In the context of the governance of nuclear activities,

especially in the field of the safety and the radioactive waste

management, the self-structuring of civil society is a

necessary condition of the citizens’ action.

The experience of French “Local Commissions of

Information” (CLIs) and their national federation the

(ANCCLI) represent an interesting and original

example of local actors empowerment.

The first CLI was created in Fessenheim in 1977

In 1981, the act of the Prime Minister known as “Circulaire Mauroy” opened the way to the official creation of CLIs in the vicinity of nuclear

installations by Regional Councils

The 2006 Law on transparency and security in the nuclear field included provisions on the organisation, role and funding of the CLIs and

reinforced the legal basis of their missions

The TSN law confirm the existence of a national federation - ANCCLI

2012 : 38 CLIs exist in France – 36 of them are members of the ANCCLI

Local Commissions of Information….(CLI)

Ø  Represent a diversity of contexts and experiences that sheds light on the issue of the contribution of local actors to safety and protection of people and the environment around nuclear sites

Ø  Facilitate dialogue of local actors with public authorities and operators

Ø  They address a variety of issues linked to the safety of the nuclear site and its impacts

Ø  Pluralistic dialogue forums gathering various types of local actors (elected representatives, NGOs, local experts, trade unions and other local organisations)

ANCCLI Nationale Association of Local Information Commissions ?

In order to fulfil their missions, the CLIs may need to exchange information or to be represented at the national level, so in 2000 the ANCCLI is created to :

Ø  Favour exchanges of experience and sharing of information between CLIs

Ø  Define a representation of all the CLIs

Ø  Establish relations with national (ministries, ASN, HCTISN, IRSN…) and international organisations

Ø  Offer logistic support to the CLIs

Ø  Organise various pedagogic initiatives for the CLIs (visit of sites, formations ...)

C'est donc à luide trouver des solutions, ou dedonner les moyens suffisants àses salariés pour qu’ils puissentêtre hébergés dans des condi-tions conformes au droit fran-çais.

Compte-tenu des dimen-sions du chantier du projet der e c h e r c h e , e n c o u r s d econstruction à Cadarache, laproblématique est particulière-ment aiguë pour Iter. Au pointd'inquiéter les membres de laC o m m i s s i o n l o c a l ed’information Iter qui organi-sent, vendredi à Vinon (à 17 h àla salle des fêtes), une réunionpublique en forme de questionadressée aux pouvoirs publicset aux collectivités territoriales."Logement, hébergement, santé,scolarité, déplacements et trans-ports... où en est-on de l’accueildes travailleurs du chantierIter?" Selon les projections réali-sées par l’agence européenneFusion for Energy (F4E) quidoit construire les 39 bâtimentsdu site, le pic de constructionconcentrera plus de 3 000 sala-riés simultanément, de 2014 à2017. Parmi eux, 1500 à 2000 se-ront en recherche d’une solu-tion d’hébergement à proximi-té du site du chantier, pour desdurées très variables.

L'Agence Iter France (AIF) a

donc d'ores et déjà effectué desdémarches afin d'organiser etfaciliter l’accès aux logementsdes entreprises (françaises etétrangères) et répondre à leursbesoins. L’AIF a mis en place enplace, avec l’accord et le sou-tien des maîtres d’ouvrage du si-

te (Iter Organization et FusionFor Energy), un dispositif divisée n d e u x p h a s e s . I l s ' a g i td'abord d'accompagner la re-cherche de logements des sala-riés par des agences de reloca-tion (d'ores et déjà opération-nelles). Une étude, réalisée en-

tre juillet 2011 et juin 2012, aégalement permis de réaliserun inventaire des solutionsd’hébergements dans un péri-mètre de 30 minutes autour duchantier.

Pour la réalisation de l’étude,une démarche de concertation

a été lancée. L’ensemble des col-lectivités concernées (commu-nes, intercommunalités etConseils généraux) ont été ren-c o n t r é s a f i n d e f a i r el’inventaire des possibilitésd’hébergement. Les services del’Etat (Dreal et DDT) ont égale-m e n t é t é a s s o c i é s a f i nd’analyser la faisabilité adminis-trative de chaque projet, de défi-nir leur calendrier de réalisa-tion et, dès que possible, d’enévaluer le coût. Parallèlement,les entreprises et les consor-tiums présélectionnés dans lecadre des appels d’offre lancéspar Fusion For Energy, ont étécontactés et des questionnairespuis des rencontres ont permisde définir les premiers besoinsen hébergements.

Offre meublée à vocation tou-ristique ou saisonnière, projetsen cours de construction, possi-bilités de réhabilitation... L'étu-de estime la capacité d’accueilactuelle à environ 500 places,alors que le nombre de person-nes attendues va augmenter en-tre 800 et 1200 personnes dèsl'année prochaine. "Dans tousles cas de figure, le parc de loge-ment existant semble très insuffi-sant pour répondre à la totalitédes besoins des entreprises",conclut d'ailleurs l'étude. Etc'est précisément pour faire fa-ce à l’insuffisance du nombrede logements, que l’Agence IterFrance s’est engagée dans unedémarche de recensement desprojets (lire ci-dessous). Maiségalement que la Commissionlocale tient à organiser cetteréunion de prévention. Avec, infine, le même objectif: garantirun accueil satisfaisant des en-treprises et de leurs salariés.

The mission of information of the CLIs seems clear but is nonetheless complex or ambivalent : What is the source of the information ? What is the content of this or that piece of information? What is its use? To whom should it be diffuse?

Ø  The operator and the Nuclear Safety Authority are the first source of information of the CLIs (complemented by other sources of information)

Ø  The CLIs pay attention to a wide variety of issues: Ø  respect of the norms (composition of the discharges, temperature of the

discharged water ...) Ø  periodic inspections, environmental monitoring, Ø  discharge and take authorisations, Ø  risk factors, Ø  technical innovation (e.g. the EPR), changes in the workforce, the

equipment or the methods

À l’ordre du jour lundi soirde la réunion publiquede la Commission locale

d’information, à Rians : le rap-port TSN 2011 du CEA et lesavis émis par l’Autorité de sûre-té nucléaire. TSN signifie Trans-parence et Sécurité Nucléaire.Avec une obligation légale, da-tant de 2006, de produire an-n u e l l e m e n t u n r a p p o r td’activités : toute personneayant "le droit d’être informéesur les risques liés aux activitésnucléaires". Et, à Rians, c’estMaurice Mazière, le directeurdu CEA Cadarache, qui s’estprêté à l’exercice de présenta-tion du rapport. Avant de répon-dre aux questions du public.

Parmi les faits marquants del’année 2011, on retrouve les ac-tivités liées à plusieurs Installa-tions nucléaires de base (INB)du CEA Cadarache.

À commencer par la poursui-te du démantèlement des instal-lations d’Areva au sein del’Atelier de technologie du plu-tonium ; l’ATPu qui avait dé-frayé la chronique en 2009 enraison du surplus de poussièresde plutonium retrouvées dansles boîtes à gants (lire ci-des-sous). En 2011, 253 équipe-ments de l’ATPu ont été déman-telés, sur les 462 prévus au to-tal.

"Nous avons désormais toutesles autorisations nécessairespour tout démanteler", a préci-sé Maurice Mazière. On se sou-v i e n t e n e f f e t q u ’ a p r è sl’incident de 2009, l’ASN avaitrenforcé la procédure préalableà toutes opérations.

À noter la réalisation d’unepremière série d’essais au seindu laboratoire Verdon. Cetteinstallation permet en effet desimuler des accidents graves(de type Fukushima) avec, en2011, des travaux sur la perte de

refroidissement à partir d’uncrayon de combustible portéjusqu’à 2500 degrés. L’objectifétant de savoir comment lecombustible se détériore.

"Il a fallu aussi boucler rapide-ment les premières évaluationscomplémentaires de sûreté suiteà l’accident de Fukushima, aégalement rappelé Maurice Ma-zière. Et nous avons finalisé,avec la CLI, l’étude d’impact ducentre. Une étude qui intègretous les impacts liés à l’activitédu centre : radiologiques maiségalement environnementaux,sociaux et économiques. Sans

oublier la préparation del’exercice national de simula-tion sismique réalisé début2012". Maurice Mazière ad’ailleurs été amené à expliciterun point précis du dossierd’évaluation complémentairede sûreté post Fukushima.

Mieux anticiperAinsi, à la question de la vul-

nérabilité du poste de secoursdu CEA, mise en évidence parl’exercice, le directeur a livrédes éléments liés au projet deconstruction d’un nouveau pos-te de commandement. "Il pour-

rait s’agir d’une base logistiquede secours où seraient regroupésles moyens nécessaires à des se-cours post-séisme".

Parmi les observations de laCLI sur le rapport TSN, les mem-bres de la commission ont sou-haité reprendre certaines re-marques de l’ASN, estimantque "le CEA doit faire preuved’une plus grande anticipationet de davantage de rigueur dansla gestion des déchets et ef-fluents liquides radioactifs".Une anticipation qui tiendraitsans doute plus au renforce-ment des liens entre le CEA et

l’Agence nationale pour la ges-tion des déchets radioactifs (An-dra), chargée de la réception etdu stockage.

"Nous n’avons bien évidem-ment pas vocation à stocker desdéchets à Cadarache. Mais ilfaut savoir que nombre de nosdéchets sont aujourd’hui blo-qués dans les installations afinde répondre de manière très pré-cise aux exigences de l’Andra. Etnous menons des discussionstrès serrées afin de pouvoir leurenvoyer nos colis", a donc dé-taillé Maurice Mazière.

Competence building and access to expertise are conditions that are essential for effective participation of society actors in the instruction of files upstream of the decisions

ANCLI : federating means and competences to inform and investigate

The CLIs are primarily local organisations. Their missions of information and monitoring concern a particular facility and directed towards local populations. However, in order to fulfil their missions, the CLIs may need to exchange information or to be represented at the national level

Ø  2000 : The National Association of the CLIs is create and be made by the Presidents of the CLIs Ø  2005 : ANCCLI structures its memberships into 4 colleges corresponding of the pluralistic categories of CLI members Ø  2006 : in compliance with the TSN law – ANCLI become ANCCLI (inclusion of the Committee of information around military nuclear activities)

White papers about the role of the CLIs and ANCCLI in the governance system

In 2005, while the Law on nuclear transparency and safety was in the process of being finalised, the CLIs made the lawmaker aware of their 25-years experience and of their expectations under the form of a White Paper on local governance of nuclear sites so that is could be taken into account into the new law. The White Papers outline shared directions for the CLIs and put forward their experience and their ambitions for the future to their institutional interlocutors.

In 2006, ANCLI issued a second White Paper on radioactive materials and waste and local communities

Both White Papers were drafted by working groups composed of members from different CLIs.

The Scientific Committee of ANCCLI

The Scientific Committee structure the knowledge and competences of the CLIs :

The Scientific Committee can be seized by ANCCLI or by the CLIs It gathers diversified competences concerning nuclear issues, from hydrogeology to physics, as well as social sciences or epidemiology

Ø  Advises and assists the CLIs and ANCCLI in their expertises and scientific investigations

Ø  Favours the development of reflections and exchanges within the CLIs and promotes conferences and debates

Ø  Plays an advisory role for the drafting of the publications of the CLIs and ANCCLI

Permanent working groups

Working groups to takes up sensitive and topical issues which any CLI is likely to be confronted with : radioactive waste, new reactors, post-accident issues, decommissioning…

The objective of these working groups is to answer complex citizen questionings which necessitate integrating scientific, technical, social, or even ethical dimensions of the issues considered

For this, the permanent working groups acquire by themselves the necessary competences, appropriate knowledges, initiate debates and more generally favour the development of questionings about the issue they investigate

To date, three permanent working groups were created on “radioactive waste and materials”, “Safety”, and “territories and post-accident issues”.

CLI and ANCCLI a recognized participatory governance model in Europe

Since 2009, the ANCCLI initiate a European process of consultation and cooperation around the application of the Aarhus Convention (CAN) in the field of the nuclear activity The experience of European Stress Tests on Nuclear Safety has demonstrated the relevance of the contribution of civil society to continuous improvement and strengthening of the safety nuclear installations A statement echoed by many European NGOs involved in daily monitoring of european nuclear activities which emphasize the specificity of participatory governance model provided by the CLI and ANCCLI in France

In this perspective, ANCCLI initiate an opening consultation for structuring an European civil society organization to

enhance the transparency of nuclear activities Nuclear Transparency Watch - NTW
