Request by Kolbrook Design, Inc. for a courtesy review for a Dunkin' Donuts/Baskin Robbins at the Huntington West Shopping Center on the north side of Algonquin Road, east of Huntington Boulevard

June 8, 2015

Planning, Building and Zoning

Peter Gugliotta r&-Request by Kolbrook Design, Inc. for a courtesy review for a Dunkin' Donuts/Baskin Robbins at the Huntington West Shopping Center on the north side of Algonquin Road, east of Huntington Boulevard.

Kolbrook Design, Inc. is proposing to construct a combination Dunkin' Donuts/Baskin Robbins freestanding 2,367 square foot building with a drive-thru in the front of this shopping center along Algonquin Road. The proposal would include a request for the Village to vacate 50' of the existing 70' wide permanent green space easement along Algonquin Road that was platted at the time the center was first built. The developer and shopping center owner have not yet stated whether a separate outlot would be platted or if it would remain as part of the center property with a ground lease.

In 2009, the Village approved construction of a drive-thru only canopy structure for a bank (currently PNC bank) immediately east

· of this subject area in this same shopping center. The retail bank space is located in one of the inline units of the shopping center with an underground connection via pneumatic tubes to the drive-thru lanes. The project originally proposed the full bank building within the setback area, however, in order to minimize Village concerns about the new bank outlot impacting parking lot circulation, elimination of a large portion of the open space easement, and blocking views of the inline tenants, the bank altered their proposal to only build the drive-thru canopy as an outbuilding.

The petitioner is seeking early input on the feasibility of constructing this building in the existing open space easement area, and on key elements of the site plan design, before investing resources in further plan development. The attached plans are only at a conceptual level and will require further refinement. In addition to the release of the green space easement, staff has identified the following key items that would need to be addressed:

NBl

Page 5: AGENDA Village of Hoffman Estates

Planning, Building and Zoning Conunittee -2- June 8, 2015

BACKGROUND: (Continued)

+ Parking study to verify the remaining parking lot can accommodate the existing retail space (assuming full occupancy) plus the new demand from this building.

+ Traffic distribution!drive-thru stacking/circulation analysis is needed support the proposed plan.

+ Building architecture will need to be upgraded to provide a more appropriate "4-sided" design for this outlot building, instead of the utilitarian design on the wall facing the customer parking lot.

+ Pedestrian connectivity and a reduction in conflicts needs to be further discussed since all customers would need to cross a main circulation drive to get to the building.

+ General site details need to be improved, such as driver visibility, handicapped parking design/location, trash enclosure location/design, etc.

+ Clarify if an outlot will be subdivided, and if so, provide a plat with the appropriate cross access, parking, and maintenance easements.

+ Signage needs further review since the amount shown conceptually is more than typically allowed.

If the petitioner decides to proceed with the formal process, the above items will need to be resolved as part of the plan review process.

The subject property is zoned B-1 (Business District) and this project would require site plan, subdivision, master sign plan, and possibly variation review by the Planning and Zoning Commission.

RECOMMENDATION:

Material is presented for courtesy review only.

Request by Vipul M. Lakhani d/b/a AlA Development Corporation (owner) for a site plan amendment to demolish the farmhouse and to construct a house on Lot 2 of the O'Malley Farm Subdivision at 940 Freeman Road

June 8, 2015

Peter Guglio£1j.;'osh EdwardsJAE

Request by Vipul M. Lakhani d/b/a AlA Development Corporation (owner) for a site plan amendment to demolish the farmhouse and to construct a house on Lot 2 of the O'Malley Farm Subdivision at 940 Freeman Road.

The subdivision and site plan for O'Malley Farm were originally approved in 2003. Over the following year, a new house was built on Lot 1 of the three lot subdivision. In 2007 and 2008, the original developer, New Haven Development, requested permission to demolish the farmhouse on Lot 2, which was denied. Since that time, the property went through foreclosure. The prior outstanding guarantees and deposits related to the former owner were resolved by the foreclosing bank. In January 2011, the financial obligations in terms of the Village subdivision approval, guarantees, and deposits for Lot 2 (the farmhouse) and Lot 3 (the then vacant lot) were split so that the lots could be sold separately to different purchasers. In 2012, Lot 3 was sold to Icon Building Group, which constructed a new home on that lot. In 2013, Lot 2 was sold to Residential Dynamics Group, LLC, and the Village Board approved a proposal to remodel and expand the house to make it habitable and marketable. However, the renovation costs exceeded the profit margin, and the homebuilder did not proceed with the project. In 2014, Residential Dynamics Group, LLC, listed the property back on the market for sale. In March 2015, the petitioner, Vipul M. Lakhani d/b/a AlA Development Corporation, purchased the property.

The original approval of the O'Malley Farm subdivision and the corresponding site plan approval for Lot 2 requires that the house be retained and renovated. The subsequent site plan amendment granted to Residential Dynamics Group, LLC complied with the original requirement to retain the house. However, the renovation costs include replacement of many of the house components which was found to be financially impractical.

Page 12: AGENDA Village of Hoffman Estates

Planning, Building and Zoning Conunittee -2- June 8, 2015

BACKGROUND: (Continued)

Since 2003, Village staff has pursued property maintenance violations with the various property owners, such as replacing broken windows, removing litter, and cutting the grass. Staff has also received numerous inquiries from neighbors regarding the degrading condition of the farmhouse and from prospective buyers regarding the Village requirements for the property.

DISCUSSION:

Vipul M. Lakhani d/b/a AIA Development Corporation (owner) is requesting a site plan amendment for authorization to demolish the farmhouse and to construct a market rate house, along with site improvements, including construction of a driveway and landscaping changes. The petitioner has submitted plans for an approximately 4,000 square foot (excluding the attached garage), two-story house with a face brick and stone exterior on all four elevations. If approved, construction of the house would complete the three lot subdivision.

Demolition Conditions of approval are included requiring that the demolition permit and building permit be obtained concurrently, as well as deadlines to complete the demolition and commence construction.

Engineering and Code Enforcement The Engineering Division has reviewed the proposed plans, and the grading plan is acceptable. Conditions related to the proposed grading will be included with the building permit.

A project guarantee for the demolition and construction (primarily for utility work and tree preservation) will be applied to the building permit. The existing water well and septic system would be removed and a private sanitary sewer line would be added.

Landscape Plan The landscape plan includes the addition of seven trees in the rear yard and one tree in the front yard. Two of the trees are required by the Subdivision Code for the development of any one family residential lot. Six of the trees are required by the Subdivision Code to mitigate the proposed removal of two mature trees in the location of the proposed driveway. The total mitigation for the removed trees is 21 shade trees, which is impractical for a single lot and, therefore, a fee of$6,000 will be required in lieu of planting the other 15 trees. The fee will be paid by the petitioner to be applied to the Village's tree fund.

During construction, tree protection fencing will be installed to protect the existing trees to be preserved. The proposed driveway is curved and includes a retaining wall to comply with the preservation requirements to protect an existing mature Black Walnut tree. Silt fencing will be installed to prevent construction runoff onto adjacent properties.

Architecture The proposed house would complement the new houses built on Lots 1 and 2 in terms of the house size, general architectural style, and building components. The house would comply with the floor area ratio allowed for this property. The building exterior would include face brick with areas of stone accents and a variety of window styles. The use of brick and stone on all elevations would exceed that of the adjacent houses and others in the neighborhood, which generally include siding on all elevations with brick accents on the front elevation. A covered porch with columns is proposed on the front elevation. A patio is proposed in the rear yard.

Planning, Building and Zoning Conunittee - 3 - June 8, 2015

RECOMMENDATION:

Approval of a request by Vipul M. Lakhani d/b/a AlA Development Corporation (owner) for a site plan amendment to demolish the farmhouse and to construct a house on Lot 2 of the O'Malley Farm Subdivision at 940 Freeman Road, with the following conditions:

1. A demolition permit and building permit shall be obtained concurrently and within 9 months of Village Board action on this request.

2. Demolition of the farmhouse shall commence within 14 days after issuance of a Village demolition permit. Demolition work shall be completed within a period not to exceed 48 hours. Construction of the new house shall proceed within 30 days after completion of the farmhouse demolition.

3. In order to minimize the disturbances to the surrounding residences, construction parking shall be generally limited to the front of Lot 2 for the house under construction. When on-street parking is necessary, it shall be limited to the north side of Freeman Road.

4. A performance guarantee deposit shall be submitted in the amount of $10,000 prior to issuance of the demolition permit and building permit.

5. There are no recapture or traffic impact fees required with this development. Payment of park and school donations shall occur in accordance with the Village Subdivision Code.

6. The following conditions relate to the tree protection and tree preservation for the property:

a. Prior to the issuance of the demolition permit and building permit, tree protection measures shall be completed and any additional tree protection procedures as specified by Development Services staff.

b. No work shall commence until the tree protection fencing has been installed.

c. For the purpose of tree preservation, site plan amendment approval is contingent upon the petitioner constructing the house as proposed, including the location shown on the plans, grading around the house, etc. Changes to the proposed plans that impact the trees beyond what is shown on the approved plans or that differ substantially in size or character, as determined by the Village from those shown in the approved plans, shall require a site plan amendment.

d. The petitioner shall submit $6,000 to the Village to mitigate the removal of two trees as shown on the petitioner's plans.

e. If existing preserved trees are damaged or removed during construction, beyond the two trees shown for removal, the petitioner shall plant additional mitigation trees. The number and size of replacement mitigation trees shall be consistent with Table 4: Replacement Trees Required for Mitigated (Removed) Trees in the Tree Preservation section of the Village code.

Page 14: AGENDA Village of Hoffman Estates

Planning, Building and Zoning Committee -4- June 8, 2015

RECOMMENDATION: (Continued)

f. Prior to the issuance of the certificate of occupancy, in accordance with the Village direction and, if deemed necessary, upon consideration of the recommendation of an urban forest professional, the trees and the finished lot condition shall be evaluated for items the petitioner must implement. This shall include crown pruning, fertilization, watering, and the location of the mulch, seed, or sod depending on the location of critical root zones. Where seed is applied, the ground condition shall be finely graded to provide positive drainage away from all trees in a manner that avoids damage to the trees.

g. At the time of final certificate of occupancy, the Village, and if deemed necessary in consultation with an urban forester, will assess the condition of the preserved trees. If, in the opinion of the Village additional maintenance is necessary, then the petitioner shall provide funds in an amount to be determined by the Village to maintain the trees for up to an additional three years, and to remove and mitigate them if requested by the homeowner if such trees are determined to be in decline by the Village.

Re: Proposal Summary for 940 Freeman Road Hoffman Estates IL

To the Village of Hoffman Estates Board:

We would like to kindly propose the demolition of the current structure located on 940 Freeman Road Hoffman Estates commonly known as the farmhouse. There have been 2 requests to renovate the farmhouse both of these requests did not moved forward after approval. According to our conversations with Joshua Edwards the assistant planner at the Village of Hoffman Estates the reason the renovations plans did not move forward is because the developer felt the costs would be too high and the returns would not justify the investment, the results were, the developer abandoned the project. It would be the same case for us. It does not make much economic sense for us to renovate the farmhouse because the risks versus the reward would not be in our favor or any other serious investors favor. Instead demolishing the farmhouse does make economic sense. Constructing the home that we have proposed (see drawings) would be somewhat similar to the other newer homes in the area and have somewhat of a farm house look (see our large arches and high roof structure on the drawings). I believe the home we have proposed would suite the neighborhood well and the people of Hoffman Estates who live in the neighborhood would welcome a newer all brick home. We would like to work with the Village Board of Hoffman Estates to resolve this long overdue issue. If anyone needs to contact me regarding this proposal or anything related to this property existing or proposed please feel free to contact me via phone at 847-529-5800 or email [email protected].

Thank You

COMMITTEE AGENDA ITEM VILLAGE OF HOFFMAN ESTATES

Request approval of a resolution amending the Economic Development Commission of the Village of Hoffman Estates

June 8, 2015

Planning, Building and Zoning

Kevin Kramer {{.t::,

Request approval of a resolution amending the Economic Development Commission of the Village of Hoffman Estates.

The Economic Development Commission (EDC) was formed by Resolution #673 in 1987 with all eight of the original duties specified for the Commission completed. Since then, two resolutions were passed to make minor modifications to the structure and charges of the EDC. The position of Economic Development Director at a staff level was created in 2003 and, therefore, one of the changes has to do with adding the Economic Development Director as an Ex-Officio member. The other resolution slightly changed the duties of the EDC in 2007. The Commission has met an average of 1.8 times per year for the past 7 years, with only I meeting each of the last three years. After again reviewing the duties of the EDC, staff noticed a diminished role for the EDC because the charged duties are in the job description of the Director of Economic Development. When the EDC was set up, there was neither a specific staff person devoted to economic development nor a Chamber of Commerce to support and help grow the small business community. Both of those things are in place now to enhance the economic welfare of Hoffman Estates, making the very duties of the EDC outdated.

With most of the current duties of the EDC encompassed in the job of Director of Economic Development, staff would propose amending the duties of the EDC to include the following:

I. Keep abreast of State and Federal legislative tools which may enhance economic development. This duty would charge the EDC to keep up with proposed and passed legislative changes which would affect the economy and economic development practices. The EDC would then report to the Director of Economic Development any changes that have been made or are pending.

NB3

Page 31: AGENDA Village of Hoffman Estates

Planning, Building and Zoning Committee -2- June 8, 2015

DISCUSSION: (Continued)

2. Organize a yearly broker/developer event. The Village hosted an event in 2011, whereby brokers and developers were invited to a free concert in a luxury box at the Sears Centre. The EDC could help to organize a yearly event where brokers, developers, and land owners are invited for a presentation on the state of the economy in town, along with highlighting some key additions and prime development sites. The guests could then stay for drinks, socializing, and an event that night. This would help promote the Village and build relationships with key players in the commercial development industry.

3. Receive and review a quarterly report from the Department of Economic Development. This will keep the EDC up-to-date on non-confidential items occurring in the Village while helping to hold the Department of Economic Development accountable for tasks and projects.

4. Coordinate and run the holiday shop local event. The EDC could promote Hoffman Estates businesses by coordinating and running the Shop Local program during the holiday season. They could also work with shopping center owners to host events which draw the consumer to their site and stores.

5. Support small business through an outreach program and hosting annual excellence awards. While reaching out to all companies in town is of great importance, it is not always possible for the Director of Economic Development to visit everyone. The Hoffman Estates Chamber of Commerce currently has various outreach programs, events, and even an awards dinner. Perhaps the EDC could host their own awards program for all businesses in town, not just those who are members of the Chamber.

6. Work with the Hoffman Estates Chamber of Commerce to support small businesses. The EDC could elect a liaison to the Chamber, or several liaisons, to interact at Chamber functions, inform both groups of what the other is doing, and help to work together to promote and grow businesses in Hoffman Estates.

RECOMMENDATION:

Request approve a resolution amending the Economic Development Commission of the Village of Hoffman Estates.

COMMITTEE AGENDA ITEM VILLAGE OF HOFFMAN ESTATES

Request au extension of the date set forth in Section 302 of the Redevelopment Agreement with Ala Carte Entertainment, LP to October 1, 2015

June 8, 2015

Planning, Building and Zoning

Mark Koplin/Kevin Kramer

Request an extension of the date set forth in Section 302 of the Redevelopment Agreement with Ala Carte Entertainment, LP to October 1, 2015.

In 2014, Ala Carte Entertainment approached the Village with plans to purchase, redevelop, and reopen the two vacant restaurants in the Barrington/Higgins TIF. Because the sale price was above market value, Ala Carte inquired about incentives to help with the real estate costs. Therefore, in May 2014, the Village Board approved an inducement resolution authorizing up to $4.7 million of potential TIF expenditures to be reimbursed only if the Village Board amends the TIF Plan and Project (Resolution 1565, May 5, 2014). Later in May and June of 2014, Ala Carte Entertainment purchased both vacant properties, and in July 2014, the Village Board approved redevelopment site plans for both locations to be opened as a Moretti's Pizzaria and Whiskey River BBQ.

The Village approved a Redevelopment Agreement for the Barrington/Higgins Redevelopment Project Area and TIF Note with Ala Carte Entertainment in November 2014, in the amount of $550,000. Within the Agreement, Section 302 addressed construction completion and states, "The Developer shall proceed with commercially reasonable diligence to complete construction of the Project on or before April!, 2015". The project was defined as a complete renovation and operation of restaurants in both buildings. The Moretti's opened in the former Max & Erma's space in March 2015 (prior to the deadline), but the BBQ restaurant, originally named Whiskey River BBQ, remains under construction. The owner continues to work diligently on the project, but since the original vision for the project has changed, it is not finished. Based upon the success of Moretti's in Hoffman Estates, the owners are expanding their ideas for the BBQ restaurant to include not only a name change, but an expansion upon the former Lone Star building to create more dining space. Thus the project is not complete by the date set in the Agreement. The owner requests a six month extension to complete the project.

Approve a request for a six month extension of the date set forth in Section 302 of the Redevelopment Agreement, attached to ordinance 4456, with Ala Carte Entertainment, LP to October 1, 2015, based upon the owner's diligence to provide a quality restaurant to serve the community.

Risk Food 34%

Food establishments are divided into the risk categories of high, moderate or low, and planned inspections are performed three, two, or one time each year respectively. A high risk establishment presents a high relative risk of causing food borne illness based on the large number of food handling operations typically implicated in food borne outbreaks and/or the type of population served by the facility. There are approximately 265 facilities that require a total of approximately 470 planned inspections throughout the year (this number fluctuates based on businesses opening/closing).

During 2014, the State of Illinois began implementing a new Food Handler Permit rule that requires every food establishment employee to pass a basic online test relative to their job tasks, as opposed to the previous rule where just one on-site manager must be trained. As part of this new rule, the Village Health Officer has the added responsibility of spot checking employees on basic requirements such as hot or cold temperatures, hand washing practices, and other basic sanitation provisions. There has also been an increase in the number of establishments requesting educational information from the Health Officer due to these new State regulations.

Tourism DIRTY GIRL - SEARS CENTRE ARENA - JUNE

27,2015

• The success of hosting the BadAss Dash drew another obstacle type SK to SCA. Dirty Girl is a ladies only obstacle event that benefits BRIGHT PINK (Breast Cancer initiative) previously held at Lake County Fairgrounds drawing about 3,000 participants. Extensive work with event organizers to secure route and property usage permissions. Connecting event to local synergistic businesses. BadAss Dash was held May 2, with no incident and a great crowd (approximately 2,000 registered participants). MS Walk was held May 3, drawing 3,000+ participants and volunteers. Conant High School Drumline led the MS walkers through Prairie Stone, which was hosted by Cabela's. After BadAss Dash and MS walk, participants could be seen at Stone Eagle, Saddle Room, Rookies, Buffalo Wild Wings, and Red Robin, as well as sandwich shops and Panda Express. Due to expansive development next year within Prairie Stone, we are assisting BadAss Dash and Dirty Girl to find an alternative location within our Village for 2016.

Tourism (Cont.) FITNESS FOR AMERICA- JULY 25/26, 2015- AT&T CAMPUS • Met with Mark Frey, CEO of AM ITA who viewed the video of last year's event and secured

a $30,000 signature sponsorship. The event is on track to attract 4,000 participants, volunteers, and spectators. The new consolidation of Alexian/Adventist/Ascension into AMITA presents additional opportunities. Mr. Frey suggested their new food vendor would be a great partner to provide food on-site for event participants, as well as the gathered audience. Adding a GLO-RUN allows us to reach out to more non-profit organizations. If they put a team into the GLO-RUN, all registration fees are refunded to their organization, giving them a chance to host their own SK without the overhead. Since GLO-RUN is not a timed event, it typically draws more women, children, and families; this is the perfect synergy for the new Woman's and Children's Hospital. Staff is currently connecting Village businesses with the event to grow the festival atmosphere. Now in its 6th year, the event is the 2nd largest inline skating marathon in the nation, drawing international teams and providing much needed tourism during July. This year, we are splitting the cash prize purses ($10,000) between ALL age groups in the running events as opposed to the Marathon only. We are the ONLY event to offer cash prizes at every level, so we anticipate running events will grow through this initiative. Hoffman Estates Park District partners with us and provides extraordinary local marketing through their established database of program participants and electronic signage.
