InAprilofthisyear,theDistrictCourtconductedajudicialreviewregardingthewatercallbytheBigWood&LittleWoodwaterusersassociation (senior waterrightholders). TheDistrictCourtheldthat the“seniors failed tosatisfyboththefilingandservice requirements ofRule30totheprejudiceofthesubstantialrightsofSunValley, theCitiesofFair-fieldandKetchum,andtheWaterDistrict37BGroundWaterAssociation.” ThisrulingsetasidetheIDWR Director’s OrderDenyingSunValleyCom-pany’sMotiontoDismississuedinJuly2015,andre-mandedthematterbacktoIDWRforfurtherproceed-ingsasnecessary.TheDis-trictCourtalsosetasidetheDirector’sOrderDenyingaJointMotiontoDesignateACGWS by Rulemakingand to Dismiss DeliveryCalls. Based on the DistrictCourt’srulingandthatnoappealwasfiled,theIDWRDirectorissuedanorderonJune22,2016,concludingthatnofurtherproceedingsarenecessaryanddismissedthedeliverycalls.

WhilegiftshoppingIranacrossachocolatecoveredhuckle-berryicecreambaronastick.Nomatterwhat,thereisalwaysroomforicecreamandIhadnothadmydailyicecreamyet(andtothinkhuckleberriesarepopularinMontana,IthoughttheywereanIdahothing!XXX). Idaho Provisions Advanced in House Interior Bill

from Senator Mike Simpson Washington,D.C.-IdahoCongressmanMikeSimpsontodaysupportedtheHouseInteriorandEnvironmentAp-propriationsbillforFY17duringtheHouseAppropria-tionsCommitteeconsideration.IncludedinthelegislationarepoliciesimportanttowesternstatesandcriticalfundingforPaymentinLieuofTaxes(PILT),avitalprograminthewestthatensurescommunitiesareadequatelycom-pensatedforthelackoftaxrevenueduetothepresenceoffederalland. “EverycountyinIdahodependsonthefederalgovern-mentmeetingitsobligationsthroughPaymentsinLieuofTaxes,”saidSimpson.“PILTisessentiallythegov-ernment’spropertytaxonthefederallanditowns,anditneedstobepaidfullyandontime.I’mpleasedthatfullfundingwasincludedinthisbill,andIamalsocommittedtofulfillingthepromisesmadetopubliclandscountiesinthelong-termandwillcontinueworkingtoprovidepermanentcertaintyforIdaho’scounties.” Simpson,whoisvice-chairofthesubcommittee,alsosupportedlanguagethatwouldpreventafuturelistingofthesage-grousewhileprohibitinganychangestoresourcemanagementplansthatareinconsistentwithstateman-agementplans.Thelanguagealsoprohibitsthewithdrawalofmineralrightsinsage-grousefocalareas. “Thedecisionnottolistthesage-grouseasanendan-geredspecieslastSeptemberwasavictoryforwesternstates,”saidSimpson.“However,IremainconcernedabouttheimpactsoftheBLM’sresourcemanagementplansandtheconsequencestheywillhaveonIdaho.Thislanguageensuresthatstatevoicesareapartofsage-grousemanage-mentandconservationefforts.” TheInteriorbillalsoincludesanumberofprovisionschampionedbySimpsonthatbenefitIdaho,including:·Fullfundingforwildfiresuppressionattheten-yearaver-ageof$3.9billionfortheDepartmentofInteriorandtheForestService;·LanguagepreventingtheEPAfromdramaticallyex-pandingitsjurisdictionoverstateandlocalwaterundertheCleanWaterActbychangingthedefinitionof“navigablewaters”;·LanguagethatdirectstheFishandWildlifeServicetoreissuetwofinalrulesremovingrecoveredwolvesinWyomingandintheWesternGreatLakesfromtheen-dangeredspecieslist;·LanguageprohibitingtheEPAfrommovingforward

witheconomicallyharmfulproposalstoregulategreen-housegasesfromstationarysources;·Languagethatprohibitsabanonrecreationalshootingandhuntingonfederalandpubliclands. CongressmanSimpsonalsoofferedanamendmentthatprohibitstheBureauofLandManagementfromimple-mentingtheirproposed“Planning2.0”regulationuntiltheagencyprovidesadditionaltimeforpubliccomment.Theamendmentwasagreedtobyavoicevote.YoucanviewCongressmanSimpsonspeakingontheamendmenthere. Thebill,whichpassedbyavoteof31-18,nowheadstothefloorforfurtherconsideration.

Idaho Auctions 39 Priest Lake Lots for $18.9 million

(BOISE)–TheIdahoDepartmentofLands(IDL)auc-tioned39lotsatPriestLakefordeededownershipatapublicauctioninCoeurd’Alene. Thelandsalesgenerated$18.9millionforthePublicSchoolEndowment. Alloftheleasedlotsintheauctionhavecabinsonthemandareunderlease.ThelandisownedbytheStateofIda-hoandthecabinsandotherimprovementsonthelandareownedbytheleaseholdersaspersonalproperty.Thecur-rentleaseholdersappliedtoparticipateintheauction. Fortyoneleasedlotswereofferedatauction,38oftheselotssoldtothecurrentlessees.Onelothadacompetitivebidandwaspurchasedbyanon-lessee,theappraisedvalueofthatpropertywas$740,000anditsoldfor$1.1million.Thewinningbiddermustalsopaytheformerlesseetheappraisedvalueforthecabin.Twolotsdidnotreceiveanybidsattheauction. Allthelotsarelakefrontproperties.TheStatecanacceptnolessthantheappraisedvalueoftheendowmentlandsthatareauctioned. Thetotalacreageofthelandthatsoldwasapproximately45acres. InFebruary2016theLandBoardapprovedtheauctionof334leasedlotsatPriestLakeandPayetteLakebytheendof2019.Additionally,IDLwillbeauctioningunleasedlotsatbothlakesoverthenextfewyears. In2010theLandBoardapprovedaplantodivesttheState’sownershipofmostofthecottagesitesatbothlakesovertimeinordertoreinvesttheproceedsintoassetsthatgeneratehigherreturnsthantherentfromthelots. Includingtoday’sauction,228cottagesitelotshavesold-141lotsatPriestLakeand87lotsatPayetteLake-forato-talofapproximately$97.7millionfortheendowments.
