Annex C1 Identification of applicable legislation

Provide a list or reference to the existing list of applicable legislation as required by FSC-PRO-60-002a FSC National Risk Assessment Framework for each area under assessment.

Identified applicable legislation or relevant references shall be provided at least for each law sub-category specified in table 1 in the FSC-PRO-60-002a FSC National Risk

Assessment Framework (Legal rights to harvest, taxes and fees, timber harvesting, third parties’ rights, trade and transport, diligence/due care). Whenever possible, applicable

legislation shall be provided for indicators included in the law sub-categories. Justification shall be provided when level of indicator is not achieved.

Laws and regulation identified above that are relevant for: labor rights, the rights of indigenous and traditional peoples, conversion of forest to plantation and/or non-forest use, as

Abruzzo [Protection and enhancement of forests, pastures, and regional woodland assets] L.R. n. 3 del 4 gennaio 2014 "Legge organica in materia di tutela e valorizzazione delle foreste, dei pascoli e del patrimonio arboreo della regione Abruzzo"

According to L.R. n. 3 del 4 gennaio 2014 (art.30), all forest lands are protected by and subject to the prescriptions, constraints and procedures aimed to manage and mitigate the hydrogeological risk, according to RDL 3267/1923. In such lands, any digging activity shall be authorized in advance by the competent regional Authorities, unless they had been previously authorized through relevant forest management plans (in this case, a simple notification is needed, accompanied by an executive project). “Forest conversion” is defined as any operation implying land-use change into non-forestry one (art.31). Forest conversions can be authorized only on an exceptional basis, for purposes related to the public interest, and/or forest road network development for sylvicultural purposes and protection from wildfires - compatibly with biodiversity protection - and taking in consideration a set of environmental conditions, e.g. land steadiness, water flows, landscape protection, environmental healthiness, and protection from avalanches, rock falling and wind. Forest conversions can be authorized only when compensation activities are planned (art.32) through an adequate technical project. Compensation activities shall be implemented at the total expense of the entity that is responsible for the forest conversion, under the form of either reforestation (over an area that is 1.5 times wider than the converted one) or forest improvement (over an area that is 3 times wider than the converted one, if the latter is <2000 m2). Compensations shall be implemented in areas neighboring those where the conversion occurred, or within the same watershed area. Compensations need to consider and include also maintaining activities, within a certain period of time subsequent to plantation. Indigenous species shall be used. Compensation is not needed for lands covered only by shrubs. If enough land is not available to the applicant, a certain sum (to be defined case-by-case) shall be transferred to the relevant regional Department, covering the costs related to land purchasing as well as the implementation of compensation activities. Money collected through this mechanism can only be used for developing compensation measures.

Basilicata [Hydro-geological risk] D.G.R. n. 412 del 31 marzo 2015 "Disposizioni in materia di vincolo idrogeologico"

According to D.G.R. n. 412 del 31 marzo 2015, art. 9, point e), forest conversion is defined as any operation implying land-use change into agriculture and/or non-forestry one. Any forest conversion, even temporary ones, are subject to the prescriptions, constraints and procedures aimed to manage and mitigate the hydro-geological risk, according to RDL 3267/1923. A technical report shall be provided within any application for forest conversion. Forest conversion shall be authorised by the regional Department of Agriculture, rural development and mountain economy, Forest and Land Protection Office. Compensation activities shall be implemented at the total expense of the entity that is responsible for the forest conversion, under the form of either reforestation or forest improvement. Compensation is not needed, but still possible, for conversions affecting forest areas <500 m2. Compensations shall be implemented in the same watershed area where the conversion occurred.

Calabria [Management, conservation and enhancement of regional woodland assets] L.R. n.45 del 12 ottobre 2012 "Gestione, tutela e valorizzazione del patrimonio forestale regionale"

According to L.R. n.45 del 12 ottobre 2012, art. 4, point 11), forest conversion is defined as any operation eliminating existing tree and bush vegetation and implying land-use change into non-forestry one (i.e. into any land use that does not match forest definition given by regional laws). Usually, conversion is forbidden, and allowed only in cases of relevant public interest. Forest conversion shall be authorised by competent authorities identified under D.Lgs 42/2004 (Landscape protection restrictions) and L.R. 45/2012 (Watershed protection restrictions). A technical report developed by an expert technician/professional shall be provided within any application for forest conversion. Forest conversion shall be authorised by the relevant regional Department. Compensation activities shall be implemented at the total expense of the entity that is responsible for the forest conversion, under the form of reforestation (same size of converted forest area). In case the applicant doesn't hold lands suitable for compensations, a certain sum equaling the value of the converted land shall be transferred to the relevant regional Department. Compensation shall occur for conversion areas >2000 m2.

Campania [Mountain economy, protection and enhancement of mountain terrain conditions] L.R. n.14 del 24 luglio 2006 “Modifiche ed Integrazioni alla Legge Regionale 7 maggio 1996, n.11 concernente la delega in materia di economia, bonifica montana e difesa del suolo”

According to the regional forest law (art. 23), forest lands are protected by and subject to the prescriptions, constraints and procedures aimed to manage and mitigate the hydrogeological risk, when they stand on high risk areas, according to RDL 3267/1923. In such lands, any digging activity shall be authorized in advance by the competent regional Authorities, i.e. by the President of the relevant Mountain Community, or by the President of the relevant regional Province, taking in consideration the technical advices by the competent regional Department. A caution money, or similar guarantee deposit, can be requested by regional Authorities to ensure the right execution of the authorized intervention. According to the relevant regional forest regulation (art.1), technical advices (e.g. prescriptions, way-of-doing, time schedule, etc.) shall come with the relevant authorization.

Emilia Romagna

[Regional budget law, giving prescriptions on forest conversions] L.R. n. 21 del 22 dicembre 2011 "Legge finanziaria regionale adottata a norma dell'articolo 40 della legge regionale 15 novembre 2001, n. 40 in coincidenza con l'approvazione del bilancio di previsione della regione Emilia-Romagna per l'esercizio finanziario 2012 e del bilancio pluriennale 2012-2014" [Criteria and prescriptions to properly carry out compensation activities in case of forest conversions] GPG/2012/555 "Approvazione dei criteri e direttive per la realizzazione di interventi compensativi in caso di trasformazione del bosco, ai sensi dell'art. 4 del D.lgs. 227/2001 e dell'art. 34 della L.R. 22 dicembre 2011 n. 21"

According to L.R. n. 21 del 22 dicembre 2011, art. 34, any forest land is subject to the prescriptions, constraints and procedures aimed to manage and mitigate the hydrogeological risk, according to RDL 3267/1923, and landscape protection, according D.Lgs. 42/2004. Forest conversion is defined as any artificial operation that permanently eliminates the existing vegetation. Such activities need to be authorized in advance by local competent authorities, i.e. Municipalities or Unions of Municipalities. Any convertson shall be compensated through either compensation activities (afforestation/reforestation) at the expense of the applicant, or the payment of a sum equaling the implementation cost of the compensation activities. It is up to the Regional Council to determine which compensation activity shall be put in place. L.R. n. 21 del 22 dicembre 2011 lists the general guiding criteria to estimate the due money amount, as well circumstances where compensation activities are not compulsory. Criteria are further and specifically developed in the regional regulation “GPG/2012/555, Approvazione dei criteri e direttive per la realizzazione di interventi compensativi in caso di trasformazione del bosco, ai sensi dell'art. 4 del D.Lgs. 227/2001 e dell'art. 34 della L.R. 22 dicembre 2011 n. 21". Please refer to this regulation for further indications concerning forest conversion.

Friuli Venezia Giulia

[Prescriptions on forest and woodland assets] L.R. n.9 del 23 aprile 2007 “Norme in materia di risorse forestali"

According to L.R. n.9 del 23 aprile 2007 (art.42) “forest conversion” is defined as any operation implying land-use change into non-forestry one. Forest conversions can be authorized by the central competent regional authority, compatibly with biodiversity protection and a set of environmental conditions, e.g. land steadiness, water flows, forest typology, landscape protection, environmental healthiness, and protection from rock falling and wind. Forest lands are further protected by and subject to the prescriptions, constraints and procedures aimed to manage and mitigate the hydrogeological risk, when they stand on high risk areas (RDL 3267/1923). L.R. n.9 del 23 aprile 2007 (art.49) provides an additional set of operations to be included under such circumstance. Forest conversion shall be compensated through compensation activities to be implemented at the total expense of the entity that is responsible for the forest conversion, under the form of reforestation on an area of the same extension of the converted forest area (where priority habitats relevant to Directive 92/43/CEE, Annex I, are not in place), or through recovery of habitats relevant to Directive 92/43/CEE, Annex I. In lieu of implementing the due compensation activities, the applicant can pay a sum equaling the cost of such implementation. Compensation is not needed when the conversation occurs in relation to those reasons and circumstances identified in L.R. n.9 del 23 aprile 2007, art. 45, i.e. among the others: purposes related to the public interest, interventions <20,000 m2 in mountainous areas, recovery of past mountainous agriculture (naturally afforested since minimum 20 years), recovery of habitats relevant to Directive 92/43/CEE. According to the regional forest regulation (art.49), a technical report developed by an expert technician/professional that includes intended compensation activities is required to support the application for conversion. Forest conversions may occur even in neighboring areas, provided that the relevant regional Department authorised them.

Lazio [Prescriptions on forest and woodland assets] L.R. n.39 del 28 ottobre 2002 “Norme in materia di gestione delle risorse forestali”

According to L.R. n.39 del 28 ottobre 2002 (art. 37) “forest conversion” is defined as any operation implying land-use change from forest and/or shrub lands into non-forestry ones. This applies also to cases described under D.Lgs. 42/2004 (Landscape protection). Forest conversion is generally forbidden, unless it is authorized by the competent regional authority according to D.Lgs. 490/1999, and they are compatible with biodiversity protection and a set of environmental conditions, e.g. land steadiness, water flows, landscape protection, environmental healthiness, and protection from avalanches, rock falling and wind. In sylvicultural terms, “forest conversion” includes also sylvicultural treatments inducing a shift from high-forest stands to coppices, or from uneven-aged and/or aged coppices to simple coppices (art.38). Such activities shall be authorized in advance by the competent regional Authorities, i.e. by Provinces or Mountain Communities, or by the local Municipalities if the affected area <3 ha. According to L.R. n.39 del 28 ottobre 2002, art.39, the regional forest regulation identifies the circumstances where a simple communication is needed. When forest conversions, occurring as the result of either a single intervention or a sum of multiple interventions, exceed 5,000 m2, they shall be compensated. Compensation activities shall be implemented at the total expense of the entity that is responsible for the forest conversion, under the form of reforestation (same size of converted forest area) (art.40). Indigenous species should be preferred. Technical advices (e.g. prescriptions, way-of-doing, time schedule, affected area, etc.) come with the relevant authorization, including the due money deposit. Compensations shall be preferably implemented within the same watershed where the conversion occurred. If the applicant doesn’t implement the due compensation activities, the competent authorities have to perform them instead of the applicant, charging the applicant with the full cost. If enough land is not available to the applicant, public authorities decide whether the applicant should implement the compensation activities on public lands, or transfer a certain sum (defined by law) to the competent authority (art.14). The latter must use such money only for reforestation purposes, within the same Mountain Community or Province, or even a different watershed area.

Liguria [Prescriptions on forest and woodland assets, and hydro-geological conditions] L.R. n.4 del 22 gennaio 1999 "Norme in materia di foreste e di assetto idrogeologico"

According to L.R. n.4 del 22 gennaio 1999 (art.47), any reduction in the extension of forest areas is generally forbidden. Any digging activity in hydrogeological high-risk areas shall be pre-emptively authorized by the competent regional Authorities, i.e. competent Mountain Communities or Provinces. Local Municipalities are competent authorities for hydrogeological low-risk areas (art.35). A simple notification is sufficient when “modest” digging activities take place, i.e. operations <100m3 volume, <2m high and <10% water-proofing of total affected area. Forest conversions have to consider adequate compensation activities (art.47bis), to be implemented at the total expense of the entity that is responsible for the forest conversion. To this end, the applicant must transfer a certain sum (to be determined through criteria specified by law) to the regional administration, that will make use of it for performing afforestation, forest improvement or hydrogeological risk mitigation, or even urban forest interventions, even in a watershed area different from the one where the conversion occurred. Compensation activities are compulsory for conversion areas >500 m2, even when they result from multiple interventions performed over a 5-year period at distances <100 m from each other.

According to L.R. n.31 del 5 dicembre 2008 (art. 43), “forest conversion” is defined as any artificial operation eliminating the forest coverage or implying land-use change into non-forestry one. Forest conversion is generally forbidden, unless it is authorized by competent authorities - i.e. Provinces, Mountain Communities or Unions of Municipalities, and Entities managing protected areas - and they are compatible with biodiversity protection and a set of environmental conditions, e.g. land steadiness, water flows, landscape protection, environmental healthiness, and protection from avalanches, rock falling and wind. Adopted forest management plans identify circumstances where, and how, conversions can be made. If plans are missing, a full request application to the relevant competent authority is requested. Forest conversion shall be compensated through compensation activities to be implemented at the total expense of the entity that is responsible for the forest conversion, under the form of either reforestation (where low-forest area index applies) or forest improvement (where high-forest area index applies) and hydrogeological risk mitigation. Compensation activities may be carried out also by the authorizing authority. In this case, the applicant is charged with the full costs of implementation.

Marche [Forest law] L.R. n.6 del 23 febbraio 2005 "Legge forestale regionale"

According to L.R. n.6 del 23 febbraio 2005 (art.10), any reduction in the extension of forest areas is generally forbidden, as well as any shift from high-forest stands to coppices, or from uneven-aged and/or aged coppices to simple coppices. Such activities may be authorized by Provinces with the technical advice of competent Mountain Communities (art.12), for purposes related -among the others- to the public interest, and/or the forest road network development for sylvicultural purposes. Reduction of forest areas comes with compensation activities (art.23), under the form of afforestation and with a proportion of 2 trees planted for each tree cut down. Indigenous species are to be used, and the extension of the compensating areas is calculated through criteria defined by law. Compensations activities should primarily take place in the same watershed area where the conversion occurred. Compensations do not apply when the converted area is <1,000 m2. Technical advices (e.g. prescriptions, way-of-doing, time schedule, etc.) come with the relevant authorization. A caution money, or similar guarantee deposit, can be requested in order to ensure the right execution of the authorized compensation activities. If enough lands to be afforested are not available, Provinces esteem the sum to charge the applicant with, covering the costs related to land purchasing as well as the implementation of compensation activities (planting and maintenance for the first 5 years after plantation).

According to L.R. n.4 del 10 febbraio 2009 (art. 19) forest conversion is defined as any operation eliminating existing vegetation (not necessarily trees) and implying land-use change into non-forestry one (see art. 3 for definition). Forest conversion shall be authorised by competent authorities identified under D.Lgs 42/2004 (Landscape protective restrictions) and L.R. 45/1989 (Watershed protective restrictions). Authorisation shall be issued by: - Municipalities for forest areas <30.000 m2, - Regional Landscape Department (Settore Attività di Gestione e Valorizzazione del Paesaggio) for forest areas >30.000 m2. Compensation activities shall be implemented at the total expense of the entity that is responsible for the forest conversion, under the form of either reforestation (same size of converted forest area) or forest improvement (over an area that is 3 times wider than the converted one). According to L.P. n.11 del 23 maggio 2007 (art.13), forest conversion is defined as any artificial operation that eliminates the existing vegetation or any removal or modification of the forest soil profile, aimed to change the land-use destination into a non-forestry one. Such activities need to be authorized in advance by the provincial authorities, i.e. the Technical Forestry Committee and the competent provincial authorities. The Technical Forestry Committee and the competent provincial authorities may either require compensation activities or charge the applicant with a sum covering the costs for the implementation of compensation activities. In the second case, public authorities have to make use of such money only for compensation purposes, primarily within the same geographical scope where the digging activities/forest conversion occurred. Additional secondary regulations list the circumstances when simplified procedures are to be followed, e.g. in case of recovery of former and abandoned pastures, whereas additional provincial primary laws define the cases when landscape-protection procedures are to be followed or environmental impact assessments to be performed.

According to the Regolamento Regionale n.9 del 11 marzo 2015 (art. 2) forest conversion is defined as any intervention eliminating the existing vegetation, and aimed to change the land-use into a non-forestry one. Such activities shall be authorised in advance by the Regional Forestry Service (art.16). Furthermore, any forest conversion is subject to the prescriptions, constraints and procedures aimed to manage and mitigate the hydrogeological risk (art.21). According to the regional regulation “Regolamento Regionale n.21 del 12 novembre 2013, Attuazione degli articoli 20 bis e 20 ter della L.R. 30 novembre 2000, n. 18 - Trasformazione boschiva con compensazione”, “compensations” consist of afforestation activities of non-forest lands, making use of indigenous species (art. 2). The Regional Forest Plan indicates where conversion can take place, and under which conditions. If such Plan is missing, a full application needs to be submitted together with a technical report developed by an expert technician/professional. Compensations consists of improved forest management applied to other forest lands. Compensation activities are always required, and they cannot be <2,000 m2. The size of the area is established through criteria proportional to the forest canopy coverage index of the converted area, i.e. 1 converted m2:2-5 compensated m2 with low-value index, and 1:1 m2 with high-value index (art.8). Areas to be compensated should be primarily located within the same watershed area where conversion occurred, indigenous species should be used and priority must be given to those interventions enabling re-unification of different forest areas (art.13). Compensation activities are carried out at the expense of the entity responsible for the forest conversion; whereas a caution money, or similar guarantee deposit, can be requested by regional Authorities to ensure the right execution of the prescribed compensation activities (art.12).

These also include forest conversions, along with any change from high-forest stands to coppices, or from uneven-aged and/or aged coppices to simple coppices. According to L.R. n.39 del 21 marzo 2000 (art.42), any forest conversion is subject to the prescriptions, constraints and procedures aimed to manage and mitigate the hydrogeological risk, according to RDL n.3267/1923, and landscape protection according D.Lgs. 42/2004. Forest conversion is defined as any intervention eliminating the existing vegetation, aimed to change the land-use into a non-forestry one (art.79). For what concerns hydrogeological issues, authorizations are issued by Provinces or Unions of Municipalities (formerly named Mountain Communities), or Municipalities. Additional provincial secondary regulations list the circumstances under which simplified procedures are to be followed, or no procedures are needed at all. When conversions are >2,000 m2 - even when they result from multiple interventions performed over a 3-year period at distances <300 m from each other (art.81) - compensation activities shall occur at the total expense of the entity that is responsible for the forest conversion, under the form of reforestation (same size of converted forest area) (art.44). Technical advice and prescriptions (e.g., way-of-doing, time schedule, etc.) come with the relevant authorization. If lands to be afforested are not available, Provinces define the sum to charge the applicant with, through criteria defined by law (art.81). If conversions affect >5 ha, the regional Council prescribes soecific measures for compensation activities, that may be realized also in Provinces or Unions of Municipalities different from those where conversion actually occurred. A caution money, or similar guarantee deposit, shall be given by the applicant, in order to ensure the right execution of the authorized intervention.

Umbria [Territorial and urban planning] L.R. n. 27 del 24 marzo 2000 "Piano urbanistico territoriale"

Whereas the regional forest low protects forests by conversion activities (art.7), the regional law L.R. n. 27 del 24 marzo 2000 (territorial planning) (art.15) states that it is possible to realize infrastructures for purposes related to the public interest at the expense of forest lands when alternatives are not viable/possible. Such activities shall be authorized in advance by competent authorities (not further defined), as stated by the regional forest law (art.7) and the regional forest regulation (art.55 and 57). When infrastructures are planned to be realized within forest lands, compensation activities shall be implemented (L.R. n. 27 del 24 marzo 2000, art.2), at the full expense of the applicant, within the same or neighbouring Municipalities where infrastructures are planned to be realized. Compensation activities shall be performed under the form of afforestation activities, including forest maintenance activities for the first five years after plantation. Alternatively, competent authorities can charge the applicant with a fee covering the estimated costs for the implementation of compensation activities. A caution money, or similar guarantee deposit, shall be paid by the applicant, in order to ensure the proper execution of the authorized intervention.

Forest conversion is defined by the Regional Forest Regulation (Prescizioni di Massima e Polizia Forestale della Regione Veneto) (art.52) as any operation implying land-use change into non-forestry one on a permanent basis. Infrastructures supporting rural activities make exception. According to L.R. n.52 del 13 settembre 1978 (art.4), any forest conversions and any “transformation” of “steady lands” into lands with different land-uses are subject to the prescriptions, constraints and procedures aimed to manage and mitigate the hydrogeological risk, according to RDL n.3267/1923. Furthermore, it is explicitly forbidden to reduce the extension of forest areas, unless interventions are authorized in advance by the regional Council through competent territorial authorities. Interventions shall be compensated, at the expense of the applicant, in form of (a) afforestation (same sixe of converted area), (b) forest improvement on an area double in size than the one being converted, (c) payment of a sum covering forest improvement costs for an area double in size than the one that is being converted.
