SUBJECT : Complete Staff Work for the Proposed Omnibus Guidelines on the Regulation of Operations of Parent-Teacher Associations (PTAs)

I. Background

1.1 The Parent-Teacher Associations (PTAs) have been one of the primary partners of the Department of Education (DepEd) in promoting the welfare of the learners and in helping to ensure the delivery of quality basic education services. Over the years, PTAs have been actively involved in school improvement planning activities and many innovative programs and projects utilizing resources available in the community.

1.2 The active and collaborative engagements among parents, teachers, and the

school community are critical for ensuring the welfare of the learners. The State recognizes this invaluable partnership through Presidential Decree (PD) 603 (Child and Youth Welfare Code of 1974). Specifically, PD 603, Article 77, called for a Parent-Teacher Association (PTA) formation in every school community and stated:

1.2.1 Every elementary and secondary school shall organize a parent-teacher

association for the purpose of providing a forum for the discussion of problems and their solutions, relating to the total school program, and for ensuring the full cooperation of parents in the efficient implementation of such program. All parents who have children enrolled in a school are encouraged to be active members of its PTA, and to comply with whatever obligations and responsibilities such membership entails.

1.2.2 Parent-Teacher Association all over the country shall aid the municipal

and other local authorities and school officials in the enforcement of juvenile delinquency control measures, and in the implementation of programs and activities to promote child welfare.

1.3 The Batas Pambansa (BP) 232 (Education Act of 1982) emphasizes the rights

of parents to organize themselves and/or with teachers, thereby establishing a forum for discussion of their duties and concerns in the education of their learners. Corollary to this, DepEd issued the first major policies on the organization of PTAs: DECS Order Nos. 67 and 98, s. 1998. These Orders

provide guidelines governing the Parents and Teachers Association (PTA) and Parents, Teacher, and Community Association (PTCA).

1.4 With particular attention in organizing the PTA, election guidelines, and

learner participation, Republic Act (RA) No. 9155 (Governance of Basic Education Act of 2001), along with the issuance of DepEd Order (DO) No. 54, s. 2009 (Revised Guidelines Governing Parents-Teachers Associations at the School Level); DO No. 58, s. 2009 (Designating a Focal Office to Handle Concerns and Activities Relative to Parents-Teachers Associations and its Federations), as amended by DO No. 22, s. 2011; DO No. 77, s. 2009 (Guidelines for the Conduct of Elections of the Parents-Teachers Associations at the School Level and their Federations), as amended by DO No. 83, s. 2010; and DO No. 117, s. 2009 (Pupil and Student Participation in the Parents-Teachers Associations), established the importance of this matter.

1.5 Among the important roles of PTA, its membership in the Local School Board

(LSB) that administers the utilization of the Special Education Fund (SEF) and gives the LSB the opportunity to perform its tasks and directives with its stakeholders is one of its primary functions.

1.6 The PTA can serve as an avenue in addressing school-learner-related

problems, offering action-based solutions, and providing necessary activities for the learners and the school in general. While parents’ involvement with the school contributes to ensuring the implementation of initiatives to improve the welfare of the learners, there have been clear limitations on how previous DepEd issuances safeguarded this partnership and addressed the concerns of the PTAs. Over the years, PTA-related concerns increased and became more complex which in effect impacted the implementation of programs to improve learner performance.

1.7 Currently, the PTAs are governed by various DepEd policies, rules, and

regulations since 1998 which have not been consolidated and/or harmonized to properly guide our school heads, the local school boards, teachers, and parents/guardians alike into effectively supporting the learning of children at the basic education level.

1.8 The situation is exacerbated by the occurrence of the global Covid-19

pandemic that struck the country in March 2020. Since then, the delivery of basic education services took a major shift in policies and strategies with the adoption of remote learning to which the public school system and most private schools are not accustomed to. Despite the lack of resources and capacity, public and private basic education schools, the learners, including parents and teachers, quickly adapted to the challenges of the pandemic. As these events unfolded, most of the PTA activities have been set aside, and PTAs have not been as active and supportive for lack of clarity and guidance on how to help facilitate learning or conduct affairs in a school where the delivery of education is strictly online.

1.9 Thus, the proposed Omnibus Guidelines on the Regulation of Operations of

Parent-Teacher Associations is herein submitted to:

1.9.1 promote harmonious, active, and collaborative engagement among teachers, parents, and the community in the implementation of school programs for learners’ welfare;

1.9.2 establish the crucial roles of the PTA as a dynamic school-based association concerned with partnership and programs for the best interest of the learners (e.g., facilitating parent-teacher partnership, participating in discussions for learners’ welfare, and engaging in developing and implementing school programs);

1.9.3 articulate the distinct roles and responsibilities of PTA members;

1.9.4 streamline the processes for managing PTA affairs at the different levels which include, among others: (i) election of PTA officers consisting of parent/guardian- and teacher-members under different modalities; (ii) requirements and privileges bestowed upon recognized PTAs; (iii) conduct of meetings for General Assembly and special occasions; (iv) undertaking of fundraising projects; and (v) financial management and transparency of PTA operations and the concomitant accountability of its officers; and

1.9.5 update and harmonize DepEd policies and guidelines on PTA for clarity and consistency.

1.10 In developing these guidelines, a total of twenty-one (21) DepEd Orders

and memos were reviewed; 7 laws were consulted; 2 consultation meetings participated in by nineteen (19) stakeholders (select DepEd Central Office personnel, ExeCom and ManCom members, and 2 PTA officials) and a key informant interview with a school head were conducted; and at least forty (40) internal meetings transpired over a period of three (3) months by the team working on the draft. The document also contains at least ten (10) provisions applicable to private and non-DepEd-managed basic education schools.

II. Clear Statement of the Request

2.1 We respectfully furnish herewith the proposed Omnibus Guidelines on the Regulation of Operations of Parent-Teacher Associations (PTAs) for your review, comments, and/or recommendations. This document consists of the following:

2.1.1 Draft DepEd Order on the Adoption of the Proposed Omnibus PTA Guidelines of 2021 (Attachment 1); and

2.1.2 Omnibus Guidelines on the Regulation of Operations of PTAs (Attachment 2).

1. The Parent-Teacher Associations (PTAs) have been one of the primary partners of the Department of Education (DepEd) in promoting the welfare of the learners and in helping to ensure the delivery of quality basic education services.

With the occurrence of the global COVID-19 pandemic that struck the country in

March 2020, the delivery of basic education services took a major shift in policies and strategies with the adoption of remote learning to which the public school

system and most private schools are not accustomed to. Despite the lack of resources and capacity, public and private basic education schools, the learners,

including parents and teachers, quickly adapted to the challenges of the pandemic.

2. As these events unfolded, most of the PTA activities have been set aside and PTAs have not been as active compared prior to pandemic situation due to the

various Inter-Agency Task Force (IATF), Department of Health (DOH) and other relevant agencies’ protocols on the conduct of meetings and gatherings, among

others. While DepEd has conducted several PTA orientation activities equipping them on the critical roles of parents in ensuring that learning shall continue

despite the COVID-19 situation and that the Basic Education Learning Continuity

Plan (BE-LCP) shall be successfully implemented - there is still a need to provide clarity and guidance on how PTA as an organization may help facilitate learning or

conduct affairs in a school where education is delivered primarily through distance learning modality. Health and education experts say that blended learning (and the

way we conduct our activities and meetings) should still continue even during a post COVID-19 pandemic situation.

3. Currently, the PTAs are governed by various DepEd policies, rules, and regulations since 1998. Aside from the fact that such issuances may no longer be updated or responsive to addressing the above challenges and the other issues and

concerns of PTAs brought by the new normal, these issuances have not been consolidated and/or harmonized to properly guide our school heads, the local

school boards, teachers, and parents/guardians alike into effectively supporting

the learning of children at the basic education level.

4. In light of the foregoing considerations, the Omnibus Guidelines on the Regulation of Operations of Parent-Teacher Associations (PTAs) or otherwise

known as the “Omnibus PTA Guidelines of 2021” is hereby issued to:

a) promote harmonious, active, and collaborative engagement among teachers, parents, and the community in the implementation of school

programs for learners’ welfare;

b) establish the crucial roles of the PTA as a dynamic school-based association concerned with partnership and programs for the best

interest of the learners (e.g., facilitating parent-teacher partnership,

participating in discussions for learners’ welfare, and engaging in developing and implementing school programs);

c) articulate the distinct roles and responsibilities of PTA members;

d) streamline the processes for carrying out PTA affairs at the different

levels which include, among others: (i) election of PTA officers consisting of parent/guardian- and teacher-members under different modalities; (ii)

requirements and privileges bestowed upon recognized PTAs; (iii)

conduct of meetings for General Assembly and special occasions; (iv) undertaking of fundraising projects; and (v) financial management and

transparency of PTA operations and the concomitant accountability of its officers; and

e) update and harmonize DepEd policies and guidelines on PTA for clarity

and consistency.

5. All DepEd orders, memoranda, rules, and regulations, which are inconsistent with this Order are hereby repealed, rescinded, or modified

accordingly.

Section 3. Statement of Policy 1 2

3.1 Every public and private basic education school shall organize 3 a PTA to provide a forum for the discussion of issues and their 4 solutions relative to the total school program, and to ensure the 5 full cooperation of parents/guardians in the efficient 6 implementation of such programs. 7

8 3.2 Every PTA shall adhere to the guidelines on the conduct of 9

elections of PTAs as well as the duties and responsibilities 10 prescribed under these Omnibus PTA Guidelines of 2021. 11

12 3.3 Every PTA shall provide mechanisms to: a) open an avenue for 13

the discussion of relevant concerns, b) provide assistance and 14 support to the school for the promotion of their common 15 interest, c) facilitate conflicts/disputes resolutions and 16 sanctions, and d) safeguard and manage financial matters. 17

18 3.4 Every PTA shall coordinate with community members, local 19

government units (LGUs), civic organizations, and other 20 stakeholders to achieve school and community development 21 plans. 22

23 3.5 Every PTA shall aim towards recognition and maintenance of 24

its status to maximize privileges and conduct activities 25 exclusive for recognized PTAs. 26

27 3.6 DepEd, through the school, division, region, and central office 28

shall monitor and provide guidance on the establishment and 29 operations of PTAs. 30

33 4.1 The Omnibus PTA Guidelines of 2021 encompasses the 34

directives for the central, regional, school division offices, and 35 all public schools offering the K to 12 Basic Education Program 36 in effectively regulating the operations of PTAs. 37

38 4.2 These guidelines likewise cover all private and non-DepEd- 39

managed basic education schools, where applicable. 40 41 4.3 These guidelines involve several stakeholders but limited to 42

parents/guardians, teachers, school heads, and non-teaching 43 personnel in organizing and managing the PTAs from the 44 school level up to the provincial PTA federations. 45

46 Section 5. Definition of Terms 47

48 The following terms are described as follows: 49

50 5.1 Guardian. Refers to a person who is either: 51

52 5.1.1 an individual, authorized in writing by the biological 53

parent/s, to whom the care and custody of the learner 54 has been entrusted; 55

5.1.2 a relative of the learner within the fourth degree of 1 consanguinity or affinity: Provided that, said relative has 2 the physical care and custody over the learner and said 3 relative is living in the same household as the learner; 4

5 5.1.3 an individual appointed by a competent court as the legal 6

guardian of the learner; 7 8 5.1.4 an individual who holds a certification from the barangay 9

stating that the learner is staying with the guardian, and 10 is providing financial support and resources together 11 with an affidavit of two disinterested persons; or 12

13 5.1.5 in the case of an orphan, the individual/institution 14

who/which has the care and custody of the learner. 15 16 To distinguish from a parent-member of a PTA, a guardian may 17 also be called the guardian-member of the PTA. 18

19 5.2 Homeroom. Refers to a section or a class of learners with a 20

class or teacher/adviser as the facilitator in-charge. 21 22 5.3 Homeroom Adviser. Refers to the teacher-facilitator in charge 23

of a homeroom or a class who may also be called as a class 24 adviser. 25

26 5.4 Parent. Refers to the natural or biological father or mother, or 27

legal adoptive father or mother of a learner currently enrolled 28 in a school. To distinguish from a teacher-member of a PTA, a 29 parent may also be called the parent-member of the PTA. 30

31 5.5 Presiding officer. Refers to an individual who has direct 32

supervision over the conduct of elections that includes 33 initiation of run-off elections and draw lots. 34

35 5.6 Quorum. Constitutes such number of members or officers 36

present in a meeting or General Assembly (GA) to set a formal 37 meeting in motion, as well as to pass or to adopt a resolution, 38 as provided hereof. 39

40 5.7 Recognition. Refers to the process of extending support and 41

assistance to the PTA by the school head to demonstrate an 42 effective school-community partnership, subject to meeting 43 certain requirements under these guidelines. 44

45 5.8 Remote Communication. Refers to the transfer of data between 46

two or more devices not located at the same site. It shall also 47 refer to a conference telephone or similar communications 48 equipment, SMS/MMS, Viber, Facebook Messenger, and other 49 similar messaging application systems that will allow all 50 persons participating in the meeting to communicate with each 51 other at the same time. 52

53 5.9 Run-off election. Refers to another round of election to 54

determine the winner among three (3) or more candidates in a 55 tie from the first round of election. 56

5.10 School Improvement Plan (SIP). Refers to a roadmap that 1 outlines specific interventions that a school, with the help of 2 the community and other stakeholders, will undertake within 3 a period of three (3) consecutive school years. It aims to improve 4 the teaching and learning process and promote partnership 5 with community stakeholders. 6

7 5.11 Teacher-member. Refers to all teachers in a school, as defined 8

under Republic Act (RA) 4670 (Magna Carta for Public School 9 Teachers Act) and RA 7836 (Philippine Teachers 10 Professionalization Act of 1994) as amended by RA 9293 who 11 are members of the PTA. For purposes of these guidelines, all 12 teaching-related and non-teaching personnel shall also be 13 considered as teacher-members. 14

15 Private and non-DepEd-managed basic education schools may 16 adopt a different definition for teacher-members by excluding 17 teaching-related and non-teaching personnel from the above 18 definition. 19

20 5.12 Voluntary School Contributions (VSCs). Consistent with 21

DepEd’s “No Collection Policy,” refers to the voluntary 22 contributions that may be collected at any time during the year 23 by parents/guardians to fund activities of certain organizations 24 (e.g., Boy Scouts of the Philippines, Girl Scouts of the 25 Philippines, Philippine National Red Cross, Anti-TB Fund 26 Drive, PTAs, School Publication, learners’ organizations), as 27 well as to support activities identified in the SIP in pursuit of 28 continuous improvement. 29

30 II. THE SCHOOL PTA 31 32

Section 6. Organizing the School PTA 33 34

The PTA mainly serves as a forum for discussing school-learner-35 related problems and their solutions while ensuring 36 parents/guardians’ full cooperation in efficiently implementing the 37 school programs. The collaborative effort and involvement among 38 PTA members have resulted in favorable impact on learners and 39 school programs designed for them. In relation to Section 11.5.1 40 hereof, the School PTA Board of Directors (BOD) may adopt its own 41 by-laws to provide additional guidelines on the operation and 42 organization of the School PTA: Provided that, such by-laws are not 43 inconsistent with existing laws, these guidelines, and other relevant 44 DepEd issuances on the matter. 45

46 Section 7. Composition of School-Level PTAs 47

48 7.1 Homeroom PTA (HPTA). Refers to the PTA organized at the 49

classroom level. The HPTA shall be composed of all 50 parent/guardian-members and homeroom advisers. Subject to 51 Sections 10 and 14 hereof, the HPTA shall elect from among its 52 parent/guardian-members the following set of officers: 53 President, Vice-President, Secretary, Treasurer, Auditor, and 54 other positions it may deem necessary by a majority vote of 55

those present during the election. The HPTA officers shall 1 exercise similar functions stated under Sections 11.5 and 11.6 2 over their respective homerooms. 3

4 7.2 Grade Level PTA (GrPTA). Refers to the PTA organized in each 5

grade level, which shall be composed of all parent/guardian-6 members and teacher-members of a particular grade level. 7 There is hereby created a GrPTA Council of Representatives 8 (GrPTA-CoR), composed of all Presidents of the HPTA in each 9 grade level. The GrPTA-CoR shall elect, from its members, a 10 Grade Level Representative to constitute the GrPTA who shall 11 represent their respective grade levels in School PTA activities. 12 A permanent alternate shall be elected per grade level in the 13 absence of the GrPTA Representatives. 14

15 7.3 School PTA (SPTA). Formerly known as the General PTA, refers 16

to the PTA organized at the school level which shall be 17 composed of all parent/guardian-members and teacher-18 members of the school. 19

20 7.3.1 SPTA-BOD. There is hereby created an SPTA-BOD, which 21

shall be composed of all duly elected GrPTA 22 representatives and teacher-representatives to the BOD. 23 24 7.3.1.1 SPTA Executive Committee (EXECOM) Officers. 25

Subject to Sections 10, 11.6, and 14 hereof, the 26 SPTA-BOD shall elect from among its 27 parent/guardian-members and teacher-members 28 the following set of officers who will comprise the 29 SPTA-EXECOM: President, Vice-President, 30 Secretary, Treasurer, Business Manager, Auditor, 31 and other positions it may deem necessary by a 32 majority vote of those present during the election. 33

34 7.3.2 SPTA GA. The SPTA GA shall be composed of all 35

parent/guardian-members and teacher-members of the 36 school as defined under Sections 5.1, 5.4, 5.11, and 12 37 hereof. 38

39 Other members of the community may be invited or 40 consulted (e.g., local government officials, civic 41 organizations, and school-based learner organizations) to 42 solicit their support or active participation in school 43 activities. 44

45 Section 8. Membership in a PTA 46

47 8.1 Membership in a PTA shall be limited to parents, or in their 48

absence, the guardians of duly enrolled learners, as well as 49 teaching, teaching-related, and non-teaching personnel in a 50 basic education school, whether public or private. 51

52 8.2 Guardians of learners may also hold a position in the 53

Homeroom, Grade Level, and/or School PTAs. 54 55

8.3 A teacher-member elected as a member of the BOD may not be 1 elected as an EXECOM Officer, except as Secretary of the SPTA. 2 The school head shall only serve as adviser to the SPTA. 3

4 8.4 A teacher-member with a child enrolled in a certain school may 5

only participate in HPTA, GrPTA, and SPTA as a 6 parent/guardian-member. 7

8 8.5 A school head may be elected as a PTA officer of another school, 9

except for the position of SPTA President, where his/her child 10 is enrolled. 11

12 8.6 Membership in the PTA shall not be restricted by the non-13

payment of the PTA membership dues, which shall be purely 14 on a voluntary basis. 15

16 Section 9. Duties and Responsibilities of PTA Members 17

18 9.1 Parent/Guardian-Members 19

20 9.1.1 attend PTA meetings, including general assemblies; 21 22 9.1.2 participate in the election of PTA officers; 23 24 9.1.3 actively support and participate in PTA programs, 25

projects, and activities; 26 27 9.1.4 monitor learner performance and provide feedback to the 28

teacher concerned; 29 30 9.1.5 support teachers in their teaching and non-teaching 31

duties; 32 33 9.1.6 help the school to implement programs and projects 34

including, but not limited to Brigada Pagbasa, Brigada 35 Eskwela, Gulayan sa Paaralan Program, monitor 36 attendance of learners at risk of dropping out, and 37 promote health and nutrition programs; 38

39 9.1.7 give feedback on school policies and programs for 40

consideration of homeroom adviser and/or school 41 authorities; 42

43 9.1.8 help promote DepEd advocacies, campaigns, and other 44

programs on ensuring the delivery of quality education; 45 and 46

47 9.1.9 perform such other duties and responsibilities, which 48

may be promulgated by the SPTA and the school subject 49 to the existing laws, policies, and DepEd rules and 50 regulations. 51

9.2 Teacher-Members 1 2

9.2.1 monitor learner performance and provide 3 feedback/observations to the parent/guardian-4 members; 5

6 9.2.2 support and actively participate in PTA programs, 7

projects, and activities; 8 9 9.2.3 for teacher-members who are also homeroom advisers, 10

conduct regular HPTA meetings, attend general 11 assemblies, and ensure compliance with the reportorial 12 requirements of the HPTA as stated in Section 20.2.10; 13 and 14

15 9.2.4 perform such other duties and responsibilities which 16

may be promulgated by the SPTA and the school subject 17 to the existing laws, policies, and DepEd rules and 18 regulations. 19

20 Section 10. Election of Officers of School-Level PTAs 21

22 10.1 Voting Rights. The right of a member to vote may be limited, 23

broadened, or denied subject to valid cause and the extent 24 specified in the by-laws. Unless so limited, broadened, or 25 denied, each member shall be entitled to one (1) vote. The 26 by-laws may likewise authorize voting through physical 27 (face-to-face), remote communication, and hybrid elections 28 (combination of physical and remote communication 29 modalities). 30

31 During the conduct of elections, a parent/guardian-member 32 shall be entitled to one (1) vote per learner enrolled in the 33 school. Thus, while the father and mother of a learner may 34 be both considered as parent-member, the two (2) parent-35 member representing one learner in the HPTA shall only be 36 entitled to one (1) vote. 37

38 10.2 No Proxy Voting. No proxy or absentee voting shall be 39

allowed. No parent/guardian or member of a decision-40 making body may delegate his/her voting power to a 41 representative to enable a vote in his/her absence. 42

43 10.3 The Election Committee (ELECOM) 44

45 10.3.1 A 7-member Election Committee (ELECOM) is hereby 46

created and shall be convened by the school head 47 every start of the School Year (SY) and shall serve 48 until the end of SY. The ELECOM shall have over-all 49 supervision over the conduct of the HPTA and GrPTA 50 elections, and direct supervision over the conduct of 51 election of the SPTA-EXECOM Officers and teacher-52 representatives to the BOD. 53

The ELECOM shall be composed of the following: 1 2 10.3.1.1 School head as Chairperson; and 3

4 10.3.1.2 Two (2) teachers and four (4) parent/ 5

guardian-members as members. 6 7

10.3.2 Membership to the ELECOM must meet the following 8 criteria: 9

10 10.3.2.1 must be a person of known probity, 11

honesty, integrity, competence, and 12 independence; 13

14 10.3.2.2 must not currently hold any position in the 15

PTA; and 16 17

10.3.2.3 must not have the intention to run for any 18 position in the PTA during the current SY. 19

20 10.3.3 The ELECOM shall prepare the Notice of Meeting for 21

the election of officers of the HPTA, GrPTA, and 22 SPTA-BOD and EXECOM. The Notice shall also 23 include the following: 24

25 10.3.3.1 date of notification; 26 27 10.3.3.2 meeting agenda; 28 29 10.3.3.3 list of positions to be filled and its respective 30

duties and responsibilities as stipulated in 31 their by-laws, if the SPTA has any; 32

33 10.3.3.4 date, time, and venue of the meeting; and 34 35 10.3.3.5 mode of communication for the conduct of 36

the meeting (physical or face-to-face, 37 remote, or hybrid communication). 38

39 The ELECOM shall determine the most 40 appropriate mode of the conduct of the 41 meeting. In case of election through remote 42 or hybrid communication, the ELECOM 43 shall test the meeting platform to be chosen 44 to ensure that the activities will run 45 smoothly. 46

47 10.3.4 The ELECOM, through the homeroom adviser, shall 48

disseminate the Notice of Meeting at least ten (10) 49 calendar days prior to the date of the election, 50 through available and appropriate dissemination 51 strategies such as: (i) giving of notice slip to learners, 52 (ii) posting in the school’s bulletin board or other 53 conspicuous places within the school campus, (iii) 54 posting in the official social media page of the school, 55 or (iv) sending text messages/calls, chats, emails, 56

and/or (v) other communication platforms, as 1 applicable. 2

3 10.3.5 On or before the stated date of election and 4

consistent with Section 12.1.2 hereof, the ELECOM 5 shall orient the parent/guardian-members on the 6 election procedures for all PTA officers, as well as the 7 roles and responsibilities of the PTA. 8

9 10.3.6 The ELECOM shall: 10

11 10.3.6.1 adopt rules and regulations that will ensure 12

free, honest, and orderly election, whether 13 regular or run-off elections; 14

15 10.3.6.2 designate the homeroom advisers as 16

election presiding officers to help ensure 17 that election procedures, requirements, 18 and timelines are strictly followed, 19 including the verification of identity of 20 voting PTA members; 21

22 10.3.6.3 ensure that no proxy voting is allowed; 23 24 10.3.6.4 rule on any question or protest regarding 25

the conduct of the elections; and 26 27 10.3.6.5 proclaim all duly elected PTA officers. 28

29 10.3.7 Immediately after the proclamation of the winners or 30

upon resolution of any election protest, the ELECOM 31 shall turn over all the election results and materials 32 to the homeroom adviser in case of the HPTA, and to 33 the school head in case of the GrPTA and the SPTA, 34 for safekeeping and documentation, subject to the 35 provisions of RA 10173 (Data Privacy Act of 2012) 36 and the Executive Order on Freedom of Information. 37

38 10.3.8 The ELECOM may also promulgate and issue 39

additional guidelines relative to the conduct of PTA 40 elections that are consistent with these and other 41 existing guidelines. 42

43 10.4 Election Timelines 44

45 10.4.1 The indicative dates of PTA elections shall be 46

included in the annual calendar of school activities. 47 The conduct of PTA elections of the new set of officers 48 for HPTA, GrPTA, and SPTA-BOD and EXECOM shall 49 be held within thirty (30) calendar days from the start 50 of SY. 51

52 10.4.2 A GA shall be convened by the incumbent BOD prior 53

to the election. Such GA may be held on the same 54 date or before the actual date of election: Provided 55 that, the GA and the election shall occur within thirty 56

(30) days from the start of the SY consistent with 1 Section 12.1.2. 2

3 10.5 Election Procedures. The conduct of HPTA, GrPTA, and SPTA 4

elections shall be undertaken in accordance with the Notice 5 of Meeting issued by the ELECOM, including all the 6 procedures prescribed in these guidelines. 7

8 10.5.1 For HPTA elections, the homeroom adviser shall sit 9

as the presiding officer as designated by the 10 ELECOM. For GrPTA elections, the ELECOM shall 11 designate a presiding officer from among the grade 12 level homeroom advisers who is the most 13 knowledgeable of the election procedures. This 14 presiding officer shall have the following 15 responsibilities: 16

17 10.5.1.1 supervise the conduct of elections; 18 19 10.5.1.2 conduct the voting in the designated polling 20

place and administer the counting of votes; 21 22 10.5.1.3 maintain order within the polling place and 23

its premises; 24 25 10.5.1.4 ensure the integrity and secrecy of all 26

documents related to the conduct of 27 election; and 28

29 10.5.1.5 facilitate and perform other functions for 30

the smooth implementation of the voting 31 process. 32

33 10.5.2 Subject to confirmation by the ELECOM, the 34

presiding officer may designate a parent/guardian-35 member to assist in the conduct of the election: 36 Provided that, such parent/guardian-member shall 37 be disqualified from any HPTA nomination or to run 38 for any HPTA position. 39

40 10.5.3 In case of absence of the homeroom adviser as 41

presiding officer on the day of the election, the 42 ELECOM shall designate any homeroom adviser of 43 the same or adjacent grade level who completed the 44 HPTA election for his/her advisory class, and who is 45 willing to serve as a substitute presiding officer. 46

47 10.5.4 A vote for a particular candidate shall be counted 48

and recorded by the ELECOM as valid. Any 49 succeeding vote for the same candidate from the 50 same voter shall be considered void and shall be 51 rejected outright. 52

53 10.5.5 In case of a tie between two (2) candidates, the 54

winner shall be selected by a toss coin. 55 56

10.5.6 If the tie consists of three (3) or more candidates, a 1 run-off election shall be immediately held to break 2 the tie. The HPTA members shall vote for one of the 3 candidates in a tie during the first round of the 4 election, and the one who garnered the most number 5 of votes wins. In case another tie emerges which 6 involves three or more candidates, the process of 7 run-off election shall be repeated until one of the 8 candidates garners more votes than the other tied 9 candidates. 10

11 10.5.7 After the election of HPTA officers, the duly elected 12

HPTA Presidents of each grade level shall convene as 13 the GrPTA-Council of Representatives (GrPTA-CoR) 14 and elect a GrPTA representative and his/her 15 permanent alternate to the BOD. 16

17 10.5.8 Consistent with Section 11.2, the ELECOM shall 18

convene all homeroom advisers to elect their teacher-19 representatives to the BOD prior to electing the 20 SPTA-EXECOM Officers. 21

22 10.5.9 After electing the GrPTA Representatives and the 23

teacher-representatives, the ELECOM shall organize 24 the BOD and carry out the election of the SPTA-25 EXECOM Officers in Section 7.3.1.1. 26 27

10.5.10 Without prejudice to Section 10.7 hereof on election 28 protest, the ELECOM shall formally proclaim all the 29 newly elected officers consisting of: 30

31 10.5.10.1 SPTA-EXECOM Officers; 32 33 10.5.10.2 SPTA-BOD; 34 35 10.5.10.3 GrPTA-CoR; and 36 37 10.5.10.4 HPTA Officers. 38

39 10.5.11 Any issues/concerns affecting the validity of the 40

elections shall be referred immediately to the 41 ELECOM for resolution. 42

43 10.5.12 The presiding officer during the election of HPTA and 44

GrPTA officers shall submit to the school head the 45 following documents within 48 hours from the date 46 of the election: 47

48 10.5.12.1 approved minutes of the election meeting; 49 50 10.5.12.2 attendance sheet; 51 52 10.5.12.3 election results; 53 54 10.5.12.4 list of newly elected officers of the HPTA 55

and GrPTA; and 56

10.5.12.5 picture documentation of the election 1 process. 2

3 10.5.13 The ELECOM shall also ensure that the same set of 4

above-enumerated documents, with respect to the 5 election of SPTA-EXECOM Officers and the teacher- 6 representatives to the BOD, are maintained and shall 7 form part of the SPTA records to be kept by the school 8 head. 9

10 10.5.14 The school head shall verify and certify the validity of 11

the election results within one (1) week from the date 12 of the submission of election-related documents, 13 including other ELECOM documents generated by 14 administering the election procedures (e.g., decided 15 election protests). 16

17 10.5.15 Upon compliance with Section 10.5.10 and the 18

preceding section, the school head shall present the 19 newly elected set of officers who shall then take their 20 respective oaths of office. On the same occasion, the 21 previous set of officers shall turn over all cash, 22 records, properties, and other accountabilities to the 23 newly elected officers. 24

25 10.5.16 The documents enumerated under Sections 10.5.12 26

and 10.7, and the verification and certification of 27 their validity under Section 10.5.14 are provided 28 under these guidelines for records/documentation 29 purposes only. Failure to satisfy the same will not 30 invalidate the proclamation of the winners of election 31 by the ELECOM. Accordingly, the school head shall 32 still proceed with the presentation of the newly 33 elected set of officers, the taking of their respective 34 oaths of office, and the turnover of cash, records, 35 properties, and other accountabilities to the newly 36 elected officers, notwithstanding non-compliance 37 with Sections 10.5.12 and 10.5.14 hereof. 38 39

10.5.17 Conflict of Interest. No two (2) HPTA Officers related 40 within the fourth civil degree of consanguinity or 41 affinity shall be elected as representatives to the 42 GrPTA in the same SY. 43

44 10.6 Modes of Elections. The conduct of PTA election at all levels 45

(HPTA, GrPTA, SPTA, and FPTA) may be undertaken 46 through any of the following modalities: by physical election 47 (face-to-face), by remote communication (online and offline), 48 and by hybrid procedures (combination of physical and 49 remote communication modalities) as deemed practicable. 50

51 10.6.1 Physical Election (face-to-face) 52

53 10.6.1.1 PTA members shall convene in the 54

designated location at the time set forth in 55

the Notice of Meeting issued by the 1 ELECOM. Upon arrival at the venue, PTA 2 members shall sign the attendance sheet 3 to record their attendance and to 4 determine the presence of a quorum. 5

6 10.6.1.2 If a quorum is met, the ELECOM shall 7

proceed with the conduct of the election as 8 earlier stated in the Notice of Meeting. The 9 presiding officer shall have direct 10 supervision over the conduct of election of 11 the HPTA officers and GrPTA 12 representatives, which shall be done either 13 by viva voce or secret ballot. Whereas, 14 the election of SPTA and Federated PTA 15 (FPTA) officers shall be done by secret 16 ballot. 17

18 10.6.1.3 In case of a tie, as mentioned in Section 19

10.5.5, a toss coin shall be immediately 20 done in the presence of the candidates. 21

22 10.6.2 Election by Remote Communication 23

24 PTA members who cannot physically attend 25 meetings or cast a vote during elections may 26 participate through remote communication such as 27 online (audio/video conferencing) or offline 28 (SMS/text messaging/phone calls). PTA members 29 shall immediately notify the presiding officer as to 30 whether he/she will attend or vote through remote 31 communication. The requirements enumerated 32 under Section 13.1.4 hereof on the conduct of 33 meetings by remote communication shall also be 34 complied with by a PTA member who wishes to 35 participate in an election by remote communication. 36

37 10.6.2.1 Election by Online Procedures 38

the conduct of 16 election of the 17 HPTA Officers and 18 GrPTA 19 Representatives, 20 by viva voce; and 21

22 10.6.2.1.2.4 call the names of 23

the present PTA 24 members based 25 on the completed 26 attendance sheet 27 to enable them to 28 cast their votes. 29

30 10.6.2.1.3 In the case of the SPTA/FPTA, 31

the election will be done 32 through secret ballots using 33 direct messaging applications 34 (i.e., SMS, Viber messaging, 35 WhatsApp, Facebook 36 Messenger, and other reputable 37 applications) submitted directly 38 to the presiding officer. 39

40 10.6.2.1.4 In case of a tie, a toss coin shall 41

be immediately administered by 42 the presiding officer as 43 mentioned in Section 10.5.5 44 and captured through real-time 45 video conferencing in such a 46 manner that the entire process 47 is visible on camera to 48 determine fairness and 49 transparency of the 50 proceedings. 51

10.6.2.2 Election by Offline Procedures – is a type 1 of communication without internet 2 connectivity. Under this mode, 3 communications may be exchanged by 4 means of SMS/text messages and/or voice 5 calls. The presiding officer shall: 6

7 10.6.2.2.1 verify the mobile number of PTA 8

members, determine who 9 among them will participate in 10 the election either through text 11 messaging or phone call and 12 ensure that the policy on no 13 proxy voting under Section 10.2 14 shall be strictly observed; 15

16 10.6.2.2.2 ensure that all members can 17

participate, read, and/or hear 18 the discussions during the 19 meeting; 20

21 10.6.2.2.3 send a text message explaining 22

the processes and rules of the 23 election through remote 24 communication to ensure the 25 integrity and smooth conduct of 26 the elections. The text message 27 shall also include the names of 28 parent/guardian-members in 29 their respective homerooms as 30 reference for nomination; 31

32 10.6.2.2.4 allot 10 to 20 minutes to gather 33

nominations per position from 34 the parent/guardian-members 35 either through text messaging 36 or phone call; 37

38 10.6.2.2.5 consolidate the name of 39

nominees for the respective PTA 40 positions to be sent to the 41 parent/guardian-members for 42 their votes; 43

44 10.6.2.2.6 allot 10 to 20 minutes for the 45

parent/guardian-members to 46 cast their votes per position 47 either through text messaging 48 or phone call; 49

50 10.6.2.2.7 tally the votes received with 51

proper documentation; 52 53 54

10.6.2.2.8 repeat the process from 1 Sections 10.6.2.2.4 to 2 10.6.2.2.7 until all the 3 positions to be filled are 4 covered; and 5

announcing the newly elected 8 PTA officers. 9

10 10.6.2.3 In case of a tie as mentioned in Section 11

10.5.5, a toss coin shall be immediately 12 administered by the presiding officer, 13 complete with video recording. The 14 presiding officer, in the interest of fairness 15 and transparency of the proceedings, shall 16 perform the coin toss in such a manner that 17 the entire process is visible on camera. 18

19 10.6.3 Election through Hybrid Communication 20

21 A combination of physical (face-to-face) and remote 22 communication (online and/or offline) may be used 23 in the conduct of elections as may deem appropriate 24 or practicable under the circumstances of the PTA 25 members. 26

27 10.6.3.1 PTA members who cannot physically 28

attend the election may vote through 29 remote communication: Provided, that 30 he/she shall notify in advance the 31 presiding officer of his/her intention to 32 vote or attend through remote 33 communication. 34

35 10.6.3.2 In the conduct of physical election (face-to-36

face), the same rules as provided for under 37 Section 10.6.1 shall be observed. 38

39 10.6.3.3 In the conduct of election through remote 40

communication, the same rule as provided 41 under Section 10.6.2 shall be observed. 42

43 10.7 Election Protest. Any candidate of a certain position may file 44

a protest relating to the election and/or the qualifications 45 of the elected officer directly with the ELECOM according to 46 the following: 47

48 10.7.1 a candidate who intends to file a protest must first 49

take an oath before the ELECOM of his/her 50 intention to file an election-related protest within 51 sixty (60) minutes from the time that the elected 52 officers have been proclaimed. Failure to comply 53 within this period shall automatically forfeit the 54 candidate’s right to protest; 55

10.7.2 a formal protest in writing must be filed before the 1 ELECOM, duly supported by evidence, within 2 twenty-four (24) hours after taking an oath of 3 intention to file; and 4

5 10.7.3 the ELECOM shall conduct an investigation and 6

resolve the election protest within forty-eight (48) 7 hours from receipt thereof. The decision of ELECOM 8 shall be final, non-appealable, and executory. 9

10 Section 11. The SPTA Board of Directors (BOD) and its Executive 11

Committee (EXECOM) Officers 12 13

11.1 Roles of the SPTA BOD and its EXECOM. The administration 14 of the affairs and management of activities of the SPTA are 15 vested upon the BOD and its EXECOM, in accordance with 16 these guidelines and their by-laws, if there is any, as follows: 17

18 11.2 Composition of SPTA-BODs in Public Basic Education 19

Schools. The SPTA-BOD shall be composed of all GrPTA 20 Representatives, including teacher-representatives to be 21 elected from among the homeroom advisers: Provided that, 22 the SPTA-BOD shall be composed of two-thirds (2/3) 23 parent/guardian-members and one-third (1/3) teacher-24 members: Provided further, that the number of teacher-25 members shall not exceed one-third (1/3) of the total 26 number of SPTA-BOD members and shall not come from the 27 same grade level: Provided, finally, that depending on the 28 number of elected GrPTA Representatives, the total number 29 of SPTA-BOD members in every school shall be as follows: 30

31 11.2.1 Primary School (incomplete elementary school or up 32

to Grade 3 only) - five (5) members if Kindergarten 33 level is offered, or four (4) members if Kindergarten 34 level is not offered; 35

36 11.2.2 Elementary School (whether Kindergarten level is 37

offered or not) – nine (9) members; 38 39 11.2.3 Integrated School (Elementary to Junior High School 40

only - whether Kindergarten level is offered or not) – 41 fifteen (15) members; 42

43 11.2.4 Integrated School (Elementary to Senior High School 44

- whether Kindergarten level is offered or not) – 45 seventeen (17) members; 46

47 11.2.5 Junior High School only – six (6) members; and 48 49 11.2.6 Junior High School to Senior High School - nine (9) 50

members. 51 52 11.2.7 Standalone Senior High Schools - all HPTA 53

Presidents shall serve as SPTA-BOD members, plus 54 the appropriate number of teacher-representatives 55

whose number should be consistent with Section 1 11.2 hereof. 2

3 11.2.8 In case of schools not covered by the aforementioned 4

enumeration of the number of SPTA-BOD members 5 (e.g., multigrade schools or schools that offer an 6 incomplete number of grade levels), the requirement 7 that all GrPTA representatives, including the 8 appropriate number of teacher-representatives as 9 provided in Section 11.2 hereof, shall apply to 10 determine the composition of the SPTA-BOD. 11 12

11.2.9 The general rules and procedures for the election of 13 officers provided in Section 10 hereof, to the extent 14 applicable and/or not inconsistent with the rules 15 provided under this section, shall also apply to the 16 election of officers of the SPTA-BOD and EXECOM. 17

18 11.3 Composition of SPTA-BODs in Private and Non-DepEd-19

Managed Basic Education Schools. Private and non-DepEd-20 managed basic education schools may adopt a different 21 number of SPTA-BOD members in their school PTAs: 22 Provided that, the SPTA-BOD shall consist of two-thirds 23 (2/3) parent/guardian-members and one-third (1/3) 24 teacher-members: Provided further, that the proportion of 25 parent/guardian-members in the SPTA-BOD must always 26 exceed the proportion of teacher-members. 27

28 11.4 Terms of Office 29

30 11.4.1 The terms of office of the SPTA-BOD and its EXECOM 31

Officers shall be one (1) year from the date of election. 32 They shall hold office until a new set of officers has 33 been elected and qualified. 34

35 11.4.2 In no case shall an SPTA-BOD and its EXECOM 36

Officers serve for more than two (2) consecutive 37 terms. 38

39 11.4.3 In case of unforeseeable events (i.e., pandemic, 40

calamities, armed conflicts, and the like) where 41 conducting PTA election is not possible, the existing 42 officers shall continue to hold their respective offices 43 or positions until a new set of officers has been 44 elected and qualified. 45

46 11.5 Duties and Responsibilities of the SPTA-BOD 47

48 11.5.1 To adopt its own by-laws as it may be deemed 49

necessary, to provide additional guidelines on the 50 operation and organization of the School PTA: 51 Provided that, such by-laws are not inconsistent with 52 existing laws, these guidelines, and other relevant 53 DepEd issuances on the matter. 54

11.5.2 To oversee the activities of the HPTAs and the 1 GrPTAs. 2

3 11.5.3 To support the programs, projects, campaigns, and 4

advocacies on basic education. 5 6 11.5.4 To plan activities and create opportunities that will 7

support the teaching and learning improvement of 8 learners, teachers, and school personnel, consistent 9 with Articles VI and VII. 10

11 11.5.5 To keep the parent/guardian-members informed of 12

the changes in the school system and reporting the 13 planned and completed activities of the school 14 through posting in the school’s bulletin board, PTA’s 15 official social media accounts, and in learner 16 publications. 17

18 11.5.6 To maintain records of all PTA resolutions, its by-19

laws, and amendments, and contact information of 20 all the SPTA-BOD members and its EXECOM 21 officers. 22

23 11.5.7 To carry out its tasks in the assigned committees 24

with utmost integrity, honesty, and diligence. 25 26 11.5.8 To perform such other functions as may be required 27

in carrying out the purposes of the PTA. 28 29 11.5.9 The SPTA-BOD members shall perform the above-30

enumerated duties and responsibilities collegially to 31 promote the interest of the school. The individual 32 members of the SPTA-BOD, who are GrPTA 33 representatives, shall exercise functions that will 34 promote the interest of the grade level they represent. 35

36 11.6 Duties and Responsibilities of the EXECOM Officers of the 37

SPTA. The EXECOM Officers of the SPTA (President, Vice-38 President, Secretary, Treasurer, Auditor, Business Manager, 39 and other officers who may be specified in the by-laws) shall 40 manage the SPTA and perform such duties and 41 responsibilities as may be provided for in the by-laws, these 42 guidelines and DepEd policies, rules and regulations and as 43 later may be resolved by the SPTA-BOD. Without prejudice 44 to the formulation of by-laws by the PTAs, the general duties 45 and responsibilities of these officers shall be as follows: 46

47 11.6.1 President 48

49 11.6.1.1 Responsible for the development and 50

implementation of the policies, plans, and 51 programs of the BOD, including its affairs 52 and activities. 53

54 11.6.1.2 Lead the formulation and adoption of the 55

by-laws of the BOD. 56

1 11.6.1.3 Represent the BOD in school improvement 2

planning activities in coordination with 3 school officials concerned and in all its 4 official functions and activities. 5

6 11.6.1.4 Preside in all meetings of the PTA officers, 7

the BOD and the GA. 8 9 11.6.1.5 Sign vouchers, contracts, and other 10

documents, as may be authorized by the 11 BOD and/or the by-laws. 12

13 11.6.2 Vice-President - Performs the same duties as the 14

President, in the absence, incapacity, or as requested 15 by the President pending results of the election to be 16 called for the purpose pursuant to Section 11.8 17 hereof. 18

19 11.6.3 Secretary 20 21

11.6.3.1 Responsible for the arrangement of 22 meetings and activities of BOD, including 23 the dissemination of Notice of Meeting and 24 other announcements, and the 25 maintenance of the bulletin board at the 26 school head’s office or at the PTA’s 27 designated office space within the school 28 compound. 29

30 11.6.3.2 Take minutes of meetings consistent with 31

Section 13.1.5 hereof and take custody of 32 all documents, minutes of meetings, and 33 other records of the SPTA. 34

35 11.6.3.3 Maintain a registry of all elected PTA 36

officers consisting of, among others, the 37 following: full name, address, contact 38 numbers, and email address of PTA officer 39 concerned, and the name and grade level of 40 the learner/ward he/she represents. 41

42 11.6.3.4 Turn over all SPTA records of operations as 43

described in Sections 27.6.1.3 and 27.6.1.4 44 including the registry of elected PTA officers 45 and other pertinent documents as may be 46 directed by the President and/or the BOD. 47

48 11.6.4 Treasurer 49

50 11.6.4.1 Take charge of all collections on behalf of 51

the PTA, and issue corresponding receipts 52 for all such contributions in cash or in kind. 53

54 11.6.4.2 Maintain an up-to-date PTA logbook of 55

activities, properties, funds, accounts, and 56

financial transactions, including the 1 maintenance of an orderly record of 2 vouchers, bank-verified deposit and 3 withdrawal slips and BOD resolutions 4 authorizing fund disbursement. 5

6 11.6.4.3 Open a bank account with passbook on 7

behalf of the PTA as provided under Section 8 27.1 hereof. 9

10 11.6.4.4 Submit to the President and the BOD 11

reports on funds utilization duly certified by 12 the Auditor every two (2) months, or as may 13 be provided for in the by-laws of the PTA. 14

15 11.6.4.5 Turn over all cash and undeposited 16

collections, together with the logbook, 17 passbook and other financial records, 18 inventories, official receipts, and other 19 pertinent documents as may be directed by 20 the President and/or the BOD. 21

22 11.6.5 Auditor 23

24 11.6.5.1 Review the PTA logbook periodically to 25

ascertain the condition and status of the 26 PTA finances including the orderliness and 27 completeness of documents supporting 28 such transactions. 29

30 11.6.5.2 Submit a report to the President and the 31

BOD after the examination and validation 32 of the Treasurer’s report and provide 33 suggestions/recommendations as 34 appropriate. 35

36 11.6.6 Business Manager 37

38 11.6.6.1 Plan, recommend, and execute fundraising 39

projects. 40 41 11.6.6.2 Perform canvassing of materials and 42

supplies and other activities. 43 44 11.6.6.3 Coordinate and monitor supply chain 45

operations for the activities and provide 46 logistical support as may be required by the 47 PTA. 48

49 11.7 Basic Committees that may be Created. These guidelines 50

further authorize the creation of temporary or permanent 51 special committees, and govern the terms of office, 52 composition, powers, and responsibilities of the members 53 thereof. Such committees shall be as follows: 54

11.7.1 SPTA Grievance Committee (SPTA-GC) is hereby 1 created to address minor or less grave complaints, 2 conflicts or dispute against the PTA, the SPTA-BOD, 3 or any of their members pertaining to their official 4 functions. The SPTA-GC shall be composed of: (a) a 5 member of the SPTA-BOD designated by the school 6 head as Chairperson; and (b) two (2) SPTA members 7 of good standing in the school/community 8 recommended by the SPTA-BOD and accepted by the 9 school head. The SPTA-GC shall perform its duties 10 and responsibilities in accordance with Article VIII 11 hereof. 12

13 11.7.2 SPTA Disciplinary Committee (SPTA-DC) is hereby 14

created to address grave complaints, misconduct or 15 rule violation filed against the PTA, the SPTA-BOD, 16 or any of the officers and members pertaining to their 17 official functions. The SPTA-DC shall be composed 18 of: (a) a member of the SPTA-BOD designated by the 19 school head as Chairperson; and (b) two (2) SPTA 20 members of good standing in the school/community 21 recommended by the SPTA-BOD and accepted by the 22 school head. The SPTA-DC shall perform its duties 23 and responsibilities in accordance with Article VIII 24 hereof. 25

26 11.7.3 Other committees that SPTA-BOD may organize as it 27

sees fit, shall include the Committee on Finance, 28 Committee on Programs and Projects, Committee on 29 Audit, and the Committee on External and 30 Community Affairs. The SPTA-BOD is further 31 authorized to determine, among others, the terms of 32 office of the members thereof, as well as their 33 composition, powers, and responsibilities. 34

35 11.8 Grounds for Removal of an SPTA-BOD or its EXECOM 36

Officer 37 38

11.8.1 A SPTA-BOD or its EXECOM Officer shall be 39 automatically removed from office in the event of the 40 cancellation of recognition of SPTA or the transfer, 41 drop-out, expulsion, or death of his/her learner or 42 ward. 43

44 11.8.2 A SPTA-BOD or its EXECOM Officer shall also be 45

automatically removed from office upon the 46 imposition of the penalty of dismissal/expulsion in 47 relation to Section 32 hereof or conviction by final 48 judgement of an administrative or a criminal offense 49 involving moral turpitude. 50

51 11.8.3 Within one (1) week from the time an SPTA-BOD 52

member position is considered vacant resulting from 53 removal as provided under the preceding Sections 54 11.8.1 and 11.8.2, resignation, or death, the 55

alternate representative for the grade level concerned 1 shall assume the vacated position: Provided that, if 2 the vacancy occurs from among the teacher-3 representative to the SPTA-BOD, an election shall be 4 conducted from among the homeroom advisers to fill 5 this vacancy. Such new BOD member shall 6 immediately assume office and shall serve only for 7 the remaining unexpired portion of the term of office. 8

9 11.8.4 Within one (1) week from the time an SPTA-EXECOM 10

Officer position is considered vacant resulting from 11 removal as provided under the preceding Sections 12 11.8.1 and 11.8.2, resignation, or death, the vacancy 13 shall be filled first in accordance with the preceding 14 provision. Thereafter, an election shall be 15 immediately conducted among the SPTA-BOD 16 members to fill this vacancy. In case an officer 17 resigns from his/her SPTA-EXECOM duties, the 18 SPTA-BOD shall elect from among themselves the 19 replacement for the vacated position. 20

21 III. THE SPTA GENERAL ASSEMBLY (GA), MEETINGS, AND QUORUM 22

23 Section 12. The SPTA GA 24

25 12.1 The SPTA GA shall be the highest policy-making body of the 26

PTA and shall be the only body that provides equal 27 representation to all its members at the school level. Subject 28 to the rules on meetings and quorum as provided under this 29 section, the SPTA GA can adopt a resolution that will 30 advocate and provide general policy guidance to the SPTA-31 BOD and its EXECOM Officers. 32

33 12.1.1 The SPTA GA shall be a venue for presentation and 34

discussion of the PTA’s programs, projects, activities, 35 financial statements, reports, and other matters. 36

37 12.1.2 The first SPTA GA of each SY shall be convened by 38

the incumbent SPTA-BOD (from previous SY) prior to 39 the conduct of elections for the current SY. Such 40 SPTA GA meeting shall not be later than 30 days 41 from the date of school opening to discuss the 42 following matters: 43

44 13.1.3.1 report on physical, financial, and other 45

accomplishments of the SPTA-BOD of the 46 previous SY; 47

48 13.1.3.2 orientation on the election procedures, to 49

be conducted by the ELECOM, for the new 50 sets of officers of HPTA, GrPTA, and SPTA 51 as enumerated in Section 10.3.5 hereof; 52 and 53

54 13.1.3.3 other PTA- and school-related matters. 55

13.1.4 The SPTA-BOD elected for the current SY shall 1 convene the SPTA GA at least two (2) times a year. 2 Meeting can either be done physically (face-to-face) 3 or remotely in consideration of unforeseen 4 circumstances (e.g., pandemic, calamities, or 5 thereabouts). To maximize the attendance of the 6 parent/guardian-members, it is highly encouraged 7 that such SPTA GA meetings be called on the same 8 date and be held prior to the actual distribution of 9 Report Cards to the learners. 10

11 Section 13. Meetings 12

13 13.1 Organizing PTA Meetings 14

15 13.1.1 PTA meetings at all levels may be conducted through 16

physical (face-to-face), remote, or hybrid 17 communications. The PTA officers shall coordinate 18 with the homeroom adviser or school head with 19 respect to the time, venue, and other details/logistics 20 that may be required in the conduct of the meeting. 21 Subject to existing laws, rules, and regulations, the 22 homeroom adviser or the school head shall not 23 unreasonably withhold readily available resources, 24 logistics or facilities of the school pertinent to the 25 conduct of the PTA meetings. 26

27 13.1.2 The Notice of Meeting, regardless of form, should be 28

disseminated in a manner provided under Section 29 10.3.4 with complete details on date, time, venue, 30 preferred mode of communication, agenda, and 31 updates/agreement from previous meetings, as 32 applicable. 33

34 13.1.3 Members who cannot physically attend meetings but 35

have notified in advance the PTA President and the 36 PTA Secretary of his/her intention to participate 37 through remote communications may be 38 accommodated: Provided that, the members have the 39 capability and/or have satisfied the requirements to 40 participate in meetings by remote communication 41 under these guidelines or the SPTA’s by-laws. The 42 PTA Secretary shall take note of such fact in the 43 minutes of the meeting. 44

45 13.1.4 All SPTAs shall adopt its own rules on how PTA 46

members may participate in meetings by remote 47 communication. Such rules may be patterned after 48 Section 10.6.2 hereof on the participation of PTA 49 members in elections by remote communications. 50 PTA members shall have the burden of 51 meeting/satisfying the reasonable logistical 52 requirements or resources required, such as but not 53 limited to the following: 54

13.1.4.1 ensure stable access to internet 1 connectivity or telephone/mobile signal; 2

3 13.1.4.2 have provisions for load/credits to 4

appropriate mobile services; 5 6 13.1.4.3 download/secure the compatible video-7

conferencing platform being used by the 8 PTA; 9

10 13.1.4.4 be in a location that is free from any noise 11

or disturbances that may disrupt the 12 proceedings of the meeting; 13

14 13.1.4.5 have clear voice/audio by remote 15

communication; and 16 17 13.1.4.6 other requirements to ensure the smooth 18

conduct of meetings through remote 19 communication. 20

21 13.1.5 The meetings shall be documented through minutes 22

of meetings, attendance sheets, various 23 reports/handouts used, and pictures. 24

25 13.1.5.1 The minutes of all meetings of PTA 26

members, officers, or the SPTA-BOD shall 27 set forth in detail, among others: (i) the 28 time and place of the meeting; (ii) the 29 notice given; (iii) the agenda; (iv) the 30 communication modality whether the 31 meeting was physical, remote, or hybrid 32 communications; (v) those present noting 33 their time of entry and exit; (vi) those 34 absent; and (vii) every act done or ordered 35 at the meeting. 36

37 13.1.5.2 Upon the request of a PTA member, the 38

yeas and nays must be taken on any 39 motion or proposition, and a record 40 thereof carefully made. The protest of a 41 PTA member, officer, or SPTA-BOD on any 42 action or proposed action must be 43 recorded in full upon their request. 44

45 13.1.5.3 All minutes of PTA meetings must be duly 46

signed by the Secretary, approved by the 47 President and contents noted by the 48 homeroom adviser or the school head 49 within seven (7) calendar days from the 50 conduct of the meeting. The approved 51 minutes must be properly filed and kept in 52 accordance with Section 27.6 hereof. 53

13.2 Levels of PTA Meetings 1 2

13.2.1 HPTA Meetings. The HPTA meetings shall, among 3 others: 4

5 13.2.1.1 be a venue for the conduct of HPTA 6

elections, parent/guardian-members 7 orientation (school and homeroom policies, 8 HPTA rules and regulations, etc.), and 9 parent/guardian-members consultation 10 (discussion of activities, issues, and 11 concerns for the learners, teachers, and 12 school, etc.); 13

14 13.2.1.2 be attended by the homeroom adviser and 15

parent/guardian-members in a homeroom; 16 and 17

18 13.2.1.3 be conducted quarterly in simultaneous 19

with the distribution of Report Cards. 20 Special meetings may, however, be held as 21 often as necessary. 22

23 13.2.2 GrPTA Meetings. The GrPTA meetings which shall be 24

presided over by the GrPTA Representative shall: 25 26

13.2.2.1 be a venue for the conduct of GrPTA 27 elections, GrPTA-CoR orientation (GrPTA 28 rules and regulations, etc.), and GrPTA-CoR 29 and parent/guardian-members 30 consultation (discussion of activities, 31 issues, and concerns in the grade level for 32 the learners, teachers, and school, etc.); 33 and 34

35 13.2.2.2 be attended by the homeroom advisers, 36

GrPTA-CoR, and parent/guardian-37 members in a grade level. 38

39 13.2.3 SPTA Meetings. The SPTA-BOD and EXECOM 40

meetings may be held jointly or separately and shall 41 be presided over by the SPTA President: 42

43 13.2.3.1 at least once (1x) a month unless otherwise 44

provided in their by-laws. As it may be 45 deemed necessary, a special meeting may 46 be held upon the call of the SPTA President; 47

48 13.2.3.2 to address administrative, technical, and 49

logistical issues peculiar to the 50 school/community; and 51

52 13.2.3.3 to discuss ways and means to improve the 53

teaching and learning environment in the 54 school concerned, plan fundraising 55

projects, including strategies to support the 1 HPTAs and the GrPTAs. 2

3 Section 14. Quorum 4

5 14.1 A quorum shall be established before the start of any 6

meeting of the SPTA GA, HPTA, GrPTA, and SPTA-BOD and 7 EXECOM. For purposes of these guidelines, a quorum for 8 SPTA GA, HPTA, and GrPTA meetings shall consist of one-9 fourth (¼) of the total membership. For GrPTA-CoR and 10 SPTA-BOD and EXECOM meetings, a quorum shall consist 11 of a majority (50%+1) of the total membership to set a formal 12 meeting in motion and to pass a resolution by voting. 13

14 14.2 If a quorum is not met within 30 minutes from the official 15

start of the meeting, said meeting shall be adjourned. In 16 such a case, it shall be recorded that no meeting was 17 conducted due to the lack of a quorum. Nonetheless, the 18 SPTA GA, HPTA, GrPTA, and SPTA-BOD and EXECOM 19 present may constitute themselves as a consultative body for 20 the purpose of discussing PTA-related matters. 21

22 14.3 No resolution shall be proposed or voted upon unless there 23

is a quorum. 24 25 IV. THE FEDERATED PTA (FPTA) 26 27

Section 15. Organizing Federated PTAs 28 29

RA 7160 (Local Government Code of 1991) mandates the 30 organization of the LSB in municipal, city, and provincial levels 31 and to include, as representatives, the duly elected Presidents of 32 FPTAs from these levels. RA 7160 provides that the SEF of 33 municipalities, cities, and provinces shall be used to support 34 education activities at the localities, subject to the authority 35 provided for in DepEd-DBM-DILG Joint Circular (JC) No. 1, s. 36 2017 (Revised Guidelines on the Use of the SEF), as amended by 37 JC Nos. 1 and 2, s. 2020. To carry out these important mandates, 38 these guidelines provide for the federation of PTAs which shall be 39 observed by all public basic education schools every SY. 40

41 Section 16. Composition of Federated PTAs at the Municipality, City, 42

and Provincial Levels 43 44

16.1 Federated PTA (FPTA). Refers to the PTA organized in each 45 municipality, city, and province. 46

47 16.1.1 All duly elected PTA Presidents of public basic 48

education schools in the municipality or city shall 49 compose the Municipal or City FPTAs; and 50

51 16.1.2 All duly elected Presidents of the Municipal FPTA and 52

City FPTA, in case of component cities, shall compose 53 the Provincial FPTA. 54

16.2 The municipal, city, and provincial FPTAs may elect between 1 five (5) to fifteen (15) BOD members which shall be odd in 2 number, depending on the number of SPTA Presidents in the 3 municipality or city, or the number of municipal or 4 component city FPTA Presidents in the province. 5

6 16.3 The FPTA-BOD shall organize a set of officers which shall be 7

known as the FPTA-EXECOM and which shall comprise of: 8 President, Vice-President, Secretary, Treasurer, Business 9 Manager, Auditor, and other positions it may deem 10 necessary by a majority vote of those present during the 11 election. The EXECOM of the FPTA shall perform the duties 12 and responsibilities provided under Sections 11.6.1 to 13 11.6.6 hereof. 14

15 Section 17. Election of Officers of Federated PTAs 16

17 17.1 Election Timeline. The indicative dates of FPTA elections at 18

the municipal, city, and province shall be included in the 19 calendar of activities of the city and division offices 20 concerned each year. The timeline for the municipal or city 21 FPTA election of the BOD members and its EXECOM Officers 22 shall be within sixty (60) calendar days from the start of the 23 SY, while the election for the provincial FPTA-BOD members 24 and its EXECOM Officers shall be within seventy-five (75) 25 calendar days from the start of the SY. 26

27 17.2 Election Procedures. Elections of the FPTA shall be 28

facilitated by the Public Schools District Supervisor (PSDS) 29 designated by the Schools Division Superintendent (SDS) in 30 the case of municipalities, and the SDS in the case of cities 31 and provinces. They shall provide the venue and logistical 32 support, observe the election timeline, and shall not interfere 33 with the conduct of the elections. The FPTA elections shall 34 be conducted through physical (face-to-face), remote, or 35 hybrid communication following these procedures: 36

37 17.2.1 Every start of the meeting for the election of FPTA-38

BOD, the PTA Presidents present shall first organize 39 their ELECOM to oversee the conduct of elections. 40 The elections shall be by secret ballot, and no proxy 41 or absentee voting shall be allowed. 42

43 17.2.2 The FPTA-BOD shall elect, from among themselves, 44

officers, consistent with Sections 16.2 and 16.3 45 hereof, to be known as the FPTA-EXECOM Officers 46 of the municipality, city, or province. 47

48 17.2.3 The election of FPTA-BOD and its EXECOM Officers, 49

regardless of levels, shall follow the processes 50 described in Section 10.6 hereof. 51

52 17.2.4 After the election, the FPTA-BODs at the municipal, 53

city, or provincial levels shall inform the designated 54 PSDS or SDS through a resolution of the duly elected 55

FPTA-BOD and its EXECOM Officers. This resolution 1 shall be certified by the ELECOM. 2

3 17.2.5 Upon acceptance of the letter or resolution of the list 4

of duly elected FPTA-BOD members and EXECOM 5 Officers from the municipal, city, and provincial 6 levels, the PSDS or SDS shall officially transmit a 7 copy of the letter or resolution to the Municipal or 8 City Mayor or the Provincial Governor, for 9 information and records purposes. 10

11 Section 18. Duties and Responsibilities of a Federated PTA and Its Officers 12

13 18.1 Pursuant to RA 7160 (Local Government Code of 1991), the 14

duly elected FPTA Presidents from the municipality, city, and 15 provincial levels shall represent the FPTAs in their respective 16 LSBs. 17

18 18.2 The FPTAs shall conduct regular focus group discussions 19

with their respective constituents on matters that may be 20 discussed in the LSB. 21

22 18.3 Elected Presidents of the municipality, city, and provincial 23

FPTAs, in collaboration with the co-chairpersons of the LSBs 24 (i.e., PSDS and SDS), shall ensure that the SEF of the LGU 25 concerned is used to fund essential school requirements in 26 accordance with the provisions of DepEd-DBM-DILG JC No. 27 1, s. 2017, JC Nos. 1 and 2, s. 2020, and other relevant laws, 28 rules, and regulations on the use of SEF. 29

30 18.4 The FPTA shall: 31

32 18.4.1 help their respective schools to formulate and 33

implement programs and projects intended to 34 address the welfare and learning needs of the 35 learners; 36

37 18.4.2 represent the interest of PTA members and learners 38

in the agenda of LSB; 39 40 18.4.3 promote various advocacies, campaigns, and 41

programs and projects of DepEd and other 42 government agencies relating to learners’ welfare and 43 education; 44

45 18.4.4 conduct benchmarking activities on schools’ best 46

practices that may be adapted by other schools; 47 48 18.4.5 advocate for laws or policies that further the 49

education, physical and mental health, welfare, and 50 safety of learners and teachers; 51

52 18.4.6 promote the collaboration and engagement of 53

families, educators, non-government organizations, 54 private sector, and other stakeholders in the 55 education of the learners; and 56

1 18.4.7 ensure the prompt creation of the following 2

committees: 3 4

18.4.7.1 FPTA Grievance Committee (FPTA-GC) is 5 hereby created to address minor or less 6 grave complaints, conflicts or disputes 7 against the FPTA, the FPTA-BOD, or any of 8 their members pertaining to their official 9 functions. The FPTA-GC shall be composed 10 of: (a) a member of the FPTA-BOD 11 designated by the SDS (in case of municipal 12 FPTA) or the Regional Director [(RD) (in case 13 of city/provincial FPTA)] as Chairperson; 14 and (b) two (2) FPTA members of good 15 standing in the municipality/city/province 16 recommended by the FPTA-BOD and 17 accepted by the SDS (in case of municipal 18 FPTA) or the RD (in case of city/provincial 19 FPTA). The FPTA-GC shall perform its duties 20 and responsibilities in accordance with 21 Article VIII hereof. 22

23 18.4.7.2 FPTA Disciplinary Committee (FPTA-DC) is 24

hereby created to address grave complaints, 25 misconduct or rule violation filed against 26 the FPTA, the FPTA-BOD, or any of the 27 officers and members pertaining to their 28 official functions. The FPTA-DC shall be 29 composed of: (a) a member of the FPTA-BOD 30 designated by the SDS (in case of municipal 31 FPTA) or the RD (in case of city/provincial 32 FPTA) as Chairperson; and (b) two (2) FPTA 33 members of good standing in the 34 municipality/city/province recommended 35 by the FPTA-BOD and accepted by the SDS 36 (in case of municipal FPTA) or the RD (in 37 case of city/provincial FPTA). The FPTA-DC 38 shall perform its duties and responsibilities 39 in accordance with Article VIII hereof. 40

41 18.4.7.3 Other committees that FPTA-BOD may see 42

fit, such as the Committee on Finance, 43 Committee on Programs and Projects, 44 Committee on Audit, and the Committee on 45 External and Community Affairs. The FPTA-46 BOD is further authorized to determine, 47 among others, the terms of office of the 48 members thereof, as well as their 49 composition, powers, and responsibilities. 50

V. RECOGNIZING A SCHOOL PTA AND ITS PRIVILEGES 1 2

Section 19. Classification of School PTAs 3 4 19.1 All SPTAs to be organized for SY 2021-2022, for purposes of 5

these guidelines, shall be deemed officially recognized 6 SPTAs: Provided that, such PTAs belong to schools with a 7 validly organized SPTA for the last two (2) SYs prior to the 8 effectivity hereof. These officially recognized SPTAs shall 9 satisfy the requirements enumerated under Section 20 10 hereof to maintain its status as such: Provided that, if the 11 SPTA fails to satisfy said requirements to maintain its status 12 as an officially recognized SPTA for two (2) consecutive SYs, 13 said SPTA shall revert to the status of a non-officially 14 recognized SPTA. 15

16 19.2 An officially recognized SPTA is one which is organized 17

under these guidelines and has satisfied Sections 19.1 and 18 20 hereof. As such, it is allowed to collect VSCs and other 19 authorized contributions at any time of the SY subject to 20 Section 26.2 hereof and other laws, DepEd rules and 21 regulations on the collection of VSCs and shall enjoy the 22 privileges of an officially recognized SPTA as provided under 23 Section 23 hereof. 24

25 19.3 All newly organized SPTAs and/or schools without a validly 26

organized SPTAs for the last two (2) SYs prior to the 27 effectivity of these guidelines shall be considered as non-28 officially recognized SPTAs. 29

30 19.4 A non-officially recognized SPTA is one which is newly 31

created or organized SPTA under these guidelines and has 32 not yet satisfied Sections 19.1 and 20 hereof. Subject to the 33 limitations enumerated under Section 23.1.5.1 a non-34 officially recognized SPTA may still collect PTA membership 35 dues at any time of the SY and may enjoy the privileges of 36 an officially recognized SPTA, if allowed by the school head, 37 as provided under Section 23.2 hereof. 38

39 Section 20. Requirements for a School PTA to be Officially Recognized 40

41 20.1 This provision shall apply to all non-officially recognized 42

SPTAs as provided under Sections 19.3 and 19.4 hereof, and 43 to former officially recognized SPTAs that reverted to the 44 status of non-officially recognized SPTAs as provided under 45 Section 19.1 hereof. 46

47 This shall also apply in case of a school established after SY 48 2020-2021 and organizes an SPTA for the first time: Provided 49 that, the SPTA of such newly established school must satisfy 50 the requirements provided under Section 20.2 for two (2) 51 consecutive SYs for it to be considered as officially 52 recognized SPTA. 53

20.2 An SPTA, to be considered as an officially recognized SPTA 1 under this section, must satisfy the following requirements 2 by the end of a current SY: 3

4 20.2.1 election of all officers of HPTAs, GrPTAs, and SPTAs 5

as provided in Sections 7 and 10 hereof; 6 7 20.2.2 submission of the list of all duly elected officers of the 8

HPTAs, GrPTAs, SPTAs, and members of the BOD as 9 supported by their respective Oaths of Office; 10 11

20.2.3 the official name of the SPTA bearing the name of the 12 school (e.g., Parent-Teacher Association of Rizal High 13 School or Rizal High School Parent-Teacher 14 Association); 15

16 20.2.4 open a bank account and conduct its financial 17

businesses in accordance with Article VII hereof; 18 19 20.2.5 submission of SPTA calendar of activities; 20 21 20.2.6 must conduct at least two (2) GAs a year, which may 22

coincide with homeroom meetings or distribution of 23 Report Cards; 24

25 20.2.7 must actively participate in the school improvement 26

planning, Brigada Eskwela, Commencement/ 27 Graduation or Recognition/Moving-Up exercises, 28 among others; 29

30 20.2.8 hold at least two (2) school-wide PTA activities as 31

provided under Section 24, subject to DepEd policies 32 and guidelines; 33

34 20.2.9 implement at least one (1) priority project listed in 35

the SIP; and 36 37

20.2.10 submit the following documents within thirty (30) 38 days after the end of the SY: 39

40 20.2.10.1 Accomplishment Report – The Secretary 41

and the President shall submit the HPTA 42 accomplishment report to the homeroom 43 adviser for review and approval. Once 44 approved, the HPTA President shall submit 45 the same to the GrPTA Representative, 46 who shall then consolidate and endorse 47 the reports to the SPTA President. These 48 reports shall be further consolidated by the 49 SPTA Secretary and integrated into the 50 overall accomplishment report which the 51 President shall submit to the school head. 52

53 20.2.10.2 Report of Financial Operations – The 54

aforesaid Accomplishment Report shall be 55 supported by a Report of Financial 56

Operations of the HPTA and the SPTA. The 1 SPTA Treasurer, Auditor, and President 2 shall ensure the availability of the SPTA 3 logbook of activities and financial 4 transactions, including other financial 5 records for inspection by the school head 6 and/or the present Division PTA Affairs 7 Committee (created under DO 54, s. 2009) 8 any time. A Report of Financial Operations 9 duly signed by the SPTA President, 10 Treasurer, and Auditor shall be submitted 11 to the school head. Such financial 12 report/statement shall be reviewed by the 13 Division Accountant. 14

15 Section 21. Issuance of a Certificate of Recognition to SPTAs 16

17 21.1 School heads shall issue a Certificate of Recognition to all 18

SPTAs that satisfy the requirements provided under Sections 19 20.2 within thirty (30) days from the effectivity of these 20 guidelines. 21

22 21.2 For non-officially recognized SPTAs, as enumerated under 23

Sections 19.4 and 20.1, paragraph 1 and which have 24 complied with the requirements under Section 20.2 hereof, 25 the school head shall issue a Certificate of Recognition to the 26 SPTA within thirty (30) days from the beginning of the SY 27 immediately following the SY when the said requirements 28 were satisfied. 29

30 21.3 In case of newly established schools as stated under Section 31

20.1, paragraph 2, the school head shall issue the Certificate 32 of Recognition to the SPTA within thirty (30) days from the 33 beginning of the next SY after satisfaction of the 34 requirements under Section 20.2 hereof for two (2) 35 consecutive SYs. 36

37 Section 22. Incorporation with the Securities and Exchange Commission 38

(SEC), Not Required 39 40

An SPTA may or may not be incorporated with the Securities and 41 Exchange Commission (SEC). If incorporated, the registered entity 42 shall, as far as practicable, be used in the organization of the SPTA. 43

44 Section 23. Privileges of a Recognized PTA 45

46 23.1 The privileges of recognized SPTAs include, but not limited 47

to, the following: 48 49

23.1.1 construct a building or structure in accordance with 50 the SIP and undertake any permanent renovation or 51 improvement on building, structure, or fixture within 52 the school premises for its office or headquarters: 53 Provided that, it will be automatically considered as 54 a property of the school. A written agreement shall 55

be executed before the improvement or construction 1 takes place. A Deed of Donation shall also be 2 executed by and between the SPTA and the school 3 immediately after the completion of the improvement 4 or construction; 5

6 23.1.2 use of any available space within the school premises 7

as its office or headquarters: Provided that, costs 8 pertinent to electricity, water, and other utilities shall 9 be for the account of the SPTA, however, should the 10 school need such space, the SPTA shall vacate the 11 space immediately: Provided further, that the school 12 shall have an alternative space/location where they 13 can transfer; 14

15 23.1.3 represent the PTA members in the following: 16

17 23.1.3.1 School Governance Council (SGC); 18 19 23.1.3.2 Child Protection Committee; and 20 21 23.1.3.3 Oplan Kalusugan sa DepEd Technical 22

Working Group at the school level, and the 23 like. 24

25 23.1.4 access pertinent information about learners, 26

available in DepEd’s Unified Information Systems, in 27 aid of formulating activities and projects to improve 28 learning, subject to the provisions of RA 10173 (Data 29 Privacy Act of 2012) and the Freedom of Information 30 Executive Order; 31

32 23.1.5 undertake the following activities: 33

34 23.1.5.1 not more than four (4) fundraising activities 35

to support the school’s academic and co-36 curricular programs, projects, and 37 activities, including parent-initiated 38 seminars and capacity-building activities, 39 subject to DepEd policies and guidelines: 40 Provided that, the SPTA shall comply with 41 the “No Collection Policy” of the Department 42 (or purely voluntary). Non-officially 43 recognized SPTAs shall be limited to not 44 more than two (2) fundraising activities; 45

46 23.1.5.2 accept donations, whether cash or in kind 47

(e.g., school supplies, materials, and 48 equipment), from private sector or 49 stakeholders. In the case of a non-officially 50 recognized SPTA, acceptance of donations 51 shall be directly coursed through the 52 Adopt-a-School Program Coordinator or 53 school head; and 54

23.1.5.3 act as an observer in the school’s 1 procurement activities and participate in 2 the school’s Technical Inspection and 3 Acceptance Committee, subject to the 4 provision of RA 9184 (Government 5 Procurement Reform Act). 6

7 23.1.6 eligible to be elected as BOD of the Municipal or City 8

FPTA. 9 10

23.2 Except for the privilege accorded to an officially recognized 11 SPTA under Section 23.1.6, a non-officially recognized SPTA 12 may be allowed to exercise any of the above enumerated 13 privileges under Section 23, subject to the sound discretion 14 of the school head. 15

16 VI. ALLOWED AND PROHIBITED ACTIVITIES OF A PTA 17

18 Section 24. Allowed PTA Activities 19

20 24.1 A PTA is allowed to conduct activities that will directly 21

support the learners, teaching and non-teaching personnel, 22 school, other parents/guardians, and community. For 23 purposes of these guidelines, even non-officially recognized 24 SPTAs are allowed to do the activities enumerated under this 25 section. All PTA activities within the school premises or 26 which involve the school, its personnel or learners shall be 27 with prior consultation and approval of the school head. The 28 activities that may be conducted by a PTA shall be based on 29 the following: 30

31 24.2 Support to Learners 32

33 24.2.1 Purchase and/or donation of the following items: 34

35 24.2.1.1 supplementary learning resources, 36

textbooks, reference books, science 37 laboratory equipment, or related materials 38 for the classroom or school library; 39

40 24.2.1.2 school supplies for distribution to the 41

learners, such as bags, pencils, notebooks, 42 and other learning materials; 43

44 24.2.1.3 ICT-based intervention/support to the 45

teaching-learning process using 46 instructional technologies such as 47 electronic reader, desktop computers, 48 laptops, tablets, hardware and software, 49 internet connectivity, television, radios, 50 printers, and multimedia materials; and 51

52 24.2.1.4 necessities for the use of learners, such as 53

hygiene kits, footwear, and nutritional 54 supplements. 55

24.2.2 Organize activities or events including, but not 1 limited to: 2

3 24.2.2.1 academic enrichment activities like 4

Reading Programs, peer learning sessions, 5 informative talks, and other similar 6 activities; 7

8 24.2.2.2 learner support activities like outreach 9

programs, and advocacy campaigns in 10 radios, TVs, and print media, e.g., Brigada 11 Eskwela ads; and 12

13 24.2.2.3 organize seminars, webinars, and capacity-14

building activities to engage and empower 15 the parents/guardians to pursue lifelong 16 learning goals for themselves and their 17 learners, and to support teachers in their 18 continuing professional development. 19

20 24.2.3 Partner with the Supreme Student Government on 21

their programs, projects, and activities consistent 22 with existing laws, DepEd rules and regulations on 23 the matter. 24

25 24.3 Support to School Improvement 26

27 24.3.1 Participate in the preparation of the SIP and in the 28

review of School-Based Management (SBM) 29 practices; 30

31 24.3.2 Construct a building or structure and undertake any 32

permanent renovation or improvement on building, 33 structure, or fixture within school for teaching and 34 learning; 35

36 24.3.3 Purchase and/or donate items for school 37

improvement and maintenance, including but not 38 limited to: 39

40 24.3.3.1 equipment, furniture, and fixtures, and 41

appliances for classrooms and the school; 42 43 24.3.3.2 sports and recreational equipment for 44

school sports, learners’ play area, and the 45 like; 46

47 24.3.3.3 Water and Sanitation Hygiene (WASH) in 48

School (WinS) facilities, and the like; and 49 50 24.3.3.4 School safety components, such as gates, 51

barriers/walls, and school ground 52 revamping. 53

24.4 Support to Community Development 1 2

24.4.1 Organize activities or events that will: 3 4

24.4.1.1 promote community engagement such as 5 clean-up drives, tree planting, urban 6 farming, and other similar activities; 7 8

24.4.1.2 promote health and wellness such as 9 mental and physical health campaigns, and 10 advocacy campaigns on the prevention and 11 mitigation of infectious and communicable 12 diseases; 13

14 24.4.1.3 recognize the exceptional contributions of 15

learners, parents/guardians, and teachers 16 to the community; 17

18 24.4.1.4 keep the school community informed of 19

current events, reform initiatives, issues 20 and accomplishments by publishing and 21 distributing information fliers, newsletters, 22 reports, and the like; and 23

24 24.4.1.5 partner with the LGU, non-government 25

organizations, civil society organizations, 26 and the private sector in improving the 27 quality of basic education at the local level. 28

29 Section 25. Prohibited PTA Activities or Acts of PTA Officers 30

31 25.1 PTAs or PTA officers are prohibited from performing any or 32

all of the following: 33 34

25.1.1 interfering in the academic and administrative 35 management and operations of the school, and of the 36 DepEd, in general; 37

38 25.1.2 engaging in any partisan political activity within 39

school premises; 40 41 25.1.3 operating a canteen/school supplies store, or being 42

a concessionaire thereof inside the school or nearby 43 premises, or offering these services to the school as 44 its client either directly or indirectly; 45

46 25.1.4 selling insurance and/or pre-need plans and 47

recruiting in multilevel marketing or other similar 48 schemes/programs to learners and/or their 49 parent/guardian-members; 50

51 25.1.5 receiving any form of salaries, honoraria, 52

emoluments, or other forms of compensation 53 especially for PTA officers, BOD and EXECOM 54 members; 55

25.1.6 using the name of the school for unauthorized 1 solicitation of financial or other resources from 2 private donors or stakeholders; 3

4 25.1.7 charging any service fees against the amount 5

collected from VSCs; 6 7 25.1.8 calling upon learners and teachers for purposes of 8

investigation or disciplinary action; and 9 10 25.1.9 such other acts or circumstances analogous to the 11

foregoing. 12 13

25.2 Any violation of the provisions of this section shall be dealt 14 with corresponding sanctions as provided under Section 32 15 hereof. 16

17 VII. FINANCIAL MATTERS 18 19

Section 26. General Policies on Financial Transactions of Homeroom 20 and School PTAs 21

22 26.1 Consistent with existing laws, rules and regulations 23

implementing DepEd’s “No Collection Policy,” no school 24 shall collect VSCs except through the PTA: Provided that, 25 the collection of VSCs and performance of other financial 26 transactions shall only be allowed whenever they support 27 the programs and activities identified in the SIP and 28 provided further, that it shall be done in close coordination 29 with the homeroom adviser and/or the school head 30 concerned. 31

32 26.2 In carrying out such SIP programs and projects, the PTAs 33

may engage in fundraising activities, the collection of VSCs 34 for which shall be guided by the following policies: 35

36 26.2.1 For Kindergarten to Grade 4 learners: No VSCs 37

shall be collected from these learners anytime 38 during the SY, except for the VSCs authorized to be 39 collected pursuant to Section 26.2.3. 40

41 26.2.2 For Grades 5 to 12 learners: No VSCs shall be 42

collected from these learners during the enrollment 43 period, and on the first month of classes. The PTA 44 may collect VSCs from the learners beginning the 45 third (3rd) month of classes of the current SY. 46

47 26.2.3 The membership fees and other contributions that 48

DepEd authorizes to be collected as VSCs are 49 shown in Table 1. However, the collection of fees 50 shall be strictly on a voluntary basis. 51

52 26.2.4 Contributions may be collected beginning the third 53

(3rd) month of classes until the end of the SY, 54 considering the following: 55

26.2.4.3 the PTA membership fees shall be 12 collected only once from 13 parent/guardian-members, regardless of 14 the number of their learners in the school; 15

16 26.2.4.4 VSCs shall be collected by the PTA 17

Treasurer, or the duly authorized 18 representative as approved by the SPTA-19 BOD, who shall issue pre-numbered 20 receipts for every collection made. The 21 total amount collected each day will be 22 deposited to the PTA bank account 23 consistent with Section 27.3 hereof. The 24 total amount of deposit must tally with 25 the total amount reflected in the pre-26 numbered receipts; 27

28 26.2.4.5 no school personnel shall collect fees from 29

learners, nor shall they safekeep and/or 30 disburse such funds; 31

26.2.4.6 learner organizations may authorize the 1 PTAs to collect their VSCs for the 2 organizations’ programs, projects, or 3 activities. The amount collected by the 4 PTAs shall be remitted immediately to the 5 learner organizations concerned or the 6 school on the day it was collected. No 7 service fee shall be charged against any 8 learner organization by the PTAs; and 9

10 26.2.4.7 in no case shall non-payment of VSCs be 11

made as a basis for non-admission, non-12 promotion, or non-issuance of a Report 13 Card, Certificate of Good Moral Character, 14 and Clearance to a student by the school 15 concerned. 16

17 26.3 The rules provided under this section, including the 18

amounts that may be collected voluntarily, shall be subject 19 to changes or adjustments by subsequent DepEd 20 issuances on the matter. 21

22 Section 27. Financial Management and Reporting 23

24 27.1 All SPTAs, whether officially recognized or not, and FPTAs 25

must be required to open and maintain an “and/or” bank 26 account with a passbook, preferably a checking account, 27 in a reputable bank as determined by the SPTA/FPTA-28 EXECOM. It shall be opened in the name of the President, 29 Treasurer, and Auditor of the SPTA/FPTA in accordance 30 with the following provisions: 31

32 27.1.1 While the bank account shall be opened as an 33

“and/or” bank account, all account signatories 34 shall be required to sign all documents necessary 35 to open and maintain bank accounts and conduct 36 financial transactions including, but not limited to, 37 deposit/withdrawal slips, and checks, provided, 38 that in case the SPTA/FPTA is registered with the 39 SEC, the bank account shall be opened under the 40 name of the SPTA/FPTA as registered with the 41 SEC. 42

43 27.1.2 The “or” portion of the “and/or” nature of the bank 44

account shall only apply in the event of a PTA 45 officer-signatory’s removal from office or the 46 declaration of his/her position as vacant as 47 provided under Sections 11.4 and 11.8 hereof 48 respectively: Provided, that in such an event, the 49 remaining signatories shall immediately withdraw 50 all the money and close the bank account. The PTA 51 officer elected to occupy the position vacated by the 52 former PTA officer-signatory, together with the 53 concerned PTA officers designated by these 54

guidelines shall immediately open a new bank 1 account in accordance with Section 27.1 hereof. 2

3 27.2 If the PTA is unable to open its own bank account due to 4

justifiable reasons in accordance with the preceding 5 section, such PTA may still collect PTA membership fees 6 and other VSCs for its fundraising projects: Provided that, 7 such collections shall be recorded and kept in accordance 8 with Section 27.5 hereof. 9

10 27.3 Consistent with existing laws, rules and regulations 11

implementing DepEd’s “No Collection Policy,” no school 12 shall be allowed to collect VSCs except through the PTA. 13 Except for the PTA membership dues and other PTA-14 related VSCs, all collections by the PTA shall be remitted 15 to the school on the same day when such VSCs are 16 collected. Meanwhile, collections made for PTA-related 17 VSCs or fundraising projects shall be deposited on the day 18 they are collected, or if not possible to the next banking 19 day, to the PTA’s bank account if such PTA has a bank 20 account, or shall be physically turned over to the school 21 head for safekeeping until the PTA is able to open its own 22 bank account. The school head shall not commingle the 23 PTA funds turned over to them under this section with 24 their personal or school funds and shall keep the same in 25 a separate and secured place. 26

27 27.4 HPTAs and GrPTAs shall likewise be required to open their 28

own bank accounts if they engage in authorized 29 fundraising activities: Provided, that they shall comply with 30 all the requirements stated under Section 23.1.5.1 hereof. 31

32 27.5 PTAs shall maintain an official logbook to record all its 33

activities and financial transactions, whether in cash or in-34 kind. The estimated value of in-kind contributions must 35 also be recorded, and copies of supporting 36 receipts/documents must be properly kept on file. 37 38

27.6 Recordkeeping, Disbursement and Reporting 39 40 27.6.1 Subject to the provisions of RA 10173 (Data Privacy 41

Act of 2012) and the Executive Order on Freedom 42 of Information, the PTA shall maintain a complete 43 file of all documents pertaining to its operations 44 including, but not limited to, the following: 45

46 27.6.1.1 an official logbook for all its activities and 47

financial transactions; 48 49 27.6.1.2 pre-numbered receipts and invoices; 50 51 27.6.1.3 reports and other documents submitted 52

to the school head and/or the Division 53 PTA Affairs Committee; and 54

27.6.1.4 other important documents pertaining to 1 PTA operations which include, among 2 others: 3

4 27.6.1.4.1 Notices of Meetings, 5 6 27.6.1.4.2 Attendance Sheets, 7 8 27.6.1.4.3 Minutes of the meetings, and 9 10 27.6.1.4.4 Resolutions. 11

12 27.6.2 All PTA records must be kept secured or always 13

locked in the school premises and cannot be taken 14 out unless authorized by the majority vote of the 15 Officers of the PTA. The school head shall provide a 16 space or cabinet where the SPTA Secretary shall 17 organize all such records and documents properly. 18

19 27.6.3 All PTA collections shall be deposited to its 20

authorized account immediately or on the next 21 banking day, and a copy of the validated deposit 22 slip and the updated passbook must be returned to 23 the PTA cabinet for security. The PTA Treasurer 24 shall furnish a machine-validated slip indicating 25 the outstanding balance of the PTA account on a 26 monthly basis to the PTA officers and the school 27 head. 28

29 27.6.4 The opening and closing of bank accounts shall be 30

supported by appropriate resolutions adopted by a 31 majority vote of the SPTA/FPTA Board of Directors 32 members. When opening bank accounts, the 33 SPTA/FPTA resolution must properly identify the 34 new authorized signatories of the account. 35

36 27.6.5 Signing of checks or withdrawal slips involving an 37

amount of Ten Thousand Pesos (Php10,000.00) 38 and above shall be supported by appropriate 39 resolutions adopted by a majority vote of the 40 SPTA/FPTA Board of Directors: Provided that, if the 41 amount involved is below Ten Thousand Pesos 42 (Php10,000.00) it shall be supported by 43 appropriate resolutions adopted by a majority vote 44 of the SPTA/FPTA Executive Committee officers. All 45 resolutions covering the financial transactions 46 relative to the bank account must indicate the 47 purpose/s for which such transaction/s must be 48 incurred. 49

50 27.6.6 No cash advances shall be allowed without a PTA 51

resolution and a fully accomplished petty cash 52 voucher: Provided that, liquidation of previous cash 53 advances of concerned PTA officials, if there is any, 54 have been settled. 55

27.6.7 A Report on the Physical and Financial Status of 1 the PTA Operations duly signed by its officers shall 2 be submitted on a quarterly and yearly basis, and 3 to be submitted as follows: 4

5 27.6.7.1 For HPTA - to the homeroom adviser, copy 6

furnished the school head; 7 8 27.6.7.2 For SPTA – to the school head, copy 9

furnished the Schools Division Office 10 concerned; and 11

12 27.6.7.3 For FPTAs at the municipality, city, and 13

provincial levels – to the Schools Division 14 Office concerned. 15

16 27.6.8 In case of Financial Status Reports, the PTA 17

EXECOM Officers must always attach a copy of the 18 updated passbook, updated machine-validated 19 outstanding balance for the reference month, a 20 listing of all resolutions passed, and a summary of 21 all petty cash vouchers and collection receipts 22 issued for the period being reported. 23

24 Section 28. Transparency and Accountability 25

26 28.1 To ensure transparency and accountability, all PTA records, 27

regardless of the form in which they are stored, shall be 28 open to inspection by any PTA member at reasonable hours 29 on school days, and a demand in writing may be made by 30 such PTA members at their expense, for copies of such 31 records or excerpts from said records: Provided that, if the 32 request involves personal, sensitive personal or privileged 33 information, PTA may grant or deny such request consistent 34 with the provisions of RA 10173 (Data Privacy Act of 2012). 35

36 28.2 PTAs are required to install a PTA bulletin board outside of 37

its office and create a PTA social media platform account 38 where announcements, approved resolutions, financial 39 statements, financial and accomplishment reports, and 40 other required reports, shall be posted. In the case of the 41 PTA bank account, this information must be communicated 42 in writing to the school head concerned. 43

44 Section 29. Turnover of PTA Records, Activities, and Funds 45

46 29.1 At the end of the SY, all PTA documents, records, 47

passbooks, and the official logbook of activities and other 48 resources must be properly accounted for and turned over 49 to the school head. In the event that there are undeposited 50 collections of the PTA consisting of VSCs collected on behalf 51 of the school and VSCs collected for the PTA’s fundraising 52 projects, notwithstanding the requirements provided under 53 Section 27.3 hereof, such undeposited collections shall also 54 be turned over to the school head who shall ensure the 55

deposit of the same to the PTA bank account the next 1 banking day. The turnover shall be done in a meeting solely 2 called for the purpose. The school head shall acknowledge 3 receipt in writing of all resources being turned over by the 4 previous PTA, safekeep and protect them until a new set of 5 PTA officers is elected and qualified. 6

7 29.2 If the PTA engages in an activity during the school break 8

(e.g., Brigada Eskwela), the PTA officers must pass a 9 resolution to be able to make use of the PTA funds as 10 reflected in the passbook, the logbook, and other records. 11 Such resources accessed by the PTA officers from the 12 homeroom adviser and/or school head shall be returned 13 immediately with a complete report on the activity 14 implemented and supported by all available receipts and 15 vouchers. 16

17 29.3 Consistent with Sections 10.5.16 and 29.1 hereof, the 18

school head at the opening of the new SY, shall turn over 19 the passbook, logbook, PTA records, documents and other 20 resources to the newly elected PTA officers of the current SY 21 in the presence of the outgoing PTA officers. 22

23 29.4 If the school head transfers, resigns, retires, or is separated 24

from the school, all the above enumerated PTA resources 25 shall be turned over to the newly designated school head. 26

27 VIII. CONFLICTS/DISPUTE RESOLUTION, DISCIPLINARY PROCEEDINGS 28

AND SANCTIONS 29 30

Section 30. Grievance Proceedings 31 32

30.1 In relation to Sections 11.7.1 and 18.4.7.1 hereof, 33 complaints and grievances arising between and among 34 members and/or officers of the PTA shall be disposed of in 35 accordance with these guidelines. Such complaints may 36 include, but not limited to, the following: 37

38 30.1.1 improper implementation of PTA policies and 39

procedures; 40 41 30.1.2 unfair treatment of one officer/member of another 42

officer/member; 43 44 30.1.3 disagreements or conflicts arising from poor 45

interpersonal relationships; and 46 47 30.1.4 all other matters or actions of PTA 48

members/officers giving rise to dissatisfaction and 49 discontentment of other PTA members/officers. 50

51 30.2 The grievance mechanism shall proceed in this manner: 52

53 30.2.1 Discussion with PTA President. At the first 54

instance, the aggrieved party shall present his/her 55

grievance orally or in writing to his/her PTA 1 President, who shall, within three (3) days from the 2 date of presentation, inform the concerned party 3 orally of his or her decision. Provided however, that 4 where the object of the grievance is/are PTA 5 officer/s, the aggrieved party may bring the 6 grievance to the SPTA/FPTA-GC. 7

8 30.2.2 In the oral discussion, the following shall be 9

observed: 10 11

30.2.2.1 The aggrieved party shall be put at ease 12 during the oral discussion. 13

14 30.2.2.2 The aggrieved party shall be encouraged 15

to talk and narrate or explain his/her side 16 during the oral discussion. 17

18 30.2.2.3 The case shall be heard fully, with the PTA 19

President keeping his/her views and 20 opinions entirely to himself/herself until 21 after the party has explained his/her side 22 during the oral discussion. A definite 23 decision shall be reached by the PTA 24 President based on the merits of the 25 grievance within three (3) days from the 26 presentation thereof. 27

28 30.3 In case the object of the grievance is a member of the 29

SPTA/FPTA-GC, the aggrieved party may submit the 30 grievance to the SDS (in case of SPTA-GC) or the RD (in 31 case of FPTA-GC) which shall proceed in a manner similar 32 to Section 30.2 hereof. 33

34 30.4 The SPTA/FPTA-GC shall recommend the case to the 35

SPTA/FPTA-DC if it involves matters falling under the 36 jurisdiction of the latter as provided under Section 31.1 37 hereof. 38

39 30.5 Appeal to the SPTA/FPTA-GC. If the aggrieved party is not 40

satisfied with the decision of the PTA President in relation 41 to Section 30.2 hereof, he/she may file an appeal with the 42 SPTA/FPTA-GC. The SPTA/FPTA, if it finds the appeal 43 meritorious, may conduct an investigation and hearing 44 within seven (7) calendar days from receipt thereof and 45 render a decision within forty-eight (48) hours after the 46 investigation. 47

48 30.6 Appeal to the Schools Division Superintendent/Regional 49

Director. If the aggrieved party is not satisfied with the 50 SPTA/FPTA-GC decision, he or she may submit an appeal 51 in writing, within (7) calendar days from the receipt of such 52 decision to the SDS (in case of SPTA-GC) or the RD (in case 53 of FPTA-GC) who shall immediately act on the matter 54 within forty-eight (48) hours from receipt of the appeal. 55

Section 31. Disciplinary Proceedings 1 2

31.1 The following complaints against members and/or officers 3 of the PTA shall be disposed of in accordance with this 4 section which may include, but not limited to, the 5 following: 6

7 31.1.1 simple neglect of duties and responsibilities; 8 9 31.1.2 simple misconduct; 10 11 31.1.3 directly or indirectly requesting or receiving any gift 12

or benefit involving an amount less than Five 13 Thousand Pesos (Php5,000.00) for himself/herself, 14 in connection with any PTA contract or transaction 15 between the school/SPTA/FPTA and any other 16 party, wherein the PTA officer in his/her official 17 capacity has to intervene; 18

19 31.1.4 discourtesy in the discharge of official duties of PTA 20

officers; 21 22 31.1.5 lobbying for personal interest or gain; 23 24 31.1.6 insubordination; 25 26

31.1.7 commission of an offense that is equivalent to a 27 violation of a special law involving a fine amounting 28 to not more than Forty Thousand Pesos 29 (Php40,000.00); 30

31 31.1.8 other minor or less grave offenses stipulated in 32

their by-laws; 33 34 31.1.9 abuse or misuse of power and authority; 35

36 31.1.10 misappropriation of PTA funds; 37 38 31.1.11 directly or indirectly requesting or receiving any 39

gift or benefit involving an amount not less than 40 Five Thousand Pesos (Php5,000.00) for 41 himself/herself, in connection with any PTA 42 contract or transaction between the 43 school/SPTA/FPTA and any other party, wherein 44 the PTA officer in his/her official capacity has to 45 intervene; 46

47 31.1.12 malicious attacks against the organization, and its 48

officers and members; 49 50 31.1.13 willful violation of the by-laws or rules, 51

regulations, measures, resolutions, and decisions 52 of the PTA; 53

54 31.1.14 falsification of documents; 55 56

31.1.15 gross immoral conduct; 1 2 31.1.16 gross neglect of duties and responsibilities; 3 4 31.1.17 five (5) successive unexcused absences in regular 5

PTA meetings and/or school/PTA-initiated 6 events/projects/activities; 7

8 31.1.18 commission of an offense that is equivalent to a 9

violation of the Revised Penal Code or special laws 10 involving a penalty of imprisonment and/or fine 11 amounting to more than Forty Thousand Pesos 12 (Php40,000.00); and 13

14 31.1.19 other major or grave offenses stipulated in their 15

by-laws. 16 17

31.2 In relation to Sections 11.7.2 and 18.4.7.2 hereof, the 18 SPTA/FPTA Disciplinary Committee (SPTA/FPTA-DC) 19 shall, motu proprio or upon a complaint filed/made by any 20 parent/guardian/learner/teacher/PTA officer against any 21 PTA member/officer, and after due notice and hearing, 22 resolve the complaint, and recommend the imposition of 23 the appropriate sanction/s as provided under Section 32 24 hereof, to the defendant-PTA member/officer, if warranted. 25 The SPTA/FPTA-DC may take cognizance of anonymous 26 complaints if supported by actual and verifiable 27 documentary, testimonial, real, demonstrative, and/or 28 electronic evidence. The SPTA/FPTA-DC shall recommend 29 the case to the SPTA/FPTA-GC if it involves matters falling 30 under the jurisdiction of the latter as provided under 31 Section 30.1 hereof. 32

33 31.3 The SPTA/FPTA-DC shall have sixty (60) calendar days 34

from receipt of a complaint to resolve such complaint and 35 submit a recommendation to the SPTA/FPTA-BOD. The 36 SPTA/FPTA-BOD shall have sixty (60) calendar days from 37 receipt of the recommendation of the SPTA/FPTA-DC to 38 either ratify or reverse the same by a vote of two-thirds 39 (2/3) of its members in a meeting called for the purpose. If 40 the SPTA/FPTA-BOD member is the defendant, he/she 41 must inhibit from participating in the meeting. 42

43 31.4 In cases involving SPTA officers/members in relation to 44

Section 31.1 hereof, the school head may also motu proprio 45 investigate PTA-related conflicts/disputes, which shall 46 then be endorsed to the SPTA-BOD for resolution in the 47 manner provided in the preceding section. If such 48 conflicts/disputes involve the SPTA-BOD or EXECOM 49 Officer, the same shall be endorsed to the SDS for 50 resolution. 51

52 31.5 In cases involving FPTA officers/members in relation to 53

Section 31.1 hereof, the SDS may also motu proprio 54 investigate PTA-related conflicts/disputes, which shall 55

then be endorsed to the FPTA-BOD for resolution in the 1 manner provided in the preceding section. If such 2 conflicts/disputes involve the FPTA-BOD or EXECOM 3 Officer, the same shall be endorsed to the RD for 4 resolution. 5

6 31.6 If such complaint is not resolved by the SPTA/FPTA-DC or 7

SPTA/FPTA-BOD within the period provided under Section 8 31.3 for whatever reason, the SPTA/FPTA-DC or 9 SPTA/FPTA-BOD shall automatically elevate the complaint 10 to the SDS/RD, for appropriate action. The SDS/RD shall 11 resolve the case within sixty (60) calendar days from 12 receipt of the same. 13

14 31.7 With respect to the concurrent jurisdiction of SPTA-DC and 15

the school head, and FPTA-DC and SDS to commence a 16 motu proprio complaint as provided under Sections 31.2, 17 31.4, and 31.5 hereof, the exercise of one disciplining 18 authority over the case shall exclude the other disciplining 19 authority with concurrent jurisdiction from taking 20 cognizance of any case similar or related thereto. 21

22 Section 32. Sanctions 23

24 32.1 The following sanctions may be imposed by the proper 25

disciplining authority in connection with any violation that 26 may be committed by SPTA/FPTA members or officers: 27

28 32.1.1 Written reprimand to suspension of rights for a 29

maximum period of six (6) months shall be imposed 30 for committing any of the violations enumerated 31 from Sections 31.1.1 to 31.1.8 hereof. 32

33 32.1.2 Suspension of rights for a period of more than six 34

(6) months to dismissal/expulsion from office in the 35 case of a PTA officer, shall be imposed for 36 committing any of the violations enumerated from 37 Sections 31.1.9 to 31.1.19 hereof. 38

39 32.2 The sanctions that may be imposed upon an erring 40

SPTA/FPTA member/officer under these guidelines shall 41 only be applicable to parent/guardian-members. DepEd 42 Order 49, s. 2006 (Revised Rules of Procedures of the 43 Department of Education in Administrative Cases) shall be 44 applied in case of disciplinary actions against teacher-45 members. 46

47 32.3 Cancellation of Official Recognition of an SPTA 48

49 32.3.1 Upon the recommendation of the school head, the 50

Division PTA Affairs Committee shall cancel the 51 recognition of the SPTA on the following grounds: 52 53

32.3.1.1 commission of any of the prohibited acts 54 under Section 25 and violation of any of 55

the general policies on financial 1 transactions under Section 26 hereof, 2 without prejudice to the filing of 3 appropriate charge/s before any 4 court/tribunal; and 5

6 32.3.1.2 failure to submit an Accomplishment 7

Report and/or a Report of Financial 8 Operations. 9

10 32.4 Criminal, civil and/or administrative actions may be filed 11

against any SPTA-BOD officers/members who is 12 responsible for any action on the above grounds. 13 Commission of any violation listed above shall disqualify a 14 parent/guardian-member from any SPTA office or position 15 in the next SY. 16

17 32.5 If the SPTA recognition is cancelled, the alternate GrPTA 18

representatives (as mentioned in Section 7.2, hereof) shall 19 automatically replace the SPTA-BOD. The school head 20 shall immediately convene the ELECOM pursuant to 21 Section 10.5.9 which shall then call for a special election 22 for the new set of SPTA-EXECOM Officers. 23

24 IX. PROGRESS MONITORING OF A SCHOOL PTA 25 26

Section 33. The School Head 27 28

33.1 Ensure that PTA activities are aligned with the SIP. 29 30 33.2 Conduct regular inspection of the books of accounts and 31

other financial records of the PTA. 32 33 33.3 Issue Certificates of Acceptance to private donors of in-kind 34

donations to the school. 35 36 33.4 Submit periodic reports to the Division PTA Coordinator. 37

38 Section 34. The Division PTA Affairs Committee 39

40 34.1 Composition. The present Division PTA Affairs Committee 41

created under DO 54, s. 2009 shall continue to function as 42 such in addition to whatever additional duties and 43 responsibilities that may be provided under these guidelines. 44 It shall consist of the following: 45

9 34.2 The Division PTA Affairs Committee, through the Division PTA 10

Coordinator, shall strictly monitor the activities of the PTAs 11 and their compliance with reports and other requirements, 12 and settle disputes and matters that may be submitted to it 13 for resolution. 14

15 34.3 The Division PTA Affairs Committee shall submit the 16

validated and consolidated PTA Monitoring Report (Annex 1) 17 to the designated Regional PTA Coordinator. 18

19 Section 35. The Regional/Division PTA Coordinator 20

21 35.1 The Chief of the Education Support Services Division (ESSD) 22

at the Regional Office shall be designated as the Regional PTA 23 Coordinator. The Division Education Supervisor (In-Charge of 24 PTA) shall serve concurrently as the Division PTA 25 Coordinator. The Regional/Division PTA Coordinator shall: 26

27 35.1.1 oversee PTA school governance, operations, and 28

affairs; 29 30 35.1.2 consolidate and facilitate the resolution of PTA issues 31

and concerns; 32 33 35.1.3 transmit to concerned DepEd Central Office unit/s 34

certain unresolved issues for appropriate action; and 35 36

35.1.4 prepare and submit the consolidated PTA Monitoring 37 Report Form quarterly to the concerned DepEd 38 Central Office Unit on PTA-related matters. 39

40 35.2 All Regional and Division PTA Coordinators are required and 41

authorized to conduct annual PTA Coordinators conference 42 in the regional and division levels, to review/evaluate and 43 learn from PTA coordination experience, with the end in view 44 of enabling or strengthening coordination at the division and 45 regional levels on PTA-related policies and decisions. 46 47

Section 36. The DepEd Central Offices In-Charge of PTA-Related Activities 48 49

The Offices of the Undersecretary for Field Operations, Palarong 50 Pambansa Secretariat, and DEACO, and the Undersecretary for 51 Legislative Affairs, External Partnerships and Project Management 52 Service shall, among others, oversee the operations of PTAs, 53 monitor, and consolidate PTA-related reports to serve as inputs in 54

PTA policy review/reformulation and enhance the role of PTAs as 1 an effective and efficient partner in educational development. 2

3 X. TRANSITORY PROVISIONS 4

5 Section 37. PTA Officers in a Hold-Over Capacity from the Previous SY to 6

the Succeeding SY 7 8

Existing officers of recognized SPTAs and FPTAs duly elected in SY 9 2019-2020, to the extent applicable, may be allowed to stay and 10 serve in a hold-over the capacity in SY 2020-2021 due to the 11 present COVID situation. Their tenure shall continue until a new 12 set of PTA officers shall have been elected and qualified. 13 14

Section 38. Election of New PTA Officers for SY 2021-2022 15 16

The election of new PTA officers for SY 2021-2022 shall be 17 governed by these guidelines. However, given the continuing 18 challenges posed by COVID-19 and the actual date of effectivity 19 of these guidelines, all schools are given until December 31, 2021 20 to carry out such election and other SPTA and FPTA-mandated 21 activities, including, but not limited to the: 22

23 38.1 election of HPTA, GrPTA, SPTA-EXECOM, and FPTA-24

EXECOM officers; 25 26

38.2 submission of accomplishment and financial reports; 27 28

38.3 turnover of all records and documents from the current 29 SPTA/FPTA officers to the incoming SPTA/FPTA officers; 30

31 38.4 conduct of school General Assembly (GA); and 32

33 38.5 all other duties, responsibilities, and SPTA/FPTA related 34

activities required to be complied with under these 35 guidelines but provide for an earlier deadline or period 36 within which to satisfy. 37

38 XI. MISCELLANEOUS PROVISIONS 39

40 Section 39. Adoption of PTA By-laws 41

42 The PTA may adopt its own by-laws: Provided that, such by-laws 43 are not inconsistent with existing laws, these guidelines and other 44 DepEd rules and regulations. If the PTA has existing by-laws prior 45 to the issuance of these guidelines, it is given one (1) SY to amend 46 its by-laws to conform with these guidelines. 47

48 Section 40. School Performance 49

50 The organization and active functioning of a recognized SPTA 51 shall be among the important linkages that the school head must 52 maintain to improve the school performance. 53 54 55

Section 41. Applicability of these Guidelines to Private and Non-DepEd- 1 Managed Basic Education Schools 2

3 41.1 Sections 5.1, 5.4, 5.11, 8.1, 8.2, 11.2, 11.3, and 37 of these 4

guidelines shall be applicable to the operations and 5 management of PTAs in all private and non-DepEd-6 managed basic education schools. Except for said 7 provisions, such schools shall have the option to adopt the 8 other provisions of these guidelines or promulgate their own 9 rules and regulations consistent with existing laws, DepEd 10 issuances, and policies. 11

12 41.2 Subject to the preceding section, the current PTA rules of 13

all private and non-DepEd-managed basic education 14 schools shall remain effective. 15

16 41.3 All private and non-DepEd-managed basic education 17

schools shall allow participation in meetings and election by 18 PTA members/officers through remote communication. 19 Unless already covered by their current rules or until such 20 schools have promulgated their own rules on the conduct of 21 PTA elections and meetings through remote 22 communication, Sections 10.6.2 and 13 hereof shall also 23 apply to all private and non-DepEd-managed basic 24 education schools. 25

26 41.4 The DepEd Regional Office concerned shall have original 27

jurisdiction to resolve all PTA issues and disputes in private 28 and non-DepEd-managed basic education schools. 29

30 41.5 Except as provided under Section 41.1, PTAs in private and 31

non-DepEd-managed basic education schools shall be 32 governed primarily by the rules and regulations they 33 formulated, and these guidelines shall suppletorily apply. In 34 the absence of such rules, the provisions of these guidelines 35 and other DepEd issuances shall govern. 36

37 Section 42. Suppletory Application of Some Rules 38 39

In relation to Sections 30 and 31 hereof, the Revised Rules of 40 Court, Revised Rules on Administrative Cases in the Civil Service 41 (RRACCS), and Revised Rules of Procedure of the Department of 42 Education in Administrative Cases (DepEd Order 49, s. 2006). 43

44 Section 43. Separability Clause 45

46 If for any reason, any portion or provision of these guidelines is 47 declared unconstitutional, the remaining provisions shall not be 48 affected thereby and shall continue to be in full force and effect. 49

50 Section 44. Repealing Clause 51

52 All prior issuances, rules, and regulations inconsistent with these 53 guidelines are hereby repealed, rescinded, or modified 54 accordingly. 55
