INTRODUCTORY COMMENT BY A MODERATOR
Mr. Patrick Yang Oh Kim, Senior Vice-President announced
that Mr. Kim, Mr. Hirohito Katsunuma, also Senior
Vice-President, and Mr. Alex Ferdinand Fider, Co-Chair of the
APAA Academy Group would preside at the Asian IP Forum as
Moderators. Mr. Kim informed that there would be 12 or so APAA
Groups among all the 18 Recognized Groups to make their
presentation of their summary Group reports at the Forum.
Moderator Kim asked the reporters to limit their presentation
to within five minutes each, due to the time constraints.
REPORTS BY THE RECOGNIZED GROUPS
For this year‟s Asian IP Forum, the representatives of
the next 12 Recognized Groups presented the highlights of their
Group reports:

CLOSING of THE FORUM
Mr. Alex Ferdinand S. Fider, Co-Chair of the APAA Academy
Group informed that the Recognized Group reports, Committee

reports, and Special Topic reports would be uploaded onto the
APAA website in due course. Expressing his appreciation for
the preparation for their reports made by the Recognized Groups
and the Co-Chairs of the six Standing Committees, Mr. Fider
closed the session for the Asian IP Forum in Penang, Malaysia.

VIII. APAA MEETING
ExCom/AdCom Meeting in Penang, Malaysia in February, 2014
The ExCom/AdCom Meeting was held at the Shangri La Rasa Sayang
Hotel, the conference hotel for the APAA 63rd Council Meeting,
in Penang, Malaysia from February 28-March 3 this year. With
the Organizing Committee of the APAA Malaysia Group, the
ExCom/AdCom members exchanged views and offered advice
regarding the preparation for the Penang Council Meeting 2014,
including the registration fees, possible number of
participants, hotel accommodations, etc. The members
conducted sight inspection tours to the conference hotels, the
venues for the social functions, and selected sightseeing spots
on the Excursion Day for the Penang Council Meeting, during
their stay. At the ExCom/AdCom Meeting in Penang, the matter
of the management and administration of the APAA were also
deliberated

The two Workshop Sessions were held in the afternoon of
November 9, the 2nd day of the Penang Council Meeting, in Pelangi
Room of the Shangri-La‟s Rasa Sayang Resort & Spa.
The main topic dealt with, this time, for the First Session
was “Alternative Dispute Resolution (ADR)” while that for the
Second Session was “Patent Prosecution Highway (PPH)”.
The three distinguished speakers in each session offered
their very inspiring expert opinions and suggestions to the
participants at the Workshop on the occasions. When three
panelists finished their presentations in each Session, a “Q
& A session” was held and questions raised from the floor were
replied and clarified by the panelists.
In completion of these Workshop Sessions, mementoes were
presented by Mr. C. K. Kwong, APAA President, to the respective
speakers so as to express the Association‟s appreciation of the
participation, preparation, and dedication of the speakers.

Distinguished Guests, Members of the Media, Ladies and
Gentlemen,
[1] It is my distinct pleasure to be here today to officiate
the opening of the 63rd Council Meeting of the Asian Patent
Attorneys Association (“APAA”). A very warm welcome to
each of you. This is an august forum, a gathering of
intellectual property professionals to discuss the
subject-matter of their expertise and a truly
international meeting, with participants coming not only
from the Asian countries but also from the Americas, Europe,
UK, Australia, New Zealand and around the globe.

[2] Thank you for choosing Penang as the venue for the 63rd
Council Meeting. Needless to say, we are delighted to be
playing host.
[3] Despite being the second smallest state in Malaysia,
Penang is amongst the top foreign direct investment (FDI)
state in Malaysia. We are also the traditional leader for
the electrical and electronics industries. Penang houses
more than 300 multinational companies within the region,
playing host to nearly all the marquee and top brand names.
[4] Some of you may already have experienced Penang as a
tourist. We are a well-known tourist destination and
through careful planning, we have managed to maintain the
delicate balance between a highly urbanised, developed
state and the physical, living heritage that has made us
a UNESCO World Heritage City.
[5] With tourism itself, we are carving a niche as a leading
provider of medical tourism. About two-thirds of
national medical tourism receipts now come from Penang and
our hospitals service about 60% of the total foreign
medical tourists who come to Malaysia for healthcare. No
less than seven major private hospitals provide high
quality yet affordable healthcare to both local and
foreign patients.
[6] In addition to becoming a medical city, Penang also aims
to be a regional education hub. Today, Penang offers nine
reputable international schools and more than 30 public
and private universities and colleges.
[7] We pay close attention too to our services industry through
sectors such as tourism, healthcare, education,
hospitality, MICE (Meetings, Incentives, Conventions and

Exhibitions), property and logistics.
[8] As for the MICE industry, construction is well underway
to build the Subterranean Penang International Conference
& Exhibition Centre (SPICE), which will be a massive
underground exhibition centre with “Penang People‟s Park”
on the ground above that will include a sports arena as
well as an aquatic centre.
[9] We are also embarking on developing the Penang Tech Centre
modelled as a scientific laboratory, which will become a
public showcase of science, technology and innovation as
well as a centre for convergence of industry, innovators
and thinkers. You may be interested to know that Penang
is the only state in Malaysia to offer free wi-fi in public
places.
[10] I am personally passionate about innovation, creativity
and trade. Penang can be a center for creativity by
leveraging on our 3Ts of talent, technology and tolerance.
For a Creative Cluster to be established, we need to
protect intellectual property rights. There is no
substitute for a system of effective intellectual property
protection if we aspire to own a world-class economy. IP
systems underpin global trade and investment and will
increasingly do so. That is the reality.
[11] IP has proven itself to be a key driver of economic growth
globally. Successful commercial enterprises have shown
that by harnessing IP properly, it can be a valuable
game-changer to deliver sustained competitive advantage
for both enterprises and economies. We take full
cognisance of this and that it is essential that we fully
develop Penang as a campus for intellectual property
creators. This will be critical in our vision to transform
Penang into an international and intelligent city. The

State fully embraces the importance of intellectual
property to the future of Penang and it seems more than
apt that Penang is the host venue of a meeting of
intellectual property practitioners, most of whom, are at
the top of their game.
[12] Let me thank, in closing, the Malaysia Country Group of
the Asian Patent Attorneys Association for making the
initial bid some years ago to host this Meeting in Penang
and for successfully realising it today. No doubt much
work, effort, time and commitment have gone into planning
and organising this Meeting.
[13] Over the next few days, I hope that you will enjoy the many
programs, learning and networking opportunities which the
Council Meeting offers. I hope too that you will have some
time to explore Penang during your stay. Penang is a truly
remarkable place, like a rich, charming, old grande dame,
if I may say, full of mystery, heritage and culture but
vibrant enough to keep it fresh and exciting. And, of
course, don‟t miss the opportunity to try our local food,
for which Penang is world famous.

[1] On behalf of the Malaysian Judiciary, I extend a very warm
welcome to the distinguished participants of the 63rd
Council Meeting of the Asian Patent Attorneys Association
(“APAA”). „SELAMAT DATANG‟. It is indeed a privilege for
me to be addressing all of you at this opening session of
the Meeting on the beautiful island of Penang or “the Pearl
of the Orient”.
[2] The Right Honourable Chief Justice of Malaysia, Tun Arifin
bin Zakaria, regrets that he is unable to be with us this
evening due to work commitments. He conveys his warm

regards to all of you and wishes of success to the APAA
63rd Council Meeting and has asked that I say a few words
on his behalf.
[3] As I understand it, the Asian Patent Attorneys Association
or APAA, is a non-governmental organisation dedicated to
promoting and enhancing intellectual property protection
in the Asian region (including Australia and New Zealand).
Its members include leading intellectual property
practitioners from Asia and countries globally, using the
platform of the annual Council Meeting to network,
exchange views, debate and share information about the
most current developments in intellectual property.
[4] The importance of intellectual property as a key enabler
of productivity and economic growth has become
significantly more pronounced over the years, especially,
in this age of knowledge-based economy, production and
services.
[5] A strong and effective IP protection that will encourage
companies to bring new innovations to the market, calls
for a legal framework which not only keeps up with the rapid
developments in IP but also one which is well versed in
the intricacies of intellectual property laws and
protection. In short, a judicial system that can give
effective and efficient treatment of intellectual

property issues that comes before it.
[6] The Malaysian Judiciary, tasked with this responsibility,
has tackled it head on. In July 2007, we launched the
Intellectual Property Courts and Malaysia became one of
the first countries in the region to have specialised
courts to dispose of IP cases. At the moment there is only
one IP Court in Kuala Lumpur. As at 31 October 2014 there
are 72 cases pending in the IP Court comprising of 8 patent
cases, 2 passing off cases, 60 trade mark cases and 2 other
cases. As for the appellate Court, there are 6 appeals
pending at Court of Appeal and only 3 notice of motion for
leave to appeal pending in the Federal Court as at 31
October 2014.
[7] The Court of Appeal also has taken proactive approach to
expedite the hearing of the IP appeals. For appeals
involving interlocutory matters, the appeal will be
disposed of within 3 months from the date the appeal is
registered. For full trial appeals, the appeal is expected
to be heard and disposed of within 9 months from the date
the appeal is registered.
[8] This IP Court has been a success in view of the speedy
disposal of cases registered before it. About 85% of the
cases before the specialised IP Court are disposed of
within 9 months of filing. The remaining 15% or so are cases

such as those more complex ones which will necessarily take
longer to be ready for trial, cases which are put on hold
pending appeal on a related case and so on. Even so, these
cases continue to be tracked and they are generally
required to be disposed of under 2 years of filing.
[9] The high disposal rate of cases is not confined to the
specialised IP Court but is a statistic shared by the other
courts as well. Most of the pending cases are current,
with the exception of those sent back by the appellate
courts or those awaiting the decisions of appellate courts.
It is safe to say that the backlog of cases in the High
Courts with particular reference to Kuala Lumpur has been
eradicated.
[10] What we see today are the results of the difficult but
necessary judicial transformation programs that were
embarked upon by the Malaysian Judiciary since 2008.
[11] Efficiency in the disposal of cases is however not
everything. The Malaysian Judiciary is mindful of giving
equal emphasis to the quality of the judgments produced
by our courts. Priority is given to this without compromise.
In specialised areas such as intellectual property, this
can be challenging for our judges since the majority of
them do not have a background in intellectual property or
science.

[12] Recognising that our judges, like everyone else, will need
training and continued learning to produce quality work
and keep abreast of legal developments, we launched our
own Judicial Academy under the Judicial Appointments
Commission in December 2011. This Academy is responsible
for the continued training of our superior court judges.
Since its inception, there have been training programmes
almost every month and training is conducted by judges for
judges. I am happy to note that the Judicial Academy has
proven itself, to be an important and integral component
of the judiciary.
[13] The efforts of the Malaysian Judiciary are ongoing and
continuous. We are committed to a system which provides
independent and fair adjudication of disputes, where
litigants can be confident that justice has been done in
accordance with the law. In the field of intellectual
property this can be most significant as it is not unusual
that the disputed intellectual property rights form the
very heart and pulse of an enterprise.
[14] The Malaysian Judiciary is fully committed to a strong,
independent, efficient and knowledgeable judiciary. No
one should have any doubt about that.
[15] I wish you a very successful Council Meeting and a most
enjoyable stay in Malaysia.

Good evening. Welcome to Penang, the Pearl of the Orient.
1. On behalf of the Recognized Group of APAA Malaysia and the APAA
2014 Council Meeting Organizing Committee, it gives me great
pleasure to have this opportunity to offer you the warmest welcome to
the APAA 63rd Council Meeting in Penang.
2. It is a great honour for us to host the APAA 63rd Council Meeting in
Penang; and it is our hope that it will be an interesting and enriching
experience for all of you. The Meeting received overwhelming response
from Members and Observers from more than 70 countries; and we
had to close registration ahead of the original deadline.
3. APAA has 18 Recognized Groups. In 1990, Malaysia became the 9th
Recognized Group of APAA. We have since continued to grow and
contribute to APAA with representation in a number of Committees.
Some of you who are present here may know and remember that
members of the Malaysian Group hosted the 23rd APAA Council
Meeting, also in Penang, back in 1984. That was 30 years ago, before
we became a Recognized Group.
4. Come December 2014, APAA will be 45 years old. From a humble
beginning in 1969, APAA now has 18 Recognized Groups and more
than 2,300 members. As you are aware, the objective of APAA is to
create, promote and enhance awareness and protection of intellectual
property in the Asian region, including Australia and New Zealand. It
is my fervent hope that this year’s Meeting, just like the Meetings of
previous years, would provide a platform for Members and Observers

to form, renew and strengthen friendship, co-operation and
understanding among practitioners and patent attorneys in the area
of intellectual property laws. It is through such friendship,
co-operation and understanding that we could work together to help
create awareness, promote and develop this important area of law.
5. We live in a borderless world and as legal practitioners and patent
attorneys we must constantly recognise and acquaint ourselves with
the various changes brought about by globalization. This is important
because these changes have significantly impacted the IP regime and
our practice, and will continue to do so. Thus, a regular
re-examination of the current intellectual property regime and
practice is needed to ensure that we will be able to continue enhancing
the protection of intellectual property.
6. The APAA Council Meetings set a good tradition for Members and
Observers to meet on a yearly basis to share our ideas, knowledge and
experience with a view to finding new and more effective ways of
dealing with various legal issues in this area of law, especially new
issues which emerge as a result of the rapid and constant changes
facing us, in particular in the science and technology industry.
7. In addition to official meetings and forums, the Organizing Committee has
organized a number of social events such as Welcome Reception, Theme Night,
excursions and Gala Dinner for you.
8. I hope you would be able find some time from your busy schedule to explore
Penang during your stay here in Penang. There is so much to enjoy here - from

visiting the heritage buildings in George Town (which is listed as a UNESCO
World Cultural Heritage Site) to enjoying the beautiful beaches and the
scrumptious local cuisines. As some would say, the old and the new come
together in a wonderful way in Penang. I really hope that you will be able to
discover for yourselves the wonder of Penang during your stay here.
9. I cannot possibly end this speech without recognizing and acknowledging the
great and tireless work of all the directors of APAA Malaysia and members of
the Organizing Committee in ensuring that this Council Meeting will be a
memorable experience for everyone. Due to time constraints, please forgive me
for not acknowledging and thanking each and every one of you. Nevertheless,
I would like to specifically record my appreciation and thanks to Ms Linda

As President of the Asian Patent Attorneys Association, it is my great
honor and pleasure to welcome you all to the 63rd
Council Meeting of
our Association.
2. This meeting is graced by the attendance of over 1400 friends and

3. Malaysia became the 9th
Recognized Group of our Association in 1990.
It has since grown and actively contributed to our Association with
representation in our important Committees and even given us a
President for the term 2003/2006. Looking back in time, the
Malaysian Group members courageously hosted the 23rd
APAA Council
Meeting in Penang 30 years ago, even before they formed themselves
into a Recognized Group. Now, we are back.
4. In the last decade, a time during which Malaysia’s intellectual property
laws developed rapidly in parallel to its ratification and accession to IP
related international treaties. Prominent members of the Malaysian
Group took part in legislative reform and made valuable contributions.
Malaysia has now become one of the power houses in South East Asia.
5. (a) The various names given to Penang reflect its diversity and history.
The island of Penang was referred to as Bīnláng Yù (by the Chinese in
the 15th
Century – Ming Dynasty), Pulau Pinang (by the Portuguese in
the 16th Century), Prince of Wales Island (by the British in the 18
th
Century) and now Penang in modern Malay meaning “island of the
areca nut palm” and affectionately called “Garden of the East”. Now
Penang is Penang! Its capital, George Town, is listed by UNESCO as a
World Heritage Site.
(b) This colorful city is reflected by the beautifully decorated trishaw
which lead the procession into this hall. The trishaws is part and
partial of the living heritage of Georg Town and the most effective local
means of transport in move about in the narrow streets of the heritage
city.
6. The Malaysian Recognized Group and its Organization Committee have
been meticulous in ensuring an enjoyable and meaningful meeting for
all our participants.
7. Last year, we established the APAA Academy, Roundtable Meeting,

Conference Committee and the new Asian IP Forum. These are not
stand alone structures but they were conceived and are growing to
become inter-related parts of our internal road and bridge building
project to foster a solid platform of the further advancement of our
Association. It is our aim to further raise the professional posture of
our members in each of the respective APAA jurisdictions and play an
even more meaningful role in the world IP community in tandem with
the growth of Asia. This year, on the humanitarian side, we have
established a machinery for sustainable Charitable Donations this year
following the Yolanda typhoon which hit the Philippines. The
professional training arm of our Academy has already finished the
necessary planning and preparations for rolling out its first training
programme in the Spring of 2015 when our Bulletin will also be
published by the Publication Group within 2 months after the
Conference. The newly revamped APAA website and online system
is now being put to use for uploading materials before the conference
and updating membership directory. We are going to formally
incorporate a separate set of Election Rules to provide an efficient to
ensure that the Association can through its Council choose its future
leadership from candidate who are ready, willing and able to serve.
8. We know that while it takes 100% of our strength to get to where we are
on the building of the new structures, machinery and systems, we need
another 100% of energy to refine and perfect them.
9. While there is hard work to be done on the one hand, we do not forget
that networking and entertainment which are important too. We have
included in our official programmes excursions, lunches, dinners and
hospitality suite programme practically every night. In APAA, you can
do good networking just by taking part in our conference programme.
10. Our Association and its conference have an Asian base but with
international outlook. By our annual meeting, we bring together our
fellow members from 24 APAA jurisdictions and observers from 50
jurisdictions worldwide. Your presence adds colour to our event for
which we thank you.
In the true APAA spirit of fostering ties of mutual friendship and
understanding, I wish our conference in the next few days will bring you
good memories and fruitful relationship.

Speech at the Farewell Banquet (Day 4)
1. Ladies and gentlemen, our friends and fellow members, we have had 4
days of very enjoyable conference hosted by our Malaysia Recognized
Group. We owe our thanks to Mr. Michael Soo, Ms. Linda Wang,
their Organizing Committee and members of the Malaysian
Recognized Group for their great efforts, perseverance and generous
hospitality.
2. While we enjoy participating in the conference, having to organize 96
hours of activities for 1,500 persons is no easy job. Behind the
operations which look smooth and easy to us, there is a lot of hard
work by the Malaysian Team.
3. When I took part in their working session during the pre-conference site
visit, I could feel their enthusiasm and the dedication in giving us 4 days
wonderful event. It has been an exciting as well as a thoroughly
enjoyable conference to me. I hope you feel the same as I do.
4. Between now and our next meeting in Okinawa, Japan, there are 335
days (13-17/11/2015). During this time, we live our own lives and
work in our own offices. But friendship will connect us together until
we meet again. I wish to thank you once again for coming to our
meeting and count on your continuous support.
5. As a small token to show the appreciation of our Association for the
impeccable job done by Michael and Linda and their team, I would like
to present a small gift to Co-Chairs.
6. Michael and Linda, may I invite you to the stage.

APAA 2014: GALA BANQUET SPEECH

Good evening, everyone.
I do not have much to say except “Thank you very much” to each of you for being
here and for giving us the privilege of hosting you at this 63rd APAA Council
Meeting in Penang.
As many of you would know, this has been a turbulent year for Malaysia,
struck by the unprecedented double tragedies of MH370 and MH17. Within a
short span of 130 days, a total of 537 lives and two air crafts were lost. The
nation sank to its lowest depth in grief, sorrow, loss and pain.
Overnight, Malaysian Airlines, one of the world’s safest airlines, became a
jinxed name. Tourist and travel cancellations to Malaysia were at an all-time
high. Visit Malaysia Year 2014, which was worked on and heavily promoted
by the Government for the earlier two years, quickly became a non-event.
We feared for the worst and had serious doubts. But, you, the brothers and
sisters of our APAA family, did not disappoint. When we closed registration
in mid-October, we recorded close to 1500 registered participants and guests.
In your own small way, you showed us and a small part of Malaysia that we are
not without friends and that, things can be normal again. For that, we thank
you.

It would be unthinkable for me to end this speech without thanking all the
members of the Malaysia Group who have contributed in so many ways to put
this Meeting together. Time constraint does not permit me to name each of
you but you would know who you are. I would, however, like to specifically
mention the following members of the Malaysia Group for their untiring efforts,

Speech – Honorary President, Day 4 – Farewell Banquet (Award) 1. Following the APAA Enduring Award presentations, I would like to
announce a very important appointment by the Association.

2. At the 63rd Council Meeting of the Association this morning, a resolution was unanimously passed by the Council pursuant to Article 11.6 that “Past President Kiyoshi Asamura be elected by the Council to the position of Honorary President”.
3. This Article provides that the criteria for appointment was simply “Where
Council considers circumstances are appropriate”. It is a very low profile wording but it requires the highest standard for an individual to satisfy those words “appropriate circumstances”. This is the gold standard for receiving the highest honour which can be conferred by the Association to its members.
4. The position is for life. The Honorary President has an advisory role to
the President and Council.
5. So far, only 2 Honorary Presidents have been named by the Association. They are Mr. Masao Okabe and Mr. William Howie whose appointments were 13 years ago.
6. Mr. Asamura, affectionately called by many of us as “Mr. APAA” is one of
the founding members of the Association when it was established in 1969. He was President of the Association for 2 terms of 3 years from 1994 to 2000. The contributions made by him and his office to the Association have been invaluable.
7. His nomination by Past President Alonzo Ancheta and Advisory
Committee Member Kingson Lai was unanimously endorsed by all members of the ExCom and AdCom and further unanimously approved by the Council. The conferment of this life-time title of Honorary President of APAA to Mr. APAA is a well-deserved award for his 45 years of outstanding contributions and devotion to the Association.
8. May I now invite Mr. Asamura to come onto the stage to receive a dragon
plate from the Association to mark this happy occasion. 9. [Presentation to dragon plate to Mr. Asamura].
10. Would you like to say a few words to our members.
Honorary President Asamura presented his address on this occasion as
follows:

“President Kwong, APAA members, Guests, and Observers.
It is my great honor to be elected as an Honorary President of the APAA.
I thank all of you.
Back to the formation of the APAA, I was one of the JPAA members who
proposed to establish the Asian Patent Attorneys Association to patent
attorneys from Korea and Taiwan in order to attend the Diplomatic Conference
on the PCT in May 1970.
Although, the time for preparation was very short and limited, it is very
fortunate that the APAA was established on December 26, 1969 and was invited
to the PCT Diplomatic Conference. I was one of the 8 delegates from the APAA.
I was elected as the 5th President of the APAA at the Niigata General
Assembly in 1994.
It was very fortunate that the inaugural President Dr. Yuasa, the 3rd
President Mr. Masao Okabe and the 4th President Mr. Howie attended the
Niigata meeting. We missed the 2nd President Mr. Inomata who had
unfortunately passed away before the Niigata meeting. We took a memorial
photograph of the four presidents of the APAA in Niigata.
I was re-elected as the President of the APAA in 1997 and stepped down in
2000.
During my six years as the President, Council members, Committee
members, guests and observers helped me greatly and cooperated with
developing the growth of APAA activities.
Now, speaking of a private matter, this year is a special year for me. I
became 77 years old this year. 77 is a happy number in Japan and perhaps in
Taiwan also. We call it KIJU for the 77th birthday and I celebrated my KIJU
last January.
Further, November 23, 2014 will be the 50th Anniversary of our wedding.

My wife and I will celebrate our Golden Wedding Anniversary on that day.
President Kwong! Thank you very much again for giving me this award
of Honorary President of the APAA.
In closing, I will continue to make every effort to the further growth of the
APAA.
