• The applicant requests a Conditional Use Permit for an Automobile Repair Garage in order to develop the site
with a two-bay oil-change facility. Services proposed include oil changes, tire service, engine repair and transmission work. No body work will be performed on the site. All repairs will take place within the proposed building.
• The proposed 1,675 square-foot building will feature exterior building finishes of a brick water table, an asphalt
shingle roof, and metal awnings over the main entrance.
• The Landscape Plan depicts existing trees along the street with proposed enhancements that include trees, shrubs and seasonal plants, which will assist in screening the parking lot and bay doors from the right-of-way.
• The hours of operation are planned as 8:00 a.m. to 7:30 p.m., Monday through Friday, 8:00 a.m. to 6:00 p.m., on
Saturdays, and 10:00 a.m. to 5:00 p.m., on Sundays. It is anticipated that up to six employees will be on the site at any given time.

The long-term vision for the Lynnhaven SGA calls for series of mixed-use and flexible developments. Design principles include enabling flexible development sites and building types to respond to ever-changing market needs and development programs, uses that are compatible with AICUZ restrictions and building on the existing good balance between homes, jobs, and services.

This site is located in the Chesapeake Bay watershed. There are no significant natural or cultural resources associated with the site as it was formerly developed with a restaurant and parking lot and is predominately impervious.

Water Both sites currently connect to City water. There are existing 16-inch, 20-inch and 36-inch City water mains along Virginia Beach Boulevard. There are existing eight-inch and 20-inch City water mains along North Lynnhaven Road. Sewer Both sites currently connect to City sewer. There is an existing 24-inch HRSD sanitary sewer force main along Virginia Beach Boulevard. There is an existing 12-inch City gravity sanitary sewer main along North Lynnhaven Road. There is an existing 10-inch City sewer force main along North Lynnhaven Road.
This proposal to redevelop the subject site with an Automobile Repair Garage is, in Staff’s opinion, acceptable. The building is designed with finishes that complement the surrounding area. This coupled with elements depicted on the attractive Landscape Plan reflect an investment in our community. While the Lynnhaven Strategic Growth Area Master Plan calls for long-term redevelopment of the site with mixed-use non-residential uses, the proposed use is compatible with the existing auto-oriented and service uses along this stretch of Virginia Beach Boulevard. As such, the proposed use is acceptable until the market creates a transition of this area to the long-term vision established in the Lynnhaven Strategic Growth Area Plan. Public Utilities Staff has noted that water and sanitary sewer service must be verified and improved if necessary so that the proposed development will have adequate water pressure, fire protection and sanitary sewer service. A more detailed review of the utilities and other details of the project will be done during final site plan review. Based on the considerations above, Staff finds the application to be an acceptable use and recommends approval of the request subject to the conditions below.

1. With the exception of any modifications required by any of these conditions, the site shall be developed and
maintained substantially in conformance with the submitted site layout entitled “Site Plan” dated 03/20/17, and prepared by Ceso. Said plan has been exhibited to the Virginia Beach City Council and is on file with the Planning Department.
2. The Landscape Plan shall be developed and maintained substantially in conformance with the submitted layout
entitled “Site Landscape Plan” on page 8 of this report.
3. The design, size and materials of the building shall be substantially in adherence, with the submitted elevation exhibits entitled “Valvoline Instant Oil Change Two Bay Right Hand Prototype Design (Exterior Elevations – Left Elevation, Right Elevation, Front Elevation, and Rear Elevation)” prepared by Ceso. Said elevations have been exhibited to the Virginia Beach City Council and are on file with the Planning Department.
4. As depicted on the site layout referenced in Conditions 1, a one-foot no ingress/egress easement shall be
recorded along the property line at Virginia Beach Boulevard and North Lynnhaven Road west of the proposed entrance along Virginia Beach Boulevard to limit additional ingress/egress on Virginia Beach Boulevard and North Lynnhaven Road.
5. The freestanding sign shall be monument style with a brick base that matches the building, and shall be no taller
than eight feet as measured from the ground to the top of the sign.
6. Any onsite signage shall meet the requirements of the City Zoning Ordinance, and there shall be no neon, other than individual channel letters lighted with internal neon and as approved by the Zoning Administrator, or electronic display signs or accents, installed on any wall area of the exterior of the building, in or on the windows, or on the doors. There shall be no window signage permitted. The building signage shall not be a “box sign” and the proposed sign package shall be submitted to the Zoning Administrator for review and acceptance prior to the issuance of a sign permit.
7. All vehicle repairs shall take place inside the building.
8. No outside storage of equipment, parts, or materials shall be permitted.
9. There shall be no outside storage or display of tires.
10. No outside storage of vehicles in a state of obvious disrepair shall be permitted. If vehicles in this condition
require storage, then such vehicles shall be stored within the building.
11. There shall be no storage containers outside the building or in parking spaces.
12. The dumpster shall be enclosed with a either a solid fence or a wall constructed of brick that matches the building, not less than six-feet in height, and any required screening shall be installed in accordance with Section 245(e) of the Zoning Ordinance and the City of Virginia Beach Landscaping Guide.
13. There shall be no decorative pennants, feather flags, streamers, air dancers, inflatables or other similar advertising items located on the site.
Further conditions may be required during the administration of applicable City Ordinances and Standards. Any site plan submitted with this application may require revision during detailed site plan review to meet all applicable City Codes and Standards. All

applicable permits required by the City Code, including those administered by the Department of Planning / Development Services Center and Department of Planning / Permits and Inspections Division, and the issuance of a Certificate of Occupancy, are required before any uses allowed by this Use Permit are valid. The applicant is encouraged to contact and work with the Crime Prevention Office within the Police Department for crime prevention techniques and Crime Prevention Through Environmental Design (CPTED) concepts and strategies as they pertain to this site.
