    The Arts, Creative and Cultural Innovations Committee was called to order by the Acting Chair at 2:03 p.m.

    CARRIED UNANIMOUSLY 4. New Business

    4.1 Election of Chair and Vice Chair

    Timothy Tweed volunteered for the position of Chair and the Committee had no objections. It was MOVED and SECONDED THAT the Arts, Creative and Cultural Innovations Advisory Committee elect Timothy Tweed as Chair.

    CARRIED UNANIMOUSLY Mr. Tweed assumed the position of Chair.

    Brenda Longland volunteered for the position of Vice Chair and the Committee had no objections. It was MOVED and SECONDED THAT the Arts, Creative and Cultural Innovations Advisory Committee elect Brenda Longland as Vice Chair.

    CARRIED UNANIMOUSLY

    4.2 Potential Purchase of Firehouse Sculpture The Director of Recreation and Facilities sought the Committee’s feedback on the City’s interest in purchasing the Firehouse Sculpture located at the roundabout off Ellis Street at a sale price of $21,000 USD (valued at $30,000 USD) from the Arts Reserve Fund. The Committee was also asked to provide feedback on potential locations for the relocation of the sculpture if purchased.

    Members at large inquired about the cost of moving the sculpture. Comments from the membership included that big art is required throughout the community to make a big impact, the sculpture is seen as an asset to the community as it is not a controversial piece and corporate sponsorship/ partnership should be sought based on the potential locations for the sculpture.

    It was MOVED and SECONDED THAT the Arts, Creative and Cultural Innovations Advisory Committee strike a sub-committee to discuss locations for public art and research corporate sponsorship prior to making a recommendation to Council regarding the potential purchase of the Firehouse Sculpture.

    CARRIED UNANIMOUSLY

    4.3 City Sculpture Program Brainstorm

    The Director of Recreation and Facilities, reminded the Committee that the City has many sculptures and there is usually an opportunity to purchase any of the sculptures that the City is leasing. The Committee was informed that exploring corporate sponsorship/partnership ideas would be a great way to increase the amount of art in the City.

    4.4 Guided City Sculpture Walks The Director of Recreation and Facilities, informed the Committee that an enquiry was received by someone who had seen the Sculpture Brochure was wondering if the City offered any guided walks. The City does not currently have the staff resources to offer guided walks. The Committee was asked for any input on whether the City could contact any organizations that might be interested in offering such walks. A member at large informed staff about the Ambassador Program through the Downtown Penticton Association. Another member at large suggested that be a call-out program be developed to engage members of the Community.

    5. Representative Updates

    5.1 Penticton Art Gallery

    • February 20, 2020: 3rd Annual Loving Mugs Chili Cook-off • March 21, 2020: Bob Ross: Happy Little Accidents Exhibition Opening

    5.2 Shatford Centre & Okanagan School of Arts

    • February 19, 2020: Abstracted Ideas Opening • Painting, publishing, crafting and food and nutrition classes coming up • Gala fundraiser postponed • Rock School and Jazz School • New musical theatre program started at the Shatford Centre called “Show time” • May 15, 2020: Penticton Art Walk

    5.3 Penticton Arts Council

    • Current exhibit is titled “Love Letters” at Lier House • Gathered together different arts groups in the community for roundtable

    discussions to work together more effectively. Second monthly meeting is taking place February 19, 2020.

    • April 4, 2020: Third party fundraising event – “Roaring 20s Style Party” at Cannery Brewing

  • Outline: The Downtown Penticton Association initiated the breezeway project as it covered three essential topics in our downtown core - safety, vision, and parking initiative. Over the past year, we’ve developed our plan to repaint the murals, we researched sponsorship and grants within and outside our community.

    We’ve received a $10,000 grant from Tweed Collective. Tweed Collective is an initiative that funds community impact projects all across Canada. Tweed’s main partners are the non-profits, business improvement areas (BIA), and registered charities, whose main mandates to grow opportunities, grow greener and grow connections in their communities.

    The City of Penticton repainted the breezeway and will replace each mural with new plywood. Initially, the plan was to remove the mural structures altogether to have a clean, fresh surface. However, recognizing the structural issues and that they cannot be removed, we came up with a new plan. To have the murals in a digital format and printed on vinyl anti-graffiti wraps.

    We want to discuss with several artists the potential of the area and vision of what we want to see, including the provisions of a vibrant, family-friendly themed breezeway.

    We will request a digital form for the artwork provided by the artist. The artwork will be fashioned onto the murals with a vinyl wrap. Jafa Signs has provided generous sponsorship to have the wraps made at cost. We have chosen this direction versus individual paintings because the wraps will combat against graffiti and be easier to replace in the future should any damage occur or if a new design is requested.

    Vision:

    Our vision is to create visually aesthetic murals in the breezeway that promotes a sense of identity, belonging, attachment, welcoming, and strengthening of the community. To generate a tangible sense of place, destination, resulting in increased foot traffic while adding colour, vibrancy, and character to the urban environment.

    Why:

    Safety initiative – Enhance public safety by creating a feeling that the breezeway is cared for, making crimes of opportunity less likely to happen.

    Economic development initiative – Increase tourism by making commercial retail sectors more attractive destinations for visitors and residents.

    Parking initiative – Increase awareness of parking available in the downtown core. When parking in the 200 Block Lot, it is a quick access point through the breezeway to connect onto Main Street.

    How:

    • Create a committee made up of City of Penticton, Art Council and Downtown Penticton Association

    • Define the cost for each artist • Set guidelines for artists to follow • Committee approves the artwork before printing

  • Our Ask: We are bringing this proposal forward to the Arts, Creative & Cultural Innovations Advisory Committee to see if there is any available funding to pay the artists a higher rate. As you can see, in the budget we have allocated $4000 for the artist honorarium. We value our local artists’ time, creativity, and energy, and would like to offer a suitable payment.

  • 2020 – 2022 Terms of Reference Arts, Creative & Cultural Innovation Advisory Committee

    1. The Committee shall consist of NINE (9) voting members appointed by City Council for a term ending December 31, 2022. Preference will be given for individuals with direct knowledge or interest and/or experience in arts and culture that could include, but is not limited to:

    • Art professionals • Art collectives • Architects • Landscape designers • Urban designers • Wineries • Conservation society

    2. The Committee Members shall appoint a Chair and Vice-Chair.

    3. Council shall appoint one (1) Council representative to the Committee.

    4. Role of Council Representative:

    • Non-Voting Member • Liaison to City Council

    5. The Mayor or their Deputy will act as an alternate Council representative.

    6. A majority of appointed voting members shall constitute a quorum.

    7. The Director of Recreation & Facilities and Director of Development Services and/or designates, shall attend committee meetings to provide operational support to the Committee.

    8. The Corporate Administration Department shall arrange for secretarial services to the Committee.

    9. The Committee shall meet quarterly, or as required when a new piece of business is referred to the Committee by Council or staff requiring immediate action.

    10. The Committee’s mandate is to make recommendations to the Council on all matters referred to the Committee, including:

    • The Committee uses the City’s Public Art Policy as its basis for advising City Council and its Boards, Agencies, Commissions, Committees or Staff, developers and citizens when reasonable and objective advice and guidance on public art is needed;

  • • The Committee undertakes to research, develop and propose arts and culture activities to complement community revitalization efforts along side private and non-profit sector partners;

    • The Committee undertakes to research, develop and propose other creative and cultural programs in line with the City’s vision;

    • The Committee, for each initiative it proposes to execute, will research, develop and propose funding source options for consideration, including, but not limited to, corporate sponsorship, community partnerships, grants, awards and municipal funding;

    • Recommend actions which promote increased collaboration and communication between arts and cultural groups; and

    • Recommend actions, education and marketing initiatives which promote increased public awareness and participation in arts and culture in the community.

    The Committee will not participate in operational matters respecting the City of Penticton.

    11. Conflict of Interest

    All Committee members are expected to review and sign a Conflict of Interest Declaration and adhere to the requirements set out in the declaration.

    If a Committee member attending a meeting considers that he or she is not entitled to participate in the discussion of a matter or to vote on a question in respect of a matter because the member has a direct or indirect pecuniary interest in the matter, or for any other reason, the member must declare this and state the general nature of why he or she considers this to be the case and immediately leave the meeting or the part of the meeting during which the matter is under consideration.

    The member’s declaration must be recorded in the minutes, and the Committee member must not attempt in any way, whether before, during or after the meeting to influence the voting on any question in respect to the matter.

    12. Removal of a Member from Committee

    Council may remove a Committee member from a Committee for good and sufficient reason, which may include any of the following, without limitation:

    (a) the absence of a Committee member from three (3) consecutive regularly scheduled Committee meetings, unless the absence is because of illness or is with leave of the Committee;

    (b) a finding by Council that the Committee member has engaged in misconduct, such as bullying or harassment of another Committee member or a City employee; or

    (c) participation by a Committee member in circumstances where the Committee member has a conflict of interest. In any case where Council proposes to remove a member from a Committee, the member will be provided with notice and an opportunity to be heard by Council prior to Council voting on the matter.

  • 13. Resignation

    Any member may resign upon sending written notice to the Corporate Officer.

    In the event of a vacancy occurring during a regular term, the vacancy may be filled for the remainder of that term in the same way the initial appointments were made.

    14. Closed Meeting

    All Committee members are expected to review and sign a Confidentiality Declaration and adhere to the requirements set out in the declaration.

    No meeting or part thereof shall be closed to the public except in accordance with Section 90 of the Community Charter. Should a Closed meeting be held by the Committee, members must keep in confidence, any information considered in any part of said meeting until such time as the information is released to the public as lawfully authorized or required. Should the municipality suffer loss or damage due to contravention of confidentiality, the municipality may recover damages from the person(s) for the loss or damage.

    15. The Mayor will sign all correspondence initiated by the Committee on behalf of the City of Penticton.

    16. For certainty, the rules and procedures of Council Procedure Bylaw No. 2018-35 and all amendments thereto shall be observed as far as may be applicable.

    CONFLICT OF INTEREST

    Throughout your Committee term you are required to ensure that you do not participate in matters when you have a conflict of interest. A conflict of interest includes a pecuniary interest or another interest in a matter that constitutes a conflict, such as personal interest in a matter that is a distinct from the interest other citizens would have in the matter generally. A pecuniary interest refers to an interest a matter which may have financial consequences for you, such that you might be seen to have a recognizable incentive to vote for financial reasons. The phrase “pecuniary interest” is interpreted broadly. The interest does not mean there is a direct financial benefit or loss to you. It is sufficient if a matter has the potential to impact your pecuniary interests, whether directly or through another person or corporation, such as a close family member or your employer. Accordingly, you hereby acknowledge the following: 1. It is your responsibility, as an individual committee member, to be aware of a potential

    conflict of interest and to declare the conflict when it arises.

    2. If you are unsure of whether you may have a conflict, it is your responsibility to obtain further advice or information in respect of the matter.

    3. Once you have declared a conflict in relation to a matter coming before the committee, you must not:

    a. Participate in any discussion of the matter; b. Vote; or c. Attempt in any way, whether before, during or after the committee meeting, to

    influence the decision of others.

    4. If you participate when you have a conflict, the consequence is removal from the committee by Council.
