TECHNICAL REQUIREMENTS TO THE FEZ BORDER

• FEZ should be separated from the customs territory of the Republic of Armenia

• FEZ separa-tion from RA customs ter-ritory should be carried out through fenc-ing

• FEZ building or part of the FEZ building from the outside should be illu-minated, cam-eras should be installed to observe the whole territory or part of the building

• If a free eco-nomic zone is established in a building or in several parts of the building, the windows of the building or the windows of that part of the build-ing should be covered with metal fence, in addition the exit and en-trance should be separated and bordered.

ON FREE ECONOMIC ZONES

Article 1. Subject matter of the Law

This Law regulates the legal relationships arising during the establishment,organisationandliquidationoffreeeconomiczones.

Article 2. Legislation on free economic zones

1.ThelegislationonfreeeconomiczonesintheRepublicofArmeniacomprisesthisLaw,theCivilCode,lawsregulatingcustomsandtaxrelationshipsandotherlegalactsoftheRepublicofArmenia.2.WhereinternationaltreatiesoftheRepublicofArmeniaprovidefornormsotherthanthoseenvisagedbythisLaw,thenormsoftheinternationaltreatiesshallapply.

Article 3. Concepts used in this Law

MainconceptsusedinthisLaw:(1) “Free economic zone”shallmeanthespecialareadefinedbytheGovernmentof the Republic of Armenia (hereinafter referred to as “the Government”) inaccordance with this Law, which is deemed to be beyond the customs area oftheRepublicofArmeniaandwhereinentrepreneurialactivitiesarecarriedout inaccordancewiththespecificsofthisLaw.Different operational types of free economic zones may be established in theterritoryoftheRepublicofArmenia;(2) “Organiser of a free economic zone” (hereinafter referred to as “theOrganiser”)shallmeanthelegalpersonestablished(founded)bytheGovernmentorselecteduponthedecisionoftheGovernment,withthesoleaimoforganisinga free economic zone that ensures the creation of infrastructures necessary forcarryingoutactivitiesinthefreeeconomiczoneandtherenderingofservices;(3) “Operator of a free economic zone” (hereinafter referred to as “theOperator”) shall mean the commercial legal person, individual entrepreneur ora branch registered in the Republic of Armenia that performs entrepreneurial

activitiessolelyinthefreeeconomiczoneinaccordancewiththisLaw,aswellastherepresentationofaforeignorganisationholdingarespectiveauthorisationissuedbytheGovernmentandarespectivecontractsignedwiththeOrganiser;(4)“Authorisedbody”shallmeanthestateadministrationbodyauthorisedbytheGovernmentinthefieldofstatepolicyonfreeeconomiczones.

Article 4. Granting authorisation of the Operator and the selection of the Organiser

1. The authorisation of theOperator shall be granted andwithdrawn under theprocedureestablishedbytheGovernment.2.TheauthorisationoftheOperatorshallbeissuedbytheGovernmentfollowingtheevaluationofthebusinessplansubmittedbytheOperator.3. The requirements to the business plan submitted by the Operator and theevaluationprocedurethereofshallbeestablishedbytheGovernment.4.TheOperatorshallreceiveanadditionalauthorisationforcarryingoutactivitiesotherthanthosedefinedbytheauthorisation.5.Incaseofviolationoforfailuretocomplywiththerequirementsdefinedbytheauthorisationgranted inaccordancewithpart1of thisArticle, theauthorisationshallbewithdrawn.6.Theprocedureandcriteria forselectingtheOrganisershallbedefinedbytheGovernment.

Article 5. Establishment of a free economic zone

1.ThefreeeconomiczoneshallbeestablisheduponthedecisionoftheGovernment.2.ThedecisionoftheGovernmentontheestablishmentofafreeeconomiczoneshallinclude:(1)theobjectiveofestablishingafreeeconomiczone;(2)thedescriptionandthebordersofthearea;(3)theoperationaltype;(4)thetypesofactivitiestobecarriedoutbytheOperator;(5)thetimelimitsfortheactivitiesofthefreeeconomiczone;(6)thequalifyingstandardsfortheOrganiserandtheOperator;(7)theinvestmentprogrammefortheestablishmentofafreeeconomiczone;(8)personaldataoftheOrganiser,iftheOrganiserisknowninadvance;(9)othernecessarydataandrequirements.3.IfthefreeeconomiczonefailstostartoperatingwithinoneyearafteradoptingthedecisionoftheGovernmentontheestablishmentofаfreeeconomiczone,thedecisionoftheGovernmentontheestablishmentofafreeeconomiczoneshallberevoked.

Article 6. Requirements for a free economic zone

1.Thefreeeconomiczoneshouldqualifyforthefollowingrequirements:(1)beequippedwithfacilitiesforbringingincargotransportationmeans,includingrailwaytransport,withaparkingspaceandadeadend;(2)bedemarcatedwithaborderincompliancewiththetechnicalrequirementstotheborderlineapprovedbytheGovernment;(3)beprovidedwiththeconditionsnecessaryforcarryingoutcustomscontrolandcustomsformalitiesbycustomsofficers;(4)havefacilitiesforfreemovementofgoodswithinthefreeeconomiczone;(5)beequippedwithsafety,first-aidandanti-firesystems;(6)haveuninterruptedwater supplyandwastewater collection system,energysupply,gassupply,solidwastedisposalandatleastatelephonelineandinternetasmeansofcommunication;(7)beequippedwithappropriatemeansofcomplyingwithsanitaryandhygienicnorms;(8)haveaquarantineservicearea;(9)beprovidedwithlogisticsequipmentforpreservationofgoodsaswellaswithcommunicationandothermeansnecessaryfortheloading,unloading,transporta-tionandstoragefacilities.2.Therequirementsofpoint1ofpart1ofthisArticlemaybenotcompliedwithwherethefulfilmentthereofisjustifiedtobetechnicallyimpossible.

Article 7. Concluding the contract on organising the free economic zone

1.Theauthorisedbody,onbehalf of theGovernment, shall concludea relevantcontractwiththeOrganiser.2.ThelegalregimedefinedbythelegislationoftheRepublicofArmeniaforthefreeeconomiczoneshallbeappliedfromthedatereferredtointhecontractconcludedbetweentheauthorisedbody,onbehalfoftheGovernment,andtheOrganiser,un-lessanotherdateisdefineduponthedecisionoftheGovernment.3.ThecontractconcludedbetweentheauthorisedbodyandtheOrganisershallbesubjecttopublicationintheofficialwebpageoftheauthorisedbody.

Article 8. Powers of the authorised body

1.Theauthorisedbody: (1)mayrecommendtheGovernmenttomakeamendmentstothecontractonor-ganisationofthefreeeconomiczoneortorescindit;(2)shallexercisecontroloverthecompliancewiththecontractualobligationsoforganisingthefreeeconomiczone;

(3)shallconductastudyonthecompliancewiththerequirementsdefinedbytheauthorisationoftheOperatorofafreeeconomiczoneand,ifnecessary,furnishtheGovernmentwitharespectiverecommendation;(4)shallrequirereportsfromtheOrganiserontheactivitiesinthefreeeconomiczoneundertheprocedureprovidedforandasprescribedbytheGovernment;(5) shall performother functionsenvisagedby the legislationof theRepublic ofArmenia;(6)shallsubmitaproposaltotheGovernmentonwithdrawaloftheauthorisationgrantedtotheOperator.

Article 9. Obligations of the Organiser

1.TheobligationsoftheOrganisershallbeasfollows:(1) toconstruct,exploit theengineeringconstructionsand infrastructuresof thefreeeconomiczoneasprescribedbythelegislationoftheRepublicofArmeniaaswellastoensuretherequirementsprovidedforbyArticle6ofthisLaw;(2)toconcludeacontractwiththeOperatorshavingreceivedanauthorisationfromtheGovernmentandexercisecontrolovertheimplementationofthecontract;(3)todefinethepeculiaritiesofinternalsafetyrulesofthefreeeconomiczone;(4)toensurethefulfilmentofthequalifyingrequirementsforthefreeeconomiczone,providedforbythisLaw;(5)toensurethefulfilmentofcontractualobligationsconcludedinaccordancewithArticle7ofthisLaw,fortheperformanceofactivitiesinthefreeeconomiczone;(6)tosubmitreportstotheauthorisedbodyontheactivitiesforthepreviousyearinthefreeeconomiczone,asprescribedbytheGovernment;(7)toimplementmeasuresaimedattheinternationalrecognitionofthefreeeco-nomiczoneandtheengagementofOperatorstherein;(8)todefineandpublishtheoperationalrulesofthefreeeconomiczoneandfulfilotherobligationsdefinedbythecontract.

Article 10. Obligations of Operators

1.TheobligationsofOperatorsshallbeasfollows:(1)toconstructintheareaofthefreeeconomiczoneinaccordancewiththeplanapprovedinadvance,byagreeingitwiththeOrganiser;(2)tocomplywiththerequirementsofthelegislationoftheRepublicofArmeniawithregardtopursuingactivitiesinthefreeeconomiczoneandthoseoftheproce-dureforoperationofthefreeeconomiczone;(3)tocomplywiththesafetyrulesofthefreeeconomiczone,therequirementsde-finedbytheauthorisationandtofulfilotherobligationsasdefinedbythecontract.

Article 11. Restrictions in the free economic zone

1.Thefollowingtypesofactivitiesmaynotbecarriedout inthefreeeconomiczone:(1)productionandtradeofradioactivesubstances;(2)productionandtradeofarms,ammunitionandexplosives;(3) imports, storage, production and trade of narcotic drugs and psychotropicsubstanceswithoutanauthorisationissuedasprescribedbythelegislationoftheRepublicofArmenia.2.Theentryandexitofnaturalpersons,goodsandtransportationmeansintoandoutofthefreeeconomiczonewithoutcustomscontrolshallbeprohibited.3.TheentryandexitofnaturalpersonsandtransportationmeansintoandoutofthefreeeconomiczoneshallbecarriedoutasprescribedbythelegislationoftheRepublicofArmenia.

Article 12. Operation of the free economic zone

1.TheoperationofthefreeeconomiczoneshallbecarriedoutonthebasisofacontractconcludedbetweentheOperatorandtheOrganiser inaccordancewiththeoperationprocedureestablishedbytheOrganiser.2.OthertypesofactivitiesinthefreeeconomiczoneotherthanthosedefinedbythedecisionoftheGovernmentontheestablishmentofafreeeconomiczonemaybecarriedoutonlybylegalpersonsandindividualentrepreneursnotdeemedasOperators.TheactivitiescarriedoutinthefreeeconomiczonebylegalpersonsandindividualentrepreneursnotdeemedasOperatorsshallnotbeconsideredasactivitiescar-riedoutbeyondthecustomsborderoftheRepublicofArmenia.

Article 13. Tax, customs and currency regulation in the free economic zone

1.Thetaxandcustomsrelationshipsinthefreeeconomiczoneshallberegulatedbythetaxandcustoms legislationof theRepublicofArmenia, taking intocon-siderationthattheOperatorsofthefreeeconomiczonearegrantedprivilegesforpayingprofittax,valueaddedtax,propertytax,andcustomsduty.2.PeculiaritiesshallbedefinedbytheLawoftheRepublicofArmenia“Oncurrencyregulationandcurrencycontrol”withregardtothetransactionscarriedoutinthefreeeconomiczoneaswellasthetransactionscarriedoutbetweentheOperatorsandotherentitiesofcivillawrelations.

1.TheoperationofthefreeeconomiczoneshallbecarriedoutonthebasisofacontractconcludedbetweentheOperatorandtheOrganiser inaccordancewiththeoperationprocedureestablishedbytheOrganiser.2.OthertypesofactivitiesinthefreeeconomiczoneotherthanthosedefinedbythedecisionoftheGovernmentontheestablishmentofafreeeconomiczonemaybecarriedoutonlybylegalpersonsandindividualentrepreneursnotdeemedasOperators.TheactivitiescarriedoutinthefreeeconomiczonebylegalpersonsandindividualentrepreneursnotdeemedasOperatorsshallnotbeconsideredasactivitiescar-riedoutbeyondthecustomsborderoftheRepublicofArmenia.

Article 13. Tax, customs and currency regulation in the free economic zone

1.Thetaxandcustomsrelationshipsinthefreeeconomiczoneshallberegulatedbythetaxandcustoms legislationof theRepublicofArmenia, taking intocon-siderationthattheOperatorsofthefreeeconomiczonearegrantedprivilegesforpayingprofittax,valueaddedtax,propertytax,andcustomsduty.2.PeculiaritiesshallbedefinedbytheLawoftheRepublicofArmenia“Oncurrencyregulationandcurrencycontrol”withregardtothetransactionscarriedoutinthefreeeconomiczoneaswellasthetransactionscarriedoutbetweentheOperatorsandotherentitiesofcivillawrelations.

Article 14. Rendering services and exercising supervision by the State in the free economic zone

1.TheservicesrenderedbytheState inthefreeeconomiczoneshallbe imple-menteduponasimplified(‘onewindow’)principledefinedbytheGovernment.2.Therespectivestatebodiesrenderingstateservicesandexercisingsupervisionmayhavesubdivisionswithintheterritoryofthefreeeconomiczone.

Article 15. Liquidation of the free economic zone

1.Thefreeeconomiczonemaybeliquidated:(1)upon theexpiryof thedefined time limit, in case theGovernmentdoesnotadoptadecisionontheextensionofthetimelimit;(2)early—upon thedecisionof theGovernment—withprior compensationofdamagesincurredbytheOrganiserandtheOperatorsinresultoftheliquidation.2.Theprocessofearlyliquidationasperpoint2ofpart1ofthisArticlemaystartnotearlierthanoneyearafteradoptingthedecisionthereon.

Article 16. Dispute settlement in the free economic zone

1.Thesettlementofdisputeswith regard to theoperationof the freeeconomiczoneshallbecarriedoutasprescribedbythelegislationoftheRepublicofArmenia.2.ThesettlementofdisputesamongtheOperatorsmaybecarriedoutalsothroughinternationalarbitrage.

Article 17. Entry into force of the Law

ThisLawshallenter into forceon the tenthday following thedayof theofficialpromulgation.

Article1.Article15oftheLawoftheRepublicofArmeniaH0-118of14May1997"Onvalueaddedtax"shallbesupplementedwithpoint36whichreadsasfollows:

"(36)provisionofservicestotheOrganiserofthefreeeconomiczoneandtoanopera-toroffreeeconomiczone,supplyofgoodswithintheterritoryoffreeeconomiczone.".

Article2.ThisLawshallenterintoforceonthedayfollowingtheofficialpromulgation.

Article1.TheLawoftheRepublicofArmeniaH0-183of27December1997“Onincometax”shallbesupplementedwithArticle11.2whichreadsasfollows:

“Article11.2.IncomereceivedfromoperationofthefreeeconomiczoneWhendeterminingthetaxable incomewhich isduetotaxablepersonsactingasoperatorsofthefreeeconomiczoneestablishedintheterritoryoftheRepublicofArmeniaasprescribedbylaw,thegrossincomegeneratedfortheentireyearshallbedecreasedintheamountoftheincomereceivedfromtheoperationinthefreeeconomiczone.”.

Article2.ThisLawshallenterintoforceonthedayfollowingtheofficialpromulga-tion.

Article1.Article39.1oftheLawoftheRepublicofArmeniaH0-155of30September1997“Onprofittax”(hereinafterreferredtoas“theLaw”)shallbeamendedasfollows:“TheprofittaxamountofthereportingyearresultingfromtheactivitiesinthefreeeconomiczoneestablishedintheterritoryoftheRepublicofArmeniaandwhichisduetothetaxpayeractingasanoperatorofthefreeeconomiczoneasprescribedbylawshall-fortheperiodofoperatinginthefreeeconomiczone-bereducedby100%.”.

Article2.Thewords“,aswellasfromtheoperatorsofthefreeeconomiczonees-tablishedintheterritoryoftheRepublicofArmenia”shallbeaddedaftertheword“person”inArticle55(2)oftheLaw.

Article3.ThisLawshallenterintoforceonthedayfollowingtheofficialpromulgation.

PROCEDURE

FOR SELECTING AND DETERMINING THE QUALIFYING STANDARDS FOR THE ORGANISER OF THE FREE ECONOMIC ZONE

I. GENERAL PROVISIONS1.ThisProcedure(hereinafterreferredtoas“theProcedure”)determines

theproceduresandstandardsfortheselectionoftheorganiserofthefreeeconomiczoneintheRepublicofArmenia.

2.ThedefinitionsusedinthisprocedurederivefromtheLawoftheRepub-licofArmenia“OnFreeEconomicZones”andshallhavethesamemeaningsasperthereferredLaw.

3.TheorganisershallcarryoutitsactivitiesinthemannerdefinedbythelegislationoftheRepublicofArmenia,onbehalfoftheGovernmentoftheRepublicofArmeniabasedontheagreementconcludedwiththeMinistryofEconomyoftheRepublicofArmenia(hereinafterreferredtoas“theauthorisedbody”).

II. PROCEDURE FOR SELECTING THE ORGANISER4.Withaviewtoorganisingafreeeconomiczone,uponthedecisionofthe

GovernmentoftheRepublicofArmenia,thelegalpersonmaybeselectedastheorganiserofthefreeeconomiczone,inthefollowingtwocasesofestablishingfreeeconomiczones:

(1)attheinitiativeoftheGovernmentoftheRepublicofArmenia;(2)attheprivateinitiative.5.Theselectionoftheorganiserofthefreeeconomiczonecreatedatthe

initiativeoftheGovernmentoftheRepublicofArmeniaandtheconclusionoftheagreementshallbecarriedoutinaccordancewiththefollowingprocedure:

(1)followingtheadoptionoftheDecisionoftheGovernmentoftheRepub-licofArmenia“Onestablishinga freeeconomiczone”, theauthorisedbodyshallcarryouttheselectionoftheOrganiserofthefreeeconomiczoneinaccordancewith theproceduredefinedby theLawof theRepublicofArmenia “OnProcure-ments”,applyingcompetitivedialogueprocedure;

(2) the Organiser shall be selected upon the evaluation results of bidsbasedontheevaluationstandardsreferredtoinChapterIVoftheProcedure;

(3)theauthorisedbodyshallsendtheselectionresultstotheGovernmentoftheRepublicofArmeniaforitsapproval;

(4)within30daysaftertheDecisionoftheGovernmentoftheRepublicofArmenia“OnapprovingtheOrganiserofthefreeeconomiczone”entersintoforce,theGovernmentof theRepublicofArmenia representedby theauthorisedbodyshallconcludeanagreementonorganisingafreeeconomiczonewiththeselectedorganisation.

6.Theestablishmentofafreeeconomiczoneattheprivateinitiative,theselectionoftheOrganiserandtheconclusionoftheagreementshallbecarriedoutinaccordancewiththefollowingprocedure:

(1)WithaviewtoestablishingafreeeconomiczoneintheterritoryoftheRepublicofArmeniaattheprivateinitiative,theinitiatorshallsubmitabidtotheGovernmentoftheRepublicofArmenia;

(2)Thebidshallcomprisethefollowingdocuments:(a)theapplication;(b)thelistandtariffsofservicesprovidedbytheOrganiser;(c)thedescriptionofthefreeeconomiczone,theobjectiveofitsestablish-

ment,maindirectionsofactivities;(d)thelocation,blueprintofthepremises,aswellasthedesignofcon-

structionsincasethereareanyconstructionsavailableatthepremises;(e)thebusinessplan,whichshouldbeconsistentwiththestandardsre-

ferredtoinChapterIVoftheProcedure;(3)withaviewtoevaluatingthebidoftheprivateorganisationsubmitted

fortheestablishmentofafreeeconomiczone,astandinginteragencycommissionshallbeestablisheduponthedecisionofthePrimeMinisteroftheRepublicofAr-menia(hereinafterreferredtoas“theCommission”);

(4)theCommissionshall,within20days,evaluatethedocumentsincludedinthebidinaccordancewiththebidevaluationstandardsdefinedintheProcedure,andshallsubmitaconclusionontheestablishmentofafreeeconomiczonetotheGovernmentoftheRepublicofArmenia;

(5)TheGovernmentof theRepublicofArmeniashall consider the issueofappropriatenessofestablishingafreeeconomiczoneandrecognisingaprivateentityastheOrganiserofafreeeconomiczone,asaresultofwhichthebidshallbeeitherawardedorrefused;

(6)theauthorisedbodyshall,within3daysfollowingtherendereddeci-sion,communicatetotheinitiatoroftheDecisionoftheGovernmentoftheRepublicofArmenia;

(7)within30workingdaysafter thedecisionof theGovernmentof theRepublicofArmeniaonestablishingafreeeconomiczoneandapprovingtheOrgan-iserofthefreeeconomiczoneentersintoforce,theGovernmentoftheRepublicofArmeniarepresentedbytheauthorisedbody,shallconcludeanagreementonorganisingafreeeconomiczone.

III. STRUCTURE OF THE COMMISSION7.TheCommissionshallcomprise9persons:thechairperson,secretaryand7

members.ThechairpersonoftheCommissionshallbetheheadoftheauthorisedbody,andthesecretaryshallbetheheadoftherelevantsubdivisionoftheauthorisedbody.

8.TheminutesofeachCommissionsittingshallbetaken.TheminutesshallbesignedbythechairpersonoftheCommissionandbyothermembershavingat-tendedthesitting.

9.ThesittingoftheCommissionshallhaveaquorum,ifattendedbyatleasttwothirdsofthemembersoftheCommission,andincaselessthantwothirdsofthemembersoftheCommissionattended,thesittingshallbeconsideredfailedandanewsittingshallbeappointed.TheCommissionshallinformallbiddersofthedayandtimeofthenewsitting.

10.IncaseoftheabsenceofthechairpersonoftheCommission,theactivi-tiesoftheCommissionshallbemanagedbyanymemberoftheCommissionuponthedecisionofthechairperson.

IV. BID EVALUATION STANDARDS11.Thefollowingarethebidevaluationstandards:(1)Thecomplianceoftheactivitiesofeachpotentialoperatorwiththeob-

jectiveofestablishingafreeeconomiczone;(2)thelistandtariffsforservicesprovidedbytheOrganiser;(3)theamount,purposeandtermsoftheinvestments,includingthetypes

ofinvestments,whetherfinancialorproperty;(4)thecompliancewiththerequirementsreferredtoinArticle6oftheLaw,includ-

ingengineeringdesign(hereinafterreferredtoas“thedesign”)andvisualoutline,orthepro-visionofgroundsfornotobservingtherequirementsreferredtoinArticle6(1)(1)oftheLaw;

(5)measuresaimedatrecognisingthefreeeconomiczoneandbranding,in-cludingavailabilityofmarketingcontracts,involvinginternationalbrandsandotheroper-atorsinthefreeeconomiczoneandactivitiesaimedatsupportingexportoftheproductsmanufacturedandservicesprovidedinthefreeeconomiczoneandexpectedoutputs;

(6)experienceinthefieldoforganisingafreeeconomiczone(willbecon-sideredasadvantage);

(7)divisionofobligationsbetweentheOrganiserandthestate,andtheextentofinvolvementoftheparties;

(8)justificationofthenecessitytoestablishafreeeconomiczone(onlyincaseoftheprivateinitiative);

(9)environmentalassessment;(10)thenumberofjobstobecreatedbytheOrganiserandtheamountof

averagesalary.

THE PROCEDURE FOR THE GRANTING OF PERMITS TO THE OPERATORS OF FREE ECONOMIC ZONES AND

FOR THE TERMINATION THEREOF, AS WELL AS BUSINESS PLAN REQUIREMENTS SUBMITTED BY THE OPERATOR AND

THE ASSESSMENT PROCEDURE THEREOF

I. GENERAL PROVISIONS1.ThisProcedure(hereinafterreferredtoas“theProcedure”)shalldefine

theproceduresforthegrantingofpermitstotheoperatorsoffreeeconomiczonesandfortheterminationthereof,aswellasbusinessplanrequirementssubmittedbytheoperatorandtheassessmentprocedurethereof.

2.DefinitionsusedinthisRegulationshallarisefromtheLawoftheRepub-licofArmenia“OnFreeEconomicZones”andshallhavethemeaningsenvisagedbythereferredlaw.

3.Operatorsof freeeconomic zones shall bedeemed tobe commerciallegalpersons,individualentrepreneursandrepresentationsofforeignorganisations(hereinafterreferredtoas“operator”),whichhavebeengrantedtherelevantper-mitasprescribedbythisProcedure,haveconcludedacontractwiththeOrganiserandareregisteredwithintheRepublicofArmenia.

4.Thepermittooperatewithinthefreeeconomiczoneshallbegrantedfortheperiodrequestedbytheoperator,butnotlongerthantheendofoperationofthefreeeconomiczone.

II. THE PROCEDURE FOR GRANTING THE PERMIT5.Thepermittooperatewithinthefreeeconomiczoneshallbegranted

upon theDecisionof theGovernmentof theRepublic ofArmenia,basedon theopinionsubmittedbytheCommissionfollowingtheassessmentoftheapplicant’sbusinessplanasprescribedbypoint10oftheAnnexNo1oftheDecisionoftheGovernmentoftheRepublicofArmeniaNo1521of13October2011.

6.TheapplicationsubmittedtotheCommissionshallcomprisethefol-lowingdocuments:

(1)application(inprescribedform);(2)businessplan,whichmustmeetthestandardsreferredtoinChapter

IVoftheRegulation;

(3) statement submittedby theOrganiser on conditions of carrying outactivitieswithinthefreeeconomiczone.

7.TheCommissionshall,withina15-dayperiod,examinethesubmitteddocuments,assessthebusinessplanonthebasisofstandardsdefinedinthePro-cedureandsubmitarelevantopiniontotheGovernmentoftheRepublicofArmeniaforconsideration.

8.TheGovernmentoftheRepublicofArmeniashall,withina21-dayperi-od,adoptarelevantdecisiononeithergrantingapermitorrefusingtheapplication.Thegroundforrefusingtheapplicationshallbethenon-complianceoftheapplica-tionwithbusinessplanrequirementsprescribedbythisProcedure.

9. The applicant and the Organiser shall conclude a contract within 3monthsafterthedecisiontograntthepermitentersintoforce.

10.Followingtheconclusionofthecontract,theMinistryofEconomyoftheRepublicofArmenia(hereinafterreferredtoas“theauthorisedbody”)shall,withina3-dayperiod,grantapermitcertificatetotheapplicant.TheformofthecertificateshallbedefineduponthejointdecisionoftheheadoftheauthorisedbodyandtheMinisterofFinanceoftheRepublicofArmenia.

11.Upongrantingthecertificate,theauthorisedbodyshall,withina1-dayperiod,submitthecopyofthecertificatetotheStateRevenueCommitteeadjuncttotheGovernmentoftheRepublicofArmenia.

12.Theauthorisedbodyshallkeepa registerofpermitsgranted to theoperators,whichshallbepublishedontheofficialwebsiteoftheauthorisedbody.

13.TheavailabilityoftheregistershallserveasagroundforapplyingtheprivilegesgrantedtotheoperatorasperthelegislationoftheRepublicofArmenia.

III. THE PROCEDURE FOR TERMINATING THE OPERATOR’S PERMIT

14.Thedecisiononterminatingtheoperator’spermitshallbeadoptedbytheGovernmentoftheRepublicofArmeniaonthebasisoftheopinionsubmittedbytheauthorisedbody.

15.Theoperator’spermitshallbeterminatedupononeofthefollowingreasons:(1)therequestoftheoperator;(2)theterminationofthecontractbetweentheorganiserandtheoperator;(3)theliquidationofthefreeeconomiczone;(4)theexpiryofthetermsetbythepermit;(5)theviolationofornon-compliancewiththerequirementsprescribedby

thepermit;(6)theviolationoftherequirementsofArticle11(1)oftheLawoftheRe-

publicofArmenia“Onfreeeconomiczones”.16.Disputesregardingtheterminationofthepermitshallberegulatedas

prescribedbythelegislationoftheRepublicofArmenia.

IV. BUSINESS PLAN REQUIREMENTS AND ITS ASSESSMENT STANDARDS

17.Thebusinessplan (hereinafter referred toas “theplan”)shallbeas-sessedbytheCommission,byapplyingweightcoefficientsforeachoftheassess-ment standardswhere the sum total of these coefficients shouldnot exceed100units.Consideringtheoperationalsignificanceofthefreeeconomiczone,theweightcoefficientforeachofthestandardsshallbedeterminedbytheCommissionpriortotheassessment.

18.Theplanshallbeassessedbasedonthefollowingstandards:(1)exportpolicy,destinationsandvolumes;(2)complianceoftheplanwiththeaimsofestablishingthefreeeconomic

zoneanditsoperationalnature;(3)useoftechnologicalinnovations;(4)numberofemployeesandothersocialactions;(5)amountoftotalinvestments;(6)informationonkeystrategicpartners(whereappropriate).19.Theassessmentstandardsdefinedbypoint18ofthisProcedureshall

alsobeincludedinthebusinessplanrequirements.

II. THE TECHNICAL REQUIREMENTS SET FOR THE BOUNDARY OF THE FREE ECONOMIC ZONE

3.ThosefreeeconomiczoneswithintheRepublicofArmenia,theopera-tional typewhereof implies imports and exports of goods,must be demarcatedinawayastoensureitsseparationfromthecustomsterritoryoftheRepublicofArmenia.

4.TheboundariesofthefreeeconomiczoneseparatingitfromthecustomsterritoryoftheRepublicofArmeniamustbedemarcatedbyfencingitsothattoexcludethepossibilityofimportingandexportingordamaginggoodsbeyondthecustomscontrolfromthefreeeconomiczone.Thefenceofthefreeeconomiczonemustbebuiltatsuchadistancefromthebuildingsandstructuresconstructedintheterritoryofthefreeeconomiczoneinordertoexcludethepossibilitiesofimport-ingandexportinggoodsbeyondthecustomscontrolfromthefreeeconomiczone.

5.Thefollowingtechnicalrequirementsareset for fencingthefreeeco-nomiczone:

(1)thefencemustbebuiltofstone,concreteorothermaterialwhichen-surestheisolationoftheterritory;

(2)theheightofthefencemustbenotlessthan2.5metres;(3)thefencemustbeuninterruptedthroughitswholeborderline,except

fortheentryfornaturalpersons,aswellasthecheckpointsintendedforimportsandexportsofgoodsandtransportationmeans;

(4)videocamerasmustbeplacedalongthefenceatsuchadistancesothatitbecomespossibletoensurethevisibilityofthewholeterritory;

(5)thefencemustbeilluminatedfromthetwosides(insideandoutside).6.Thewholeouterpartofthefenceofthefreeeconomiczoneisdeemed

tobethecustomsboundaryoftheRepublicofArmenia.7.Intheeventthatthefreeeconomiczoneisbasedinabuildingorseveral

partsofabuilding,thewindowsofthebuildingorthepartofthebuildingmustbelatticedwithametalliclattice,andtheentryandexitmustbeseparatedandde-marcatedensuringitsdetachmentfromthecustomsterritoryoftheRepublicofAr-meniainordertoexcludethepossibilitiesofimportingandexportinggoodsbeyondcustomscontrolfromtheterritoryofthefreeeconomiczone.

8.Thebuildingorthepartofthebuildingdeemedtobethefreeeconomiczonemustbeilluminatedfromtheoutside.

9.Videosurveillancemeansmustbeplacedinthebuildingorthepartofthebuildingdeemedasthefreeeconomiczone,keepingthewholeofthebuildingorthepartthereofvisible.

10.Forthepurposeofconductingduesecuritycontrol,theOrganisermustbesuppliedwithanareanecessary forvideosurveillanceconductedbycustomsauthoritiesandtheOrganiser’ssecuritybodies(checkpoint).

11.Thefollowingtechnicalrequirementsaresetforthecheckpointofthefreeeconomiczone:

(1)thecheckpointmusthaveanareaintendedforcarryingoutcustomsformalities;

(2)thecheckpointmusthaveanareaintendedforcarryingoutcustomscontrol;

(3)thecheckpointmusthaveaseparatedareasuppliedwiththeappropri-ateequipmentforcustomsbrokers;

(4)thecheckpointmustbeprovidedwithbuildingsorequipmentspeciallyseparatedandadjusted formaintenanceofgoods,whichareunder themainte-nanceofcustomsauthorities,andrequirespecialmaintenanceconditions(fragileandperishable items, requiringa certain regimeofhumidityand temperature–flammable,hazardousfortheenvironment);

(5)thecheckpointmustbeequippedwithelectronicweighingscales(in-cludingscaleshavingthecapacityofweighingatleast80tonnesofvehicleandatleast150tonnesofrailwaysintheeventthatthesupplyofgoodsintoandfromthefreeeconomiczoneistobecarriedoutviarailwayorautomobiletransport);

(6)thecheckpointmustbeprovidedwithdevicesandequipmentsneces-saryfordetailedexamination(x-raying,detectingradioactivemeans,etc.)pursuanttotherequirementsbythesuperiorcustomsauthority;

(7) thecheckpointmustbeprovidedwithcommunicationandelectronictechnicalequipments,internetandradio-telecommunicationnecessaryfortheof-ficersofthecustomsauthoritytoorganisethecustomsformalitieson-site;

(8)thecheckpointmustbeprovidedwithothertechnicalmeansnecessaryforloading,unloading,carriageortransportationofgoods;

(9)thecheckpointmustbeprovidedwithanaudiovisualrecordingsystem.12.TheOrganiserofthefreeeconomiczonemustensuretheavailabilityof

thesecurityservice(ownorhired)andthesoundconditionofsecurityequipmentforthepurposeofassuringtheprotectionoftheterritoryofthefreeeconomiczoneandcheckpointcontrol,aswellasofvideoandaudiorecordingoftheactionsinthewholeterritoryviaremotecontrolledvideocameras.Thevideoandaudiorecordsforeachdaymustbekeptseparatelyinthecomputeroranyotherexternalmedia,whichwillgiveanopportunitytowatchandhearthevideoandaudiorecordclearlyvianumberingaccordingtothedate.Thevideorecordsmustindicatethedateandhourofrecording.Therecordedvideoandaudiosourcesmustbekeptatleastforthreeyears.

13.Intheeventofadamageofthefenceduringtheexploitationofthefreeeconomiczone,theOrganisermustforthwitheliminatethedeficienciesanddam-ages,moreover,duringtheseactivitiestheresponsibilityofensuringthesecurityofthefreeeconomiczonemustbebornebytheOrganisertogetherwiththesecurityservices.
