President’s ReportHappy new year to all the my fellow Directors, Management, Staff and Members of the Club, I hope the festive season treated you well and 2014 brings you health and happiness.
The change-over has officially taken place with Shane Atkins stepping up as the new Club Chief
Executive Officer filling the shoes of the long serving Gorden Stevens who retired at the end of December. We all look forward to Shane’s leadership and experience.
The current Club renovations are on track. The concrete slab has been formed and the next stage will consist of the construction of a koi fish pond that will be built adjacent to the outdoor area. I look forward to seeing what 2014 brings for the Club.

THE LEO McCARTHY MEMORIAL SMITHFIELD R.S.L. SUB-BRANCH CLUB LIMITED
ACN 000 926 661
Pursuant to Article 34(b) of the Articles of Association of the Leo McCarthy Memorial Smithfield R.S.L. Sub-Branch Club Limited,the Board of Directors makes the following By-law 19 which relates to Articles 27 to 29 inclusive of the Articles of Association:
Election of Board1. (a) A member who introduces a guest to the Cub must on each
occasion on any day on which the guest is to enter thepremises of the Club enter the name in full or the surnameand initials of the given names and the address of thatguest, the date of that day and the signature of the member.
(b) The member must remain in the reasonable company ofthe member’s guests while they are on the premises of theClub.
(c) When the member leaves the Club the member’s guests (ifthey have not already done so) must also leave the Club.
(d) A member is responsible for the conduct of guestsintroduced into the Club by that member and if the guest ofa member engages in conduct which is unbecoming oroffensive that member may be the subject of a disciplinarycharge under the Club’s Constitution.
(e) A member shall not introduce into the Club as a guest aperson who is then under suspension from the Club or whohas been expelled from the Club or who has been turnedout of the Club pursuant to Section 77 of the Liquor Act.
2. The dress regulations must be observed at all times. Gentsmust remove hats upon entering the Club premises. Ordinarycleanliness must be insisted upon at all times. The DutyManager or Doorkeeper shall decide when a member/visitor isunacceptably dressed.
3. The whole of the Club other than the outdoor gaming area andoutdoor terraces which are located on the ground level is asmoke free area for the purposes of the Smoke FreeEnvironment Act. Smoking is therefore prohibited in all partsof the Club other than these designated areas. Any person whosmokes in a smoke free area will be removed from the Club’spremises and if that person is a member may be subject todisciplinary action under the Club’s Constitution.
4. (a) No illegal gambling is allowed on the premises of the Club.(b) Raffle tickets must not be sold in the premises of the Club
other than with the permission of the Board and on suchtimes and days and in accordance with such otherconditions as may be specified by the Board.
5. No member or visitor shall be permitted to make any unduenoise in the Club or cause annoyance to other members/visitors.
6. Any member found wilfully damaging the Club property willhave his membership suspended and may be proceeded againstat law.
7. Deleted.8. No member shall personally reprimand any servant of the Club,
but shall, if he has a complaint, see the Duty Manager or lodgesame in writing addressed to the Secretary Manager.
9. (a) Any person who is not a member of the Club and isattending the premises of the Club for the purposes of a subbranch meeting or an RSL service or other RSL functionwill, if that person is:(i) a member of the Australian Defence Force or(ii) a former member of the Australian Defence Force and
produces evidence that the person is a servicemember of the RSL and a member of at least one (1)other RSL or services club be admitted as an honorarymember of the Club.
(b) All other persons who are not members of the Club wishingto attend the meetings, services and functions referred toin paragraph (a) may be admitted either as guests of amember or as a temporary member (provided that theyqualify for temporary membership) and in each case theappropriate details are recorded in the Register of Guestsor the Register of Temporary Members.
10. Members using the Car Park shall park their vehicles so as notto prevent entry to, or exit from, the Car Park. Members mustvacate the Car Park as soon as possible and not createdunnecessary noise which may cause annoyance to residentsliving in the near vicinity. Members using Car Park mustcomply with all signage in area including traffic flow arrows.
11. No unauthorised persons will be allowed behind the bar, or inthe kitchen, or any staff area.
12. No poker machine change will be given after the Bar closes. NoJackpot or Short Pays will be made 15 minutes after the barclosing time. No member shall play more than one pokermachine at a time, if other members are waiting to playmachines. A machine cannot be reserved for more than threeminutes. The Club reserves the right to pay jackpots to visitorsby cheque, to be forwarded to address shown in Visitor’sRegister.
13. All members shall leave the Club premises within half an hourafter the Bar closes or when directed by the Duty Manager orhis Deputy. When leaving the Club, no member shall make anyunnecessary noise or disturbance in the vicinity of the Club.
14. Deleted.15. Any matters which are not provided for in the Rules and By‐
Laws shall be dealt with by the board, whose decision shall befinal.
16. The conduct of members and their guests at the Jack Traversmemorial Lodge, at Greenwell Point and all other suchproperties, wheresoever owned and/or operated by SmithfieldRSL must conform to the usual requirements of a Club Member,at all times.
17. No member or visitor shall, within the Club premises or withinview of such premises, behave in such a manner that mayreflect on the good conduct of the Club or the membership.
18. The circulation of any petition for the gathering of signatures,for any purpose except those referred to within theConstitution of Club or any other relevant Acts will not beundertaken within the Club or premises without the expressedpermission of the Board of Management.
19. The election of the Board shall be conducted in the followingmanner:(a) The Board shall appoint a Returning Officer and at least
two (2) scrutineers to take charge of the ballot. (b) The Returning Officer and the scrutineers shall not be:
(i) a candidate for any position;(ii) the proposer or seconder of a candidate for any
position;(iii) a close relative (as referred to in the Registered Clubs
Act) of a candidate for any position.(iv) the Secretary or any employee of the Club.

(c) The Returning Officer shall be the Electoral Commissionerof New South Wales appointed in accordance with Section36 of the Registered Clubs Act.
(d) Notwithstanding paragraphs (b) and (c), when Section30(1)(a1) of the Registered Clubs Act takes effect theReturning Officer will be a person or body approved by theDirector of Liquor and Gaming.
(e) (i) Nominations shall close at 5.00 pm on a daydetermined by the Board that is at least fourteen (14)days prior to the date fixed for the Annual GeneralMeeting (“the close of nominations”).
(ii) Nominations must be received by the ReturningOfficer on or before the close of nominations asprovided in sub paragraphs (i).
(iii) Nominations will not be received by the Club. Untilsection 30(1)(a1) of the Registered Clubs Act takeseffect a nomination must be given to the ElectoralCommission of New South Wales for the attention of“Returning Officer” either by faxing the nomination tofax (02) 9290 5939 or by posting it to ElectoralCommission of New South Wales PO Box 693,Grosvenor Place NSW 1220 or by delivering it to theElectoral Commission of New South Wales Level 25,201 Kent Street Sydney NSW 2000.
(f) Notice of:(i) the date and time of the close of nominations;(ii) the details of the Returning Officer in sub paragraph
(e)(iii) shall be prominently posted on the NoticeBoard at least forty‐two (42) days prior to the datefixed for the Annual General Meeting.
(g) In accordance with and subject to Article 28(a),nominations for election to the Board shall be made inwriting and signed by two Service members, or nominatedor seconded by a member of the Board, and by the nomineewho shall thereby signify his or her consent to thenomination.
(h) A nomination can be withdrawn by the nominee at anytime prior to the close of nominations.
(i) An eligible member may be nominated for more than oneoffice.
(j) The Secretary shall immediately after the closing ofnominations post the name of each candidate and his orher proposers on the Notice Board.
(k) If the full number of candidates for the various positions onthe Board is not nominated by the close of nominationsthen those candidates who are nominated shall be declaredelected to the relevant positions and additionalnominations shall with the consent of the nominee ornominees be made at the meeting for the position not sofilled.
(l) If by the close of nominations there be only the requisitenumber of candidates nominated for the various positionsthose candidates shall be declared duly elected.
(m) If by the close of nominations there be more than therequired number of candidates nominated for any positionan election by secret ballot shall take place in respect ofthat position in accordance with this By‐law 19.
(n) If a member who has been nominated for more than oneoffice is elected to a senior office, the member shall beeliminated from the election for the junior office. For thepurposes of this By‐law 19 the order of seniority of shallbe:(i) Firstly ‐ President (ii) Secondly ‐ Senior Vice President (iii) Thirdly ‐ Vice President (iv) Fourthly ‐ Ordinary Director
(o) The Returning Officer shall supervise the preparation ofballot papers.
(p) The order in which names of candidates appear on theballot paper shall be determined by lot drawn by theReturning Officer.
(q) Members will be able to cast their votes in the premises ofthe Club on the Wednesday through to the Sunday(inclusive) in the week immediately preceding the week inwhich the Annual General Meeting is to be held betweenthe following times on each day: 9.00 am to 2.00 pm and3.00 pm to 8.00 pm
(r) The Returning Officer shall supervise the issue of ballotpapers.
(s) Members shall record their vote by placing a number in thesquare on the ballot paper against the name of thecandidate for whom they wish to vote. For a ballot paperto be formal at least one preference must be indicated bythe number “1” marked against a candidate on a ballotpaper.
(t) Members shall place their ballot papers in the ballot boxprovided at the Club.
(u) The Returning Officer shall supervise the safe custody ofthe ballot box and ballot papers placed in the ballot box.
(v) The Returning Officer shall supervise the examination ofballot papers.
(w) The decision of the Returning Officer as to the formality orinformality of any vote shall be final.
(x) Votes will be counted on the “first past the post” methodusing numbers. The Returning Officer shall supervise thecounting of votes.
(y) In the event of an equality of votes, the Returning Officershall draw lots between the candidates who had the samenumber of votes and the candidate who is drawn first shallbe declared elected to that position.
(z) The Returning Officer shall report the result of the ballot tothe meeting.
(aa) If the Returning Officer is not present, a scrutineer shallperform the duties of the Returning Officer set out in thisBy‐law 19.
(bb)If at the close of the Annual General Meeting any vacanciesremain on the Board, such vacancies shall be casualvacancies and may be filled in accordance with Article 30.
(cc) Members shall not on the premises of the Club (includingthe car park) issue or cause to be issued or distributed toother members any how to vote card or similar documentsor material advocating that members either vote for oragainst any candidate or group of candidates seekingelection to the Board of Directors of the Club”

SUB BRANCH – PRESIDENT’S REPORTAnother year done and dusted. I hope that all of you had a joyous Christmas, with lots of family fun, and that the New Year, so far, has been up to your hopes and expectations.Our Sub Branch continues to function well and prosper, with our Members enjoying the results of that prosperity. These benefits will continue into the future.
As you are, no doubt aware I will not be nominating for any position on the Management Committee at the Annual General Meeting to be held on 12 March 2014. I am not retiring for any reasons of health, but I feel that after having served for the past twelve years as your President that the time has come for a change of leadership. I have enjoyed working with you Members of this Sub Branch, and over the years, together we have achieved very significant changes to the fortunes of our Sub Branch, this will continue into the foreseeable future.
I thank you Members of the Management Committee for your loyalty and support over the years. Everything that we achieved, we achieved together, and I ask of you for the future to always remember that Unity is Strength.
My sincere thanks to the various Sporting Bodies for your kind invitations to attend your end of year celebrations and to take part in their Trophy presentations. Domenica and I have always enjoyed ourselves and the pleasure of your company.
On 7 December 2013, the Sub Branch held its Annual Christmas Lunch, which was very well attended, and a good time was had by all. Also on that day we gave the Annual Smithfield RSL Sub Branch Scholarships to Students from the five Public High Schools from this area, to assist them in the start of their tertiary education, this is a Smithfield Sub Branch initiative and is greatly appreciated by those students who receive the Grant and also by the High Schools involved.
Upcoming Sub Branch events are: AGM Meeting on 12 March 2014 at 7:30pm, The Commemoration Sunday March on 20 April 2014, and the ANZAC Day Dawn Service on 25 April 2014, I look forward to seeing your there and at our regular Monthly meetings.Once again I wish you and your families and friends a Happy and Healthy New Year.

The Annual General Meeting was held on 19 November 2013 at the Club. The first event of the 2014 calendar was held at Greenwell Point on the weekend of 6-8 December 2013.The weather and sea forecast was for fine weather but a lumpy 3 metre swell with a little wind also on the agenda. The Bureau were spot on, the fishing was slow initially, but things started to heat up. Jaime Nelson caught a 3.3kg snapper, Paul Attard caught his first and second snapper ever, and Alan Hardy also caught a great mixed bag whilst fishing on the Yellow Sub. Selai Nelson also caught some solid trevally. Those on Cool Cat were in the groove with Paul Camilleri hooking up and landing a 2.4kg John Dory and fellow crew Jimmy O Sullivan, Joe Formosa and skipper Paul Grima also catching a number a great fish. Steve and Trish Noack both bagged out on flathead, with Kevin Smith ending up on 16. Good effort Kev. John Brooks caught a beaut bream fishing south. Sunday conditions were a lot windier, so fishing time was limited. The winner of the weekend was Selai Nelson with Steve Noack runner up. The next event will be held on the Australia Day Long Weekend at Mount White. Until next write up – tight lines
CRICKET REPORTThe season is at the half way point with all sides being competitive with many strong individual performances. The Under 10’s are currently 6th and the under 14’s currently 5th both sides if they can string a few wins together in the new year will be pushing for a place in the semi-finals. The senior sides are performing strongly with the second grade side currently 2nd, third grade are 4th, fourth grade are equal 3rd and fifth grade are 6th.
Our Pink Stumps day will be held on 22 February 2014 at Brennan Park all proceeds from this day go to the McGrath Foundation.
