Of all the ballads of the War of 1812, the one still strongest in tradition is about James Bird,who served with Perry. Blind Sam Taylor of Westfield, Chautauqua County, who recently died atthe County Farm at an advanced age, used to sing it in my boyhood when Sam was a fishpeddler.He said that when he was a young man, seventy years ago, he heard the ballad from a cousin ofBird’s, a lady who lived at Kingston, Pennsylvania. According to Sam, after Perry’s victory Birdwas given a furlough to heal his wound and visit his sweetheart. Unfortunately he overstayedhis leave because of bad roads in Western New York, and notices were spread offering a rewardfor his capture as a deserter. In Westfield he was recognized by a man who, greedy for the reward,offered to give him lodging for the night and to take him in a boat from Barcelona Harbor, a milefrom Westfield, to Presque Isle (Erie), where the fleet had headquarters. When the alleged de-serter reached Erie, his host of the night before received thirty dollars, and Bird was ordered toimmediate execution. Sam said that the officer who ordered the firing squad was in love withBird’s girl. Commodore Perry killed two horses attempting to reach his ships in time to stop theexecution, but arrived just as the fatal shot was fired. Bird’s enemy at Erie was “so ashamed thathe leaned on his sword and died”. Nor did the betrayer at Westfield escape: when Bird’s motherheard of her son’s fate, she put a curse upon the family of the man who had sold her boy for thirtypieces of silver—a curse which has persisted to my own generation.

Here is Blind Sam’s version of the ballad, as sung by Bird’s cousin:

The Ballad of James BirdIn recognition of the two hundred years since the War of 1812, we offer the following excerpt

from Harold W. Thompson’s Body, Boots & Britches1

Sons of freedom, listen to me,And you daughters too give ear;

You a sad and mournful storyAs was ever told shall hear.

How, you know, our troops surrenderedAnd defenceless left the West;

Soon and quick the troops assembledThe invader to resist

Amongst the troops that marched to ErieWere the Kingston volunteers;

Captain Thomas them commandedTo protect our west frontiers.

There was one amongst our numberTall and graceful in his mien;

Firm his steps, his looks were manly,Scarce a nobler youth was seen.

One sweet kiss he snatched from Mary,Craved his mother’s prayer once more,

Pressed his father’s hand and left themFor Lake Erie’s distant shore.

Soon they came where noble PerryHad assembled all his fleet;

There the gallant Bird enlisted,Hoping soon his foe to meet.

Where is Bird? The battle rages.Is he in the strife or no?

Hark, the cannon’s roar tremendous;There he meets the Bastille [hostile] foe.

Ah, behold him, seeing Perry!In that self-same ship they fight;

See, his messmates fall around him—Nothing can his soul affright.

Lo, behold, a ball has struck him;See the crimson current flow.

“Leave the deck,” exclaimed brave Perry.“No,” said Bird, “I will not go.

Hi Wayne, Could you include a correction in the nextChautauqua Genealogist for me? I wrote the article *Dear Janand Thomas: Letters from family in Westerville, Ohio, dated 1886- 1894*. [Vol. 34, No. 4, November 2011 pg 77-79] The date January28, 1886 is after my name but it actually is the date of the firstletter in the article. It looks like I wrote the first two introductoryparagraphs in 1886. The letters are in two newsletters and myname and 1886 are the same. I wrote the introductory paragraphsin 2011 and the first letter is 1886.

Thank you, Kathleen Newcomer

The Chautauqua Genealogist VOL. 35, NO. 2 SPRING 2012

“Here on deck I took my station;Never will Bird his colors fly.

I’ll stand by thee, noble Captain,Till we conquer or we die.”

There he fought, though faint and bleeding,Till the Stars and Stripes arose,

Victory having crowned our efforts,All triumphant o’er our foes.

Then did Bird receive a pension?Was he to his friends restored?

No, nor ever to his bosomClasped that maid his heart adored.

But there came most dismal tidingsFrom Lake Erie’s distant shore;

Better far had Bird have perished‘Midst the cannons’ dreadful roar.

“Read this letter, dearest parents;This will bring sad news to you;

Do not mourn your first beloved,Though this brings my last adieu.

“Read this letter, brother, sister—It’s the last you’ll hear from me;

I must suffer for desertingFrom the brig Niagaree.”

[Lo, he fought so brave at Erie,Freely bled and nobly dared.

Let his courage plead for mercy,Let his precious life be spared!]

Dark and cloudy was the morningBird was ordered out to die;

Not a heart, not one felt sorry,None for Bird to heave a sigh.

See him march and hear his fetters;Hark! they clank upon the air.

Firm his steps, his looks were manly,And his heart ne’er harbored fear.

See him kneel upon his coffin.Sure, his death will do no good.

See him—hark! O God, they’ve shot him!Now his bosom streams with blood.

Farewell, Bird, farewell forever;Home and friends you’ll see no more.

Now his mangled corpse lies buriedOn Lake Erie’s distant shore.

That Bird was not quite so ill-used as the folk believed seemsto be proved by the researches of Mr. Charles B. Galbreath intoNaval records. The lad of twenty had escaped military disciplinefor misconduct by transferring to the Marines; as a Marine hedisplayed the conspicuous bravery which the ballad describes.But when his health permitted a return to duty he deserted froma guard posted to watch government stores. When he had beencaptured and court-martialed, the President regretfully refusedto extend clemency, and in October, 1814, he was one of threedeserters executed on board the Niagara. The ballad, composedby a Pennsylvania journalist named Charles Miner, follows ratherclosely Bird’s last letter to his parents, in which he makes noexcuses but warns others to avoid his fate. It was a gallant, un-disciplined, and penitent young man who was made to serve asexample to troops which had the frontier’s dislike for regimenta-tion.

There is a touching sequel to Bird’s own story. In 1825 aweary pioneer named Culver, travelling slowly across New YorkState, stopped with his family, horse, and oxen at an inn some-where between Buffalo and Westfield, near Lake Erie. That nightMrs. Culver was hushing her babe with the melancholy ballad ofJames Bird, when her host and his wife entered the room weep-ing. They were the parents of the unfortunate youth—and theywere hearing the song for the first time. Over and over again theCulvers sang the ballad. Next morning, the Birds refused to ac-cept payment for their hospitality.

Here’s more information gleaned from the internet:James Bird was born 20 Nov 1785 in Eatonville, m, Wyoming

County, Pennsylvania. Died 10 Nov 1814, Erie, Erie County, Penn-sylvania. He was the eldest son of John Bird and RebeccaMontanye. Originally buried in Erie, PA, and moved to Forty FortCemetery in 1935.

James Bird’s siblings were Thomas[1788], Derrick[1789], JohnJr.[1793], Sarah[1794], Margaret[1795, Elizabeth[1798], Mary[1800],Jane[1802], Abram[1804] and Rebecca[1806].

Veteran of the war of 1812, Battle of Erie. [James Bird] Was

shot as a deserter after he left his command to join the Army atNew Orleans. The charges appear to have been in error .*The follow is from one of the unofficial Marine websites:

[www.timetoast.com/timelines/1814-1815-draft]The Court Martial & Execution of James Bird, USMCThe Court Martial of James Bird, USMC, for desertion takes

place aboard the Brig Lawrence, off Buffalio, NY on 14 Septem-ber. Bird and his fellow marine, James Rankin, plead guilty andthrow themselves on the mercy of the court. The court con-demns the two to death.

On 22 October, President Madision upholds the death sen-tence issued to Bird and Rankin, despite a recommendation forclemency, on the grounds that “desertion from off post in time ofwar could not be overlooked, therefore, an example must bemade.”

On 11 November, Bird and Rankin are executed by firingsquad aboard the Brig Niagara.

“Although it occurs after the troubles of the winter of 1813-1814, perhaps the most notable example of desertion at Erie Sta-tion was the case of Marines James Bird and James Rankin andSeaman Henry Davidson. As noted earlier, the twenty-seven-year-old Bird marched to Erie with Captain Samuel Thomas’scompany of Pennsylvania artillery. While at Erie and still a militia-man, Bird was arrested and charged with theft, mutiny, and re-sisting arrest. Marine Lieutenant Brooks, desperate for recruits,persuaded Bird to join the corps, promising to have the chargesdropped. Rankin enlisted at Hagerstown, Maryland, in April 1813.Little is known about Davidson’s background except that he hada history of disciplinary problems in the navy. All three served inbattle of Lake Erie, during which Bird received a wound. Hisservice in the battle earned Bird promotion to corporal.”

“On 4 June 1814, Bird was in charge of a detail, which in-cluded Rankin and Davidson, assigned to guard a warehouse atthe Erie Naval Station. All three deserted; this was the fifth in-stance of desertion for Davidson. Captured six days later nearButler, Pennsylvania, the crewmen were returned to the fleet,

court-martialed, and sentenced to death. Death was an oft-pre-scribed sentence for desertion during the period, but all deathpenalties were reviewed by the President, who commuted mostto a lesser punishment. Nevertheless, desertion was an increas-ing problem in the military, and authorities felt an example mustbe set. On 11 November 1814 a firing squad executed James Birdand James Rankin on board the Niagara, and Davidson washanged from a yardarm. All three were buried beneath a sandbarat the mouth of Mill Creek in Presque Isle Bay.”

“Efforts were made to turn Bird’s case into a cause celebre.Poems touting his patriotism and public spirit began appearingand several writers recounted ‘the thoroughly authentic story ofthe unyielding patriotism, the magnificent courage, the noble

continued from pg 23 self-denial, the whole hearted devotion of James Bird to his coun-try and his country’s flag.’ Assertions were also made that Bird’sdesertion was patrioritcally motivated, that he was actually at-tempting to make his way south to join Andrew Jackson’s armyin repelling the redcoats below New Orleans. Since the Britishplan to capture New Orleans was unknown until long after thetrio’s desertion, the legend lacks credibility.” [Signal Victory:The Lake Erie Campaign 1812-13, by David Curtis Skaggs &Gerard T. Altoff, Naval Institute Press, 1997, pp. 171-172]

This is a three part list. The first list is our current membersby name sorted alphabetically. Showing mailing address, phonenumber, email address and member number. I actually have troublewith emails. They bounce. I then put an <error> code next to theiraddress which tells me that I have removed them from my emailnotification list. Sorry about the change in font size. Some thingsjust don’t fit and mess up the look of the list.

The next list is member number and their name. This allowsthe researcher to use the surname list more easily.

The last list is our surname list. Simply look up the surnamethat you are interested in and the numbers following are membersthat are also researching that name. You might try contacting thatother member and see if they have information that could helpyou with your research.

If you see any errors in your contact information simply letme know. You should also look at your mailing label. Your memberstatus is on the top line of the label.

WILLIAM J. DOTY

William Joseph Doty,County Treasurer since1918 and prominent inCounty affairs for manyyears, died at his home inMayville on Wednesdaymorning, February 14, 1940.He would have been 71years of age the followingSaturday. He was born inthe Town of Sheridan, Feb-ruary 17, 1869, the son ofCapt. Joseph C. Doty andMartha Chapman Doty. Mr.Doty was a pioneer GreatLakes captain. He was alsoSupervisor of Sheridan.

Mr. Doty received hiseducation in the districtschools of Sheridan. At theage of seventeen, he leftschool and secured employ-

ment on ships on the Great Lakes. He spent four years on thelakes and then returned to Sheridan, purchased a farm and en-tered the grape industry.

He represented the Town of Sheridan on the Board of Super-visors for twelve years before being elected County Treasurer.He remained in Sheridan until the spring of 1919, when he movedto Mayville.

He was a staunch Republican and served on the CountyRepublican Committee for several years.

Mr. Doty’s varied interests in fraternal, civic, political, andcounty and local government made him a host of friends andacquaintances. During his life time he was associated with theMasonic fraternity, the Eastern Star, the Grange, County YMCA,County Historical Society, the Odd Fellows, the ChautauquaStamp and Coin Club, the Chautauqua County Farm and HomeBureau and 4-H Clubs, the Chautauqua County Fair, and others.In nearly all of these organizations he held positions of trust andresponsibility. He was Past Master of the Chautauqua CountyPomona Grange, and also served as District Deputy of the Sec-ond Chautauqua District of the I.O.O.F. At the time of his death,he was president of the Chautauqua Fair Association. He servedas president of the village of Mayville for one term.

At the time of his death, Mr. Doty was working on the His-torical Annals of Southwestern New York, of which he was edi-tor. His fund of knowledge in historical matters made his servicesinvaluable to the proposed publication.

For many years it was his custom to take vacations in inter-esting parts of the country. He kept a photographic record ofthese trips and presented the pictures as colored stereopticonviews to scores of organizations, who had only to request hisservices. In this manner he doubled and redoubled the long listof those who knew him as a kind and generous friend.

In 1893, Mr. Doty was married to Martha Graves, daughter of

Orville and Florence Graves of Panama. Mrs. Doty died whilethey resided in Mayville. Later Mr. Doty married Miss EstelleBrightman of Mayville, who survives him; one daughter, Mrs.Lester Matthews of Oneida and two grandchildren also survive.

Funeral services were held at the Methodist Church. Burialwas in the Mayville Cemetery, with Masonic service.

The following quotation from an editorial in the JamestownPost, of February 15, 1940, very fully expresses Mr. Doty’s char-acter and the qualities of mind and heart which he possessed:

“If there was any person in Chautauqua County who did notknow Will Doty personally, he missed an acquaintanceship ofunusual value - acquaintanceship of a man who never met any-one who did not become his friend, and whose friend he did notbecome. No other comment could portray more faithfully thecharacter of this friendly man who has now gone from us.”

I Get No Respect:Kosciusko Walworth Forbes was born on 13 December 1844,

in time to be named in honor of the famous Polish-Americanhero. However, the census-takers do not seem to have knownabout that. In 1850 when he was but six he was recorded asCosesco. In 1860 he had to live with Rsciuska.1870 was no improvement: Roseusko. Sadly the 1880 Censusreverted to a version of his earliest entry, Cosceusks. Happily the1890 census burned.

The poor man died on 29 May 1899 so he escaped the tor-ment of a 1900 entry.

At least the Censor got it right, but it took an obituary to getthere.submitted by Doug Shepard

While going through boxes of family papers that just couldn’tbe thrown away, but their time had come to shred all those canceledchecks. What’s this check made out to my uncle? Here’s one fora load of gravel for $5. Mortgage payments, insurance payments,doctor and hospital payments. I know, I shred the checks andsave the ledger. What an unusual source for family history.

Museum, but you enter by way of the library.

President’s MessageHi everyone,It is amazing how much the internet effects our lives. I have

been offline for months now and missed many things. In mymind I have connected genealogical work to online. And sinceCCGS is all about this work, then when not online I only connectto other things going on in my hectic life. I’m sorry for anythingor anybody that I inconvenienced. The good thing is that we arenow in the season where we can do work in cemeteries or travelto towns that we can gather information on our journeys to ourroots. Last meeting Jack [Ericson] and Norman [Carlson] didsome good work on things our society can do. Lets support

them by getting involved with their ideas. Speaking of journeys,have you seen all the TV shows that show others on their jour-neys? I wish I could afford to travel to states and countrieswhere my ancestry begins. Another thing I missed was a relativeof my 2nd great-grandfather emailed. I hope contacting hermonths later won’t discourage her from wanting to collaboratwith her. I hope each of you won’t let your life get so hectic thatyou miss out on the rewards of your journeys and may you andyour families lives be blessed. - George Davis
