7. PORTERAGE: Escorted TOURSPorterage is included at hotels ONLY on ESCORTED TOURS, and

includes handling of one normal-sized suitcase per person.Wheeled carry-on cases are considered a normal piece of luggage.Additional baggage willincur a charge of $5 per piece per service to be paid locally.

8. FORUM SELECTION CLAUSEAll vacations are subject to the terms and conditions

shown on the Apple Vacations Fair Trade Contract andyour booking of the vacation is acceptance of the termsin this contract. The Forum for resolution of disputeswith this contract or with Apple Vacations is and shallbe the States of Illinois and Pennsylvania and any actionagainst Apple Vacations must be brought only thosestates and in accordance with those states’ laws, rulesand procedures.

WHAT WE PROVIDE IN RETURN

1. PRICE GUARANTEEOur intention is to provide you with the vacation which you have

selected,at the price in effect at time of booking. If for any reason we have to increase the price of your vacation, including an error made incomputing your price, we will offer you the option of cancellation withoutcharge, provided that you advise us within seven days of your receipt of notice of the increase.This does not apply to price increases resulting froma change in U.S. or foreign government taxes or fuel surcharges.

If a scheduled airline initiates a schedule change which results in a fareincrease,the passenger is responsible for the additional cost.

2. FLIGHT INFORMATIONYour travel agent will be able to confirm the latest flight details at the

time you make your reservation, and these will also appear on thebooking confirmation we issue when we receive your deposit.

Your flight tickets, which we dispatch two to five weeks prior todeparture (except for late bookings) , will contain your flight information.All times are subject to change. Apple Vacations assumes no responsibility for any passengers making independent connections to our flights.

3. AMENDMENTS & CANCELLATIONSpecial features offered by hotels are subject to change at the hotel's

discretion. In the unlikely event that a major change involving a pre-departure change of hotel, departure or return date,departure city or destination becomes necessary, we will notify you as soon as possible.If you find the revised arrangements we offerunacceptable, you will have the option of cancellation without charge(less any insurance premium) provided that you notify uswithin seven days of your receipt of notice of the change(or prior to departure date if notified less than sevendays prior).

In the event of a change, we will try to substitute comparable services,but in the event of complete cancellation by us or a supplier, our only liability will be to provide a refund in the form of an Apple Vacationscredit.

4. REFUNDSAny refunds due to you will be made as soon as possible. Please note,

however, that no refunds will be made for any services provided in theitinerary that you do not use.

Insurance premiums are non-refundable andnon-transferable. Refunds (if applicable) for scheduled air programsmust be issued upon the return of the unused ticket. Apple Vacationsaccepts bookings only through travel agents and allcommunications prior to your departure, including payment and refund

transactions, must be via your travel agent.If for any reason you should lose your scheduled

airline ticket, you will have to purchase a new ticket atyour own expense and upon your return home, you must contactyour travel agent to begin refund procedures by completing a “Lost TicketApplication” (fees may apply) . Any refunds made by the airline will bebased on the value of the original ticket issued less any airlineprocessing fees . In most cases the replacement ticket you have topurchase will be more expensive.

5. OUR RESPONSIBILITY TO YOUApple Vacations and it s supplier, Kuoni Travel and Central Holidays,

have made arrangements with airlines, hotels and other independentsuppliers to provide you with the services you purchase. We have takenall reasonable steps to ensure that proper arrangements have been madefor your vacation. However, we do not accept and expressly disclaim any liability for the actions or omissions of theseindependent suppliers, over whom we have no directcontrol. If you find you have any dispute with such persons, however, wewill give you as much reasonable help as we can in resolving this.

Please understand that we cannot control and will not be responsiblefor such factors as weather,government actions, terrorism, mechanicalbreakdowns, your physical, medical or mental disabilities, your failure toobtain valid travel documents or your failure to follow travel instructions.

Apple Vacations is not responsible for losses or damagesarising from bodily or emotional injury, property or othereconomic damage caused by factors beyond our control.Apple Vacations is not responsible for bodily, emotional or consequdamages or monetary losses due to flight delays,air line turbulence

transportation accidents or other unforeseen circumstances.All prices and features described herein (as well as in

Apple’s print advertisements and website) are subject tochange without notice. Some hotel room photographs donot depict the standard room category.

If any term or provision of this Fair Trade Contract is held invaotherwise unenforceable, the enforceability of the remaining termsprovisions will not be impaired thereby.

6. TOUR RESTRICTIONSOn Escorted Tours to Italy, we do not accept children under 8 y

of age, because we have found that they are too young to enjoy touOn Cruise Packages and Independent Tours there is no age limit. Larrangements for infants under 2 years are free of charge, providinparents pay directly to hotels for food, crib, etc. Disabled participarequire special assistance must be accompanied by a qualified helpassumes total responsibility for the disabled participant's well-beinFurthermore, most transportation services (including motor coachnot equipped with wheelchair ramps and for safety reasons, passenrequiring wheelchairs cannot be transported on Escorted Tours, RivCruises, or Sea Cruises.

We reserve the right to accept or reject any person as a tour participant and to expel from the tour any participant whose condudeemed incompatible with the interests of the tour group. Any incexpenses will be charged to the expelled tour participants.

7. SIGHTSEEING & ITINERARIESSightseeing is included in the itinerary and is under the directio

of licensed local guides where required. Entrance fees to all placesare included where indicated. During holidays, some sights such asmuseums may be closed or unavailable for visits.We reserve the rigvary the sequence of sightseeing and/or to re-route the order of citishould circumstances demand it. Should this occur, the itinerary cowill be maintained,however, the order may change.
