Editorial
Scheduled Castes have been subjected to various kinds of social
discrimination and economic deprivation through the ages. At present,
above 50% scheduled castes are living under below poverty line and
work as bonded labors or landless laborers and sweepers. A large
number of their population work as tenants. Most of them are also
involved in the brick-kiln and leather work. They have been living in
huts in rural areas. In rural areas, their huts are located in separate
settlement outside the main village and they generally lack even basic
amenities. Many live in temporary structure in the land of landlords.
Land mafia grab the land on which scheduled castes set up their huts.
They have few places where they can burn their dead, and many of these
are illegally occupied by local feudal.
Majority of scheduled castes do not send their girls to schools
fearing of unpleasant incidents with them. Most of scheduled castes do
not possess national identity card, the important documents which could
give some realistic figures about their status. Scheduled castes are
victims of religious discrimination by upper caste. Scheduled castes are
refused entry into temples by upper castes.
In view of their misery condition in the society, the framer of the
Constitution made specific provisions for upliftment of downtrodden.
Under the Article 338 of the Constitution, the National Commission for
Scheduled Castes was constituted to monitor the condition of the
scheduled castes and their socio- economic and educational development
and to bring them into mainstream of the society by providing for their
equitable share in the governance through the policy of reservation in
elected bodies, public services and educational courses, protection
against social and economic exploitation and enhanced and specific
financial allocation for expediting their socio-economic development.
The Commission has been given enhanced powers and responsibilities
and it is also empowered to regulate its own procedure.
A large number of central ministries/departments allocate funds
under SCP as per the guidelines and are required to formulate need
based schemes for accelerated socio-economic development of
scheduled castes. The government schemes must aim at building
competence, capacity to be self reliant, capacity to compete within the
general atmosphere of economic liberalization through appropriate
schemes/projects. Such a capacity building will reduce the vulnerability
of scheduled castes being reduced to economically weaker and weaker
over the years.
The benefits, however, have not reached all SCs and a large
number of them continue to be steeped in poverty and misery and
subject to discrimination and atrocities by other sections of society. The
development programmes need to be implemented with renewed vigor
and reoriented, wherever necessary and targeted specifically on those
sections among SCs who have remained deprived of the benefits of
development in the past
Instrument for Social Inclusion
Indian Constitution seeks to abolish 'untouchability' and its practice in any
form is forbidden. It needs to be made operational with the ostensible objective to
remove humiliation and multifaceted harassments meted to the Scheduled Castes
and to ensure their fundamental and socio-economic, political, and cultural rights.
But despite various measures adopted the governments to improve the socio-
economic conditions of the Scheduled Castes and Scheduled Tribes they remain
vulnerable and are subject to various offences, indignities and humiliations and
harassment. When they assert their rights and against the practice of
Untouchability against them the vested interest try to cow them down and terrorize
them. Atrocities against the Scheduled Castes and Scheduled Tribes still continued.
The normal provisions of the existing laws like, the Protection of Civil Rights Act
1955 and Indian Penal Code have been found inadequate to check these atrocities
continuing the gross indignities and offences against Scheduled Castes and
Scheduled Tribes. Recognizing these, the Parliament passed „Scheduled Caste and
Scheduled Tribe (Prevention of Atrocities) Act‟, 1989 & Rules, 1995. The
statement of objects and reasons appended to the Bill is that despite various
measures to improve the socioeconomic conditions of Scheduled Castes &
Scheduled Tribes, they remain vulnerable. They are denied a number of civil
rights; they are subjected to various offences, indignities, humiliations and
harassment. They have, in several brutal incidents, been deprived of their life and
property. Serious atrocities are committed against them for various historical,
social and economic reasons. The preamble of the Act also states that the Act is “to
prevent the commission of offences of atrocities against the members of Scheduled
Castes and Tribes, to provide for Special Courts for the trial of such offences and
for the relief and rehabilitation of the victims of such offenses and for matters
connected therewith or incidental thereto.”
Thus objectives of the Act clearly emphasize the intention of the Government to
deliver justice to these communities through proactive efforts to enable them to
live in society with dignity and self-esteem and without fear or violence or
suppression from the dominant castes. The practice of untouchability, in its overt
and covert form was made a cognizable and non compoundable offence, and strict
punishment is provided for any such offence.
The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989
with stringent provisions was enacted on 9 September 1989. Section 23 (1) of the
Act authorizes the Central Government to frame rules for carrying out the purpose
of the Act. Drawing power from this section, the Scheduled Castes and the
Scheduled Tribes (Prevention of Atrocities) Rules of 1995 were framed. The rules
for the Act were notified on 31 March 1995
Implementation of SCSP
Guidelines on formulation, implementation and monitoring of SCSP have
been issued by the Planning Commission from time to time. Consolidated
guidelines in this regard were last issued to 62 Central Ministries/Departments in
December, 2006, for the implementation from the Annual Plan, 2007-08.The 62
Central Ministries/Departments addressed as above, are,inter alia, required to
earmark funds under SCSP/TSP from the Plan outlay, at least in proportion of
percentage of SC and ST population in the country, which was 16.2% and 8.2%
respectively, as per census, 2001. Funds should be earmarked for SCSP under a
separate Minor Head of every ministry/department. Non-divertibility to any other
scheme shold be ensured by ministry/department. There are guidelines for
categorization of Outlay/Expenditure to include under SCSP which ensure direct
benefits to individuals or families belonging to scheduled Castes and Outlay for
area oriented schemes directly benefiting scheduled castes hamlets /villages having
more than 40% scheduled Castes and Scheduled Tribes population shall be
included in SCSP & TSP
A dedicated unit may be constituted in every Central Ministry/Department
for the welfare and development of SCs as nodal unit for formulation and
implementation of SCSP. The nodal unit should be responsible for ensuring that
the funds will be allocated to the sectoral unit in the Departments to implement the
schemes directly relevant for SC development.
Status of implementation of the above guidelines has remained inadequate.
Hardly any Ministry is showing its SCSP/TSP outlays under a separate Budget
Heads. Some Ministries are showing a notional earmarking, but the criterion
followed in doing so is not uniform and transparent. Also, in the absence of this
outlay being shown under a separate minor head. Such notional earmarking does
not have much significance, nor is its non-divertibility ensured. In the absence of
separate earmarking and budgeting of funds under SCSP/TSP by Central
Ministries/Departments, it is not possible, as of now, to quantify the total amount
allocated and/or spent by the Central Government under SCSP/TSP. The SCSP and
TSP strategies thus remain substantially un-implemented at the level of the Central
Ministries/ Departments mainly due to lack of an effective mechanism in this
behalf. Some indication of Central Government allocation on schemes of SCs and
STs is available from the Expenditure Budget. This gives information about
allocations under schemes that aresubstantially meant for SCs/STs, in two parts i.e.
Schemes in which there is 100% provision for SCs/STs, and Schemes where at
least 20% of the allocation is earmarked for SCs/STs. Planning Commission has
been insisting upon Central Ministries/Departments to properly implement its
guidelines regarding SCSP/TSP.
NCSC - At a glance The Constitution made special provisions to provide safeguards against the
exploitation of Scheduled Castes and Scheduled Tribes and to promote and protect
their social, educational, economic and cultural interests. In this context,
Commissioner for Scheduled Castes and Scheduled Tribes was designated to
investigate all matters relating to the safeguards for Scheduled Castes and
Scheduled Tribes in various statutes and to report to the President upon the
working of these safeguards with its regional offices in different parts of the
country. In 1978, replacing one Member Commission, the Government set up a
Multi- Member Commission.
Thus the first Commission for Scheduled Caste and Scheduled Tribes was
set up in August, 1978 with Shri Bhola Paswan Shastri as Chairman and other four
Members. In 1987, the Commission for Scheduled Castes and Scheduled Tribes
was renamed as the National for Scheduled Castes and Scheduled Tribes and it was
set up under the Ministry of Welfare's Resolution. The first Commission consisted
of Shri Ram Dhan as Chairman, Shri Bandi Oraon as Vice- Chairman and Shri B.
Sammaiah, Dr. Sarojini Mahishi, Choudhary Hari Singh, Shri N. Brahma and Shri
Jina Bhai Darjee as Members.
The second Commission was constituted on 5.10.95 with Shri
Hanumanthappa as Chairman, Smt. Omem Moyong Deori as Vice- Chairman and
the Members of the Commission were Shri N.C. Chaturvedi, Shri Anand Mohan
Biswas, Ven Lama Lobzang, Shri Narsing Baitha and Shri Jina B. Yadaiah.
The third Commission was constituted in December, 1998 consisting of
Shri Dileep Singh Bhuria as Chairman, Shri Kameshwar Paswan as Vice-
Chairman and Shri Harinder Singh Khalsa, Ven Lama Lobzang, Shri Chhotray
Majhi and Shri M. Kannan as Members. Smt. Venna Nayyar was also appointed as
Member. On the resignation of Shri M. Kannan, Shri C. Chellappan was appointed
as Member.
The fourth Commission was constituted in March, 2002 consisting of Dr.
Bizay Sonkar Shastri as Chairperson, Ven. Lama Chosphel Zotpa as Vice-
Chairperson and Shri Vijay Kumar Choudhary, Shri Narayan Singh Kesari and
Shri Tapir Gao as Members.
In February, 2004, National Commission for Scheduled Castes and
Scheduled Tribes was bifurcated in two different Commissions i.e. National
Commission for Scheduled Castes and National Commission for Scheduled Tribes.
However, the bifurcation came into effect in December, 2004.
FAQs on SC/ST's Prevention of Atrocities Act, 1989.
Police
Question: The case has already been booked u/s of IPS. Why
Should it be booked again u/s 3 of POA Act, 1989?
Answer: Because, over and above the provisions of IPC, the
SCs and STs (POA) Act, 1989 is focussed, more
Punitive with provisions for a graded rehabilitation
And monetary relief.
Question:
How could it be presumed that the person in
question is a genuine member of SC/ST?
Answer: Insist on Caste Certificate to be produced within a
few hours. But don't deny FIR just because he has
not produced caste certificate instantly.
Question: How can it be established that the motive behind the
Incident is reveng/caste feeling?
Answer: Find out if the victim is known to the accused. Prior
knowledge of the victim who belongs to SC/ST,
might imply that this prior knowledge about the
victim or his family (particularly in villages/small
towns) establishes that the accused had prior
knowledge about the caste of the victim. Find out if
there is any history of past dispute/quarrel/
animosity between the two, or between the two
families or between their communities/neighborhood
etc. If it could be proved that there was a history of
animosity or enmity, then the present dispute could
be a result of the past animosity ignited by the
present circumstances which could lead to the
conclusion that the sole/main or one of the motive of
the present dispute and crime had its roots in caste
feeling I bias. This could be immediate or
secondary.
Question: If the accused is already booked under IPC, charge
sheeted on the basis of FIR, by default or by
ignorance, how can he be booked again under the
POA Act?
Answer: Supplementary charges can be framed under POA
Act And facts/reports presented to the court etc.

Question: If the complaint does not seem to be trustworthy,
why should an FIR be recorded that adds to the
burden and reflect on the performance of police?
Answer:
- Please don't sit on value judgement, Section 154
Cr.PC does not stipulate presumption on the part of
police.
- Supreme Court has allowed the police to be
reasonable which does not mean rejection of
complaint outrightly without verifying the facts.
- Hold on –verify facts – if found false prima facie
– deny FIR, giving reasons on the basis of primary
investigation. But act fast.

-What can be done when both the parties try to
lodge FIR against?
Answer: Investigate and find the truth.
Victims
Question: When the SHO/PS-in-charge refuses to lodge FIR,
what can be done?
Answer: Go to the SP and give your complaint in writing.
Question: If the SP also refuses?
Answer: Approach the National Commission for SCs and
National Commission for STs. This is the provision
of the SCs and STs (POA) Rules, 1995
Question: How to convince the police?
Answer: -Show the proof of your caste identity.
-Lodge a written complaint with the police.
-Attach versions of witness(es) supporting your
statement duly signed by him/them by affidavit in
writing.
-Try to establish the motive with direct and
circumstantial evidence.
-Insist on receipt of your complaint duly signed by
the duty officer.

Scheduled Castes constitute the largest proportion amongst
agriculture labour. However, the number of SC land owners was very
low. The Report of Governors constituted for the Scheduled Castes also
mentioned that there was enough land in this Country for making it
available to the SCs.There is a need to have a land bank for the SCs. The
largest proportion of casual labour in urban areas belongs to SCs. In
order to improve their condition, there is a need to ensure greater
ownership of the means of production by them.National Skill
Development Initiative should be utilized for the benefit of SCs working
as unskilled labours. The problem of untouchability still continues. The
disparity/discrimination against SCs is prevalent even in urban
areas.Setting up of residential schools for Scheduled Castes should be
taken up on a large scale. Right to Education Act, 2005 does not provide
a separate reservation quota for SC children in private un-aided
institutions. The are clubbed with several other groups in the category
"children from disadvantaged groups". This needs to be rectified. The
issue of Reservation in private sector for SCs needs to be addressed on
priority.

सॊत ÜòãðÇðçð उन भहान ् सन्तों भें अग्रणी थे जजन्होंने अऩनी यचनाओॊ के भाध्मभ से
çðÙðð¸ð भें व्माप्त फुयाइमों को दयू कयने भें भहत्िऩूणण मोगदान ककमा। इनकी यचनाओॊ की विशषेता रोक-िाणी का अद्भतु प्रमोग यही है जजससे जनभानस ऩय इनका अमभट प्रबाि ऩड़ता है। भधयु एिॊ सहज सॊत यैदास की िाणी ऻानाश्रमी होते हुए बी ऻानाश्रमी एिॊ पे्रभाश्रमी शाखाओॊ के भध्म सेतु की तयह है।
रगबग छ: सौ फत्तीस िषण ऩहरे बायतीम सभाज अनेक फुयाइमों से ग्रस्त था। उसी सभम ÜòãðÇðçð जैसे सभाज-सुधायक सन्तों का प्रादबुाणि हुआ। ÜòãðÇðçð का जन्भ काशी भें चभणकाय कुर भें हुआ था। उनके वऩता का नाभ सॊतो ो़ख दास औय भाता का नाभ कभाण देिी फतामा जाता है। ÜòãðÇðçð ने साध-ुसन्तों की सॊगतत से ऩमाणप्त व्मािहारयक ऻान प्राप्त ककमा था। जूते फनाने का काभ उनका ऩैतकृ व्मिसाम था औय उन्होंने इसे सहषण अऩनामा। िे अऩना काभ ऩूयी रगन तथा ऩरयश्रभ से कयते थे औय सभम से काभ को ऩूया कयने ऩय फहुत ध्मान देत ेथे।.उनकी सभमानुऩारन की प्रितृत तथा भधयु व्मिहाय के कायण उनके सम्ऩकण भें आने िारे रोग बी फहुत प्रसन्न यहते थे।
ÜòãðÇðçð प्रायम्ब से ही फहुत ऩयोऩकायी तथा दमारु थे औय दसूयों की सहामता कयना उनका स्िबाि फन गमा था। साधु-सन्तों की सहामता कयने भें उनको विशषे आनन्द मभरता था। िे उन्हें प्राम: भूल्म मरमे बफना जूते बेंट कय ददमा कयते थे। उनके स्िबाि के कायण उनके भाता-वऩता उनसे अप्रसन्न यहते थे। कुछ सभम फाद उन्होंने ÜòãðÇðçð तथा उनकी ऩत्नी को अऩने घय से अरग कय ददमा। ÜòãðÇðçð ऩड़ोस भें ही अऩने मरए एक अरग झोऩड़ी फनाकय तत्ऩयता स ेअऩने व्मिसाम का काभ कयते थे औय शषे सभम ईश्िय-बजन तथा साध-ुसन्तों के सत्सॊग भें व्मतीत कयते थे।
उनके जीिन की छोटी-छोटी घटनाओॊ से सभम तथा िचन के ऩारन सम्फन्धी उनके गुणों का ऩता चरता है। एक फाय एक ऩिण के अिसय ऩय ऩड़ोस के रोग गॊगा-स्नान के मरए जा यहे थे। ÜòãðÇðçð के मशष्मों भें से एक ने उनसे बी चरने का आग्रह ककमा तो िे फोरे, गॊगा-स्नान के मरए भैं अिश्म चरता ककन्तु एक व्मजतत को जूते फनाकय आज ही देन ेका भैंने िचन दे यखा है। मदद भैं उसे आज जूते नहीॊ दे सका तो िचन बॊग होगा। गॊगा स्नान के मरए जाने ऩय भन महाॉ रगा यहेगा तो ऩुण्म कैसे प्राप्त होगा ? भन जो काभ कयने के मरए अन्त:कयण से तमैाय हो िही काभ कयना उचचत है। भन सही है तो इसे कठौते के जर भें ही गॊगास्नान का ऩुण्म प्राप्त
हो सकता है। कहा जाता है कक इस प्रकाय के व्मिहाय के फाद से ही कहाित प्रचमरत हो गमी कक - भन चॊगा तो कठौती भें गॊगा।
ÜòãðÇðçð ने ऊॉ च-नीच की बािना तथा ईश्िय-बजतत के नाभ ऩय ककमे जाने िारे वििाद को सायहीन तथा तनयथणक फतामा औय सफको ऩयस्ऩय मभरजुर कय पे्रभऩूिणक यहने का उऩदेश ददमा।
िे स्िमॊ भधयु तथा बजततऩूणण बजनों की यचना कयते थे औय उन्हें बाि-विबोय होकय सुनाते थे। उनका विश्िास था कक याभ, कृष्ण, कयीभ, याघि आदद सफ एक ही ऩयभेश्िय के विविध नाभ हैं। िेद, कुयान, ऩुयाण आदद ग्रन्थों भें एक ही ऩयभेश्िय का गुणगान ककमा गमा है।
उनका विश्िास था कक ईश्िय की बजतत के मरए सदाचाय, ऩयदहत-बािना तथा सद्वव्मिहाय का ऩारन कयना अत्मािश्मक है। अमबभान त्माग कय दसूयों के साथ व्मिहाय कयने औय विनम्रता तथा मशष्टता के गुणों का विकास कयने ऩय उन्होंने फहुत फर ददमा।
उनके विचायों का आशम मही है कक ईश्िय की बजतत फड़ े बाग्म से प्राप्त होती है। अमबभान शून्म यहकय काभ कयने िारा व्मजतत जीिन भें सपर यहता है जैसे कक विशारकाम हाथी शतकय के कणों को चनुने भें असभथण यहता है जफकक रघु शयीय की वऩऩीमरका (चीॊटी) इन कणों को सयरताऩूिणक चनु रेती है। इसी प्रकाय अमबभान तथा फड़प्ऩन का बाि त्माग कय विनम्रताऩूिणक आचयण कयने िारा भनुष्म ही ईश्िय का बतत हो सकता है।
ÜòãðÇðçð की िाणी बजतत की सच्ची बािना, सभाज के व्माऩक दहत की काभना तथा भानि प्रेभ से ओत-प्रोत होती थी। इसमरए उसका श्रोताओॊ के भन ऩय गहया प्रबाि ऩड़ता था। उनके बजनों तथा उऩदेशों से रोगों को ऐसी मशऺा मभरती थी जजससे उनकी शॊकाओॊ का सन्तोषजनक सभाधान हो जाता था औय रोग स्ित: उनके अनुमामी फन जाते थे।
उनकी िाणी का इतना व्माऩक प्रबाि ऩड़ा कक सभाज के सबी िगों के रोग उनके प्रतत श्रद्धारु फन गमे। कहा जाता है कक भीयाफाई उनकी बजतत-बािना से फहुत प्रबावित हुईं औय उनकी मशष्मा फन गमी थीॊ।
आज बी सन्त ÜòãðÇðçð के उऩदेश सभाज के कल्माण तथा उत्थान के मरए अत्मचधक भहत्िऩूणण हैं। उन्होंने अऩने आचयण तथा व्मिहाय से मह प्रभाणणत कय ददमा है कक भनुष्म अऩने जन्भ तथा व्मिसाम के आधाय ऩय भहान नहीॊ होता है। विचायों की शे्रष्ठता, सभाज के दहत की बािना से प्रेरयत कामण तथा सद्वव्मिहाय जैसे गुण ही भनुष्म को भहान फनाने भें सहामक होते हैं। इन्हीॊ गुणों के कायण सन्त यैदास को अऩने सभम के सभाज भें अत्मचधक सम्भान मभरा औय इसी कायण आज बी रोग इन्हें श्रद्धाऩूिणक स्भयण कयते हैं।
