BY-LAW NO. 4684

A BY-LAW to adopt Official Plan Amendment No. 1 to the Official Plan for the United Counties of Stormont, Dundas and Glengarry.

WHEREAS the Official Plan for the United Counties of Stormont, Dundas and Glengarry was adopted by Council on July 18, 2005 and approved by the Minister of Municipal Affairs and Housing on August 14,2006;

AND WHEREAS Section 21 (1) of The Planning Act, R.S.O., 1990 states that a council of a municipality that is within a planning area may initiate an amendment to any official plan that applies to the municipality;

AND WHEREAS it is deemed necessary to pass a housekeeping amendment to the original official plan for the purpose of correcting errors and omissions in the text of the plan as well as the designations of select sites on some of the land use schedules;

NOW THEREFORE the Council of the Corporation of the United Counties of Stormont, Dundas and Glengarry enacts as follows:

1. That Official Plan Amendment No. 1 to the Official Plan for the Corporation of the United Counties of Stormont, Dundas and Glengarry, consisting of the attached maps and explanatory text, is hereby adopted.

2. That the Clerk is hereby authorized and directed to make application to the Minister of Municipal Affairs and Housing for the approval of the Official Plan Amendment.

3. That this by-law come into force and effect on the final passing thereof.

PART A - PREAMBLE introduces the actual Amendment but does not constitute part of Amendment No. 1 to the Official Plan United Counties of Stormont Dundas and Glengarry.

PART B - THE AMENDMENT consists of the following text and maps, which constitutes Amendment No.1 to the Official Plan for the United Counties of Stormont Dundas and Glengarry.

PART C - THE APPENDICES do not form part of Amendment No. 1 but are provided to clarify the intent and to supply background information related to the Amendment.

PART A - PREAMBLE

The purpose of Amendment No. 1 to the Official Plan for the United Counties of Stormont Dundas and Glengarry is to correct the errors and omissions in the text, schedules and modifications that constitute the Official Plan for the United Counties of Stormont Dundas and Glengarry as approved by the Ministry of Municipal Affairs and Housing, on August 14, 2006 and to incorporate the corrections into the Official Plan through this Amendment.

Location and Characteristics

The amendments to the Text of the Official Plan include those that apply to the entire United Counties as well as matters which apply to individual Townships or sites. The amendments to the Schedules affect certain sites within the United Counties. The following table outlines the changes that are included in this amendment.

The corrections involve various changes to roads and other items shown on these schedules

This Licence was amendment by the Ministry of Natural Resources on February 6, 2006 but was only recently brought to the attention of the County Planning Department Redesignating the area no longer licensed by MNR to Rural district is consistent with the adjacent Rural land use designation

PART B - THE AMENDMENT

The Introductory Statement

All of this part of the document entitled, Part B - The Amendment, consisting of the following text and the attached maps designated Schedule "A , Schedule "B", Schedule "C" and Schedule "D" constitutes Amendment No. 1 to the Official Plan for the United Counties of Stormont Dundas and Glengarry.

Basis of the Amendment

The basis for the Amendment is to correct errors andlor omissions that occured in the County Official Plan, as approved and modified by the Ministry of Municipal Affairs and Housing as well as information that has been brought to the attention of the County. The majority of the amendments are relatively minor in nature, and all of them have have been agreed to, by Ministry staff. Some of the amendments are required in order to avoid potential appeals on the County Official Plan to the Ontario Municipal Board

Details of the Amendment

The Official Plan for the United Counties of Stormont, Dundas and Glengarry is amended as follows:

1. In the Table of contents, page (ii) change the title of 4.05.1 to "Public use facility"

2. In modification No. 41, add the word "ground" after the word "burial" in the last paragraph of the replacement text for Section 7.06.1 - Development Applications and Infrastructure Works (public Works)

3. In modification No. 46, change the reference to 8.14.13.3 S.

4. In modification No. 48 replace the word "of' with the word "on" between the word "dwellings" and "existing" in the replacement paragraph for Section 8.14.13.3.D.11

5. In modification No. 56, add a "0" to the Roll No. in Item No. 103 of Table 9.1 - Special land use Districts, to make it correct. The correct Roll No. for this property is 041 1 0090061 1 000.

6. In modification No. 58 Section 9.03 "Special Land Use Policies" change the second paragraph to read "Within the Special Policy Area, commercial uses, agricultural service uses and employment district uses.. . ." under the Township of South Stormont Special Policy area East of St. Andrew's Settlement Area

Correct a number of mapping discrepancies on Land Use Schedule A1 North Dundas involving various roads and other items, a shown on SCHEDULE 'C'.

Change the size and shape of the Extractive Resource Lands (Licensed Pit & Quarry) designation on Part of Lots I 1 and 12, Concession 5, former Township of Roxborough, now in the Township of North Storrnont, License No. 5786, on Land Use Schedule A3, and redesignate those lands that are no longer included in the License, as Rural Disdtrict.

Implementation

1. In addition to the specific policies set out in this Amendment, the affected areas of land shall also be subject to all other applicable policies in the Official Plan for the United Counties of Stormont, Dundas and Glengarry.

TAKE NOTICE that the Council of the Corporation of the United Counties of Stormont Dundas and Glengarry will hold a Public Meeting to consider an amendment to the County Official Plan in accordance with Subsection 17(15) of the Planning Act and Subsection 2 of Ontario Re ulation 198196. The subject

THE PURPOSE of the amendment is to correct errors and omissions to the County Official Plan. The errors and omissions include some changes to the Text of the Off~cial Plan as well as to the designations on some selected sites on the Land Use Schedules

ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed Amendment to the County Official Plan. If a person or public body that files an appeal of a decision of the Council of the United Counties of Stormont, Dundas and Glengany in respect of the proposed Official Plan Amendment does not make oral submissions at a public meeting or make written submissions to the Ministry of Municipal Affairs and Housing before the proposed amendment to the County Official plan is approved or refused, the Ontario Municipal Board may dismiss all or part of the appeal.
