Edwards v. Aguillard
The teaching of Creation Science & Evolution in public schools
History of Edwards v. Aguillard - Louisianna enacted the "Balanced Treatment for Creation-Science and Evolution-Science in Public School Institution Act" AKA, "The Creationism Act". -The Establishment Clause in the Constitution played a major roal in the decision. - Supreme Court thought "The Creationism Act" was an attempt to advance one religion over another. - Edwards side agrued that teaching both sides would inhance the education of science to students.
Edwards v. Aguillard goes to Supreme Court
-December 10th of 1986 the case was argued in Supreme Court. -June 19th of 1987 Supreme Court decided in favor of Aguillard, ("Creationism Act" was unconstitutional). -7:2 in favor of Aguillard - Case tests the 'religous inclusion in public establishments' part of the Establishment Clause in the Consistution.
The Aftermath
- "Intelligent Design" termed in 1990's - Kitzmiller v. Dover Area School District -"Intelligent Design" taught in schools - Found in favor of Kitzmiller - Now, the teaching of Evolution and Creation or "Intelligent Design" in schools is a secure matter due to Edwards v. Aguillard and Kitzmiller v. Dover Area School District.
