The Building Act 2004: Last amended in 2013 Brought in several new changes (such as but not limited to); more types of work exempt from consent Higher penalties for doing work without consents (Increased to $200,000 max) Changes to some terms and definitions MBIE has even more power to hold BCAs to account BUT WHY???? 7. END GOAL OR OWN GOAL? TO BE THE BEST AND TO BE SELF REGULATING! BECAUSE THEY WANT TO IMPLEMENT OTHER AMENDMENTS TO THE ACT AND NOT ALLOW US TO DEVOLVE.. 8. SO WHAT DO THEY WANT TO CHANGE AND WHY? WHY HASNT IT HAPPENED YET? THE MINISTRY WANTS TO BRING IN THE CHANGES THEY THOUGHT THEY COULD IN 2012! 9. BECAUSE . THE CHANGES THEY ANTICIPATED HAVENT BEEN BACKED UP IN ALL SECTORS BY TRAINING, AND ITS ALL CHANGING REALLY FAST!!!! NO ITS NOT JUST IN THE TRADES!!! EVERY BCA HAS BEEN SUBJECTED TO THE SAME PROBLEMS, AND SUFFERS THE SAME GROWING PAINS! 10. SO WHATS BEEN DECIDED BY THEM SO FAR? Some points from the BOINZ Conference.. 11. AUDIENCE QUESTIONS? 12. IT SAVES TIME AND FRUSTRATION SO WHAT ADVICE OR TOOLS CAN WE SUGGEST? 17. BUILDING IS LIKE BAKING Example: I want a chocolate cake, it has to feed 8 people, be delicious, look good, last for at least a week in the fridge and I can freeze it after if needed so I can use it again! Chocolate Cake 1 Recipe: Alyson Holst (Acceptable Solution AS1) Jamies Cook book VM1. 500gms self raising flour 2 eggs 250mls milk 100gms cocoa 250gms butter 500gms castor sugar 50gms icing sugar Put flour and sugar in bowl, make a well add milk and eggs and melted butter, mix well, add to greased tin, put into oven at 180 degrees for 40 minutes. Remove allow to cool add chocolate icing to suit. Chocolate cake 2 Aunty Bettys recipe. (Alternative solution) 500gms gluten free flour 2 duck eggs Teaspoon baking soda 250mls soya milk 100gms cocoa 250gms margarine 8 tablespoons of honey 2 anchovies Put everything in the bowl, mix it and cook until ready. 18. APPLICATION & DESIGN SUMMARY WHEN AN APPLICATION IS MADE TO BUILD THE CHOCOLATE CAKE THE BCA ONLY VERIFIES YOUR RECIPE MATCHES THE ONE YOUVE SAID YOURE GOING TO MAKE IT TO! IF YOUVE SAID YOUR RECIPE IS ALYSON HOLSTS, THEN ALL WE DO IS COMPARE WHAT YOUVE SUPPLIED TO THAT RECIPE, AND IF ITS DIFFERENT YOU GET A FURTHER INFORMATION LETTER IF ITS THE SAME YOU GET NOTHING AND THE CONSENT IS GRANTED IF ITS AUNTY BETTYS ALTERNATIVE SOLUTION WILL IT STILL MEET MY PERFORMANCE REQUIREMENTS i.e. I want a chocolate cake, it has to feed 8 people, be delicious, look good, last for at least a week in the fridge and I can freeze it after if needed so I can use it again! IF WE AGREE, BECAUSE AS AN INSTRUCTION TO COOK/BUILD IT WILL MEET THOSE REQUIREMENTS THEN GREAT! BUT IF WE THINK THAT IT WONT LAST OR FREEZE, THEN YOURE GOING TO BE ASKED TO GIVE FURTHER PROOF OF HOW IT WILL? 19. WHAT PROOF? BY COMPARISON OR BY VERIFICATION BY SOMEONE ELSE etc.. 20. BUILDERS, PLUMBERS, ELECTRICIANS etc.. GREAT NEWS!!!!!!!!! THE ONLY THING YOU HAVE TO DO ON SITE UNDER SECTION 14E, IS BASICALLY BUILD TO THE PLANS AND SPECIFICATION! YEP THATS ALL! SERIOUSLY!! Thats basically it! 21. BUT THE OWNER OR ARCHITECT WANTS TO CHANGE STUFF? NO PROBLEM!!! BUT YOU MUST GET THIS APPROVED BY THE BCA BEFORE YOU DO IT, THE ACT REQUIRES IT! BUT WHY???? BECAUSE NONE OF US WANTS TO HAVE TO EAT AUNTY BETTYS CHOCOLATE CAKE!! 22. THE ONLY JOB OF THE BUILDING INSPECTOR ON SITE? THE ONLY JOB THEY ARE OBLIGED TO DO IS CHECK THAT WHAT YOUVE BUILT DOES MATCH THE BUILDING CONSENT! LETS FACE IT. ITS ONLY WHEN IT DOESNT, THAT WE ALL END UP FEELING LIKE THIS GUY AGAIN!!!!!!! AND THERES NO REASON FOR IT IF WE WORK TOGETHER AND COMMUNICATE 23. PRE-LODGED QUESTIONS Thank you to those who sent them in TIM PIKE FROM SIGMA ENGINEERING 24. WANTS TO KNOW: WHAT IS REQUIRED FOR CONSENT APPLICATIONS? HAVE WE COVERED THAT ENOUGH OR DO WE WANT SOME MORE CLARIFICATION HERE?? 25. HE WOULD ALSO LIKE TO KNOW WHERE WE ARE AT WITH EQ PRONE BUILDING ASSESSMENT, AND ANY THING NEW THAT MIGHT CROP UP e.g. THE BUILDING (EARTHQUAKE PRONE BUILDINGS) AMENDMENT BILL 2013.? ITS HAD A FIRST READING OF SORTS IN PARLIAMENT BUT ISNT LAW YET. IF AND WHEN IT COMES IN IT WILL PLACE SIGNIFICANT PRESSURE ON TAS TO COMPLETE SEISMIC ASSESSMENTS OF BUILDINGS WITHIN A 5 YEAR PERIOD. BUILDINGS IN GENERAL WILL HAVE TO BE UPGRADED WITHIN 20 YEARS, BUT ALLOWING FOR THE 5 AT THE START THAT WOULD MEAN WITHIN 15 POTENTIALLY OF THE ASSESSMENT. PRIORITY BUILDINGS CAN BE REQUIRED TO UPGRADE SOONER e.g. ONES THAT POSE SIGNIFICANT THREAT FROM FALLING DEBRIS, OR IF THEY FELL OVER THEY COULD BLOCK TRANSPORT ROUTES THAT HAD STRATEGIC IMPORTANCE IN AN EMERGENCY.. APART FROM THAT EXISTING BUILDINGS ARE REALLY ONLY AFFECTED UNDER THE ACT IF THEY UNDERGO A CHANGE OF USE AS DEFINED IN REGUALTION. THE COUNCIL HAS NO OTHER POLICY THAT AFFECTS THIS. 26. SHOULD CONSENT APPLICATIONS INCLUDE ITEMS SUCH AS SEWER CONNECTIONS,VEHICLE CROSSINGS ETC? THEY SHOULD IF YOU NEED THEM, BUT ONLY BECAUSE THIS CAN HELP THE PROJECT OVERALL FLOW SMOOTHLY. NO BCA CANNOT REFUSE TO LODGE OR APPROVE A CONSENT FOR ISSUE UNDER ANOTHER ACT. YOU WOULD SIMPLY BE ADVISED YOU MAY REQUIRE PERMISSION FROM ANOTHER ORGANISATION BEFORE STARTING WORK e.g. YOU MAY NEED A RESOURCE CONSENT FOR BOUNDARY DISTANCE ETC THAT WASNT APPROVED BY THE TIME THE CONSENT WAS ISSUED TO YOU? 27. TERRY CHRISTISON Hawkes Bay Wastewater Management WHY DOES CHBDC STAMP BUILDING CONSENTS AT TIMES WITH :- HBRC PERMITTED ACTIVITY LETTER ISSUED IN ERROR ON CERTAIN BUILDING CONSENTS IF IT HAS NOTHING TO DO WITH THEM? IT LEAVES THE DRAINLAYER IN NO MANS LAND AS TO WHETHER THE WORK WILL GET A CODE COMPLIANCE CERTIFICATE? 28. A FAIR QUESTION INDEED! THE REASONS ARE FOUR FOLD: 1. WHEN WE REALIZED THAT THIS WAS HAPPEING HBRC SUGGESTED TO US THAT WE COULD ADVISE OWNERS AND DESIGNERS OF THIS AND THAT BECAUSE IT WAS THEIR ERROR THEY WOULD SORT OUT HOW TO FIX IT. 2. BECAUSE WE KNEW THIS WAS THE CASE WE COULD NOT BE COMPLICIT IN APPROVING WORK THAT BREACHED ANOTHER ACT OR REGULATION (section 51(2)(b) of BA04) 3. ALTHOUGH TRULY UNFORTUNATE, IF AS AN INSTALLER YOU WERE UNAWARE OF THE CHECKSHEET FLAW AT HBRC, ALL HBRC CERTIFIED INSTALLERS WERE SUPPLIED COPIES OF THE OPERATIONAL CHANGES THE SAME AS CHBDC WAS, AND SHOULD IDEALLY HAVE RECOGNIZED THE ANOMALY. 4. HOWEVER UNDER SECTION 94 OF THE BUILDING ACT 2004 IT IS NOT SOMETHING WE CAN REFUSE TO ISSUE A CCC OVER, IT BECOMES ENFORCED UNDER THE RMA 1991, WHICH AS OFFICERS OF THE TA WE CAN ISSUE INFRINGEMENT NOTICES FOR FAILURE TO COMPLY. 29. MARK AND KELLY ANNAND HOW CAN WE ENSURE THAT THE CONSENTING PROCESS IS DONE WITHOUT TOO MUCH NEED FOR DELAY WHAT CAN WE DO AS BUILDERS TO ENSURE THIS? 30. ONE THING YOU CAN DO IS LIAISE WITH THE OTHER TRADES AS MUCH AS POSSIBLE BEFORE HAND IF YOU KNOW WHO THEY ARE. IF THEY SEE CONCEPT DRAWINGS AND INTEND ON DOING THINGS DIFFERENTLY, TALK TO THE DRAUGHTSMAN AND ASK THEM TO CHANGE THE PRODUCT OR BUILDING METHOD TO WHAT AND HOW YOU INTEND TO BUILD. THIS WILL SAVE YOU TIME LATER HAVING TO SUPPLY IT ALL AS VARAITIONS AND SLOW DOWN THE WHOLE BCA PROCESS THAT HAS TO DEAL WITH THAT. IF YOU SEE SOMETHING ON OR NOT ON THE PLANS HAVE A CHAT TO THE DESIGNER, IT MIGHT SAVE US HAVING TO ASK FOR IT? 31. MARK AND KELLY ANNAND CAN WE HAVE HARD COPIES OF HOW TO FILL OUT ALL FORMS CORRECTLY? 32. THATS A GOOD IDEA AND SOMETHING WE CAN DO FOR THE WEB SITE AND PUT IN THE PACKS! THE SECRET IS THAT THE INFORMATION ON HOW TO SUPPLY APPLICATIONS IS ALREADY IN THERE, AND SOME FEEDBACK IS THAT THERE IS TOO MUCH INFORMATION, SO ITS A FINE LINE. BUT WE WILL PUT IN AN EXAMPLE FORM, BUT WE CANT DO THE MEANS OF COMPLIANCE BECAUSE THIS IS DIFFERENT FOR EVERY CONSENT, BUT WERE HAPPY TO GUIDE YOU IN PERSON OR BY PHONE 33. MARK AND KELLY ANNAND CAN WE HAVE FURTHER INFORMATION LETTERS BY E- MAIL AS WELL AS IN THE MAIL? 34. GOOD POINT AGAIN. AS A POLICY WE DO SEND FURTHER INFORMATION LETTERS BY E-MAIL AND HARD COPY IN CASE ONE GOES MISSING.
