AUSTRALIAN HALAL DEVELOPMENT & ACCREDITATION CERTIFICATION

TERMS AND CONDITIONS APPLICATION GUIDELINES

1. All applicants applying for a halal certificate (hereinafter referred to as ‘certificate’) from HDAA, may, upon their satisfying the requirements set out by AHDAA, be issued a certificate in terms provided therein.

2. All applications for the issue of a certificate by AHDAA must be made on the prescribed form available from the AHDAA’ website,http://www.ahdaa.com.au/content/application-form

3. Endorsement scheme is applicable to imported, exported or re-exported product in respect of which a Halal certificate has been issued.

4. No space is to be left blank in the application form, otherwise this may affect the application. If space is insufficient, please attach a separate list. Incomplete or incorrect entries to the application form will disqualify the application. Please enter ‘N/A’ in the respective sections if it is not applicable.

5. The application form must be submitted together with the following basic supporting documents. These documents are also to be made available during inspections and audits;

a) Relevant license, and permit issued by Department of Agriculture or other relevant authorities b) Veterinary Health certificates (for meat-based products) c) Free Sales Certificate (for health-dietary supplement) d) Product Specifications e) Shipment invoices f) Packing Lists g) Valid local and/or overseas Halal certificates of applied products from other Islamic certifying

authorities/agencies where applicable

6. The Halal certificate accompanying the products must contain the following information:

a) Halal certificate number b) Product consignment description c) Quantity d) Product Marks/Brand Name e) Net Mass (to specify no. of cartons/drums) f) Transport medium, name and number g) Departure Port/Airport (if imported) h) Manufacturer/Works/Slaughter-house name and address i) Date of Manufacture/Slaughter j) Consignment number k) Date of issue l) Place of issue m) Official signatory

7. The applicant must ensure that all the guidelines on the application procedures for AHDAA Halal certification and, the conditions and requirements set by AHDAA have been fully met before submitting their application.

8. The duly completed form is to be submitted to AHDAA by hand or post or via on-line together with

application fee stipulated.

9. Each application will be processed with strictest confidence. 10 All successful applicants must not display or use the term, mark or description ‘Halal’, or ‘Muslim food’ or

their equivalent in any language or description to represent that any food or edible item can be consumed by Muslims with or without a certification from AHDAA. Only the AHDAA Halal Certification mark is

permitted

11. The applicant must inform AHDAA in writing if he wishes to change the information given in the application form. AHDAA written approval must be obtained before any change/addition can be made.

12. All Normal application, application must be made 14 days from the scheduled arrival/departure of the products into/from Australia. For Express, application must be made 7 days from the scheduled arrival/departure of the products into/from Australia

13. There must be at least two Muslim employees as Halal Liaison Officers at critical points, determined by AHDAA, assigned to be responsible to verify and maintain the Halal status and ensure that all conditions and requirements set by AHDAA be strictly adhered to (refer to Halal Liaison Officers: Roles & Responsibility)

14. All applications must include the relevant stipulated non-refundable application fees (new applicants)

15. Application that fails to meet AHDAA Halal Certification terms and conditions will be rejected.

I) CERTIFICATION REQUIREMENTS

1. Non-halal and questionable ingredients, determined by AHDAA, must not be used in and or applied on any product applied for.

2. All ingredients used must be clearly and completely submitted:.

a) Details of the sources of all ingredients used (Technical specifications required, if any) b) Detailed chart of the process flow of all ingredients used

c) Detailed chart of the process flow of product manufactured. d) Technical specifications of all end-products e) Valid Halal certificates from reliable and AHDAA recognized Halal certification agencies from

the country origin may be submitted.

3. AHDAA may request for additional product and ingredient information if paragraph (II) section (2) is found insufficient.

4. A Test Analysis Report from any Australian accredited testing laboratories may be required upon notice by AHDAA to confirm that the product does not contain non-Halal ingredients, for instance, animals, animal derivatives and ethanol for all new and renewal applications. The product sample/s for testing must be taken by the above test agency personally or by a AHDAA personnel from the applicant’s premises and sealed with an approved AHDAA security seal. The applicant is to bear the cost of the laboratory testing.

5. All Halal products must be stored separately from non-Halal items, and there must be a clear demarcation being put up to distinguish them. Physical contamination between the equipment used for Halal and non-Halal food, which may occur during receiving or storing should be avoided.

6. Every carton and basic packaging must be clearly labeled legibly in English with the following particulars a) Description of the product b) Origin c) Brand name of the product d) Name and address of manufacturer/slaughterhouse e) Name and designation number of processing establishment/slaughter-house f) Date at which the product was manufactured or slaughter date g) Name and designation number of packing establishment (s) h) The batch number i) Weight of the product as contained in each packaging j) Number of basic packages in each carton k) Halal certification mark and detail information of the CB who issued the Halal certificate

7. There must be at least two permanent Muslim employees as Halal Liaison Officers at critical points, determined by AHDAA, assigned to be responsible to verify and maintain the Halal status and ensure that all conditions and requirements set by AHDAA be strictly adhered to (refer to Halal officer: their roles and responsibility)

8. Any printed or published materials, posters and advertisements that may offend the Muslim public are not allowed. Successful applicants are required to obtain AHDAA’s prior clearance for any advertisements in any form of media.

9. All staff must be given a copy of and proper briefing on the AHDAA’s guidelines and requirements on the issue of Halal certification for their information and strict compliance.

10. AHDAA will only certify Halal on one type of product per consignment basis. A separate application is required for more than one product although shipped in the same consignment.

IV) HALAL CERTIFICATION AUDITING &INSPECTION

1. AHDAA conducts audits and inspections on applied consignments before the issuance of Halal certificates are considered.

2. The applicant must give full co-operation by providing any relevant information required. Repeat audit and inspections will be conducted when necessary.

3. Surprise periodic checks may be conducted after the applicant has been issued with AHDAA Halal certification.

V) RESULTS

1. The applicant will be notified on the results of his application by email,post or phone or fax.

2. Successful applicants will be informed to collect the Halal certificate (s) at AHDAA. He must pay the relevant non-refundable fees as stipulated before issuing of certificate (s). Payments can be made by cheque. Cheque payment must be crossed and be made payable to AHDAA.

VI) AHDAA HALAL CERTIFICATE,CERTIFICATION AND AHDAA HALAL CERTIFICATION MARK

1. The AHDAA Halal Certificate and or any part of it is the property of AHDAA. The certificate holder will be held responsible to the halal certificate(s) issued to him/her. The certificate and or any part of it is not transferable and copied without written approval from AHDAA.

2. The Halal certificate is issued to the applicant only after AHDAA has inspected the applied product (s)and is satisfied that the product(s) meet Halal requirements and that all conditions set by AHDAA have been complied with.

3. The valid original certificate issued for the purpose intended to must be kept and only produce them when required. Original, photocopied and expired Halal certificate(s) must not be displayed.

4. The applicant must file a police report for any loss of certificate immediately and extend a copy of it to AHDAA.

5. The certificate issued remains the property of AHDAA and shall be returned immediately upon AHDAA request.

6. The certificate holder will be held responsible for the Halal certificate(s) issued. The certificate and or any part thereof are NOT TRANSFERABLE.

7. The AHDAA Halal Certification Mark and/or any part of it is the property of AHDAA, all parties interested to use and reproduce the AHDAA Halal Certification Mark and or any part of it in any kind, must get prior written approval from AHDAA.

8. The certificate holder must make use of AHDAA Halal Certification Mark when printing the word ‘HALAL’ on the product label or packaging specified.

VII) OTHERCONDITIONS

1. In the event of a public complaint, the applicant is answerable to AHDAA and must provide a written explanation regarding the matter.

2. The applicant shall at all times indemnify and keep indemnified AHDAA fully and completely against all claims, damages, expenses or costs (including those asserted by third parties) arising directly or indirectly from his acts, errors or omissions.

3. In the event of any breach, AHDAA reserves the right to withdraw the certificate issued and all Halal signs must be surrendered to AHDAA upon request.

4. AHDAA may, from time to time, change the requirements for the application and issue of a certificate and or issue such directives, as AHDAA deems fit for the compliance by a holder of AHDAA’s Halal certificate.

5. AHDAA will review all applications if it is deemed necessary.

6. The decision of AHDAA in respect of all matters shall be final.

XI. HALAL OFFICER ROLES &RESPONSIBILITIES

1. Perform basic Islamic practice such as daily compulsory prayers, Fast during the month of Ramadhan,to name a few

2. Must be aware of basic halal requirements in addition to AHDAA Halal Certification requirements.

3. To ensure that the Halal standard, as specified by AHDAA, is being met at all times and in all line of food production processes.

4. Maintain records as specified in Halal Certification Requirement.

5. To ensure that all product ingredients used is Halal.

6. Responsible in the receiving of Halal food related goods.

7. To ensure that vehicles used to transport and delivery of food/product should be exclusively used for Halal products only.
