Constitutional Guarantees

• Peaceable assembly

• No protection for:– Incitement of violence

– Blocking public streets

– Closing down schools

– Endangering life, property, public order

Time-Place-Manner Restrictions

• Noise violations around schools, hospitals

• Inflammatory topics

• Potential for violence or civil unrest

• Crowd control vs. Thought control

Public Property

• Government has the authority to manage assembly permits to mitigate possibility of potential violence or unrest.

• So long as the demonstrators remain non-violent, they can not be punished for disorderly conduct.

• Abortion/Family Planning clinics

• Buffer zones

Private Property

• Owner decides who assembles on the property

• Usual laws apply

Freedom of Association

• Associations are not obligated to release their membership rolls to the government, unless there is a legitimate and legal need.
