision – Motion was made by Councilmember Hircock, seconded by Councilmember Knafla to authorize the purchase, off the state bid, of a Trimble S7 Robotic Total Station, from Frontier Precision, Inc., St. Cloud, in the amount of $25,235.72, for the Engineering Department, to be charged to the Equipment Fund. Ayes: Hircock, Gosiak, Lundberg, Zylka, Hanfler, Liljegren, Knafla, and Hanson. Nays: none. Motion carried.

8. OLD BUSINESS a. Ordinance No. 5, Seventh Series, Amend City Code Chapters 7 and 11 [Introduced 12/18/17] – Mayor Zylka moved for the adoption of Ordinance No. 5, Seventh Series, an Ordinance Amending City Code Chapter 5, entitled “Streets and Sidewalks”, and Chapter 11, entitled “Land Use Regulations, Zoning”, by addressing errors or conflicting language indicated during the codification review and to replace existing regulations regarding development and land use within floodplain areas with updated language consistent with State law. Councilmember Liljegren seconded the motion for adoption. On a roll call vote; Ayes: Hircock, Gosiak, Lundberg, Zylka, Hanfler, Liljegren, Knafla, and Hanson. Nays: none. Council President Hanfler then declared said Ordinance No. 5 to have received the unanimous vote of the entire City Council and the same to have been duly passed, approved and adopted.

b. Ordinance No. 5A, Seventh Series, Authorize Summary Publication of Ordinance No. 5, Seventh Series [Introduced 12/18/17] – Councilmember Knafla introduced and moved for the adoption of Ordinance No. 5A, Seventh Series, an Ordinance Authorizing the Summary Publication of Ordinance No. 5, Seventh Series, to Reflect the Updates to Minnesota Statutes 237 Regarding “Small Wireless Facilities, and correcting missing language and amend City Code, Chapter 11, adding requirements for conditional use permits, establishing rules, regulations, penalties and processes for conditional uses and variances. Councilmember Hanson seconded the motion for adoption. On a roll call vote; Ayes: Gosiak, Lundberg, Zylka, Hanfler, Liljegren, Knafla, Hanson, and Hircock. Nays: none. Council President Hanfler then declared said Ordinance No. 5A to have received the unanimous vote of the entire City Council and the same to have been duly passed, approved and adopted.

9. NEW BUSINESS a. Resolution 2018-01, Official Newspaper – Mayor Zylka introduced and moved for the adoption of Resolution 2018-01, a Resolution Designating the Morrison County Record the Official Newspaper of the City of Little Falls for 2018. Councilmember Lundberg seconded the motion for adoption. On a roll call vote; Ayes: Lundberg, Zylka, Hanfler, Liljegren, Knafla, Hanson, Hircock, and Gosiak. Nays: none. Council President Hanfler then declared said Resolution 2018-01 to have received the unanimous vote of the entire City Council and the same to have been duly passed, approved and adopted.

b. Resolution 2018-02, Official Depositories – Councilmember Hircock introduced and moved for the adoption of Resolution 2018-02, a Resolution Designating the Official Depositories of City Funds. Councilmember Lundberg seconded the motion for adoption. On a roll call vote; Ayes: Zylka, Hanfler, Liljegren, Knafla, Hanson, Hircock, Gosiak, and Lundberg. Nays: none. Council President Hanfler then declared said Resolution 2018-02 to have received the unanimous vote of the entire City Council and the same to have been duly passed, approved and adopted.

Councilmember Hircock seconded the motion for adoption. On a roll call vote; Ayes: Hanfler, Liljegren, Knafla, Hanson, Hircock, Gosiak, Lundberg, and Zylka. Nays: none. Council President Hanfler then declared said Resolution 2018-03 to have received the unanimous vote of the entire City Council and the same to have been duly passed, approved and adopted.

d. Agreement, Economic Development Authority and Wabash National, L.P. – Motion was made by Councilmember Hanson, seconded by Councilmember Hircock to approve the Grant Agreement by and between the Economic Development Authority of the City of Little Falls and Wabash National, L.P. Ayes: Hircock, Gosiak, Lundberg, Zylka, Hanfler, Liljegren, Knafla, and Hanson. Nays: none. Motion carried.

Heritage Preservation Commission Meeting Minutes of January 8, 2018

1. Call to Order: Chairperson Don Opatz called the meeting to order at 12:01 p.m.

Members present: Gary Block, Wayne Liljegren Linda LeMieur, Don Opatz, Maxine Strege, and Camille Warzecha Member absent: Linda Burggraff

2. Approval of the Minutes: The minutes of December 12, 2017 Heritage Preservation Commission meeting were reviewed. Maxine Strege made a motion to approve the minutes as presented. Camille Warzecha seconded the motion. The motion was approved.

3. Financial Report: as of November 30, 2017: $50,468.00

4. Old Business: A. Downtown Design Guidelines: Wendy Zylka. No new information was available

5. New Business: A. 2018 Century Homes Applications: Don Opatz. Advertising options for notifying Little Falls residents of the opportunity to submit their homes for consideration for Century Home status was discussed. In 2017, an insert in the City water bill was used. Camille Warzecha made a motion requesting City Staff include this information in the next available water bill, preferably February is possible. Maxine Strege seconded the motion. The motion was approved. Wendy Zylka will check on availability.

B. Grant Applications for 2018: Don Opatz. Two ideas were discussed with the first being signage for the historic downtown during the highway 27 construction project scheduled for 2019. The second suggestion was for updating and reprinting the Historic Walking Tour brochure. Wendy Zylka will check on eligibility of these items.

C. Election of Officers and Committee Appointments: At the February meeting, the election of officers will be held. At this time, Wayne Liljegren, Camille Warzecha and Susy Prosapio are on the Mayor’s list to be asked to continue serving on the HPC.

6. Other Concerns from Commission Members: none

BACKGROUND: Staff has been notified that Walmart is changing their name by removing the hyphen from Wal-Mart. Since the State requires all name changes to reapply for liquor licenses, staff is requesting the City Council approve the request from Walmart Inc.

ACTION REQUEST: The City Council approve the Off Sale Liquor License as requested by Walmart Inc., dba Walmart #1634, 15091 Northeast Eighteenth Street, contingent upon the appropriate paperwork and insurance are received, and approval is granted by the Police Chief and the Minnesota Department of Public Safety, Alcohol and Gambling Enforcement Division.

RESOLUTION 2018-04

RESOLUTION ORDERING PUBLIC IMPROVEMENT 378 SURFACE AND/OR UTILITY IMPROVEMENTS, FIFTH STREET NORTHWEST

WHEREAS, the City Council of the City of Little Falls by Resolution duly adopted December 18, 2017, provided for a public hearing to be held on the 16th day of January, 2018, pursuant to Minnesota Statutes of 1953, Chapter 429, as amended, relative to Public Improvement 378, the general nature of which the improvements are as follows, to wit:

Complete grading, curb, gutter and bituminous surface, sanitary sewer main, sanitary sewer service lines, water service lines, storm sewer, and related appurtenances thereto on Fifth Street Northwest between Third and Fourth Avenues Northwest; and

WHEREAS, all property owners whose property is liable to be assessed for the making of these improvements were duly given published notice of the City Council’s hearing as provided by law through two weekly publications, a week apart, and the last publication having been made at least three (3) days prior to the City Council hearing, and mailing copies of said notice to the owners of each parcel proposed to be assessed as provided by law, and the hearing was held and property owners heard thereon on the 16th day of January, 2018.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Little Falls, that:

FIRST: The improvements hereinbefore described in the City Council’s Resolution adopted December 18, 2017, are hereby ordered as follows:

Complete grading, curb, gutter and bituminous surface, sanitary sewer main, sanitary sewer service lines, water service lines, storm sewer, and related appurtenances thereto on Fifth Street Northwest between Third and Fourth Avenues Northwest; and

SECOND: Such improvements are necessary, cost-effective, and feasible as detailed in the feasibility report; and

THIRD: Such improvements are in compliance with the comprehensive plan; and

FOURTH: Such improvements are hereby ordered as proposed in the City Council’s Resolution adopted December 18, 2017; and

FIFTH: The final plans and specifications will be prepared by City engineering staff and/or a certified professional engineer, and submitted to the City Council for final approval; and

SIXTH: Said project may be combined with others for the purposes of bidding and project construction to completion, and for bonding purposes; and

SEVENTH: The project will be bid on or before August 1, 2018; and

EIGHTH: Said improvements will be completed, assessments levied, and improvement bonds issued to finance the cost thereof pursuant to Minnesota Statutes of 1953, Chapter 429, as amended.

Dear Mayor Zylka and City Council,

We write to share our disfavor with the potential road/surface “improvement” project on 8th

Street. We use quotations in the word improvement because there is a vast difference of opinion

on what exactly an improvement denotes. Having witnessed the laying to waste of 7th Street SE,

a project done last summer, we’re concerned that there is no concern for the beauty of the street,

only the ugly “improvement” that will occur. What does NOT improve are the elements of what

makes a street attractive to live on, and thus, “improved”.

Having witnessed on times too numerous to count, the absolute butchering of trees, disregard for

any kind of visual interest, and lack of any inclusive thought that might protect the current

surrounding beauty of the street is a mighty high concern. One only needs to look at 7th Street to

see that a canopy is nonexistent, and the “improvement” came at a high visual and monetary

price.

We wholly agree that a city must be one where economics are in balance, money is allocated

well, and streets are safe. But we put before you that people choose to live in cities for reasons

beyond that—for the beauty that a city presents—its tree lined streets and overall landscape. If

this were not the case, we would all live on the pavement, which we do not.

Unless there is some regard made to how the finished street will look, a REAL conversation with

property owners about how the City intends to work with those of us who have taken time to

plant boulevard trees and landscaping, we are not in favor of this project.

RESOLUTION 2018-07

RESOLUTION ORDERING PUBLIC IMPROVEMENT 378 SURFACE AND/OR UTILITY IMPROVEMENTS, EDGEWOOD ROAD

WHEREAS, the City Council of the City of Little Falls by Resolution duly adopted December 18, 2017, provided for a public hearing to be held on the 16th day of January, 2018, pursuant to Minnesota Statutes of 1953, Chapter 429, as amended, relative to Public Improvement 378, the general nature of which the improvements are as follows, to wit:

Complete grading, bituminous surface, sanitary sewer main, sanitary sewer services, watermain, water service lines, and related appurtenances thereto on Edgewood Road between Riverwood and a point approximately 1,000 feet easterly of Riverwood; and

WHEREAS, all property owners whose property is liable to be assessed for the making of these improvements were duly given published notice of the City Council’s hearing as provided by law through two weekly publications, a week apart, and the last publication having been made at least three (3) days prior to the City Council hearing, and mailing copies of said notice to the owners of each parcel proposed to be assessed as provided by law, and the hearing was held and property owners heard thereon on the 16th day of January, 2018.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Little Falls, that:

FIRST: The improvements hereinbefore described in the City Council’s Resolution adopted December 18, 2017, are hereby ordered as follows:

Complete grading, bituminous surface, sanitary sewer main, sanitary sewer services, watermain, water service lines, and related appurtenances thereto on Edgewood Road between Riverwood and a point approximately 1,000 feet easterly of Riverwood; and

SECOND: Such improvements are necessary, cost-effective, and feasible as detailed in the feasibility report; and

THIRD: Such improvements are in compliance with the comprehensive plan; and

FOURTH: Such improvements are hereby ordered as proposed in the City Council’s Resolution adopted December 18, 2017; and

FIFTH: The final plans and specifications will be prepared by City engineering staff and/or a certified professional engineer, and submitted to the City Council for final approval; and

SIXTH: Said project may be combined with others for the purposes of bidding and project construction to completion, and for bonding purposes; and

SEVENTH: The project will be bid on or before August 1, 2018; and

EIGHTH: Said improvements will be completed, assessments levied, and improvement bonds issued to finance the cost thereof pursuant to Minnesota Statutes of 1953, Chapter 429, as amended.

RESOLUTION 2018-08

RESOLUTION ORDERING PUBLIC IMPROVEMENT 378 SURFACE AND/OR UTILITY IMPROVEMENTS, FRONT AND WOOD STREETS

WHEREAS, the City Council of the City of Little Falls by Resolution duly adopted December 18, 2017, provided for a public hearing to be held on the 16th day of January, 2018, pursuant to Minnesota Statutes of 1953, Chapter 429, as amended, relative to Public Improvement 378, the general nature of which the improvements are as follows, to wit:

Complete grading, bituminous surfacing, sanitary sewer mains, sanitary sewer service lines, watermains, water service lines, storm sewer, and related appurtenances thereto on Front Street between Trunk Highway 27 [Broadway] and Wood Street; and on Wood Street between First Avenue South and approximately 200 feet northerly of First Avenue South; and

WHEREAS, all property owners whose property is liable to be assessed for the making of these improvements were duly given published notice of the City Council’s hearing as provided by law through two weekly publications, a week apart, and the last publication having been made at least three (3) days prior to the City Council hearing, and mailing copies of said notice to the owners of each parcel proposed to be assessed as provided by law, and the hearing was held and property owners heard thereon on the 16th day of January, 2018.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Little Falls, that:

FIRST: The improvements hereinbefore described in the City Council’s Resolution adopted December 18, 2017, are hereby ordered as follows:

Complete grading, bituminous surfacing, sanitary sewer mains, sanitary sewer service lines, watermains, water service lines, storm sewer, and related appurtenances thereto on Front Street between Trunk Highway 27 [Broadway] and Wood Street; and on Wood Street between First Avenue South and approximately 200 feet northerly of First Avenue South; and

SECOND: Such improvements are necessary, cost-effective, and feasible as detailed in the feasibility report; and

THIRD: Such improvements are in compliance with the comprehensive plan; and

FOURTH: Such improvements are hereby ordered as proposed in the City Council’s Resolution adopted December 18, 2017; and

FIFTH: The final plans and specifications will be prepared by City engineering staff and/or a certified professional engineer, and submitted to the City Council for final approval; and

SIXTH: Said project may be combined with others for the purposes of bidding and project construction to completion, and for bonding purposes; and

SEVENTH: The project will be bid on or before August 1, 2018; and

EIGHTH: Said improvements will be completed, assessments levied, and improvement bonds issued to finance the cost thereof pursuant to Minnesota Statutes of 1953, Chapter 429, as amended.

WHEREAS, the City Code of the City of Little Falls authorizes the City Council to establish fees for licenses and permits by resolution; and

WHEREAS, there will be no refund on any licenses and permits, except as allowed for building permits or as provided by Minnesota Statute.
