"The problem of women being abandoned in NRI marriages is a grave issue. For the first time, government of India is providing coordinated support to women facing problems in their marriage to NRIs," she wrote.
Gandhi also said that based on the recommendations by NCW, the Integrated Nodal Agency (INA) has been issuing Look-Out Circulars (LoCs) to absconding husbands in cases of NRI Marriages.
"Till now, 6 LoCs have been issued. MEA has also revoked passports of erring husbands," she said.

NEW DELHI: A mediation cell has been opened on the website of the
National Commission for Protection of Child Rights for complaints of
Indians who fled with their children from abroad, Union minister Maneka
Gandhi said on Friday.
Addressing a national conference of the state women commissions,
Maneka Gandhi said the cell consisting of members of the ministry of
external affairs and NCPCR would contact the embassies of the respective
countries and try to reach a solution after consultations with them.
About why India should not become a signatory of the Hague Convention,
she said If India was a signatory then the child would have to be sent back
and the woman apprehended.
"We refused that we would not send our women back so their child is
snatched away from them," the minister for women and child development
said.
She said her ministry has been desperately looking for a solution for
women who eloped from abroad with their child to escape domestic
violence or for some other issue.
"We haven't come to a solution, but till a solution is reached this cell has
been formed," she added.
The Hague Convention is a multi-national treaty that seeks to protect
children wrongfully removed by one of the parents from the custody of the
other parent.
She recommended members of the women commissions to follow three
things - release a book on the performance every year, identify single
cases and try to solve them and hire lawyers for women who cannot afford
it.

property of NRIs who have abandoned their wives.
At a seminar on "NRI marriages and trafficking of women and children", she said that a new bill is
likely to be taken up in the next session of Parliament.
"We are also developing a separate website where summons and warrants against NRI men who
have abandoned their wives and have illegally married abroad will be uploaded. Those responding
to it will be declared a proclaimed offender and his properties would be seized," she added.
Sushma Swaraj said that under the new law the passport of the person will be cancelled and the
property will also be confiscated.
"And if he doesn't return, his property could be sold to give financial aid to his aggrieved wife. We
will have to make some amendments in the Code of Criminal Procedure. We are already in talks
with Law and Home ministry and all efforts are being made to ensure that a law is in place by the
end of this year," she said.
In last three years, the MEA has received 3,328 complaints from Indian women who have been
deserted by their NRI husbands.
"We are acting tough on such cases. For a start, the passports of eight NRI men accused of
abandoning their wives have been cancelled. The accused whose passports were revoked have
surrendered," Sushma Swaraj added.

Swaraj had told Parliament in March that the 39 Indians, who were were abducted by the ISIS terror outfit in Mosul three years ago, were dead. While addressing a national conference on state women commissions, she urged them to launch a crackdown on the illegal network of agents operating across the country. She lamented that agent who transported the 39 Indians to Iraq was still sending people abroad. Swaraj said the passage of the anti-trafficking bill was a very good step but till the network of such illegal agents was curbed its full impact could not be realised. “Young boys are trafficked from Mumbai who say that they are being sent to different merchant ships as crew members, but in reality they are being sent for smuggling and when they get arrested in other countries it becomes very difficult to rescue them from there,” she rued. Swaraj advised that people need to go only through authorised Government agents. “The Ministry has all the information of people who go through government authorised agents and we know who is the employer. So in case of any unforseen incident, we have an agent responsible for them,” she said. She said the state commissions need to identify these illegal agents and give their names to the Chief Minister and ask him to take action against “so called agents”. “Half of the problem would be solved if such agents are identified and a crackdown is launched against them,” she added. New Delhi: The ministry of external affairs (MEA) is developing a portal where summons and warrants against absconding NRI husbands would be served, and if the accused does not respond he would be declared a proclaimed offender and his property would be attached, external affairs minister Sushma Swaraj said on Friday.
She said for coming up with such a portal, there needs to be amendments in the Code of Criminal Procedure (CrPc) that would allow the district magistrate to accept such summons and warrants put on the portal to be “deemed as served”.
The external affairs minister said the law ministry, legislative Assembly, home ministry and the women and child development ministry have agreed on the proposal, according to news agency PTI.
According to the MEA, 3,328 complaints have been received during the last three years (January 2015 to November, 2017) from distressed Indian women deserted by their NRI spouses. The MEA is developing a portal, where summons and warrants against absconding NRI husbands would be served, and if the accused does not respond he would be declared a proclaimed offender and his property would be “attached,” Ms Swaraj said.
Attachment is a legal process by which at the request of a creditor, designates specific property owned by the debtor to be transferred to the creditor, or sold for the benefit of the creditor. The creditor in this case would be the victim.
“We are trying if the amendments could be introduced in the Cabinet and we would try to get it passed in the next Parliament session,” Ms Swaraj was quoted as saying said at a conference on NRI Marriages and Trafficking of Women and Children.

In a bid to prevent such fraudulent marriages, the Ministry of External Affairs is developing a
portal, where summons and warrants against absconding NRI husbands would be served, and if
the accused does not respond he would be declared a proclaimed offender and his property
would be "attached", Swaraj said. Attachment is a legal process by which at the request of a
creditor, designates specific property owned by the debtor to be transferred to the creditor, or
sold for the benefit of the creditor.
The creditor, in this case, would be the victim. "We are trying if the amendments could be

summons and warrants on the website and those not responding to it will be declared a proclaimed
offender and his properties would be seized.
“We will get a law to this effect passed preferably in the next session of Parliament,” Swaraj said after
inaugurating day-long national seminar on “NRI marriages and trafficking of women and children”,
jointly organised by the MEA and the Maharashtra State Commission for Women.
The Government is in the process of developing a portal too, she said, adding that the Law Ministry,
the Home Ministry and the Women and Child Development Ministry have agreed to the proposal.
According to the MEA, 3,328 complaints were received during the last three years (January 2015 to
November, 2017) from distressed Indian women deserted by their NRI spouses. In Punjab alone,
there are over 15,000 women who are affected with this menace.
“We are acting tough in such cases. For a start, the passports of eight NRI men accused of abandoning
their wives have been cancelled. The accused whose passports were revoked have surrendered,” she
added.
Union Women and Child Development Minister Maneka Gandhi said till the time a law comes into
force, an inter-ministerial coordination committee has been formed to look into grievances of
affected women. “My Ministry gets 10-12 complaints regarding NRI marriages on a daily basis.
Similar complaints come to the MEA. The committee does coordination work and ensures that each
case is handled effectively so that aggrieved women get relief,” she said.
Talking about the problem of trafficking of women and illegal immigration, Swaraj said a new
phenomenon of “asylum seekers” have come to notice where youngsters in the age group 20-25 are
trying to get to the US through Mexico and are getting caught on borders.
“We have come across three batches of around 500 people mostly from Punjab and Haryana who
are illegally trying to get into the US. Illegal immigration agents are charging Rs 20-25 lakh for this.
It is a very dangerous trend which we need to stop,” she added. Sushma lamented despite her
repeated requests, State Governments have failed to take action against illegal agents who are
operating freely.
Maharashtra State Women Commission Chairperson Vijaya Rahatkar said the State panel has taken
various initiatives to tackle the problem of NRI marriages and trafficking of women. “Apart from
taking courts to doorsteps of affected people, we have published books in Marathi to make women
aware of various social problems affecting them.
“We have also created a helpline and a special cell for NRI marriages in Maharashtra, a first-of-its-
kind initiative in India. We have urged the Foreign Minister to create a similar cell at the national
level,” Rahatkar said.
Rahatkar further said, “Similarly cases of trafficking of women and children are also growing.
Trafficking of Indians to other nations and of women of other nationalities, particularly from Nepal,
Bangladesh, Burma and erstwhile Russian Federation nations are on the rise. We also need to find
ways to address this burning issue.”

The Ministry of External Affair’s (MEA) hands are tied when it comes to acting against
agents who illegally facilitate migration of Indians to work abroad, External Affairs Minister
Sushma Swaraj said on Friday, while urging all states to register cases against such agents
operating illegally within their jurisdiction.
“This is a rampant problem. Our hands are tied. I have written to all chief ministers to control
agents who traffic women for job,” Swaraj said said at the national conference on NRI
Marriages and Trafficking of women and children, which was organised by the MEA and
Maharashtra State Commission for Women in New Delhi.
Referring to The Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill,
2018, which was passed by Lok Sabha on Thursday, Swaraj said: “Under the Trafficking
Bill, agents will now be booked for trafficking women on pretext of employment…”
The Bill provides for the prevention, rescue, and rehabilitation of trafficked persons.
The Minister said that since the BJP government had come to power, the MEA had helped to
bring back over one lakh women, including distressed Indian women deserted by their NRI
spouses and those stuck abroad after being duped by agents over job opportunities.
Swaraj said she had come across cases where women were assured a certain job in one
country, but trafficked to another country only to be subjected to abuse. “In several cases,
these stranded Indians have created Twitter accounts to reach out to our Ministry,” the
Minister said.
Dnyaneshwar Mulay, secretary (CPV and OIA), MEA, said that Indian missions and posts in
other countries have been informed and sensitised about these issues. “Migrants seeking
employment abroad should go through only government agents,” he said.
To regulate issues arising in marriages with NRIs, Swaraj said, the MEA is developing a
portal where summons and warrants against absconding NRI husbands would be served, and
if the accused does not respond he would be declared a proclaimed offender and his property
would be attached.
“For this a CrPC amendment is required. Home Ministry and WCD are on it with us. A
dedicated portal on our website will display list of court summons in NRI marriage cases and
it will be deemed as served. The husband will be declared offender if he does not appear,”
she said.
Union WCD minister Menaka Gandhi meanwhile said that a single window portal had been
already set up to accept all such complaints. “The WCD provides names for lookout notices
to MEA that can revoke passports in cases where husband is found guilty of abandoning his
wife…Eight cases have come to us so far where passports have been revoked,” she said.
Gandhi said that while around 200 one-stop-crisis centre exist in India, over 600 more are
slated to be launched for women in legal or medical aid.
According to Rakesh Kumar Garg, Chairperson of State Commission for NRI in Punjab,
maximum number of complaints related to NRI marriages have been registered in the state.

पर प्रकाडशत होने के बाि यह माना िाएगा डक िारंट-नोडटस संबंडधत व्यक्ति ने इसे पढ़
डलया है।
डििेश मंत्री ने कहा डक यह िेखा गया है डक यहां से शािी कर भागने िाले िुले् डििेश में
िाकर अपना पता, ईमेल ि फोन नंबर बिल लेते हैं। उसी को ध्यान में रखकर यह
िेबसाइट तैयार की िा रही है। भगोडे़ िुले् की भारत में संपडि िब्त करने का िो मसौिा
तैयार डकया गया है, उस पर कें द्रीय गृह मंत्री रािनाथ डसंह, कानून मंत्री रडिशंकर प्रसाि
और मडहला एिं बाल डिकास मंत्री मेनका गांधी सहमत हैं। अकेले पंिाब में ही करीब 15
हिार मडहलायें ऐसी हैं, िो एनआरआई डििाह के मामलो ंमें फंसी हैं।
डििेश भेिने के डलए मानि तस्करी का एक नया रूप सामने आया है। डििेश मंत्री ने कहा,
एिेंट लोगो ंको शरणाथी बनाकर डििेश भेि रहे हैं। इसमें पंिाब पहले नंबर पर, हररयाणा
िूसरे और गुिरात तीसरे स्थान पर है। एक व्यक्ति से लगभग 25 लाख रुपए डलए िाते हैं।
एिेंट इनके िस्तािेि में क्या डलखते हैं, यह बड़ा रोचक है।

तस्करी के िररये इराक भेिने के डलये डिमे्मिार एिेंट अब भी अपना धंधा चला रहा है। इस एिेंट ने डिन
39 भारतीयो ंको इराक भेिा था , उन्ें िहां अगिा कर डलया गया था और बाि में उनकी हत्या कर िी
गयी। डििेश मंत्री सुषमा स्वराि ने राज्य मडहला आयोगो ंसे ऐसे गैरकानूनी एिेंटो ंके क्तखलाफ मुडहम चलाने
का अनुरोध डकया।
स्वराि ने माचि में संसि को बताया था डक तीन साल पहले मोसुल में आतंकिािी संगठन आईएसआईएस
द्वारा बंधक बनाये गये 39 भारतीयो ंकी मौत हो चुकी है। राज्य मडहला आयोगो ंके एक राष्ट्र ीय समे्मलन को
संबोडधत करते हुए उन्ोनें अनुरोध डकया डक आयोग िेशभर में चल रहे ऐसे एिेंटो ंके गैरकानूनी नेटिकि
के क्तखलाफ मुडहम शुरू करें। उन्ोनें खेि व्यि डकया डक डिस एिेंट ने 39 भारतीयो ंको इराक भेिा था ,
िह अब भी लोगो ंको डििेश भेि रहा है।
स्वराि ने कहा डक मानि तस्करी रोधी डिधेयक का पाररत होना एक बहुत अच्छा किम है लेडकन िब तक
ऐसे अिैध एिेंटो ंके नेटिकि को खत्म नही ंडकया िाता तब तक इसका पूरा प्रभाि नही ंडिखेगा। उन्ोनें
कहा, ‘‘मंुबई से युिाओ ंकी तस्करी हो रही है, डिन्ें कहा िाता है डक उन्ें चालक िल के सिस्य के तौर
पर डिडभन्न व्यापाररक िहािो ंपर भेिा िा रहा है। लेडकन हकीकत में उन्ें मानि तस्करी के इरािे से भेिा
िाता है और िब अन्य िेशो ंमें उन्ें डगरफ्तार कर डलया िाता है तो िहां से उन्ें मुि कराने में बहुत
कडठनाई आती है।’’
स्वराि ने लोगो ंको डसफि अडधकृत सरकारी एिेंटो ंके िररये ही डििेश िाने की सलाह िी। उन्ोनें कहा,
‘‘सरकारी एिेंटो ंके माध्यम से िाने िाले लोगो ंके बारे में मंत्रालय के पास सारी सूचनाएं होती हैं और हम
िानते हैं डक कौन उनका डनयोिा है। इसडलए डकसी भी अनपेडक्षत घटना के मामले में हमारे पास उनके
डलये डिमे्मिार एिेंट होता है।’’
सुषमा ने कहा डक राज्य के आयोगो ंको ऐसे अिैध एिेंटो ंकी पहचान करने की आिश्यकता है। इनके नाम
िे मुख्यमंत्री को िें और उनके क्तखलाफ कारििाई करने को कहें। उन्ोनें कहा, ‘‘अगर ऐसे एिेंटो ंकी
पहचान कर उनके क्तखलाफ मुडहम शुरू की िाती है तो आधी समस्या खत्म हो िायेगी।’’

New Delhi, July 27 (IANS) External Affairs Minister Sushma Swaraj on Friday said that her ministry is framing a new law to tackle the problem in NRI marriages and providing for deterrent measures like confiscating property of NRIs who have abandoned their wives. At a seminar on "NRI marriages and trafficking of women and children", she said that a new bill is likely to be taken up in the next session of Parliament. "We are also developing a separate website where summons and warrants against NRI men who have abandoned their wives and have illegally married abroad will be uploaded. Those responding to it will be declared a proclaimed offender and his properties would be seized," she added. Sushma Swaraj said that under the new law the passport of the person will be canceled and the property will also be confiscated. "And if he doesn't return, his property could be sold to give financial aid to his aggrieved wife. We will have to make some amendments in the Code of Criminal Procedure. We are already in talks with Law and Home ministry and all efforts are being make to ensure that a law is in place by the end of this year," she said. In last three years, the MEA has received 3,328 complaints from Indian women who have been deserted by their NRI husbands. "We are acting tough on such cases. Sushma Swaraj (Photo: PIB/File) External Affairs Minister Sushma Swaraj today asked the concerned authorities to take strict action against illegal agents who have been sending people on false promises abroad.
Addressing a national conference in New Delhi on NRI marriages and trafficking of women and children, she said people were suffering and being exploited in the name of good opportunities in foreign countries by these agents. She said, there was a need to create awareness among people that they must opt for government registered agents only. The minister asked the states to identify such illegal agents who were bypassing all rules and regulations. Her ministry has saved a large number of women who were being sent abroad on the false promise of employment.
On the issue of NRI marriages, she said efforts are being made to provide justice to those females who have suffered in such marriages. She asked people to carefully verify the NRI grooms before the marriage.
She said in Punjab alone more than 15,000 females have been left by their NRI husbands which is a matter of concern.
The MEA, the minister said, was developing a portal where summons and warrants against absconding NRI husbands would be served, and if the accused did not respond he would be declared a proclaimed offender and his property attached,
For coming up with such a portal, the Code of Criminal Procedure (CrPc) needed to be amended to allow district magistrates to accept such summons and warrants put on the portal to be “deemed as served”.
Swaraj said the Law Ministry, Legislative Assembly, Home Ministry and the Women and Child Development Ministry have agreed on the proposal.

The Centre is in the process of strengthening the legal framework to
prosecute the absconding NRIs who abandon their wives which will
include confiscation of property owned by them or their relatives.
External Affairs Minister Sushma Swaraj on Friday said the
government will enact a law during the next session of Parliament, if
not during the current session to beef up the legal provisions.
Other measures which will be incorporated in the proposed law
include posting the court warrants and summons on a website being
developed by the ministry against the accused NRIs.
They will be deemed as served, and legal action proceeded accordingly
against the person.
Those who will not respond to the warrants and summon will be
considered a proclaimed offender leading to seizure of his or his
relatives properties, said Swaraj, while inaugurating a day-long
National Seminar on “NRI marriages and trafficking of women and
children jointly organised by MEA and Maharashtra State
Commission for Women.
The law will ensure that deserter husband is penalised, Swaraj said.
“We will not only cancel his passport but also confiscate his property.
And if he doesn’t return, his property could be sold to give financial
aid to his aggrieved wife. We will have to make some amendments in
the Code of Criminal Procedure…We are already in talks with Law and
Union Home Ministry and all efforts are being make to ensure that a
law is in place by the end of this year,” she added.
Till the time the new law is in place a committee consisting of
personnel of MEA, Women and Child Development (WCD) and Law
Ministry and Home Affairs under the nodal authority of WCD had
been constituted to look into complaints against NRIs in abandoning
and physical abuse of their wives.
The MEA has been continuously receiving complaints about NRIs in
the matter. In Punjab alone, there are over 15,000 women who are
affected with this menace.
Attributing the practice to be a fad among youngsters and their
parents to settle abroad, she said: “In last three years, the ministry has
received 3,328 complaints from Indian women who have been
deserted by their NRI husbands.
“We are acting tough on such cases. For a start, the passports of eight
NRI men accused of abandoning their wives have been cancelled. The
accused whose passports were revoked have surrendered,” Swaraj
added.
A top official of the MEA told The Tribune that MEA and the Law
Ministry, WCD and Home Affairs have agreed in principle to
strengthen the legal framework.
Addressing the conference, WCD minister Maneka Gandhi said the
need for strengthening the legal framework is on account of NRIs not
responding to justice system, and often furnishing fake addresses to avoid court summons and warrants.

The MEA is developing a portal where summons and warrants against absconding
NRI husbands would be served, and if the accused does not respond he would be
declared a proclaimed offender and his property would be attached, Union
minister Sushma Swaraj said today.
She said for coming up with such a portal, there needs to be amendments in the
Code of Criminal Procedure (CrPc) that would allow district magistrate to accept
such summons and warrants put on the portal to be "deemed as served".
The External Affairs minister said the Law Ministry, Legislative Assembly, Home
Ministry and the Women and Child Development Ministry have agreed on the
proposal.
Swaraj said the move aims to prevent NRI marriages where husbands abandon
their wives and abscond or mentally and physically abuse them after marriage in a
foreign country.
According to the Ministry of External Affairs, 3,328 complaints have been
received during the last three years (January 2015 to November, 2017) from
distressed Indian women deserted by their NRI spouses.
In a bid to prevent such fraudulent marriages, the Ministry of External Affairs is
developing a portal, where summons and warrants against absconding NRI
husbands would be served, and if the accused does not respond he would be
declared a proclaimed offender and his property would be "attached", Swaraj said.
Attachment is a legal process by which at the request of a creditor, designates
specific property owned by the debtor to be transferred to the creditor, or sold for
the benefit of the creditor. The creditor in this case would be the victim.
"We are trying if the amendments could be introduced in the Cabinet and we
would try to get it passed in the next Parliament session," she said at the national
conference on NRI Marriages and Trafficking of Women and Children.
But in the meantime, an inter-ministerial committee has been established for which
the Ministry of Women and Child Development is the nodal authority.
The committee also has members from the Law Ministry and the Ministry of
External Affairs and based on their recommendations lookout notices against eight
absconders have been issued and their passports have been cancelled.
"The accused whose passports were revoked have surrendered," she added.
A Women and Child Development official has said the committee has received 70
complaints in the last two months based on which the National Commission for
Women conducted its probe and recommended cancellation of eight passports.

External Affairs Minister Sushma Swaraj on Thursday said the agent responsible for
trafficking 39 Indians to Iraq, who were abducted and later killed, was still operating his
business and urged state women commissions to crackdown against such illegal agents.
Swaraj had told Parliament in March that the 39 Indians, who were abducted by the ISIS
terror outfit in Mosul three years ago, were dead.
While addressing a national conference on state women commissions, she urged them
to launch a crackdown on the illegal network of agents operating across the country.
She lamented that agent who transported the 39 Indians to Iraq was still sending people
abroad.
Swaraj said the passage of the anti-trafficking bill was a very good step but till the
network of such illegal agents was curbed its full impact could not be realised.
“Young boys are trafficked from Mumbai who say that they are being sent to different
merchant ships as crew members, but in reality they are being sent for smuggling and
when they get arrested in other countries it becomes very difficult to rescue them from
there,” she rued.
Swaraj advised that people need to go only through authorised government agents.
“The ministry has all the information of people who go through government authorised
agents and we know who is the employer. So in case of any unforseen incident, we have
an agent responsible for them,” she said.
She said the state commissions need to identify these illegal agents and give their names
to the chief minister and ask him to take action against “so-called agents”.
“Half of the problem would be solved if such agents are identified and a crackdown is
launched against them,” she added.

Indians to Iraq three years ago was still running his business. She requested state women
commissions to take action against such illegal agents across the country, reported PTI. The
minister was addressing a national conference on state women commissions.
In March, Swaraj had told Parliament that the 39 Indians, who were kidnapped by the Islamic
State in Mosul, had been killed.
Swaraj said passing the anti-trafficking bill was a very good step but its impact would not be
completely felt till the network of such illegal agents was active. “Young boys are trafficked

External Affairs Minister Sushma Swaraj on Friday said that her ministry is framing a new
law to tackle the problem in NRI marriages and providing for deterrent measures like
confiscating property of NRIs who have abandoned their wives.
At a seminar on "NRI marriages and trafficking of women and children", she said that a
new bill is likely to be taken up in the next session of Parliament.
"We are also developing a separate website where summons and warrants against NRI
men who have abandoned their wives and have illegally married abroad will be
uploaded. Those responding to it will be declared a proclaimed offender and his
properties would be seized," she added.
Sushma Swaraj said that under the new law the passport of the person will be canceled
and the property will also be confiscated.
"And if he doesn't return, his property could be sold to give financial aid to his aggrieved
wife. We will have to make some amendments in the Code of Criminal Procedure. We are
already in talks with Law and Home ministry and all efforts are being make to ensure that
a law is in place by the end of this year," she said.
In last three years, the MEA has received 3,328 complaints from Indian women who have
been deserted by their NRI husbands.

NEW DELHI: The MEA is developing a portal where summons and warrants against absconding NRI husbands
would be served, and if the accused does not respond he would be declared a proclaimed offender and his
property would be attached, Union minister Sushma Swaraj said today.
She said for coming up with such a portal, there needs to be amendments in the Code of Criminal Procedure
(CrPc) that would allow district magistrate to accept such summons and warrants put on the portal to be "deemed
as served".
The External Affairs minister said the Law Ministry, Legislative Assembly, Home Ministry and the Women and
Child Development Ministry have agreed on the proposal.
Swaraj said the move aims to prevent NRI marriages where husbands abandon their wives and abscond or
mentally and physically abuse them after marriage in a foreign country.
According to the Ministry of External Affairs, 3,328 complaints have been received during the last three years
(January 2015 to November, 2017) from distressed Indian women deserted by their NRI spouses.
In a bid to prevent such fraudulent marriages, the Ministry of External Affairs is developing a portal, where
summons and warrants against absconding NRI husbands would be served, and if the accused does not respond
he would be declared a proclaimed offender and his property would be "attached", Swaraj said.
Attachment is a legal process by which at the request of a creditor, designates specific property owned by the
debtor to be transferred to the creditor, or sold for the benefit of the creditor. The creditor in this case would be
the victim.
"We are trying if the amendments could be introduced in the Cabinet and we would try to get it passed in the next
Parliament session," she said at the national conference on NRI Marriages and Trafficking of Women and
Children.
But in the meantime, an inter-ministerial committee has been established for which the Ministry of Women and
Child Development is the nodal authority.
The committee also has members from the Law Ministry and the Ministry of External Affairs and based on their
recommendations lookout notices against eight absconders have been issued and their passports have been
cancelled.
"The accused whose passports were revoked have surrendered," she added.
A Women and Child Development official has said the committee has received 70 complaints in the last two
months based on which the National Commission for Women conducted its probe and recommended

बक्ति मडहला आयोग या डकसी िूसरे न्याडयक शक्ति प्राप्त संगठन द्वारा भेिे गए समन की
भी तामील कराएगा। िह समन डििेश मंत्रालय की िेबसाइट पर अपलोि होगा। इसके बाि
आरोपी एनआरआई पडत के पास ििाब न िेने का कोई भी बहाना नही ंबचेगा।
िेशभर में ऐसे मामलो ंके डनपटारे के डलए डििेश मंत्रालय में डसंगल डिंिो डसस्टम भी शुरू
कराया िा रहा है। इसके साथ िेश के सभी राज्य मडहला आयोग इस डसस्टम से िुड़
िाएंगे। उनकी िांच ररपोटि पर ही यह मंत्रालय केस को िूसरे मुि में िहां की न्याडयक
व्यिस्था के मुताडबक आगे बढ़ाएगा। डपछले िो-तीन साल में ऐसे तीन-चार हिार मामले
पंिीकृत हुए हैं।
एनआरआई वििाह: कब और कैसे शुरू हहते हैं झगडे
महाराष्ट्र राज्य मडहला आयोग की चेयरमैन एिं भािपा मडहला मोचे की राष्ट्र ीय अध्यक्ष
डििया रहाटकर ने इस डिषय पर अमर उिाला िॉट काम के साथ डिशेष बातचीत की है।
उनका कहना है डक हमारे िेश में एनआरआई डििाह से संबंडधत झगडे़ बढ़ते िा रहे हैं।
िब डििाह की बात होती है तो लड़की पक्ष सभी बातो ंपर ध्यान नही ंिेता। उनके डलए बड़ी
बात केिल यही होती है डक हमारी लड़की डििेश िाएगी।
कई केसो ंमें िेखने को डमला है डक डििाह के बाि लड़का यह कह कर डििेश चला िाता है
डक िह िो-तीन माह में लड़की को िहां पर बुला लेगा। कुछ मामलो ंमें यह होता है डक
लड़की साथ तो चली िाती है, लेडकन डििेश में उसे प्रताड़ना झेलनी पड़ती है। यह क्तस्थडत
सबसे ज्यािा कष्ट्िायक होती है, क्योडंक िूसरे मुि में उसकी मिि करने िाला कोई नही ं
होता। िहां के कानून की िडटलतायें भी पीडड़ता को बेबस होने के डलए मिबूर कर िेती है।
अगर साथ में बच्चा भी है तो मडहला के डलए डिक्कतें और अडधक बढ़ िाती हैं।
सही राह समझ नही ों आती
ऐसे मामलो ंमें लड़की के माता-डपता अपने शहर की पुडलस और कोटि कचहरी के चक्कर
काटते हैं। डिन्ें थोड़ा बहुत मालूम होता है, िे राज्य मडहला आयोग, राष्ट्र ीय मडहला एिं बाल
कल्याण मंत्रालय, मानिाडधकार आयोग और राष्ट्र ीय मडहला आयोग के पास फररयाि लगाते
हैं। इन सब िगहो ंपर उन्ें िैसी ही सामान्य डिक्कतो ंका सामना करना पड़ता है, िो
स्थानीय स्तर पर िेखने को डमलती हैं।
डगनती के कुछ पररिार, डिन्ें डििेश मंत्रालय की कुछ िानकारी होती है, िे िहााँ पहंुच
िाते हैं। िो पररिार सीधे यहां पर आ िाते हैं, उन्ें डकसी न डकसी रूप में नीचे की
संस्थाओ ंके पास ही लौटना पड़ता है। डििेश मंत्रालय केिल पुख्ता आधार पर ही डकसी
मामले को लेकर िूसरे िेश को कुछ डलख सकता है। उसके डलए मंत्रालय पहले पुडलस,
अिालत या आयोग की ठोस िांच ररपोटि का अध्ययन करता है।
वसोंगल विोंडह वसस्टम का यह फायदा हहगा
एनआरआई डििाह के झगडे़ से संबंडधत कोई भी केस िब डकसी राज्य मडहला आयोग के
पास िाएगा तो उसकी सूचना तुरंत डििेश मंत्रालय के पास भी पहंुचेगी। ऐसे मामलो ंके
डनपटारे के डलए डपछले डिनो ंडििेश मंत्रालय में एक कमेटी का गठन डकया गया है। इसमें
राष्ट्र ीय मडहला आयोग, डििेश मंत्रालय, गृह मंत्रालय और मडहला एिं बाल कल्याण मंत्रालय
के प्रडतडनडध शाडमल हैं। डििया रहाटकर ने बताया डक इस प्रडक्रया में सभी राज्य आयोग,
केस को आगे बढ़ाने में कमेटी की मिि करें गे। कमेटी को िरूरी िस्तािेि मुहैया कराए
िाएंगे। इससे सभी केसो ंकी प्रगडत ररपोटि भी डमलती रहेगी।
एनआरआई दुल्ा कहेगा, जी मैं आ रहा हों...
अभी तक िो व्यिस्था है, उसके तहत एनआरआई िुल्ा लड़की के पररिन ही नही,ं बक्ति
मडहला आयोग एिं िूसरी संस्थाओ ंको भी परेशान करता है। आयोग समन भेिता है तो
मालूम पड़ता है डक आरोपी ने अपना पता बिल डलया है। टेलीफोन भी बिल गया और ई-
मेल पर कुछ भेिो ंतो िह भी बैरंग लौट आती है। ऐसी क्तस्थडत में केिल डििेश मंत्रालय के
पास ही िे अडधकार होते हैं, डिनकी मिि से िुल्ें तक पहंुचा िा सकता है। िह िहां पर
भी होगा, उसकी िानकारी डििेश मंत्रालय के पास होती है।
काम का परडमट, िीिा की अिडध या िूसरी िानकाररयां, सब मंत्रालय में डमल िाएंगी।
अब नई व्यिस्था के तहत आयोग डििेश मंत्रालय के द्वारा ही आरोपी को समन डभििाएगा।
बाकायिा समन को मंत्रालय की िेबसाइट पर अपलोि करें गे। अगर इसके बाि भी आरोपी
सामने नही ंआया तो ंउसका लाइसेंस या िकि परडमट सस्पेंि करा डिया िाएगा। इन
क्तस्थडतयो ंमें एनआरआई िुले् को सामने आना ही पडे़गा।
शुक्रिार कह देशभर के राज्य मवहला आयहग इस पर करें गे मोंथन
महाराष्ट्र राज्य मडहला आयोग की चेयरमैन डििया रहाटकर, डिन्ोनें गत िषि मंुबई में
मडहलाओ ंकी समस्याओ ंको लेकर एक बड़ा समे्मलन कराया था। इसमें 27 िेशो ंने भाग
डलया था। अब ऐसा ही एक डििसीय सम्मलेन 27 िुलाई को केिी मागि क्तस्थत महाराष्ट्र
सिन में आयोडित होगा।
इसमें सभी राज्य के मडहला आयोग, राष्ट्र ीय मानिाडधकार आयोग के प्रडतडनडधयो ंके अलिा
उपराष्ट्र पडत िैंकया नायिू, डििेश मंत्री सुषमा स्वराि, महाराष्ट्र के मुख्यमंत्री िेिेंद्र

Ahead of the national conference on NRI marriages and trafficking of women and
children, Maharashtra women commissions urged External Affairs Minister
Sushma Swaraj to penalise NRI's who desert women after marrying them.
"In the last three years, 3,300 complaints related to NRI marriages, exploitation
and desertions have been received. We have requested the External Affairs
Ministry to put up summons against guilty people on its website and suspend their
passports so that we can initiate legal action against them," said Vijaya Rahatkar,
chief of Maharashtra Women's Commission and President of BJP's Mahila
Morcha.
The conference is being organised by Ministry of External Affairs (MEA) and
Maharashtra State Commission for Women. It will be attended by Sushma Swaraj,
Vice-President Venkaiah Naidu and Women and Child Development (WCD)
Minister Maneka Gandhi. Representatives from 20 state women commissions, top
ministry and government officials and members of civil society groups will
participate in the conference.
"We have also asked Swaraj to create single window mechanism where affected
women can go and file their complaints," Rahatkar said.
Speaking on providing a smoother grievance redressal mechanism for women
under duress, Rahatkar said the women commissions had urged MEA to create a
single point of contact within the ministry where aggrieved women can file
complaints.
"Today they have to run from pillar to post, from one government department to
other in search of justice. A single window mechanism will not only ensure speedy
justice to affected women but also ensure better coordination between MEA and
other state women commissions."

partners, the state women commissions have urged the Ministry of External Affairs to find a way to
penalise those NRIs who marry women in India and then desert them.
"Serving summons to such NRIs, who desert their wives after marriage, is very difficult as they
change their addresses and emails while abroad. We have urged External Affairs Minister Sushma
Swaraj to find a way to serve summons to such defaulters so that swift penal action could be taken
against them," said Maharashtra State Commission for Women Chairperson Vijaya Rahatkar.
Rahatkar further stated that the women commission has asked Swaraj to create a single window
mechanism where affected women can go and file their complaints.
"It may be the outcome of the lacuna in the legal system that complaints related to NRI marriage
desertions have been increasing year after year. As per the available records, in the last three years
over 3,300 cases have come to the notice," she said. "Given that these cases are growing, we have to
take proactive measures so that guilty get punished. We have requested the MEA to put up
summons against guilty people on its website and suspend their passports so that we can initiate
legal action against them," she said
To brainstorm over the issue with all the stakeholders, a national conference on "NRI Marriages, and
Trafficking of Women and Children – Issues and way forward", is also being organised by MEA and
Maharashtra State Commission for Women on Friday.
Representatives from 20 state women commissions, government officials, etc would take part in the

Sushma Swaraj to devise a mechanism to help women aggrieved by NRI marriages and
create a single contact point mechanism within the ministry where they can directly go with
their issues, Maharashtra Women Commission chief Vijaya Rahatkar said.
"In the last three years, over 3,300 complaints related to NRI marriage desertions have been
filed. As these cases are growing, we have to take proactive measures so that guilty are
punished," Rahatkar said.
She said the SWCs requested Swaraj to find a way to serve summonses to such defaulters so
that swift penal action could be taken against them.
"We have also asked Swaraj to create single window mechanism where affected women can
go and file their complaints," Rahatkar said in a statement. "Today they have to run from
pillar to post, from one government department to other in search of justice."
She also said cases of trafficking of women and children are also growing.
"Trafficking of Indians to other nations and of women to other nationalities, particularly
from Nepal, Bangladesh, Burma and erstwhile Russian Federation nations, are on the rise.

PUNE: The Maharashtra State Commission for Women is set to prepare a
framework in consultation with the National Commission of Women (NCW)
and external affairs ministry to redress NRI marriage abuse cases.
With Maharashtra reporting the maximum number of such cases in India
(see graphics), the state women’s commission has tied up with its
counterparts across the country to organize a workshop on Friday and
come out with some definite solutions to address abuses related to NRI
marriages.
“The meeting will involve all stakeholders to address the issue. We hope
that the involvement of the external affairs ministry will ensure that a
framework is in place to resolve NRI marriage abuse cases easily,” state
women’s commission chairperson Vijaya Rahatkar said.
During a recent meeting, the ministries of women and child development
and law and justice had recommended that all NRI marriages should be
registered within a week of the wedding and notified on the website of the
registrars of marriages.
“Parents often get their daughters married to NRI men without mandatory
checks,” a commission member said.

"We are also developing a separate website where summons and warrants against
NRI men who have abandoned their wives and have illegally married abroad will
be uploaded. Those responding to it will be declared a proclaimed offender and
his properties would be seized," she added.

and the property will also be confiscated.
"And if he doesn't return, his property could be sold to give financial aid to his
aggrieved wife. We will have to make some amendments in the Code of Criminal
Procedure. We are already in talks with Law and Home ministry and all efforts are
being make to ensure that a law is in place by the end of this year," she said.

have been deserted by their NRI husbands. "We are acting tough on such cases. For
a start, the passports of eight NRI men accused of abandoning their wives have
been canceled. The accused whose passports were revoked have

The Indian government is planning to strengthen the rules in a bid to tackle cases
of marriage disputes involving Non-Resident Indians. A new law, “Summons and
Warrants Against Indian People Living Abroad,” will be enacted during the next
session of parliament, External Affairs Minister Sushma Swaraj said on July 17,
ANI reported.
The government will also bring in other measures to take actions against NRI men
accused of abandoning their wives, Swaraj said. A website is under development
on which notices and warrants against them will be posted, and deemed as served.
If the accused NRI does not respond, he would be declared a proclaimed offender
and legal action will be initiated against him. The proposal to launch the website
has been cleared by the ministries of external affairs, law, home and women and
child development.
“The law will enable online serving of summons/warrants against NRIs who have
abandoned their wives and have illegally married abroad through a new MEA
website. We will upload summons and warrants on the website and those not
responding to it will be declared a proclaimed offender and his properties would be
seized,” Swaraj said at a conference held over the issue of NRI marriages and
trafficking of women and children, according to ANI.
For the summons on the website to be considered as “served” under Indian law, the
Code of Criminal Procedure would require some amendments, which the
government will try to get passed in the parliament at the earliest.
“We are trying if the amendments could be introduced in the cabinet and we would
try to get it passed in the next parliament session,” Swaraj was quoted as saying by
PTI.
The new law will enable the government to cancel the passport of the accused NRI
as well as confiscate his property in India.
“We will not only cancel the passport but also confiscate the property. And NRIs
who don’t return, their property could be sold to give financial aid to their
aggrieved wives. We will have to make some amendments in the Code of Criminal
Procedure,” Swaraj added.
In the last three years, the External Affairs Ministry has received 3,328
complaints from Indian women who say that they have been deserted by their NRI
husbands.

Until the new law comes into place, an inter-ministerial committee has been set up

Addressing a national conference in New Delhi on NRI marriages and trafficking of women and children, she said people were suffering and being exploited in the name of good opportunities in foreign countries by these agents. She said, there was a need to create awareness among people that they must opt for government registered agents only. The minister asked the states to identify such illegal agents who were bypassing all rules and regulations. Her ministry has saved a large number of women who were being sent abroad on the false promise of employment.
On the issue of NRI marriages, she said efforts are being made to provide justice to those females who have suffered in such marriages. She asked people to carefully verify the NRI grooms before the marriage.
She said in Punjab alone more than 15,000 females have been left by their NRI husbands which is a matter of concern.
The MEA, the minister said, was developing a portal where summons and warrants against absconding NRI husbands would be served, and if the accused did not respond he would be declared a proclaimed offender and his property attached,
For coming up with such a portal, the Code of Criminal Procedure (CrPc) needed to be amended to allow district magistrates to accept such summons and warrants put on the portal to be “deemed as served”.
Swaraj said the Law Ministry, Legislative Assembly, Home Ministry and the Women and Child Development Ministry have agreed on the proposal.
Swaraj said the move was aimed at preventing NRI marriages where husbands abandon their wives and abscond or mentally and physically abuse them after marriage in a foreign country.

External Affairs Minister Sushma Swaraj on Friday said that the government will enact a law, 'Summons and Warrants Against Indian People Living Abroad', during the next session of Parliament.

New Delhi: Union Women and Child Development Minister Maneka Gandhi on Friday said that amendment to Code of Criminal Procedure has been proposed for better tackling of issues related to NRI men abandoning wives in India and absconding.
“Amendment to CrPC has also been proposed, wherein in case an erring spouse does not appear after the summons has been uploaded, he will be declared a proclaimed offender,” she tweeted after she attended a seminar on “NRI marriages and trafficking of women and children” here.
“The problem of women being abandoned in NRI marriages is a grave issue. For the first time, government of India is providing coordinated support to women facing problems in their marriage to NRIs,” she wrote.
Gandhi also said that based on the recommendations by NCW, the Integrated Nodal Agency (INA) has been issuing Look-Out Circulars (LoCs) to absconding husbands in cases of NRI Marriages.
“Till now, 6 LoCs have been issued. MEA has also revoked passports of erring husbands,” she said.
