1 .O Introduction

The A//amt.&y Township Well Testing Program was conducted during thelatter half of 1996 with the aid of a New Jersey Department of Environmental Protection(NJDEP) Office of Environmental Services Matching Grant (ES95006). The projectscope was designed and coordinated between the Allamuchy Township EnvironmentalCommission, PK Environmental, and GeoEnvironmental Research to analyze theTownship’s aquifer groundwater quality. Analytical parameters were chosen for testingat the seven strategically selected wells shown on Figure 1, Well Location Map, andFigure 2, Allamuchy Township Aquifer Map, and listed on Table 1.

Well No. 1 on Johnsonburg Road was sampled because traces of volatile organiccompounds had been detected in previous sampling events, according to theEnvironmental Commission. This public non-community supply well is also locatedin due proximity to the Town center, and an abandoned gasoline/service station.This area appears to be situated in carbonate bedrock, near the crystalline bedrockcontact, however at this time it is uncertain which aquifer is supplying this well.

Well No. 2 is a newly installed domestic well located in the Waterloo section of townwithin 100 feet of the Musconetcong River. The well appears to be in the carbonateaquifer downgradient within 100 feet of the crystalline bedrock contact. Thisresidence is the site of a recently remediated leaking underground fuel oil tankwhere the original shallow well was decommissioned.

Well No. 3 is a domestic well located in carbonate bedrock off Gibbs Road about1000 feet cross-gradient from an active junk yard. An unnamed stream runs about150 feet from the well and junk yard.

Well No. 4 is a domestic well located in carbonate bedrock on Bear Creek Roadacross from agricultural land where probable shallow sinkhole depressions wereobserved.

Well No. 5 is a domestic well located in fractured crystalline bedrock on PetersDrive in the vicinity of Ridge Road within a new residential development near theTownship of Independence border.

Well No. 6 is located on Youngs Island Road adjacent to an active agricultural area.This well appears to be in the carbonate bedrock aquifer within 500 feetdowngradient of the crystalline bedrock contact.

Well No. 7 is a domestic well located in carbonate bedrock on Ervey Road.

2.0 Purpose of the Study

Recognizing the importance of protecting the Township’s drinking water, theAllamuchy Township Environmental Commission originally sought to identify Well HeadProtection Areas for public non-community supply wells, and to makerecommendations for land use management to protect wells from contamination. TheAllamuchy Township Well Testing Program matching grant project scope wasrevised to specifically analyze the Township’s aquifer groundwater quality by testingchosen analytical parameters at seven Township wells. These wells were selectedfollowing the determination of the primary aquifers within the Township as shown onFigure 2. The selected general parameters which were analyzed at individual wells areshown on Table 2. Test results will be used by the Environmental Commission todocument and evaluate existing aquifer water quality, and to establish a preliminarybaseline for comparison and monitoring of future water quality trends within theTownship.

Within the Safe Drinking Water Act (SDWA), amended through July 1996, theFederal Environmental Protection Agency (EPA) has implemented a nationwideprogram to protect groundwater resources used for public water supplies from allpotential threats generated by human activities. The SDWA of 1974 mandated thatnationwide standards be established to help insure that the public receives safe waterthroughout the United Sates.

The SDWA defines contaminant as any physical, chemical, biological, orradiological substance or matter in water. Maximum contaminant Level (MCL) indicatesthe maximum permissible level of a contaminant in water that is delivered to any user ofa public water system. The act clearly delineates between health-related qualitycontaminants as primary contaminanfs and aesthetic-related contaminants assecondary contaminants. The maximum contaminant levels required by the NationalDrinking Water Standards are presented in the Federal Register 40 (40 CFR 161-163Revised National Primary Drinking Water Regulations, Appendix A).

. Any more stringent maximum contaminant levels for hazardous contaminants listedin NJAC 7:10-16 Safe Drinking Water Act Maximum Contaminant Levels ForHazardous Contaminants.

NJDEP’s Ground Water Quality Standards (NJAC 7:9-6) provide the rules ofthe NJDEP concerning ground water classification, designated uses of ground water,and ground water quality criteria and constituent standards, pursuant to the WaterPollution Control Act and the Water Quality Planning Act. These standards provide thebasis for protection of ambient ground water quality through the establishment ofconstituent standards for ground water pollutants. In addition, these standards specifythe criteria for potable ground water.

NJDEP’s Ground Water Quality Standards are as stringent or more stringentthan the National Primary Drinking Water Regulations and the NJDEP’s Safe DrinkingWater Act Maximum Contaminant Levels For Hazardous Contaminants, with theexception for the maximum contaminant level values for vinyl chloride and I,1 ,ITrichloroethane. The values depicted in the individual well tables, in Section 5.0(Results) of this report, for vinyl chloride and l,l, 1 Trichloroethane are from NJAC 7:10-16 “Safe Drinking Water Act Maximum Contaminant Levels For HazardousContaminants” as they are the more stringent values.

3.0 Field Methodolow

Groundwater samples were collected from six domestic and one public non-community (PNC) water supply wells on October 8, 1996, by John Q. Robinson, CPG,and Sandra Kehrley, PE. In addition, a field blank was also collected, and a trip blankwas incorporated into the sampling program.

The six domestic groundwater samples were collected during a constant rainfrom the homeowner’s outside tap. This was done to bypass optional water treatmentchemicals and equipment such as water softeners. The sample taken at the PNC well(Well No. 1) was collected from an inside cold water tap. The aeration screen at theschool was removed prior to sample collection. Each well was purged for at least 15minutes before sampling. Well Nos. 2, 4, 5, 6, and 7 were sampled after audibleconfirmation of well pump start-up. Well No. 3, which is reportedly over 200 feet deep,was purged for one-half hour before sampling, and Well No.1 was sampled after lunchwhich is a time of increased water usage. Following is the order of sample parametercollection at each well:

l Bacteria (fecal coliform and fecal streptococcus)

All field samples were packed in ice and transported to the Industrial ControlManagement (ICM) laboratory in Randolph, New Jersey in accordance with standardchain-of-custody protocol, with the exception of the bacteriological sample for Well No.2, which was received by the laboratory 10 minutes beyond the regulatory holding timeof six hours.

4.0 Laboratory Analyses

Three labs participated in the groundwater analyses, with all of the laboratory results beingpresented in Appendix D:

Key Technology, Inc. analyzed radon in groundwater with all samples testing belowthe 40,000 pCi/L (picocuries per Liter) action level for radon in water. These watersample results were received from Key Technology on October II, 1996.

Industrial Corrosion Management (ICM), Inc. did the analyses for volatile organics,priority pollutant metals at Well No. 3, fecal coliform, fecal streptococcus, chloride,nitrogen nitrate, nitrogen ammonia, sulfate, turbidity, total dissolved solids, andpetroleum hydrocarbons at Well No. 1. Water sample results of these analyticalparameters were received from ICM Labs on October 28, 1996, with the exception ofpesticides and PCB’s which was subcontracted to Lancaster Laboratories.

Lancaster Laboratories analyzed pesticides and PCBs at Well No. 6 with the resultsbeing N.D. (none detected) within the EPA 505 method detection limits in ug/l(micrograms per liter). These water sample results were received from Lancaster Labson November 12, 1996.

5.0 Results

Except for the fecal coliform results for Well No. 7, the results of the laboratoryanalyses indicate that all well sample parameters were non-detectable or detected atconcentrations below NJDEP groundwater standards and USEPA and NJDEP drinkingwater standards. (Individual well summary tables immediately follow this section).

Volatile Organic CompoundsResults of the VOC screen indicate that only one VOC, the compound 1 ,I ,ITrichloroethane, was detected in Well No. 1.This chemical is used as a cleaner and degreaser of metals, and generally getsinto drinking water by improper waste disposal. This VOC was detected at theinstrument quantitation limit of 1 ug/l with the NJDEP Primary Drinking Waterregulation for this compound being 26 ug/l. There were no VOCs detected inthe field or trip blanks. All other well samples for VOC’s were analyzed asundetectable.

No. 1, or in the associated field blank.. Pesticides and PCBs were analyzed for but not detected in Well No. 6.. Priority pollutant metals were analyzed for but not detected in Well No. 3.

General Chemistry Parameters. Chlori$z concentrations ranged from 129 mg/l in Well No. 1 to 2.6 mg/l in

Well No. 2 (the NJDEP groundwater standard for this compound is250,000 mg/l).

. Nitrate ranged from 6.3 mg/l in Well No. 4 to non-detectable in Well Nos.2, 3 and 5.

. Ammonia was not detected in any wells.

. Sulfate was detected at concentrations ranging from 29.1 mg/l in Well No. 3to 13.3 mg/l in Well No. 7.

. Turbidity concentrations ranged from 1.9 nephlometric turbidity units (NTUs)in Well No. 3 to 0.15 NTUs in Well No. 7.

. Total dissolved solids (TDS) ranged from 575 mg/l in Well No. 1 to 135mg/l in Well No. 5. The NJDEP groundwater standard for TDS is 500 mg/l.

Bacterial. Fecal streptococcus bacteria was not detected in any well samples.. Fecal coliform was detected in Well No. 7 at a concentration of 1

colony/l00 ml. This positive result exceeds USEPA and NJDEP safe drinkingwater standards, and NJDEP groundwater standards.

RadonRadon concentrations ranged from 2,296 picocuries per liter (pCi/L) in Well No.6 to non-detectable in Well Nos. 3 and 7. The groundwater standard for radonis 40,000 pCi/L. Low levels of radon were detected in carbonate aquifer wells 1,2, 4, and 6. Wells 1, 2 and 6 are located near contacts with upland graniticcrystalline bedrock which may be recharging residual radon enrichedgroundwater to the carbonate aquifer.

Maximum Contaminant levels

The EPA’s “National Primary Drinking Water Regulations - MaximumContaminant levels” were taken from the Code of Federal Regulations 40 CFR141.11 through 141.13 and 141.60 through 141.62.

NJDEP’s Ground Water Criteria values were taken from NJAC 7:9-6 WaterPollution Control Appendix. The column entitled “Higher of the PQLs andGround Water Quality Criteria” was used as per N.J.A.C. 7:9-6.9 ( c )Microbiological and Turbidity values were taken from NJDEP’s SecondaryDrinking Water Regulations N.J.A.C. 7:10-7.

EPA’s states that 10,000 pCi/L of radon in water contributes about 1 pCi/L toradon in air levels, therefore the action level for radon in water is 40,000 pCi/L(equivalent to 4 C’/Lp I In air). This data was supplied by KEY Technology Inc.

I 6.0 Remediation

-

The investigation of groundwater resources in Allamuchy Township, within thescope of this Well Testing Program, has provided primarily good results, yet has raisedconcerns with respect to monitoring of the water supply. Based on the review of theavailable information and test results, some remediation measures should beconsidered wherever detected or positive results have been identified. While it appearsthat there are no immediate threats to groundwater supplies, not currently monitored byTownship officials, consideration should be given to the following:

Installation of activated carbon water filters at the Well No. 1 water supply outlets toremove the detected traces of VOC’s (I, 1, I-Trichloroethane). Activated carbonfiltration uses any of several carbonaceous materials such as bituminous coal,coconut shells, lignite, peat, or wood to sorb organic contaminants which adhere tothe exposed surfaces of the carbon pores. Studies have indicated that activatedcarbon is most effective in removing large (high molecular weight) impurities andthose with relatively low solubility in water, such as pesticides, benzene, andhalogenated organics such as trichloroethylene (TCE).

Regarding the elevated results of Total Dissolved Solids at Well No. 1, aluminumsulfate (alum) is used as a coagulant to remove color, turbidity, and bacteria inconnection with rapid sand filtration.

Well No. 7 which is located in the Quaker Church area of the Township, shouldconsider resampling and analysis for fecal coliform to confirm the detectableconcentration in this well. The presence of fecal coliform or E. coli in drinking wateris associated with sewage or animal wastes, but is generally a result of problemswith malfunctioning individual septic systems, water treatment or the pipes whichdistribute the water. Remediation of fecal coliform can be achieved through thefollowing measures, although some of these measures are recommended for largewater supply

Appropriate placement, construction, pipe replacement and repairproceduresMaintenance of a disinfectant residual within the systemPeriodic system purging and flushingMaintenance of positive water pressureFiltration and disinfection using strong oxidants such as chlorine,chlorine dioxide, ultraviolet filter or ozoneCompliance with the requirements of the State’s Wellhead ProtectionProgram

Based on some of our preliminary research regarding PNC wells in theTownship, it appears that most of the PNC well operators are not in compliance withthe sampling and analysis schedule as mandated by the Clean Water Act. Scheduledsampling of the PNC wells will provide long-term monitoring of groundwater quality ingrowth areas such as the Route 517 corridor. In addition, static water level data,collected some time after a period of non-pumping, should be required and monitored

by the Township to establish baseline water quantity data, and to evaluate potentialtrends of water level decline. Township PNC well operators should be reminded oftheir responsibility to comply with safe drinking water standards. In areas where knownor potential contaminant sources are located within the Township, the local healthdepartment should become active in researching and determining that cleanup isachievable and documented.

To protect groundwater supplies in place of remediation, several preventativeand proactive measures can be implemented with respect to non-point source pollution.Township home and property owners should understand that septic systems should beinspected and maintained on a frequent basis. Old and faulty septic systems should bereplaced, and the use of organic solvents to clean septic systems should be prohibited.In areas where storage of hazardous substances are permitted, such as the storage ofpesticides in agricultural areas, the storage facility should be designed with a concretefloor to confine spills, and be well ventilated.

Municipal stormwater management ordinances and land use controls should beexpanded and enhanced with respect to septic design standards and retention-detention basin standards. Properly designed basins will allow adsorption of non-pointpollutants into basin substrate materials as the stormwater recharges the aquifer. Anitrogen loading analysis should be considered for projected high density zones wherepermeable soils exist, since high concentrations of nitrogen can degrade groundwater.Wetlands protection should be encouraged since wetlands act to purify groundwater.

The 1994 NJDEP Best Management Practices Manual presents recent andinnovative land use planning and site design techniques for stormwater and non-pointsource pollution control, including retrofitting of developed areas.

to enforce the provisions of the New Jersey Safe DrinkingWater Act (N.J.S.A. 58:12A-1 et seq.) and the regulationspromulgated thereunder. A violation of the provisions ofsuch orders constitutes a violation of the Act, and violatorsare liable to civil penalties of not more than $5000 for eachoffense; each day of a continuing offense constituting aseparate and distinct offense. SUBCHAPTER 4. DISINFECI’ION

7:10-4.1 Disinfection(a) Except in accordance with the provisions of subsec-

tion (b) of this section, every public community water systemshah disinfect all water in accordance with section 13 ofsubchapter 11, in order to insure delivered water that is ofmicrobiologically safe quality.

(b) Except for public community water systems that uti-lize surface waters, a system that serves 100 or fewerdwellings or properties may elect not to disinfect its watersupply, provided that if it adopts this option it shall increasethe number of microbiological samples taken from its distri-bution system to a minimum of two samples per monthtaken at biweekly intervals.

(c) Notwithstanding the provisions of subsection (a) and(b) of this section, any public community water system, orpublic non-community water system, may be required todisinfect its water supply if, in the opinion of the Depart-ment, said water supply is microbiologically unacceptable orquestionable.

(d) Any public water system that purchases treated waterfrom another public community water system on a regularor continuous basis may be required to redisinfect saidwater if deemed necessary by the Department.

.7:10-5.2 Discretional changes to National Regulations(a) In accordance with the discretional authority permit-

ted by the National Regulations, for compliance with theNew Jersey Primary Drinking Water Regulations, the fol-lowing provisions shah apply:

--+ 1. Turbidity:

i. The Department may establish a monthly a&ageturbidity MCL up to five turbidity units (5 T.U.)‘jat arepresentative entry(ies) to the distribution system for aparticular water system (hereinafter in this subsectionreferred to as a “turbidity exception”) provided that thesupplier of water can demonstrate to the satisfaction ofthe Department that the higher turbidity will not inter-fere with disinfection, prevent maintenance of an effec-tive disinfectant agent throughout the distribution sys-tem, or interfere with microbiological determinations.(National Regulations, 40 CFR 141.13(a)).

ii. In considering requests for a turbidity exceptionthe Department will take into account the previousmicrobiological testing results of the water system, thedegree of development in the watershed and its poten-tial for contamination, and any history available to theDepartment of diseases suspected to be of waterborneorigin that have occurred within the service area of thewater system.

iii. A request by a supplier of water for a turbidityexception shall be submitted in writing to the Bureau ofPotable Water, Department of Environmental Protec-tion, P.O. Box CN-029, Trenton, New Jersey, 08625,and shall include, as a minimum, the following:

(1) A report on a sanitary survey of the watershed,conducted within six months prior to the date of therequest, listing probable sources of contamination.

(2) Results of a series of Standard Plate Counttests conducted on at least ten days during the thirtydays prior to the date of the request. Each seriesshall comprise tests of the water prior to and immedi-ately following disinfection and at least three tests ofwater collected from representative points within thedistribution system, the locations of ‘which are shownon a map of the distribution system.

(3) A daily record of chlorine residuals for a peri-od of not less than thirty days immediately prior tothe date of the request, indicating maintenance of afree chlorine residual of not less than 0.1 mg/l atrepresentative point within the distribution system,the locations of which are shown on a map of thedistribution system.

(4) A record of turbidity data for the entrypoint(s) to be considered for the turbidity exceptionshowing that the turbidity, based on a monthly aver-age over the twelve months immediately prior to thedate of the request, does not exceed 5 T.U.

(5) Results of a seiies of microbiological testsconducted on at least five days during the twelvemonths immediately prior to the date of the requeston days during which the turbidity of the deliveredwater exceeded 1 T.U. Such tests shall be on sam-ples collected from the entry point(s) into the distri-bution system and shall be conducted by both themembrane filter and the fermentation tube methods.

(6) A map of the distribution system showing thelocations from which samples of water were taken forStandard Plate Count and chlorine residual determi-nations as above mentioned.

iv. If the Department is satisfied, on the basis of thedata submitted and upon its own judgment, that thegranting of the turbidity exception will not interferewith disinfection, prevent maintenance of an effectivedisinfectant agent throughout the distribution system,interfere with microbiological determinations, or be ahazard to health, the Department may grant, in writingand with such conditions as it may deem to be applica-ble, the requested turbidity exception. Such exceptionshall be valid for a period not exceeding one year but,at the discretion of the Department, may be renewedfor additional periods each not exceeding one year, ifrequests therefor, accompanied by the required sup-porting data, are submitted for each renewal.

v. The Department may revoke the turbidity excep-tion at any time upon a finding that the conditionsunder which such exception may be made pursuant tothe provisions of 40 CFR 141.13(a) of the NationalRegulations are violated.

2. Microbiological:6

:.1.i. Public community and noncommunity water sys- .’

terns that are required to take less than four microbio-logical samples per month shall, unless otherwise re-quired by the Department, determine compliance onsampling during a three-month period (National Regu-lations, 40 CFR 141.14(c)). At its discretion the De-partment shall notify, in writing the owners of anypublic community and noncommunity water systemsthat they shall be required to base compliance uponsampling during a one-month period.

ii. A community water system serving 25 to 1,000persons shall not be permitted to reduce the microbio-logical sampling frequency as allowed by 40 CFR141.21(b) of the National Regulations to no less thanone per quarter on the basis of a history of no colifonnbacterial contamination and on a sanitary survey by theState showing the water system to be solely supplied bya protected ground source and free from sanitary de-fects.

iii. A noncommunity water system shall not be per-mitted to reduce the microbiological sampling frequen-cy to less than one sample per quarter on the basis of asanitary survey, as provided for in 40 CFR 141.21(c) ofthe National Regulations.

iv. The substitution of chlorine residual monitoring ’for microbiological sampling by the suppliers of waterfor community or noncommunity water systems shallnot be acceptable. (National Regulations, 40 CFR c141.21(h)).3. Inorganics: Unless required by the Department, in

writing, to conduct more frequent sampling, noncommuni-“.ty water systems shall repeat sampling and analyses for ‘!nitrate not less frequently than at three-year intervals(National Regulations, 40 CFR 14123(a)(3)).

4. Organics: Community water systems utilizing sur-face sources shall repeat sampling and analyses for organ-its not less frequently than at three-year intervals. Suchsampling shall be conducted during the period April 1through September 30 of the year in which the samplesare collected. (National Regulations, 40 CFR 141.24).

5. Substitution of previous analyses not accepted: Thesubstitution of inorganic, organic and radionuclide analy-ses, taken prior to the effect date of the National Regula-tions, shall not be accepted. (National Regulations, 40CFR 141.23(a), 141.24(d) and 141.26(a)(2)). .

6. Monitoring of consecutive systems:i. Every community water system that purchases all

of its water from another community water system shallmonitor its system for microbiological quality with theapplicable frequency required by 40 CFR 141.21(b) ofthe National Regulations, according to the populationserved by the system that purchases the water; andshall monitor its system for inorganics and radionu- .!elides with the same frequencysystem from which the water isRegulations, 40 CFR 141.29).

Every community water system that purchasesmore than fifty percent of its annual water require-ments from another community system that utilizes asurface source shall monitor its system for organics withthe same frequency as is required of the system fromwhich the water is purchased. (National Regulations,40 CFR 141.29).

7. Other discretional provisions: In all other cases inwhich the State may exercise discretion under the provi-sions of the National Regulations, the supplier of watershall make appropriate requests, in writing, to the Bureauof Potable Water, Division of Water Resources, P.O. BoxCN-029, Trenton, New Jersey, 08625 for consideration ofsuch alternate provisions. Such discretionary powers areincluded in, but may not be limited to, 40 CFR 141.13(a),141.21(d)(4), 141.2.5(a)(3), 141.26(b)(4)iv, and 141.27 ofthe National Regulations.

7:10-5.3 Additional requirements(a) Maximum contaminant levels rules are as follows.

1. The maximum contaminant level for fluoride shallbe 2.0 mg/l, which is based on the annual average of the

maximum daily air temperature for central New Jersey.

2. The maximum contaminant levels for coliform bac-teria applicable to all nonpublic water systems are as. _-follows:

i. When the membrane filter technique is used:

(1) Organisms of the coliform group shall be ab-sent in the standard Dortion of 100 ml when onlv onesingle sample is examined. -

(2) In a series of samples the arithmetical meandensity of organisms of the coliform group shall notexceed one colony per 100 ml.

ii. When the multitube fermentation technique isused:

(1) Organisms of the coliform group shall be ab-sent in all five of the standard 10 ml portions consti-tuting the standard sample when only one singlesample is examined.

(2) In a series of samples not more than tenpercent of the standard 10 ml portions shall show thepresence of organisms of the coliform group.

3. The maximum contaminant levels for turbidity, in-organics, organics and redionuclides shall apply to anypublic water system or nonpublic water system upon afinding by the Department that such is necessary for theprotection of health.

(b) Monitoring and ‘analytical requirements are as fol-lows.

1. The monitoring and analytical requirements fordetermining compliance with the maximum contaminant

levels shall be as required by the National Regulations, orthese Regulations, as applicable; except that at the dis-cretion of the Department additional monitoring may berequired for specific parameters, or the monitoring fre-quency may be increased, to meet special requirementsfor specific water systems.

2. Except for individual water systems, all nonpublicwater systems shall be monitored and tested for microbio-logical quality not less frequently than each quarter.Such monitoring shall be the responsibility of, and at theexpense of, the owner of the system. The samples shallbe tested at a laboratory certified pursuant to the provi-sions of subchapter 8 of this chapter, and the results shallbe maintained on the premises of the nonpublic watersystem for review, as may be required, by a representativeof the Department, or the local board of health.

7:10-5.4 Reporting requirements

(a) Except where a shorter reporting period is requiredby the National Regulations or by the provisions of thissection, the supplier of water from a public water systemshall report to the Department, within the first ten days ofthe month following the month in which any test, measure-ment or analysis is made pursuant to these regulations, theresult of that test, measurement or analysis. Such reports -shall be submitted in a format prescribed by the Bureau ofPotable Water, and on forms available from same, to:

(b) The supplier of water from a public water systemshall report by telephone (609) 292-5550 within 48 hours, tothe Bureau of Potable Water, the failure to comply with-anyprimary drinking water regulation, including failure to com-ply with any monitoring requirement.

(c) The supplier of water from a public noncommunitywater system which is not in compliance with any primarydrinking water regulation, schedule of compliance of anyvariance or exemption, or fails to comply with any monitor-ing requirement shall immediately post the notice of suchfailure, prescribed as to form and content by the Depart-ment, in a conspicuous place where it is most likely to beseen by consumers. This notice shall remain posted untilthe Department determines the public noncommunity watersystem has complied with the regulations, schedules, ormonitoring requirements.

(d) The supplier of water is not required to report analyt-ical results to the Department where the sample has beentaken by State personnel and where the State laboratory

(2) Exemptions shall become effective upon re-ceipt of the order granting them.

ii. Notification to administrator: The Commissionershall promptly notify the Administrator of the UnitedStates Environmental Protection Agency of all vari-antes and exemptions granted. Such notification shallcontain the reason for the variance or exemption, thebases for the findings the Commissioner was requiredto make before granting the variance or exemption, andshall document the need for the variance or exemption.

iii. Compliance schedules:

(1) Proposed schedule:

(A) The Commissioner, within one year fromissuing an order granting a variance or exemption,shall propose a compliance schedule for inclusiontherein. Such schedule shall include dates forattainment of each step toward compliance; andwhere applicable, dates by which arrangement foran alternative raw water source or improvement toan existing source will be completed; dates ofconnection thereto; and dates by which final com-pliance is to be achieved. In addition, said sched-ule shall provide for implementation of ,controlmeasures, including interim control measures, foreach contaminant for which the variance or exemp-tion is granted.

(B) Failure of a supplier of water to meet acompliance schedule date, or to comply with any

other condition therein, shall be adequate groundsfor summary termination of the variance or exemp-tion at the discretion of the Commissioner, andmay be considered a violation under the SafeDrinking Water Act.

(2) Public hearing: Before a final schedule ofcompliance for a variance or exemption may beimposed, the Commissioner shall provide public no-tice of the opportunity for public hearing hereon.The notice and hearing shall be as described in thissubsection.

7:10-6.4 Renewal of variances and exemptions

Variances and exemptions will be granted for the periodof time stated therein, and must be renewed in order tocontinue in effect beyond that time. The maximum dura-tion of a variance is 5 years. Renewals of variances orexemptions may be allowed in the Commissioner’s discre-tion. Renewal applications should be made at least 6months prior to termination of the variance or exemption,to assure adequate time for the renewal process.

cSUBCHAPTER 7. SECONDARY DRINKINGWATER

7:10-7.1 Authority, purpose and scopeThese secondary regulations, promulgated pursuant to

Section 4(a) of the New Jersey Safe Drinking Water Act(N.J.S.A. 58:12A_4(a)), are recommended standards for po-table water. These regulations apply to any substance indrinking water which may adversely affect the taste, odor, orappearance of such water, or which may otherwise adverselyaffect the public welfare. N.J.A.C. 7:10-7.2 specifies theupper and/or lower levels of substances in drinking waterrequired to protect the public welfare. These standardsmay be required to be met by any water supply when theadministrative authority having jurisdiction over the watersupply finds a need therefor. 7:10-7.2 Maximum upper and/or minimum lower levels ofspecified substances in drinking water

i. Visible organisms such as algae, algal diatoms,crustaceans, arachnids, and larvae.

ii. Those micro-organisms which render the waterunpalatable or unaesthetic to the consumer.

7:lCL73 Monitoring(a) When a public community water system is provided

with treatment facilities specifically for pH adjustmentand/or iron and/or manganese removal, the supplier ofwater shall conduct analyses with a minimum frequency of.once daily for pH, iron or manganese, as apphcable, onsamples of water at the point(s) of delivery into the distribu-tion system. Such analyses need not be conducted in acertified laboratory.

(b) In addition, public community water systems shall besampled and analyzed for the parameters listed in thephysical and chemical characteristics at intervals no lessfrequent than the monitoring being performed for inorganicchemical contaminants listed in the Primary Drinking WaterRegulations. The analyses shall be performed by a labora-tory certified by the Department pursuant to subchapter 8of this chapter.

(c) More frequent samples from public water systems forspecific parameters shall be taken if required by the Depart-ment, and, with the permission of the Department, may beanalyzed by the supplier of water.

(d) Monitoring of nonpublic water systems shall be at afrequency directed by the local health department.

SUBCHAPTERS 8 THROUGH 9. (RESERVED)

SUBCHAPTER 10. PHYSICAL CONNECTIONS

7:10-10.1 DefinitionsThe following words and terms, when used in this sub-

chapter, shall have the following meanings unless the con-text clearly indicates otherwise.

“Approved Physical Connection Installation” means adouble check valve assembly or a reduced pressure zonebackflow preventer assembly which is designed and installedin accordance with these regulations.

“Double Check Valve Assembly” means a backflow pre-vention device consisting of two independently acting checkvalves, internally force loaded to a normally closed positionbetween two tightly closing shut-off valves, and with meansof testing for tightness.

“Internal Inspection” means the dismantling of the checkvalves or the reduced pressure zone backflow preventer tovisually inspect the integrity mechanism of the device andthe clappers, discs, facing rings, etc.

“Reduced Pressure Zone Backflow Preventer Assembly”means a backflow prevention device consisting of two inde-pendently acting check valves, internalIy force loaded to anormally closed position and separated by an intermediatechamber (or zone) in which there is an automatic reliefmeans of venting to atmosphere internally loaded to anormally open position between two tightly closing shut-offvalves and with means for testing for tightness of the checksand opening of relief means.

“Unapproved Water Supply” means any water source ofsupply which is not a Public Community Water System.

7:10-10.2 General

(a) The purpose and intent of these regulations are toprotect a Public Community Water System, from backflowfrom a supply which may be contaminated; of questionableor unknown quality; or over which the water purve; ‘or haslittle or no control.

(b) The requirements contained in these regulations arenot to be confused with the requirements of the PlumbingSubcode of the New Jersey State Uniform ConstructionCode, N.J.A.C. 5:23-3.5, for the prevention of illegalplumbing cross-connections, nor with any state or local re-quirements for the practice or procedure known as “cross-connection control by containment” whereby a backflowprevention device may be required to protect a public com-munity water system from contamination as a result ofpossible illegal plumbing cross-connections.

(c) An approved physical connection installation shall beinstalled, and a permit obtained from the Department ofevery physical connection between a public community wa-ter system and any unapproved water supply; or, except asmentioned below, where dual but physically separate pipingwhere one is from a public community water system and theother is from an unapproved water supply, enter a commonbuilding. An approved physical connection installation isnot required where the piping from the unapproved watersupply serves only a fiie protection system which is notinterconnected with a public community water system.

7:10-15.8 Calculation of fees for Physical ConnectionPermits

(a) The initial physical connection permit fee shall be$150.00.

(b) The annual physical connection fee shall be $200.00.

SUBCHAPTER 16. SAFE DRINKING WATER ACTMAXIMUM CONTAMINANT LEVELS FORHAZARDOUS CONTAMINANTS

7:10-16.1 Scope and authorityThis subchapter shall constitute the rules of the Depart-

ment of Environmental Protection governing the establish-ment of Maximum Contaminant Levels as authorized by theSafe Drinking Water Act, N.J.S.A. 58:12A-1 et seq., asamended by P.L. 1983, ~443, commonly known as “theA-280 amendments”.

7:10-16.2 ConstructionThis subchapter shall be construed so as to permit the

Department to discharge its statutory functions and to effec-tuate the purposes of the law.

7:10-16.3 ApplicabilityThis subchapter shall be applicable to all owners or

operators of public community water systems as defined inN.J.A.C. 7:10-1.3.

7:10-i6.4 DefinitionsAs used in this subchapter, the following words and terms

shall, in addition to those provided in N.J.AC. 7:10-1.3 and7:10-14.3, have the following meanings unless the contextclearly indicates otherwise:

“Average” means the sum of the results of the samplinganalyses divided by the number of analyses. For the pur-pose of calculating the average of, the test results, wheneverthe result is non-detectable or below the analytical methoddetection limit (MDL), half of the MDL shall be used torepresent the sample analysis result for ‘the purpose ofcalculating the average of the test results.

“Check samples” means adchtional tests performed inresponse to a compliance sample that exceeds an MCL.

“Department” means the New Jersey Department ofEnvironmental Protection.

“Maximum contaminant level” or “MCL” means the max-imum permissible level of a contaminant in water which isdelivered to the free-flowing outlet of the ultimate user of apublic water system or other water system to which Stateprimary drinking water rules apply, except in the case of

turbidity where the maximum permissible level is measuredat the point of entry to the distribution system. Contami-nants added to the water under circumstances controlled bythe user, except those resulting from corrosion of piping andplumbing caused by water quality, are excluded from thisdefinition.

“Method detection limit” or “MDL” means the minimumconcentration of a contaminant, determined pursuant to 40C.F.R. 136 (Appendix B) or N.J.A.C. 7:18-l et seq., thatcan be measured and reported with 99 percent confidenceto have an analytical concentration greater than zero.

“Polychlorinated biphenyls (PCBs) total” means the sumof all the individual polychlorinated biphenyls as set forth bythe appropriate analytical method as provided in N.J.A.C.7:18-l et seq.

“State Act” means the Safe Drinking Water Act, N.J.S.A.58:12A-1 et seq., as amended by P.L. 1983, c-443.

7:10-16.5 SeverabilityIf any section, subsection, provision, clause or portion of

this subchapter is adjudged unconstitutional or invalid by acourt of competent jurisdiction, the remainder of this sub-chapter shall not.be affected thereby.

7:10-16.6 PenaltiesFailure by the owner or operator of a public community

water system to comply with any requirement of the StateAct or this subchapter may result in the penalties set forthin N.J.S.A. 58:12A-10 and N.J.A.C. 7:10_14.15.

7:10-l&8 Compliance requirements and procedures

(a) In accordance with the testing procedures provided inN.J.A.C. 7:10-14 and 7~10-16.9, the owner or operator of apublic community water system shall analyze for each con-taminant listed in N.J.A.C. 7:10-16.7 for which there is anMCL.

ENVIRONMENTAL PROTECTION

3. The identity and concentration of the contamina-tjon initially reported.

e(d) The Department may, upon being notified in accor-

dance with (b)3 above of the exceedance of any MCL, takeone or more of the following actions:

1. Require the owner or operator of the public com-munity water system to conduct additional testing and/orsampling to determine the nature and extent of thecontamination; and/or

2. Require the owner or operator of the public com-munity water system to investigate alternative sources ofwater.

(b) The owner or operator of a public community watersystem shall, upon receipt of an analysis that reports anexceedance of the maximum contaminant levels for one ormore of the hazardous contaminants set forth in N.J.A.C.7:10-16.7, take the following actions:

1. Notify the Department in writing of the test resultwithin seven days of receipt of the analysis at the follow-ing address:

2. Obtain three additional samples and have themanalyzed within 30 calendar days of receipt of the initialanalysis in accordance with the testing procedures re-quired under (a) above;

3. If the average of the four tests is above the MCL,report to the Department by telephone (60%292-5550)within 48 hours and in writing within seven days of thereceipt of the analysis required pursuant to (b)2 above atthe address provided in (b)l above; and

4. Comply with the public notification requirements ofN.J.A.C. 7:10-16.10.

(c) The owner or operator of a public community watersystem may, where the additional three samples and anal-yses required pursuant to (b)2 above provide evidencethat no hazardous contaminant listed in N.J.A.C.7:10-16.7 exceeds the method detection limit, request thatthe Department consider the initial test to be inaccurateand unreproducible. The Department shall, in consider-ing such requests, base its determination upon the follow-ing factors:

1. Previous analytical results;

2. Vulnerability of the water supply to a source ofcontamination; and

7:10-16.9 Laboratory iesting

(a) The analysis required by this subchapter shall beconducted at a laboratory, certified in accordance withN.J.A.C. 7:18 and the laboratory shall be certified for thespecific method for which the test is conducted.

(b) All analysis shall be conducted by methods and labo-ratories capable of achieving MDLs below the respectiveMCL of the contaminant being tested.

(c) The owner or operator of a public community water. _system shall, when submitting sample analyses to the De-partment, provide the following: (

1. The analytical result of any contaminant monitoredfor as part of the analytical testing method that is used,including, but not limited to, the specifically regulati:llanalyses;

2. The values of ah analyses above the MDL; and

3. The quality control parameters submitted on theDepartment’s QC Data for Hazardous ContaminantAnalysis Form.

7:1O-16.10 Public notification

The owner or operator of a public community watersystem shall provide public notification of any MCL viola-tion in accordance with the most current version of the.Federal National Primary Drinking Water regulations (40CFR 141.32, as amended).

7:10-16.11 Remediation requirements and procedures

(a) Except as provided in (b) below, the owner or opera-tor of a public community water system that exceeds theMCL for any hazardous contaminant listed in N.J.A.C.7:10-16.7 shall, within one year of receipt of the results ofthe tests conducted pursuant to N.J.A.C. 7:10-16.8, take anyaction necessary to bring the water into compliance with the
