Terms & ConditionsIt is essential that all Clients read these Terms andConditions for booking models. All bookings are subjectto these terms and Conditions although Ordinary PeopleLimited (the Agent) reserve the right to negotiate withinthe structure of these Terms and Conditons.

1. Hours

The normal hours for a booking are between O9OO and18OO hours. A days work is 8 hours (including a 1 hourlunch break): a half day is 4 hours and the minimumbooking is 2 hours any time worked outside these hoursis charged at the overtime rate as follows:

i Between18OO hours and 24OO hours Monday to Friday one and a half times normal rate

ii Between O9OO and 18OO on a Saturday oneand half times normal rate.

iii Between 18OO and 24OO hours on a Saturday and between O9OO and 18OO on Sunday two times normalrate.

iv All other hours by negotiation.

2. Travel

Travel time will be charged at a rate to be agreed prior tobooking in respect of travel outside a five mile radiusfrom Charing Cross.

3. Fees

All parties concerned in booking a model must consult theAgent before quoting fees to the Client. Fees will beagreed at the time of booking. Fees will cover usage inthe UK only for a period of one year ending within eight-een months of the booking. Fees will cover the type ortypes of usage specifically agreed at the time of booking,but no other. If there is to be additional usage the Clientmust inform the Agent in advance and negotiate a furtherfee. If a further fee is not agreed in advance of the addi-tional usage the Agent is entitled to fix a fee for the addi-tional usage at a sum considered reasonable by the Agentwhich the Client will pay on receipt of an invoice. Feeswill be charged for each type of usage for periods of oneyear each.

Fittings/HairdressingFees for fitting and hairdressing will be a minimum of5O% of the hourly rate (with a minimum of £5O per hour)

InvoicingAll fees (including agency fees) will be invoiced by themodel agent. Fees for the agent�s services are chargedonly to the employer and are included in the invoice totalas 2O% on TV assignments and 37% on photographicshoots. VAT is charged in addition as appropriate.

4. Restrictions

An exclusion fee is to be negotiated when a Clientrequires a model to work in connection with a product onthe basis he/she is then precluded from doing work inconnection with competing products. It is the Clientsresponsibility to check product bookings with the Agentfor conflicts prior to booking the model. Unless such anexclusion fee is negotiated and paid then if a model adve-tises a product he/she is able to work for any competitor.

5. Meals

The Client is responsible for the payment and provision ofmodels meals on all bookings of over 4 hours + duration.

6. Weather Permitting Bookings

i First Cancellation at half fee (providing the model is rebooked) unless the model arrives at a booking through the Clients failure to cancel it in time then full fee is payable.

ii Second cancellation at full fee.

7. Cancellations

Providing a cancellation is notified to the Agent inwriting two working days before the booking thenonly half fee will be payable. If notice is received onworking day prior to the booking then full feeremains payable.

8. Provisional Bookings

Provisional bookings will be automatically cancelled ifthey are not confirmed within 24 hours of the proposed

booking or if a definite booking is offered then a provi-sional can not be confirmed.

9. Payment

Payment on all invoices must be made before any usage,and at latest within 3O days of invoice. VAT is payable onall fees. The client responsible for commissioning thework will be invoiced and will be solely responsible forpayment. Interest will be charged on all outstandingaccounts at the rate of 15% per annum after the expiryof 3O days from the date of the invoice.

1O. Exclusion of liability

Whilst every endeavour is made to provide a satisfactoryand efficient service to the client the Agent is not respon-sible for the conduct of any model and is not liable forany loss of profits or other damages including damage toproperty or persons suffered either directly or indirectlyas a result of any act or omission of any models intro-duced by the Agent nor is the Agent liable for any loss ofthe same nature alleged to have been caused by theAgent.

11. All dealings to be through the Agent

The Client must not enter in to a direct agreement withany model supplied by the Agent whilst the modelremains registered with the agent. Once negotiations inrelation to a booking have commenced between theClient and the Agent then the client must not enter in todirect discussions with any model in relation to the termsof the booking, the agreement of fees or the payment offees.

12. Acceptance

All bookings of a model made by the Client are made onthe basis that these Terms and Conditions are incorporat-ed in the contract between the Client and the Agent onbehalf of the model.
