JohnDrewLigon–208S.ElmStreet,Apartment107Mr.LigonexpressedhissupportforwhatevertheCitydecidestodoinregardtoitsgemofagolfcourse.BradfordCreekwasdesignedbythelateRobertE.Cupp,II,whowasoneofthetopgolfcoursearchitectsintheUnitedStates,andperhapsintheworld.Mr.LigonstatedheplaysatBradfordCreekandlovesthecourse,eventhoughitiscurrentlyinstateofdisrepair.HehopestheCitywillmaintainandenhancethecourseasitaddmuchtothequalityoflife.TherebeingnooneelsepresentwhowishedtoaddresstheCityCouncil,MayorSmithclosedthepubliccommentperiodat6:09pm.

SPECIALRECOGNITIONS

PRESENTATIONOFCIGNA’S2017WELL‐BEINGAWARDMayorSmithstatedtheCityandtheGreenvilleUtilitiesCommission(GUC)havebeenselectedastheCarolina’s2017Well‐BeingAwardrecipient.Thisawardisadistincthonorrecognizingemployerswhohaveactivelyandpositivelyimpactedtheoverallhealthandwell‐beingoftheirpopulations.LindsayPeters,HealthPromotionsManagerforCigna,gaveashortpresentationthenpresentedtheaward,alongwith$1,000towardaHealthImprovementFund.RECOGNITIONOFOFFICERSINHONOROFCOMMUNITYPOLICINGWEEK2017MayorSmithstatedthisisCommunityPolicingWeekandthefirstpartoftonight’srecognitionisofficerswhohavebeenselectedbytheirpeersforhavinggoneaboveandbeyondregularpolicing.ShepresentedcertificatestoOfficerWilliamBaileyandChildTraumaResponseVictim’sAdvocate,DeniseWilliams‐Braswell,werefollowinguponacaseatmetafamilyatalocalmotelwheretheywereresidingtemporarily.Theyrealizedthefamilyhadnofoodforthechildrenandwereonthevergeofevictionastheyhadnomoneytoremaininthehotel.Ms.Braswell‐WilliamstookthefamilytotheDepartmentofSocialServicestosignupforFoodStamps,butrecognizingthatwouldtakesometime,soshemadesurethefamilyhadfood.OfficerBaileypaidoutofhisownpocketforthemotelsothefamilywouldnotbeoutonthestreet.Next,MayorSmithrecognizedOfficerRonWilder,whoreceivedacallinDecemberthatagentlemanwasstandingoutsidetheFireDepartmentwithnowheretogoin32°temperatures.HehadjustgottenoffworkandhadnowheretostaybecausetheHomelessShelterwasfull.OfficerWildertookthegentlemantoahotelandpaidoutofhisownpocketforseveralnight’sstayinthehotelandreturnedwithclothingfortheman.

MayorSmithrecognizedGangUnitOfficerBrockFlannerywhocontinuestodemonstrateanunderstandingandpassionforcommunitypolicingthroughhisdailyinteractionswiththecitizensofGreenville.Someofhiscareerhighlightsdemonstratingthisdedicationincludetakingamanouttolunchforhis80thbirthdayafterhismotorizedwheelchairbrokedownonthesideoftheroad,buildingafenceandinstallinglightsanddoingsomelandscapingforawomanonMyrtleStreetandperformingCPRona16dayoldgirlwhobecameunresponsive.OfficerFlanneryvisitsthelittlegirlandherfamilyonaregularbasis.BothEMSandhospitalstaffhaveadvisedthatthislittlegirlmightnotbealivetodaywereitnotforOfficerFlannery’saction.MayorSmithreiteratedthattheofficersalreadyrecognizedwereidentifiedbytheirpeers,butsinceitistheMayor’sCommunityPolicingWeek,shewouldalsoliketorecognizesomeofficersshehasobserved.DeputyChiefTedSaulsconsistentlyshowsupforeverycommunityevent,knowseveryperson’snameandfullyembodiesthespiritofcommunitypolicing.OfficerRichardWilliamsisintheCommunityOutreachDivision,andworkswiththeCopsandBarbersprogram.Hehasapassionforworkingwiththecommunityanddoesasuperbjob.MayorSmithstatedshebumpedintohimatafootballgameatJHRoseHighSchoolandheofferedtowalkhertohercar.Ittook45minutestogettohercarbecauseeverychildatthatschoolknewhisnameandranuptohughim.Heaskedabouttheirparents,whohealsoknewbyname.Hekeepsupwiththechildrenheworkswithandgetstoknowtheirparents.Hehelpswithanyneedthechildmayhaveinordertobesuccessful.CaptainCecilHardy,whoisactuallyretired,hascomebacktoworkasaReserveOfficertohelpout.In1985,CaptainHardystartedtheCommunityAssistantTeaminhisoff‐dutyhours,thenbroughtittothePoliceDepartment.Heworkedwiththecommunitytodeterminewhatwasneededinordertobuildrelationships.In1987,hewaslistedasoneoftheTop10OfficersintheWorld.HewasinvitedtotheWhiteHouseatleasttwiceforhiscommunitypolicingefforts.CaptainHardystartedProjectWeedandSeedinthe1990’sandworkedwithSafeNeighborhoods.Additionally,hehelpedformerPoliceChiefWilliamAndersonestablishthePALProgram.(ADDED)RETIREMENTRESOLUTIONFORCITYATTORNEYDAVEHOLEC‐(ResolutionNo.051‐17)MayorSmithreadthefollowingresolutionandpresentedittoCityAttorneyDaveHolec,thankinghimforhis20+yearsofservicetotheCityofGreenvilleanditscitizens:

PUBLICHEARINGSAPPLICATIONTORECEIVEFUNDSFROMTHEEDWARDBYRNEMEMORIALJUSTICEASSISTANCEGRANTPROGRAMChiefofPoliceMarkHoltzmanstatedtheBureauofJusticeAssistance(BJA)annuallyawardsagenciesgrantmoneyforvariousneeds.TheBJAdesignatesgrantsbasedonthesizeofajurisdictionandlevelofactivity.GreenvillePoliceDepartment(GPD)hasreceivedinformationthatitiseligibletoreceivefundsfromtheEdwardByrneMemorialJusticeAssistanceGrantprogramintheamountof$31,893.ChiefHoltzmanstatedGPDintendstoutilizethefundsasfollows: $28,608willbeusedtopurchaseaDirectLinkSeriesCrisisResponseThrowPhone.

Thisdeviceisutilizedduringcriticalincidentstoallowdirectcontactwithindividualsincrisis.Thiswillhelpensuresecurecommunicationsbetweenmembersofthedepartmentandmembersofthepublicwhenothermeansarenotavailable.

$3,285willbeusedtopurchasethree(3)forensiccrimescenescreensthatwillbeutilizedbycrimesceneinvestigatorstoshieldtragic/sensitiveeventsfrompublicview.Thesescreenswillprovidesecurityforinvestigativescenes,allowmedicalpersonnelandinvestigatorstooperatemoresecurelyandallowprivacyforvictims.

ChiefHoltzmansaidthegrantrequiresapublichearingbeheldbeforethefinalapplicationcanbeapprovedandfundsdistributed.ThefundswillbeavailableatthebeginningoftheFederalfiscalyear,whichbeginsOctober1,2017.NoCitymatchisrequired.ItshouldbenotedthatthisgrantisbeingjointlyawardedtothePittCountySheriff'sOfficeandtheywillalsoreceive$31,893.AnInterlocalAgreementhasbeenpreparedbetweentheCityandCountyfordistributionofthesefunds.

UPDATEBYTHENORTHCAROLINADEPARTMENTOFTRANSPORTATIONOFPROJECTSU‐5870ANDU‐5785FIRETOWERROADANDPORTERTOWNROADANDRESOLUTIONOFSUPPORTThisitemwascontinuedtoNovember9,2017byrequestofNC‐DOTandapprovaloftheCityCouncil.ORDINANCERELATINGTOEXOTICANIMALSCityAttorneyDaveHolecstatedthatduringtheMay8,2017PublicCommentPeriod,severalcitizensexpressedconcernaboutaroadsideexhibitionofexoticanimalsatacommercialpropertyinthecity.Theconcernwasaboutthemannerinwhichtheanimalswerekeptorcaged.ThecitizensrequestedthatCouncilconsiderabanonexoticanimalperformancesorexhibitionsinthecityorabanonkeepingexoticanimalsinthecity.AtitsSeptember11,2017meeting,CityCouncildirectedthatanordinancebedraftedwhichdoesnotbanpersonalownershipofexoticanimalsbutdoesbantheuseanddisplayofexoticanimalsforcommercialpurposesTheCityCodecurrentlyallowsaperson,businessorevent(i.e.circus,exhibition,show,andthelike)tohaveanexoticanimaluponreceiptofapermitfromtheAnimalProtectiveServicesDivision(APS).TheDivisionhasissued44exoticanimalpermitssince1998.Otherthantherecentcomplaints,theDivision’ssupervisorreportsthatheisnotawareofanyissueswiththepermits.Thepermitswereissuedtocircuses,animalexhibitionshows,andprivatecitizens(toallowexoticanimalstobekeptaspets).TheordinanceproposedfortheCityCouncil’sconsiderationdoesthefollowing: Prohibitsthekeepingofanexoticanimalfortheuse,display,orexhibitionfor

commercialpurposes.Therearelistedexceptionssuchasatanexhibitionbyanaccreditedzoooraquarium,alicensedwildlifesanctuary,orauniversityregisteredundertheAnimalWelfareAct,andalsoatapetshoporatRiverParkNorth.An

additionalaccreditationorganizationforzoosoraquariumshasbeenadded–theZoologicalAssociationofAmerica(ZAA).Commercialpurposesinclude,butarenotlimitedto,acircus,exhibition,show,oreducationalprogram.

Allowsthekeepingofanyexoticanimalfornon‐commercialpurposesuponreceiptofapermit.Thiswouldinvolvethesituationwhereexoticanimalsarekeptaspets.ThepermittingallowstheCitytobeawareofwherethesearekeptandallowsconditionstobeimposedinordertoensuretheyarekeptinasafemanner.Anexhibitionoreducationaloutreachprogramconductedbyanaccreditedzoooraquariumisalsorequiredtoreceiveapermit.

Mr.Holecstatedaviolationoftheordinanceisenforcedbyacivilpenaltyintheamountof$250orbyanequitableremedy(aninjunction).Theproposedordinanceeliminatesthefeeforcommercialuse.CouncilMemberSmileymovedtoapprovetheordinancewhichprohibitsthecommercialuseanddisplayofexoticanimals,withcertainexceptions,butallowsthenon‐commercialkeepingofexoticanimalsonapermittedbasis.CouncilMemberBarrsecondedthemotion.CouncilMemberConnellyaskedabouttheinvolvementofAnimalProtectiveServicesinthisprocess.APSOfficerTimLangleystatedhewasunawareoftheissuepriortothelastCityCouncilmeeting,buthehasreviewedtheCityAttorney’sdraftordinance.CouncilMemberConnellyaskedifOfficerLangleyfeelsthisordinanceisnecessary.OfficerLangleysaidtherearealwaystwosidestoanystory.Atthelastmeeting,theCouncilheardfromconcernedcitizenrequestingabanonexhibitionshowsduetotheperceivedtreatmentofexoticanimalsatarecentroadsideexhibition.Thatisoneside.OfficerLangleyfeelsthereisanalternativetoafullban.Partofhisjobistoinspectacircuswhenitcomesintotown.Hedoesaverystringentinspectiononalloftheiranimals.HehasbeentrainedbytheHumaneSocietyoftheUnitedStatesandPeoplefortheEthicalTreatmentofAnimalsonwhattolookfor.Greenvilleexceedsthoseinspectionalguidelines.Helookstoseeifcagesaretoosmall,iftheanimalshaveanyinjuries,scarsormarkings.Helooksforproperfood,waterandshelter.Onceaninspectionisdone,eitheralawenforcementofficerorananimalcontrolofficerremainsonsiteatalltimes.TherehasneverbeenanissueinthisCitywithanytypeofexhibitionshow.HestatedhewouldbewillingtoincorporateguidelinesfromtheZAAintohisinspectionprocessandaskedtobegiven24months.Ifpeoplearestillcomplainingatthatpoint,thenhewouldhavenoissueswithsupportingaban.MayorPro‐TemGloverfeelsOfficerLangleyknowswhatheisdoing.APShastheirhandsfull,butthedivisionhasbeentakingahit.ShefeelstheCouncilshouldtakeOfficerLangley’srecommendationintoaccount.

CouncilMemberGodleysaidstaffdoesn’tgetenoughsupportfortheworktheydo.Ifstafffeelstheycanenhancetheirinspectionprocess,hefeelstheCouncilshouldgivethemthatopportunity.CouncilMemberMercermovedtocontinuethemattertoNovember,however,themotiondiedforlackofasecond.Therebeingnofurtherdiscussion,themotiontoapprovetheordinancewhichprohibitsthecommercialuseanddisplayofexoticanimals,withcertainexceptions,butallowsthenon‐commercialkeepingofexoticanimalsonapermittedbasisfailedbyavoteof2to4,withCouncilMembersSmileyandMercercastingtheonlyaffirmativevotes.APPROVALOFWOMBLECARLYLESANDRIDGE&RICE,LLPASBONDCOUNSELUponmotionbyCouncilMemberConnellyandsecondbyCouncilMemberMercer,theCityCouncilvotedunanimouslytoapproveWombleCarlyleSandridge&Rice,LLPtoprovidetheCity'sBondCounselservices.AUTHORIZATIONTOAPPLYFOR2017TIGERGRANT:MULTIMODALTRANSPORTATIONNETWORKEconomicDevelopmentandRevitalizationManagerRogerJohnsonstatedundertheTransportationInvestmentGeneratingEconomicRecovery,theU.S.DepartmentofTransportation(TIGER)providesfundingfortransportationandtransitprojectsthataremulti‐modal,multi‐jurisdictionalorotherwisechallengingtofundthroughexistingprograms.TIGERinvestmentsaimtomakecommunitiesmorelivable,safe,efficientandsustainable.CitiescanuseTIGERfundstosupplement“traditional”transportationfundingfromstateDOTs,especiallyforprojectsthatemphasizenon‐automotivemodes.TheTIGERprogramexpectslocalitiestoprovidematchingfunds,whichcancomefromvariousnon‐federalsources.Aminimumofa20%non‐federalmatchisgenerallyrequired,butrecentexperiencepointsoutthatgrantproposalsapproximatingalargerpercentageofalocalmatcharemorecompetitive.A2017TIGERapplication,likethe2016proposal,willfocusonpedestrianandroadwayimprovementsonWestFifthStreet,DickinsonAvenue,ReadeCircle,andAlbemarleAvenue.However,the2017applicationwillexpandtoincludepedestrianimprovementsforPittStreet,ClarkStreet,apedestrianpassageacrosstherailroadtrackstoandfromWestGreenville,andarenovationofAtlanticAvenue.Theseimprovementsprimarilyconsistofsidewalks,pedestriancrossings,streetscapes,lighting,roadwayenhancements,andsidewalkaccessories.

Thegrantapplicationwillexplainthattheseimprovementswillcreateeasier,efficientandsaferaccesstotheGreenvilleTransportationandActivityCenter(GTAC).Moreover,GTACwillthensafelylinkpeople,particularlyWestGreenvilleresidents,toplacesofeducation,healthcareandjobs.Mr.Johnsonstatedthegrantproposalrequests$8,200,000infederalfundingandrequiresaminimum20%localmatch.Stafflearnedthatsuccessfulapplicantshistoricallyprovidealargerlocalmatch.Staffformulatedanapplicationthatprovidesalargerlocalcontributionanddoesnotrequirenewfunding.TheCitywilluse$5.65millioninexistingfundstoincludetheHighwayTrustFund,the2015StreetandPedestrianTransportationBondand$1,500,000fromtheCity’sCapitalImprovementPlantoconstitutetheCitymatch.Itisestimatedthatthiscombinationoffundingwillresultina41%localmatch.UponmotionbyCouncilMemberMercerandsecondbyCouncilMemberConnelly,theCityCouncilvotedunanimouslytoauthorizeCitystafftosubmita2017TIGERgrantapplicationproposal,uponthefinalapprovaloftheCityManager,tobesubmittednolaterthanOctober16,2017.UPDATEONBRADFORDCREEKPUBLICGOLFCOURSE–POTENTIALMANAGEMENTORMARKETINGCONTRACTAssistantCityManagerMichaelCowinstatedCityCouncildirectedstafflastmonthtocontinuenegotiationswithBillyCasperGolfforcontractedmanagementofBradfordCreekandtoreportthestatusofthenegotiationsatameetingthismonth.Councilalsodirectedstafftoinvestigateoutsidemarketinginlieuofcontractedmanagement,specificallylookingatfirmswithgolfcoursemarketingexperience.Mr.Cowinstatedthathe,alongwithRecreationandParksDirectorGaryFentonandCityAttorneyDaveHolec,hasbeenreviewingthecontractproposedwithBillyCasperGolf.Theysubmittedacounter‐proposalbacktoBillyCasperandhaveworkedtonegotiatethedifferencesbetweenthetwo.Mr.Cowinreviewedthenegotiatedterms:

Mr.CowinnotedtheYouthgolfprogramswerenotpartoftheoriginalcontractwithBillyCasper,buthavebeeninputthroughthenegotiationprocess.HestatedthatRecreationandParksDirectorGaryFentonwouldaddresstheCity’sinvestigationofworkingwithanoutsidemarketingfirm.MayorSmithaskedifBillyCasperhaspreviousexperiencewithFirstTee.Mr.Cowinstatedtheydo.MayorSmithaskedifitistruethatSNAGwastheCity’sversionoftryingtobeginwithFirstTee.Mr.Fentonsaidhewouldnotsaythat.SNAG,orStartingNewatGolf,isaprogramthatisverypopularacrossthenationnow.Itutilizesspecialequipment,suchaslargerclubsandclubheads.TheCityhastargetedsomeofthelargerrecreationcentersaspotentialpartnersandparticipantsinthatprogram.MayorSmithaskedaboutBillyCasper’swillingnesstoreachouttoFirstTee.Mr.Cowinstatedtheyarewillingtoentertainthat.Mr.Fentonstatedinadditiontonegotiatingamanagementagreement,staffwasaskedtoresearchamarketingfirmwithspecificgolfcourseexperienceforacontractthatwouldfocusonlyonthemarketingaspectsofthecoursewiththefollowinggoals: IncreaseroundsplayedatBradfordCreek IncreaseoverallawarenessbyBradfordCreek’stargetmarkets DevelopagolfmarketingplanforBradfordCreek Implementgolfmarketingplan Design,developandhostwebsiteMr.Fentonstatedamarketing‐onlyfocuscouldbeexpectedtoincuraone‐timestartupexpense(firstyearonly)of$10,000forconductingamarketinganalysisandactionplan,alongwithwebsitedesign.Annualrecurringcostsareestimatedat$20,000formanagingthemarketingprogram,websitehostingandmanagementandanemailmarketingcampaign.Revenuesof$77,000areanticipated,ora$3‐$5returnoneverydollarspentinmarketing.ProjectionsforFiscalYear2017‐2018withoutamarketingcontractresultinanetlossof$153,605($637,169inRevenuesminus$790,774inExpenses).Withamarketingcontract,projectionsforthesameperiodwouldresultinalessernetlossof$102,605($714,169inRevenuesminus$816,774inExpenses).Insummary,Mr.FentonstatedthatalloptionsnecessitatesomesubsidybytheCityforthegolfcourse.AgaincomparingprojectedFiscalYear2017‐2018financialoperations,theCitycouldanticipatethefollowing:

FollowingdiscussionbytheCityCouncil,CouncilmemberGodleymovedtoapprovecontractingwithBillyCasperGolfformanagementoftheBradfordCreekPublicGolfCourse.MayorPro‐TemGloversecondedthemotion,whichpassedbyunanimousvote.CONTRACTAWARDFORTHETOWNCREEKCULVERTDRAINAGEIMPROVEMENTPROJECT‐(Continuedfrom10/09/2017)‐(ResolutionNo.052‐17)PublicWorksDirectorKevinMulliganstatedtheCitythestudyanddesignphaseoftheTownCreekCulvertprojectinthefallof2013.TheTownCreekCulvertdrainsstormwaterfromapproximately300acresintheuptownGreenvillearea.Itwasbuiltintheearly1900sandneedstobesubstantiallyrehabilitatedorreplacedduetomultiplefailuresandlocalizedflooding.Theurgencyofthisprojectisdrivenbythe10thStreetConnectorProject(NCDOT,U‐3315)whichiscurrentlyunderconstruction.TheTownCreekCulvertisoneofthemainoutfallsfortheuptownareaandthe10thStreetConnector.ThePublicWorksDepartmentinitiallysolicitedbidsonSeptember21,2016.Onebidwasreceivedafterre‐advertisementfor$31,074,905.78.ThebidexceededtheCity’sbudgetfortheproject.ThePublicWorksDepartmentmodifiedthescopeandre‐bidtheproject.Modificationsincluded,butwerenotlimitedto,extendingroadclosuretimelines,identifyingareaswithsoilcontaminationandreducingliquidateddamages.PublicWorkssolicitedbidsasecondtimewiththemodifiedscopeonJune8,2017.TheCityreceived3bids.TraderConstructionCompanyofNewBern,NCsubmittedthelowestresponsible,responsivebidintheamountof$22,281,176.15.Itisanticipatedcontractsforconstructionphaseengineering,constructionmaterialstestingandenvironmentalserviceswillbepresentedtoCityCouncilforawardinNovember2017.Mr.Mulliganstatedthatapproximately$3millionofthetotalcostwillbefundedbytheGreenvilleUtilitiesCommission(GUC)forworkassociatedwiththeirwaterandwastewaterinfrastructure.RemainingprojectcostwillbefundedintheStormwaterUtilityFundbystormwaterutilityfeerevenuesthroughacombinationoffinancingsources
