Bambolim, Tiswadi taluka. (GCZMA/�/1/07/83) (Antonio Fernandes)
Decision: GCZMA members decided to reject the application made by Shri. Antonio Fernandes, to
erect bund wall to prevent sea erosion at the site. However, GCZMA agreed that the recommendation
made by WRD for temporary measures to be taken up the extent of 300mts. at the said site be
permitted to prevent erosion in monsoon and under strict supervision of the WRD.

Proposed �OC for repair/modification of existing jetty at Rumod and dredging of certain area
of River Mandovi in Bicholim taluka, by M/s Pandurang Tomblo.

Construction of residential buildings by M/s Hermitage Builders in Sy. �o. 16/4 and Sy. �o.
16/6 at Sernabattim village, Salcete Taluka.
The request of M/s Hermitage Builder vide their letter dated 24/04/2009, for change in site
plans/location and scope of the project from residential to a Health resort, was discussed. Lt. Gen.
R.S.K. Kapur (Retd.), appeared on behalf of the M/s. Hermitage Builders and explained their concept.
Decision: On perusal of the site inspection details, which indicate the structure to be coming up on
sanddunes, it was decided that the same should not be permitted neither should the request for change
in site plans/scope of the project be allowed. The request made by M/s. Hermitage Builders is
therefore rejected.

Urgent Anti Sea erosion and Protection measures for Candolim Beach………Request from
WRD
The matter was discussed with Mr. P.B. Badami, Executive Engg.-I, WRD, who gave a
detailed presentation on the matter and appraised the Members on efforts proposed to be taken up for
preventing further erosion on the beach by installing geotubes, which is a soft measure adopted in
consultation with CWPRS, Pune.

Proposal from the Department of tourism….(i) Installation of High Mast Light Unit at Miramar
Beach, (ii) Provision of toilets,parking lot and picnic spot at Bogmalo Beach and (iii) Erection of
Iron Gate near Bandodkar Statue at Calalngute.
The Proposals of the Department of Tourism forwarded to the GCZMA were discussed. It
was decided to approve the installation of High Mast Light Unit at Miramar beach, while the other
two proposals to be deferred and site inspection and detailed evaluation of the proposals are carried
out.
Case �o. 3
Illegalities carried out by Shipyards and barge repair workshops at Rassaim, Loutolim and
near Borim Bridge…. Complaints from Public.
The Complaints received form the public about the inaction of various authorities on the
illegal activities being carried out by the shipyards and barge repair facilities at site was deliberated. It
is seen that the Revenue authorities have not yet completed the inquiries and mapping/ site survey
pending before them and that the Village Panchayat has granted approvals without proper verification
of the permissions from other statutory Authorities.
It was decided that the matter be detailed and action required to be taken be put up during the
next meeting i.e. on 27th May 2009, in the meanwhile site inspections be conducted and reports
prepared.

Decision: Deferred, The members on perusal of the case papers and the structural details and site location,
desired further clarifications regarding applicability of CRZ Notification, 1991 for this area. Besides the
structure proposed for reconstruction will change the character of the present construction to multidwelling
units. This requires verification from MPDA or TCP Department. GCZMA has been granting approvals for
reconstruction of structures in the CRZ -II areas subject to existing plinth size and expansion upto 9 m in height.
These clarification to be put up in next GCZMA meeting scheduled on 29/01/2010

Decision: The matter was discussed at length. The GCZMA Members perused the latest site
inspection report carried out by officials of GCZMA. Members took note of the fact, that the
project proponent has undertaken hill cutting in the NDZ portion, apparently without the
mandatory approvals from TCP. GCZMA Members desired to know the view of the CoP
Department in this matter, so also the likely fallout of the activity on the nearby areas.
The GCZMA members took note of the fact that such an activity in the said area is
permissible activity and desired that before permitted any such activity due care should be
taken to ensure that the entire project and future projects; if any; in that areas do not have any
adverse impact on the riverrine and coastal ecosystem.
It was decided to re-inspect the site, with two members of the authority; Dr. A.G.
Untawale & Engineer Pascoal Noronha, alongwith Director (Industries) (Member, GCZMA),
CoP and TCP and the matter placed for final decision in the next GCZMA meeting.

I. Personal hearing before GCZMA on 31/05/2010.
M/s Models Real Estate Developers and Mr. Peter Vaz v/s GCZMA in W.P. �o. 215 of
2010.
Details of Hearing:
Adv. Mahesh Sonak appeared for the petitioner and Shri. Peter Vaz, Petitioner was
present.
Adv. Mahesh Sonak presented the status of the site, and presented his submissions
before the Authority. He argued that the site concerned has always been in municipal limits
and never has its jurisdiction changed unlike the area at Vaiguinium which is the subject Page Page Page Page 6666 of of of of 8888

matter of W.P. No. 519 of 2007. He sought to clarify the differences in both these
areas i.e. the site at Dona Paula and Vaiguinim area. Vaiguinim area was earlier in V.P.
jurisdiction of Taleigao and later in Panaji Municipality and then shifted back to V.P.
Taleigao. However, Dona Paula has remained as a Municipal Area all throughout.
He put forth his argument that the High Court order dated 26/10/2007, in W.P. No.
519 of 2007, is not applicable to his plot. He argued that the High Court has only stayed the
reclassification of CRZ-III to CRZ-II in respect of those areas which were reverted back to
V.P. Status and the order does not comment on Municipal area status.
In the arguments put forth, MS (GCZMA) stated as per CZMP,1996; the area from
Cabo Raj Niwas to Dona-Paula jetty is classified as CRZ- III. In this area lies the plot of the
petitioner on 03/12/2001, Ministry of Environment & Forest (MoEF) has reclassified the area
from Cabo Raj Niwas upto Donapaula Cove as CRZ-II. That would mean that this area
which is CRZ –III was reclassified as CRZ-II. Further, the order of Hon’ble High Court in
W.P. No. 519 of 2007 clearly stays the reclassification done by MoEF the letter dated
03/12/2001 except for the area from Ribandar to Routunda of Gasper Dias in Panaji
Municipal limits.
Adv. Sonak put further the argument that as per CZMP, 1996 item no. 2 (B) (B) (xiii)
(j) “ all areas outside Municipal limits are classified as CRZ-III “. He stated by this fact, his
plot being in municipal limit is classified as CRZ-II and not CRZ-III. It was informed to him,
that the CZMP,1996 clearly specifies the area from Cabo Raj Niwas to Dona Paula jetty as
CRZ-III, irrespective of the fact that the area is in municipality limits or not.
Adv. Sonak; further argued that as per the CZMP, 1996 item no.2 (B) (B) (xiii) (i)
“the plateau top to the extent is classified as CRZ-II which falls in Municipal limits”. He
stated that his plot falls in Municipal limits and is also on a plateau. The GCZMA member
desired to know the height of the plot which is claimed to be the plateau from sea level. Shri
Peter Vaz, petitioner explained that it is approximately 12 mts to 15 mts from sea level.
Hearing was concluded.
Decision: After hearing the petitioner, Advocate for petitioner, after going through the
records of the case and the orders of the Hon’ble High Court; the GCZMA member;
concluded that pursuant to the order of the Hon’ble High Court in W.P. No. 519of 2007; this
area is classified as CRZ-III. There is no dispute the same of being in municipal limits and
GCZMA yet again reiterates its stand taken before the Hon’ble High Court in W.P. No.
519/2007 that the development character of the area cannot change with change in local
authority status. Thus the classification of the area should have been retained as CRZ-II,
being developed and falling in municipal limits. However, with the decision of the Hon’ble
High Court in W.P. No. 519 of 2007, the said area is classified as CRZ-III. In terms of order
in W.P. No. 422/98 and W.P. No. 99/99 dated 13/10/2006; only repairs and renovation of
existing structures to the existing plinth is permissible. Moreover it is in NDZ area and only
repairs and renovations is permissible to the existing plinth. Page Page Page Page 7777 of of of of 8888

As far the contention, that the plot is on a plateau is concerned; there is no merit in the
submissions made. The plot is on a cliffy portion with an undulating terrain forming part of
the ledge or outcrop extending into the Zuari river. This is confirmed from detail examination
of Survey of India Toposheet, 1991. The plateau to which is referred in the CZMP, 1996 in
the plateau or highland / mountain (hill) table top land, which is comprising the location of
NIO, La Marvel Colony, portion of Raj Bhavan area etc. Thus it is inferred that the plot is not
on a plateau as made out in the submission of the party.
GCZMA therefore decided that the application of M/s Model Real Estate Developers,
for a development in property bearing Chalta No. 5-I & 5-J in P.T. Sheet No. 165 at Dona
Paula made vide letter dated 13/04/2009; cannot be accepted for granting approval / clearance
from CRZ point of view.
Order be issued accordingly.
