A. City and County ACO Reports - City and County Animal Control 41

County ACO gave their report including picking up a total of 105 animals, 43
88 to the ASCMV; 7 owner released dogs, 27 stray dogs, 37 stray cats, one 44
care and welfare hold, 12 injured animals, and three rabies quarantines at 45
ASCMV, and nine quarantines at the County court hold facility and held over 46

from the previous month. Nine snakes and eight dead animals were also 1
picked up. March 11 - 31 stray animal calls from Central Dispatch 163 calls, 2
and responded to 64. April of 195 calls, responded 49. May 1 - 7 of 40 3
calls, responded to 10. Total pandemic 123 of 398 responded to for 31%. 4
Bite calls, 12 exposures ot humans, two exposures by other animals. Total 5
of seven quarantines at ASCMV, three home quarantines, two animals gone 6
on arrival for human exposure, two animals gone from animal exposure. 7
Total of 7 animals owner released: Two animal aggressive, one injured, 8
three general cannot care for the animal, one for killing livestock. In the 9
field return to owner total of 19 for April. Scanned 120 animals. Types of 10
calls, 616 calls including 50 injured animals, six cruelty calls, 30 vicious 11
animals, 16 bite calls, field educated/compliance on eight licensing/ 12
microchips, 20 permits, seven rabies vaccinations, 40 care and 13
maintenance or other ordinance violations. Court outcomes for April, nine 14
cases that went to court with total of 20 charges, 58 regular hours plus six 15
hours of overtime with 4 guilty pleas with $212 dollars to local canine rescue 16
group, six dismissed for compliance, continuance of 10 cases. 17

City ACO April responded to 345 reported strays and of those 198 were 19
GOA (gone on arrival); 147 were impounded, 120 were impounded at 20
ASCMV with 67 dogs and 53 cats. Successful in field RTO 27, unsuccessful 21
in returning seven. Three year comparison decrease from February to this 22
month and May will be stepper decline. Owner release: one dog bit a family 23
member; one dog was old and sick; one dog that the owner cannot confine 24
and aggression towards other animals in the residence; two cats due to 25
owner in the hospital, five puppies with parvo. Unable to field RTO, three 26
for no contact by phone, one address in California, one in Kansas, third in 27
El Paso, Texas. Three no contact by phone or at the residence and those 28
profiles not updated. One ear-tipped cat registered to ASCMV. Stray maps 29
were shared and expanded upon for April, January, February, and March. 30
If there are wildlife and they are causing issues, such as a pack of coyotes 31
tried to attack a woman's small dog, then Fish and Wildlife are called in by 32
the ACO. Board Member Gandara complimented the ACOs on their work, 33
and education initiatives. ACO are doing school presentations and can do 34
Zoom classes as well. Board Member Abeyta-Stuve asked if the current 35
calls for cats include just a single cat or mom with kittens. ACO officer 36
stated it varies. On the map in the notes section it shows exactly. 37

B. Shelter Statistics and Activities 39

Clint Thacker gave the ASCMV Executive Director’s report. Current count 41
at the shelter 192, compared to 2019 at 489 difference is because of the 42
shift impounds asked both ACOs to do. Intake continues to be low as well, 43
2020 330 total intake for April versus 771 in 2019. Outcomes 49 finalized 44
adoptions, which the animal is sterilized and everything done but this year 45
sterilizations not done yet due to pandemic. Reclaims 48, rescued 140. 46

Euthanasia 49. 82.9% live release rate which fell because population slow. 1
Not euthanizing adoptable, healthy animals. April 543 people coming ot the 2
shelter compared to 2171 in 2019, but the pandemic limiting who comes 3
into the center and only with an appointment. Board Member Ellins asked 4
why no surgeries are being done. This is due to the Governor's order on 5
halting all elective surgeries. Surgeries have resumed on a limited basis. 6

C. Committee Reports 8

1. Finance - David Dollahon, Committee Chair 10

City Finance staff gave the financial report. Unaudited financials 12
ending April 30th. Cash balance is at $263,000; accounts receivable 13
at $4,180 which $4,000 from City of Anthon and $180 from Sunland 14
Park. Liabilities $62,000, and unassigned fund balance $206,000. 15
Capital projects funds restricted balance $3,600. Change in net 16
position, budget to actual parameter at 83.3%, actual revenues at 17
$2,353,000, total expenditures are at $247,000. The parameter is at 18
81.4% for revenues and total expenditures are at 79.3%. After 19
transfers net change to fund balance $28,000. Expenditures that 20
stand out are temporary services at 99.9% budget to actual. No 21
contracting services for April and there were three payrolls posted. 22
The pie chart of overall total expenditures; 75% personnel, 11% 23
services, 7% supplies. 24

Board Member Dollahon explained the need for a budget adjustment 26
in the June meeting. Also in June meeting a detailed request for 27
additional funding from the City. Clint will provide details for 28
increasing in the City's contribution. Finances are really tight as 29
revenue continues to be down with so few people coming in for 30
adoptions etc. 31

2. Executive - Yvonne Flores, Committee Chair 33

Board Member Sanchez stated there was discussion of receipt of 35
another grant. Clint Thacker stated the most in depth discussion was 36
the City discussing bringing in the ASCMV as a department. Board 37
Member Gandara City had a work session May 11, 2020 to discuss 38
City taking over ASCMV. ASCMV is a Joint Powers Agreement with 39
City of Las Cruces and Doña Ana County since 2008. The City is 40
working on having a second joint meeting with the County. Board 41
Member Dollahon has shared comments and PowerPoint shared 42
with County Chuck McMahon and Jeannine Quintero with request for 43
further discussion based on the City Council direction. More 44
discussion with ASCMV and City staff, minimal amount of staffing 45
with minimal animals in the center, and then look for adjustment 46

based on that. Also evaluate different cost centers based on breed 1
of animals, cats vs. dogs, small dogs vs. large dogs. Formal request 2
to the County from the City Manager's office to start discussions 3
formally with the County staff on next steps related to the Joint 4
Powers Agreement. 5

3. Facilities - Kassandra Gandara, Committee Chair 7

Board Member Gandara discussed current renovations to the HVAC 9
system. Adopted pet space being cleaned. Kudos to Michel Meunier 10
for picking 17 cats, caring for them and finding "furever" homes. 11
Pleased with the ASCMV adopting the Governor's mandate in terms 12
of six-feet, and cleaning and adhering to that. Clint Thacker stated 13
a continuing rotation process of when construction starts on the roof 14
and ripping out airduct systems, so the animals are removed in that 15
section. After that process is complete then thoroughly scrub the 16
area. Air scrubbers are being put in each intake and outtake. 17

D. CfPP Report 19

Clint Thacker gave the presentation. A volunteer handbook was drafted, 21
and article from Las Cruces bulletin volunteer project for Cruces Creatives 22
was also drafted. Las Cruces Dog Park Coalition, great information on the 23
dog parks, but also on animals found. Las Cruces Pet Networking to Save 24
Lives Southern New Mexico. New Mexico Furever Homes Animal Rescue 25
transported ASCMV dogs to Southwest Oasis in Tucson. Safe Haven 26
Animal Sanctuary the two pictured were adopted. Spay and Neuter Action 27
Program, graphic shows why spay neuter, reduces spraying and marking 28
cats, the roaming of dogs reduced, aggression reduced, lower chance of 29
cancer, decrease of overpopulation, and also increases the animal's 30
lifespan. Spay neuter vouchers dated January 15th through March 23rd are 31
automatically approved for expiration date May 29th. Mobile clinic 32
scheduled for spring were cancelled. UNcaged Paws doing great for the 33
ASCMV. May 9th fly out of El Paso of 64 dogs and cats. Dog is my Co-34
Pilot, Lulu's Fun, UNcaged Paws did amazing things. I'm Almost Home 35
Animal Rescue, formerly Chained Dog, has new life. Feed the love, 36
continue to support the community's pets during COVID-19, accepting pet 37
food donations. Drive through pet bank third Saturday of every month, 38
11:00 - 1:00 on Picacho Avenue at Action Programs for Animals. May the 39
Purr be with you, Coalition for Pets and People are always looking for 40
volunteers. Board Member Sanchez stated that the nonprofits are not 41
being able to have many of their fund raising events, so if anyone in the 42
community can help. Also with pet food donations. 43

A. Resolution 2020-13: Accept the Carroll Petrie Foundation Grant and 1
Maddie's Fund Grant 2

Clint Thacker these are great grants. Thank Emily Muir, the Volunteer 4
Coordinator for the Carroll Petrie Foundation and secure that $25,000. It is 5
more of a donation, it is open, i.e. no restrictions on it. Amy Delefex, animal 6
caregiver, she applied for Maddie's fund and got the $10,000. It is 7
earmarked for foster care which could include spay/neuter of a foster 8
animal. ASCMV is working with local vets to have people be able to take 9
adopted animals to vets' clinics for spay/neuter rather than only at the 10
ASCMV. 11

VI. Discussion Items 16

A. Proposal to merge the ASCMV as a City of Las Cruces department. 18
19
Board Member Dollahon e-mailed the County members the presentation 20
and the notes from the May 11th City Council meeting. This is complex but 21
with history. The City had an agreement with Humane Society up until 2008 22
to operate the center. In 2008 the Joint Powers Agreement was established 23
between the two governing bodies to essentially establish this Board, and 24
to operate the center. It was last amended in 2012. There are some items 25
within the Joint Powers Agreement that are not being done; one the City 26
has never executed a lease or made arrangements for credit for a lease 27
between the Animal Service Center and City as the owner. This was 28
something dropped by City staff. 29

There are also things within the lease that were the City is specifically 31
providing that is called out not to be providing. That's training, drug testing, 32
risk management, and onboarding of employees as the fiscal agent. Within 33
the proposal is if the City were to bring it in as a department: Going to a fee 34
for service or fee per animal basis for reimbursement from the County. 35
That's what is currently done with the other incorporated areas of Dona Ana 36
County excluding the City of Las Cruces. The second part is the way the 37
wording is in the Joint Powers agreement, to disband the Joint Powers 38
agreement of the Animal Service Center, it has to be through mutual 39
discussion and mutual agreement. Converting fee for service would not be 40
done instantly, probably a couple of years with a flat guaranteed 41
commitment from the County, and then converting to an animal fee for 42
service contract, similar to what we do with the other municipalities. 43

Did a historical analysis of the budget and came up a fee for service and it 45
depends on the number of animals that are in the center that are brought 46

in. It does account for the fact that citizens and animal control officers drop 1
off animals to the Center. It is based on if the animal is known and their 2
addresses known, then it's attributed to the City or the County, if it is not 3
then it depends on the processes that the Center goes through. City will 4
speak with County management. City needs some refinement based on 5
the Council's questions and those notes were shared with ASCMV. The 6
meeting of May 11th was recorded, available YouTube and the City's 7
internet. Clint Thacker expressed thanks, and states this is the direction 8
they would like to go. 9

Board Member Ellins questioned the fee for service, and be a basic flat rate 11
for a year or two, and would the flat rate be the same the County is currently 12
paying? Board Member Dollahon stated that is still part of the ongoing 13
discussion. The formula being proposed beyond the first two years is to do 14
the flat fee, something based on the average number of animals that are 15
brought in based on a geographical location, probably use a three year 16
average. Variety and variation in number of animals to the Center. 17
Converting the old shelter to new community public spay/neuter or medical 18
center that supports not only the animals in the Center being adopted out 19
but provide support back to the low-income community in partnership with 20
a multitude of nonprofits that help qualify people. Center would take a 21
voucher. Board Member Ellins stated when the discussion for fee for 22
services, will the fee depend upon the shape the animal comes in, i.e. if the 23
animal needs medical treatment would the fee be more than if just dropping 24
off a stray animal? Board Member Dollahon stated that is a good question 25
but cannot be answered now. Board Member Dollahon would like it to be 26
as simple as possible for understanding and implementation. There will 27
always be a reconciliation to what animals came in when and how they 28
arrived etc. Clint Thacker stated that with previous experiences with per 29
animal charging, it just been a flat rate and average amount; some animals 30
almost nothing and other animals needing a lot more care. 31

ANIMAL SERVICE CENTER OF THE MESILLA VALLEY RESOLUTION NO. 2020-14
A RESOLUTION TO ACCEPT A $9,000 BEST FRIENDS ANIMAL SOCIETY CAT LIFESAVING MENTORSHIP FINANCIAL ASSISTANCE AND ADJUST THE ADOPTED FY2020 BUDGET ALLOWING THE GRANT. The Animal Service Center of Mesilla Valley (ASCMV) Board of Directors is hereby informed that:
WHEREAS, the ASCMV applied for and is the recipient of a Best Friends Cat Lifesaving
Mentorship one-time financial assistance; and
WHEREAS, the funds will be used to cover the costs of spay/neuter surgeries, vaccines and ear
tipping for Return to Field eligible cats; and
WHEREAS, the funds will also be used for the implementation and utilization of various
lifesaving avenues that result in live outcomes for cats at the ASCMV.
NOW THEREFORE, be it resolved by the Board of Directors for the Animal Service Center of
the Mesilla Valley:
(I)
THAT the FY2020 adopted budget will be hereby amended as shown in Exhibit “A” attached
hereto and made part of this resolution is hereby adopted.
(II)
THAT, once approved, a copy of the signed, recorded resolution and any supporting
documentation will be submitted to the City of Las Cruces, as fiscal agent for submission to the
Department of Finance and Administration (DFA) for approval and incorporation into its (City of Las
Cruces) respective budget for inclusion in the FY2020 budget for the ASCMV.
(III)
THAT, ASCMV staff be and hereby are authorized to take any action necessary to implement
and comply with the budget submitted and approved as part of this resolution.

ANIMAL SERVICE CENTER OF THE MESILLA VALLEY RESOLUTION NO. 2020-15 A RESOLUTION FROM THE ASCMV TO REQUEST AN INCREASE IN CITY CONTRIBUTION FOR THE ASCMV FY21 BUDGET. The Animal Service Center of the Mesilla Valley (ASCMV) Board of Directors is hereby
informed that:
WHEREAS, the ASCMV has completed an analysis of revenues and expenditures, and
has determined that additional funding is needed in order to successfully accomplish its
mission of caring for animals brought to the shelter; and
WHEREAS, the ASCMV requests an increase of $520,255 to its Fiscal Year 2021 Annual
Budget from the City of Las Cruces.
NOW THEREFORE, be it resolved by the Board of Directors for the Animal Service Center
of the Mesilla Valley:
