VETERINARY CHEMICALS

The Agricultural and Veterinary Chemical Code Act 1994 (the Act) commenced on 15 March 1995.

The Agricultural and Veterinary Chemicals Code (the Agvet Code) scheduled to the Act requires notices to be

published in the Gazette containing details of the registration of agricultural and veterinary chemical products

and other approvals granted by the Australian Pesticides and Veterinary Medicines Authority. The Agvet Code

and related legislation also requires certain other notices to be published in the Gazette. A reference to Agvet

Codes in this publication is a reference to the Agvet Code in each state and territory jurisdiction.

GENERAL INFORMATION

The APVMA (Australian Pesticides and Veterinary Medicines Authority) Gazette is published fortnightly and contains details of

the registration of agricultural and veterinary chemicals products and other approvals granted by the APVMA, notices as requi red

by the Agricultural and Veterinary Chemicals Code (the Agvet Code) and related legislation and a range of regulatory material

issued by the APVMA.

Pursuant to section 8J(1) of the Agvet Code, the APVMA has decided that it is unnecessary to publish details of applications

made for the purpose of notifying minor variations to registration details. The APVMA will however report notifications activity in

quarterly statistical reports.

Agricultural and Veterinary Chemicals Code Act 1994 Section 47C Notice—End of Registrations of Chemical Products


This notice is published under section 47C of the Agricultural and Veterinary Chemicals Code scheduled to the

Agricultural and Veterinary Chemicals Code Act 1994 (Agvet Code). The APVMA provides notice that:

1. The registration of the products listed in this notice were not renewed for the financial year 2015– 2016 (the

Product(s)).

2. The registrations for the Product(s) ended on 30 June 2015.

INSTRUCTIONS FOR DEALING WITH THE CHEMICAL PRODUCTS

The APVMA issues the following instructions for the possession, custody, supply and use of existing stocks of the

Product(s) listed in this notice and which were manufactured in, or imported into, Australia before 30 June 2015:

1. The label attached to the container of the product must be identical (except for particulars relating to the batch

number, date of manufacture or expiry date of the product) to an approved label for that product that was in force

on 30 June 2015; and

2. The products are to be used in accordance with the instructions on the approved label for that product.

Note: The label(s) for these products in force on 30 June 2015 continue in force while these instructions apply to the

product.

INSTRUCTIONS FOR POSSESSION, HAVING CUSTODY OF, USING OR OTHERWISE DEALING WITH THE

PRODUCTS

If after publication of this notice a person, possesses, has custody of, uses or otherwise deals with the Product(s) in

accordance with the instructions in this notice, the person is taken to have been issued with a permit to possess, have

custody of, use or otherwise deal with the Product(s) in accordance with those instructions until:

(a) 1 year after the day on which the registration ended (being 1 July 2015); or

(b) The APVMA, by notice published in the Gazette, declares that this subsection does not apply in respect of the

Product(s);

whichever first occurs.

LATE APPLICATIONS FOR RENEWAL OF REGISTRATION

A late application for renewal of registration for products whose registration has lapsed as at 30 June 2015 will only be

accepted up until 15 December 2015.

Products whose registration lapsed before 30 June 2015 and late applications for products whose registration lapsed as

at 30 June 2015 that are received after 15 December 2015 will need to submit a new application for product registration.

FAILURE TO COMPLY WITH NOTICE

All products listed in this notice are now subject to APVMA Compliance. Where instances of possession, custody of, use

or otherwise dealing with the Product(s) with the intention of supply, or to supply the Product(s) outside the scope of the

notice are identified, regulatory action will be considered.



It is an offence under the Agvet Code for a person to supply, or cause or permit to be supplied or possess for supply, any

Product(s) listed in this notice after 30 June 2015 other than in accordance with this notice. It will be an offence to supply

the Product(s) or to possess or have custody of the Product(s) with the intent of supplying it after 30 June 2015 or an

earlier date notified by the APVMA by notice in the gazette.

The following instructions set out how a person can deal with the cancelled products.

SUPPLY

A person may supply or cause to be supplied products manufactured prior to 18 November 2015 at wholesale and retail

level, until the 18 November 2016.

After 18 November 2016 it will be an offence against the Agvet Codes to have possession or custody of the products with

the intention to supply, or to supply the products.

USE

A person may continue to use the products according to label instructions until 18 November 2016.

Any person who possesses, has custody of, uses, or otherwise deals with the listed products in accordance with the

above instructions is taken to have been issued with a permit under the Agvet Codes to so possess, have custody of,

use or otherwise deal with the products after the registration has been cancelled until 18 November 2016.

The supply and use of the products must be in accordance with the conditions of registration or approval, including any

conditions relating to the shelf life or expiry date.

It is an offence to possess, have custody of, use, or deal with the products listed in the table in a manner that

contravenes the above instructions.

New Active Constituent Metaflumizone


The Australian Pesticides and Veterinary Medicines Authority (APVMA) has before it an application for approval of a new

active constituent, metaflumizone.

SUMMARY OF THE APVMA’S EVALUATION OF METAFLUMIZONE ACTIVE CONSTITUENT

The APVMA has evaluated the chemistry aspects of metaflumizone active constituent (manufacturing process, quality

control procedures, batch analysis results and analytical methods) and found them to be acceptable.

On the basis of the data provided, and the toxicological assessment, it is proposed that the following APVMA Active

Constituent Standard be established for metaflumizone active constituent:

Other compounds of toxicological significance are not expected to occur in metaflumizone active constituent.

The Office of Chemical Safety (OCS) has completed a toxicological evaluation of metaflumizone.

No Acceptable Daily Intake (ADI) or Acute Reference Dose (ARfD) for metaflumizone is required since the proposed

product SIESTA GRANULAR ANT BAIT containing metaflumizone is not for use in food-producing situations.

On 27 March 2015, the Delegate to the Secretary of the Department of Health published a final scheduling decision to

confirm the current Schedule 5 entry for metaflumizone in the Standard for the Uniform Scheduling of Medicines and

Poisons (SUSMP) with no exemption cut-off.

The OCS has indicated that there are no objections on toxicological grounds to the approval of the active constituent

metaflumizone.

The APVMA accepts the findings and recommendations of its advisers on these criteria.

The APVMA is satisfied that the proposed importation and use of metaflumizone would not be an undue toxicological

hazard to the safety of people exposed to it during its handling and use.

MAKING A SUBMISSION

In accordance with section 12 of the Agvet Code, the APVMA invites any person to submit a relevant written submission

as to whether metaflumizone should be approved. Submissions should relate only to matters that are considered in

determining whether the safety criteria set out in section 5A of the Agvet Code have been met. Submissions should state

the grounds on which they are based.

Siesta Granular Ant Bait containing Metaflumizone


The Australian Pesticides and Veterinary Medicines Authority (APVMA) has before it applications for registration of a

new product containing a new active constituent, metaflumizone. The product is SIESTA GRANULAR ANT BAIT.

SUMMARY OF THE APVMA’S EVALUATION OF SIESTA GRANULAR ANT BAIT IN ACCORDANCE WITH THE

REQUIREMENTS OF SECTION 14(1)(C) OF THE AGRICULTURAL AND VETERINARY CHEMICALS CODE (THE

‘AGVET CODE’), SCHEDULED TO THE AGRICULTURAL AND VETERINARY CHEMICALS CODE ACT 1994

1. The APVMA has evaluated the application and in its assessment in relation to whether the safety criteria have been

met in accordance with the definition set out in section 5A of the Agvet Code, and proposes to determine that:

(i) The APVMA is satisfied that the proposed use of SIESTA GRANULAR ANT BAIT containing the active

constituent metaflumizone would not be an undue hazard to the safety of people exposed to them during their

handling and use.

The Office of Chemical Safety and (OCS) in the Department of Health has conducted a risk assessment on

the products and concluded that they can be used safely.

The product is a ready-to-use granulated bait (oil bait) containing 0.63 g/kg metaflumizone. The product is

proposed to be used to control nuisance ant species (such as coastal brown ant, black ant and red imported

fire ant) on gardens, golf courses, industrial areas, lawns, parks, turf, sports grounds and other non-crop land

and non-food bearing nursery stock. The use rate is 3–5 g of the formulated product per 20 m2, equivalent to

0.950 to 1.583 g metaflumizone/ha. A maximum of 2.5 kg product per ha is not exceeded if individual mounds

are treated.

According to the label instructions, the product granules should be evenly distributed over infested areas using

a hand held rotary granule spreader or equivalent spinning disk type applicator which ensures uniform

distribution. For small areas, granules may be uniformly sprinkled by gloved hand. A maximum of six

applications per year are permitted with a minimum retreatment interval of 30 days.

Users may be exposed to the product when opening the packages and loading the product, and during

application when using a hand held rotary granule spreader or equivalent spinning disk type applicator, or

dispersing the product by hand. Exposure is considered to be medium to long-term in duration. The main route

of exposure to the product granules will be dermal contact, as well as inhalation of the granule dust, or



accidental ocular exposure. As no product-specific exposure data were provided, the OCS has used

surrogate/modelling data related to bait usage along with the draft product label indications and applicant

information for risk assessment. Based on the outcomes of the risk assessment, First Aid Instructions and

Safety Directions have been recommended for inclusion on the product labels.

Based on an assessment of the toxicology, it was considered that there should be no adverse effects on

human health from the professional use of SIESTA GRANULAR ANT BAIT when used in accordance with the

label directions.

(ii) The APVMA is satisfied that the proposed use of SIESTA GRANULAR ANT BAIT will not be an undue hazard

to the safety of people using anything containing their residues as the products are not proposed for use in

food crop areas or in food producing animals.

(iii) The APVMA is satisfied that the proposed use of SIESTA GRANULAR ANT BAIT containing the active

constituent metaflumizone is not likely to be harmful to human beings if used according to the product(s) label

directions.

Metaflumizone is a new semicarbazone insecticide. Metaflumizone belongs to a new IRAC (Insecticide Resistance

Action Committee) Mode of Action (MoA) Chemical Group, 22B. The direct effects are that SIESTA GRANULAR ANT

BAIT causes the cessation of feeding, increasing levels of immobility, and ultimately ant death.

The proposed use of a new product, SIESTA GRANULAR ANT BAIT, containing 0.063% metaflumizone, is for

the control of nuisance ant species on gardens, golf courses, lawns, parks, turf and sports grounds, and

industrial areas (including home garden use). SIESTA GRANULAR ANT BAIT will be available in 170 g, 450 g

and 11.34 kg packages, packed in a high-density polyethylene container with twist cap and a self-adhesive

label.

Toxicokinetic and metabolism studies demonstrated the tendency of metaflumizone accumulation in fatty

tissue following repeat exposure. Up to 17% of the administered dose was absorbed following an oral low

dose to the rat. Metaflumizone in aqueous suspension is generally poorly absorbed via the dermal route.

Metaflumizone displayed low acute oral, dermal and inhalation toxicity; caused slight eye irritation; but not skin

irritation or skin sensitisation in experimental animals.

Due to the poor palatability of metaflumizone-containing diet, oral dosing by gavage, rather than dietary

administration was used in the majority of repeat dose studies. Toxicity in test animals was characterised by

reduced food consumption, reduced bodyweight gain, poor general state, ataxia, and lateral position following

repeated oral administration. Centrilobular hepatocellular hypertrophy was observed in repeat-dose studies of

rats, but not in mice or dogs.

Metaflumizone was not considered to be a reproductive toxicant. In a rabbit developmental study, an

increased incidence of retarded growth in foetuses occurred but only at dose levels that were toxic to the

dams. Foetal toxicity was not noted in a rat developmental study. There was no evidence of any teratogenic

effects. Life-time exposure studies in mice and rats did not show any evidence of carcinogenic potential. A

battery of genotoxicity tests indicated that metaflumizone was not likely to be a genotoxic agent in vivo. There

was no indication of any neurotoxicity or immunotoxicity.

The Z-isomer of metaflumizone displayed biological activity in experimental animal tests. It had low acute oral

toxicity in rats and did not induce genetic point mutations in vitro. The Z-isomer caused effects similar to

racemic metaflumizone in rats following repeat oral dosing. Toxicity studies with selected impurities and



metabolites showed similar or lower acute toxicity, repeat dose toxicity and / or genotoxicity when compared to

the active constituent toxicity profile.

The product SIESTA GRANULAR ANT BAIT showed low acute oral and dermal toxicity in rats. The acute

inhalational toxicity is likely to be low based on product formulation and use pattern information; however, an

acute inhalation study was not available. It was not an eye irritant in rabbits, but was a slight skin irritant in

rabbits, and a skin sensitiser in guinea pigs by a modified Buehler test.

The APVMA has considered the findings of the Department of Health and accepts these conclusions. Based

on an assessment of the toxicology, it was considered that there should be no adverse effects on human

health from the use of SIESTA GRANULAR ANT BAIT when used in accordance with their label directions.

(iv) The APVMA is satisfied that the proposed use of the new products SIESTA GRANULAR ANT BAIT containing

the active constituent metaflumizone, would not be likely to have an unintended effect that is harmful to

animals, plants or things or the environment.

Metaflumizone is stable to hydrolysis under neutral and basic conditions but may undergo photolytic

degradation under acidic conditions. It is only slowly degraded by biotic processes in soil and sediment under

both aerobic and anaerobic laboratory conditions. The chemical quickly dissipates from the water column

where it associates with the sediment. Dissipation was more rapid in the field than in the laboratory studies

carried out in the dark. Photolysis on the soil surface is likely to have contributed to field dissipation in the bare

soil plots, which were kept free of vegetation by herbicides. Metaflumizone is not expected to be mobile in

soils. Metaflumizone was shown to bioconcentrate in aquatic organisms, however, further studies indicated

that it does not bioaccumulate in fish, earthworms or mammals or biomagnify in the aquatic food chain. A

study indicated biomagnification in aquatic snails.

Metaflumizone is practically non-toxic to birds based on acute exposure, and moderately toxic to birds from

dietary exposure. While the substance did show effects on reproduction, additional tests demonstrated a clear

preference for birds to consume normal food rather than the granules. Testing with fish, algae and aquatic

plants generally showed no effects up to the levels tested. However, it was chronically highly toxic to aquatic

invertebrates.

The substance showed delayed toxicity to bees in standard adult acute oral and contact toxicity tests and is

considered moderately toxic to bees. It was not acutely toxic to beneficial insects at the maximum single

application rate currently proposed for use in Australia. Metaflumizone generally did not exhibit toxicity

towards terrestrial invertebrates, soil microorganisms or non-target terrestrial plants.

To support the application, a full suite of environmental fate and toxicity data were provided for the new active

constituent. Several tests for environmental fate and ecotoxicity provided were undertaken using rates and

formulations not registered in Australia, or where registration is sought in Australia. These tests have been

accepted as providing additional information on the fate and toxicity of the active constituent. One ecotoxicity

study was provided for the end-use product itself.

The risk assessment determined that the chemical is unlikely to pose an environmental risk under the

proposed use pattern.

The APVMA has considered the findings of their advisor and accepts these conclusions.

2. The APVMA has evaluated the applications and in its assessment in relation to whether the efficacy criteria have

been met in accordance with the definition set out in section 5B of the Agvet Code, and proposes to determine that:



(i) In relation to its assessment of efficacy under section 14(3)(f), the APVMA is satisfied that data from trials

supporting the efficacy of the products adequately demonstrates that if used according to the product label

directions, the products are effective for their proposed uses.

3. The APVMA has evaluated the applications and in its assessment in relation to whether the trade criteria have been

met in accordance with the definition set out in section 5C of the Agvet Code, and proposes to determine that:

(i) The APVMA is satisfied that the proposed use of SIESTA® GRANULAR ANT BAIT would not adversely affect

trade between Australia and places outside Australia as the products are not for use in animals producing any

major Australian export commodities.

Variations to Standard 1.4.2 of the Australia New Zealand Food Standards Code


The APVMA has previously gazetted particular amendments which it had made to the APVMA MRL Standard and which

have been proposed as variations to maximum residue limits (MRLs) for substances contained in agricultural and

veterinary chemical products as set out as in Standard 1.4.2–Maximum Residue Limits of the Australia New Zealand

Food Standards Code. This notice pertains to proposals (No. 8) gazetted on 8 September 2015 (No. APVMA 18).

Submissions have been sought on these proposals and the APVMA has written separately to each person or

organisation that made a submission. All matters raised in the submissions have been resolved.

Under subsection 82(1) of the Food Standards Australia New Zealand Act 1991, the APVMA has, by legislative

instrument, incorporated these variations to MRLs into Standard 1.4.2. A copy of the Amendment Instrument (No.

APVMA 9, 2015) accompanies this notice. For a complete and up-to-date version of Standard 1.4.2, including these

amendments together with their Explanatory Statement, please refer to the Federal Register of Legislative Instrument

available on the Comlaw website at www.comlaw.gov.au.

Based on dietary exposure assessments and current health standards, the APVMA and FSANZ are satisfied that these

MRLs are not harmful to public health. MRLs contained in Standard 1.4.2 provide the limits for residues of agricultural

and veterinary chemicals that may legitimately occur in foods. By this means, Standard 1.4.2 permits the sale of treated

foods and protects public health by minimising residues in foods consistent with the effective control of pests and

diseases.

The Agreement between the Government of Australia and the Government of New Zealand concerning a Joint Food

Standards System, excludes MRLs for agricultural and veterinary chemicals in food from the system setting joint food

standards. Australia and New Zealand independently and separately develop MRLs for agricultural and veterinary

chemicals in food.

Food Standards Australia New Zealand (FSANZ) made Sanitary and Phytosanitary (SPS) notification to the World Trade

Organization (WTO) in relation to these variations and no comment was received in response to that notice.

A copy of these variations have been given to FSANZ.

The variations take effect as from the date of this notice.

This notice is published in accordance with subsection 82(7) of the Food Standards Australia New Zealand Act 1991.

1 Name of Instrument

This Instrument is the Australia New Zealand Food Standards Code—Standard 1.4.2–Maximum Residue Limits Amendment Instrument No. APVMA 10, 2015.

2 Commencement

Pursuant to subsection 82(8) of the Food Standards Australia New Zealand Act 1991, this Amendment Instrument commences on the day a copy of it is published in the Gazette.

Note: A copy of the variations made by the Amendment Instrument was published in the Commonwealth of

Australia Agricultural and Veterinary Chemicals Gazette No. APVMA 24 of 1 December 2015.

3 Object

The object of this Instrument is for the APVMA to make variations to Standard 1.4.2–Maximum Residue Limits of the Australia New Zealand Food Standards Code to include or change maximum residue limits pertaining to agricultural and veterinary chemical products.

4 Interpretation

In this Instrument: —

APVMA means the Australian Pesticides and Veterinary Medicines Authority established by section 6 of the Agricultural and Veterinary Chemicals (Administration) Act 1992; and

Principal Instrument means Standard 1.4.2–Maximum Residue Limits of the Australia New Zealand Food Standard Code as defined in Section 4 of the Food Standards Australia New Zealand Act 1991 being the code published in Gazette No. P 27 on 27 August 1987 together with any amendments of the standards in that code. The whole of the Australia New Zealand Food Standard Code (including Standard 1.4.2) was further published in Gazette P 30 of 20 December 2000.

SUMMARY OF THE APVMA’S EVALUATION OF OXATHIAPIPROLIN ACTIVE CONSTITUENT

The Scientific Assessment and Chemical Review Program of the APVMA has evaluated the chemistry aspects of

Oxathiapiprolin active constituent (manufacturing process, quality control procedures, batch analysis results and

analytical methods) and found them to be acceptable.

On the basis of the data provided, and the toxicological assessment, it is proposed that the following APVMA Active

Constituent Standard be established for Oxathiapiprolin active constituent:

Other compounds of toxicological significance are not expected to occur in Oxathiapiprolin TGAC as a result of the raw

materials and the synthetic route used.

The Office of Chemical Safety has considered the toxicological aspects of Oxathiapiprolin TGAC, and advised that there

are no toxicological objections to the approval of this chemical.

An acceptable Daily Intake (ADI) has been set at 4.1 mg/kg bw/d based on a NOAEL of 411 mg/kg bw/d in a 2

generation reproduction rat and applying a 100 fold safety factor (consisting of a 10-fold safety factor for both intra- and

inter-species variation).

An Acute Reference Dose (ARfD) was not established since Oxathiapiprolin was considered unlikely to present an acute

hazard to humans, noting that no toxicologically significant acute findings were seen in animal studies.

Based on the toxicological profile of the chemical, the OCS recommends to the Delegate of the Department of Health

that consideration be given to a listing in Appendix B of the SUSMP for Oxathiapiprolin.

The Advisory Committee on Chemicals Scheduling (ACCS) have considered the OCS recommendations to the

Chemicals Scheduling Delegate of the Department of Health that consideration be given to a listing in Appendix B of the

Poisons Standard for Oxathiapiprolin. The Delegate’s interim decision is expected to be published in February 2016 at

the TGA website.

The APVMA accepts the findings and recommendations of its advisers on these criteria.

The APVMA is satisfied that the proposed importation and use of Oxathiapiprolin would not be an undue toxicological

hazard to the safety of people exposed to it during its handling and use.

matters that are considered in determining whether the safety criteria set out in section 5A of the Agvet Code have been

Revocation of Suspension of a Product Containing Dimethoate to allow Approval of new Label


On 27 November 2015 the APVMA revoked the suspension of the following dimethoate product registration to allow

approval of a new product label that has instructions consistent with the previous suspension instructions as published

on 6 October 2015 to mitigate the dietary risks identified in the review of dimethoate.

Please note that the label approvals listed in column 4 remain suspended. Products bearing these suspended labels

must continue to be used only in accordance with the instructions issued by the APVMA to allow continued use of

suspended dimethoate products. See permit PER 13155 for the current instructions for the use of suspended dimethoate

according to its label instructions.

CERTAIN OTHER DIMETHOATE PRODUCTS AND LABEL APPROVALS ARE NOT INCLUDED IN THIS

REVOCATION

Certain other dimethoate products and labels (as listed in Table 2 below) as well as previous labels for the above product

(as listed in column 4 of Table 1) remain suspended and must only be used in accordance with the instructions issued by
