advertisingsubsequenttothereceiptofsuchacontractconstitutes

TheTimesreservestherighttoissuenewratecardsandtorevise
itsratesinwriting,effectivenolessthanfive(5)daysafterdistribution
ofthenewratecardand/orofwrittennoticeofratechangestothe
addressoftheadvertisersoragencystatedinacontract.
WhenTheTimesisrequestedtoinsertaboxnumberinafull-run
advertisementandforwardtheboxnumberreplies,theservice
chargeis$275forfull-runand$100forsuburbanzoned
advertisements.Replieswillbeforwardedtotheadvertiserfor
aperiodofonemonthfollowingthepublicationdateofthead.
Chargesforboxnumbersarenotcommissionable.
GeneralPoliciesandRateInformation
Theratecardlevelapplicabletoanadvertiserisdeterminedby
theadvertiser’sprojectedvolumeduringa12-monthcontractperiod.OurCOFDepartmentwillprovidetheadvertiseroragency
withaNewYorkTimescontractforsignature.
Contractrequestsmustspecifyadefinitebeginningdateand
aresubjecttoaratecardeffectivewhenthecontractbeginsand
subsequentratecardincreasesandmodifications.Volumeand
frequencycontractdiscountswillbeearnedonlyonadvertising
insertedwithina12-monthperiod.Additionally,acontractis
applicabletoadsplacedwithinasingleadvertisingcategory.
Iftheadvertiserexceedstheinitialestimatedcontractleveland
achievesthenextleveloftheratecard,theadvertiserwillbeentitledtoarebatebasedupontheretroactiveapplicationofthe
lowerrateearned.TheTimeswillcredittheadvertiseroragency
accountfortheamountoftherebateearned.
Ifthecontractlevelisnotachieved,theadvertiserwillbeassessed
ashortagebasedupontheretroactiveapplicationofthehigher
rateearned.TheTimeswillinvoicetheadvertiseroragencyforthe
shortage,andpaymentwillbeduetoTheTimesinaccordance
withthepreviouslyestablishedcredittermsfortheadvertiser.

CopyRegulations
TheadvertiserandtheadvertisingagencyjointlygranttoTheTimes
thenon-exclusiveworldwideperpetualrightandlicensetopublish
theadvertisementinTheTimes,includinginprintandinanyother
formatormedianowknownorlaterdevised,whetherornotsuch
advertisementmaybeindividuallyaccessed,perceivedorretrieved
fromsuchformormedia.Inaddition,theadvertiserandthe
advertisingagencyassumeliability,jointlyandseverally,forall
content(includingtextrepresentationsandillustrations)of
advertisementsprintedandalsoassumeresponsibilityforany
claimsarisingtherefrommadeagainstTheTimes.AdvertiseracknowledgesthatTheNewYorkTimesownsthecopyrightinand
totheselection,coordinationandarrangementofthecontentof
thenewspaper,includinganyadvertisementsitpublishes.
