History of Subject Site

1983 Subject site was a part of the area annexed into City Limits and assumed A-O Agricultural Open zoning.

2001 Rezoned to R-4 Apartments.

2003 New Thoroughfare Plan adopted and Decatur Rd was upgraded to a Major Collector.

2005 City constructed Arrington Rd & Decatur Rd in anticipation of development in the area.

2006Rezoned to A-P Administrative Professional & C-1 General Commercial (Later renamed O Office & GC General Commercial respectively).

2009Property platted as Lot 1, Block 5 of Tower Point Phase 5. Comprehensive Plan Future Land Use & Character Map was also adopted this year.

Proposed Zoning

Staff recommends approval of the rezoning request with the condition that no residential buildings be constructed within the 135-ft buffer from the heater-treater located on the abutting property containing oil and gas uses.

Planning & Zoning Commission heard this the February 4th meeting and voted to recommend approval with the condition as stated by staff.

1. Consistency with the Comprehensive Plan;2. Compatibility with the present zoning and conforming uses

of nearby property and with the character of the neighborhood;

3. Suitability of the property affected by the amendment for uses permitted by the district that would be made applicable by the proposed amendment;

4. Suitability of the property affected by the amendment for uses permitted by the district applicable to the property at the time of the proposed amendment;

5. Marketability of the property affected by the amendment for uses permitted by the district applicable to the property at the time of the proposed amendment; and

6. Availability of water, wastewater, stormwater, and transportation facilities generally suitable and adequate for the proposed use.
