A N O R D I N A N C E F U R T H E R TO A M E N D T H E T R I A L U P O N I N F O R M A T I O N O R D I N A N C E .

B E IT E N A C T E D by the H i g h Commissioner for Palestine, with the advice of the Advisorv Council thereof :—

1. This Ordinance may be cited as the Tr ia l Upon Information (Amendment) Ordinance, 1937.

Short title.

2. I n this Ordinance the principal Ordinance means the Tr ia l Upon Information Ordinance, 1924.

Interpretation.

3. Section amended —

14 of the principal Ordinance shall be further

(a) by the insertion of the words "or his advocate" between the words "accused person" and "sha l l be at l i b e r t y " ; and

(b) by the deletion of the word "personal ly" ; and

(c) by the insertion between the words "by the Magistrate" and "and afterwards" of the words "or by some other person in the presence of the Magistrate as the Chief Justice may direct either generally or in any particular class of case".

Amendment of section 14 of the principal Ordinance.

4. Section 26 of the principal Ordinance shall be amended by the substitution of the following sub-section for sub-section (i) thereof :—

"(1) No person shall be put upon his trial upon information before the Court of Criminal Assize or a District Court, not­withstanding that he may have been committed for trial by a Magistrate, except upon an information filed by or on behalf of the Attorney-General in the Court in which he is to be tried.

Every information shall be drawn up in accordance with the rules in the schedule to this Ordinance :

Provided that the Chief Justice may, with the concurrence of the H i g h Commissioner, add to, vary or revoke such rules.

Every information shall contain and shall be sufficient if it contains, a statement of the specific offence or offences with which the accused person is charged, together with such par­ticulars as may be necessary for giving reasonable information as to the nature of the charge.

Notwithstanding any rule or law or practice,, an information shall , subject to the provisions of this Ordinance, not be open to objection in respect of its form or contents if it is framed in accordance with the roles under this Ordinance,"

Substitution of new section for section 28 of the principal Ordinance.

5. Section 28 of the principal Ordinance shall be deleted and the following section substituted therefor :—

"28. Subject to the provisions of the rules in the schedule to this Ordinance, charges for more than one felony or for more than one misdemeanour and charges for felonies and misdemeanours may be joined in the same information."

Substitution of new section for section 29 of the principal Ordinance.

6. Section 29 of the principal Ordinance shall be deleted and the following section substituted therefor : —

"29.—(1) Where, before tr ia l , or at any stage of a tr ia l , it appears to the Court that the information is defective, the Court shall make such order for the amendment of the inform­ation as the Court thinks necessary to meet the circumstances of the case, unless, having regard to the merits of the case, the required amendments cannot be made without injustice.

(2) At any time during the proceedings before the judgment the Court before which an information is tried may amend or cause to be amended the charge or charges contained, in the i n ­formation or may add thereto a new charge, notwithstanding that such new charge is one within the jurisdiction of some other Court to fry upon information, or one which could be tried summarily :

Provided that no charge may be added which is not supported by evidence taken before the Magistrate or which renders the person charged liable to a greater punishment than does any charge in the information as originally filed.

(3) Where an information is amended, a note of the order for amendment shall he endorsed on the information, and the information shall be treated for the purposes of the trial and for the purposes of all proceedings i n connection therewith as having been originally presented in the amended fcrm.

(4) Where, before tr ia l , or at any stage of a t r ia l , the Court is of opinion that a person accused may be prejudiced or embar­rassed in his defence by reason of being charged with more than one offence in the same information, or that for any other reason it is desirable to direct that the person should be tried separately for any one or more offences charged i n an informa­tion, the Court may order a separate trial of any count or counts of such information.

(5) Where, before tr ia l , or at any stage of a t r ia l , the Court is of opinion that the postponement of the trial of a person accused is expedient as a consequence of the exercise of any power of the Court under this Ordinance to amend an inform­ation or to order a separate trial of a count, the Court shall make such order as to the postponement of the trial as appears necessary.

(6) Where an order of the Court is made under this section for a separate trial or for the postponement of a tr ial —•

(a) the procedure under separate trial of a count shall he the same i n all respects as if the count had been a separ­ate information and the procedure on the postponed trial shall be the same i n all respects as if the trial had not commenced; and

(b) the Court may make such order as to admitting the accused person to bail or as to the enlargement of the recognizances and otherwise as the Court thinks fit.

(7) Any power of the Court under this section shall be in addition to and not in derogation of any other power of the Court for the same or similar purposes."

7. Section 34 of the principal Ordinance shall be amended by the insertion between the words "on proof" and the words "that the witness cannot be produced" of the words "to the reasonable satisfaction of the Court . "

Amendment of section 34 of the principal Ordinance.

8. Section 48 of the principal Ordinance shall be amended —

(a) by the insertion between the words "the conviction" and the words "of any person" and between the words "the con­v ict ion" and the words " i s based", respectively, of the words "or acquit ta l " ; and

Amendment of section 48 of the principal Ordinance.

(b) by the deletion of the words from "provided that such of-ence" to "offence charged" inclusive, and the substitution therefor of the following words : —

"notwithstanding that such offence is one within the jurisdiction of some other Court to try upon information, or one which could be tried summarily :

Provided that such offence be covered by the evidence in the case and by findings of fact necessary to establish it and does not render the accused person liable to a greater punishment than does any charge in the information."

9. Section 50 of the principal Ordinance shall be deleted and the following section substituted therefor : —

"50.—(1) Adhere upon the trial of any person it appears to the Court that he was guilty of the offence with which he is charged but that at the time of the commission of such offence he was, by reason of any disease affecting his mind, incapable of understanding what he was doing or of knowing that he ought not to have done the act or make the commission cons­tituting the offence, the Court shall return a special verdict of " G u i l t y but insane" (or " G u i l t y but insane by reason of intox­ication") , and shall direct that such person shall be detained during the pleasure of the H i g h Commissioner.

(2) Where in the course of preliminary enquiries before a Magistrate or of a trial upon information, it appears to the Magistrate or the Court that the person charged is insane so that he cannot be tried, the Magistrate or the Court shall direct him to be detained during the pleasure of the H i g h Commissioner.

Substitution of new section for section 50 of the principal Ordinance.

Where it is certified by two Government medical officers that a person detained under the provisions of this sub-section is sane and the H i g h Commissioner is satisfied that it is proper to do so, he shall direct that such person shall be tried, according to law, for the offence with which he was charged.

(3) The H i g h Commissioner may from time to time give directions as he thinks fit as to the custody of persons directed to be detained under the provisions of this section."

Kepeal of section 61 of the principal Ordinance.

Amendment of section 69 of the principal Ordinance.

10. Section Gl of the principal Ordinance, as enacted in section 7 of the Trial Upon Information (Amendment) Ordinance, 1929, is hereby repealed.

11. Section 67 of the principal Ordinance is hereby amended by the deletion of the words from " i f the Court" to "being heard" inclusive.

12. Section 68 of the principal Ordinance shall be amended —

(a) by the insertion of the expression ' ' (1)'' after the expression " 6 8 " ; and

(6) by the addition of the following proviso thereto :—

"Provided that if the appeal is by the Attorney-General, the provisions of this sub-section shall only apply to evid­ence which was tendered to the Court of Criminal Assize or the District Court and which was, in the opinion of the Court of Appeal, wrongly rejected by such C o u r t ; "

and

(c) bv the addition of the following sub-section as sub-section (2)":—

' ' (2) The Court of Appeal may require the Court of C r i m ­inal Assize or the District Court to furnish fuller or addi­tional findings of fact upon which the conviction or acquittal was based."

13. Section 69(1), paragraph (c), of the principal Ordinance shall be amended by the substitution for the wrords "quash the conviction a n d " of the words " i f the appeal is by the accused, quash the conviction, and whether the appeal is by the accused or bv the Attorney-General" .

Addition of schedule to the principal Ordinance.

14« The schedule to this Ordinance shall be as a schedule to the principal Ordinance.

15. The substitution of new sections 26(1), 28 and 29 shall not be deemed to affect any information filed prior to the commence­ment of this Ordinance or the trial of any person upon any such information or any appeal from such tr ia l , and old sections 26(1), 28 and 29 shall be deemed to apply to such information and to the trial of any such person thereon or any appeal therefrom as though this Ordinance had not been passed.

(3) The names of all witnesses who gave evidence at the preli­minary enquiry shall he endorsed on the back of the information.

(4) A n information shall not be open to objection by reason only of any failure to comply with this rule.

2.—(1) The commencement of the information shall be in the following form :—

Charges for any offences, whether felonies or misdemeanours, Joining of may be joined in the same information if those charges are founded charges on the same facts or form or are a part of a series of offences of the information same or a similar character and notwithstanding that some of them are within the jurisdiction of some other Court of inferior jurisdic­tion to try upon information or might be tried summarily.

.4.—(1) A description of the offence charged i n an information, Mode i n or where more than one offence is charged in an information, of which each offence so charged, shall be set out in the information i n a areTcTb separate paragraph called a count. charged.

(2) A count of an information shall commence with a statement of the offence charged, called the statement of offence.

(3) The statement of offence shall describe the offence shortly i n ordinary language, avoiding as far as possible the use of tech­nical terms, and without necessarily stating all the essential elements of the offence, and if the offence charged is one created by any law or Ordinance, shall contain a reference to the section of the law or Ordinance creating the offence.

(4) After the statement of the offence, particulars of such of­fence shall be set out in ordinary language, i n which the use of technical terms shall not be necessary :

Provided that where any rule of law or any law or Ordinance l imits the particulars of an offence which are required to be given in an information, nothing in this rule shall require any more parti­culars to be given than those so required.

(5) The forms set out in the appendix to these rules, or forms conforming thereto as nearly as may be, shall be used in cases to which they are applicable, and in other cases forms to the like effect or conforming thereto as nearly as may be shall be used, the statement of offence and the particulars of offence being varied ac­cording to the circumstances in each case.

(6) Where an information contains more than one count the counts shall be numbered consecutively.

Provisions 5.—(!) Where an enactment constituting an offence states the statutor offence to be the doing or the omission to do any one of any offences. different acts in the alternative, or the doing or the omission to do

any act in any one of any different capacities, or with any one of any different- intentions, or states any part of the offence i n the al ­ternative, the acts, omissions, capacities, or intentions, or other matters stated in the alternative in the enactment, may be stated in the alternative in the count charging the offence.

(2) It shall not be necessary, in any count charging a statutory offence, to negative any exception or exemption from or qualifica­tion to the operation of any law or Ordinance creating the offence.

Description 6.—(1) The description o f property in a count in an information of property. shall be in ordinary language and such as to indicate with reason­

able clearness the property referred t o , and if the property is so described it shall not he necessary (except when required for the purpose of describing an offence depending on any special ownership of property o r special value o f property) to name the person to whom the property belongs or the value of the property.

(2) Where property is vested in more than one person, and the owners o f the property arc referred to in an information it shall be sufficient to describe the property as owned by one of those per­sons by name with others, and if the persons owning the proper­ty are a body of persons with a collective name, such as " Inhabit ­ants" , "Trustees" . "Commissioners" , or " C l u b " or other such name, it shall be sufficient to use the collective name without naming any individual. A n y property of his Majesty's Nava l , Mi l i tary or A i r Forces may be described as "the property of H i s Majes ty" , and any property of the Government of Palestine may be described as "the property of the Government".

Description 7. The description or designation in an information of the of persons. accused person, or of any other person to whom reference is made

therein, shall he such as is reasonably sufficient to identify h i m , without necessarily stating his correct name, or his abode, style, degree, or occupation; and if , owing to the name of the person not being known, or for any oilier reason, it is impracticable to give such a description or designation such description or designation shall be given as is reasonably practicable in the circumstances, or such person may be described as " a person unknown" .

Description 8. Where it is necessary to refer to any document or instrument of document. j n a n information, it shall be sufficient to describe it by any name

or designation by which it is usually known, or by the purport thereof, without setting out any copy thereof.

General rules as to description.

9. Subject to any other provisions of these rules, it shall be sufficient to describe any place, time, thing, matter, act, or omis­sion whatsoever to which it is necessary to refer in any information, in ordinary language in such a manner as to indicate with reasonable clearance the place, time, thing, matter, act or omission referred to.

Statement 10. It shall not he necessary in stating any intent to defraud, of mtent. deceive or injure to state an intent to defraud, deceive or injure

any particular person where the law or Ordinance creating the offence does not make an intent to defraud, deceive or injure a par­ticular person art essential ingredient of the offence.

O B J E C T S A N D R E A S O N S .

The object of this Ordinance is to make detailed amendments to the Tr ia l Upon Information Ordinance and to provide for the drafting of informations upon pr in­ciples similar to those upon which indictments are drafted in England.

2. I n particular the Ordinance provides that the advocate of an accused person may cross-examine witnesses at a preliminary hearing.

3. It clarifies the law with regard to accused persons who are alleged to be i n ­sane, it makes clear the powers of the Court of Criminal Appeal and it provides that there shall not be an automatic appeal when a death sentence has been pronounced.

A N O R D I N A N C E T O A M E N D T H E C U S T O M S O R D I N A N C E , 1929.

B E I T E N A C T E D by the H i g h Commissioner for Palestine, with the advice of the Advisory Council thereof :—

1. This Ordinance may be cited as the Customs (Amendment) Ordinance, 1937, and the Customs Ordinance, 1929, (hereinafter referred to as the principal Ordinance), the Customs (Amendment) Ordinance, 1932, the Customs (Amendment) Ordinance, 1935, the Customs (Amendment) Ordinance, 1936, and this Ordinance may together be cited as the Customs Ordinances, 1929-1937.

2. Section 126 of the principal Ordinance (as enacted in section 5 of the Customs (Amendment) Ordinance, 1932) shall be repealed, and the following section substituted therefor :—

" T i m e for ascertaining the rate of import duties.

126. Save as provided in section 138 of this Ordinance, all import duties shall be paid i n ac­cordance wi th the tariff in force at the time such duties are paid to the proper officer :

Provided that in the case of all goods imported through the parcel post import duties shall be paid i n accordance with the tariff in force at the time when assessment of such duties is made by the proper officer at the Post Office."

Substitution of new section for section 126 of the principal Ordinance.

O B J E C T S A N D R E A S O N S .

This Ordinance removes an ambiguity in section 126 of the Customs Ordinance, 1929, which prescribes the time for ascertaining the rate of duty on imported goods. That section provides that the import duty shall be paid — " i n accordance with the tariff i n force at the time the entry for delivery of the goods is passed by the proper officer". Doubts have arisen as to when the entry for delivery of goods "passes" , and although the practice in Palestine has been to assess the duty in accordance with the tariff i n force at the moment when the duty is actually paid, which would seem to be the fairest and most desirable time, section 30 to 36 of the principal Ordinance appear to indicate that the passing of the entry may occur before the duty is actually paid.

2. Section 126 of the principal Ordinance has accordingly been replaced by a section providing i n clear terms that import duty on goods wi l l be assessed as at the moment when the duty is i n fact paid. A proviso has been added in order to con­form with the provisions of sections 29 and 34 of the principal Ordinance.
