GENERAL INFORMATION

The APVMA (Australian Pesticides and Veterinary Medicines Authority) Gazette is published fortnightly and contains details of

the registration of agricultural and veterinary chemicals products and other approvals granted by the APVMA, notices as requi red

by the Agricultural and Veterinary Chemicals Code (the Agvet Code) and related legislation and a range of regulatory material

issued by the APVMA.

Pursuant to section 53(1) of the Agvet Code, the APVMA has decided that it is unnecessary to publish details of applications

made for the purpose of notifying minor variations to registration details. The APVMA will however report notifications activity in

quarterly statistical reports.

and as an aid in the reduction of lymphoid depletion caused by PCV2 and in the

Side effects: Local tissue reactions in the form of swelling at the injection site may occur and

could last for up to 26 days. The area of local reaction is generally less than 5 cm in

diameter, but in some cases a larger swelling may occur. Vomiting may occur during

the first hour after vaccination, but no consequential negative effects are observed.

Anaphylactic reactions are uncommon. In case of such reactions, appropriate

treatment is recommended. If left untreated, anaphylactic reactions might be lethal.

The APVMA has assessed the chemistry and manufacturing aspects of Inactivated Porcine Circovirus Type 1-Type 2

Chimera and the product, including starting materials, master seed organisms (source, identity, and purity), culture

media, vaccine production, quality control, shelf life and batch release analysis, has been assessed and found to meet

APVMA standard.

The APVMA is satisfied that the proposed use of Inactivated Porcine Circovirus Type 1-Type 2 Chimera in the product,

as an aid in the prevention of Porcine Circovirus Type 2 (PCV2) viraemia, as an aid in the prevention of nasal and faecal

shedding, as an aid in the reduction of colonisation, and as an aid in the reduction of lymphoid depletion caused by

PCV2 and in the control of PCV-associated disease, would not be likely to have an effect that is harmful to human

beings, environment or trade. The adjuvant and the excipients used in the product have been previously assessed and

found to be safe. They are already present in vaccines registered for use in Australia.

In relation to its assessment of efficacy and safety in target animal, the APVMA is satisfied that the data supporting the

efficacy and safety of the product, adequately demonstrate that this product is likely to be safe and effective under

Australian conditions when used as directed according to label instructions.

MAKING A SUBMISSION

In accordance with sections 12 and 13 of the Agvet Code, the APVMA invites any person to submit a relevant written

submission as to whether the APVMA should grant the application for approval of the active constituent Inactivated

Porcine Circovirus Type 1-Type 2 Chimera and registration of the product.

Submissions should state the grounds on which they are based. Such grounds should relate only to matters outlined

above that the APVMA is required to take into account in deciding whether to grant the application.

In accordance with sections 12 of the Agvet Code, the APVMA invites any person to submit a relevant written submission

as to whether the application for approval of Inactivated Porcine Circovirus Type 1-Type 2 Chimera should be granted.

Submissions should relate only to matters that the APVMA is required by legislation to consider in deciding whether to

grant the approval. These grounds include chemistry and manufacture, and toxicity. Submissions should state the

grounds on which they are based. Comments received outside these grounds cannot be considered by the APVMA.

REASONS

2,4-D is a systemic herbicide used post emergence for the control of broadleaf and grass weeds. The APVMA

commenced a review in relation to the impact of 2,4-D high volatile esters (HVE) on the environment (including

impacts on waterways, non-target animals and plants) in 2003. Following the completion of that aspect of the

review, the APVMA formed the view that, on the presently available information, and having regard to the matters

referred to in s.14(4) and s.14(5) of the Agvet Codes, the continued use of, or any other dealing with, the active

constituents in Table 1and the products in Table 2, in accordance with their instructions for use of for such

dealings, may be likely to have an unintended effect that is harmful to animals, plants or things or to the

environment, for the purposes of s.41(1)(c) of the Agvet Codes. The cancellation action detailed in this notice

was undertaken for that reason.

INSTRUCTIONS FOR SUPPLY AND USE OF CANCELLED ACTIVE CONSTITUENTS AND

PRODUCTS

Under s.55(2)(e) of the Agvet Codes, the APVMA has determined the following instructions for the purposes of

this notice:

Import or Manufacture of Cancelled Active Constituents

After 21 August 2013 import or manufacture of any active constituent listed in Table 1 of this notice is not

permitted without written consent of the APVMA.

Import or Manufacture of Cancelled Products

After 21 August 2013 import or manufacture of any product listed in Table 2 of this notice is not permitted without

written consent of the APVMA.

Supply of Cancelled Active Constituents

After 21 August 2013 the supply of any active constituent listed in Table 1 of this notice is not permitted.

Supply of Cancelled Products

After 21 August 2013 supply of the products listed in Table 2 of this notice may only occur until 31 August 2013

as described in APVMA permit PER14329.

After 31 August 2013 supply of any product listed in Table 2 of this notice will constitute an offence under eligible

laws of this jurisdiction.

Use of Cancelled Products

After 21 August 2013 use of the products listed in Table 2 of this notice may only occur in accordance with the

instructions contained in this Notice or in accordance with those contained in APVMA permit PER14329.

After 31 August 2014 use of any product listed in Table 2 of this notice will constitute an offence under eligible

laws of this jurisdiction.

INSTRUCTIONS FOR USE OF A 2,4-D HVE PRODUCT UNDER PER14329

READ THESE INSTRUCTIONS before using or otherwise handling the 2,4-D HVE products.

NOTE AND APPLY THE FOLLOWING RESTRAINTS:

The 2,4-D HVE products are PHENOXY HERBICIDES that can cause severe damage to native vegetation and

susceptible crops such as cotton, grapes, tomatoes, oilseed crops and ornamentals.

Use of the 2,4-D HVE products is only permitted between 21 August 2013 and 31 August 2013 and

between 1 May 2014 and 31 August 2014 (inclusive).

DO NOT use the 2,4-D HVE products between 1 September 2013 and 30 April 2014.

DO NOT use the 2,4-D HVE products after 31 August 2014.

DO NOT apply the 2,4-D HVE products by air.

DO NOT apply the 2,4-D HVE products:

in aquatic situations, or

to sugar cane, or

to rights of way, or

as a harvest aid/salvage spray.

DO NOT apply more than 800 g ae/ha (1L of this product per ha) (ae=acid equivalent)

DO NOT apply if crop or weeds are stressed due to dry or excessively moist conditions.

DO NOT use unless wind speed is more than 3 kilometres per hour and less than 15 kilometres per hour as

measured at the application site.

DO NOT apply with spray nozzles smaller than ‘Coarse’ spray droplets according to the ASAE S572 definition for

standard nozzles.

DO NOT apply if rain is likely to occur within 6 hours after the use.

DO NOT apply within a buffer zone of 100 m between field edges and downwind water bodies, native vegetation

and sensitive crops.

used the product, including:

a) name and residential address of each person who used the chemical product, and

b) name and residential address of each person notified of the use of the product (if required

under State/Territory law).

7 Records about the use of a 2,4-D HVE product must include detailed information about the reasons for use

of the product, including:

a) name of the crop or use situation, and

b) name of the weeds treated and their stage of growth.

8 Records about the use of a 2,4-D HVE product must include detailed information about the weather

conditions at the application site during the time of use, including:

a) a general description of the weather throughout the period of use, and

b) estimates or accurate measurements of the temperature during the period that the products

was used (including temperatures at the start and end of the use), and

c) an estimate or accurate measurement of the relative humidity during the period that the product

was used (including the relative humidity at the start and end of the use), and

d) an estimate or accurate measurement of the wind speeds and directions during the period that

the product was used (including the wind speeds and directions at the start and end of the

use).

9 Records about the use of a 2,4-D HVE product must include detailed information about the type and rate of

application of the product, including:

a) the sprayer pressures used, and

b) the type of equipment and size of spray nozzles used, and

c) the speeds of ground application equipment, and

d) the amount of the product applied per hectare, and

e) whether the product was applied as a mixture of other products, and if so the names of the

mixed products and their application rates, and

f) the name of any additives or diluents applied with the product.

10 Records made about the use of a 2,4-D HVE product must be retained for 2 years from the date of use.

11 Records made about the use of a 2,4-D HVE product must be provided to the APVMA or State/Territory

government officers within 48 hours of request.

WARNING

Under s.55(4) of the Agvet Codes, from the date of this notice it is an offence to possess or have custody with the

intent to supply, or to otherwise deal with any 2,4-D isobutyl ester active constituent listed in Table 1 of this notice

or any product listed in Table 2 of this notice otherwise than in accordance with the instructions contained in this

notice or permit PER14329.

After 31 August 2013 supply of any product listed in Table 2 of this notice will constitute an offence under eligible

laws of this jurisdiction.

After 31 August 2014 use of any product listed in Table 2 of this notice will constitute an offence under eligible

laws of this jurisdiction.

The maximum penalty that might apply for a breach of s 55(4) is $51,000 for an individual and $255,000 for a

company.

DECLARATIONS FOR THE PURPOSES OF S.45A(5)(C) AND S.55(3)(C) OF THE AGVET CODES

For the purposes of s.45A(5)(c) and s.55(3)(c) of the Agvet Codes, respectively, s.45A(5) and s.55(3) cease to

apply in respect of the active constituents listed in Table 1 of this notice and the products listed in Table 2 of this

notice.

The effect of these declarations is that, from the date of publication of this notice, the chemical products listed in

Table 2 of this notice may only be supplied or used in accordance with APVMA permit PER14329.

The following instructions set out how a person can deal with any product bearing a cancelled label approval.

SUPPLY

A person may supply or cause to be supplied product bearing a cancelled label manufactured prior to 8 August 2013 at

wholesale and retail level, until 8 August 2015.

After 8 August 2015 it will be an offence against the Agvet Codes to have possession or custody of a product bearing a

cancelled label with the intention to supply.

USE

A person may continue to use the product according to its cancelled label instructions until 8 August 2015.

Any person who possesses, has custody of, uses, or otherwise deals with the product bearing a cancelled label in

accordance with the above instructions is taken to have been issued with a permit under the Agvet Codes to so possess,

have custody of, use or otherwise deal with the product after the labels have been cancelled until 8 August 2015.

The supply and use of the product bearing a cancelled label must be in accordance with the label instructions, including

any conditions relating to the shelf life or expiry date. It is an offence to possess, have custody of, use, or deal with the

product listed in the table in a manner that contravenes the above instructions.

EXMEPTION FOR THE PURPOSES OF SECTION 75 AND SECTION 78

The Australian Pesticides and Veterinary Medicines Authority (APVMA) has determined, as provided for under sections

75(1)(b) and 78(1)(b) of the Schedule to the Agricultural and Veterinary Chemical Code Act 1994 (the Agvet Code), that

the products listed below are exempt from the operation of section 75 and section 78 of the Agvet Code.

Products subject to this exemption

1. Velvet Pure Canine Capsules.

2. Velvet Pure Healthy Natural Treats.

3. Velvet Pure Equine Powder.

This exemption is granted for the period of 18 July 2013 to 18 October 2014 inclusive.

While in force this exemption means that while the products are veterinary chemicals, as defined by section 5 of the

Agvet Code, and unregistered, it is not an offence to possess them for the purposes of supply or to supply them.

This exemption can be cancelled or amended at any time by the APVMA.

Exemption from Offence Provisions

EXMEPTION FOR THE PURPOSES OF SECTION 75 AND SECTION 78

The Australian Pesticides and Veterinary Medicines Authority (APVMA) has determined, as provided for under sections

75(1)(b) and 78(1)(b) of the Schedule to the Agricultural and Veterinary Chemical Code Act 1994 (the Agvet Code), that

the products listed below are exempt from the operation of section 75 and section 78 of the Agvet Code.

Products subject to this exemption

1. Zagrosol AD3E (oral solution).

2. Amilyte (water soluble powder).

3. Nilstress (water soluble powder).

4. Zagrosol Minpro (oral solution).

5. Zagrosol Aminogen (oral solution).

6. Calpozag (oral solution).

This exemption is granted for the period of 23 August 2013 to 23 August 2014 inclusive.

While in force this exemption means that while the products are veterinary chemicals, as defined by section 5 of the

Agvet Code, and unregistered, it is not an offence to possess them for the purposes of supply or to supply them.

This exemption can be cancelled or amended at any time by the APVMA.
