SUSTANCIAS SICOTROPICAS("ACUERDO AIR BRIDGE DENIAL")

The Government of the United States ofAmerica ("USG") and the Government of theRepublic of Colombia ("GOC") (collectively, the"Parties"), concerned about the continuing illicittrafficking in narcotic drugs and psychotropicsubstances into, within, and through Colombia;

Recalling that under the 1962 GeneralAgreement for Economic, Technical andRelated Assistance between the Government ofthe United States of America and theGovernment of Colombia ("1962 Agreement"),the USG has agreed to furnish certaineconomic, technical, and related assistance;

El Gobierno de los Estados Unidos de America(el "USG", por sus siglas en ingles) y elGobierno de Ia Republica de Colombia (el"GC"), (colectivamente, las "Partes"),preocupados por el continuo trefico ilicito deestupefacientes y sustancias sicotrOpicas haciaColombia y dentro y a travas de la misma;

Recordando que, en virtud del ConvenioGeneral para Ayuda EconOmica, Tecnica y Afinde 1962, entre el Gobierno de los EstadosUnidos de America y el Gobierno de laRepublica de Colombia (el "Convenio de1962"), el USG ha accedido a proveer ciertaasistencia econOmica, tecnica y afin;

Recalling that the 1988 United NationsConvention Against Illicit Traffic in NarcoticDrugs and Psychotropic Substances ("1988Convention") requires the Parties to considerentering into bilateral agreements to carry out,or to enhance the effectiveness of, itsprovisions;

Recognizing that the illicit trafficking in narcoticdrugs and psychotropic substances has had amajor negative impact on Colombian efforts toachieve economic and social progress, underthe democratic rule of law;

Recordando que Ia ConvenciOn de lasNaciones Unidas contra el Trefico Ilicito deEstupefacientes y Sustancias SicotrOpicas de1988 (la "ConvenciOn de 1988") dispone quelas Partes consideren conceder la firma deacuerdos bilaterales para (lever a la practicesus disposiciones o para hacerlas maseficaces;

Reconociendo que el trefico ilicito deestupefacientes y sustancias sicotrOpicas hatenido un grave efecto negativo en losesfuerzos desplegados en Colombia paralograr progreso econOmico y social, dentro delestado democratic° de derecho;

Desiring to reinforce the bilateral program forthe control of narcotic drugs and psychotropicsubstances as set forth in the 2004 Annex tothe 1962 General Agreement for Economic,Technical and Related Assistance between theGovernment of the United States of Americaand the Government of Colombia ("2004Annex");

Have agreed as follows:

Con el deseo de fortalecer el programabilateral de control de estupefacientes ysustancias sicotr6picas, de conformidad conlas condiciones estipuladas en el Anexo de2004 al Acuerdo General para AyudaEconOmica, Tecnica y Afin de 1962 entre elGobierno de los Estados Unidos de America yel Gobierno de la Republica de Colombia (el"Anexo de 2004");

Han acordado lo siguiente:

ARTICLE IGENERAL

A. This Agreement, commonly referred to asthe "Air Bridge Denial Agreement" or "ABDAgreement" ("the Agreement"), shall be thebilateral instrument that governs the Air Bridge

A. Este acuerdo, usualmente denominado el"Acuerdo Air Bridge Denial", o el "AcuerdoABD" (el "Acuerdo") debe ser el instrumentobilateral que rija el Programa de SupresiOn del

Denial Program and the use of Air BridgeDenial Program assets in support ofsuppression of illicit maritime trafficking innarcotic drugs and psychotropic substances("SSIMT"), as set out below and in the Annexesand Appendix to this Agreement.

Trafico Ilicito Aereo y el use de activos delmismo para la supresi6n del trafico Ilicito deestupefacientes y sustancias sicotrOpicas porvia maritima ("ASTIM"), como se establece acontinuaciOn y en los Anexos y Apêndices deeste Acuerdo.

B. The program described herein is designatedas the Program for the Suppression of IllicitAerial Traffic in Narcotic Drugs andPsychotropic Substances ("Air Bridge DenialProgram" or "ABD Program"). The Partiesagree to support the ABD Program in order tostrengthen the capability of the GOC toeliminate illicit aerial trafficking in narcotic drugsand psychotropic substances in the airspace ofthe Republic of Colombia. Subject to theavailability of appropriated funds, the USG mayprovide aerial tracking equipment, training,spare parts, communications equipment,support equipment, maintenance technicianservices, advisory assistance by USG ABDProgram representatives, and other support tothe ABD program.

B. El programa descrito en este Acuerdo seconocera como el Programa para la SupresiOndel Trafico Ilicito Aare° de Estupefacientes ySustancias Sicotr6picas (el "Programa AirBridge Denial o el "Programa ABD"). LasPartes acuerdan apoyar el Programa ABD parafortalecer la capacidad del GC para eliminar eltaco ilicito aereo de estupefacientes ysustancias sicotrOpicas en el espacio aereo dela Republica de Colombia. Sujeto a ladisponibilidad de fondos asignados, el USG,podra proporcionar equipamiento de rastreoaereo, entrenamiento, repuestos, equipo decomunicaciones, equipo de apoyo, y serviciosde tecnicos de mantenimiento, asi comoasesoramiento por parte de representantes delUSG en el Programa ABD, y otro apoyo para elPrograma ABD.

C. The Colombian Air Force ("FAC") shall beresponsible for the ABD Program. The FACshall oversee operations undertaken within theABD Program and shall coordinate with theother Colombian institutions involved in theABD Program and the United States JointInteragency Task Force South ("JIATF-S"). TheFAC shall perform the day-to-day administrationof the provisions of this Agreement with theassistance of the Narcotics Affairs Section("NAS") of the U.S. Embassy in Colombia. TheU.S. Department of Defense, through JIATF-S,may provide aerial assets to the ABD programand shall exercise tactical control of those U.S.aircraft that participate in the ABD Program.

C. La Fuerza Aerea Colombiana (la "FAC")debera ser responsable por el Programa ABD.La FAC debera supervisar las operacionesejecutadas en el marco del Programa ABD ydebera coordinar con las demas institucionescolombianas participantes en el Programa ABDy con la Fuerza Especial InterinstitucionalConjunta del Sur (la "JIATF-S", por sus siglasen ingles). La FAC debera Ilevar a cabo lagestiOn diaria de lo dispuesto en el presenteAcuerdo con la asistencia de la SecciOn deAsuntos de NarcOticos (la "NAS", por sus siglasen ingles) de la Embajada de los EstadosUnidos en Colombia. El Departamento deDefensa de los Estados Unidos, a traves deJIATF-S, podra proporcionar activos aêreos alPrograma ABD y debera ejercer el controltâctico de esas aeronaves de los EstadosUnidos que participen en el Programa ABD.

D. An "ABD mission" is a mission undertaken infurtherance of the ABD Program. An "SSIMTmission" ("Annex C mission") is a mission thatuses funding and assets provided to the ABDProgram to support the ongoing efforts of theUnited States, Colombia, and other partnernations to counter illicit maritime trafficking innarcotic drugs and psychotropic substances inthe Caribbean Sea and Pacific Ocean. ABDmissions shall take priority over SSIMTmissions, unless otherwise agreed by JIATF-Sand the FAC.

D. Una "misiOn ABD" es una misiOnemprendida en apoyo del Programa ABD. Una"misiOn ASTIM" (las misiones del Anexo C) esuna misiOn que usa fondos y activosproporcionados para el Programa ABD paraapoyar los esfuerzos en curso de los EstadosUnidos, Colombia y otras naciones asociadas,para contrarrestar el trafico ilicito maritimo deestupefacientes y sustancias sicotrapicas en elMar Caribe y en el Ocêano Pacifico. Lasmisiones ABD deberan tener prioridad sobrelas misiones ASTIM a menos que seaacordado de otra forma por JIATF-S y la FAC.

ARTICLE IIABD PROGRAM DESCRIPTION

A. Under the ABD Program, non-commercialaircraft flying in Special Zones of Air Control (asdefined in Article III(B)(2)) could be subject tospecial surveillance by ground and aerialdetection assets to determine whether theaircraft is reasonably suspected to be primarilyengaged in illicit drug trafficking (as defined inparagraph F). The Appendix to Annex Acontains factors to be considered in determiningwhether the aircraft is reasonably suspected ofbeing primarily engaged in illicit drug trafficking.Safety procedures to be used in the ABDProgram are contained in Annex A and shall beused by the personnel and representatives ofboth parties in implementing the ABD Program.

ARTICULO IIDESCRIPCION DEL PROGRAMA ABD

A. De conformidad con el Programa ABD, todaaeronave no comercial que vuele en las ZonasEspeciales de Control Aêreo (segUn ladefinition en el Articulo III(B)(2)) podria estarsujeta a vigilancia especial por las unidades dedetection aêrea y terrestre con el objetivo dedeterminar si existen sospechas razonablesde que Ia aeronave se dedica principalmente altráfico ilicito de drogas, (segtin se define en elparrafo F). El Apendice del Anexo A contienefactores que deben tenerse en cuenta paradeterminar si una aeronave es razonablementesospechosa de dedicarse principalmente altrâfico ilicito de drogas. Los procedimientos deseguridad que deben seguirse en el ProgramaABD figuran en el Anexo A y seran cumplidospor el personal y los representantes de ambasPartes en la ejecucitin del Programa ABD.

B. Air Safety Monitors, Ground Safety Monitors,and JIATF-S (collectively, the "safety oversighttriad") verify compliance with the procedurescontained in Annexes A and C.

B. Los Monitores de Seguridad Aerea, losMonitores de Seguridad Terrestre, y JIATF-S(Conjuntamente, Ia "triada de monitoreo deseguridad") verificarân el cumplimiento de losprocedimientos establecidos en los Anexos A yC.

C. An "ABD event" is the application of theoperational and safety procedures described inthis Agreement to a particular civil aircraft.

D. As used in this Agreement, "interception"means the act by a tracker or interceptoraircraft of approaching and remaining near anaircraft, with the goal of identifying that aircraftand, if necessary, directing it back to itsplanned route, escorting it out of restricted orprohibited airspace or the Special Zones of AirControl, or instructing it to land.

En el sentido en que se utiliza en elpresente Acuerdo, se entiende por"interceptackin" el acto de aproximarse ymantenerse cerca de una aeronave efectuadopor una aeronave de rastreo o interceptackin,con el fin de identificar a esa aeronave y, si esnecesario, reorientarla hacia su via planeada,escoltarla fuera del espacio aereo restringido 0prohibido o de las Zonas Especiales de ControlAèreo, o darle Ordenes de aterrizar.

E. In accordance with Article 2 of theConvention for the Suppression of UnlawfulActs Against the Safety of Civil Aviation, doneat Montreal, September 23, 1971, to which boththe United States and Colombia are parties:

(1) an aircraft is considered to be in flight at anytime from the moment when all its externaldoors are closed following embarkation until themoment when any such door is opened fordisembarkation; in the case of a forced landing,the flight shall be deemed to continue until thecompetent authorities take over responsibilityfor the aircraft and for persons and property onboard;

(1) se considerara que una aeronave seencuentra en vuelo desde el momento en quese cierren las puertas externas despues delembarque hasta el momento en que se abracualquiera de dichas puertas para eldesembarque; en caso de aterrizaje forzoso,se considerara que el vuelo continua hasta quelas autoridades competentes se hagan cargode la aeronave y de las personas y bienes abordo;

(2) an aircraft is considered to be in servicefrom the beginning of preflight preparation ofthe aircraft by ground personnel or by the crewfor a specific flight until twenty-four hours afterany landing; the period of service shall, in anyevent, extend for the entire period during whichthe aircraft is in flight as defined insubparagraph (1) above.

F. An aircraft is "reasonably suspected of beingprimarily engaged in illicit drug trafficking" whena sufficient basis exists to reasonably suspectthat the primary purpose of the operation of anaircraft in service is:

F. Se considera a una aeronave como"razonablemente sospechosa de estarprincipalmente dedicada al trbfico ilicito dedrogas," cuando existen suficientes elementospare sospechar que el fin principal de laoperación de la aeronave en servicio es:

(1) the illicit transport of narcotic drugs orpsychotropic substances (as defined in the1988 Convention), or the travel of the aircraft tothe place where it illicitly receives narcoticdrugs or psychotropic substances or the returnof the aircraft after illicitly moving narcotic drugsor psychotropic substances, or

(1) el transporte ilicito de estupefacientes osustancias sicotrOpicas (segiin Ia definiciOn dela ConvenciOn de 1988), o el viaje de laaeronave al lugar donde ilicitamente recibeesos estupefacientes o sustancias sicotrOpicas,o el regreso de la aeronave despues deltransporte ilicito de dichos estupefacientes osustancias sicotrOpicas, o

(2) the transport of proceeds that directly resultfrom an illicit transaction in such narcotic drugsor psychotropic substances (or the travel of theaircraft to the place where it delivers or receivesthe proceeds). .

G. If any GOC or USG participant in the ABDProgram has reason to believe that persons notwillfully engaged in illicit drug trafficking are onboard an aircraft, that aircraft shall not beconsidered to have a primary purpose of illicitdrug trafficking.

G. Si cualquiera de los participantes del GC 6del USG en el Programa ABD tiene motivospara creer que a bordo de una aeronave viajanpersonas que no participan intencionalmenteen el trâfico ilicito de drogas, no se consideraraque esa aeronave tiene por fin principal eltràfico ilicito de drogas.

H. The pilot, crew, and passengers of all aircraftsubject to action under the ABD program arepresumed not to be engaged in illicit drugtrafficking. The highest priority for the ABDProgram is to have the intercepted aircraft landsafely at the nearest GOC-controlled landingstrip, where law enforcement personnel maytake control of the aircraft. As detailed in Annex

donde las autoridades competentes puedanasumir el control de la misma. Como seexplica detalladamente en el Anexo A, elempleo de fuerza letal se hara Unicamentecomo Ultimo recurso.

I. Continued USG support for the ABD Programis conditioned upon consistent, strict adherenceto the safety procedures in Annex A to thisAgreement, including the International CivilAviation Organization ("ICAO") radio and visualcommunication procedures for interceptioncontained in Annex 2 to the Convention onInternational Civil Aviation, done at Chicago onDecember 7, 1944; U.S. Congressionalauthorization and appropriations of funds; andcompletion of all requirements under relevantU.S. laws and procedures.

La continuaci6n del apoyo del USG alPrograma ABD esta condicionada alcumplimiento estricto y coherente con losprocedimientos de seguridad que figuran en elAnexo A del presente Acuerdo, incluidos losprocedimientos de comunicaciOn por radio yvisual para la interceptaciOn de la Organizacionde la AviaciOn Civil Internacional (OACI), quefiguran en el Anexo 2 de la ConvenciOn sobreIa AviaciOn Civil Internacional, firmada enChicago el 7 de diciembre de 1944; a laautorizaciOn y las asignaciones de fondos delCongreso de los Estados Unidos, y alcumplimiento de todos los requisitos deconformidad con las leyes y los procedimientospertinentes de los Estados Unidos.

J. The operation of tracker or detection andmonitoring aircraft used in the ABD Programshall be subject to the rules, regulations, andprocedures in force in Colombia, unless otherprocedures have been agreed upon by theParties regarding these matters.

J. La operaci6n de una aeronave de rastreo odetecciOn y seguimiento vinculada al ProgramaABD se sujetara a las reglas, regulaciones yprocedimientos vigentes en Colombia a menosque las Partes acuerden otros procedimientosal respecto.

ARTICLE IIIRESPONSIBILITIES OF THE GOVERNMENT

OF COLOMBIA

A. The GOC agrees to assign specializedpersonnel sufficient to meet operationalrequirements. The GOC is responsible for allrelated costs for such personnel, including butnot limited to salaries, benefits, and travel withinColombia, except as otherwise provided for inthis Agreement or agreed to by the Parties.Subject to the availability of appropriated funds,the GOC shall ensure effective day-to-dayoperation of the ABD Program by providingadequate funding for normal administrative andrelated expenses, such as rents and utilities.GOC personnel may be trained throughfinancing provided by the USG, by personnel ofthe USG or by GOC personnel certified by theUSG as instructors.

ARTiCULO IIIRESPONSABILIDADES DEL GOBIERNO DE

COLOMBIA

A. El GC se compromete a proporcionar elpersonal especializado necesario para darcumplimiento a los requisitos operativos. El GCse encargara de todos los costos relacionadoscon ese personal, incluidos entre otros,salarios, prestaciones y viajes dentro deColombia, salvo que se disponga de otro modoen el presente Acuerdo o por convenio entrelas Partes. Sujeto a Ia disponibilidadpresupuestal, el GC .asegurara la efectivaoperaciOn cotidiana del Programa ABD,mediante el suministro de suficientes fondospara cubrir los gastos normales deadministraciOn y los gastos conexos, comorentas y servicios püblicos. El personal del GCpodra ser entrenado mediante elfinanciamiento del USG, por personal del USGo por personal del GC certificado comoinstructor por el USG.

B. The GOC shall:

(1) ensure compliance with the procedures inAnnexes A and C to this Agreement;

(2) designate Special Zones of Air Control("ZECAs"). ZECAs are sections of Colombiannational airspace delineated by the FAC, incoordination with the Special AdministrativeUnit of the Civil Aviation Agency of the GOC.The ZECAs shall be clearly defined and theirexistence clearly and widely disseminated priorto the commencement of activities under theABD Program. The ZECAs shall only coverareas where there is sufficient basis toreasonably suspect that there are routes usedfor illicit trafficking in narcotic drugs orpsychotropic substances and may not bedesignated over areas that are heavilypopulated. The geographical coordinates of theZECAs are attached hereto as Annex B to thisAgreement;

(2) designar Zonas Especiales de ControlAare° ("ZECA"). Las ZECA son sectoresdesignados del espacio aareo colombianodelimitados por Ia FAC, en coordination con IaUnidad Administrativa Especial deAeronautica Civil del GC. Las ZECA seranclaramente definidas, y su existencia clara yampliamente difundida antes de iniciar lasactividades en el marco del Programa ABD.Las ZECA abarcaran Unicamente areasacerca de las cuales existan fundamentossuficientes para sospechar razonablementeque haya rutas utilizadas para el trafico ilicitode estupefacientes o sustancias sicotrOpicas yno seran designadas sobre areas densamentepobladas. Las coordenadas geograficas de lasZECA se adjuntan como Anexo B del presenteAcuerdo;

(3) on an annual basis, or as changes occur,widely promulgate, throughout the civil aviationcommunity via NOTAM and other appropriatemeans, notice of the existence and location ofthe ZECAs and the procedures that the FACshall use to order intercepted aircraft to land,including the consequences of non-compliance;

(3) anualmente, o segOn vayan ocurriendo loscambios, difundir ampliamente a todo elpersonal pertinente de la aviaciOn civilmediante avisos a los pilotos (NOTAM) y otrosmedios pertinentes, la notification de laexistencia y ubicaciOn de las ZECA y losprocedimientos que empleara Ia FAC paraordenar aterrizar a una aeronave interceptada,incluidas las consecuencias delincumplimiento;

(4) establish a safety oversight program andprovide Air Safety Monitors (ASM) and GroundSafety Monitors (GSM). In conjunction withJIATF-S, these safety monitors comprise the"safety oversight triad" and verify compliancewith the procedures contained in Annexes Aand C;

(4) establecer un programa de verification deseguridad y proporcionar Monitores deSeguridad Aórea (MSA) y Monitores deSeguridad Terrestre (MST). En conjunto conJIATF-S, estos monitores de seguridadintegran "la triada de monitoreo de seguridad" yverificaran el cumplimiento de losprocedimientos establecidos en los Anexos A yC;

(5) ensure that the GOC pilots, the MissionCommander Officers, and the Air and GroundSafety Monitors are proficient in English,including functional comprehension of common-use and specialized aviation terminology, andare familiar with agreed-upon communicationprotocols for the operational implementation ofthe ABD Program;

(5) asegurar que los pilotos del GC, losOficiales Comandantes de Misi6n y losMonitores de Seguridad Aarea y Terrestreposean los conocimientos suficientes deinglês, incluida la comprensi6n funcional de laterminologia de aviaciOn de use corriente yespecializada, y esten familiarizados con losprotocolos de comunicaciones convenidos deantemano para Ia ejecuciOn operativa delPrograma ABD;

(6) carry out through the Ministry of Defense thefollow-up and supervision for the adequate dailyimplementation and management of the ABDProgram;

(6) realizar por intermedio del Ministerio deDefensa las acciones de seguimiento ysupervision que correspondan para laadecuada ejecuciOn y administration diaria delPrograma ABD;

D. All GOC agencies involved in implementingthe ABD Program agree to minimize operationalcosts directly borne by the USG. In particular,any aircraft to which the USG providesmaintenance support under this Agreementshall remain within the mutually establishedhourly flight limits, unless a case-by-caseexception is requested and approved inadvance through consultations between theParties. The Parties shall review the number ofhours on a monthly basis to determine if yearlyexpenditure targets are being met.

The USG's ability toconsent to exceptional uses of ABD assistancemay be subject to limitations imposed by U.S.law.

ARTICLE IVRESPONSIBILITIES OF THE GOVERNMENT

OF THE UNITED STATES

A. The USG intends to transfer to the GOC thetitle to five (5) SR-560 aircraft and one (1)Cessna 182 aircraft.

B. The USG intends to transfer to the GOCspecial aviation tools and test equipment, spareparts and support equipment associated withthe aircraft described in the previous section.

C. The USG intends to transfer to the GOC thefacilities built in support of the ABD Program.

D. The USG intends to effect the transfersdecribed in Sections A, B and C by separatetransfer agreements reached by both Parties.

ARTICULO IVRESPONSABILIDADES DEL GOBIERNO DE

LOS ESTADOS UNIDOS

A. El USG se propone transferir al GC el titulode propiedad de cinco (5) aeronaves SR-560 yuna (1) aeronave Cessna 182.

B. El USG se propone transferir al GC lasherramientas especiales y equipos de pruebapara la aviaciOn, repuestos y equipo de apoyorelacionado con las aeronaves descritas en elliteral anterior.

C. El USG se propone transferir al GC lasinstalaciones construidas en apoyo alPrograma ABD.

D. El USG se propone efectuar lastransferencias descritas en los literales A, B yC mediante acuerdos de transferencia entre lasdos Partes.

E. Unless otherwise agreed by both Parties,the USG shall provide logistical supportrequired for the operation of the SR-560 aircraftin the FAC units made available by the GOC,subject to the availability of appropriated funds.

F. Subject to the availability of appropriatedfunds, the USG intends to provide training,operations, and equipment maintenancesupport to the FAC to support the ABDProgram. All USG-funded training shall be inaccordance with current U.S. Department ofState Bureau of International Narcotics and LawEnforcement ("INL") Air Bridge Denialoperations and aircrew training syllabi, by INL-approved instructors. Training may be formal,informal, on-the-job training, or a mixture of alltypes. All training shall be focused ondeveloping an aviation infrastructure capable ofsafely and effectively continuing Colombianoperations after the termination of USGsupport.

G. The USG shall ensure that semi-annualreviews and a yearly certification of the ABDProgram are conducted, in accordance with therelevant U.S. law, including 22 U.S.C. section2291-4 (as amended).

H. The USG shall assist the GOC in providingsafety oversight through the use of the JIATF-SOperations Center. This portion of the "safetyoversight triad" shall also verify compliance withthe established procedures that are containedin Annexes A and C. The USG shall assist theGOC in ensuring that the FAC Ground and AirSafety Monitors are proficient in English, andare familiar with agreed-upon communicationprotocols for the operational implementation ofthis ABD Program.

I. The USG acknowledges that, in the event thatthe USG suspends or terminates USG-providedsupport, the GOC may suspend or terminatefuture USG access to Colombian informationand support provided under this Agreement.

ARTICLE VFUNDING

A. Disbursement of USG funds for procurementof goods and services referred to in thisAgreement shall be subject to the availability ofappropriated funds for that purpose and shallbe made as charges against sub-obligatingdocuments prepared and issued by the USG.

ARTICLE XAIRCRAFT ACCIDENTS

The purpose of an Accident Investigation Boardis to determine the cause of an accident andrecommend corrective actions in the areas oftraining, operational procedures, maintenance,and equipment with the objective of preventingfuture accidents. In the event of an accidentinvolving any aircraft engaged in operationsunder the ABD Program or SSIMT, the Partiesshall consult and decide on the need for aCombined Accident Investigation Board and theprocedures for that Board within 30 days of theaccident. All members of a Combined AccidentInvestigation Board shall have access to allrelevant damaged material/equipment,information, files, and reports.

ARTICULO XACCIDENTES DE AERONAVES

La finalidad de Ia Junta de InvestigaciOn deAccidentes es determinar Ia causa de unaccidente y recomendar medidas correctivasen los campos de adiestramiento,procedimientos operativos, mantenimiento yequipo con el objetivo de evitar futurosaccidentes. En caso de un accidente queimplique cualquier aeronave comprometida enoperaciones en el Programa ABD o el ASTIM,las Partes deberan consultar y decidirmutuamente acerca de Ia necesidad de crearuna Junta Mixta de InvestigaciOn deAccidentes y los procedimientos que seguiraesa Junta, dentro de los 30 dias siguientes alaccidente. Todos los miembros de la JuntaMixta de InvestigaciOn de Accidentes tendranacceso a todo el material/equipo relevante quesufri6 dab°, asi como a la informaci6n,archivos e informes.

ARTICLE XICURRENCY EXCHANGE

Currency exchange under this Agreement shallbe in accordance with Article V of the 1962Agreement.

El cambio de moneda conforme a esteAcuerdo se debera hacer segOn lo dispuestoen el Articulo V del Convenio de 1962.

ARTICLE XIITAXES AND DUTIES

ARTICLE XIIISTATUS OF USG PERSONNEL IN

COLOMBIA

USG personnel present in Colombia inconnection with implementation of thisAgreement shall be accorded the sameprivileges and immunities enjoyed by SpecialMissions in accordance with Article III of the1962 Agreement.

ARTICLE XVIFINAL PROVISIONS

A. This Agreement shall enter into force fromJanuary 1, 2008 and supersede the "Agreementbetween the Government of the United Statesof America and the Government of the Republicof Colombia Concerning the Program for theSuppression of Illicit Aerial Traffic in NarcoticDrugs and Psychotropic Substances" signed atBogota on March 14, 2007"

ARTICULO XVIDISPOSICIONES FINALES

A. Este Acuerdo entrare en vigor a partir del 1de enero de 2008 y sustituye el "Acuerdo entreel Gobierno de los Estados Unidos de Americay el Gobierno de Ia Republica de Colombiarelativo al Programa de Supresi6n del TreficoIlicito Aereo de Estupefacientes y SustanciasSicotrOpicas", firmado en Bogota el 14 demarzo del 2007.

B. Amendments to this Agreement may bemade as agreed by the Parties. Allamendments to this Agreement shall be inwriting. The amendments shall enter into forceimmediately upon signature by both Partiesunless otherwise specified in the amendments.

C. Either Party may temporarily suspend ABDProgram operations pending a joint review inaccordance with Article IX herein. Suchsuspension shall take effect upon notification ofone Party in writing to the other of suchsuspension. Either Party may suspend itsassistance to the ABD Program, in part or infull, if it believes that the other Party has failedto comply with its responsibilities under thisAgreement.

The USG reserves the right to terminate anyor all assistance provided under this Agreementor to take other appropriate measures if anagency of the GOC to or through whichassistance is being provided under thisAgreement or a key individual of such agencyor any recipient of scholarships, fellowships, ortraining financed under this Agreement is foundto have been convicted of a narcotic drugs orpsychotropic substances offense or to be orhave been engaged in illicit trafficking innarcotic drugs or psychotropic substances.

E. Nothing in this Agreement modifies or altersthe obligations between the Parties provided forin other international agreements to whicheither is a party; nor is anything in thisAgreement intended to prejudice the position of

G. Either Party may terminate this Agreementby giving the other Party 90 days' written noticeprior to such termination. In addition, the USGmay terminate this Agreement if a PresidentialDetermination required by U.S. law is no longerin effect for this Program effective on the datethe USG notifies Colombia of such a change.Termination of this Agreement shall cancel anyobligations of the Parties to make contributionspursuant to this Agreement, except forpayments of commitments entered into withthird parties prior to the notice of cancellation ofthe Agreement. Additionally, notwithstandingsuch termination, it is expressly understood thatthe obligations under Article VI of thisAgreement, relating to the use of property, shallremain in force after termination of theAgreement.

La terminaciOn del presenteAcuerdo anularb todas las obligaciones de lasPartes de hacer contribuciones encumplimiento del Acuerdo, excepto el pago delos compromisos contraidos con terceros conanterioridad a la fecha de notificaci6n de laterminaciOn del Acuerdo. Adicionalmente, noobstante dicha terminaci6n, quedaexpresamente entendido que las obligacionessegt:in el Articulo VI del presente Acuerdo en loconcerniente al use de la propiedad, deberanpermanecer en vigencia despues de laterminaciOn del Acuerdo.

Operational areas for the detection,identification and monitoring of civil aircraft overthe Pacific Ocean and the Caribbean Sea shallbe jointly determined by JIATF-S and the FAC.These activities shall be conducted in a mannerconsistent with international aviation law andthe international law of the sea. The FAC shallnot initiate Phases I, II, or III with any aircraft somonitored (nor shall it give directions to followan interceptor's instructions or to land) unlessand until that aircraft enters into a ZECA.

The GOC shall makeall reasonable efforts to ensure that Phase III, ifreached, also only be initiated within a ZECA.However, although not desirable, it is possiblethat Phase III might occur outside a ZECA,prompted by an identification of an aircraftreasonably suspected of being primarilyengaged in illicit drug trafficking within a ZECA,because of the time involved in completing theprocedures.

H. Under the ABD Program the GOC shall notenter into Phase II or Phase III (as describedherein) when:

This provision does notapply if there exists sufficient reason toconclude that the report of unlawful interferenceis being used as a trick in order to avoid the useof force by the FAC.

If any USG or GOC participant in an ABD eventhas reason to believe that one or more of theseconditions is met, that interception shall beterminated immediately. However, theseprocedures are not intended to preclude theGOC from conducting efforts to identify andmonitor these categories of aircraft throughradio contact, visual identification, or by othermeans.

If there is a loss of communications amongany of the members of the safety oversighttriad, USG or GOC agencies or personnelduring Phases I, II, or III of an ABD event, asdescribed herein, the GOC or USG ABDparticipants (including those in paragraph B ofthis section) may require that the ongoing ABDevent terminate. The departure of a trackingaircraft from the scene after the FAC hasinitiated an ABD ground event shall not bedeemed to constitute a loss of communicationsif there is a second GSM in the CCOFA who isfollowing the event, as described in sectionVII.F. herein, and is in active communicationwith the interceptor.

J. The Parties shall take the necessary steps toensure that each of their nationals orrepresentatives, when participating in the ABDProgram, is fully familiar with the contents ofthis Annex, including its Appendix, and AnnexB.

II. Detection, Sorting, and Identification

When the GOC detects or is informed of anaircraft operating in a ZECA that is a candidatefor possible ABD action (a "track of interest"),information on that aircraft shall be gathered(sorted) by the GOC from all reasonablyavailable sources, including radar systems,radio and visual contact with the aircraft,electronic systems (which help verify whetherthe plane is traveling on a filed flight plan andwhat type of plane it is), and relevant air trafficcontrol centers, to begin to determine whetherthe aircraft is reasonably suspected to beprimarily engaged in illicit drug trafficking. Thatdetermination shall be made by the OCB in theCCOFA, using the factors set forth in theAppendix, as well as other information providedto GOC and USG participants in the ongoingaction.

II. Detection, ClasificaciOn e Identification

III. Monitoring

If the GOC reasonably suspects that an aircraftis primarily engaged in illicit drug trafficking, thataircraft shall be tracked and monitored. Iftracking is intermittent, positive re-identificationshall be made with reasonable certainty beforethe ABD event may continue. If the GOC hasbeen unable to identify the track of interest as alegitimate track, the aircraft shall be consideredsuspect by the FAC under FAC procedures andmay be intercepted.

III. Monitoreo

If there continues to be a reasonablesuspicion that the aircraft in flight is primarilyengaged in illicit drug trafficking, the interceptoraircraft shall contact the intercepted aircraftusing ICAO radio communications proceduresand using the appropriate frequencies or, ifradio contact cannot be established, throughthe use of ICAO visual signals, and order theintercepted aircraft to land at a designatedplace suitable for a safe landing.

V. Use of Warning Shots (Phase II)

Phase II consists of the firing of warning shots,using ammunition containing tracer rounds, inorder to demonstrate to the pilot of theintercepted aircraft that he must comply with theinterceptor's order. If all of the proceduresrequired under this Agreement have beenfollowed, if the information gathered continuesto indicate that an aircraft is reasonablysuspected of being primarily engaged in illicitdrug trafficking, and if the aircraft fails torespond to the interceptor's order to land, theGOC may, in accordance with the following,move to Phase II.

A. In Phase II, the Colombian interceptoraircraft shall not fire warning shots until herequests and receives authorization. All suchrequests must be reviewed by the COFAC.

B. In advance of firing warning shots, theinterceptor aircraft shall attempt to warn theintercepted aircraft, using ICAO radiocommunications procedures and using theappropriate frequencies, that warning shotsshall be used if the intercepted aircraft refusesto comply. Unless the safety of flight preventsit, warning shots shall be fired from a positionslightly ahead of the wing line and parallel tothe course of. the intercepted aircraft to ensurethat the intercepted aircraft is not in the line offire. In the event that the safety of flight ortechnical limitations prevent warning shots frombeing fired from the position described above,the pilot of the interceptor aircraft shall makeevery reasonable effort to make the warningshots visible to the pilot of the interceptedaircraft. The aircraft firing the warning shotsshall make every reasonable effort to avoidshooting the intercepted aircraft, any otheraircraft in the vicinity, or persons or property onthe ground.

B. Upon receipt of the COFAC's authorization,the interceptor aircraft shall warn theintercepted aircraft, using ICAO radiocommunications procedures and using theappropriate frequencies, that it shall be firedupon if it refuses to comply. The force usedagainst the intercepted aircraft shall not be inexcess of the minimum necessary to disable it,starting with a minimum level of fire in anattempt to persuade the intercepted aircraft toland as directed. The intercepted aircraft shallbe given a reasonable opportunity to obey thepreviously issued orders to land before theinterceptor uses additional force. Levels offorce may be increased if the interceptedaircraft continues to refuse to follow theinterceptor's directions. It is acknowledged thateven the minimum level of force could result inloss of life. If the intercepted aircraft has landedor been shot down, the interceptor aircraft ortracker aircraft shall give immediate notice tothe CCOFA of the location of the interceptedaircraft. Additionally, the GOC shall initiate theactions required in section VII.K.

C. VII. Procedures on the Ground

A. When an ABD event has entered Phase I,the FAC shall alert the command and controlcenter of the Colombian National Police("CNP"), the JOC of the Joint Military ForcesCommand, and appropriate aviation authoritiesof those locations at which an interceptedaircraft might be forced to land.

If an aircraft reasonably suspected to beprimarily engaged in illicit drug trafficking lands,or, is located at an airfield where units of theCNP or military forces are not present, andCNP or military forces are unable to arrive atthe location of the aircraft within a reasonableperiod of time (calculated by the on-stationloiter time of the tracker aircraft) or in sufficientnumbers to control the situation, they shallnotify the FAC immediately. Once the FAC isnotified, the COFAC may consider whether toproceed with the ABD ground event. Thefollowing rules shall govern the event:

(a) the interceptor aircraft first shall make twopasses over the aircraft, rocking its wings andflashing its navigational lights. The passesshall be made at an altitude adequately low tobe heard by individuals on the ground.Simultaneously, the interceptor shall attempt toestablish contact with the located aircraft usingICAO radio communications procedures,making sure to attempt contact using theappropriate frequencies, including thefrequency of uncontrolled aerodromes (122.9MHZ). Radio communications shall use theEnglish and Spanish languages and, wherepossible, the language of the country ofregistry, if known. The pilot shall attempt toobtain information from the pilot of the locatedaircraft, and shall inform the CCOFA of thephysical characteristics of the aircraft and itsproximity to buildings or populated areas.(Ground Phase I)

El piloto tratarà de obtener informationdel piloto de la aeronave localizada e informaràal CCOFA de las caracteristicas fisicas de laaeronave y de su proximidad a edificaciones ozonas pobladas. (Fase I en Tierra).

(b) if there continues to be a reasonablesuspicion that the located aircraft is primarilyengaged in illicit drug and the located aircraftdoes not respond to the attempts to contact it,the interceptor aircraft shall attempt to warn thelocated aircraft, using ICAO radiocommunications procedures and using theappropriate frequencies, that warning shots willbe used if the located aircraft refuses torespond. If the located aircraft continues to failto respond to the warning, the interceptor may,after obtaining permission from the COFAC, firewarning shots, i.e., shots not aimed directly atthe located aircraft, while at the same timeinforming the aircraft on the appropriatefrequencies that it is currently firing warningshots and that if its instructions are not followedthe located aircraft will be rendered inoperative.(Ground Phase II);

(b) si continua habiendo una sospecharazonable de que la aeronave localizada estáprincipalmente dedicada al trAfico ilicito dedrogas y Ia aeronave localizada no responde alos intentos de establecer contacto con ella, laaeronave interceptora tratarb de advertir a Iaaeronave localizada, empleando losprocedimientos de radiocomunicaciones de laOACI y usando frecuencias apropiadas, que seharan disparos de advertencia si Ia aeronavelocalizada se niega a responder. (c) if, after warning shots are fired, the locatedaircraft does not acknowledge or follow theinterceptor's directions, the Colombianinterceptor aircraft may only fire weapons at thelocated aircraft if it requests and receivespermission to do so. G. The use of airborne weapons against anaircraft on the ground is only permitted inaccordance with the procedures described inparagraph F.

H. The procedures in paragraph F shall applyduring any attempt by an aircraft reasonablysuspected of being primarly engaged in illicitdrug trafficking to takeoff without permission. Ifan aircraft described in paragraph D succeedsin taking off and had been the subject of prioraerial tracking, the aerial event shall bereinitiated from the furthest aerial phasecompleted. If an aircraft succeeds in taking offbut had not been the subject of prior aerialtracking, the aerial event shall be initiated fromPhase I.

H. Los procedimientos del parrafo F deber6naplicarse durante cualquier intento dedespegue sin permiso de una aeronaverazonablemente sospechosa de estarprincipalmente dedicada al trafico ilicito dedrogas. Si la aeronave descrita en el pàrrafo Dtiene exito en el despegue y ha sido objeto deun rastreo aereo previo, la acci6n aerea deberaser reiniciada desde la Ultima fase aereaculminada. Si la aeronave tiene exit° en eldespegue pero no ha estado sujeta a unrastreo aereo previo, el procedimiento para elevento aereo debera iniciarse desde la Fase I.

I. All events in which Phase II and III actionsare taken against an aircraft on the groundwithout a tracker must still be reviewed inaccordance with section VIII herein.

J. With regard to each paragraph above, theforce used against an aircraft on the ground,following the procedures set forth in this sectionVII, shall not be in excess of the minimumnecessary to prevent it from taking off.

K. Search and Rescue: To the extent possible,the GOC, with the support of participating USGagencies, shall conduct search and rescueoperations involving intercepted or locatedaircraft. Airborne assets, if available, shallremain on the scene as long as possible, reportthe location of downed aircraft, renderassistance as able, and, if so equipped, recordthrough audio and visual means post-eventefforts and actions.

K. BOsqueda y Rescate: en la medida de loposible, el GC, con el apoyo de los organismosque participan por parte del USG, deberaconducir operaciones de bOsqueda y rescateque involucren aeronaves interceptadas olocalizadas. Los activos adreos, si estàndisponibles, deberân permanecer en la escenamientras sea posible, comunicarân la ubicaciOnde las aeronaves siniestradas, prestarân laayuda que puedan y, de estar equipadas paraello, grabaran por medios de audio y visualeslas acciones y esfuerzos posteriores al evento.

L. If, with regard to an aircraft intercepted orlocated on the ground that is reasonablysuspected to be primarily engaged in illicit drugtrafficking, the GOC observes cargo beingoffloaded from that aircraft onto ground-basedor water-based conveyances, the GOC mayfollow those conveyances by air to gatherinformation on such conveyances, includingtheir identity and destination.

L. Si con respecto a una aeronaveinterceptada o localizada en tierra de la queexista sospecha razonable de que se dedicaprincipalmente al trafico ilicito de drogas, el GCobserva que la carga se estb trasladando dedicha aeronave a algan medio de transporte detierra o agua, el GC podra seguir par aire adicho transporte para obtener informationsobre el mismo, incluido su destino eidentification.

VIII. Review of ABD Events

A. The USG, represented by JIATF-S, and theGOC, represented by the Chief of AirOperations of the FAC, shall jointly review ABDevents that proceed to Phase II or Phase Ill. Allother ABD events shall be jointly reviewed bythe NAS and the FAC. The onboard tapes of allaircraft engaged in ABD events shall be theprimary basis for these reviews and each Partyshall provide access to all onboard tapesinvolving a particular ABD event for purposes ofconducting a review of that event. In addition,each Party shall receive copies of all onboardtapes of tracker aircraft involving ABD eventsthat proceed to Phase II or Phase III. The USGand GOC shall keep all onboard tapes of ABDevents that they possess, in accordance withtheir laws and regulations, and in any event inaccordance with the following schedule:

VIII. Revision de los Eventos ABD

A. El USG, representado por la JIATF-S, y elGC, representado por el Jefe de OperacionesAereas de la FAC, deberan revisarconjuntamente los eventos ABD que Ileguen ala Fase II o a Ia Fase III. Todos los otroseventos ABD deberan revisarse conjuntamentepor el NAS y la FAC. Las cintas que seencuentren a bordo de todas las aeronavesinvolucradas en eventos ABD seran la baseprincipal para estas revisiones y cada Partedebera facilitar el acceso a todas las cintas dea bordo sobre un evento ABD particular con elfin de que se realice la revision de ese evento.Adicionalmente, cada Parte debera recibircopias de todas las cintas grabadas a bordo deaeronaves de rastreo sobre eventos ABD queIleguen a la Fase II o a la Fase Ill. El USG y elGC deberan guardar todas las cintas grabadasa bordo sobre los eventos ABD que posean,segan sus (eyes y regulaciones, y en cualquierevento segan lo siguiente:

(1) For ABD events that proceed to Phase II orPhase III, for at least one year; and

For ABD events that proceed to Phase II orPhase III, the USG and GOC each shallproduce a memorandum summarizing eachevent, evaluating whether procedures werefollowed, reviewing any errors or anomalies,and proposing corrective actions, if any, to betaken. Any differences in views shall beaddressed in consultations between the Parties.

The following factors should be consideredbefore and during Phase I in determiningwhether an aircraft is reasonably suspected ofbeing primarily engaged in illicit drug trafficking:

(6) Does the aircraft have false (or no) tailnumbers?

(7) Are the windows blacked out?

(8) Does the physical description of the aircraftmatch the description of an aircraft previouslyused in illicit drug trafficking?

(9) Is there signal or human intelligenceindicating that the aircraft is primarily engagedin illicit drug trafficking?

(10) Is the aircraft flying without permissionover a FAC restricted area in a ZECA?

ANNEX C: USE OF ABD ASSETS INSUPPORT OF SUPPRESSION OF ILLICITMARITIME TRAFFICKING IN NARCOTICDRUGS AND PSYCHOTROPICSUBSTANCES

The Parties agree to comply with the followingprocedures in connection with the use of ABDassets in support of suppression of illicitmaritime trafficking in narcotic drugs andpsychotropic substances ("SSIMT'). Theprocedures outlined below are designed toensure standardization among the JointInteragency Task Force South ("JIATF-S"),Colombian Air Force ("FAC"), and ColombianNavy ("ARC") operations, in a mannerconsistent with the roles and missions of theColombian armed forces, and meet thedomestic legal requirements of each Party.Additional implementing arrangements may becoordinated among JIATF-S, FAC, and ARC.

ANEXO C: USO DE LOS ACTIVOS DEL ABDEN APOYO A LA SUPRESION DEL TRAFICOILiCITO DE ESTUPEFACIENTES YSUSTANCIAS SICOTROPICAS POR VIAMARITIMA

Las Partes convienen en seguir los siguientesprocedimientos para la utilizaciOn de losactivos del ABD en Apoyo a Ia SupresiOn delTrafico Ilicito de Estupefacientes y SustanciasSicotrOpicas por Via Maritima ("ASTIM"). Losprocedimientos que se esbozan a continuackintienen el fin de asegurar, la uniformidad de lasoperaciones de la Fuerza EspecialInterinstitucional Conjunta del Sur ("JIATF-S"),Fuerza Aerea Colombiana ("FAC") y la ArmadaNacional de la Republica de Colombia ("ARC"),de manera coherente con los roles y misionesde las Fuerzas Armadas de Colombia, y queesas operaciones cumplan con los requisitosjuridicos internos de cada Parte. La JIATF-S, laFAC y la ARC podran coordinar entre siacuerdos de implementaciOn adicionales.

I. General

A. The purpose of using the Cessna CitationSR-560 for SSIMT is to support the ongoingefforts of the United States, Colombia, andother nations to counter illicit maritimetrafficking in narcotic drugs and psychotropicsubstances in the Pacific Ocean and CaribbeanSea. ABD missions shall take priority overSSIMT missions, unless otherwise agreed to byJIATF-S and the FAC.

I. Generalidades

A. La utilizaciOn de las aeronaves CessnaCitation SR-560 para el ASTIM tiene el fin decontribuir a los esfuerzos en curso de losEstados Unidos, Colombia y otras nacionespara contrarrestar el trafico ilicito de drogas porvia maritima en el Oceano Pacifico y en el MarCaribe. Las misiones de ABD deberki tenerprioridad sobre las misiones ASTIM a menosque sea acordado de otra forma por JIATF-S yla FAC.

B. Operational areas of SSIMT shall be jointlydetermined by JIATF-S and the FAC. SSIMTmissions shall be conducted in a mannerconsistent with international aviation law andthe international law of the sea.

C. The maximum number of monthly hours thatthe SR-560 aircraft shall be allowed to fly insupport of SSIMT shall be 120 hours permonth. The U.S. Embassy, in coordination withthe FAC and JIATF-S may jointly change thedesignated number of SSIMT hours.

D. For purposes of SSIMT, the SR-560 shall beunder the operational control of the FAC andtactical control of JIATF-S. JIATF-S shall notifyCCOFA of any tactical decisions concerning theSR-560.

E. At a minimum, the GOC shall provide thefollowing participants for SSIMT: the COFAC;the FAC Chief of Air Operations ("JOA"), theCOLNAV Chief of Naval Operations ("JONA"),the director of the COLNAV Center ofOperations ("DICOA"), the OCB; a GSM; anASM; the ODM; the FAC and COLNAV LiaisonOfficers assigned to JIATF-S. The OCBtransmits the COFAC's orders to the ODM.The ODM transmits orders from the OCB to theSR-560 aircraft and supervises compliance bySR-560 aircraft with the procedures and ordersdetailed herein. The FAC and COLNAV LiaisonOfficers assigned to JIATF-S coordinate SSIMTmissions among JIATF-S, the JOA, and theJONA. The ASM and GSM shall be qualified inEnglish. The GSM(s) is the FAC'srepresentative at the Colombian Air ForceCommand and Control Center ("CCOFA")during SSIMT missions. The GSM shall relayall JIATF-S tactical decisions to CCOFA and,when necessary, assist with the transition fromSSIMT to ABD or from ABD to SSIMT. TheASM is the FAC's representative on SR-560aircraft responsible for communicating with theGSM(s) and JIATF-S, and shall report/pass allcollected information to JIATF-S and theCCOFA.

F. At a minimum, the USG shall provide thefollowing participants: a JIATF-S TacticalCommander; a JIATF-S Command Duty Officer(CDO); and a Host Nation Rider (HNR)Assistant, when required. The Host NationRider Assistant shall be fluent in Spanish. TheJIATF-S Tactical Commander exercises tacticalcontrol of the aircraft through the JOC. TheJIATF-S Command Duty Officer is the TacticalCommander's senior watch officer at the COC.The AAOCC, which is located in the CCOFA,shall assist in coordination, informationexchange, and analysis among JIATF-S,CCOFA, and COA.

E. F. El USG proporcionara, como minimo, elsiguiente personal: un Comandante Tactic° dela JIATF-S; un Oficial de Servicio de Mando dela JIATF-S ("CDO"); y un Asistente del HostNation Rider, si se necesita. El Asistente delHost Nation Rider poseera un buen dominio delespanol. El Comandante Tactic° de Ia JIATF-Sejerce control tactic() de las aeronaves a travêsdel COC de la JIATF-S. El Oficial de Serviciode Mando de Ia JIATF-S sera el oficial superiorde vigilancia del Comandante Tactico en elCOC. II. SSIMT Procedures

A. SSIMT missions are executed under threecategories:

The FACshall transfer tactical control of the SR-560 toJIATF-S when a mission originally designatedfor ABD is re-tasked for SSIMT.

B. The SR-560 shall conduct SSIMT missionsin accordance with procedures previouslyestablished for them by JIATF-S, the COLAF,and COLNAV. Information concerning thesurface tracks shall be collected via radarsystems, electro-optical and infrared sensors,radio transmissions, and visual sightings.

(1) For each surface track, the ASM shall reportas much of the following information aspossible:

(a) Vessel Name;(b) Vessel Length;(c) Vessel Flag;(d) Vessel Type;(e) Vessel Position;(f) Vessel Course;(g) Vessel Speed; and(h) Suspect activities in which vessel or crewmembers are engaged, if any.

C. Upon detection of a surface track of interestin coordination with the COLNAV and JIATF-S,the SR-560 should maneuver and attempt radiocommunications with the ST01. Once radiocontact with the surface track of interest isestablished, Right of Approach (ROA)questions should be used to determine thefollowing:

(1) Name of the vessel(2) Nationality of the vessel(3) Home port(4) Official registration number(5) Last port of call(6) Next port of call(7) Purpose of voyage.

C. Cuando se observe un objetivo de interesen la superficie, en coordinaci6n con Ia ARC yIa JIATF-S, Ia aeronave SR-560 maniobrara eintentara establecer comunicaciOn de radio conel mismo.
