Situation…..

• There is a settlement occurred between the Management and Recognized Trade Union.

• After all the proceedings are carried out, one Non Signatory Union defies or resists openly to the settlement.

• From an HR manager point of view what are the steps to be taken further………

Probable solutions

1. These union do not have any right to resist against the settlement

2. They should have participated in collective bargaining.

3. Even after they are resisting, they have to register themselves as trade union.

Personal Aspects

The personality of HR manager and the way he tackles the situation ….

• Be calm :- Calmly accept the situation

• Show Respect :- Don’t dishonor the person. Attack the situation, not the person

• Be Magnanimous :- Conflict = Little real problem + Much pride at stake

• Discuss :- Put yourself in other’s Shoe and debate

• Be Rational :- Don’t perceive, find the reason

• Acknowledge Emotions :- Think about emotions influencing the disagreement

• Displacement :- Don’t let anger displace attention to other factors

• Think Creatively :- Suggest solutions which are rejected earlier by others

• Change the Wording :- The words of may be the reasons , so modify

• Compromise :- As majority is agree, compromise for the minors

• Build trust :- Takes time but once established, constitutes to goodwill

Legal Aspects

• Mediation :- Mutual third party consults with those defying settlement and tries to resolve

• Conciliation :- Discussion in front of ALC

• Adjudication :- Resolved in tribunal courts

• Arbitration :- Third person s chosen as arbitrator and his verdict is considered final

NEXT…..

Most problems change over time. They change• As circumstances change• Attitude of people change• Heat dies down• Other matters become more prominent
