Hi Anthony.
I refer to DA2015.342.1 and the proposal to reduce the FFL of the dwellings to 2.7 AHD in lieu of 3.0 AHD as required
by Condition 9.
The proposed FFL of 2.7 AHD will position the dwellings above predicted climate change levels and 1 in 100 year
flood levels.
The FFL does not provide for freeboard, however, verbal advice received from the Department of Water is that the
nominated minimum FFL is very conservative and that the likelihood of flooding including freeboard is very low.
It should also be noted that the majority of the dwellings in the estate have an FFL of 2.7. If this development were
raised to an FFL of 3.0 AHD the development would be out of keeping with the established streetscape and appear
overbearing and obtrusive. In addition to the above it is considered a level of 3.0 AHD would give
rise to a loss of privacy for the adjoining properties which have existing dwellings with an FFL
of 2.7. Please refer to the attached survey. The survey shows that Lot 502 has an existing fence
to a height of 4.39 AHD and Lot 501 has an existing dividing fence to a height of 4.46 AHD. If
the development on Lot 517 incorporated dwellings to an FFL of 3.0 AHD the dividing fences
on these sites would only have a height of 1.46 metres above the proposed dwelling FFL. It is
considered this would give rise to a loss of privacy or a perceived loss of privacy in relation to
Lot 502 in particular as its outdoor living area is adjacent to the subject site.
Given that the proposed FFL of 2.7 AHD is in keeping with established FFL’s of surrounding dwellings and that
nominated floodplain levels are conservative it is considered the proposed 2.7AHD FFL is acceptable.
