Background
In 1997, outgoing UBC President David Strangway invited the Asia Pacific Economic
Co-operation (APEC) Leaders to meet to UBC. The meeting, which would take place on
November 25, 1997, was part of the APEC Summit taking place that same month in
Vancouver and would see the, often controversial, leaders of numerous nations,
including China, Indonesia and the US descend on UBC. A number of groups, many of
them student lead, criticized UBC's decision to host the event, and the months leading
up to the summit saw increasing action on the UBC campus against the coming APEC
summit. These actions, including those organized by the student-led APEC Alert, were
geared toward raising awareness of APEC among students, staff and faculty, and
encouraging political action and active resistance against APEC. Many of these groups
and protestors considered APEC to be undemocratic, complicit in the erosion of human
rights and in fostering a society of consumption, and promoters of environmental
destruction.
Following a series of peaceful demonstrations on the morning of November 25 1997,
protesters, including members of APEC Alert, and police began to clash in the
afternoon. At one of the roadblocks on N.W. Marine Drive (Gate 6), RCMP officers
moved into the crowd with pepper spray, an incident captured by a CBC News crew. A
number of protesters, including 48 students, were arrested.
A variety of legal actions were initiated in the days after the protests and arrests.
Serious charges were leveled at the RCMP for their handling of the event, and for their
alleged role in the suppression of free speech and other civil rights. Allegations of
political interference by the Prime Minister's Office (PMO) into the actions of the RCMP
were also made. An official inquiry into the events at UBC was launched by the RCMP's
Public Complaints Commission (PCC) on February 20, 1998, and formal hearings
commenced October 5, 1998. Following allegations of further political interference, the
hearings ended abruptly with the resignation of the Inquiry's Chief Commissioner,
Gerald Morin, on December 4, 1998. A second round of hearings under the direction of
Ted Hughes began on March 23, 1999, and concluded on June 30, 2000. The PCC's
interim report was released on July 31, 2001, and its final report appeared on March 25,
2002.
Scope and Content
The collection consists of exhibits, videotapes and documents collected for the PCC,
correspondence and legal documents related to both the PCC and related legal actions,
APEC Alert posters, information, pamphlets and ephemera, other material collected
and created by Oppenheim with regard to the events surrounding APEC and the RCMP
PCC, transcripts of the PCC proceedings, and a number of photographs.

The collection was acquired by the UBC Archives in separate donations by Jonathan
Oppenheim and Annette Muttray in 2008.
File/item list available.
In memory of Sheri Ash, who compiled, organized and looked after parts of this
collection from 1998 until her death. She was intimately involved with the legal team for
the students for the court challenges and for the RCMP Public Complaints
Commission's inquiry into APEC – without her, much of this collection would not have
survived to be donated to the University Archives.

November 22-24, 1997
A variety of non-violent arrests occur prior to the AELM.
November 25, 1997
AELM takes place at the UBC MOA; additional arrests occur and violence breaks
out.
December 8, 1997
BCCLA President Kay Stockholder files a complaint with the RCMP PCC and
becomes the first to call for public hearings into events at the APEC summit.
February 20 1998
Shirley Heafey, Chair of the RCMP PCC appoints a three-person panel (Gerald
Morin, Vina Starr, John Wright) to oversee the preliminary hearings into
complaints arising out of the APEC summit.
October 5, 1998
Formal hearings commence.
November 23, 1998
Following severe criticisms of political interference into the affairs of the PCC
panel, Solicitor General Andy Scott resigns and is replaced by Lawrence
MacAulay.
December 4, 10, 1998
PCC Commissioner Gerald Morin resigns, alleging additional political
interference. This is followed six days later by the resignations of Vina Starr and
John Wright.
December 21, 1998
Shirley Heafey, Chair of the RCMP PCC appoints Ted Hughes as sole
commissioner to oversee a new (second) round of hearings.
March 23, 1999
Formal hearings commence for a second time.
June 30, 2000
Formal hearings end.
July 31, 2001
The PCC's interim report ("The Hughes Report") is released.
March 25, 2002
The PCC's final report is released.

In 1997, Jonathan Oppenheim was a graduate student in the Physics Department at the
University of British Columbia and a member of APEC Alert, a grassroots group
formed at UBC of students, former students, faculty, staff and others who were
opposed to APEC (the Asia Pacific Economic Summit) on the UBC campus and to the
entire APEC agenda. Oppenheim was involved in organizing and carrying out APEC
Alert's three phases of resistance to APEC. “Refuse APEC” ran to November 17.
“Summit Under Siege” began November 17 with the erection of a tent city on the lawn
to the west of the SUB. “Crash the Summit,” began November 25, the day that UBC
would welcome APEC. In the early afternoon of November 25th, protesters and police
began to clash in the afternoon. Among the various actions taking place on the UBC
campus that day, protesters, including Jonathan Oppenheim, broke through a police
barricade at Gate 3 near the School of Theology. He was subsequently arrested.
Jonathan Oppenheim was party to the legal actions launched in the days and weeks
following the APEC Leader's meeting at UBC alleging that he had been wrongfully
arrested and that unnecessary force was used by police during his arrest. Oppenheim
chose to represent himself at the PCC hearings and was a vocal critic of the process
insisting that it could have no lasting effect due to its inability to call then Prime
Minister Jean Chretien to account for decisions made in and around the protests at
UBC. In the end, frustrated by what he saw as the corruption of process, Oppenheim
“resigned” from the PCC proceedings on February 25, 2000.
The sub-collection consists of exhibits, videotapes, photographs and documents
collected for the PCC, correspondence and legal documents related to both the PCC and
related legal actions, APEC Alert posters, information, pamphlets and ephemera, and
other material collected and created by Oppenheim with regard to the events

and civilian witnesses for exhibit during the RCMP Public Complaints
Commission. The exhibits consist of correspondence, witness statements, police
statements, photographs and videotapes and other materials considered
pertinent for inclusion in the PCC. The series also includes the Commission's
Interim Report published in July 2001. The exhibits are arranged in alpha-
numeric order where applicable and then by creating agency or individual.

Legal Documents for APEC PCC and related Federal Court Litigation series. –
1998-2000.

The series consists of submissions by counsel representing a variety of
individuals and organizations including the Attorney General of Canada, the
Vancouver Police Department, the RCMP and various civilian participants in the
RCMP PCC. It includes Affidavits, Books of Authority, Motion Records,
Arguments, and Submissions.
RCMP PCC / Federal Trial Correspondence series. – 1997-2000.

The series consists of correspondence regarding the RCMP PCC and related legal
action that took place around the PCC. It consists primarily of correspondence to
Jonathan Oppenheim, but includes correspondence written by Oppenheim and
other civilian participants in the RCMP PCC. It includes Oppenheim's
“resignation letter” to PCC Commissioner Ted Hughes.
The majority of the correspondence is arranged in rough chronological order.
APEC Alert and Jonathan Oppenheim Documents series. – 1997-2000.

The series consists of materials created and disseminated by APEC Alert both
before the APEC summit and in its aftermath and materials collected and created
by Jonathan Oppenheim. It consists of posters, pamphlets, and ephemera
produced by APEC Alert, information about APEC and the leaders of the APEC
countries, News Releases about the PCC and a letter written to UBC faculty. In
addition, it includes documents composed by Oppenheim and other APEC Alert
members in their attempts to subpoena then Prime Minister Jean Chretien to
appear at the RCMP PCC.
General APEC Documents and Correspondence. – 1997-2001.

The series consists of various documents related to the APEC PCC. It includes a
variety of APEC related correspondence, exhibits, submissions and notes much
of it related to both the perceived lack of cooperation of the Prime Minister's
Office in providing access to necessary documents or access to the Prime
Minister himself as well as including Procter's note which led to Andy Scott's
resignation and the end of the first phase of the RCMP PCC.
Videotapes. – 1997-1999.

The series consists of videotaped exhibits compiled for the APEC PCC and other
amateur and news video of actions at UBC and in Downtown Vancouver with
regard to APEC. The videos include helicopter and nightvision footage of
downtown and UBC, news coverage of APEC and the protests at UBC, and
RCMP video footage of the event at UBC.

Annette Muttray Sub-Collection. – 1997-2001.
1.66 m of textual records.
In 1997, Annette Muttray was a graduate student in the Biology Department at the
University of British Columbia. Muttray was a vocal opponent to what she viewed as
UBC's preoccupation with money before education and was involved in various actions
on campus directed at showing discontent with this preoccupation. On November 25,
1997, during the clash at UBC between RCMP, Vancouver Police and student and other
protesters, Muttray was arrested while searching for fellow protester and friend Jamie
Doucette who had, himself, been arrested some time earlier. Muttray was taken to the
Richmond Police Detention Facility alongside many other APEC protesters, and, like
the other female protestors, subjected to a strip search by police. Muttray, like many of
the other student complainants at the APEC PCC, was a vocal critic of the process
insisting that it could have no real effect as long as the respondents (in this case, the
RCMP among other government ministries) were responsible for vetting their own
documents and evidence. In the end, Muttray's allegations that her arrest had been
inappropriate, and that her bicycle and backpack had been left unattended by police
were rejected by the PCC Commissioner. In addition, while the strip search of female
prisoners was, in general, deemed inappropriate by the Commissioner, he agreed that
Muttray had been legally and rightfully arrested and that her strip search was,
therefore, not unlawful.
The sub-collection consists of exhibits collected for the PCC and transcripts of the
RCMP PCC Hearing from August 1999 to June 2000.
