IN RESPONSE TO CORONAVIRUS COVID‐19
In light of the COVID‐19 pandemic, California Governor Gavin Newsom issued Executive Order N‐25‐20 and N-29-20 on March 12, 2020 and March 17, 2020, respectively, relating to the convening of public meetings; and the State of California Public Health Officer issued Executive Order N-33-20 on March 19, 2020, relating to ordering all individuals living in the State of California to stay home or at their place of residence. The Kings County Association of Governments (KCAG) hereby provides notice that it will continue to convene its regularly scheduled public meetings of the KCAG Commission via teleconference until further notice.
Members of the public who wish to participate in the meeting electronically can do so one of two ways: via telephone using the Call in Number and Participant Code noted on the meeting agenda; or by postal or electronic mail. The public may submit written comments on any matter within the KCAG Commission’s subject matter jurisdiction, regardless of whether it is on the agenda for KCAG Commission consideration or action, and those comments will be entered into the administrative record of the meeting. I. CALL MEETING TO ORDER
The regular meeting of the Kings County Association of Governments (KCAG) was called to order by Joe Neves, Chairperson, at 4:30 p.m., on April 22, 2020 via teleconference, in accordance with COVID-19 Public Meeting Protocol. COMMISSIONERS PRESENT: Martin Devine, Joe Neves, Sid Palmerin, John

II. KCAG TRANSPORTATION POLICY COMMITTEE
A. General Transportation Items
1. FY 2018-19 Transportation Development Act Financial and Compliance Audit
Mary Madrid reported that the KCAG Transportation Policy Committee authorized the County of Kings Auditor to withhold any Transit Development Act fund allocations to the City of Corcoran, until such time as their FY 2018-19 Transportation Development Act (TDA) fiscal and compliance audit report is received as per the applicable California Code of Regulations. Corcoran’s FY 2018-19 audit report has been received on April 17, 2020 and therefore the Auditor may release the withheld allocations and resume current year allocations to the City of Corcoran. The audit report includes findings that the City of Corcoran is not in compliance in one area, noting that management of the TDA funds failed to establish a separate fund or subaccount and properly identify the receipt of SB1 SGR funds. The City of Corcoran will establish a separate fund for which SB1 funds are to be maintained and recorded. There were no other instances of noncompliance to TDA laws or other matters that are required to be reported from the City of Corcoran’s audit report. The auditor plans to work more closely with the City of Corcoran to assist in having the next audit completed earlier. A motion was made and seconded (Plourde / Devine) to accept the final FY 2018-2019 TDA Financial and Compliance Audit for the City of Corcoran for submittal to Caltrans and the State Controller’s Office; and to authorize the County of Kings Auditor to resume Transportation Development Act fund allocations to the City of Corcoran, and to release the allocations withheld during the month of April. 2. FY 2020-21 Transportation Development Act Activities Teresa Nickell stated that Transportation Development Act (TDA) funds are composed of Local Transportation Funds (LTF) and State Transit Assistance (STA) funds and that the Kings County Association of Governments (KCAG) is to administer TDA funds available to Kings County. KCAG has received claims and other required documentation from all applicable agencies and each claimant was required to hold a public hearing and present an adopted resolution, stating their findings on unmet transit needs, and required environmental documents within their jurisdiction before funds can be allocated for road purposes. The Kings County Area Public Transit Agency (KCAPTA) held public hearings during February and March 2020 meetings and the City of Corcoran held public hearings in March and April. KCAG will hold one public hearing for unmet transit needs testimony during the May KCAG Transportation Policy Committee (TPC) meeting. The Social Services Transportation Advisory Council (SSTAC) will hold one public meeting in early June.

Teresa Nickell reported that the estimate of FY 20-21 LTF funds to Kings County is $4,400,000 and provided a summary of the fund claim requests. KCAG Staff will provide the SSTAC’s letter of recommendation in regards to unmet transit needs to the KCAG Transportation Policy Committee at the June meeting. Approval of the TDA apportionments and allocation instructions to the County Auditor will be made by Resolution also during the June meeting. It was noted that the released public hearing notice contains the information needed to provide testimony via teleconferencing for the June meeting.
B. Caltrans Report Michael Navarro announced that he is now the Deputy District Director for Planning and Local Assistance. He reported that during the COVID-19, overall state traffic is down 35%, but that traffic volumes on Interstate 5 are up. The SR 41 roundabout in Kettleman City is scheduled for construction in spring of 2024; the SR 41 and Stratford Kings River bridge replacement is scheduled to start in fall 2022; and SR 43 pavement preservation in Kings County is on track for construction in late 2020. Commissioner Woolley asked if Caltrans has an ongoing traffic count on SR 269 entering Avenal. The reply was that the traffic volumes are coming from Caltrans Headquarters. The question was regarding why there are count strips along SR 269 during the COVID-19 shelter in place. Caltrans will inquire about that and report back. Commissioner Palmerin inquired about the SR 43 pavement preservation. The reply was that the project work starts at the Tulare County line and continues to Santa Fe Avenue.

Terri King summarized some items scheduled for the May KCAG Transportation Policy Committee meeting, which include the final presentation for the Electric Vehicle Readiness Plan; the Unmet Transit Needs public hearing; the FY 2019-20 Overall Work Program amendment; the final FY 2020-21 Overall Work Program and Budget; the Regional Surface Transportation Program funding allocation; the third quarter financial report; the new deferred compensation program provider; the Department of Finance population estimates; and employee compensation changes.
